The Embassy Office of the Kingdom of the Netherlands in the Republic of Moldova presents its compliments to the Ministry of Foreign Affairs and European Integration of the Republic of Moldova and has the honour to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Moldova on mutual administrative assistance in customs matters, signed at Chisinau on 19 June 2006 (hereinafter referred to as “the Agreement of 2006”).

The Government of the Kingdom of the Netherlands proposes that, in accordance with Article 21, paragraphs 2 and 3, of the Agreement of 2006, the application of the Agreement of 2006 shall be extended to Aruba, Curaçao and Sint Maarten, subject to the following:

• 1. For the Kingdom of the Netherlands, the term “customs administration” in Article 1, under a), of the Agreement of 2006 shall mean, as regards Aruba, Curaçao and Sint Maarten, the respective central administration responsible for the implementation of customs laws.

• 2. Article 2, paragraph 4, of the Agreement of 2006 shall apply only to Aruba, Curaçao and Sint Maarten, as the case may be, insofar as the agreements or arrangements referred to therein apply to those respective parts of the Kingdom of the Netherlands.

• 3. As regards Aruba, Curaçao and Sint Maarten, the requirements of national law within the meaning of Article 17 of the Agreement of 2006 fall under the scope of the Ordinance on person registration or the Kingdom Act Administrative Assistance, as the case may be.

If the foregoing is acceptable to the Government of the Republic of Moldova, the Embassy Office of the Kingdom of the Netherlands in the Republic of Moldova has the further honour to propose that this Note and the Ministry’s Note in reply shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Moldova which shall enter into force on the first day of the second month following the date of receipt of the later notification in which one Contracting Party informs the other Contracting Party that the formalities required for the entry into force of this Agreement have been complied with.

The Embassy Office of the Kingdom of the Netherlands in the Republic of Moldova avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Moldova the assurance of its highest consideration.

The Ministry confirms that the above proposal is acceptable to the Government of the Republic of Moldova and that the Embassy’s Office of the Kingdom of the Netherlands in the Republic of Moldova Note and this Note in reply shall constitute an Agreement between the Republic of Moldova and the Kingdom of the Netherlands which shall enter into force on the first day of the second month following the date of receipt of the later notification in which one Contracting Party informs the other Contracting Party that the formalities required for the entry into force of this Agreement have been complied with.

Het Ambassadekantoor van het Koninkrijk der Nederlanden in de Republiek Moldavië biedt het Ministerie van Buitenlandse Zaken en Europese Integratie van de Republiek Moldavië haar complimenten aan en heeft de eer te verwijzen naar het Verdrag tussen het Koninkrijk der Nederlanden en de Republiek Moldavië inzake wederzijdse administratieve bijstand in douanezaken, ondertekend te Chisinau op 19 juni 2006 (hierna te noemen „het Verdrag van 2006”).

De Regering van het Koninkrijk der Nederlanden stelt voor dat, in overeenstemming met artikel 21, tweede en derde lid, van het Verdrag van 2006, de toepassing van het Verdrag van 2006 wordt uitgebreid tot Aruba, Curaçao en Sint Maarten, met inachtneming van het volgende:

• 1. Voor het Koninkrijk der Nederlanden wordt, wat Aruba, Curaçao en Sint Maarten betreft, onder de uitdrukking „douaneadministratie” in artikel 1, onderdeel a, van het Verdrag van 2006 verstaan de respectieve centrale administratie die verantwoordelijk is voor de toepassing van de douanewetgeving.

• 2. Artikel 2, vierde lid, van het Verdrag van 2006 is uitsluitend van toepassing op Aruba, Curaçao en Sint Maarten, naargelang van het geval, voor zover de daarin bedoelde overeenkomsten of regelingen van toepassing zijn op deze respectieve delen van het Koninkrijk der Nederlanden.

• 3. De vereisten van de nationale wetgeving in de zin van artikel 17 van het Verdrag van 2006 vallen wat Aruba, Curaçao en Sint Maarten betreft, onder het bereik van de Landsverordening persoonsregistratie of de Rijkswet administratieve bijstand1, naargelang van het geval.

Indien het voorgaande aanvaardbaar is voor de Regering van de Republiek Moldavië, heeft het Ambassadekantoor van het Koninkrijk der Nederlanden in de Republiek Moldavië voorts de eer voor te stellen dat deze nota en de antwoordnota van het Ministerie een Verdrag zullen vormen tussen het Koninkrijk der Nederlanden en de Republiek Moldavië dat in werking zal treden op de eerste dag van de tweede maand die volgt op de datum van ontvangst van de laatste kennisgeving waarin één van de Verdragsluitende partijen aan de andere Verdragsluitende partij mededeelt dat aan de benodigde formaliteiten voor de inwerkingtreding van dit Verdrag is voldaan.

Het Ambassadekantoor van het Koninkrijk der Nederlanden in de Republiek Moldavië maakt van deze gelegenheid gebruik om het Ministerie van Buitenlandse Zaken van de Republiek Moldavië opnieuw te verzekeren van haar zeer bijzondere hoogachting.

Het Ministerie van Buitenlandse Zaken en Europese Integratie van de Republiek Moldavië biedt het Ambassadekantoor van het Koninkrijk der Nederlanden in de Republiek Moldavië haar complimenten aan en heeft de eer de ontvangst te bevestigen van de nota verbaal nr. CHS/2019/050 d.d. 6 augustus 2019, die als volgt luidt:

Het Ministerie bevestigt dat het bovengenoemde voorstel voor de Regering van de Republiek Moldavië aanvaardbaar is en dat de nota van het Ambassadekantoor van het Koninkrijk der Nederlanden in de Republiek Moldavië en deze antwoordnota een Verdrag zullen vormen tussen de Republiek Moldavië en het Koninkrijk der Nederlanden dat in werking zal treden op de eerste dag van de tweede maand die volgt op de datum van ontvangst van de laatste kennisgeving waarin één van de Verdragsluitende partijen aan de andere Verdragsluitende partij mededeelt dat aan de benodigde formaliteiten voor de inwerkingtreding van dit Verdrag is voldaan.
