European Agreement concerning the work of crews of vehicles engaged in international road transport (AETR)

The Contracting Parties,

Being desirous of promoting the development and improvement of the international transport of passengers and goods by road,

Convinced of the need to increase the safety of road traffic, to make regulations governing certain conditions of employment in international road transport in accordance with the principles of the International Labour Organisation, and jointly to adopt certain measures to ensure the observance of those regulations,

Have agreed as follows:

Article 1. Definitions

For the purposes of this Agreement

(a) “vehicle” means any motor vehicle or trailer; this term includes any combination of vehicles;
(b) “motor vehicle” means any self-propelled road vehicle which is normally used for carrying persons or goods by road or for drawing, on the road, vehicles used for the carriage of persons or goods; this term does not include agricultural tractors;
(c) “trailer” means any vehicle designed to be drawn by a motor vehicle and includes semi-trailers;
(d) “semi-trailer” means any trailer designed to be coupled to a motor vehicle in such a way that part of it rests on the motor vehicle and that a substantial part of its weight and of the weight of its load is borne by the motor vehicle;
(e) “combination of vehicles” means coupled vehicles which travel on the road as a unit;
(f) ‘Permissible maximum mass’ means the maximum mass of the laden vehicle declared permissible by the competent authority of the State in which the vehicle is registered;
(g) ‘Carriage by road’ means any journey made entirely or in part on roads open to the public of a vehicle, whether laden or not, used for the carriage of passengers or goods;
(h) “international road transport” (“international carriage by road”) means road transport which involves the crossing of at least one frontier;
(i) ‘regular services’ means services which provide for the carriage of passengers at specified intervals along specified routes, passengers being taken up and set down at predetermined stopping points.

Rules governing the operations of services or documents taking the place thereof, approved by the competent authorities of Contracting Parties and published by the carrier before coming into operation, shall specify the conditions of carriage and in particular the frequency of services, timetables, faretables and the obligation to accept passengers for carriage, in so far as such conditions are not prescribed by any law or regulation.

Services by whomsoever organized, which provide for the carriage of specified categories of passengers to the exclusion of other passengers, in so far as such services are operated under the conditions specified in the first subparagraph of this definition, shall be deemed to be regular services. Such services, in particular those providing for the carriage of workers to and from their place of work or of schoolchildren to and from school, are hereinafter called ‘special regular services’;
(j) ‘Driver’ means any person, whether wage-earning or not, who drives the vehicle even for a short period, or who is carried on a vehicle as part of his duties in order to be available for driving if necessary;
(k) “crew member” means the driver or either of the following, whether wage-earning or not
- (i) a driver's mate, i.e. any person accompanying the driver in order to assist him in certain manoeuvres and habitually taking an effective part in the transport operations, though not a driver in the sense of paragraph (j) of this article;
- (ii) a conductor, i.e. any person who accompanies the driver of a vehicle engaged in the carriage of passengers and is responsible in particular for the issue or checking of tickets or other documents entitling passengers to travel on the vehicle;
(l) ‘week’ means the period between 0000 hours on Monday and 2400 hours on Sunday;
(m) ‘Rest’ means any uninterrupted period during which the driver may freely dispose of his time;
(n) ‘Break’ means any period during which a driver may not carry out any driving or any other work and which is used exclusively for recuperation;
(o) ‘Daily rest period’ means the daily period during which a driver may freely dispose of his time and covers a ‘regular daily rest period’ and a ‘reduced daily rest period’:
- – ‘Regular daily rest period’ means any period of rest of at least 11 hours. Alternatively, this regular daily rest period may be taken in two periods, the first of which must be an uninterrupted period of at least 3 hours and the second an uninterrupted period of at least 9 hours;
- – ‘Reduced daily rest period’ means any period of rest of at least 9 hours but less than 11 hours;
(p) ‘Weekly rest period’ means the weekly period during which a driver may freely dispose of his time and covers a ‘regular weekly rest period’ and a ‘reduced weekly rest period’:
- – ‘Regular weekly rest period’ means any period of rest of at least 45 hours;
- – ‘Reduced weekly rest period’ means any period of rest of less than 45 hours, which may, subject to the conditions laid down in article 8, paragraph (6), of the Agreement be shortened to a minimum of 24 consecutive hours;
(q) ‘Other work’ means all working activities except driving, including any work for the same or another employer, within or outside of the transport sector. It does not include waiting time and time not devoted to driving spent in a vehicle in motion, a ferryboat or a train;
(r) ‘Driving time’ means the duration of driving activity recorded automatically or semi-automatically or manually in the conditions defined in this Agreement;
(s) ‘Daily driving time’ means the total accumulated driving time between the end of one daily rest period and the beginning of the following daily rest period or between a daily rest period and a weekly rest period;
(t) ‘Weekly driving time’ means the total accumulated driving time during a week;
(u) ‘Driving period’ means the accumulated driving time from when a driver commences driving following a rest period or a break until he takes a rest period or a break. The driving period may be continuous or broken;
(v) ‘Multi-manning’ means the situation where, during each period of driving between any two consecutive daily rest periods, or between a daily rest period and a weekly rest period, there are at least two drivers in the vehicle to do the driving. For the first hour of multi-manning the presence of another driver or drivers is optional, but for the remainder of the period it is compulsory;
(w) ‘Transport undertaking’ means any natural person, any legal person, any association or group of persons without legal personality, whether profit-making or not, or any official body, whether having its own legal personality or being dependent upon an authority having such a personality, which engages in carriage by road, whether for hire or reward or for own account.

Article 2. Scope

1 This Agreement shall apply in the territory of each Contracting Party to all international road transport performed by any vehicle registered in the territory of the said Contracting Party or in the territory of any other Contracting Party.

2 Nevertheless, unless the Contracting Parties whose territory is used agree otherwise, this Agreement shall not apply to international road transport performed by:
- a) Vehicles used for the carriage of goods where the permissible maximum mass of the vehicle, including any trailer or semi-trailer, does not exceed 3.5 tonnes;
- b) Vehicles used for the carriage of passengers which, by virtue of their construction and equipment, are suitable for carrying not more than nine persons, including the driver, and are intended for that purpose;
- c) Vehicles used for the carriage of passengers on regular services where the route covered by the service in question does not exceed 50 kilometres;
- d) Vehicles with a maximum authorized speed not exceeding 40 kilometres per hour;
- e) Vehicles owned or hired without a driver by the armed services, civil defence services, fire services, and forces responsible for maintaining public order when the carriage is undertaken as a consequence of the tasks assigned to these services and is under their control;
- f) Vehicles used in emergencies or rescue operations, including the non-commercial transport of humanitarian aid;
- g) Specialized vehicles used for medical purposes;
- h) Specialized breakdown vehicles operating within 100 kilometres of their base;
- i) Vehicles undergoing road tests for technical development, repair or maintenance purposes, and new or rebuilt vehicles which have not yet been put into service;
- j) Vehicles with a maximum permissible mass not exceeding 7.5 tonnes used for non-commercial carriage of goods;
- k) Commercial vehicles which have a historical status according to the legislation of the Contracting Party in which they are being driven and which are used for the non-commercial carriage of passengers or goods.

Article 3. Application of some provisions of the Agreement to road transport performed by vehicles registered in the territories of non-Contracting States

1 Each Contracting Party shall apply in its territory, in respect of international road transport performed by any vehicle registered in the territory of a State which is not a Contracting Party to this Agreement, provisions not less strict than those laid down in articles 5, 6, 7, 8, 9 and 10 of this Agreement.

- a) However, it shall be open to any Contracting Party, in the case of a vehicle registered in a State which is not a Contracting Party to this Agreement, merely to require, in lieu of a control device conforming to the specifications in the Annex to this Agreement, daily record sheets completed manually by each crew member for the period of time from the moment of entry into the territory of the first Contracting Party.
- b) For this purpose, each crew member shall write on his record sheet the information concerning his professional activities and rest periods, using the appropriate graphic symbols as defined in article 12 of the Annex to this Agreement.

Article 4. General principles

Each Contracting Party may apply higher minima or lower maxima than those laid down in articles 5 to 8 inclusive. Nevertheless, the provisions of this Agreement shall remain applicable to drivers, engaged in international road transport operations on vehicles registered in another Contracting or non-Contracting State.

Article 5. Crews

1 The minimum ages for drivers engaged in the carriage of goods shall be as follows:
- a) for vehicles, including, where appropriate, trailers or semi-trailers, having a permissible maximum weight of not more than 7.5 tonnes, 18 years;
- b) for other vehicles:
  - 21 years, or
  - 18 years provided that the person concerned holds a certificate of professional competence recognized by one of the Contracting Parties confirming that he has completed a training course for drivers of vehicles intended for the carriage of goods by road. Contracting Parties shall inform one another of the prevailing national minimum training levels and other relevant conditions relating to drivers engaged in international carriage of goods under this Agreement.

2 Any driver engaged in the carriage of passengers shall have reached the age of 21 years.

Any driver engaged in the carriage of passengers on journeys beyond a 50 kilometre radius from the place where the vehicle is normally based must also fulfil one of the following conditions:
- a) he must have worked for at least one year in the carriage of goods as a driver of vehicles with a permissible maximum weight exceeding 3.5 tonnes;
- b) he must have worked for at least one year as a driver of vehicles used to provide passenger services on journeys within a 50 kilometre radius from the place where the vehicle is normally based, or other types of passenger services not subject to this Agreement provided the competent authority considers that he has by so doing acquired the necessary experience;
- c) he must hold a certificate of professional competence recognized by one of the Contracting Parties confirming that he has completed a training course for drivers of vehicles intended for the carriage of passengers by road.

Article 6. Driving periods

1 The daily driving time, as defined in article 1, paragraph (s), of this Agreement, shall not exceed 9 hours. It may be extended to at most 10 hours not more than twice during the week.

2 The weekly driving time, as defined in article 1, paragraph (t), of this Agreement, shall not exceed 56 hours.

3 The total accumulated driving time during any two consecutive weeks shall not exceed 90 hours.

4 Driving periods shall include all driving in the territory of Contracting and non-Contracting Parties.

5 A driver shall record as other work any time spent as described in article 1, paragraph (q), as well as any time spent driving a vehicle used for commercial operations not falling within the scope of this Agreement, and shall record any periods of availability, as set out in article 12, paragraph 3 (c), of the Annex to this Agreement. This record shall be entered either manually on a record sheet or printout or by use of the manual input facilities of the recording equipment.

Article 6 bis. – Interruption of the daily rest period in the course of combined transport operations

Article 7. Breaks

1 After a driving period of four and a half hours, a driver shall take an uninterrupted break of not less than 45 minutes, unless he begins a rest period.

2 This break, as defined in article 1, paragraph (n), of this Agreement, may be replaced by a break of at least 15 minutes followed by a break of at least 30 minutes each distributed over the driving period or immediately after this period in such a way as to comply with the provisions of paragraph 1.

3 For the purposes of this article, the waiting time and time not devoted to driving spent in a vehicle in motion, a ferryboat or a train shall not be regarded as ‘other work’, as defined in article 1, paragraph (q), of this Agreement, and will be able to be qualified as a ‘break’.

4 The breaks observed under this article may not be regarded as daily rest periods.

Article 8. Rest periods

1 A driver shall take daily and weekly rest periods as defined in article 1, paragraphs (o) and (p).

2 Within each period of 24 hours after the end of the previous daily rest period or weekly rest period, a driver shall have taken a new daily rest period.

If the portion of the daily rest period which falls within that 24-hour period is at least 9 hours but less than 11 hours, then the daily rest period in question shall be regarded as a reduced daily rest period.

3 By way of derogation from paragraph 2, within 30 hours of the end of a daily or weekly rest period, a driver engaged in multi-manning must have taken a new daily rest period of at least 9 hours.

4 A daily rest period may be extended to make a regular weekly rest period or a reduced weekly rest period.

5 A driver may have at most three reduced daily rest periods between any two weekly rest periods.

- a) In any two consecutive weeks, a driver shall take at least:
  - (i) Two regular weekly rest periods; or
  - (ii) One regular weekly rest period and one reduced weekly rest period of at least 24 hours. However, the reduction shall be compensated by an equivalent period of rest taken en bloc before the end of the third week following the week in question.
  A weekly rest period shall start no later than at the end of six 24-hour periods from the end of the previous weekly rest period.
- b) By way of derogation from paragraph 6 (a), a driver engaged in a single service of international carriage of passengers, other than a regular service, may postpone the weekly rest period for up to twelve consecutive 24-hour periods following a previous regular weekly rest period, provided that:
  - (i) the service lasts at least 24 consecutive hours in a Contracting Party or a third country other than the one in which the service started, and
  - (ii) the driver takes after the use of the derogation:
    - a. either two regular weekly rest periods, or
    - b. one regular weekly rest period and one reduced weekly rest period of at least 24 hours. However, the reduction shall be compensated by an equivalent period of rest taken en bloc before the end of the third week following the end of the derogation period,
    and
  - (iii) four years after the country of registration has implemented the digital tachograph, the vehicle is equipped with recording equipment in accordance with the requirements of Appendix 1B of the Annex, and
  - (iv) after 1 January 2014, in case of driving during the period from 22:00 to 06:00, the vehicle is multi-manned or the driving period referred to in Article 7 is reduced to three hours.
- c) By way of derogation from paragraph 6 (a), drivers who are engaged in multi manning shall take each week a regular weekly rest period of at least 45 hours. This period may be reduced to a minimum of 24 hours (reduced weekly rest period). However, each reduction shall be compensated by an equivalent period of rest taken en bloc before the end of the third week following the week in question.
A weekly rest period shall start no later than at the end of six 24-hour periods from the end of the previous weekly rest period.

7 Any rest taken as compensation for a reduced weekly rest period shall be attached to another rest period of at least 9 hours.

8 Where a driver chooses to do this, daily rest periods and reduced weekly rest periods taken away from base may be taken in a vehicle, as long as it has specially fitted sleeping facilities for each driver as foreseen by the constructor’s design, and it is stationary.

9 A weekly rest period that falls in two weeks may be counted in either week, but not in both.

Article 8 bis. Derogations from article 8

1 By way of derogation from article 8, where a driver accompanies a vehicle which is transported by ferryboat or train and takes a regular daily rest period, that period may be interrupted not more than twice by other activities provided the following conditions are fulfilled:
- a) That part of the daily rest period spent on land must be able to be taken before or after the portion of the daily rest period taken on board the ferryboat or the train;
- b) The period between the portions of the daily rest period must be as short as possible and may on no account exceed a total of one hour before embarkation or after disembarkation, customs formalities being included in the embarkation or disembarkation operations.
During all the portions of the daily rest period, the driver shall have access to a bunk or couchette.

2 Any time spent travelling to a location to take charge of a vehicle falling within the scope of this Agreement, or to return from that location, when the vehicle is neither at the driver’s home nor at the employer’s operational centre where the driver is normally based, shall not be counted as a rest or break unless the driver is in a ferryboat or train and has access to suitable sleeping facilities.

3 Any time spent by a driver driving a vehicle which falls outside the scope of this Agreement to or from a vehicle which falls within the scope of this Agreement and which is not at the driver’s home or at the employer’s operational centre where the driver is normally based shall count as ‘other work’.

Article 9. Exceptions

Provided that road safety is not thereby jeopardized and to enable him to reach a suitable stopping place, the driver may depart from the provisions of this Agreement to the extent necessary to ensure the safety of persons, of the vehicle or of its load. The driver shall indicate the nature of and reason for his departure from those provisions on the record sheet or on a printout of the control device or in his duty roster, at the latest on arrival at a suitable stopping place.

Article 10. Control device

1 The Contracting Parties shall prescribe the installation and use on vehicles registered in their territory of a control device according to the requirements of this Agreement and the Annex and Appendices thereto.

2 The control device within the sense of this Agreement shall, as regards construction, installation, use and testing, comply with the requirements of this Agreement and the Annex and Appendices thereto.

3 A control device conforming to Council Regulation (EEC) No. 3821/85 of 20 December 1985 as regards construction, installation, use and testing shall be considered as conforming to the requirements of this Agreement and the Annex and Appendices thereto.

Article 11. Supervision by the undertaking

1 The undertaking shall organize road transport operations and properly instruct crew members so that they are able to comply with the provisions of this Agreement.

2 It shall make a regular check of driving periods, hours of other work and rest periods by referring to all documents at its disposal such as the individual control books. Should it discover any breach of this Agreement it shall take prompt action to end it and to avoid its repetition, for example by changing hours of work and routes.

3 Payments to wage-earning drivers, even in the form of bonuses or wage supplements, related to distances travelled and/or the amount of goods carried shall be prohibited, unless these payments are of such a kind as not to endanger road safety or encourage breaches of this Agreement.

4 A transport undertaking shall be liable for infringements committed by drivers of the undertaking, even if the infringement was committed in the territory of another Contracting Party or a non-Contracting Party.

Without prejudice to the right of Contracting Parties to hold transport undertakings fully liable, Contracting Parties may make this liability conditional on the undertaking’s infringement of paragraphs 1 and 2. Contracting Parties may consider any evidence that the transport undertaking cannot reasonably be held responsible for the infringement committed.

5 Undertakings, consignors, freight forwarders, tour operators, principal contractors, subcontractors and driver employment agencies shall ensure that contractually agreed transport time schedules respect this Agreement.

Article 12. Measures of enforcement of the Agreement

1 Each Contracting Party shall adopt all appropriate measures to ensure observance of the provisions of this Agreement, in particular by an adequate level of roadside checks and checks performed on the premises of undertakings annually covering a large and representative proportion of drivers, undertakings and vehicles of all transport categories coming within the scope of this Agreement.
- a) The competent administrations of the Contracting Parties shall organize the checks so that:
  - (i) During each calendar year, a minimum of 1% of the days worked by the drivers of vehicles to which this Agreement applies shall be checked. From 1 January 2010, this percentage will increase to at least 2%, and from 1 January 2012, to at least 3%;
  - (ii) At least 15% of the total number of working days checked shall be checked at the roadside and at least 25% on the premises of undertakings. From 1 January 2010, not less than 30% of the total number of working days checked shall be checked at the roadside and not less than 50% shall be checked on the premises of undertakings.
- b) The elements of roadside checks shall include:
  - (i) Daily and weekly driving periods, interruptions and daily and weekly rest periods;
  - (ii) The record sheets of the preceding days, which shall be on board the vehicle, and/or the data stored for the same period on the driver card and/or in the memory of the control device and/or on the printouts, when required;
  - (iii) The correct functioning of the control device.
  These checks shall be carried out without discrimination among vehicles, undertakings and drivers whether resident or not, and regardless of the origin or destination of the journey or type of tachograph.
- c) The elements of checks on the premises of undertakings shall include, apart from the elements subject to roadside checks and compliance with the provisions of article 11, paragraph 2, of the Annex:
  - (i) Weekly rest periods and driving periods between these rest periods;
  - (ii) Two-weekly limits on hours of driving;
  - (iii) Compensation for weekly rest periods reduced in accordance with article 8, paragraph 6;
  - (iv) Use of record sheets and/or vehicle unit and driver card data and printouts and/or the organization of drivers’ working time.

2 Within the framework of mutual assistance, the competent authorities of the Contracting Parties shall regularly send one another all available information concerning:

– Breaches of this Agreement committed by non-residents and any penalties imposed for such breaches;

– Penalties imposed by a Contracting Party on its residents for such breaches committed on the territory of other Contracting Parties.

In case of serious breaches, such information shall include the penalty imposed.

3 If the findings of a roadside check on the driver of a vehicle registered in the territory of another Contracting Party provide grounds to believe that infringements have been committed which cannot be detected during the check due to lack of necessary data, the competent authorities of the Contracting Party concerned shall assist each other to clarify the situation. In cases where, to this end, the competent Contracting Party carries out a check at the premises of the undertaking, the results of this check shall be communicated to the other Party concerned.

4 Contracting Parties shall work in cooperation with each other in the organization of concerted roadside checks.

5 The United Nations Economic Commission for Europe shall issue a report every two years on the application by Contracting Parties of paragraph 1 of the present article.

- a) A Contracting Party shall authorize its competent authorities to impose a penalty on a driver for an infringement of this Agreement detected on its territory and for which a penalty has not already been imposed, even if that infringement has been committed in the territory of another Contracting Party or of a non-Contracting Party;
- b) A Contracting Party shall authorize its competent authorities to impose a penalty on an undertaking for an infringement of this Agreement detected on its territory and for which a penalty has not already been imposed, even if that infringement has been committed in the territory of another Contracting Party or of a non-Contracting Party.
By way of exception, when an infringement is detected which has been committed by an undertaking established in another Contracting Party or in a non-Contracting Party, the imposing of sanctions shall conform to the procedure foreseen in the bilateral road transport agreement between the Parties concerned.

Contracting Parties will examine, starting from 2011, the possibility of removing the exception in paragraph 6 (b), on the basis of the readiness of all Contracting Parties.

7 Whenever a Contracting Party initiates proceedings or imposes a penalty for a particular infringement, it shall provide the driver with due evidence of this in writing.

8 Contracting Parties shall ensure that a system of proportionate penalties, which may include financial penalties, is in force for infringements of this Agreement on the part of undertakings, or associated consignors, freight forwarders, tour operators, principal contractors, subcontractors and driver employment agencies.

Article 12 bis. Model standardized forms

1 To facilitate international roadside checks, model standardized forms will be introduced, for use when required, in the Annex to this Agreement, which will be supplemented accordingly by a new Appendix 3. These forms will be introduced or amended in accordance with the procedure defined in article 22 ter.

2 The model forms shown in Appendix 3 are in no way binding. However, if they are used, they shall respect the contents as defined, in particular the numbering, order and titles of items.

3 Contracting Parties may supplement these data with additional information to satisfy national or regional requirements. This additional information must under no circumstances be required for transport originating in another Contracting Party or third country. For this purpose, it shall appear on the form totally separated from data defined for international traffic.

4 These forms shall be accepted at any roadside check carried out in the territory of Contracting Parties to this Agreement.

Article 13. Transitional provisions

1 All the new provisions of the present Agreement, including its Annex and Appendices 1B and 2, relating to the introduction of a digital control device, shall become mandatory for countries which are Contracting Parties to this Agreement at latest four years after the date of entry into force of the relevant amendments resulting from the procedure specified in article 21. In consequence, all vehicles covered by this Agreement, put into service for the first time after the expiry of this period, shall be equipped with a control device conforming to these new requirements. During this four-year period, Contracting Parties, which have not yet implemented these amendments in their countries, shall accept and control on their territory vehicles registered in another Contracting Party to this Agreement, which are already equipped with such a digital control device.

