The Royal Netherlands Embassy presents its compliments to the Ministry of External Affairs of the Commonwealth of the Bahamas and has the honour to refer to its Note of July 23, 1980, No: 3214.

The Embassy herewith presents to the Ministry Drafts for an exchange of Notes between the Government of the Commonwealth of the Bahamas and the Government of the Kingdom of the Netherlands.

The Embassy would appreciate receiving a reply from the Ministry as to whether the proposed Drafts are acceptable to the Government of the Commonwealth of the Bahamas.

Furthermore, the Embassy has the honour to present to the Ministry for its information an English version of the Extradition Act that is valid at present in the Kingdom of the Netherlands.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Ministry of External Affairs of the Commonwealth of the Bahamas the assurances of its highest consideration.

• I. The Royal Netherlands Embassy presents its compliments to the Ministry of Foreign Affairs of the Commonwealth of The Bahamas and has the honour to refer to the Extradition Treaty between the Kingdom of the Netherlands and the United Kingdom of Great Britain and Ireland, signed in London on 26th September, 1898, which Treaty was in force for the then British Colony The Bahamas as of 14th March, 1899.

  The Embassy has been instructed by the Government of the Kingdom of the Netherlands to propose to the Government of the Commonwealth of The Bahamas that the relations between the two States in matters of extradition shall be governed by the provisions of the said Treaty of 26 September, 1898, with the understanding that whenever reference is made to subjects, authorities, territories or laws of the United Kingdom of Great Britain and Ireland in said Treaty, this shall be understood to mean subjects, authorities, territories or laws of the Commonwealth of The Bahamas. In addition, it is proposed that each Party may refuse extradition not only on grounds specifically mentioned in the Treaty, but also on grounds specified in or provided for by its laws, subject to the right of reciprocal application. Furthermore, in relation to the provision contained in article II, last paragraph of the Treaty, the Government of the Kingdom of the Netherlands would appreciate the confirmation that the Government of the Commonwealth of The Bahamas also understands this provision to mean that extradition for crimes relating to narcotic drugs may take place in accordance with the provisions of the national laws and regulations of each Party.

  Finally, it is proposed that the Contracting Parties undertake to provide each other with the maximum of assistance, in accordance with the provisions of national legislation, in any criminal proceedings relating to offences whose punishment lies within the jurisdiction of the judicial authorities of the Party requesting the assistance. If the foregoing is acceptable to the Government of the Commonwealth of The Bahamas, the Embassy has the honour further to propose that this Note, and the Ministry's confirmative reply, shall constitute an Agreement between the Kingdom of the Netherlands and the Commonwealth of The Bahamas on this subject, which Agreement shall apply, as regards the Kingdom of the Netherlands, to the Kingdom in Europe and to the Netherlands Antilles and which shall enter into force on the date on which the Government of the Kingdom of the Netherlands and the Government of the Commonwealth of The Bahamas have notified each other that the formalities constitutionally required therefore in both countries have been complied with.

The Embassy's Note, No. 4654 of 18 November, 1980, which contained a proposal for an Exchange of Notes reads as follows:

De Ambassade van het Koninkrijk der Nederlanden biedt het Ministerie van Buitenlandse Zaken van het Gemenebest van de Bahamas haar complimenten aan en heeft de eer te verwijzen naar haar Nota No. 3214 van 23 juli 1980. De Ambassade biedt hierbij het Ministerie de concepten aan voor een Notawisseling tussen de Regering van het Gemenebest van de Bahamas en de Regering van het Koninkrijk der Nederlanden.

De Ambassade zou het zeer op prijs stellen antwoord van het Ministerie te ontvangen met betrekking tot de vraag of de voorgestelde concepten aanvaardbaar zijn voor de Regering van het Gemenebest van de Bahama-eilanden.

De Ambassade heeft voorts de eer het Ministerie te zijner informatie een Engelse vertaling van de thans in het Koninkrijk der Nederlanden geldende Uitleveringswet aan te bieden.

De Ambassade van het Koninkrijk der Nederlanden maakt van deze gelegenheid gebruik het Ministerie van Buitenlandse Zaken van het Gemenebest van de Bahamas opnieuw de verzekering van haar zeer bijzondere hoogachting te geven.

• I. De Ambassade van het Koninkrijk der Nederlanden biedt het Ministerie van het Gemenebest van de Bahamas haar complimenten aan en heeft de eer te verwijzen naar het Uitleveringsverdrag tussen het Koninkrijk der Nederlanden en het Verenigd Koninkrijk van Groot-Brittannië en Ierland, ondertekend op 26 september 1898 te Londen, welk Verdrag met ingang van 14 maart 1899 van kracht was voor de toenmalige Britse Kolonie de Bahama-eilanden.

  De Regering van het Koninkrijk der Nederlanden heeft de Ambassade opgedragen aan de Regering van het Gemenebest van de Bahamas voor te stellen dat de betrekkingen tussen de twee Staten ter zake van uitlevering zullen worden beheerst door de bepalingen van het genoemde Verdrag van 26 september 1898, met dien verstande dat wanneer er in dat Verdrag sprake is van onderdanen, autoriteiten, grondgebieden of wetten van het Verenigd Koninkrijk van GrootBrittannië en Ierland daaronder worden verstaan: onderdanen, autoriteiten, grondgebieden of wetten van het Gemenebest van de Bahamas. Voorts wordt voorgesteld dat elke Partij uitlevering niet slechts mag weigeren op gronden die in het bijzonder in het Verdrag zijn genoemd, doch ook op gronden die zijn omschreven of voorzien in haar wetgeving, met inachtneming van het recht van toepassing van het beginsel van wederkerigheid. Met betrekking tot het bepaalde in artikel II, laatste lid, van het Verdrag zou de Regering van het Koninkrijk der Nederlanden de bevestiging op prijs stellen dat de Regering van het Gemenebest van de Bahamas ook onder deze bepaling verstaat dat uitlevering voor misdrijven die betrekking hebben op verdovende middelen, kan plaatsvinden in overeenstemming met de bepalingen van de nationale wetten en voorschriften van elke Partij.

  Ten slotte wordt voorgesteld dat de Verdragsluitende Partijen zich ertoe verbinden elkaar in zo ruim mogelijke mate rechtshulp te verlenen, in overeenstemming met de bepalingen van de nationale wetgeving, in elke strafrechtelijke procedure die betrekking heeft op strafbare feiten waarvan de bestraffing behoort tot de bevoegdheid van de rechterlijke autoriteiten van de verzoekende Partij. Indien de bovengenoemde voorstellen aanvaardbaar zijn voor de Regering van het Gemenebest van de Bahamas, heeft de Ambassade de eer verder voor te stellen dat deze Nota en het bevestigende antwoord van het Ministerie daarop een Overeenkomst ter zake tussen het Koninkrijk der Nederlanden en het Gemenebest van de Bahamas zullen vormen, welke Overeenkomst, wat het Koninkrijk der Nederlanden betreft, van toepassing zal zijn op het Rijk in Europa en op de Nederlandse Antillen en in werking zal treden op de datum waarop de Regering van het Koninkrijk der Nederlanden en de Regering van het Gemenebest van de Bahamas elkaar ervan in kennis hebben gesteld dat in beide landen aan alle daarvoor vereiste constitutionele formaliteiten is voldaan.
