Protocol relating to Intervention on the High Seas in Cases of Pollution by Substances other than Oil, 1973

The Parties to the present Protocol,

Being Parties to the International Convention relating to Intervention on the High Seas in Cases of Oil Pollution Casualties, done at Brussels on 29 November 1969,

Taking into account the Resolution on International Co-operation Concerning Pollutants other than Oil adopted by the International Legal Conference on Marine Pollution Damage, 1969,

Further taking into account that pursuant to the Resolution, the Inter-Governmental Maritime Consultative Organization has intensified its work, in collaboration with all interested international organizations, on all aspects of pollution by substances other than oil,

Have agreed as follows:

Article I

  • 1 Parties to the present Protocol may take such measures on the high seas as may be necessary to prevent, mitigate or eliminate grave and imminent danger to their coastline or related interests from pollution or threat of pollution by substances other than oil following upon a maritime casualty or acts related to such a casualty, which may reasonably be expected to result in major harmful consequences.

  • 2 “Substances other than oil” as referred to in paragraph 1 shall be:

    • (a) those substances enumerated in a list which shall be established by an appropriate body designated by the Organization and which shall be annexed to the present Protocol, and

    • (b) those other substances which are liable to create hazards to human health, to harm living resources and marine life, to damage amenities or to interfere with other legitimate uses of the sea.

  • 3 Whenever an intervening Party takes action with regard to a substance referred to in paragraph 2 (b) above that Party shall have the burden of establishing that the substance, under the circumstances present at the time of the intervention, could reasonably pose a grave and imminent danger analogous to that posed by any of the substances enumerated in the list referred to in paragraph 2 (a) above.

Article II

  • 2 For the purpose of the present Protocol the list of experts referred to in Articles III (c) and IV of the Convention shall be extended to include experts qualified to give advice in relation to substances other than oil. Nominations to the list may be made by Member States of the Organization and by Parties to the present Protocol.

Article III

  • 1 The list referred to in paragraph 2 (a) of Article I shall be maintained by the appropriate body designated by the Organization.

  • 2 Any amendment to the list proposed by a Party to the present Protocol shall be submitted to the Organization and circulated by it to all Members of the Organization and all Parties to the present Protocol at least three months prior to its consideration by the appropriate body.

  • 3 Parties to the present Protocol whether or not Members of the Organization shall be entitled to participate in the proceedings of the appropriate body.

  • 4 Amendments shall be adopted by a two-thirds majority of only the Parties to the present Protocol present and voting.

  • 5 If adopted in accordance with paragraph 4 above, the amendment shall be communicated by the Organization to all Parties to the present Protocol for acceptance.

  • 6 The amendment shall be deemed to have been accepted at the end of a period of six months after it has been communicated, unless within that period an objection to the amendment has been communicated to the Organization by not less than one-third of the Parties to the present Protocol.

  • 7 An amendment deemed to have been accepted in accordance with paragraph 6 above shall enter into force three months after its acceptance for all Parties to the present Protocol, with the exception of those which before that date have made a declaration of non-acceptance of the said amendment.

Article IV

  • 1 The present Protocol shall be open for signature by the States which have signed the Convention referred to in Article II or acceded thereto, and by any State invited to be represented at the International Conference on Marine Pollution, 1973. The Protocol shall remain open for signature from 15 January 1974 until 31 December 1974 at the Headquarters of the Organization.

  • 2 Subject to paragraph 4 of this Article, the present Protocol shall be subject to ratification, acceptance or approval by the States which have signed it.

  • 3 Subject to paragraph 4, this Protocol shall be open for accession by States which did not sign it.

  • 4 The present Protocol may be ratified, accepted, approved or acceded to only by States which have ratified, accepted, approved or acceded to the Convention referred to in Article II.

Article V

  • 1 Ratification, acceptance, approval or accession shall be effected by the deposit of a formal instrument to that effect with the Secretary-General of the Organization.

