The Committee of Ministers,
Having regard to Resolution (55) 34 approving the establishment of a Council of Europe
Resettlement Fund,
Having regard to Resolution (56) 9 adopting the regulations of this Fund on the basis
of a partial agreement;
Having noted the said Articles of Agreement;
Having regard to Article 3 of the General Agreement on Privileges and Immunities of
the Council of Europe;
Considering that creditors of the Resettlement Fund must have means of legal redress,
Declares that it is prepared to waive the immunity of the Council of Europe from legal
process if an action is brought against the Council in consequence of a dispute over
the interpretation or execution of the terms of a lease or any other contractual obligation
arising out of a contract concluded between the applicant and the Council in connection
with the Resettlement Fund and within the limits of the liability of that Fund, it
being understood that claims arising from a Court judgement, or from any contract,
shall be made exclusively from the Fund's resources, or by Member States participating
in the Fund,
Decides that, in the circumstances mentioned in the previous paragraph, and in any
country where the laws require such representation, the Council of Europe shall be
represented in law by the Governor of the Resettlement Fund.