- a) The Contracting Parties shall take the necessary steps to be able to issue the driver cards referred to in the Annex to the present Agreement, as amended, at latest three months before the expiry of the four-year deadline referred to in paragraph 1. This minimum period of three months shall also be complied with in the event of the implementation by a Contracting Party of the provisions relating to the digital control device in conformity with Appendix 1B to this Annex before the expiry of the four-year deadline. Such Contracting Parties shall keep the secretariat of the Working Party on Road Transport of the Economic Commission for Europe informed of progress in the introduction of the digital control device in conformity with Appendix 1B to this Annex within its territory.
- b) Pending the issue by Contracting Parties of the cards referred to in a), the provisions of article 14 of the Annex to this Agreement shall apply to drivers who may be required to drive vehicles fitted with a digital control device in accordance with Appendix 1B to this Annex.

3 Any instrument of ratification or accession deposited by a State after the entry into force of the amendments referred to in paragraph 1 shall be deemed to apply to the Agreement as amended, including the deadline for implementation specified in paragraph 1.

If accession takes place less than two years before the expiry of the deadline referred to in paragraph 1, the State shall inform the depositary of the date on which the digital control device will be brought into effective use in its territory when it deposits its instrument of ratification or accession. Such State may make use of a transitional period not exceeding two years from the date of entry into force of the Agreement for the State. The depositary shall so inform all Contracting Parties.

The provisions of the preceding paragraph shall also apply in the event of the accession of a State after the expiry of the four-year deadline for implementation referred to in paragraph 1.

Article 13 bis. Transitional provisions

The provisions referred to at the end of article 12, paragraphs 7 (a) and 7 (b), of the Annex to this Agreement shall apply three months after the present amendment has entered into force.

Final provisions

Article 14

1 This Agreement shall be open for signature until 31 March 1971 and thereafter for accession, by States members of the Economic Commission for Europe and States admitted to the Commission in a consultative capacity under paragraph 8 or 11 of the Commission's terms of reference. Accessions under paragraph 11 of the Commission's terms of reference shall be limited to the following States: Algeria, Egypt, Jordan, Lebanon, Morocco and Tunisia.

2 This Agreement shall be ratified.

3 The instruments of ratification or accession shall be deposited with the Secretary-General of the United Nations.

4 This Agreement shall enter into force on the one hundred and eightieth day after the date of deposit of the eighth instrument of ratification or accession.

5 In respect of each State which ratifies, or accedes to, this Agreement after the deposit of the eighth instrument of ratification or accession as referred to in paragraph 4 of this article, the Agreement shall enter into force one hundred and eighty days after the deposit by that State of its instrument of ratification or accession.

Article 15

1 Any Contracting Party may denounce this Agreement by notice addressed to the Secretary-General of the United Nations.

2 The denunciation shall take effect six months after the date on which the Secretary-General receives notice thereof.

Article 16

This Agreement shall cease to have effect if for any period of twelve consecutive months after its entry into force the number of Contracting Parties is less than three.

Article 17

1 Any State may, at the time of signing this Agreement or of depositing its instrument of ratification or accession or at any time thereafter, declare by notification addressed to the Secretary-General of the United Nations that the validity of the Agreement shall be extended to all or any of the territories for the international relations of which it is responsible. The Agreement shall apply to the territory or territories named in the notification as from the one hundred and eightieth day after receipt of the notification by the Secretary-General or, if on that day the Agreement has not yet entered into force, as from the date of its entry into force.

2 Any State which has made a declaration under the preceding paragraph making this Agreement applicable to a territory for whose international relations it is responsible may denounce the Agreement separately in respect of that territory in conformity with the provisions of article 15 hereof.

Article 18

1 Any dispute between two or more Contracting Parties concerning the interpretation or application of this Agreement shall so far as possible be settled by negotiation between them.

2 Any dispute which is not settled by negotiation shall be submitted to arbitration if any one of the Contracting Parties concerned in the dispute so requests and shall accordingly be referred to one or more arbitrators selected by agreement between the Parties in dispute. If within three months from the date of the request for arbitration the Parties in dispute are unable to agree on the selection of an arbitrator or arbitrators, any of those Parties may request the Secretary-General of the United Nations to appoint a single arbitrator to whom the dispute shall be referred for decision.

3 The decision of the arbitrator or arbitrators appointed under the preceding paragraph shall be binding on the Contracting Parties in dispute.

Article 19

1 Any State may, at the time of signing, ratifying, or acceding to, this Agreement, declare that it does not consider itself bound by article 18, paragraphs 2 and 3 hereof. The other Contracting Parties shall not be bound by the said paragraphs with respect to any Contracting Party which has entered such a reservation.

2 If at the time of depositing its instrument of ratification or accession a State enters a reservation other than that provided for in paragraph 1 of this article, the Secretary-General of the United Nations shall communicate the reservation to the States which have previously deposited their instruments of ratification or accession and have not since denounced this Agreement. The reservation shall be deemed to be accepted if none of the said States has, within six months after such communication, expressed its opposition to acceptance of the reservation. Otherwise the reservation shall not be admitted, and, if the State which entered the reservation does not withdraw it the deposit of that State's instrument of ratification or accession shall be without effect. For the purpose of the application of this paragraph the opposition of States whose accession or ratification is, in virtue of this paragraph without effect by reason of reservations entered by them, shall be disregarded.

3 Any Contracting Party whose reservation has been adopted in the Protocol of signature of this Agreement or who has entered a reservation pursuant to paragraph 1 of this article, or made a reservation which has been accepted pursuant to paragraph 2 of this article may at any time withdraw such reservation by a notification addressed to the Secretary-General.

Article 20

1 After this Agreement has been in force for three years any Contracting Party may, by a notification addressed to the Secretary-General of the United Nations, request that a conference be convened for the purpose of revising the Agreement. The Secretary-General shall notify all Contracting Parties of the request and shall convene a revision conference if not less than one-third of the Contracting Parties signify their assent to the request within a period of four months from the date of the notification by the Secretary-General.

2 If a conference is convened in conformity with the preceding paragraph the Secretary-General shall notify all the Contracting Parties and invite them to submit within a period of three months such proposals as they wish the conference to consider. The Secretary-General shall circulate to all Contracting Parties the provisional agenda for the conference, together with the text of such proposals, not less than three months before the date on which the conference is to meet.

3 The Secretary-General shall invite to any conference convened under this article all the States referred to in article 14, paragraph 1, of this Agreement.

Article 21

1 Any Contracting Party may propose one or more amendments to this Agreement. The text of any proposed amendment shall be communicated to the Secretary-General of the United Nations, who shall communicate it to all Contracting Parties and inform thereof all the other States referred to in article 14, paragraph 1, of this Agreement.

2 Within a period of six months from the date on which the proposed amendment is communicated by the Secretary-General, any Contracting Party may inform the Secretary-General:
- (a) that it has an objection to the amendment proposed; or
- (b) that, although it intends to accept the proposal, the conditions necessary for such acceptance are not yet fulfilled in its State.

3 If a Contracting Party sends to the Secretary-General a communication such as is provided for in paragraph 2 (b) of this article, it may, so long as it has not notified the Secretary-General of its acceptance of the proposed amendment, submit an objection to the proposed amendment within a period of nine months following the expiry of the six-month period provided for its communication.

4 If an objection to the proposed amendment is stated in accordance with the terms of paragraphs 2 and 3 of this article, the amendment shall be deemed not to have been accepted and shall be of no effect.

5 If no objection to the proposed amendment has been stated under paragraphs 2 and 3 of this article, then the amendment shall be deemed to have been accepted as from the date specified below:
- (a) if no Contracting Party has sent a communication to the Secretary-General under paragraph 2 (b) of this article: on the expiry of the period of six months referred to in paragraph 2 of this article;
- (b) if any Contracting Party has sent a communication to the Secretary-General under paragraph 2 (b) of this article: on the earlier of the following two dates:
  - - the date by which all the Contracting Parties which sent such communications have notified the Secretary-General of their acceptance of the proposal, subject to the proviso that, if all the acceptances were notified before the expiry of the period of six months referred to in paragraph 2 of this article, this date shall be taken to be the date of expiry of the said six-month period;
  - - the date of expiry of the period of nine months referred to in paragraph 3 of this article.

5 bis In the case of a country which becomes a Contracting Party to this Agreement between the moment of notification of a draft amendment and the moment when it is considered accepted, the secretariat of the Working Party on Road Transport of the Economic Commission for Europe shall notify the new State Party of the draft amendment as soon as possible. The latter may inform the Secretary-General of any objection before the end of the six-month period from the date of transmission of the original amendment to all Contracting Parties.

6 Any amendment deemed to be accepted shall enter into force three months after the date on which it was deemed to be accepted.

7 The Secretary-General shall as soon as possible notify all Contracting Parties whether an objection to the proposed amendment has been stated under paragraph 2 (a) of this article and whether he has received from one or more Contracting Parties a communication under paragraph 2 (b) of this article. If he has received such a communication from one or more Contracting Parties, he shall subsequently inform all the Contracting Parties whether the Contracting Party or Parties which have made such a communication raise an objection to or accept the proposed amendment.

8 Independently of the amendment procedure laid down in paragraphs 1 to 6 of this article, the annex to this Agreement may be modified by agreement between the competent administrations of all the Contracting Parties; if the competent administration of a Contracting Party has stated that under its domestic law its agreement is contingent on special authorization for the purpose, or on the approval of a legislative body, the consent of the competent administration of the Contracting Party concerned to the modification of the annex shall not be deemed to have been given until the said competent administration has notified the Secretary-General that the necessary authorization or approval has been obtained. The agreement between the competent administrations shall appoint the date of entry into force of the modified annex, and may provide that, during a transitional period, the old annex shall remain in force, wholly or in part, concurrently with the modified annex.

Article 22

1 Appendices 1 and 2 to the annex to this Agreement may be amended by the procedure specified in this article.

2 At the request of a Contracting Party, any amendments proposed to appendices 1 and 2 to the annex to this Agreement shall be considered by the Principal Working Party on Road Transport of the Economic Commission for Europe.

3 If it is adopted by the majority of the members present and voting, and if this majority includes the majority of the Contracting Parties present and voting, the amendment shall be communicated by the Secretary-General to the competent administrations of all the Contracting Parties for acceptance.

4 The amendment shall be accepted if, within a period of six months following the date of notification, less than one-third of the competent administrations of the Contracting Parties notify the Secretary-General of their objection to the amendment.

4 bis In the case of a country which becomes a Party to this Agreement between the moment of notification of a draft amendment and the moment when it is considered accepted, the secretariat of the Working Party on Road Transport of the Economic Commission for Europe shall notify the new State Party of the draft amendment as soon as possible. The latter may inform the Secretary-General of any objection before the end of the six-month period from the date of transmission of the original amendment to all Contracting Parties.

5 Any amendment accepted shall be communicated by the Secretary-General to all the Contracting Parties and shall come into force three months after the date of its notification.

Article 22 bis. Procedure for the amendment of Appendix 1B

1 Appendix 1B of the Annex to the present Agreement shall be amended according to the procedure defined in the present article.

2 Any amendment proposal to the introductory articles of Appendix 1B shall be adopted by the Working Party on Road Transport of the Economic Commission for Europe by a majority of the Contracting Parties present and voting. Any amendment thus adopted will be transmitted by the secretariat of the Working Party to the Secretary-General for notification to all Contracting Parties. It shall enter into force three months after the date of notification to Contracting Parties.

3 Appendix 1B, adapted for the present Agreement from Annex IB1 of Regulation (EEC) 3821/85 as cited in article 10 of the present Agreement, depending directly on evolutions introduced into this Annex by the European Union, any amendment made to this Annex shall be applicable to Appendix 1B under the following conditions: of Regulation (EEC) 3821/85 as cited in article 10 of the present Agreement, depending directly on evolutions introduced into this Annex by the European Union, any amendment made to this Annex shall be applicable to Appendix 1B under the following conditions:
- – the secretariat of the Working Party on Road Transport of the Economic Commission for Europe will officially inform the competent authorities of all Contracting Parties of the publication in the Official Journal of the European Communities of the amendments introduced to Annex IB of the Community Regulation and at the same time will communicate this information to the Secretary-General accompanied by a copy of the relevant texts.
- – these amendments shall enter directly into force for Appendix 1B three months after the date of communication to Contracting Parties of the information.

4 When a proposal to amend the Annex to the present Agreement also implies an amendment to Appendix 1B, the amendments concerning the Appendix may not enter into force before those concerning the Annex. When, in this framework, amendments to Appendix 1B are presented at the same time as amendments to the Annex, their date of entry into force shall be determined by the date resulting from application of the procedures outlined in article 21.

Article 22 ter. Procedure for amending Appendix 3

1 Appendix 3 to the Annex to this Agreement shall be amended in accordance with the following procedure.

2 Any proposal to introduce into Appendix 3 model forms according to article 12 bis of this Agreement or modify existing forms shall be submitted, for adoption, to the Working Party on Road Transport of the Economic Commission for Europe. The proposal shall be deemed accepted if adopted by the majority of Contracting Parties present and voting.

The secretariat of the Economic Commission for Europe will officially inform the competent authorities of all Contracting Parties to this Agreement of any amendment thus adopted and, at the same time, will communicate this information to the Secretary-General accompanied by a copy of the relevant text.

3 Any model form thus adopted may be used three months after the date of communication of the information to Contracting Parties to this Agreement.

Article 23

In addition to the notifications referred to in articles 20 and 21 of this Agreement, the Secretary-General of the United Nations shall notify the States referred to in article 14, paragraph 1, hereof of

(a) ratifications or accessions under article 14 of this Agreement;
(b) the dates of entry into force of the present Agreement, in conformity with article 14 hereof;
(c) denunciations under article 15 of this Agreement;
(d) the termination of this Agreement in conformity with article 16 hereof;
(e) notifications received under article 17 of this Agreement;
(f) declarations and notifications received under article 19 of this Agreement;
(g) the entry into force of any amendment in conformity with article 21 of this Agreement.

Article 24

The Protocol of signature of this Agreement shall have the same force, validity and duration as the Agreement itself, of which it shall be deemed to be an integral part

Article 25

After 31 March 19712 the original of this Agreement shall be deposited with the Secretary-General of the United Nations, who shall transmit certified true copies to each of the countries referred to in article 14, paragraph 1, hereof.

IN WITNESS WHEREOF the undersigned, being duly authorized thereto, have signed this Agreement.

DONE at Geneva, this first day of July nineteen hundred and seventy, in a single copy, in the English and French languages, the two texts being equally authentic.

ANNEX Control device

General Provisions

Chapter I. Type approval

Article 1

For the purposes of this Chapter, the words “control device” shall mean “control device or its components”.

Applications for the approval of a type of control device or of a model record sheet or memory card shall be submitted, accompanied by the appropriate specifications, by the manufacturer or his agent to a Contracting Party. No application in respect of any one type of control device or of any one model record sheet or memory card may be submitted to more than one Contracting Party.

Article 2

A Contracting Party shall grant its type approval to any type of control device, to any model record sheet or memory card which conforms to the requirements laid down in Appendix 1 or 1B to this Annex, provided that the Contracting Party is in a position to check that production models conform to the approved prototype.

The control device referred to in Appendix 1B may not be granted type approval until the whole system (the control device itself, driver card and electrical gearbox connections) has demonstrated its capacity to resist attempts to tamper with or alter the data on driving times. The tests necessary to establish this shall be carried out by experts familiar with up-to-date tampering techniques.

Any modifications or additions to an approved model must receive additional type approval from the Contracting Party which granted the original type approval.

Article 3

Contracting Parties shall issue to the applicant an approval mark, which shall conform to the model shown in Appendix 2, for each type of control device or model record sheet or memory card which they approve pursuant to article 2.

Article 4

The competent authorities of the Contracting Party to which the application for type approval has been submitted shall, in respect of each type of control device or model record sheet or memory card which they approve or refuse to approve, either send within one month to the authorities of the other Contracting Parties a copy of the approval certificate accompanied by copies of the relevant specifications, or, if such is the case, notify those authorities that approval has been refused; in cases of refusal they shall communicate the reasons for their decision.

Article 5

1 If a Contracting Party which has granted type approval as provided for in article 2 finds that a certain control device or record sheet or memory card bearing the type approval mark which it has issued does not conform to the prototype which it has approved, it shall take the necessary measures to ensure that production models conform to the approved prototype. The measures taken may, if necessary, extend to withdrawal of the type approval.

2 A Contracting Party which has granted type approval shall withdraw such approval if the control device or record sheet or memory card which has been approved is not in conformity with this Annex or its Appendices or displays in use any general defect which makes it unsuitable for the purpose for which it is intended.

3 If a Contracting Party which has granted type approval is notified by another Contracting Party of one of the cases referred to in paragraphs 1 and 2, it shall also, after consulting the latter Contracting Party, take the steps laid down in those paragraphs, subject to paragraph 5.

4 A Contracting Party which ascertains that one of the cases referred to in paragraph 2 has arisen may forbid until further notice the placing on the market and putting into service of the control device or record sheets or memory card. The same applies in the cases mentioned in paragraph 1 with respect to control devices or record sheets or memory cards which have been exempted from the initial verification, if the manufacturer, after due warning, does not bring the equipment into line with the approved model or with the requirements of this Annex.

In any event, the competent authorities of the Contracting Parties shall notify one another within one month, of any withdrawal of type approval or of any other measures taken pursuant to paragraphs 1, 2 and 3 and shall specify the reasons for such action.

5 If a Contracting Party which has granted type approval disputes the existence of any of the cases specified in paragraphs 1 or 2 notified to it, the Contracting Parties concerned shall endeavour to settle the dispute.

Article 6

1 An applicant for type approval of a model record sheet shall state on his application the type or types of control device on which the sheet in question is designed to be used and shall provide a suitable device of such type or types for the purpose of testing the sheet.

2 The competent authorities of each Contracting Party shall indicate on the approval certificate for the model record sheet the type or types of control device on which that model sheet may be used.

Article 7

No Contracting Party may refuse to register any vehicle fitted with a control device, or prohibit the entry into service or use of such vehicle for any reason connected with the fact that the vehicle is fitted with such device, if the control device bears the approval mark referred to in article 3 and the installation plaque referred to in article 9.

Article 8

All decisions pursuant to this Annex refusing or withdrawing approval of a type of control device or model record sheet or memory card shall specify in detail the reasons on which they are based. A decision shall be communicated to the party concerned, who shall at the same time be informed of the remedies available to him under the laws of the Contracting Party and of the time limits for the exercise of such remedies.

Chapter II. Installation and inspection

Article 9

1 The control device may be installed or repaired only by fitters or workshops approved by the competent authorities of Contracting Parties for that purpose after the latter, should they so desire, have heard the views of the manufacturers concerned.

The period of administrative validity of approved workshop and fitter cards shall not exceed one year.

If a card issued to an approved workshop or fitter is to be extended, is damaged, malfunctions, is lost or stolen, the authority shall supply a replacement card within five working days of receiving a detailed request to that effect.

Where a new card is issued to replace an old one, the new card shall bear the same “workshop” information number, but the index shall be increased by one. The authority issuing the card shall maintain a register of lost, stolen or defective cards.

Contracting Parties shall take any measure necessary to prevent the cards distributed to approved fitters and workshops from being falsified.

2 The approved fitter or workshop shall place a special mark on the seals which it affixes and, in addition, shall enter for a control device in conformity with Appendix 1B, the electronic security data for carrying out, in particular, the authentication checks. The competent authorities of each Contracting Party shall maintain a register of the marks and electronic security data used and of approved workshop and fitter cards issued.

3 The competent authorities of the Contracting Parties shall send each other their lists of approved fitters and workshops and the cards issued to them and also copies of the marks and of the necessary information relating to the electronic security data used.

4 For the purpose of certifying that installation of the control device took place in accordance with the requirements of this Annex an installation plaque affixed as provided in Appendix 1 or 1B shall be used.

5 Seals may be removed by fitters or workshops approved by the competent authorities in accordance with the provisions of paragraph 1 of this article or in the circumstances described in Appendix 1 or 1B of this Annex.

Chapter III. Use of Equipment

Article 10

The employer and drivers shall ensure the correct functioning and proper use of, on the one hand, the control device and, on the other, the driver card where a driver is required to drive a vehicle fitted with a control device in conformity with Appendix 1B.

Article 11

1 The employer shall issue a sufficient number of record sheets to drivers of vehicles fitted with the control device in conformity with Appendix 1, bearing in mind the fact that these sheets are personal in character, the length of the period of service, and the possible obligation to replace sheets which are damaged, or have been taken by an authorized inspecting officer. The employer shall issue to drivers only sheets of an approved model suitable for use in the control device installed in the vehicle.

Where the vehicle is fitted with a control device in conformity with Appendix 1B, the employer and the driver shall ensure that, taking into account the length of the period of service, the printing on request referred to in Appendix 1B can be carried out correctly in the event of an inspection.

- a) The undertaking shall keep record sheets and printouts, whenever printouts have been made to comply with article 12, paragraph 1, in chronological order and in a legible form for at least a year after their use and shall give copies to the drivers concerned who request them. The undertaking shall also give copies of downloaded data from the driver cards to the drivers concerned who request them and the printed papers of these copies. The record sheets, printouts and downloaded data shall be produced or handed over at the request of any authorized inspecting officer.
- b) An undertaking which uses vehicles that are fitted with a control device complying with Appendix 1B of the present Annex and that fall within the scope of this Agreement shall:
  - (i) Ensure that all data are downloaded from the vehicle unit and driver card as regularly as is stipulated by the Contracting Party and that relevant data are downloaded more frequently so as to ensure that all data concerning activities undertaken by or for that undertaking are downloaded;
  - (ii) Ensure that all data downloaded from both the vehicle unit and driver card are kept for at least 12 months following recording and, should an inspecting officer request it, such data are accessible, either directly or remotely, from the premises of the undertaking.
For the purposes of this subparagraph, “downloaded” shall be interpreted in accordance with the definition laid down in Appendix 1B, Chapter I, point (s).

3 The driver card as defined in Appendix 1B shall be issued, at the request of the driver, by the competent authority of the Contracting Party where the driver has his normal residence.

A Contracting Party may require any driver subject to the provisions of the Agreement and normally resident on its territory to hold a driver card.
- a) For the purposes of this Agreement ‘normal residence’ means the place where a person usually lives, that is for at least 185 days in each calendar year, because of personal and occupational ties, or, in the case of a person with no occupational ties, because of personal ties which show close links between that person and the place where he is living.
  
  However, the normal residence of a person whose occupational ties are in a different place from his personal ties and who consequently lives in turn in different places situated in two or more Contracting Parties shall be regarded as being the place of his personal ties, provided that such person returns there regularly. This last condition need not be met where the person is living in a Contracting Party in order to carry out a fixed-term assignment.
- b) Drivers shall give proof of their place of normal residence by any appropriate means, such as their identity card or any other valid document.
- c) Where the competent authorities of the Contracting Party issuing the driver card have doubts as to the validity of a statement as to normal residence made in accordance with point (b), or for the purpose of certain specific controls, they may request any additional information or evidence.
- d) The competent authority of the issuing Contracting Party shall, as far as this can be done, ensure that the applicant does not already hold a valid driver card.

