The Benelux States (The Kingdom of Belgium, the Grand Duchy of Luxembourg and the
Kingdom of the Netherlands), acting jointly by virtue of the provisions of the Convention concluded on 11 April 1960 on the transfer of control of persons to the
external frontiers of Benelux territory, and the Kyrgyz Republic,
hereinafter referred to as “the Parties”,
Striving to promote cooperation between the Parties and to improve communication between
them in order to better execute the laws and regulations on the circulation of persons
of the Parties,
Striving to reconfirm their common desire to effectively combat the illegal immigration
of their respective nationals as well as of third-State nationals and of stateless
persons,
Recognizing the need to respect human rights and individual freedoms and stressing
that this Agreement does not affect human rights and the obligations of the Parties,
specifically obligations arising from the Universal Declaration of Human Rights of 10 December 1948 and other international agreements and in particular, the Convention relating to the Status of Refugees of 28 July 1951, the Protocol relating to the Status of Refugees of 31 January 1967, the International Covenant on Civil and Political Rights of 16 December 1966 and the Convention against Torture and Other Cruel, Inhuman or Degrading Punishment of 10 December 1984,
Striving to fulfil the obligation under international legal norms to readmit their
own nationals, especially Article 12(4) of the International Covenant on Civil and Political Rights of 16 December 1966,
Striving to establish an obligation between the Parties to readmit third-State nationals
and stateless persons, under the conditions provided for in this Agreement,
Striving to facilitate, on the basis of reciprocity, the readmission of persons having
entered into and/or residing on the territory of another Party without authorisation,
and the transit of persons to be readmitted,
Being interested in performing a fast and secure readmission in accordance with procedures
which ensure respect for human rights,
Taking into account the fact that cooperation between the Parties in the field of
readmission represents a common interest,
Referring to the Agreement between the Kyrgyz Republic and the Benelux States on the
exemption from visa requirements for holders of valid diplomatic and service/official
passports,
