The Royal Netherlands Embassy presents its compliments to the Ministry of Foreign Affairs of the Republic of Kenya and has the honour to refer to the Extradition Treaty between the Kingdom of the Netherlands and the United Kingdom of Great Britain and Ireland, signed in London on 26th September, 1898, which Treaty was extended inter alia, to the territory of Kenya before the attainment of its independence, pursuant to a Treaty signed between the aforesaid parties at the Hague on 17th August, 1914.

The Embassy has been instructed by the Government of the Kingdom of the Netherlands to propose to the Government of the Republic of Kenya that the relations between the two States shall, in conformity with their national legislation and pending the conclusion of a new extradition treaty between them, be governed by the provisions of the above-mentioned Treaty of 26 September 1898, it being understood that the provisions of paragraph 2 of Article XVIII of the said Treaty are not longer applicable.

If this proposal is acceptable to the Government of the Republic of Kenya, the Embassy has the honour further to propose that this Note and the Ministry's reply, if it is in the affirmative, shall constitute an agreement between the two Governments on this subject, which agreement shall apply, as regards the Kingdom of the Netherlands, to the territory of the Kingdom in Europe and to Surinam and shall enter into force on the date on which the Government of the Kingdom of the Netherlands notifies the Government of the Republic of Kenya that the formalities constitutionally required in the Kingdom of the Netherlands have been complied with.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Kenya the assurances of its highest consideration.

KONINKLIJKE NEDERLANDSE AMBASSADE

De Koninklijke Nederlandse Ambassade biedt het Ministerie van Buitenlandse Zaken van de Republiek Kenia haar complimenten aan en heeft de eer te verwijzen naar het op 26 september 1898 te Londen ondertekende Uitleveringsverdrag tussen het Koninkrijk der Nederlanden en het Verenigd Koninkrijk van Groot-Brittannië en Ierland, welk Verdrag ingevolge een op 17 augustus 1914 te 's-Gravenhage voor bovengenoemde partijen ondertekend Verdrag onder meer tot het gebied van Kenia was uitgebreid voordat dit de onafhankelijkheid verwierf.

De Ambassade is door de Regering van het Koninkrijk der Nederlanden opgedragen, aan de Regering van de Republiek Kenia voor te stellen, dat de betrekkingen tussen de twee Staten, in overeenstemming met hun nationale wetgeving en in afwachting van de sluiting tussen hen van een nieuw uitleveringsverdrag, door de bepalingen van voormeld Verdrag van 26 september 1898 zullen worden beheerst, waarbij wel te verstaan is dat de bepalingen van lid 2 van artikel XVIII van genoemd Verdrag niet langer van toepassing zijn.

Indien dit voorstel voor de Regering van de Republiek Kenia aanvaardbaar is, heeft de Ambassade de eer verder voor te stellen, dat deze Nota en het bevestigend antwoord daarop van het Ministerie een overeenkomst ter zake tussen de twee Regeringen vormen, welke overeenkomst, wat het Koninkrijk der Nederlanden betreft, van toepassing zal zijn op het in Europa gelegen grondgebied van het Koninkrijk en op Suriname en in werking zal treden op de datum waarop de Regering van het Koninkrijk der Nederlanden de Regering van de Republiek Kenia er van in kennis stelt, dat aan de in het Koninkrijk der Nederlanden grondwettelijk vereiste formaliteiten is voldaan.

De Koninklijke Nederlandse Ambassade moge van deze gelegenheid gebruik maken om de verzekering harer zeer bijzondere hoogachting jegens het Ministerie van Buitenlandse Zaken van de Republiek Kenia te hernieuwen.

Het Ministerie van Buitenlandse Zaken van de Republiek Kenia biedt aan de Koninklijke Nederlandse Ambassade zijn complimenten aan en heeft de eer te verwijzen naar de Nota van de Ambassade van 10 november 1967, nr. 5352, welke in haar materiële delen als volgt luidt:

Het is het Ministerie een genoegen te bevestigen, dat het voorstel, vervat in bovengenoemde Nota van de Ambassade, voor de Regering van Kenia aanvaardbaar is.

Het Ministerie van Buitenlandse Zaken van de Republiek Kenia moge van deze gelegenheid gebruik maken om de verzekering zijner zeer bijzondere hoogachting jegens de Koninklijke Nederlandse Ambassade te hernieuwen.