- a) The competent authority of the Contracting Party shall personalize the driver card in accordance with the provisions of Appendix 1B.
  
  The period of administrative validity of the driver card shall not exceed five years.
  
  The driver may hold one valid driver card only. The driver is authorized to use only his own personalized driver card. The driver shall not use a driver card which is defective or which has expired.
  
  When a driver card is issued replacing an old one, the new card shall bear the same driver card issue number but the index shall be increased by one. The issuing authority shall keep records of issued, stolen, lost or defective driver cards for a period at least equivalent to their period of validity.
  
  If the driver card is damaged, malfunctions or is lost or stolen, the authority shall supply a replacement card within five working days of receiving a detailed request to that effect.
  
  In the event of a request for the renewal of a card whose expiry date is approaching, the authority shall supply a new card before the expiry date provided that the request was sent to it within the time limits laid down in the fourth subparagraph of article 12 (1).
- b) Driver cards shall be issued only to applicants who are subject to the provisions of the Agreement.
- c) The driver card shall be personal. It may not, during its official period of validity, be withdrawn or suspended for whatever reason unless the competent authority of a Contracting Party finds that the card has been falsified, or the driver is using a card of which he is not the holder, or that the card held has been obtained on the basis of false declarations and/or forged documents. If such suspension or withdrawal measures are taken by a Contracting Party other than the Contracting Party of issue, the former shall return the card to the authorities of the Contracting Party which issued it and shall indicate the reasons for returning it.
- d) Driver cards issued by Contracting Parties shall be mutually recognized.
  
  Where the holder of a valid driver card issued by a Contracting Party has established his normal place of residence in another Contracting Party, he may ask for his card to be exchanged for an equivalent driver card; it shall be the responsibility of the Contracting Party which carries out the exchange to verify if necessary whether the card produced is actually still valid.
  
  Contracting Parties carrying out an exchange shall return the old card to the authorities of the Contracting Party of issue and indicate the reasons for so doing.
- e) Where a Contracting Party replaces or exchanges a driver card, the replacement or exchange, and any subsequent replacement or renewal, shall be registered in that Contracting Party.
- f) Contracting Parties shall take all the necessary measures to prevent any possibility of driver cards being falsified.

5 Contracting Parties shall ensure that data needed to monitor compliance with the present Agreement which are recorded and stored by the control device in conformity with Appendix 1B to this Annex can be stored for 365 days after the date of their recording and that they can be made available under conditions that guarantee the security and accuracy of the data.

Contracting Parties shall take any measures necessary to ensure that the resale or decommissioning of a control device cannot detract, in particular, from the satisfactory application of this paragraph.

Article 12

1 Drivers shall not use dirty or damaged record sheets or driver card. The sheets or driver card shall be adequately protected on this account.

In case of damage to a sheet or driver card bearing recordings, drivers shall attach the damaged sheet or driver card to a spare sheet or a appropriate sheet used to replace it.

If the driver card is damaged, malfunctions or is lost or stolen, the driver shall apply within seven calendar days for its replacement to the competent authorities of the Contracting Party in which he has his normal residence.

Where a driver wishes to renew his driver card, he shall apply to the competent authorities of the Contracting Party in which he has his normal residence not later than 15 working days before the expiry date of the card.

- a) Drivers shall use the record sheets or driver card every day on which they are driving, starting from the moment they take over the vehicle. The record sheet or driver card shall not be withdrawn before the end of the daily working period unless its withdrawal is otherwise authorized. No record sheet or driver card may be used to cover a period longer than that for which it is intended.
  
  When there is more than one driver on board a vehicle fitted with a control device in conformity with Appendix 1B, each driver shall ensure that his driver card is inserted in the correct slot in the tachograph.
- b) When, as a result of being away from the vehicle, a driver is unable to use the control device fitted to the vehicle, the periods of time indicated in paragraph 3, second indent, (b), (c) and (d), below shall:
  - (i) If the vehicle is fitted with a control device in conformity with Appendix 1, be entered on the record sheet, either manually, by automatic recording or other means, legibly and without dirtying the sheet; or
  - (ii) If the vehicle is fitted with a control device in conformity with Appendix 1B, be entered on the driver card using the manual entry facility provided in the recording equipment.
- c) Drivers shall amend the record sheets as necessary should there be more than one driver on board the vehicle, so that the information referred to in paragraph 3, second indent, (b), (c) and (d), below is recorded on the record sheet of the driver who is actually driving.

3 Drivers shall:
- – ensure that the time recorded on the sheet agrees with the official time in the country of registration of the vehicle,
- – operate the switch mechanisms enabling the following periods of time to be recorded separately and distinctly:
  - a) under the sign
    
    or
    
    3 driving time;
  - b) under the sign
    
    or
    
    4 all other periods of work;
  - c) under the sign
    
    or
    
    5 other periods of availability, namely:
    - – waiting time, i.e. the period during which drivers need remain at their posts only for the purpose of answering any calls to start or resume driving or to carry out other work,
    - – time spent beside the driver while the vehicle is in motion,
    - – time spent on a bunk while the vehicle is in motion;
  - d) under the sign
    
    or
    
    6 breaks in work and daily rest periods.

4 Each Contracting Party may permit all the periods referred to in paragraph 3, second indent (b) and (c) to be recorded under the sign

on the record sheets used on vehicles registered in its territory.

5 Each crew member concerned shall enter the following information on his record sheet:
- a) on beginning to use the sheet - his surname and first name;
- b) the date and place where use of the sheet begins and the date and place where such use ends;
- c) the registration number of each vehicle to which he is assigned, both at the start of the first journey recorded on the sheet and then, in the event of a change of vehicle, during use of the sheet;
- d) the odometer reading:
  - -
    at the start of the first journey recorded on the sheet,
  - -
    at the end of the last journey recorded on the sheet,
  - -
    in the event of a change of vehicle during a working day (reading on the vehicle to which he was assigned and reading on the vehicle to which he is assigned);
- e) if relevant, the time of any change of vehicle.

5 bis The driver shall enter in the control device in conformity with Appendix 1B the symbols of the countries in which he begins and ends his daily work period.

The above data entries shall be activated by the driver, and may be entirely manual or automatic if the control device is linked to a satellite tracking system.

6 The control device defined in Appendix 1 shall be so designed that it is possible for an authorized inspecting officer, if necessary after opening the equipment, to read the recordings relating to the nine hours preceding the time of the check without permanently deforming, damaging or soiling the sheet.

The device shall, furthermore, be so designed that it is possible, without opening the case, to verify that recordings are being made.

- a) Where the driver drives a vehicle fitted with a control device in conformity with Appendix 1, he must be able to produce, whenever an inspecting officer so requests:
  - (i) The record sheets for the current week and those used by the driver in the previous 15 calendar days;
  - (ii) The driver card, if he holds one; and
  - (iii) Any manual record and printout made during the current week and the previous 15 calendar days, as required under this Agreement.
    
    From the date of application defined in article 13 bis of this Agreement, the time periods referred to under (i) and (iii) shall cover the current day and the previous 28 calendar days.
- b) Where the driver drives a vehicle fitted with a control device in conformity with Appendix 1B, he must be able to produce, whenever an inspecting officer so requests:
  - (i) The driver card of which he is holder;
  - (ii) Any manual record and printout made during the current week and the previous 15 calendar days, as required under this Agreement;
  - (iii) The record sheets corresponding to the same period as the one referred to in the previous subparagraph during which he drove a vehicle fitted with a control device in conformity with Appendix 1.
  From the date of application defined in article 13 bis of this Agreement, the time periods referred to under (ii) shall cover the current day and the previous 28 calendar days.
- c) An authorized inspecting officer may check compliance with the Agreement by analysis of the record sheets, of the displayed or printed data which have been recorded by the control device or by the driver card or, failing this, by analysis of any other supporting document that justifies non-compliance with a provision, such as those laid down in article 13 (2) and (3).

8 It shall be forbidden to falsify, suppress or destroy data recorded on the record sheet, stored in the control device or on the driver card, or print-outs from the control device as defined in Appendix 1B. The same applies to any manipulation of the control device, record sheet or driver card which may result in data and/or printed information being falsified, suppressed or destroyed. No device which could be used to carry out the manipulations mentioned shall be present on the vehicle.

Article 13

1 In the event of breakdown or faulty operation of the control device, the employer shall have it repaired by an approved fitter or workshop, as soon as circumstances permit.

If the vehicle is unable to return to the premises within a period of one week calculated from the day of the break-down or of the discovery of defective operation, the repair shall be carried out en route.

Measures taken by the Contracting Parties may give the competent authorities power to prohibit the use of the vehicle in cases where breakdown or faulty operation has not been put right as provided in the foregoing subparagraphs.

- a) While the device is unserviceable or malfunctioning, the driver shall mark on the record sheet or sheets, or on an appropriate sheet to be attached to the record sheet or to the driver card, on which he shall enter data enabling him to be identified (name and number of his driving licence or name and number of his driver card), including his signature, all information for the various periods of time which are no longer recorded or printed out correctly by the control device.
- b) Where a driver card is damaged, malfunctions, is lost or stolen, or is not in the possession of the driver, the driver shall:
  - (i) At the start of his journey, print out the details of the vehicle he is driving, and enter onto that printout:
    - – Details that enable the driver to be identified (name and number of his driving licence or name and number of his driver card), including his signature;
    - – The periods referred to in article 12, paragraph 3, second indent, points(b), (c) and (d);
  - (ii) At the end of his journey, print out the information relating to periods of time recorded by the control device, record any periods of other work, availability and rest undertaken since the printout that was made at the start of the journey, where not recorded by the tachograph, and mark on that document details that enable the driver to be identified (name and number of his driving licence or name and number of his driver card), including his signature.

3 If a driver card is damaged or if it malfunctions, the driver shall return it to the competent authority of the Contracting Party in which he has his normal residence. Theft of the driver card shall be the subject of a formal declaration to the competent authorities of the State where the theft occurred.

Loss of the driver card must be reported in a formal declaration to the competent authorities of the Contracting Party that issued it and to the competent authorities of the Contracting Party of normal residence where they are different.

The driver may continue to drive without a driver card for a maximum period of 15 calendar days or for a longer period if this is necessary for the vehicle to return to its premises, provided he can prove the impossibility of producing or using the card during this period.

Where the authorities of the Contracting Party in which the driver has his normal residence are different from those which issued his card and where the latter are requested to renew, replace or exchange the driver card, they shall inform the authorities which issued the old card of the precise reasons for its renewal, replacement or exchange.

Article 14

1 Pursuant to article 13, paragraph 2 (b) of the Agreement, drivers who are driving a vehicle registered in a Contracting Party and to whom the competent authorities have not yet been able to issue the driver cards and who, during the transitional period referred to in paragraph 1 of this article, drive in international traffic with a vehicle fitted with a digital control device in accordance with Appendix 1B to the Annex, must be able to produce, whenever an inspecting officer so requests, the printouts and/or the record sheets for the current week and, in any event, the printout and/or record sheet for the last day on which he drove during the previous week.

2 Paragraph 1 does not apply to drivers of vehicles registered in a country where it is obligatory to use a driver card. However, drivers shall produce printouts whenever an inspecting officer so requests.

3 The printouts referred to in paragraph 1 shall be marked with the details that enable the drivers to be identified (name and number of the driving licence), including their signature.

Annex - Appendix 1

REQUIREMENTS FOR CONSTRUCTION, TESTING, INSTALLATION AND INSPECTION

I. DEFINITIONS

In this appendix

a) ‘control device’ means equipment intended for installation in road vehicles to show and record automatically or semi-automatically details of the movement of those vehicles and of certain working periods of their drivers;
b) ‘record sheet’ means a sheet designed to accept and retain recorded data, to be placed in the control device and on which the marking devices of the latter inscribe a continuous record of the information to be recorded;
c) ‘constant of the control device’ means the numerical characteristic giving the value of the input signal required to show and record a distance travelled of 1 kilometre; this constant must be expressed either in revolutions per kilometre (k = ... rev/km), or in impulses per kilometre (k = ... imp/km);
d) ‘characteristic coefficient of the vehicle’ means the numerical characteristic giving the value of the output signal emitted by the part of the vehicle linking it with the control device (gearbox output shaft or axle) while the vehicle travels a distance of one measured kilometre under normal test conditions (see Chapter VI, paragraph 4 of this appendix). The characteristic coefficient is expressed either in revolutions per kilometre (W = rev/km) or in impulses per kilometre (W = ... imp/km);
e) ‘effective circumference of wheel tyres’ means the average of the distances travelled by the several wheels moving the vehicle (driving wheels) in the course of one complete rotation. The measurement of these distances must be made under normal test conditions (see Chapter VI, paragraph 4 of this appendix) and is expressed in the form: 1 = ... mm.

II. GENERAL CHARACTERISTICS AND FUNCTIONS OF CONTROL DEVICE

The control device must be able to record the following:

1. distance travelled by the vehicle;
2. speed of the vehicle;
3. driving time;
4. other periods of work or of availability;
5. breaks from work and daily rest periods;
6. opening of the case containing the record sheet;
7. for electronic control device which is device operating by signals transmitted electrically from the distance and speed sensor, any interruption exceeding 100 milliseconds in the power supply of the recording equipment (except lighting), in the power supply of the distance and speed sensor and any interruption in the signal lead to the distance and speed sensor.

For vehicles used by two drivers the control device must be capable of recording simultaneously but distinctly and on two separate sheets details of the periods listed under 3, 4 and 5.

III. CONSTRUCTION REQUIREMENTS FOR CONTROL DEVICE

A. GENERAL POINTS

1. Control device shall include the following:
- a) Visual instruments showing:
  - distance travelled (distance recorder),
  - speed (speedometer),
  - time (clock).
- b) Recording instruments comprising:
  - a recorder of the distance travelled,
  - a speed recorder,
  - one or more time recorders satisfying the requirements laid down in Chapter III C 4.
- c) A means of marking showing on the record sheet individually:
  - each opening of the case containing that sheet,
  - for electronic control device, as defined in point 7 of Chapter II, any interruption exceeding 100 milliseconds in the power supply of the control device (except lighting), not later than at switching-on the power supply again,
  - for electronic control device, as defined in point 7 of chapter II, any interruption exceeding 100 milliseconds in the power supply of the distance and speed sensor and any interruption in the signal lead to the distance and speed sensor.
2. Any inclusion of the equipment of devices additional to those listed above must not interfere with the proper operation of the mandatory devices or with the reading of them.

The control device must be submitted for approval complete with any such additional devices.
3. Materials
- a) All the constituent parts of the control device must be made of materials with sufficient stability and mechanical strength and stable electrical and magnetic characteristics.
- b) Any modification in a constituent part of the control device or in the nature of the materials used for its manufacture must, before being applied in manufacture, be submitted for approval to the authority which granted type-approval for the control device.
4. Measurement of distance travelled

The distances travelled may be measured and recorded either:
- so as to include both forward and reverse movement, or
- so as to include only forward movement.
Any recording of reversing movements must on no account affect the clarity and accuracy of the other recordings.
5. Measurement of speed
- a) The range of speed measurement shall be as stated in the type-approval certificate.
- b) The natural frequency and the damping of the measuring device must be such that the instruments showing and recording the speed can, within the range of measurement, follow acceleration changes of up to 2 m/s², within the limits of accepted tolerances.
6. Measurement of time (clock)
- a) The control of the mechanism for resetting the clock must be located inside a case containing the record sheet; each opening of that case must be automatically recorded on the record sheet.
- b) If the forward movement mechanism of the record sheet is controlled by the clock, the period during which the latter will run correctly after being fully wound must be greater by at least 10 per cent than the recording period corresponding to the maximum sheet-load of the equipment.
7. Lighting and protection
- a) The visual instruments of the control device must be provided with adequate non-dazzling lighting.
- b) For normal conditions of use, all the internal parts of the control must be protected against damp and dust. In addition they must be made proof against tampering by means of casings capable of being sealed.

B. VISUAL INSTRUMENTS

1. Distance travelled indicator (distance recorder)
- a) The value of the smallest grading on the control device showing distance travelled must be 0.1 kilometres. Figures showing hectometres must be clearly distinguishable from those showing whole kilometres.
- b) The figures on the distance recorder must be clearly legible and must have an apparent height of at least 4 mm.
- c) The distance recorder must be capable of reading up to at least 99,999.9 kilometres.
2. Speed indicators (speedometer)
- a) Within the range of measurement, the speed scale must be uniformly graduated by 1, 2, 5 or 10 kilometres per hour. The value of a speed graduation (space between two successive marks) must not exceed 10 per cent of the maximum speed shown on the scale.
- b) The range indicated beyond that measured need not be marked by figures.
- c) The length of each space on the scale representing a speed difference of 10 kilometres per hour must not be less than 10 millimetres.
- d) On an indicator with a needle, the distance between the needle and the control device face must not exceed 3 millimetres.
3. Time indicator (clock)

The time indicator must be visible from outside control device and give a clear, plain and unambiguous reading.

C. RECORDING INSTRUMENTS

1. General points
- a) All equipment, whatever the form of the record sheet (strip or disc) must be provided with a mark enabling the record sheet to be inserted correctly, in such a way as to ensure that the time shown by the clock and the time-marking on the sheet correspond.
- b) The mechanism moving the record sheet must be such as to ensure that the latter moves without play and can be freely inserted and removed.
- c) For record sheets in disc form, the forward movement device must be controlled by the clock mechanism. In this case, the rotating movement of the sheet must be continuous and uniform, with a minimum speed of 7 millimetres per hour measured at the inner border of the ring marking the edge of the speed recording area.
  
  In equipment of the strip type, where the forward movement device of the sheets is controlled by the clock mechanism the speed of rectilinear forward movement must be at least 10 millimetres per hour.
- d) Recording of the distance travelled, of the speed of the vehicle and of any opening of the case containing the record sheet or sheets must be automatic.
2. Recording distance travelled
- a) Every kilometre of distance travelled must be represented on the record by a variation of at least 1 millimetre on the corresponding co-ordinate.
- b) Even at speeds reaching the upper limit of the range of measurement, the record of distances must still be clearly legible.
3. Recording speed
- a) Whatever the form of the record sheet, the speed recording stylus must normally move in a straight line and at right angles to the direction of travel of the record sheet.
  
  However, the movement of the stylus may be curvilinear, provided the following conditions are satisfied:
  - the trace drawn by the stylus must be perpendicular to the average circumference (in the case of sheets in disc form) or to the axis (in the case of sheets in strip form) of the area reserved for speed recording,
  - the ratio between the radius of curvature of the trace drawn by the stylus and the width of the area reserved for speed recording must be not less than 2.4 to 1 whatever the form of the record sheet,
  - the markings on the time-scale must cross the recording area in a curve of the same radius as the trace drawn by the stylus. The spaces between the markings on the time-scale must represent a period not exceeding 1 hour.
- b) Each variation in speed of 10 kilometres per hour must be represented on the record by a variation of at least 1.5 millimetres on the corresponding co-ordinate.

4. Recording time

a) Control device must be so constructed that the period of driving time is always recorded automatically and that it is possible, through the operation where necessary of a switch device to record separately the other periods of time as follows:

(i) under the sign	: driving time;
(ii) under the sign	: all other periods of work;
(iii) under the sign	: other periods of availability,
namely:	waiting time, i.e. the period during which drivers need remain at their posts only for the purpose of answering any calls to start or resume driving or to carry out other work, time spent beside the driver while the vehicle is in motion, time spent on a bunk while the vehicle is in motion;
(iv) under the sign	: breaks in work and daily rest periods.

Each contracting party may permit all the periods referred to in subparagraphs (ii) and (iii) above to be recorded under the sign

on the record sheets used on vehicles registered in its territory.

b) It must be possible, from the characteristics of the traces, their relative positions and if necessary the signs laid down in paragraph 4(a) to distinguish clearly between the various periods of time.

The various periods of time should be differentiated from one another on the record by differences in the thickness of the relevant traces, or by any other system of at least equal effectivenes from the point of view of legibility and ease of interpretation of the record.
c) In the case of vehicles with a crew consisting of more than one driver, the recordings provided for in paragraph 4(a) must be made on two separate sheets, each sheet being allocated to one driver. In this case, the forward movement of the separate sheets must be effected either by a single mechanism or by separate synchronized mechanisms.

D. CLOSING DEVICE

1. The case containing the record sheet or sheets and the control of the mechanism for resetting the clock must be provided with a lock.
2. Each opening of the case containing the record sheet or sheets and the control of the mechanism for resetting the clock must be automatically recorded on the sheet or sheets.

E. MARKINGS

1. The following markings must appear on the instrument face of the control device:
- close to the figure shown by the distance recorder, the unit of measurement of distance, indicated by the abbreviation ‘km’,
- near the speed scale, the marking ‘km/h’,
- the measurement range of the speedometer in the form ‘Vmin ... km/h, Vmax ... km/h’. This marking is not necessary if it is shown on the descriptive plaque of the equipment.
However, these requirements shall not apply to control devices approved before 10 August 1970.
2. The descriptive plaque must be built into the equipment and must show the following markings, which must be visible on the control device when installed.
- name and address of the manufacturer of the equipment,
- manufacturer’s number and year of construction,
- approval mark for the control device type,
- the constant of the equipment in the form ‘k = ... rev/km’ or ‘k = ... imp/km’,
- optionally, the range of speed measurement, in the form indicated in point 1,
- should the sensitivity of the instrument to the angle of inclination be capable of affecting the readings given by the equipment beyond the permitted tolerances, the permissible angle expressed as:
where α is the angle measured from the horizontal position of the front face (fitted the right way up) of the equipment for which the instrument is calibrated, while ß and γ represent respectively the maximum permissible upward and downward deviations from the angle of calibration α.

F. MAXIMUM TOLERANCES (VISUAL AND RECORDING INSTRUMENTS)

1. On the test bench before installation:
- a) distance travelled:
  - 1 per cent more or less than the real distance, where the distance is at least 1 kilometre;
- b) speed:
  - 3 km/h more or less than the real speed;
- c) time:
  - ± two minutes per day with a maximum of 10 minutes per 7 days in cases where the running period of the clock after rewinding is not less than that period.
2. On installation:
- a) distance travelled:
  - 2 per cent more or less than the real distance, where that distance is at least 1 kilometre;
- b) speed
  - 4 km/h more or less than real speed;
- c) time
  - ± two minutes per day, or
  - ± 10 minutes per seven days.
3. In use:
- a) distance travelled:
  - 4 per cent more or less than the real distance, where that distance is at least 1 kilometre;
- b) speed:
  - 6 km/h more or less than the real speed;
- c) time:
  - ± two minutes per day, or
  - ± 10 minutes per seven days.
4. The maximum tolerances set out in paragraphs 1, 2 and 3 are valid for temperatures between o° and 40° C, temperatures being taken in close proximity to the equipment.
5. Measurement of the maximum tolerances set out in paragraphs 2 and 3 shall take place under the conditions laid down in Chapter VI.