  • 2 Any instrument of ratification, acceptance, approval or accession deposited after the entry into force of an amendment to the present Protocol with respect to all existing Parties or after the completion of all measures required for the entry into force of the amendment with respect to all existing Parties shall be deemed to apply to the Protocol as modified by the amendment.

Article VI

  • 1 The present Protocol shall enter into force on the ninetieth day following the date on which fifteen States have deposited instruments of ratification, acceptance, approval or accession with the Secretary-General of the Organization, provided however that the present Protocol shall not enter into force before the Convention referred to in Article II has entered into force.

  • 2 For each State which subsequently ratifies, accepts, approves or accedes to it, the present Protocol shall enter into force on the ninetieth day after the deposit by such State of the appropriate instrument.

Article VII

  • 1 The present Protocol may be denounced by any Party at any time after the date on which the Protocol enters into force for that Party.

  • 2 Denunciation shall be effected by the deposit of an instrument to that effect with the Secretary-General of the Organization.

  • 3 Denunciation shall take effect one year, or such longer period as may be specified in the instrument of denunciation, after its deposit with the Secretary-General of the Organization.

Article VIII

  • 1 A conference for the purpose of revising or amending the present Protocol may be convened by the Organization.

  • 2 The Organization shall convene a conference of Parties to the present Protocol for the purpose of revising or amending it at the request of not less than one-third of the Parties.

Article IX

  • 1 The present Protocol shall be deposited with the Secretary-General of the Organization.

  • 2 The Secretary-General of the Organization shall:

    • (a) inform all States which have signed the present Protocol acceded thereto of:

      • (i) each new signature or deposit of an instrument together with the date thereof;

      • (ii) the date of entry force of the present Protocol;

      • (iii) the deposit of any instrument of denunciation of the present Protocol together with the date on which the denunciation takes effect;

      • (iv) any amendments to the present Protocol or its Annex and any objection or declaration of non-acceptance of the said amendment;

    • (b) transmit certified true copies of the present Protocol to all States which have signed the present Protocol or acceded thereto.

Article X

As soon as the present Protocol enters into force, a certified true copy thereof shall be transmitted by the Secretary-General of the Organization to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

Article XI

The present Protocol is established in a single original in the English, French, Russian and Spanish languages, all four texts being equally authentic.

IN WITNESS WHEREOF the undersigned being duly authorized for that purpose have signed the present Protocol.

Resolution on establishment of the List of substances to be annexed to the Protocol Relating to Intervention on the High Seas in Cases of Marine Pollution by Substances Other than Oil

Adopted on 21 November 1974

The Marine Environment Protection Committee,

Noting Resolution 26 of the International Conference on Marine Pollution, 1973 which requests the appropriate body designated by the Organization to establish, not later than 30 November 1974, the list, of substances to be annexed to the Protocol Relating to Intervention on the High Seas in Cases of Marine Pollution by Substances Other than Oil,

Noting further Resolution A.296 (VII) by which the Assembly designated the Committee as the appropriate body referred to in Articles I and III of the above-mentioned Protocol,

Haying considered proposals by governments for substances to be included in the list;

Having taken account of scientific advice provided by the Joint Group of Experts on the Scientific Aspects of Marine Pollution (GESAMP) with regard to evaluation of the hazards of harmful substances in the marine environment and by the International Atomic Energy Agency in respect or radioactive substances,

Adopts by the required two-thirds majority of those present and voting in the Committee the list which appears at Annex to this Resolution,

Requests the Secretary-General to annex copies thereof to the authentic texts of the Protocol in accordance with Article I, paragraph 2 (a),

Requests further the Secretary-General to communicate this list to Governments without delay,

Decides that the list should be kept under review, in consultation and co-operation with competent international organizations, in particular the International Atomic Energy Agency in respect of radioactive substances.