IV. RECORD SHEETS

A. GENERAL POINTS

1. The record sheets must be such that they do not impede the normal functioning of the instrument and that the records which they contain are indelible and easily legible and identifiable.

The record sheets must retain their dimensions and any records made on them under normal conditions of humidity and temperature.

In addition it must be possible by each crew member to enter on the sheets, without damaging them and without affecting the legibility of the recordings, the following information:
- a) on beginning to use the sheet - his surname and first name;
- b) the date and place where use of the sheet begins and the date and place where such use ends;
- c) the registration number of each vehicle to which he is assigned, both at the start of the first journey recorded on the sheet and then, in the event of a change of vehicle, during use of the sheet;
- d) the odometer reading:
  - at the start of the first journey recorded on the sheet,
  - at the end of the last journey recorded on the sheet,
  - in the event of a change of vehicle during a working day (reading on the vehicle to which he was assigned and reading on the vehicle to which he is to be assigned);
- e) the time of any change of vehicle.
Under normal conditions of storage, the recordings must remain clearly legible for at least one year.
2. The minimum recording capacity of the sheets, whatever their form, must be 24 hours.

If several discs are linked together to increase the continuous recording capacity which can be achieved without intervention by staff, the links between the various discs must be made in such a way that there are no breaks in or overlapping of recordings at the point of transfer from one disc to another.

B. RECORDING AREAS AND THEIR GRADUATION

1. The record sheets shall include the following recording areas:
- an area exclusively reserved for data relating to speed,
- an area exclusively reserved for data relating to distance travelled,
- one or more areas for data relating to driving time, to other periods of work and availability to breaks from work and to rest periods for drivers.
2. The area for recording speed must be scaled off in divisions of 20 kilometres per hour or less. The speed corresponding to each marking on the scale must be shown in figures against that marking. The symbol ‘km/h’ must be shown at least once within the area. The last marking on the scale must coincide with the upper limit of the range of measurement.
3. The area for recording distance travelled must be set out in such a way that the number of kilometres travelled may be read without difficulty.
4. The area or areas reserved for recording the periods referred to in point 1 must be so marked that it is possible to distinguish clearly between the various periods of time.

C. INFORMATION TO BE PRINTED ON THE RECORD SHEETS

Each sheet must bear, in printed form, the following information:

name and address or tradename of the manufacturer,
approval mark for the model of the sheet,
approval mark for the type or types of control devices in which the sheet may be used,
upper limit of the speed measurement range, printed in kilometres per hour.

By way of minimal additional requirements, each sheet must bear, in printed form a time-scale graduated in such a way that the time may be read directly at intervals of 15 minutes while each 5-minute interval may be termined without difficulty.

D. FREE SPACE FOR HAND-WRITTEN INSERTIONS

A free space must be provided on the sheets such that drivers may as a minimum write in the following details:

surname and first name of the driver,
date and place where use of the sheet begins and date and place where such use ends,
the registration number or numbers of the vehicle or vehicles to which the driver is assigned during the use of the sheet,
odometer readings from the vehicle or vehicles to which the driver is assigned during the use of the sheet,
the time at which any change of vehicle takes place.

V. INSTALLATION OF CONTROL DEVICE

A. GENERAL POINTS

1. Control device must be positioned in the vehicle in such a way that the driver has a clear view from his seat of speedometer, distance recorder and clock while at the same time all parts of those instruments, including driving parts, are protected against accidental damage.
2. It must be possible to adapt the constant of the control device to the characteristic coefficient of the vehicle by means of a suitable device, to be known as an adaptor.

Vehicles with two or more rear axle ratios must be fitted with a switch device whereby these various ratios may be automatically brought into line with the ratio for which the control device has been adapted to the vehicle.
3. After the control device has been checked on installation, an installation plaque shall be affixed to the vehicle beside the device or in the device itself and in such a way as to be. clearly visible. After every inspection by an approved fitter or workshop requiring a change in the setting of the installation itself, a new plaque must be affixed in place of the previous one.

The plaque must show at least the following details:
- name, address or trade name of the approved fitter or workshop,
- characteristic coefficient of the vehicle, in the form ‘w = ... rev/km’ or ‘w = ... imp/km’,
- effective circumference of the wheel tyres in the form ‘1 = ... mm’,
- the dates on which the characteristic coefficient of the vehicle was determined and the effective measured circumference of the wheel tyres.

B. SEALING

The following parts must be sealed:

a) the installation plaque, unless it is attached in such a way that it cannot be removed without the markings thereon being destroyed;
b) the two ends of the link between the control device proper and the vehicle;
c) the adaptor itself and the point of its insertion into the circuit;
d) the switch mechanism for vehicles with two or more axle ratios;
e) the links joining the adaptor and the switch mechanism to the rest of the control device;
f) the casings required under Chapter III A 7(b).

In particular cases, further seals may be required on approval of the control device type and a note of the positioning of these seals must be made on the approval certificate.

Only the seals mentioned in (b), (c) and (e) may be removed in cases of emergency; for each occasion that these seals are broken a written statement giving the reasons for such action must be prepared and made available to the competent authority.

VI. CHECKS AND INSPECTIONS

The Contracting Party shall nominate the bodies which shall carry out the checks and inspections.

1. Certification of new or repaired instruments

Every individual device, whether new or repaired, shall be certified in respect of its correct operation and the accuracy of its readings and recordings, within the limits laid down in Chapter III F 1, by means of sealing in accordance with Chapter V B (f).

For this purpose the Contracting Party may stipulate an initial verification, consisting of a check on and confirmation of the conformity of a new or repaired device with the type-approved model and/or with the requirements of this annex and its appendices or may delegate the power to certify to the manufacturers or to their authorized agents.
2. Installation

When being fitted to a vehicle, the control device and the whole installation must comply with the provisions relating to maximum tolerances laid down in Chapter III F 2.

The inspection tests shall be carried out by the approved fitter or workshop on his or its responsibility.
3. Periodic inspections
- a) Periodic inspections of the control device fitted to vehicles shall take place at least every two years and may be carried out in conjunction with roadworthiness tests of vehicles.
  
  These inspections shall include the following checks:
  - that the control device is working correctly,
  - that the control device carries the type-approval mark,
  - that the installation plaque is affixed,
  - that the seals on the control device on the other parts of the installation are intact,
  - the actual circumference of the tyres.
- b) An inspection to ensure compliance with the provision of Chapter III F 3 on the maximum tolerances in use shall be carried out at least once every six years, although each Contracting Party may stipulate a shorter interval or such inspection in respect of vehicles registered in its territory. Such inspections must include replacement of the installation plaque.
4. Measurement of errors

The measurement of errors on installation and during use shall be carried out under the following conditions, which are to be regarded as constituting standard test conditions:
- vehicle unladen, in normal running order,
- tyre pressures in accordance with the manufacturer’s instructions,
- tyre wear within the limits allowed by law,
- movement of the vehicle: the vehicle must proceed, driven by its own engine, in a straight line and on a level surface, at a speed of 50 ± 5 km/h; provided that it is of comparable accuracy, the test may also be carried out on an appropriate test bench.

Annex Appendix 1B

Requirements for the construction, testing, installation and inspection of the digital control device used in road transport

Article 1. Preamble

1 As this Appendix is an adaptation of Annex IB of Council Regulation (EEC) No. 3821/85 of 20 December 1985 concerning recording equipment in the field of road transport7, the content of this Annex is not reproduced in the AETR because of its size and its very technical character. For the complete official text and its subsequent amendments, Contracting Parties shall refer to the Official Journal of the European Union.

The content of the present Appendix 1B is therefore limited to an introduction citing the references to the relevant texts of the European Union and of the Official Journals in which they were published and highlighting, by means of cross references, the particular points where that Annex has had to be adapted to the context of the AETR.

2 In order to facilitate consultation of that Annex with the adaptations made to take into account the AETR and to allow an overall view of the text, a consolidated version of this Appendix will be elaborated by the secretariat of the United Nations Economic Commission for Europe. However, this version will not have any legal force. This version, elaborated in the official languages of the UNECE, will be updated as necessary.

Article 2. Introductory provisions to Appendix 1B

1 In accordance with paragraph 1 of article 1 above, Contracting Parties are invited, in order to consult Annex IB, to refer to Commission Regulations No. 1360/2002 of 13 June 2002 and No. 432/2004 of 5 March 2004 (see footnote below for the dates of their publication in the Official Journal of the European Union), adapting for the seventh and eighth times to technical progress Council Regulation (EEC) No. 3821/85 concerning recording equipment in the field of road transport.

3. The dimensions of the approval mark drawn below are expressed in millimetres, these dimensions being minima. The ratios between the dimensions must be maintained.

Model forms

1. The ATTESTATION OF ACTIVITIES is to be used when a driver has been on sick leave or annual leave or when he has been driving a vehicle exempted from the scope of the AETR as defined in article 2 of this Agreement.

Instructions for use (To be reproduced, where possible, on the reverse of the form)
- a) All the fields in this form must be filled in, before the journey, by the transport undertaking and the driver concerned.
- b) The text of the form may not be modified.
- c) In order to be valid, the form must be signed both by the authorized representative of the transport undertaking and by the driver himself. For individual undertakings, the driver signs once on behalf of the undertaking and once as the driver. Only the signed original is valid.
- d) The form may be printed on paper containing the undertaking’s logo. Sections 1 to 5 may be preprinted. The signature of the undersigned may not be replaced by the undertaking’s stamp but may be accompanied by it.
- e) Any additional national or regional information must be included on the reverse of the form.
- f) If this form is drawn up in a language other than English or French, the title, in the national language, must appear below the English and French titles, which must be retained. The section headings in the body of the form must be repeated in English when the original document is drawn up in a language other than English (see attached model).

2. After completing items V and VI on the front sheet, issue a book to each crew member employed by you, in conformity with the laws and regulations referred to in paragraph 1 above.
3. Keep a register showing the names of the persons to whom books have been issued, the serial number of each book issued, and the dates of issue. Require the holder to sign in the margin of the register.
4. Give the holder the necessary instructions for correct use of the book.
5. Examine the daily sheets and the weekly report every week or, if prevented from doing so, as soon thereafter as possible. Sign the weekly report.
6. Withdraw the used books, observing the time-limit specified in paragraph 9 below, and hold them at the disposal of the control authorities for not less than one year. Enter the date of the last daily sheet in the register referred to in paragraph 3 above.

To Crew Members

7. This control book is personal. Carry it with you when on duty and produce it to the control authorities on request. Hand it over to your employer when you leave the undertaking.
8. Produce this control book to your employer every week or, if prevented from doing so, as soon thereafter as possible, so that he can check your entries and sign the weekly report.
9. When the book is completed, keep it for two weeks so that you can produce it at any time to the control authorities, and than hand it as soon as possible to your employer. Keep a copy of the weekly reports.

Front sheet

10. Make sure that your surname, first name(s), date of birth and address are filled in correctly (item V).
11. Enter the date on which you first use the book (item III).
12. After use, enter the date when you last used the book (item IV).

Daily sheet

13. Fill in a daily sheet for every day on which you have been employed as a crew member.
14. Enter in box 2 the registration number of any verhicle used during the day.

22. This report should be made out at the end of every period of one week in which one or more daily sheets have been made out. For days on which you were on duty without being a crew member, i.e. for which there was no need to make out a daily sheet, enter the figure “0” opposite box G and the duration of duty periods opposite boxes Ha and Hb; if you did not engage in a particular activity, enter the figure “0” opposite the appropriate box. For days on which you were not on duty, enter the figure “0” opposite boxes G, Ha and Hb and add an explanation, such as “on leave”, “day off”.
23. Enter opposite boxes F and G the figures shown opposite boxes 12 and 13 of the relevant daily sheets.

Additional instruction applicable where domestic laws and regulations require crew members to keep an individual control book for international transport operations only

24. Before starting on an international transport operation, enter opposite boxes 12 and 13 in the daily sheets for the seven days preceding that on which the operation begins particulars of the total periods of uninterrupted rest taken before going on duty, and particulars of the daily driving periods; or make out a weekly report covering those seven days.

General note

25. No erasures, corrections or additions may be made in the book. Any mistakes, even of form only, must be corrected under “Remarks” (box 16).
26. No sheets must be destroyed.
27. All entries must be made in ink.

Note 1. In practice, boxes 10 and 10a will both be completed on the same daily sheet only where a crew member has carried out a passenger transport operation and a goods transport operation on the same day. In box 10a (completed only by crew members of passenger vehicles) the entry should be either “10 h” or “11 h”, according to the system of daily rest periods applying to the crew member.

Note 2. Opposite box 12, if 12 hours is entered as the total period of uninterrupted rest taken prior to going on duty, this means that the driver went off duty at 7 p.m. on the previous day, because adding the 5 hours from 7 p.m. to midnight on the previous day to the 7 hours entered in box 4 gives a total of 12 hours.

Protocol of signature

When signing the European Agreement concerning the Work of Crews of Vehicles engaged in International Road Transport, the undersigned, duly authorized, have agreed on the following:

The Contracting Parties declare that this Agreement is without prejudice to such provisions as may, if appropriate, subsequently be drawn up in the matter of the duration and spread-over of work.

ad article 4 of the Agreement

The provisions of article 4, paragraph 1, shall not be construed as rendering applicable, outside the State in which the vehicle performing the transport operation is registered, any prohibition of traffic on certain days or at certain hours which may apply in that State to certain categories of vehicles. The provisions of article 4, paragraph 2, shall not be construed as preventing a Contracting Party from enforcing in its territory the provisions of its domestic laws and regulations which prohibit certain categories of vehicle traffic on certain days or at certain hours.

Every Contracting Party which, being a Party to a special agreement as referred to in article 4, paragraph 2, of this Agreement, authorizes international transport operations beginning and ending in the territories of the Parties to the said special agreement by vehicles registered in the territory of a State which, being a Contracting Party to this Agreement, is not a Party to the said special agreement may make it a condition for the conclusion of bilateral or multilateral agreements authorizing such transport operations that the crews performing those operations shall, in the territories of States Parties to the said special agreement, comply with the provisions of the said special agreement.

ad article 12 of the Agreement

The undersigned undertake to discuss after the Agreement has entered into force the insertion therein, by means of an amendment, of a clause providing for the use of a control device of approved type which when placed on the vehicle would so far as possible replace the individual control book.

ad article 14 of the Agreement

The Contracting Parties recognize that it would be desirable for:

- each Contracting Party to adopt the measures necessary to enable it to institute proceedings on account of breaches of the provisions of the Agreement not only if the breaches are committed in its territory, but also if they are committed in the territory of another State during an international road transport operation performed by a vehicle which the Contracting Party has registered;
- them to afford one another assistance for the purpose of imposing penalties for breaches committed.

ad annex to the Agreement

Notwithstanding paragraph 4 of the general provisions of the annex to this Agreement, Switzerland may dispense with the requirement that employers must sign the weekly reports in the individual control book.

De Overeenkomstsluitende Partijen,

Verlangende de ontwikkeling en de verbetering van het internationale vervoer van personen en goederen over de weg te bevorderen,

Overtuigd van de noodzaak de veiligheid van het wegverkeer te vergroten, bepaalde arbeidsvoorwaarden in het internationale vervoer over de weg te regelen overeenkomstig de beginselen van de Internationale Arbeidsorganisatie en, in gezamenlijk overleg, bepaalde maatregelen vast te stellen om de naleving van een zodanige regeling te verzekeren,

Zijn het volgende overeengekomen:

Artikel 1. Definities

In deze Overeenkomst betekent:

a) „voertuig”: elk motorrijtuig of elke aanhangwagen; deze term omvat elk samenstel van voertuigen;
b) „motorrijtuig”: elk voertuig, voorzien van een voortstuwingsmotor, dat zich op eigen kracht over de weg voortbeweegt en dat dient voor het vervoer over de weg van personen en goederen of voor het over de weg trekken van voertuigen die worden gebruikt voor het vervoer van personen of goederen; deze term omvat geen landbouwtraktoren;
c) „aanhangwagen”: elk voertuig bestemd om te worden gekoppeld aan een motorrijtuig; deze term omvat opleggers;
d) „oplegger”: elke aanhangwagen bestemd om op zodanige wijze aan een motorrijtuig te worden gekoppeld, dat hij gedeeltelijk steunt op en dat een aanmerkelijk deel van zijn gewicht en van het gewicht van zijn lading wordt gedragen door dat motorrijtuig;
e) „samenstel van voertuigen”: aaneengekoppelde voertuigen die als eenheid aan het wegverkeer deelnemen;
f) „Toelaatbaar maximum totaalgewicht”: het maximum totaalgewicht van het beladen voertuig dat door de bevoegde autoriteit van de Staat waarin het voertuig is geregistreerd toelaatbaar is verklaard;
g) „Wegvervoer”: iedere verplaatsing die geheel of gedeeltelijk wordt afgelegd op voor het publiek openstaande wegen met een leeg of beladen voertuig dat wordt gebruikt voor het vervoer van passagiers of goederen;
h) „internationaal wegvervoer”: elk wegvervoer waarbij ten minste één grens wordt overschreden;
i) ,geregeld vervoer’: het geregeld vervoer van personen in een bepaalde frequentie en langs vastgestelde routes, waarbij reizigers op vaste stopplaatsen kunnen in- en uitstappen.

De vervoervoorwaarden, in het bijzonder het aantal reizen, de dienstregeling, de tarieven en de vervoerplicht worden, voor zover zij niet bij een wettelijke of bestuursrechtelijke bepaling zijn vastgesteld, neergelegd in een exploitatiereglement of overeenkomstige documenten die door de bevoegde instanties van de Overeenkomstsluitende Partijen moeten worden goedgekeurd en door de vervoerder vóór de inwerkingstelling daarvan moeten worden bekendgemaakt.

Als geregeld vervoer wordt ook aangemerkt, wie ook het vervoer organiseert, het vervoer van bepaalde categorieën personen met uitsluiting van andere reizigers, voor zover het vervoer geschiedt op de in de eerste alinea van deze definitie bepaalde wijze. Dit vervoer, in het bijzonder het vervoer van werknemers naar het werk en van het werk naar hun woonplaats of het vervoer van leerlingen naar onderwijsinstellingen en van onderwijsinstellingen naar hun woonplaats, wordt hierna ,speciaal geregeld vervoer' genoemd;
j) „Bestuurder”: iedere persoon al dan niet in loondienst, die het voertuig bestuurt, zelfs gedurende korte tijd, dan wel zich in het kader van zijn taken in het voertuig bevindt teneinde dit in voorkomend geval te kunnen besturen;
k) „lid van de bemanning” of „bemanningslid”: de bestuurder of een der volgende, al dan niet in loondienst zijnde personen:
- i) de bijrijder, d.w.z. iedere persoon die de bestuurder begeleidt ten einde hem bij het uitvoeren van bepaalde handelingen behulpzaam te zijn en die gewoonlijk metterdaad deelneemt aan de vervoerhandelingen, zonder dat hij in de zin van paragraaf j) van dit artikel de hoedanigheid van bestuurder heeft;
- ii) een conducteur, d.w.z. iedere persoon die de bestuurder van een voertuig voor personenvervoer vergezelt en die met name is belast met het afgeven en controleren van biljetten of andere documenten die de reizigers het recht geven met het voertuig te reizen;
l) ,week’: het tijdvak tussen maandag 0.00 uur en zondag 24.00 uur;
m) „Rust”: een ononderbroken tijdvak gedurende hetwelk de bestuurder vrijelijk over zijn tijd kan beschikken;
n) „Onderbreking”: een tijdvak gedurende hetwelk een bestuurder niet mag rijden noch andere werkzaamheden mag verrichten en dat uitsluitend voor herstel wordt benut;
o) „Dagelijkse rusttijd”: het dagelijkse tijdvak gedurende hetwelk een bestuurder vrijelijk over zijn tijd kan beschikken, bestaande uit een “normale dagelijkse rusttijd” en een „verkorte dagelijkse rusttijd”:

„Normale dagelijkse rusttijd”: een rustperiode van ten minste 11 uren. Als alternatief mag deze normale dagelijkse rust worden genoten in twee tijdvakken; het eerste moet een ononderbroken tijdvak van ten minste 3 uren zijn en het tweede een ononderbroken tijdvak van ten minste 9 uren;

„Verkorte dagelijkse rusttijd”: een rustperiode van ten minste 9 uren, doch minder dan 11 uren;
p) „Wekelijkse rusttijd”: het wekelijkse tijdvak gedurende hetwelk een bestuurder vrijelijk over zijn tijd kan beschikken, bestaande uit een “normale wekelijkse rusttijd” en een „verkorte wekelijkse rusttijd”:

„Normale wekelijkse rusttijd”: een rustperiode van ten minste 45 uren;

„Verkorte wekelijkse rusttijd”: een rustperiode van ten minste 45 uren die, onder de voorwaarden van artikel 8, zesde lid, van de Overeenkomst kan worden bekort tot een minimum van 24 achtereenvolgende uren;
q) „Andere werkzaamheden”: alle werkzaamheden behoudens rijden, met inbegrip van werkzaamheden voor dezelfde of een andere werkgever, binnen of buiten de vervoerssector. Dit omvat niet de wachttijd en tijd waarin niet wordt gereden in een bewegend voertuig, op een veerboot of op een trein;
r) „Rijtijd”: de duur van de rijactiviteit die automatisch, halfautomatisch of handmatig wordt geregistreerd onder de in deze Overeenkomst vervatte voorwaarden;
s) „Dagelijkse rijtijd”: de totale opgetelde rijtijd tussen het einde van de ene dagelijkse rustperiode en de aanvang van de volgende dagelijkse rustperiode of tussen een dagelijkse rustperiode en een wekelijkse rustperiode;
t) “Wekelijkse rijtijd”: de totale gedurende een week opgetelde rijtijd;
u) „Rijperiode”: de opgetelde rijtijd vanaf het tijdstip waarop een bestuurder na een rustperiode of onderbreking met rijden aanvangt totdat hij een rustperiode of onderbreking neemt. De rijperiode kan aaneengesloten of onderbroken zijn;
v) „Meervoudige bemanning”: een situatie waarin er zich tijdens elke rijperiode tussen twee opeenvolgende dagelijkse rusttijden of tussen een dagelijkse rusttijd en een wekelijkse rusttijd ten minste twee bestuurders in het voertuig bevinden om het te besturen. Bij meervoudige bemanning is de aanwezigheid van een andere bestuurder of andere bestuurders gedurende het eerste uur facultatief, maar gedurende de resterende periode verplicht;
w) „Vervoersonderneming”: een natuurlijke persoon, een rechtspersoon, een vereniging of een groep personen zonder rechtspersoonlijkheid, met of zonder winstoogmerk, of een officiële instantie, met eigen rechtspersoonlijkheid of afhankelijk van een autoriteit met rechtspersoonlijkheid, die zich bezighoudt met wegvervoer voor rekening van derden of voor eigen rekening.

Artikel 2. Toepassingsgebied

1 Deze Overeenkomst is op het grondgebied van elke Overeenkomstsluitende Partij van toepassing op al het internationaal vervoer over de weg dat wordt verricht door een voertuig dat is geregistreerd op het grondgebied van genoemde Overeenkomstsluitende Partij of op het grondgebied van een andere Overeenkomstsluitende Partij.

2 Deze Overeenkomst is, tenzij door de Overeenkomstsluitende Partijen op wier grondgebied het vervoer plaatsvindt anders is overeengekomen, evenwel niet van toepassing op internationaal vervoer over de weg, verricht met:
- a. voertuigen bestemd voor het vervoer van goederen waarvan het toelaatbaar maximum totaalgewicht, dat van aanhangwagens of opleggers daaronder begrepen, niet meer dan 3,5 ton bedraagt;
- b. voertuigen gebruikt voor het vervoer van personen die, uit hoofde van hun constructie en hun uitrusting, geschikt zijn voor het vervoer van ten hoogste negen personen, de bestuurder daaronder begrepen, en voor dat doel zijn bestemd;
- c. voertuigen bestemd voor het vervoer van personen via geregeld vervoer waarvan het traject van de route ten hoogste 50 kilometer bedraagt;
- d. voertuigen waarvan de toegestane maximumsnelheid ten hoogste 40 km per uur bedraagt;
- e. voertuigen van, of zonder bestuurder gehuurd door, de strijdkrachten, civiele bescherming, brandweer en korpsen voor de handhaving van de openbare orde voorzover het vervoer plaatsvindt in het kader van de taak waarmee deze organen zijn belast en onder hun controle valt;
- f. voertuigen gebruikt bij noodsituaties of reddingsoperaties, met inbegrip van het niet-commerciële vervoer van humanitaire hulpgoederen;
- g. speciaal voor medische doeleinden gebruikte voertuigen;
- h. speciale bergingsvoertuigen die binnen een straal van 100 km van hun thuisbasis actief zijn;
- i. voertuigen die op de weg worden beproefd met het oog op de technische ontwikkeling, reparatie of onderhoud, en nieuwe of vernieuwde voertuigen die nog niet in gebruik zijn genomen;
- j. voertuigen met een toelaatbaar maximum totaalgewicht van ten hoogste 7,5 ton, gebruikt voor niet-commercieel vervoer van goederen;
- k. commerciële voertuigen die krachtens de wetgeving van de Overeenkomstsluitende Partij waar ermee wordt gereden een historische status hebben, en die voor niet-commercieel vervoer van personen of goederen worden gebruikt.

Artikel 3. Toepassing van een aantal bepalingen van deze Overeenkomst op wegvervoer verricht door voertuigen ingeschreven in de landen die geen Partij zijn bij deze Overeenkomst

1 Elke Overeenkomstsluitende Partij past ten aanzien van internationaal wegvervoer, verricht door een voertuig dat is ingeschreven op het grondgebied van een land dat geen Partij is bij deze Overeenkomst, op haar grondgebied bepalingen toe die ten minste even streng zijn als die welke zijn neergelegd in de artikelen 5, 6, 7, 8, 9 en 10 van deze Overeenkomst.

- a. Elke Overeenkomstsluitende Partij heeft echter de bevoegdheid, bij voertuigen die zijn geregistreerd in een land dat geen Partij is bij deze Overeenkomst, in plaats van het controle apparaat overeenkomstig de bepalingen van de Bijlage bij deze Overeenkomst, slechts handmatig door ieder bemanningslid ingevulde dagelijkse registratiebladen te eisen voor het tijdvak vanaf het tijdstip van binnenkomst op het grondgebied van de eerste Overeenkomstsluitende Partij.
- b. Hiertoe noteert elk bemanningslid op zijn registratieblad de informatie met betrekking tot zijn beroepsactiviteiten en rusttijden, met gebruikmaking van de juiste grafische symbolen als omschreven in artikel 12 van de Bijlage bij deze Overeenkomst.

Artikel 4. Algemene beginselen

Elke Overeenkomstsluitende Partij kan hogere minima of lagere maxima toepassen dan die welke zijn neergelegd in de artikelen 5 tot en met 8. De bepalingen van deze Overeenkomst blijven echter van toepassing op bestuurders die internationaal wegvervoer verrichten met voertuigen die zijn ingeschreven in een ander land dat Partij of geen Partij is bij deze Overeenkomst.

Artikel 5. Bemanning

1 De minimumleeftijd van de bij het vervoer van goederen betrokken bestuurders bedraagt
- a. voor voertuigen, daaronder begrepen, indien van toepassing, aanhangwagens of opleggers, waarvan het toelaatbare maximum totaalgewicht 7,5 ton niet te boven gaat, achttien jaar;
- b. voor andere voertuigen: 21 jaar of 18 jaar, mits de betrokkene in het bezit is van een getuigschrift van vakbekwaamheid dat erkend is door een van de Overeenkomstsluitende Partijen en waaruit blijkt dat hij een opleiding voor vrachtautobestuurders heeft gevolgd. De Overeenkomstsluitende Partijen informeren elkaar over het nationale minimale opleidingsniveau dat in hun land is vereist en over de andere relevante voorwaarden die van toepassing zijn op vrachtautobestuurders in internationaal vervoer overeenkomstig de bepalingen van deze Overeenkomst.

2 Bestuurders die tewerkgesteld zijn bij het vervoer van personen dienen de leeftijd van 21 jaar te hebben bereikt.

Bestuurders die tewerkgesteld zijn bij het vervoer van personen op trajecten buiten een straal van 50 kilometer vanaf de gebruikelijke standplaats van het voertuig dienen tevens aan een van de volgende voorwaarden te voldoen:
- a. gedurende ten minste een jaar gewerkt hebben als bestuurder betrokken bij het vervoer van goederen met voertuigen waarvan het toelaatbare maximum totaalgewicht 3,5 ton te boven gaat;
- b. gedurende ten minste een jaar gewerkt hebben als bestuurder betrokken bij het personenvervoer op trajecten binnen een straal van 50 kilometer vanaf de gebruikelijke standplaats van het voertuig, of bij andere vormen van personenvervoer die niet onder deze Overeenkomst vallen, mits de bevoegde autoriteit van mening is dat zij daardoor de vereiste ervaring hebben opgedaan;
- c. houder zijn van een getuigschrift van vakbekwaamheid dat is erkend door een van de Overeenkomstsluitende Partijen en waaruit blijkt dat hij een opleiding heeft voltooid voor bestuurders van voertuigen die zijn bestemd voor het vervoer van personen over de weg.

Artikel 6. Rijtijden

1 De dagelijkse rijtijd, als omschreven in artikel 1, onderdeel s, van deze Overeenkomst, mag ten hoogste 9 uren bedragen. Ten hoogste twee maal per week mag de rijtijd worden uitgebreid tot 10 uren.

2 De wekelijkse rijtijd, als omschreven in artikel 1, onderdeel t, van deze Overeenkomst, mag ten hoogste 56 uren bedragen.

3 De totale opgetelde rijtijd gedurende twee opeenvolgende weken mag ten hoogste 90 uren bedragen.

4 Rijtijden omvatten alle rijwerkzaamheden op het grondgebied van Overeenkomstsluitende en niet-Overeenkomstsluitende Partijen.

5 Een bestuurder dient de tijd doorgebracht als omschreven in artikel 1, onderdeel q, alsmede de tijd gedurende welke een voertuig wordt bestuurd voor commerciële activiteiten die niet onder het toepassingsgebied van deze Overeenkomst vallen, als andere werkzaamheden te registreren en dient alle tijdvakken van beschikbaarheid te registreren, als vermeld in artikel 12, paragraaf 3, onderdeel c, van de Bijlage bij deze Overeenkomst. Deze registratie geschiedt handmatig op een registratieblad of afdruk of door gebruikmaking van de functies voor handmatige invoer van het controle apparaat.

Artikel 7. Onderbrekingen

1 Na een rijperiode van vier en een half uur neemt een bestuurder een aaneengesloten onderbreking van ten minste vijfenveertig minuten, tenzij hij een rusttijd neemt.

2 Deze onderbreking, als omschreven in artikel 1, onderdeel n, van deze Overeenkomst, mag worden vervangen door een onderbreking van ten minste 15 minuten, gevolgd door een onderbreking van ten minste 30 minuten die zodanig over de rijperiode of onmiddellijk na deze periode worden verdeeld dat aan de vereisten van het eerste lid wordt voldaan.

3 Voor de toepassing van dit artikel worden de wachttijd en de tijd die niet aan rijden wordt besteed in een bewegend voertuig, op een veerboot of op een trein niet aangemerkt als „andere werkzaamheden” als omschreven in artikel 1, onderdeel q, van deze Overeenkomst; deze tijd mag als „onderbreking” worden aangemerkt.

4 De in dit artikel in acht genomen onderbrekingen mogen niet worden aangemerkt als dagelijkse rusttijd.

Artikel 8. Rusttijden

1 Een bestuurder dient dagelijkse en wekelijkse rusttijden te nemen als omschreven in artikel 1, onderdelen o en p.

2 Binnen elke periode van 24 uur na het einde van de voorafgaande dagelijkse of wekelijkse rusttijd dient een bestuurder een nieuwe dagelijkse rusttijd genomen te hebben.

Indien het gedeelte van de dagelijkse rusttijd dat binnen die periode van 24 uur valt ten minste 9 doch ten hoogste 11 uren bedraagt, wordt deze dagelijkse rusttijd als een verkorte dagelijkse rusttijd aangemerkt.

3 In afwijking van het tweede lid geldt dat een bestuurder die deel uitmaakt van een meervoudige bemanning, binnen 30 uur na het einde van een dagelijkse of wekelijkse rusttijd een nieuwe dagelijkse rusttijd van ten minste 9 uren dient te hebben genoten.

4 Een dagelijkse rusttijd kan worden verlengd om een normale wekelijkse rusttijd of verkorte wekelijkse rusttijd te bereiken.

5 Tussen twee wekelijkse rusttijden mag een bestuurder ten hoogste drie verkorte dagelijkse rusttijden hebben.

6
- a. Per periode van twee opeenvolgende weken dient een bestuurder ten minste:
  - i. twee normale wekelijkse rusttijden te genieten; of
  - ii. één normale wekelijkse rusttijd en één verkorte wekelijkse rusttijd van ten minste 24 uur te nemen. Verkortingen worden evenwel gecompenseerd met een daarmee overeenkomende rusttijd die aaneengesloten wordt genoten vóór het einde van de derde week volgend op de desbetreffende week.
  Een wekelijkse rusttijd vangt uiterlijk aan het einde van zes tijdvakken van 24 uur aan, te rekenen vanaf het einde van de voorgaande wekelijkse rusttijd.
- b. In afwijking van het zesde lid, onderdeel a, kan een bestuurder die deel uitmaakt van een enkele internationale vervoersdienst van personen, anders dan een reguliere dienst, de wekelijkse rusttijd uitstellen tot 12 opvolgende tijdvakken van 24 uur, volgend op een voorgaande normale wekelijkse rusttijd, mits:
  - i. de dienst ten minste 24 opeenvolgende uren in een Overeenkomstsluitende Partij of een derde land anders dan het land waarin de dienst aanving, duurt, en
  - ii. de bestuurder na toepassing van de uitzondering:
    - a. hetzij twee normale wekelijkse rusttijden neemt,
    - b. of één normale wekelijkse rusttijd en één verkorte wekelijkse rusttijd van ten minste 24 uur neemt. Verkortingen worden evenwel gecompenseerd met een daarmee overeenkomende rusttijd die aaneengesloten wordt genoten vóór het einde van de derde week volgend op het einde van de uitzonderingsperiode,
    en
  - iii. het voertuig, vier jaren nadat het land van registratie de digitale tachograaf heeft ingevoerd, is uitgerust met registratieapparatuur in overeenstemming met de vereisten van Aanhangsel 1B van de Bijlage, en
  - iv. het voertuig, na 1 januari 2014, indien wordt gereden gedurende het tijdvak van 22:00 tot 06:00 uur, een meervoudige bemanning heeft of de in artikel 7 bedoelde rijtijd wordt verkort tot drie uren.
- c. In afwijking van het zesde lid, onderdeel a, dienen bestuurders die deel uitmaken van een meervoudige bemanning elke week een normale wekelijkse rusttijd van ten minste 45 uur te nemen. Deze tijd kan worden verkort tot een minimum van 24 uren (verkorte wekelijkse rusttijd). Elke verkorting wordt evenwel gecompenseerd met een daarmee overeenkomende rusttijd die aaneengesloten wordt genoten vóór het einde van de derde week volgend op de desbetreffende week.
Een wekelijkse rusttijd mag niet later aanvangen dan aan het einde van zes tijdvakken van 24 uur, te rekenen vanaf het einde van de voorgaande wekelijkse rusttijd.

7 Rust die wordt genomen ter compensatie van een verkorte wekelijkse rusttijd dient aansluitend op een andere rusttijd van ten minste 9 uur te worden genomen.

8 Wanneer een bestuurder dit verkiest, mogen dagelijkse rusttijden en verkorte wekelijkse rusttijden buiten de standplaats in een voertuig worden doorgebracht indien dit voor iedere bestuurder speciaal aangebrachte slaapfaciliteiten – als voorzien in het ontwerp van de bouwer – biedt en het voertuig stilstaat.

9 Een wekelijkse rusttijd die in twee weken valt, mag tot één van beide weken gerekend worden, maar niet tot beide.

Artikel 8bis. Afwijkingen van artikel 8

1 In afwijking van artikel 8 mag, wanneer een bestuurder een voertuig begeleidt dat per veerboot of trein wordt vervoerd, en op voorwaarde dat hij een normale dagelijkse rusttijd neemt, die tijd hooguit tweemaal worden onderbroken door andere activiteiten, mits aan de volgende voorwaarden wordt voldaan:
- a. het gedeelte van de dagelijkse rusttijd dat op het land wordt genoten dient te kunnen worden genomen vóór of na het gedeelte van de dagelijkse rusttijd dat aan boord van de veerboot of in de trein wordt genoten;
- b. de periode tussen de twee gedeelten van de dagelijkse rusttijd dient zo kort mogelijk te zijn en mag in geen geval langer zijn dan in totaal een uur vóór inschepen/inladen of na ontschepen/uitladen, waarbij douaneformaliteiten tot inschepen/inladen of ontschepen/uitladen worden gerekend.
Tijdens alle gedeelten van de dagelijkse rusttijd dient de bestuurder te kunnen beschikken over een bed of slaapbank.

2 Tijd besteed om te reizen naar een plaats om een voertuig te gaan besturen dat onder het toepassingsgebied van deze Overeenkomst valt, of om terug te keren van deze plaats, wanneer het voertuig zich niet in de woonplaats van de bestuurder of in de vestiging van de werkgever waaraan de bestuurder gewoonlijk verbonden is, bevindt, geldt niet als rust of onderbreking, tenzij de bestuurder reist met een veerboot of trein en geschikte slaapvoorzieningen ter beschikking heeft.

3 Tijd besteed door een bestuurder om met een voertuig dat buiten het toepassingsgebied van deze Overeenkomst valt, te rijden naar of van een voertuig dat onder het toepassingsgebied van deze Overeenkomst valt en dat zich niet in de woonplaats van de bestuurder of in de vestiging van de werkgever waaraan de bestuurder gewoonlijk verbonden is, bevindt, geldt als „andere werkzaamheden”.

Artikel 9. Uitzonderingen

Mits de veiligheid van het wegverkeer niet in gevaar wordt gebracht en om hem in staat te stellen een geschikt haltepunt te bereiken, kan de bestuurder afwijken van deze Overeenkomst voor zover zulks noodzakelijk is ter verzekering van de veiligheid van personen, voertuig of lading. Uiterlijk bij aankomst op een geschikte stopplaats vermeldt de bestuurder op het registratieblad, op een afdruk van het controle apparaat of in zijn dienstrooster de aard en de reden van zijn afwijking van deze bepalingen.

Artikel 10. Controleapparaat

1 De Overeenkomstsluitende Partijen dienen de installatie en het gebruik van een controleapparaat voor te schrijven in op hun grondgebied ingeschreven voertuigen overeenkomstig de voorschriften van deze Overeenkomst en de bijlage en de aanhangsels daarbij.

2 Het controleapparaat in de zin van deze Overeenkomst dient voor wat betreft constructie, installatie, gebruik en beproeving te voldoen aan de voorschriften van deze Overeenkomst, de bijlage en de aanhangsels daarbij.

3 Een controleapparaat dat voldoet aan Verordening (EEG) nr. 3821/85 van 20 december 1985 van de Raad voor wat betreft constructie, installatie, gebruik en beproeving wordt aangemerkt als beantwoordend aan de voorwaarden van deze Overeenkomst, de bijlage en de aanhangsels daarbij.

Artikel 11. Controle door de onderneming

1 De onderneming dient het vervoer over de weg zodanig te organiseren en de leden van de bemanning zodanig te instrueren dat deze kunnen voldoen aan de bepalingen van deze Overeenkomst.

2 Zij oefent een regelmatige controle uit op de rijtijden en op de aan ander werk bestede uren, en op de rusttijden, waarbij zij zich bedient van alle tot haar beschikking staande documenten, zoals de persoonlijke controleboekjes. Bij constatering van een inbreuk op deze Overeenkomst dient zij hieraan terstond een einde te maken en maatregelen te nemen tegen herhaling bijvoorbeeld door het wijzigen van werkroosters en reisroutes.

3 Het is verboden aan bestuurders in loondienst betalingen te verrichten, ook niet in de vorm van premies of loontoeslagen, naar gelang de afgelegde afstand en/of de hoeveelheid vervoerde goederen, tenzij deze betalingen naar hun aard de verkeersveiligheid niet in gevaar kunnen brengen of inbreuken op deze Overeenkomst aan te moedigen.

4 Een vervoersonderneming is aansprakelijk voor inbreuken van de bestuurders van de onderneming, ook wanneer die inbreuken zijn gepleegd op het grondgebied van een andere Overeenkomstsluitende Partij of een niet-Overeenkomstsluitende Partij.

Onverminderd het recht van de Overeenkomstsluitende Partijen om vervoersondernemingen volledig aansprakelijk te stellen, kunnen de Overeenkomstsluitende Partijen die aansprakelijkheid afhankelijk stellen van de inbreuk van de onderneming op het eerste of tweede lid. De Overeenkomstsluitende Partijen mogen alle bewijsstukken in aanmerking nemen waarmee aangetoond wordt dat de vervoersonderneming redelijkerwijs niet aansprakelijk kan worden gesteld voor de gepleegde inbreuk.

5 Ondernemingen, expediteurs, bevrachters, touroperators, hoofd- en onderaannemers en uitzendbureaus voor bestuurders zorgen ervoor dat contractueel overeengekomen tijdschema's voor het vervoer aan deze Overeenkomst voldoen.

Artikel 12. Maatregelen voor de toepassing van de Overeenkomst

1 Elke Overeenkomstsluitende Partij neemt alle geëigende maatregelen teneinde de naleving van de bepalingen van deze Overeenkomst te verzekeren, met name door adequate controles langs de weg en ter plaatse in de ondernemingen die jaarlijks een groot en representatief deel van de bestuurders, ondernemingen en voertuigen bestrijken binnen alle vervoerscategorieën die onder deze Overeenkomst vallen.
- a. De bevoegde administraties van de Overeenkomstsluitende Partijen organiseren de controles zodanig dat:
  - i. in elk kalenderjaar ten minste 1% van de dagen wordt gecontroleerd waarop de onder deze Overeenkomst vallende bestuurders van voertuigen werkzaam zijn geweest. Vanaf 1 januari 2010 wordt dit percentage verhoogd tot ten minste 2% en vanaf 1 januari 2012 tot ten minste 3%;
  - ii. ten minste 15% van het totale aantal gecontroleerde gewerkte dagen wordt langs de weg gecontroleerd en ten minste 25% bij de vestigingen van de ondernemingen. Vanaf 1 januari 2010 wordt ten minste 30% van het totaal aantal gecontroleerde werkdagen langs de weg gecontroleerd en wordt ten minste 50% bij de vestigingen van de ondernemingen gecontroleerd.
- b. De controles langs de weg betreffen:
  - i. dagelijkse en wekelijkse rijperiodes, onderbrekingen en dagelijkse en wekelijkse rusttijden;
  - ii. de registratiebladen van de voorgaande dagen, die zich aan boord van het voertuig dienen te bevinden, en/of de over hetzelfde tijdvak op de bestuurderskaart en/of in het geheugen van het controle apparaat en/of op de afdrukken opgeslagen gegevens, indien vereist;
  - iii. de correcte werking van het controle apparaat.
  Deze controles worden uitgevoerd zonder onderscheid tussen voertuigen, ondernemingen en bestuurders – ongeacht of zij ingezetenen zijn of niet – en ongeacht de herkomst of bestemming van de reis of het type tachograaf.
- c. De onderdelen van controles bij de vestigingen van ondernemingen betreffen, naast de onderdelen van de controles langs de weg en naleving van de bepalingen van artikel 11, paragraaf 2, van de Bijlage:
  - i. wekelijkse rusttijden en rijtijden tussen deze rusttijden;
  - ii. tweewekelijkse limieten van de rijtijden;
  - iii. compensatie voor in overeenstemming met artikel 8, zesde lid, verkorte wekelijkse rusttijden;
  - iv. gebruik van registratiebladen en/of de voertuigunit en bestuurderskaart en afdrukken en/of de organisatie van de werktijden van de bestuurder.

2 In het kader van de wederzijdse bijstand verstrekken de bevoegde autoriteiten van de Overeenkomstsluitende Partijen elkaar regelmatig alle beschikbare informatie over:

– de overtredingen van deze Overeenkomst begaan door niet-ingezetenen en de hiervoor opgelegde sancties;

– de door een Overeenkomstsluitende Partij aan op haar grondgebied woonachtige personen opgelegde sancties vanwege dergelijke op het grondgebied van andere Overeenkomstsluitende Partijen begane overtredingen.

In het geval van ernstige overtredingen moet deze informatie de opgelegde sanctie omvatten.

3 Indien tijdens een controle langs de weg van de bestuurder van een voertuig dat op het grondgebied van een andere Overeenkomstsluitende Partij is ingeschreven de constateringen aanleiding geven tot de veronderstelling dat deze persoon overtredingen heeft begaan die tijdens de controle niet kunnen worden opgespoord wegens het ontbreken van de noodzakelijke gegevens, verlenen de bevoegde autoriteiten van de betrokken Overeenkomstsluitende Partijen elkaar bijstand om de situatie op te helderen. Wanneer de bevoegde Overeenkomstsluitende Partij hiertoe een controle verricht ter plaatse in de onderneming, wordt het resultaat van deze controle ter kennis gebracht van de andere betrokken Partij.