Annex List of substances referred to in paragraph 2(a) of article I of the 1973 Intervention Protocol

Any of the following products are subject to the 1973 Intervention Protocol if they are either carried on board a ship as cargo or are residues of such products previously carried:

  • 1. Oils, as defined in Annex I to the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto (MARPOL 73/78), as amended, when carried in bulk, including those listed in Appendix I with the exception of crude oil, fuel oil, diesel oil and lubricating oil which are covered by the 1969 Intervention Convention;

  • 2. Noxious Liquid Substances, as defined in Annex II to MARPOL 73/78, as amended, when carried in bulk, and identified:

    • .1 as Pollution Category X or Y, in:

      • .1 Chapter 17 of the International Bulk Chemical Code (IBC Code); or

      • .2 Lists 1 to 4 of MEPC.2/Circulars, issued annually in December; or

    • .2 in the composite list of GESAMP Hazard Profiles, issued periodically as BLG circulars, with either:

      • .1 a “2” in column B1 and “2” in column E3; or

      • .2 “3” in column E3;

  • 3. Harmful substances, in packaged form, as defined in Annex III to MARPOL 73/78, as amended, and which have been identified as Severe Marine Pollutants (PP) in the International Maritime Dangerous Goods Code (IMDG Code) or which meet the criteria for such as defined in the IMDG Code;

  • 4. Radioactive material, transported in type B or type C packages, or as fissile material, or under special arrangements, as covered by the provisions of class 7 of the IMDG Code; and

  • 5. Liquefied gases, identified in chapter 19 of the International Code for the Construction and Equipment of Ships Carrying Liquefied Gases in Bulk, 1983 (IGC Code), as amended, when carried in bulk, and the products for which preliminary suitable conditions for the carriage have been prescribed by the Administration and port administrations involved in accordance with paragraph 1.1.6 of the IGC Code.

De Partijen bij dit Protocol,

Partij zijnde bij het Internationaal Verdrag inzake optreden in volle zee bij ongevallen die verontreiniging door olie kunnen veroorzaken, gedaan te Brussel op 29 november 1969,

Gelet op de Resolutie inzake de Internationale Samenwerking betreffende andere verontreinigende stoffen dan olie, aanvaard door de Internationale Juridische Conferentie inzake schade door verontreiniging van de zee, 1969,

Voorts gelet op het feit dat ingevolge de Resolutie, de Intergouvernementele Maritieme Consultatieve Organisatie haar werkzaamheden heeft geïntensiveerd, in samenwerking met alle belanghebbende internationale organisaties, ter zake van alle aspecten van verontreiniging door andere stoffen dan olie,

Zijn overeengekomen als volgt:

Artikel I

  • 1 De Partijen bij dit Protocol kunnen in volle zee de maatregelen nemen die noodzakelijk zijn ter voorkoming, vermindering of opheffing van ernstig en dreigend gevaar voor hun kust of daarmede samenhangende belangen door verontreiniging of dreigende verontreiniging door andere stoffen dan olie, na een ongeval op zee of na met zulk een ongeval verband houdende handelingen, waarvan redelijkerwijs kan worden aangenomen dat zij zeer ernstige schade tot gevolg zullen hebben.

  • 2 „Andere stoffen dan olie” zoals bedoeld in het eerste lid zijn:

    • (a) de stoffen opgesomd in een lijst die wordt opgesteld door een door de Organisatie aangewezen ter zake bevoegde instantie, en die als bijlage aan dit Protocol wordt gehecht, en

    • (b) de andere stoffen die de gezondheid van de mens in gevaar kunnen brengen, schade kunnen berokkenen aan de in zee voorkomende fauna en flora, een aantasting kunnen vormen van de mogelijkheden tot recreatie of een ander rechtmatig gebruik van de zee kunnen verhinderen.

  • 3 Telkens wanneer een optredende Partij maatregelen neemt met betrekking tot een stof zoals bedoeld in het tweede lid, letter (b), rust op deze Partij de bewijslast dat de stof, onder de omstandigheden ten tijde van het optreden, naar redelijkerwijs kon worden aangenomen een ernstig en dreigend gevaar kon opleveren, overeenkomende met het gevaar dat een der andere stoffen opgesomd in de lijst bedoeld in het tweede lid, letter (a), oplevert.