4 De Overeenkomstsluitende Partijen werken samen bij het organiseren van gezamenlijke controles langs de weg.

5 De Economische Commissie voor Europa van de Verenigde Naties publiceert elke twee jaar een rapport over de toepassing door de Overeenkomstsluitende Partijen van het eerste lid van dit artikel.

- a. Een Overeenkomstsluitende Partij staat haar bevoegde autoriteiten toe een bestuurder een boete op te leggen voor een op haar grondgebied geconstateerde inbreuk op deze Overeenkomst waarvoor nog niet eerder een boete is opgelegd, zelfs wanneer deze inbreuk heeft plaatsgevonden op het grondgebied van een andere Overeenkomstsluitende Partij of van een niet-Overeenkomstsluitende Partij.
- b. Een Overeenkomstsluitende Partij staat haar bevoegde autoriteiten toe een onderneming een boete op te leggen voor een op haar grondgebied geconstateerde inbreuk op deze Overeenkomst waarvoor nog niet eerder een boete is opgelegd, zelfs wanneer deze inbreuk heeft plaatsgevonden op het grondgebied van een andere Overeenkomstsluitende Partij of van een niet-Overeenkomstsluitende Partij.
Bij wijze van uitzondering vindt de oplegging van sancties, wanneer een inbreuk wordt geconstateerd die is gepleegd door een onderneming gevestigd in een andere Overeenkomstsluitende Partij of in een niet-Overeenkomstsluitende Partij, plaats overeenkomstig de procedure die is voorzien in de bilaterale wegvervoersovereenkomst tussen de betrokken Partijen.

Vanaf 2011 zullen de Overeenkomstsluitende Partijen de mogelijkheid bestuderen de in het zesde lid, onderdeel b, bedoelde uitzondering op te heffen zodra alle Overeenkomstsluitende Partijen hiertoe bereid zijn.

7 Telkens wanneer een Overeenkomstsluitende Partij voor een specifieke inbreuk vervolging instelt of een boete oplegt, verstrekt zij de bestuurder hiervan naar behoren schriftelijke bewijsstukken.

8 De Overeenkomstsluitende Partijen waarborgen dat een stelsel van proportionele straffen, waaronder financiële sancties, van kracht is voor inbreuken op deze Overeenkomst door ondernemingen of geassocieerde expediteurs, bevrachters, touroperators, hoofd- en onderaannemers en uitzendbureaus voor bestuurders.

Artikel 12bis. Gestandaardiseerde modelformulieren

1 Ter vergemakkelijking van internationale controles langs de weg worden gestandaardiseerde modelformulieren ingevoerd in de Bijlage bij deze Overeenkomst, die dienovereenkomstig wordt aangevuld met een nieuw Aanhangsel 3; deze formulieren dienen indien nodig te worden gebruikt. Deze formuleren worden ingevoerd of gewijzigd in overeenstemming met de in artikel 22ter vermelde procedure.

2 De in Aanhangsel 3 getoonde modelformulieren zijn op geen enkele wijze bindend. Indien zij worden gebruikt, dient de inhoud echter te worden gehandhaafd, in het bijzonder de nummering, volgorde en titels van de onderdelen.

3 De Overeenkomstsluitende Partijen kunnen deze gegevens aanvullen met extra informatie teneinde aan nationale of regionale vereisten te voldoen. Deze aanvullende informatie mag in geen geval worden verlangd voor vervoer afkomstig uit een andere Overeenkomstsluitende Partij of derde land. Voor dit doel dient de informatie op het formulier volledig gescheiden van de gegevens voor internationaal vervoer te worden weergegeven.

4 Deze formulieren worden aanvaard bij elke controle langs de weg die wordt uitgevoerd op het grondgebied van de Partijen bij deze Overeenkomst.

Artikel 13. Overgangsbepalingen

1 Alle nieuwe bepalingen van deze Overeenkomst, met inbegrip van zijn bijlage en de aanhangsels 1B en 2, die betrekking hebben op de invoering van een digitaal controleapparaat, worden verbindend voor landen die Overeenkomstsluitende Partij zijn bij deze Overeenkomst uiterlijk vier jaar na de datum van inwerkingtreding van de desbetreffende wijzigingen die voortvloeien uit de in artikel 21 omschreven procedure. Bijgevolg dienen alle voertuigen waarop deze Overeenkomst van toepassing is en die na het verstrijken van deze termijn voor het eerst in bedrijf zijn genomen, te zijn uitgerust met een controleapparaat dat voldoet aan deze nieuwe voorwaarden. Gedurende deze termijn van vier jaar laten de Overeenkomstsluitende Partijen die deze wijzigingen nog niet in hun landen hebben geïmplementeerd in een andere Overeenkomstsluitende Partij bij deze Overeenkomst ingeschreven voortuigen die reeds zijn uitgerust met een dergelijk digitaal controleapparaat tot hun grondgebied toe en controleren deze.

- a. De Overeenkomstsluitende Partijen nemen de nodige maatregelen om de in de bijlage bij deze Overeenkomst bedoelde bestuurderskaarten, zoals gewijzigd, uiterlijk drie maanden voor het verstrijken van de in het eerste lid bedoelde termijn van vier jaar af te geven. Aan deze minimumtermijn van drie maanden dient eveneens te worden voldaan indien een Overeenkomstsluitende Partij de bepalingen die betrekking hebben op het digitale controleapparaat in overeenstemming met aanhangsel 1B bij deze bijlage implementeert voordat de termijn van vier jaar verstreken is. Deze Overeenkomstsluitende Partijen houden het secretariaat van de Subcommissie voor het wegvervoer van de Economische Commissie voor Europa op de hoogte van de voortgang bij de invoering van het digitale controleapparaat overeenkomstig aanhangsel 1B bij deze bijlage binnen hun grondgebied.
- b. In afwachting van de afgifte door de Overeenkomstsluitende Partij van de kaarten bedoeld in onderdeel a, zijn de bepalingen van artikel 14 van de bijlage bij deze Overeenkomst van toepassing op bestuurders die mogelijk voertuigen dienen te besturen die uitgerust zijn met een digitaal controleapparaat in overeenstemming met aanhangsel 1B bij deze bijlage.”

3 Elke akte van bekrachtiging of toetreding nedergelegd door een Staat na het van kracht worden van de in het eerste lid bedoelde wijzigingen wordt geacht van toepassing te zijn op de Overeenkomst zoals gewijzigd, met inbegrip van de termijn voor de implementatie omschreven in het eerste lid.

Indien de toetreding minder dan twee jaar voor het verstrijken van de in het eerste lid bedoelde termijn plaatsvindt, stelt de Staat de depositaris bij de nederlegging van zijn akte van bekrachtiging of toetreding in kennis van de datum waarop het digitale controleapparaat feitelijk in gebruik zal worden genomen op zijn grondgebied. Een dergelijke Staat kan gebruik maken van een overgangstermijn van ten hoogste twee jaar vanaf de datum waarop de Overeenkomst voor de Staat in werking treedt. De depositaris stelt alle Overeenkomstsluitende Partijen daarvan in kennis.

De bepalingen van het voorgaande lid zijn eveneens van toepassing bij toetreding door een Staat na het verstrijken van de termijn van vier jaar voor de in het eerste lid bedoelde implementatie.

Artikel 13bis. Overgangsbepalingen

De bepalingen bedoeld aan het einde van artikel 12, paragraaf 7, onderdelen a en b, van de Bijlage bij deze Overeenkomst zijn van toepassing drie maanden nadat de onderhavige wijziging in werking is getreden.

Artikel 14. Slotbepalingen

1 Deze Overeenkomst staat tot 31 maart 1971 open voor ondertekening en, na deze datum, voor toetreding door de Lid-Staten van de Economische Commissie voor Europa, alsmede door de Staten die overeenkomstig paragraaf 8 of 11 van het mandaat van deze Commissie met adviserende bevoegdheid tot haar werkzaamheden zijn toegelaten. Toetredingen overeenkomstig paragraaf 11 van het mandaat van deze Commissie zijn beperkt tot de volgende Staten: Algerije, Egypte, Jordanië, Libanon, Marokko en Tunesië.

2 Deze Overeenkomst moet worden bekrachtigd.

3 De akten van bekrachtiging of toetreding worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.

4 Deze Overeenkomst treedt in werking op de honderdtachtigste dag na de nederlegging van de achtste akte van bekrachtiging of toetreding.

5 Voor elke Staat die deze Overeenkomst bekrachtigt of daartoe toetreedt na de nederlegging van de achtste akte van bekrachtiging of toetreding, bedoeld in het vierde lid van dit artikel, treedt deze Overeenkomst in werking honderdtachtig dagen na de nederlegging door die Staat van zijn akte van bekrachtiging of toetreding.

Artikel 15

1 Elke Overeenkomstsluitende Partij kan deze Overeenkomst opzeggen door middel van een aan de Secretaris-Generaal van de Verenigde Naties gerichte kennisgeving.

2 De opzegging wordt van kracht zes maanden na de datum van ontvangst van de kennisgeving van opzegging door de Secretaris-Generaal.

Artikel 16

Deze Overeenkomst zal ophouden van kracht te zijn indien na haar inwerkingtreding het aantal Overeenkomstsluitende Partijen gedurende een tijdvak van twaalf opeenvolgende maanden minder is dan drie.

Artikel 17

1 Elke Staat kan, bij de ondertekening van deze Overeenkomst bij de nederlegging van zijn akte van bekrachtiging of toetreding of te eniger tijd daarna, door middel van een aan de Secretaris-Generaal van de Verenigde Naties gerichte kennisgeving verklaren, dat de toepasselijkheid van deze Overeenkomst wordt uitgebreid tot alle of enkele van de gebieden voor welker internationale betrekkingen hij verantwoordelijk is. Deze Overeenkomst is ten aanzien van het gebied of de gebieden in de kennisgeving vermeld van toepassing met ingang van de honderdtachtigste dag na ontvangst van die kennisgeving door de Secretaris-Generaal of wel, indien deze Overeenkomst op die dag nog niet in werking is getreden, met ingang van de datum van haar inwerkingtreding.

2 Elke Staat die overeenkomstig het voorgaande lid een verklaring heeft afgelegd waardoor deze Overeenkomst van toepassing wordt op een gebied voor welker internationale betrekkingen hij verantwoordelijk is, kan deze Overeenkomst met betrekking tot dit gebied afzonderlijk opzeggen overeenkomstig de bepalingen van artikel 15.

Artikel 18

1 Elk geschil tussen twee of meer Overeenkomstsluitende Partijen ten aanzien van de uitlegging of de toepassing van deze Overeenkomst wordt, voor zoveel mogelijk, beslecht door middel van onderhandelingen tussen de Partijen waartussen geschil is gerezen.

2 Elk geschil dat niet is beslecht door onderhandelingen wordt aan een scheidsrechterlijke uitspraak onderworpen indien één der Overeenkomstsluitende Partijen waartussen geschil is gerezen, zulks verzoekt, en zal dienovereenkomstig worden verwezen naar een of meer scheidsrechters die door de Partijen waartussen geschil is gerezen in gemeenschappelijk overleg zijn gekozen. Indien binnen drie maanden na de datum van het verzoek om een scheidsrechterlijke uitspraak de Partijen waartussen geschil is gerezen niet tot overeenstemming zijn gekomen omtrent de keuze van een of meer scheidsrechters, kan ieder van die Partijen de Secretaris-Generaal van de Verenigde Naties verzoeken één scheidsrechter te benoemen naar wie het geschil ter beslechting zal worden verwezen.

3 De uitspraak van de overeenkomstig het vorig lid benoemde scheidsrechter of scheidsrechters zal de betrokken Overeenkomstsluitende Partijen binden.

Artikel 19

1 Elke Staat kan, op het tijdstip waarop hij deze Overeenkomst ondertekent of bekrachtigt of ertoe toetreedt, verklaren dat hij zich niet gebonden acht aan het tweede en het derde lid van artikel 18. De andere Overeenkomstsluitende Partijen zijn niet gebonden door deze leden tegenover elke Overeenkomstsluitende Partij die een zodanig voorbehoud heeft gemaakt.

2 Indien een Staat bij de nederlegging van zijn akte van bekrachtiging of toetreding een ander voorbehoud formuleert dan dat bedoeld in het eerste lid van dit artikel, deelt de Secretaris-Generaal der Verenigde Naties dit voorbehoud mede aan de Staten die hun akte van bekrachtiging of toetreding reeds hebben nedergelegd en deze Overeenkomst daarna niet hebben opgezegd. Het voorbehoud wordt geacht te zijn aanvaard, indien binnen zes maanden na de datum van deze mededeling geen van deze Staten zich tegen de aanvaarding ervan heeft verzet. In het tegenovergestelde geval wordt het voorbehoud niet toegelaten, en indien de Staat die het voorbehoud heeft geformuleerd dit niet intrekt, zal zijn nederlegging van de akte van bekrachtiging of toetreding geen gevolg hebben. Voor de toepassing van dit lid zal geen rekening worden gehouden met het verzet van de Staten waarvan toetreding of bekrachtiging krachtens dit lid geen effect heeft ten gevolge van het voorbehoud dat zij hebben geformuleerd.

3 Elke Overeenkomstsluitende Partij die bij het Protocol van ondertekening van deze Overeenkomst een voorbehoud heeft gemaakt of een voorbehoud heeft geformuleerd, dat overeenkomstig het eerste en tweede lid van dit artikel is aanvaard, kan dit voorbehoud te allen tijde intrekken door een aan de Secretaris-Generaal gerichte kennisgeving.

Artikel 20

1 Nadat deze Overeenkomst gedurende drie jaren van kracht is geweest, kan elke Overeenkomstsluitende Partij door een aan de Secretaris-Generaal van de Verenigde Naties gerichte kennisgeving de bijeenroeping van een conferentie verzoeken ten einde deze Overeenkomst te herzien. De Secretaris-Generaal doet van dit verzoek mededeling aan alle Overeenkomstsluitende Partijen en roept een herzieningsconferentie bijeen, indien binnen vier maanden na de datum van de door hem gedane mededeling ten minste een derde van de Overeenkomstsluitende Partijen hem hun instemming met dit verzoek hebben kenbaar gemaakt.

2 Indien overeenkomstig het vorige lid een conferentie wordt bijeengeroepen, zal de Secretaris-Generaal alle Overeenkomstsluitende Partijen daarvan in kennis stellen en hen uitnodigen, binnen drie maanden voorstellen in te dienen waarvan zij behandeling door de conferentie wensen. De Secretaris-Generaal doet niet korter dan drie maanden vóór de aanvang van de conferentie alle Overeenkomstsluitende Partijen mededeling van de voorlopige agenda voor de conferentie, alsmede van de tekst van de ingediende voorstellen.

3 De Secretaris-Generaal nodigt alle in het eerste lid van artikel 14 van deze Overeenkomst bedoelde Staten uit tot bijwoning van elke conferentie die overeenkomstig dit artikel wordt bijeengeroepen.

Artikel 21

1 Elke Overeenkomstsluitende Partij kan één of meer wijzigingen van deze Overeenkomst voorstellen. De tekst van elke voorgestelde wijziging wordt medegedeeld aan de Secretaris-Generaal van de Verenigde Naties, die deze tekst zal mededelen aan alle Overeenkomstsluitende Partijen en ter kennis brengen van de overige Staten, bedoeld in het eerste lid van artikel 14 van deze Overeenkomst.

2 Binnen zes maanden na de datum waarop de Secretaris-Generaal mededeling heeft gedaan van het wijzigingsvoorstel, kan iedere Overeenkomstsluitende Partij aan de Secretaris-Generaal mededelen:
- a) hetzij, dat zij bezwaar heeft tegen de voorgestelde wijziging,
- b) hetzij, dat, hoewel zij de bedoeling heeft om het voorstel te aanvaarden, aan de noodzakelijke voorwaarden voor deze aanvaarding in haar Staat nog niet is voldaan.

3 Zolang een Overeenkomstsluitende Partij die een mededeling bedoeld in het tweede lid, letter b), heeft gedaan, tot de Secretaris-Generaal geen kennisgeving van aanvaarding heeft gericht, kan zij gedurende negen maanden na het verstrijken van het door deze mededeling voorziene tijdvak van zes maanden, bezwaar maken tegen de voorgestelde wijziging.

4 Indien tegen de voorgestelde wijziging bezwaar wordt ingebracht, overeenkomstig het bepaalde in het tweede en derde lid van dit artikel, wordt de voorgestelde wijziging geacht niet te zijn aanvaard en geen effect te hebben.

5 Indien geen bezwaar wordt ingebracht tegen de voorgestelde wijziging overeenkomstig het bepaalde in het tweede en derde lid van dit artikel wordt de wijziging geacht te zijn aanvaard op het volgende tijdstip:
- a) wanneer geen Overeenkomstsluitende Partij een mededeling heeft gedaan krachtens het tweede lid, letter b), van dit artikel: na het verstrijken van het tijdvak van zes maanden, bedoeld in het tweede lid,
- b) wanneer een der Overeenkomstsluitende Partijen een mededeling heeft gedaan krachtens het tweede lid, letter b), van dit artikel, op de vroegste van de twee volgende data:
  - - de datum waarop alle Overeenkomstsluitende Partijen die een zodanige mededeling hebben gedaan aan de Secretaris-Generaal, kennis hebben gegeven van hun aanvaarding van het voorstel, welke datum echter wordt verschoven tot na het verstrijken van het tijdvak van zes maanden, bedoeld in het tweede lid van dit artikel, indien alle mededelingen betreffende de aanvaarding vóór het verstrijken van dit tijdvak zijn gedaan;
  - - de datum waarop het tijdvak van negen maanden, bedoeld in het derde lid van dit artikel, is verstreken.

5 bis Indien een land tussen het tijdstip van kennisgeving van een ontwerpwijziging en het tijdstip waarop deze geacht wordt te zijn aanvaard, Overeenkomstsluitende Partij wordt bij deze Overeenkomst, stelt het secretariaat van de Subcommissie voor het wegvervoer van de Economische Commissie van Europa de nieuwe Staat die Partij is geworden zo spoedig mogelijk in kennis van de ontwerpwijziging. De laatste kan de Secretaris-Generaal voor het verstrijken van de termijn van zes maanden vanaf de datum van toezending van de oorspronkelijke wijziging aan alle Overeenkomstsluitende Partijen in kennis stellen van enig bezwaar.

6 Elke wijziging die wordt geacht te zijn aanvaard treedt in werking drie maanden na de dag waarop zij geacht wordt te zijn aanvaard.

7 De Secretaris-Generaal richt zo spoedig mogelijk een kennisgeving aan alle Overeenkomstsluitende Partijen om hun te doen weten of overeenkomstig het tweede lid, letter a), van dit artikel een bezwaar is ingebracht tegen de voorgestelde wijziging en of hij van een of meer Overeenkomstsluitende Partijen een kennisgeving heeft ontvangen overeenkomstig het tweede lid, letter b). Indien hij van een of meer Overeenkomstsluitende Partijen een zodanige kennisgeving heeft ontvangen, zal hij daarna aan alle Overeenkomstsluitende Partijen mededelen of de desbetreffende Overeenkomstsluitende Partij(en) bezwaar maakt (maken) tegen de voorgestelde wijziging dan wel deze aanvaardt (aanvaarden).

8 Onafhankelijk van de in het eerste tot en met het zesde lid van dit artikel vastgestelde wijzigingsprocedure, kan de bijlage bij deze Overeenkomst worden gewijzigd bij overeenkomst tussen de bevoegde administraties van alle Overeenkomstsluitende Partijen; indien de bevoegde administratie van een Overeenkomstsluitende Partij heeft verklaard, dat haar nationale recht haar verplicht haar toestemming te laten afhangen van de verkrijging van een speciale machtiging daartoe ofwel van de goedkeuring van een wetgevend orgaan, zal de toestemming van de bevoegde administratie van de desbetreffende Overeenkomstsluitende Partij ten aanzien van de wijziging van de bijlage worden geacht te zijn gegeven op het tijdstip waarop die bevoegde administratie aan de Secretaris-Generaal heeft verklaard dat de vereiste machtiging of goedkeuring is verkregen. In de overeenkomst tussen de bevoegde administraties wordt de datum vastgesteld waarop de gewijzigde bijlage in werking treedt; er kan tevens in worden bepaald dat gedurende een overgangstermijn de oude bijlage geheel of gedeeltelijk naast de gewijzigde bijlage van kracht zal zijn.

Artikel 22

1 De aanhangsels 1 en 2 bij de bijlage bij deze Overeenkomst kunnen worden gewijzigd overeenkomstig de in dit artikel bepaalde procedure.

2 Op verzoek van een Overeenkomstsluitende Partij wordt elke door deze Partij voorgestelde wijziging van de aanhangsels 1 en 2 bij de bijlage bij deze Overeenkomst bestudeerd door de hoofdwerkgroep wegvervoer van de Economische Commissie voor Europa.

3 Indien zij wordt aangenomen door de meerderheid van de aanwezige leden die hun stem uitbrengen en indien deze meerderheid de meerderheid omvat van de aanwezige Overeenkomstsluitende Partijen die hun stem uitbrengen, wordt de wijziging door de Secretaris-Generaal ter kennis gebracht van de bevoegde administraties van alle Overeenkomstsluitende Partijen ter aanvaarding.

4 De wijziging is aanvaard indien, binnen zes maanden volgend op de datum van deze kennisgeving, minder dan een derde van de bevoegde administraties van de Overeenkomstsluitende Partijen de Secretaris-Generaal in kennis stelt van hun bezwaar tegen de wijziging.

4 bis Indien een land tussen het tijdstip van kennisgeving van een ontwerpwijziging en het tijdstip waarop deze geacht wordt te zijn aanvaard, Partij wordt bij deze Overeenkomst, stelt het secretariaat van de Subcommissie voor het wegvervoer van de Economische Commissie van Europa de nieuwe Staat die Partij is geworden zo spoedig mogelijk in kennis van de ontwerpwijziging. De laatste kan de Secretaris-Generaal voor het verstrijken van de termijn van zes maanden vanaf de datum van verzending van de oorspronkelijke wijziging aan alle Overeenkomstsluitende Partijen in kennis stellen van enig bezwaar.

5 Elke aanvaarde wijziging wordt door de Secretaris-Generaal ter kennis gebracht van alle Overeenkomstsluitende Partijen en treedt drie maanden na de datum van deze kennisgeving in werking.

Artikel 22 bis. Procedure voor het wijzigen van aanhangsel 1B

1 Aanhangsel 1B van de bijlage bij deze Overeenkomst wordt gewijzigd overeenkomstig de in dit artikel omschreven procedure.

2 Elk voorstel tot wijziging van de inleidende artikelen van aanhangsel 1B wordt aangenomen door de Subcommissie voor het wegvervoer van de Economische Commissie voor Europa met een meerderheid van de aanwezige Overeenkomstsluitende Partijen die hun stem uitbrengen. Elke aldus aangenomen wijziging wordt door het secretariaat van de Subcommissie voor het wegvervoer toegezonden aan de Secretaris-Generaal voor kennisgeving aan alle Overeenkomstsluitende Partijen. De wijziging treedt in werking drie maanden na de datum van de kennisgeving aan de Overeenkomstsluitende Partijen.

3 Aanhangsel 1B is een aanpassing ten behoeve van deze Overeenkomst van bijlage IB9van Verordening (EEG) 3821/85 zoals aangehaald in artikel 10 van deze Overeenkomst en rechtstreeks afhankelijk van de door de Europese Unie in deze bijlage geïntroduceerde ontwikkelingen; bijgevolg is elke wijziging van deze bijlage onder de volgende voorwaarden van toepassing op aanhangsel 1B:
- – het secretariaat van de Subcommissie voor het wegvervoer van de Economische Commissie voor Europa zal de bevoegde autoriteiten van alle Overeenkomstsluitende Partijen officieel in kennis stellen van de publicatie in het Publicatieblad van de Europese Gemeenschap van de in bijlage IB geïntroduceerde wijzigingen van de EG-verordening en deze informatie tezelfdertijd doen toekomen aan de Secretaris-Generaal tezamen met een afschrift van de desbetreffende teksten.
- – deze wijzigingen worden drie maanden na de datum van toezending van de informatie aan de Overeenkomstsluitende Partijen van kracht voor aanhangsel 1B.

4 Indien een voorstel tot wijziging van de bijlage bij deze Overeenkomst tevens wijziging van aanhangsel 1B inhoudt, mogen de wijzigingen betreffende het aanhangsel niet eerder van kracht worden dan de wijzigingen die de bijlage betreffen. Indien in dit kader tegelijkertijd met wijzigingen van de bijlage wijzigingen van aanhangsel 1B worden gepresenteerd, wordt de datum waarop zij van kracht worden bepaald door de datum die voortvloeit uit de toepassing van de procedures omschreven in artikel 21.

Artikel 22ter. Procedure voor de wijziging van Aanhangsel 3

1 Aanhangsel 3 bij de Bijlage bij deze Overeenkomst wordt gewijzigd in overeenstemming met de volgende procedure.

2 Elk voorstel tot opneming in Aanhangsel 3 van modelformulieren overeenkomstig artikel 12bis van deze Overeenkomst of tot wijziging van bestaande formulieren wordt, ter aanneming, voorgelegd aan de Subcommissie voor het wegvervoer van de Economische Commissie voor Europa. Het voorstel wordt geacht te zijn aanvaard indien het wordt aangenomen door een meerderheid van de aanwezige Overeenkomstsluitende Partijen die hun stem uitbrengen.

Het secretariaat van de Economische Commissie voor Europa stelt de bevoegde autoriteiten van alle Partijen bij deze Overeenkomst officieel op de hoogte van elke aldus aangenomen wijziging en deelt deze informatie tegelijkertijd mede aan de Secretaris-Generaal, vergezeld van een afschrift van de desbetreffende tekst.

3 Elk aldus aangenomen modelformulier kan worden gebruikt vanaf drie maanden na de datum waarop de informatie aan de Partijen bij deze Overeenkomst is medegedeeld.

Artikel 23

Naast de in de artikelen 20 en 21 van deze Overeenkomst bedoelde kennisgevingen doet de Secretaris-Generaal van de Verenigde Naties aan de in het eerste lid van artikel 14 van deze Overeenkomst bedoelde Staten mededeling van:

a) bekrachtigingen en toetredingen krachtens artikel 14 van deze Overeenkomst;
b) de data waarop krachtens artikel 14 deze Overeenkomst in werking treedt;
c) opzeggingen krachtens artikel 15 van deze Overeenkomst;
d) het krachtens artikel 16 buiten werking treden van deze Overeenkomst;
e) kennisgevingen ontvangen krachtens artikel 17 van deze Overeenkomst;
f) verklaringen en kennisgevingen ontvangen krachtens artikel 19 van deze Overeenkomst;
g) de inwerkingtreding van elke wijziging krachtens artikel 21 van deze Overeenkomst.

Artikel 24

Het Protocol van ondertekening bij deze Overeenkomst heeft dezelfde kracht, geldigheidsduur en hetzelfde gevolg als de Overeenkomst zelve, waarvan het geacht wordt een integrerend deel uit te maken.

Artikel 25

Na 31 maart 1971 wordt het origineel van deze Overeenkomst nedergelegd bij de Secretaris-Generaal van de Verenigde Naties, die aan alle landen, bedoeld in het eerste lid van artikel 14 van deze Overeenkomst, gewaarmerkte afschriften zal doen toekomen.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe behoorlijk gemachtigd, deze Overeenkomst hebben ondertekend.

GEDAAN te Genève, de eerste juli negentienhonderd zeventig in een enkel exemplaar in de Engelse en de Franse taal, zijnde beide teksten gelijkelijk authentiek.

BIJLAGE Controleapparaat

Algemene bepalingen

HOOFDSTUK I. TYPEGOEDKEURING

Artikel 1

Voor de toepassing van dit Hoofdstuk wordt verstaan onder „controleapparaat” „controleapparaat of zijn componenten”.

Aanvragen voor de goedkeuring van een type controleapparaat of een model van een registratieblad of een geheugenkaart worden, vergezeld van de desbetreffende specificaties door de fabrikant of zijn vertegenwoordiger ingediend bij een Overeenkomstsluitende Partij. Ter zake van een type controleapparaat, registratieblad- of een geheugenkaartmodel mag een aanvraag worden ingediend bij ten hoogste één Overeenkomstsluitende Partij.

Artikel 2

Een Overeenkomstsluitende Partij verleent haar typegoedkeuring aan elk type controleapparaat, aan elk registratieblad- of elk geheugenkaartmodel dat voldoet aan de in aanhangsel 1 of 1B bij deze bijlage neergelegde voorschriften, mits de Overeenkomstsluitende Partij in staat is te controleren of de productiemodellen voldoen aan het goedgekeurde prototype.

Voor het in aanhangsel 1B bedoelde controleapparaat mag geen typegoedkeuring worden verleend voordat aangetoond is dat het gehele systeem (het controleapparaat zelf, de bestuurderskaart en de elektrische verbindingen met de versnellingsbak) bestand is tegen pogingen tot manipulatie of wijziging van de gegevens omtrent de rijtijden. De benodigde beproevingen om dit vast te stellen worden uitgevoerd door deskundigen die vertrouwd zijn met de nieuwste manipulatietechnieken.

Voor wijzigingen van of toevoegingen aan een goedgekeurd model is een aanvullende typegoedkeuring vereist van de Overeenkomstsluitende Partij die de oorspronkelijke typegoedkeuring heeft verleend.

Artikel 3

De Overeenkomstsluitende Partijen verlenen de aanvrager een goedkeuringsmerk, dat voldoet aan het model vervat in aanhangsel 2, voor elk type controleapparaat of registratieblad- of geheugenkaartmodel dat zij ingevolge artikel 2 goedkeuren.

Artikel 4

De bevoegde autoriteiten van de Overeenkomstsluitende Partij waarbij een aanvraag om typegoedkeuring is ingediend, zenden ter zake van elk type controleapparaat of registratieblad- of geheugenkaartmodel dat zij goedkeuren of weigeren goed te keuren, binnen één maand de autoriteiten van de andere Overeenkomstsluitende Partijen een afschrift toe van het goedkeuringscertificaat vergezeld van afschriften van de desbetreffende specificaties, of stellen indien zulks het geval is deze autoriteiten ervan in kennis dat de goedkeuring is geweigerd; in geval van weigering vermelden zij de redenen voor hun besluit.

Artikel 5

1 Indien een Overeenkomstsluitende Partij die een typegoedkeuring als voorzien in artikel 2 heeft verleend, vaststelt dat een bepaald controleapparaat, registratieblad- of geheugenkaartmodel voorzien van een goedkeuringsmerk dat zij heeft afgegeven niet voldoet aan het door haar goedgekeurde prototype, neemt zij de nodige stappen om te waarborgen dat de productiemodellen voldoen aan het goedgekeurde prototype. De genomen maatregelen kunnen zo nodig leiden tot intrekking van de typegoedkeuring.

2 Een Overeenkomstsluitende Partij die een typegoedkeuring heeft verleend, trekt een dergelijke goedkeuring in, indien het goedgekeurde controleapparaat, het registratieblad- of geheugenkaartmodel niet voldoet aan deze bijlage of de aanhangsels daarbij of bij het gebruik ervan algemene defecten vertoont die het ongeschikt maken voor het doel waarvoor het beoogd is.

3 Indien een Overeenkomstsluitende Partij die een typegoedkeuring heeft verleend door een andere Overeenkomstsluitende Partij in kennis wordt gesteld van een van de gevallen bedoeld in het eerste en tweede lid, neemt zij, na overleg met laatstbedoelde Overeenkomstsluitende Partij, de in die leden neergelegde maatregelen met inachtneming van het vijfde lid.

4 Een Overeenkomstsluitende Partij die vaststelt dat zich een van de in het tweede lid bedoelde gevallen voordoet, kan tot nader bericht het op de markt brengen en in bedrijf stellen van het controleapparaat, registratieblad of de geheugenkaart verbieden. Hetzelfde geldt in de gevallen genoemd in het eerste lid met betrekking tot controleapparaten, registratiebladen of geheugenkaarten die zijn uitgesloten van de eerste verificatie, indien de fabrikant, na voldoende te zijn gewaarschuwd, nalaat de apparatuur in overeenstemming te brengen met het goedgekeurde model of met de vereisten van deze bijlage.

De bevoegde autoriteiten van de Overeenkomstsluitende Partijen stellen elkaar in elk geval binnen één maand in kennis van elke intrekking van een typegoedkeuring of van andere maatregelen die zijn getroffen uit hoofde van het eerste, tweede en derde lid, en vermelden de redenen voor een dergelijke maatregel.

5 Indien een Overeenkomstsluitende Partij die een typegoedkeuring heeft verleend, het bestaan van een van de in het eerste of tweede lid omschreven gevallen ter zake waarvan zij een kennisgeving heeft ontvangen bestrijdt, trachten de betrokken Overeenkomstsluitende Partijen het geschil te beslechten.

Artikel 6

1 Een aanvrager van een typegoedkeuring van een registratiebladmodel vermeldt op zijn aanvraag het type of de typen controleapparaat waarvoor het blad in kwestie is ontworpen en verschaft een geschikt apparaat van dat type of die typen ten behoeve van het beproeven van het blad.

2 De bevoegde autoriteiten van elke Overeenkomstsluitende Partij vermelden op het goedkeuringscertificaat voor het registratiebladmodel het type of de typen controleapparaat waarmee dat bladmodel kan worden gebruikt.

Artikel 7

Een Overeenkomstsluitende Partij kan niet weigeren een voertuig uitgerust met een controleapparaat in te schrijven of het in het verkeer brengen of het gebruik van een dergelijk voertuig verbieden om redenen die verband houden met het feit dat het voertuig met een dergelijk apparaat is uitgerust, indien het controleapparaat is voorzien van het goedkeuringsmerk bedoeld in artikel 3 en het installatieplaatje bedoeld in artikel 9.

Artikel 8

In alle besluiten uit hoofde van deze bijlage tot het weigeren of intrekken van de goedkeuring van een type controleapparaat, een registratieblad- of geheugenkaartmodel worden de redenen waarop zij gebaseerd zijn gedetailleerd beschreven. Besluiten worden aan de betrokken partij gezonden, die tegelijkertijd wordt geïnformeerd over de openstaande rechtsmiddelen krachtens de wetten van de Verdragsluitende Partij en de termijnen voor het instellen van die rechtsmiddelen.

HOOFDSTUK II. INSTALLATIE EN INSPECTIE

Artikel 9

1 Het controleapparaat kan uitsluitend worden geïnstalleerd of gerepareerd door installateurs of werkplaatsen die daartoe zijn goedgekeurd door de bevoegde autoriteiten van de Overeenkomstsluitende Partijen, nadat laatstbedoelde indien zij dat wensen, de opvattingen van de betrokken fabrikanten hebben vernomen.

De termijn van de administratieve geldigheid van de goedgekeurde werkplaats- en installateurskaarten mag niet langer zijn dan één jaar.

Indien een aan een goedgekeurde werkplaats of installateur afgegeven kaart moet worden verlengd, beschadigd is, slecht functioneert, verloren is of ontvreemd, verstrekt de autoriteit binnen vijf werkdagen na de ontvangst van een gedetailleerd verzoek daartoe een vervangende kaart.

Indien een nieuwe kaart wordt afgegeven ter vervanging van een oude, wordt de nieuwe kaart voorzien van hetzelfde werkplaatskaartnummer, maar het indexnummer wordt met één verhoogd. De autoriteit die de kaart afgeeft, houdt een register bij van verloren, gestolen of defecte kaarten.

De Overeenkomstsluitende Partijen nemen alle maatregelen die nodig zijn om te voorkomen dat de kaarten voor erkende installateurs en werkplaatsen worden vervalst.

2 De erkende installateur of werkplaats brengt een bijzonder merk aan op de door hem aangebrachte verzegelingen en vult voor een controleapparaat in overeenstemming met aanhangsel 1B de elektronische beveiligingsgegevens in ten behoeve van het uitvoeren van de authenticatiecontroles. De bevoegde autoriteiten van elke Overeenkomstsluitende Partij houden een register bij van de gebruikte merken en elektronische beveiligingsgegevens en van de kaarten afgegeven aan erkende werkplaatsen en installateurs.

3 De bevoegde autoriteiten van de Overeenkomstsluitende Partijen zenden elkaar hun lijsten toe van de erkende installateurs en werkplaatsen en van de aan hen afgegeven kaarten alsmede kopieën van de merken en van de nodige informatie die betrekking heeft op de gebruikte elektronische beveiligingsgegevens.

4 Teneinde te certificeren dat het controleapparaat is geïnstalleerd in overeenstemming met de voorschriften van deze bijlage, wordt een installatieplaatje aangebracht zoals voorzien in aanhangsel 1 of 1B.

5 Verzegelingen kunnen door de bevoegde autoriteiten in overeenstemming met het bepaalde in het eerste lid van dit artikel erkende installateurs of werkplaatsen of in de omstandigheden omschreven in aanhangsel 1 of 1B van deze bijlage worden verwijderd.

HOOFDSTUK III. GEBRUIK VAN APPARATUUR

Artikel 10

De werkgever en de bestuurders zorgen voor het correct functioneren en juiste gebruik van enerzijds het controleapparaat en anderzijds de bestuurderskaart indien een bestuurder een met een controleapparaat in overeenstemming met aanhangsel 1B uitgerust voertuig dient te besturen.

Artikel 11

1 De werkgever geeft een voldoende aantal registratiebladen af aan de bestuurders van voertuigen die uitgerust zijn met het controleapparaat in overeenstemming met aanhangsel 1, daarbij rekening houdend met het feit dat deze bladen persoonsgebonden zijn, de duur van het gebruik alsmede met de mogelijkheid dat bladen beschadigd raken of worden ingenomen door een inspecteur en dat deze moeten worden vervangen. De werkgever geeft aan de bestuurders alleen bladen van een goedgekeurd model af die geschikt zijn voor gebruik in het in het voertuig geïnstalleerde controleapparaat.

Indien het voertuig uitgerust is met een controleapparaat overeenkomstig aanhangsel 1B, zorgen de werkgever en de bestuurder ervoor dat, rekening houdend met de duur van het gebruik, het afdrukken op verzoek bedoeld in aanhangsel 1B correct kan geschieden bij een inspectie.

- a. De onderneming bewaart de registratiebladen en afdrukken, wanneer afdrukken zijn gemaakt ter naleving van artikel 12, eerste lid, in chronologische volgorde en in leesbare vorm gedurende ten minste een jaar nadat zij zijn gebruikt en overhandigt afschriften ervan aan de betrokken bestuurders die daarom verzoeken.
  
  De onderneming overhandigt tevens afschriften van overgebrachte gegevens van de bestuurderskaarten aan de betrokken bestuurders die daarom verzoeken alsmede de afgedrukte papieren van deze afschriften. De registratiebladen, afdrukken en overgebrachte gegevens worden getoond of overgelegd op verzoek van een bevoegde functionaris die belast is met de controle.
- b. Een onderneming die gebruik maakt van voertuigen die zijn uitgerust met een controle apparaat dat voldoet aan Aanhangsel 1B van deze Bijlage en die binnen het toepassingsgebied van deze Overeenkomst vallen:
  - i. waarborgt dat alle relevante gegevens zo vaak als door de Overeenkomstsluitende Partij is voorgeschreven, van de voertuigunit en de bestuurderskaart worden overgebracht en dat de relevante gegevens frequenter over worden gebracht om te waarborgen dat alle door of voor die onderneming verrichte activiteiten worden overgebracht;
  - ii. waarborgt dat alle gegevens die van de voertuigunit en de bestuurderskaart worden overgebracht gedurende ten minste twaalf maanden na de vastlegging ervan worden bewaard en op verzoek van een met de controle belaste functionaris bij de vestigingen van de onderneming rechtstreeks of op afstand toegankelijk zijn.
Voor de toepassing van deze subparagraaf wordt „overgebracht” uitgelegd in overeenstemming met de definitie vervat in Aanhangsel 1B, Hoofdstuk I, onderdeel s.

3 De bestuurderskaart zoals omschreven in aanhangsel 1B wordt, op verzoek van de bestuurder, afgegeven door de bevoegde autoriteit van de Overeenkomstsluitende Partij waar de bestuurder zijn normale woonplaats heeft.

Een Overeenkomstsluitende Partij kan van elke bestuurder op wie de bepalingen van de Overeenkomst van toepassing zijn en die zijn normale woonplaats op haar grondgebied heeft verlangen dat hij een bestuurderskaart bezit.
- a. Voor de toepassing van deze Overeenkomst wordt onder „normale woonplaats” verstaan de plaats waar een persoon gewoonlijk woont, dat wil zeggen gedurende ten minste 185 dagen per kalenderjaar, vanwege sociale en economische banden, of, in het geval van een persoon zonder economische banden, vanwege persoonlijke banden waaruit blijkt hoe nauw de banden tussen die persoon en de plaats waar hij woont zijn.
  
  De normale woonplaats van een persoon wiens economische banden een andere plaats betreffen dan zijn sociale banden en die bijgevolg op verschillende plaatsen woont die in twee of meer Overeenkomstsluitende Partijen zijn gelegen, wordt aangemerkt als zijnde de plaats van zijn sociale banden, mits deze persoon er regelmatig terugkeert. Aan deze laatste voorwaarde behoeft niet te worden voldaan indien de persoon in een Overeenkomstsluitende Partij woont teneinde een opdracht met een vaste looptijd uit te voeren.
- b. De bestuurders tonen hun normale woonplaats aan met behulp van passende middelen, zoals hun identiteitskaart of een ander geldig document.
- c. Indien er bij de bevoegde autoriteiten van de Overeenkomstsluitende Partij die de bestuurderskaart afgeven twijfel bestaat ten aanzien van de geldigheid van een verklaring omtrent de normale woonplaats afgelegd in overeenstemming met onderdeel b, of ten behoeve van bepaalde specifieke controles, kunnen zij verzoeken om aanvullende informatie of bewijzen.
- d. De bevoegde autoriteit van een Overeenkomstsluitende Partij die een kaart afgeeft, gaat, voorzover dit mogelijk is, na of de aanvrager niet reeds beschikt over een geldige bestuurderskaart.

- a. De bevoegde autoriteit van de Overeenkomstsluitende Partij voorziet de bestuurderskaart in overeenstemming met de bepalingen van aanhangsel 1B van de persoonsgegevens.
  
  De duur van de administratieve geldigheid van de bestuurderskaart mag niet langer zijn dan vijf jaar.
  
  De bestuurder mag slechts één geldige bestuurderskaart bezitten. De bestuurder is alleen bevoegd tot het gebruik van zijn eigen, van zijn persoonsgegevens voorziene bestuurderskaart. De bestuurder mag geen defecte of verlopen bestuurderskaart gebruiken.
  
  Indien een nieuwe bestuurderskaart wordt verstrekt ter vervanging van een oude, wordt de nieuwe kaart voorzien van hetzelfde bestuurderskaartnummer, maar het indexnummer wordt met één verhoogd. De autoriteit die de kaarten afgeeft, houdt een register bij van afgegeven, gestolen, verloren of defecte bestuurderskaarten voor een termijn die ten minste gelijk is aan hun termijn van geldigheid.
  
  Indien de bestuurderskaart beschadigd is, slecht functioneert of verloren of ontvreemd is, verstrekt de autoriteit binnen vijf werkdagen na de ontvangst van een gedetailleerd verzoek daartoe een vervangende kaart.
  
  Bij een verzoek om verlenging van een kaart waarvan de einddatum van de termijn van geldigheid nadert, verstrekt de autoriteit voor die datum een nieuwe kaart, mits zij het verzoek binnen de in artikel 12, eerste lid, vierde alinea neergelegde termijn heeft ontvangen.
- b. Bestuurderskaarten worden uitsluitend verstrekt aan aanvragers op wie de bepalingen van de Overeenkomst van toepassing zijn.
- c. De bestuurderskaart is persoonsgebonden. De kaart mag tijdens de officiële geldigheidstermijn niet, om welke reden dan ook, worden ingetrokken of opgeschort, tenzij de bevoegde autoriteit van een Overeenkomstsluitende Partij vaststelt dat de kaart vervalst is of de bestuurder gebruik maakt van een kaart waarvan hij niet de houder is, of dat de kaart verkregen is op basis van valse verklaringen en/of vervalste documenten. Indien deze maatregelen tot schorsing of intrekking worden genomen door een andere Overeenkomstsluitende Partij dan de Overeenkomstsluitende Partij die de kaart heeft afgegeven, zendt de eerstgenoemde Partij de kaart terug naar de autoriteiten van de Overeenkomstsluitende Partij die de kaart heeft afgegeven onder vermelding van de redenen voor terugzending.
- d. Bestuurderskaarten afgegeven door Overeenkomstsluitende Partijen worden wederzijds erkend.
  
  Indien de houder van een geldige bestuurderskaart die is afgegeven door een Overeenkomstsluitende Partij zijn normale woonplaats heeft gevestigd in een andere Overeenkomstsluitende Partij, kan hij verzoeken dat zijn kaart wordt omgewisseld voor een vergelijkbare bestuurderskaart; de Overeenkomstsluitende Partij die de kaarten omwisselt, verifieert zo nodig of de overgelegde kaart feitelijk nog geldig is.
  