Artikel II

  • 2 Voor toepassing van de bepalingen van dit Protocol wordt de lijst van deskundigen, bedoeld in de artikelen III, letter (c), en IV van dat Verdrag, uitgebreid, zodat zij deskundigen omvat die bevoegd zijn tot het geven van advies inzake andere stoffen dan olie. De Lid-Staten van de Organisatie en Partijen bij dit Protocol kunnen voordrachten doen voor die lijst.

Artikel III

  • 1 De in artikel I, tweede lid, letter a, bedoelde lijst wordt bijgehouden door de daartoe door de Organisatie aangewezen bevoegde instantie.

  • 2 Elke wijziging op de lijst voorgesteld door een Partij bij dit Protocol, wordt aan de Organisatie voorgelegd en wordt door deze ten minste drie maanden vóór de bestudering daarvan door de ter zake bevoegde instantie aan alle leden van de Organisatie en alle Partijen bij dit Protocol toegezonden.

  • 3 De Partijen bij dit Protocol, al dan niet lid van de Organisatie, zijn gerechtigd deel te nemen aan de besprekingen van de bevoegde instantie.

  • 4 Wijzigingen worden aangenomen met een twee derde meerderheid van slechts die Partijen bij dit Protocol die aanwezig zijn en hun stem uitbrengen.

  • 5 Indien aangenomen overeenkomstig het vierde lid, wordt de wijziging door de Organisatie ter aanvaarding medegedeeld aan alle Partijen bij dit Protocol.

  • 6 De wijziging wordt geacht te zijn aanvaard aan het eind van een termijn van zes maanden nadat zij is medegedeeld, tenzij binnen die termijn bij de Organisatie bezwaar tegen de wijziging is aangetekend door ten minste een derde van de Partijen bij dit Protocol.

  • 7 Een wijziging die geacht wordt te zijn aanvaard overeenkomstig het zesde lid treedt in werking drie maanden na aanvaarding voor alle Partijen bij dit Protocol, met uitzondering van die Partijen die vóór die datum een verklaring van niet-aanvaarding van de betrokken wijziging hebben afgelegd.

Artikel IV

  • 1 Dit Protocol staat open voor ondertekening door de Staten die het Verdrag bedoeld in artikel II hebben ondertekend of daartoe zijn toegetreden, en door elke Staat die is uitgenodigd zich te doen vertegenwoordigen bij de Internationale Conferentie over verontreiniging van de zee, 1973. Het Protocol blijft van 15 januari 1974 tot 31 december 1974 op de zetel van de Organisatie opengesteld voor ondertekening.

  • 2 Onder voorbehoud van het vierde lid van dit artikel dient dit Protocol te worden bekrachtigd, aanvaard of goedgekeurd door de Staten die het hebben ondertekend.

  • 3 Onder voorbehoud van het vierde lid staat dit Protocol open voor toetreding door Staten die het niet hebben ondertekend.

  • 4 Alleen Staten, die het Verdrag bedoeld in artikel II hebben bekrachtigd, aanvaard of goedgekeurd, of daartoe zijn toegetreden, kunnen dit Protocol bekrachtigen, aanvaarden of goedkeuren of ertoe toetreden.

Artikel V

  • 1 De bekrachtiging, aanvaarding, goedkeuring of toetreding geschiedt door de nederlegging van een daartoe strekkende akte bij de Secretaris-Generaal van de Organisatie.

  • 2 Alle akten van bekrachtiging, aanvaarding, goedkeuring of toetreding nedergelegd na de inwerkingtreding van een wijziging op dit Protocol ten aanzien van alle bestaande Partijen, of na de voltooiing van alle maatregelen, vereist voor de inwerkingtreding van de wijziging ten aanzien van alle bestaande Partijen, worden geacht van toepassing te zijn op het aldus gewijzigde Protocol.

Artikel VI

  • 1 Dit Protocol treedt in werking op de negentigste dag na de datum waarop vijftien Staten akten van bekrachtiging, aanvaarding, goedkeuring of toetreding hebben nedergelegd bij de Secretaris-Generaal van de Organisatie, met dien verstande evenwel dat dit Protocol niet in werking treedt voordat het in artikel II bedoelde Verdrag in werking treedt.

  • 2 Ten aanzien van elke Staat die dit Protocol daarna bekrachtigt, aanvaardt, goedkeurt of ertoe toetreedt, treedt het Protocol in werking op de negentigste dag na nederlegging door die Staat van de daartoe strekkende akte.

Artikel VII

  • 1 Na de datum waarop het voor een Partij in werking is getreden, kan die Partij dit Protocol te allen tijde opzeggen.

  • 2 Opzegging geschiedt door nederlegging van een daartoe strekkende akte bij de Secretaris-Generaal van de Organisatie.

  • 3 De opzegging wordt van kracht een jaar na de nederlegging van de akte van opzegging bij de Secretaris-Generaal van de Organisatie of na een langere termijn zoals in die akte is bepaald.

Artikel VIII

  • 1 De Organisatie kan een conferentie tot herziening of wijziging van dit Protocol bijeenroepen.

  • 2 De Organisatie roept een conferentie van de Partijen bij dit Protocol bijeen tot herziening of wijziging van dit Protocol op verzoek van ten minste een derde van de Partijen.

Artikel IX

  • 1 Dit Protocol wordt nedergelegd bij de Secretaris-Generaal van de Organisatie.

  • 2 De Secretaris-Generaal van de Organisatie:

    • (a) stelt alle Staten die dit Protocol hebben ondertekend of daartoe zijn toegetreden in kennis van:

      • (i) elke nieuwe ondertekening of nederlegging van een akte en de datum daarvan;

      • (ii) de datum van inwerkingtreding van dit Protocol;

      • (iii) de nederlegging van een akte van opzegging van dit Protocol met de datum van inwerkingtreding van de opzegging;

      • (iv) iedere wijziging van dit Protocol of zijn Bijlage en ieder bezwaar tegen of verklaring van niet-aanvaarding van de wijziging;

    • (b) doet voor eensluidend gewaarmerkte afschriften van dit Protocol toekomen aan alle Staten die dit Protocol hebben ondertekend of daartoe zijn toegetreden.

Artikel X

Zodra dit Protocol in werking treedt, wordt door de Secretaris-Generaal van de Organisatie een voor eensluidend gewaarmerkt afschrift toegezonden aan het Secretariaat van de Verenigde Naties ter registratie en publikatie overeenkomstig artikel 102 van het Handvest der Verenigde Naties.

Artikel XI

Dit Protocol is, in een enkel oorspronkelijk exemplaar, opgesteld in de Engelse, de Franse, de Russische en de Spaanse taal, zijnde de vier teksten gelijkelijk authentiek.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe behoorlijk gemachtigd, dit Protocol hebben ondertekend.

Resolutie inzake het opstellen van de Lijst van stoffen die als bijlage wordt gehecht aan het Protocol inzake het optreden in volle zee in gevallen van verontreiniging van de zee door andere stoffen dan olie

Resolutie Commissie inzake de Bescherming van het Mariene Milieu (MEPC) 1 (II)

De Commissie inzake de Bescherming van het Mariene Milieu,

Gelet op de 26ste Resolutie van de Internationale Conferentie over de Verontreiniging van de Zee, 1973, waarin de door de Organisatie aangewezen ter zake bevoegde instantie wordt verzocht vóór 30 november 1974 een lijst van stoffen op te stellen die als bijlage wordt gehecht aan het Protocol inzake het optreden in volle zee in gevallen van verontreiniging door andere stoffen dan olie,

Voorts gelet op Resolutie A.296 (VII) waarin de Vergadering de Commissie aanwees als de terzake bevoegde instantie bedoeld in de artikelen I en III van bovengenoemd Protocol,

Overwogen hebbende de door de Regeringen gedane voordrachten inzake de op de lijst op te nemen stoffen,

Rekening gehouden hebbende met het wetenschappelijk advies zowel van de Gemengde Groep van Deskundigen op het gebied van de Wetenschappelijke Aspecten van de Verontreiniging van de Zee (GESAMP) met betrekking tot de evaluatie van de risico's van gevaarlijke stoffen in het mariene milieu, als van de Internationale Organisatie voor Atoomenergie met betrekking tot radioactieve stoffen,

Aanvaardt met de vereiste twee derde meerderheid van hen die aanwezig zijn en hun stem uitbrengen in de Commissie, de lijst die als bijlage aan deze Resolutie is toegevoegd,

Verzoekt de Secretaris-Generaal afschriften hiervan te hechten aan de authentieke teksten van het Protocol, overeenkomstig artikel I, lid 2 onder letter a,

Verzoekt voorts de Secretaris-Generaal deze lijst onverwijld aan de Regeringen te doen toekomen,

Besluit dat de lijst regelmatig zal worden bezien in overleg en samenwerking met de internationale bevoegde organisaties, in het bijzonder de Internationale Organisatie voor Atoomenergie wanneer het radioactieve stoffen betreft.

Bijlage Lijst van stoffen bedoeld in artikel I, tweede lid, onderdeel a, van het Interventieprotocol van 1973

Alle hieronder genoemde producten vallen onder het Interventieprotocol van 1973 indien ze als lading of als residu van zulke eerder vervoerde producten worden vervoerd aan boord van een schip:

  • 1. Olie , zoals omschreven in Bijlage I bij het Internationaal Verdrag ter voorkoming van verontreiniging door schepen, 1973, zoals gewijzigd door het Protocol daarbij van 1978 (MARPOL 73/78), zoals gewijzigd, indien vervoerd in bulk, met inbegrip van de stoffen vermeld in Aanhangsel I, met uitzondering van ruwe olie, stookolie, dieselolie en smeerolie die vallen onder het Interventieverdrag van 1969;

  • 2. Schadelijke vloeistoffen , zoals omschreven in Bijlage II bij Marpol 73/78, zoals gewijzigd, indien vervoerd in bulk en aangeduid:

    • .1 als Verontreinigingscategorie X of Y, in:

      • .1 Hoofdstuk 17 van de International Bulk Chemical Code (IBC-code); of

      • .2 de lijsten 1 tot en met 4 van de MEPC.2 circulaires, die jaarlijks verschijnen in december; of

    • .2 in de Samengestelde Lijst van Gevarenprofielen van de Gemeenschappelijke Groep van Deskundigen inzake de Wetenschappelijke aspecten van verontreiniging van de zee (GESAMP Hazard Profiles), die periodiek worden uitgegeven als BLG-circulaires, met hetzij:

      • .1 een „2” in kolom B1 en een „2” in kolom E3; of

      • .2 een „3” in kolom E3;

  • 3. Schadelijke stoffen , in verpakte vorm, zoals omschreven in Bijlage III bij MARPOL 73/78, zoals gewijzigd, en die zijn aangeduid als de zeer ernstig verontreinigende stoffen (PP) in de Internationale Maritieme Code voor Gevaarlijke Stoffen (IMDG-code) of die voldoen aan de criteria ervoor zoals omschreven in de IMDG-code;

  • 4. Radioactieve stoffen die worden vervoerd in verpakkingen van type B of C of als splijtstoffen, of ingevolge een bijzondere regeling, zoals vallend onder de bepalingen van klasse 7 van de IMDG-code, en

  • 5. Vloeibaar gemaakte gassen , vermeld in hoofdstuk 19 van de International Code for the Construction and Equipment of Ships Carrying Liquefied Gases in Bulk, 1983 (IGC-code, Internationale code inzake de bouw en uitrusting van schepen die vloeibaar gemaakte gassen in bulk vervoeren), zoals gewijzigd, indien vervoerd in bulk, en de producten waarvoor de betrokken Administratie en havenautoriteiten voorlopige passende voorwaarden hebben voorgeschreven in overeenstemming met paragraaf 1.1.6. van de IGC-code.