  Overeenkomstsluitende Partijen die een kaart omwisselen zenden de oude kaart terug aan de autoriteiten van de Overeenkomstsluitende Partij die de kaart hebben afgegeven onder vermelding van de redenen daarvoor.
- e. Indien een Overeenkomstsluitende Partij een bestuurderskaart vervangt of omwisselt, wordt de vervanging of omwisseling en de eventueel daarop volgende vervanging of verlenging in die Overeenkomstsluitende Partij geregistreerd.
- f. De Overeenkomstsluitende Partijen nemen alle maatregelen die nodig zijn om te voorkomen dat bestuurderskaarten worden vervalst.

5 De Overeenkomstsluitende Partijen waarborgen dat de gegevens die nodig zijn om de naleving van deze Overeenkomst te volgen en die vastgelegd en opgeslagen kunnen worden door het controleapparaat in overeenstemming met aanhangsel 1B bij deze bijlage gedurende 365 dagen na de datum van vastlegging kunnen worden opgeslagen en toegankelijk gemaakt kunnen worden onder voorwaarden die de veiligheid en juistheid van de gegevens waarborgen.

De Overeenkomstsluitende Partijen nemen alle maatregelen die nodig zijn om te waarborgen dat het doorverkopen of uitschakelen van een controleapparaat niet ten koste kan gaan van de correcte toepassing van dit lid.

Artikel 12

1 De bestuurders gebruiken geen vuile of beschadigde registratiebladen of bestuurderskaarten. De bladen of bestuurderskaarten worden daartoe op de juiste wijze beschermd.

Bij beschadiging van een blad of bestuurderskaart waarop gegevens zijn geregistreerd, voegen de bestuurders het beschadigde blad of de beschadigde kaart bij een reserveblad of een tijdelijk blad dat ter vervanging wordt gebruikt.

Indien de bestuurderskaart beschadigd is, slecht functioneert of verloren of ontvreemd is, verzoekt de bestuurder de bevoegde autoriteiten van de Overeenkomstsluitende Partij waar hij zijn normale woonplaats heeft binnen zeven kalenderdagen om een vervangend exemplaar.

Indien een bestuurder zijn bestuurderskaart wenst te verlengen, dient hij uiterlijk 15 werkdagen voor het verstrijken van de geldigheid van de kaart een verzoek in bij de bevoegde autoriteiten van de Overeenkomstsluitende Partij waarin hij zijn normale woonplaats heeft.

- a. De bestuurders dienen voor elke dag waarop zij rijden de registratiebladen of bestuurderskaart te gebruiken vanaf het tijdstip waarop zij het voertuig overnemen. Het registratieblad of de bestuurderskaart wordt niet uit het apparaat genomen vóór het einde van de dagelijkse werktijd, tenzij dit anderszins is toegestaan. Een registratieblad of bestuurderskaart mag niet worden gebruikt voor een langere periode dan waarvoor deze is bedoeld.
  
  Wanneer zich aan boord van een voertuig dat is uitgerust met een controle apparaat in overeenstemming met Aanhangsel 1B meer dan één bestuurder bevindt, dient elke bestuurder ervoor te zorgen dat zijn bestuurderskaart in de juiste sleuf in de tachograaf wordt geplaatst.
- b. Wanneer een bestuurder na afwezigheid uit het voertuig niet in staat is het in het voertuig geïnstalleerde controle apparaat te gebruiken, dienen de tijdvakken vermeld in paragraaf 3, tweede inspringing, b, c en d hieronder:
  - i. indien het voertuig is uitgerust met een controle apparaat in overeenstemming met Aanhangsel 1, leesbaar en zonder bevuiling van het blad, hetzij handmatig, via automatische opname of andere middelen op het registratieblad te worden aangetekend; of
  - ii. indien het voertuig is uitgerust met een controle apparaat in overeenstemming met Aanhangsel 1B, met gebruikmaking van de in controle apparaat aanwezige handmatige invoervoorziening op de bestuurderskaart te worden aangetekend.
- c. De bestuurders brengen op de registratiebladen de noodzakelijke wijzigingen aan indien er aan boord van het voertuig meer dan één bestuurder is en wel zodanig dat de in paragraaf 3, tweede inspringing, onderdelen b, c en d hieronder, bedoelde informatie wordt geregistreerd op het registratieblad van de bestuurder die daadwerkelijk rijdt.

3 De bestuurders:
- – zorgen ervoor dat de op het blad geregistreerde tijdstippen overeenkomen met de officiële tijd van het land waar het voertuig ingeschreven is.
- – bedienen de schakelmechanismen waarmee de volgende tijdscategorieën afzonderlijk en duidelijk worden vastgelegd:
  - a. onder het teken
    
    of
    
    10 : de rijtijd;
  - b. onder het teken
    
    of
    
    11 : alle overige werktijden;
  - c. onder het teken
    
    of
    
    12 : de beschikbaarheidstijden, te weten:
    - – de wachttijd, dat wil zeggen de tijd gedurende welke de bestuurders slechts op hun post behoeven te blijven voor het beantwoorden van eventuele telefonische oproepen om het voertuig (weer) te gaan besturen of andere werkzaamheden te verrichten;
    - – de naast de bestuurder doorgebrachte tijd terwijl het voertuig rijdt;
    - – de op een slaapbank doorgebrachte tijd terwijl het voertuig rijdt;
  - d. onder het teken
    
    of
    
    13 : de onderbrekingen van de werkzaamheden en de dagelijkse rustperioden.

4 Elke Overeenkomstsluitende Partij kan toestaan dat alle in het derde lid, tweede streepje, onderdelen b en c, bedoelde tijden op de in de op haar grondgebied ingeschreven voertuigen gebruikte registratiebladen onder het teken

worden geregistreerd.

5 Elk lid van de betrokken bemanning registreert de volgende informatie op zijn registratieblad:
- a. aan het begin van het gebruik van het blad: zijn achternaam en voornaam;
- b. de datum en plaats waar begonnen wordt met het blad en de datum en plaats waar het gebruik ervan eindigt;
- c. het registratienummer van elk voertuig waaraan hij is toegewezen, zowel bij het begin van de eerste rit die geregistreerd wordt op het blad en vervolgens, indien hij van voertuig wisselt tijdens het gebruik van het blad;
- d. de stand van de kilometerteller:
  - -
    aan het begin van de eerste rit die op het blad wordt geregistreerd,
  - -
    aan het eind van de laatste rit die op het blad wordt geregistreerd,
  - -
    indien hij van voertuig wisselt tijdens een werkdag (stand in het voertuig waaraan hij was toegewezen en de stand in het volgende voertuig waaraan hij is toegewezen);
- e. indien relevant, het tijdstip waarop van voertuig werd gewisseld.

5 bis De bestuurder voert in het controleapparaat in overeenstemming met aanhangsel 1B de symbolen in van de landen waarin hij zijn dagelijkse werktijd begint en eindigt.

Het invoeren van de bovengenoemde gegevens wordt geactiveerd door de bestuurder en kan geheel handmatig of automatisch geschieden, indien het controleapparaat gekoppeld is aan een satellietvolgsysteem.

6 Het controleapparaat omschreven in aanhangsel 1 wordt zodanig vormgegeven dat het voor een bevoegde functionaris die belast is met de inspectie mogelijk is zo nodig na het openen van de apparatuur het geen geregistreerd is met betrekking tot de negen aan de inspectie voorgaande uren af te lezen zonder het blad permanent te vervormen, beschadigen of vuil te maken.

Het apparaat is voorts zodanig vormgegeven dat het zonder de behuizing te openen mogelijk is te controleren of er registratie plaatsvindt.

- a. Een bestuurder die een voertuig bestuurt dat is uitgerust met een controle apparaat in overeenstemming met Aanhangsel 1, dient te allen tijde op verzoek van een functionaris die belast is met de controle het volgende te tonen:
  - i. de registratiebladen van de lopende week en die welke de bestuurder de 15 voorgaande kalenderdagen heeft gebruikt;
  - ii. de bestuurderskaart indien hij er een bezit; en
  - iii. elke handmatige registratie en afdruk gemaakt tijdens de lopende week en de 15 voorgaande kalenderdagen, als vereist ingevolge deze Overeenkomst.
  Vanaf de in artikel 13bis van deze Overeenkomst vermelde toepassingsdatum dienen de onder i en iii vermelde tijdvakken betrekking te hebben op de huidige dag en de 28 voorgaande kalenderdagen.
- b. Een bestuurder die een voertuig bestuurt dat is uitgerust met een controle apparaat in overeenstemming met Aanhangsel 1B, dient te allen tijde op verzoek van een functionaris die belast is met de controle het volgende te tonen:
  - i. de bestuurderskaart waarvan hij de houder is;
  - ii. elke handmatige registratie en afdruk gemaakt tijdens de lopende week en de 15 voorgaande kalenderdagen, als vereist ingevolge deze Overeenkomst;
  - iii. de registratiebladen die op hetzelfde tijdvak betrekking hebben als het blad bedoeld in de voorgaande subparagraaf, gedurende hetwelk hij een voertuig bestuurde dat is uitgerust met een controle apparaat in overeenstemming met Aanhangsel 1.
  Vanaf de in artikel 13bis van deze Overeenkomst vermelde toepassingsdatum dienen de onder ii vermelde tijdvakken betrekking te hebben op de huidige dag en de 28 voorgaande kalenderdagen.
- c. Een bevoegd functionaris die belast is met de inspectie kan de naleving van de Overeenkomst controleren door middel van een onderzoek van de registratiebladen, van de getoonde of afgedrukte gegevens die door het controleapparaat zijn geregistreerd of via de bestuurderskaart of bij ontbreken daarvan door een onderzoek van andere ondersteunende documenten, die het niet-naleven van een bepaling zoals die welke zijn neergelegd in artikel 13, tweede en derde lid, rechtvaardigen.

8 Het is verboden gegevens te vervalsen, uit te wissen of te vernietigen, die zijn vastgelegd op het registratieblad, opgeslagen in het controleapparaat of op de bestuurderskaart of op afdrukken van het controleapparaat zoals omschreven in aanhangsel 1B. Hetzelfde geldt voor elke manipulatie met het controleapparaat, het registratieblad of de bestuurderskaart die kan leiden tot vervalsing, achterwege laten of vernietiging van gegevens en/of afgedrukte informatie. Er mag geen enkel apparaat in het voertuig aanwezig zijn dat gebruikt zou kunnen worden voor de genoemde vormen van manipulatie.

Artikel 13

1 Indien het controleapparaat defect raakt of slecht functioneert, laat de werkgever het repareren door een erkende installateur of werkplaats zodra de omstandigheden dat toelaten.

Indien het voertuig niet binnen één week, te rekenen vanaf de datum waarop het apparaat defect raakte of ontdekt werd dat het slecht functioneert, kan terugkeren naar de standplaats, wordt de reparatie onderweg uitgevoerd.

Op basis van door de Overeenkomstsluitende Partijen genomen maatregelen kunnen de bevoegde autoriteiten gemachtigd worden het gebruik van het voertuig te verbieden in gevallen waarin het defecte of slecht functionerende apparaat niet is hersteld zoals voorzien in de voorgaande leden.

- a. Indien het apparaat buiten gebruik of defect is, noteert de bestuurder op het registratieblad of de registratiebladen, dan wel op een bij het registratieblad of de bestuurderskaart te voegen geschikt blad gegevens waarmee hij kan worden geïdentificeerd (naam en nummer van zijn rijbewijs of naam en nummer van zijn bestuurderskaart), en zijn handtekening alsmede alle informatie over de verscheidene tijdvakken die niet meer zijn geregistreerd of niet meer correct met het controle apparaat zijn afgedrukt.
- b. Wanneer een bestuurderskaart beschadigd is, defect is, verloren of ontvreemd is, of niet in het bezit van de bestuurder is, handelt de bestuurder als volgt:
  - i. hij drukt bij de aanvang van zijn reis de gegevens af van het voertuig dat hij bestuurt en vult op die afdruk het volgende in:
    - – gegevens waarmee de bestuurder kan worden geïdentificeerd (naam en nummer van zijn rijbewijs of naam en nummer van zijn bestuurderskaart), alsmede zijn handtekening;
    - – de in artikel 12, paragraaf 3, tweede inspringing, onderdelen b, c en d bedoelde tijdvakken;
  - ii. hij drukt na beëindiging van zijn reis de informatie af die betrekking heeft op de tijdvakken die door het controle apparaat zijn geregistreerd, registreert alle tijdvakken van andere werkzaamheden, beschikbaarheid en de rust genomen sedert de bij de aanvang van de reis gemaakte afdruk, wanneer deze niet door de tachograaf zijn geregistreerd, en noteert in dat document de gegevens waarmee de bestuurder kan worden geïdentificeerd (naam en nummer van zijn rijbewijs of naam en nummer van zijn bestuurderskaart), alsmede zijn handtekening.

3 Indien een bestuurderskaart beschadigd is of niet functioneert, doet de bestuurder de kaart toekomen aan de bevoegde autoriteiten van de Overeenkomstsluitende Partij waarin hij zijn normale woonplaats heeft. Van ontvreemding van de bestuurderskaart wordt formeel aangifte gedaan bij de bevoegde autoriteiten van de Staat waar de ontvreemding heeft plaatsgevonden.

Bij verlies van de bestuurderskaart dient een formele verklaring te worden afgelegd bij de bevoegde autoriteiten van de Overeenkomstsluitende Partij die de kaart hebben afgegeven en bij de bevoegde autoriteiten van de Overeenkomstsluitende Partij waar hij zijn normale woonplaats heeft, indien dit een andere Partij betreft.

De bestuurder kan ten hoogste vijftien kalenderdagen zonder bestuurderskaart blijven rijden of langer indien dit nodig is om het voertuig te laten terugkeren naar de standplaats, mits de bestuurder kan aantonen dat het onmogelijk is de kaart in die periode te tonen of te gebruiken.

Indien de autoriteiten van de Overeenkomstsluitende Partij waar de bestuurder zijn normale woonplaats heeft niet dezelfde zijn als die welke zijn kaart hebben afgegeven en de laatstbedoelde verzocht worden de bestuurderskaart te verlengen, vervangen of om te wisselen, stellen zij de autoriteiten die de oude kaart hebben afgegeven in kennis van de precieze redenen voor de verlenging, vervanging of omwisseling.

Artikel 14

1 Ingevolge artikel 13, tweede lid, onderdeel b, van de Overeenkomst, dienen bestuurders die een in een Overeenkomstsluitende Partij ingeschreven voertuig besturen en aan wie de bevoegde autoriteiten nog geen bestuurderskaart hebben kunnen afgeven en die gedurende de overgangsperiode bedoeld in het eerste lid van dit artikel deelnemen aan het internationaal verkeer met een voertuig dat is uitgerust met een digitaal controleapparaat overeenkomstig aanhangsel 1B bij de bijlage, te allen tijde wanneer een functionaris belast met de inspectie daarom verzoekt in staat te zijn de afdrukken en/of registratiebladen te tonen van de lopende week en in elk geval de afdruk en/of het registratieblad van de laatste dag waarop zij reden in de voorafgaande week.

2 Het eerste lid is niet van toepassing op bestuurders van voertuigen die ingeschreven zijn in een land waar een bestuurderskaart verplicht is. De bestuurders tonen evenwel te allen tijde afdrukken indien een functionaris belast met de inspectie daarom verzoekt.

3 De in het eerste lid bedoelde afdrukken moeten worden voorzien van de gegevens waarmee de bestuurders kunnen worden geïdentificeerd (naam en nummer van het rijbewijs) alsmede hun handtekening.

Bijlage - Aanhangsel 1

CONSTRUCTIE, BEPROEVINGS-, INSTALLATIE- EN CONTROLEVOORSCHRIFTEN

I. DEFINITIES

In dit aanhangsel wordt verstaan:

a. onder „controle-apparaat” een apparaat dat is bestemd om in wegvoertuigen te worden ingebouwd om gegevens betreffende het rijden van deze voertuigen en bepaalde werktijden van hun bestuurders aan te geven en automatisch of semi-automatisch te registreren;
b. onder „registratieblad” een blad dat is ontworpen om aantekeningen op te nemen en te registreren, dat dient te worden aangebracht in het controle-apparaat en waarop de schrijfstiften van dit apparaat continu de diagrammen van de te registreren gegevens optekenen;
c. onder „constante van het controle-apparaat” het getal dat de waarde aangeeft van het ingangssignaal dat nodig is ter aanduiding en registratie van een afgelegde afstand van 1 km; deze constante moet hetzij in omwentelingen per kilometer (k = ...omw/km), hetzij in impulsen per kilometer (k = ...imp/km) worden uitgedrukt;
d. onder „kenmerkende coëfficiënt van het voertuig” het getal dat de waarde aangeeft van het uitgangssignaal van het op het voertuig aangebrachte onderdeel voor de aansluiting op het controle-apparaat (in sommige gevallen aftakas van de versnellingsbak, soms ook wiel van het voertuig), wanneer het voertuig de afstand van een km aflegt, gemeten onder normale beproevingsomstandigheden (zie hoofdstuk VI, vierde lid, van dit aanhangsel). De kenmerkende coëfficiënt wordt hetzij in omwentelingen per kilometer (w = ...omw/uur), hetzij in impulsen per kilometer (w = ... imp/km) uitgedrukt;
e. onder „effectieve omtrek der wielbanden” het gemiddelde der afstanden, afgelegd door elk der het voertuig aandrijvende wielen (aandrijfwielen) bij een volledige omwenteling. Het meten van deze afstanden moet geschieden onder normale beproevingsomstandigheden (zie hoofdstuk VI, vierde lid, van dit aanhangsel) en wordt als volgt uitgedrukt: 1 = ... mm”.

II. ALGEMENE KENMERKEN EN FUNCTIES VAN HET CONTROLE-APPARAAT

Het controle-apparaat moet onderstaande gegevens registreren:

1. afstand, afgelegd door het voertuig;
2. snelheid van het voertuig;
3. rijtijd;
4. overige werktijden en beschikbaarheidstijden;
5. arbeidsonderbrekingen en dagelijkse rusttijden;
6. opening van de kast die het registratieblad bevat;
7. voor elektronische controle-apparaten die functioneren op basis van signalen die elektrisch worden overgebracht door de afstand- en snelheidsreceptor: elke onderbreking van meer dan 100 milliseconden van de toevoer van het apparaat (met uitzondering van de verlichting), van de toevoer van de afstands- en snelheidsreceptor en elke onderbreking van het signaal van de afstands- en snelheidsreceptor.

Bij voertuigen die worden gebruikt door twee bestuurders moeten de onder 3, 4 en 5 genoemde gegevens gelijktijdig en onderscheidbaar op twee aparte bladen door het apparaat kunnen worden geregistreerd.

III. CONSTRUCTIE-EISEN VAN HET CONTROLE-APPARAAT

A. ALGEMEEN

1. De volgende inrichtingen zijn voor het controle-apparaat voorgeschreven:
- a. inrichtingen waarop kan worden afgelezen:
  - - de afgelegde afstand (totaalteller),
  - - de snelheid (tachometer),
  - - de tijd (uurwerk);
- b. registreerinrichtingen, te weten:
  - - een registreertoestel voor de afgelegde afstand,
  - - een registreertoestel voor de snelheid,
  - - een of meer registreertoestellen voor de tijd, die voldoen aan de in hoofdstuk III, C, onder 4, gestelde eisen;
- c. een merkinrichting die op het registratieblad afzonderlijk aangeeft:
  - - elk openen van de kast die dit blad bevat,
  - - voor de elektronische controle-apparaten als bedoeld in punt 7 van hoofdstuk II: elke onderbreking van de toevoer van meer dan 100 milliseconden van het apparaat (met uitzondering van de verlichting), uiterlijk op het moment dat er weer toevoer is,
  - - voor de elektronische controle-apparaten als bedoeld in punt 7 van hoofdstuk II: elke onderbreking van de toevoer van meer dan 100 milliseconden van de afstands- en snelheidsreceptor en elke onderbreking van het signaal van de afstands- en snelheidsreceptor.
2. Indien in het apparaat andere inrichtingen dan de bovengenoemde aanwezig zijn, mogen deze de juiste werking der verplichte inrichtingen niet schaden en het aflezen daarvan niet bemoeilijken. Wanneer het controle-apparaat ter goedkeuring wordt aangeboden, dienen deze eventuele andere inrichtingen te zijn aangebracht.
3. Materiaal
- a. Alle samenstellende delen van het controle-apparaat moeten zijn uitgevoerd in materiaal van voldoende stabiliteit en mechanische sterkte en met onveranderlijke elektrische en magnetische eigenschappen.
- b. Elke wijziging van een samenstellend deel van het controleapparaat of in de aard van het materiaal dat voor de vervaardiging ervan is gebruikt, moet worden goedgekeurd door de autoriteit die het apparaat heeft goedgekeurd.
4. Meting van de afgelegde afstand

De afgelegde afstanden kunnen worden opgeteld en geregistreerd:
- - hetzij bij vooruitrijden en achteruitrijden
- - hetzij uitsluitend bij vooruitrijden.
Het eventueel registreren der achteruitrijmanoeuvres mag beslist geen invloed uitoefenen op de duidelijkheid en de nauwkeurigheid van de overige registraties.
5. Meting van de snelheid
- a. Het meetbereik van de snelheidsmeter is vastgelegd in het modelgoedkeuringscertificaat.
- b. De eigen frequentie en het dempingsorgaan van het meetmechanisme moeten zodanig zijn, dat de aflees- en registreerinrichtingen van de snelheid in het meetbereik, binnen de maximaal toelaatbare toleranties, versnellingen kunnen volgen tot 2 m/s².
6. Tijdmeting (uurwerk)
- a. De aandrijving van het bijstelorgaan moet zich bevinden binnenin de kast welke het registratieblad bevat en waarvan elk openen automatisch wordt opgetekend op het registratieblad.
- b. Indien het voortbewegingsmechanisme van het registratieblad door het uurwerk wordt aangedreven, moet de tijd gedurende welke het geheel opgewonden uurwerk juist aanwijst ten minste 10% langer zijn dan de tijd waarin geregistreerd kan worden op het grootste aantal bladen dat het apparaat kan bevatten.
7. Verlichting en bescherming
- a. De afleesinrichtingen van het controle-apparaat moeten zijn voorzien van een afdoende, niet-verblindende verlichting.
- b. Alle inwendige delen van het apparaat moeten voor normale gebruiksomstandigheden beschermd zijn tegen vocht en stof. Verder moeten zij door middel van omhulsels die kunnen worden verzegeld, beschermd zijn tegen ingrepen van buitenaf.

B. AFLEESINRICHTINGEN

1. Afleesinrichting voor de afgelegde afstand (totaalteller)
- a. De afleeseenheid voor de afgelegde afstand moet 0,1 km zijn. De cijfers die hectometers aangeven moeten nauwkeurig kunnen worden onderscheiden van de cijfers die het aantal hele kilometers aangeven.
- b. De cijfers van de totaalteller moeten duidelijk leesbaar zijn en een hoogte van ten minste 4 mm hebben.
- c. De totaalteller moet kunnen aanwijzen tot ten minste 99.999,9 km.
2. Afleesinrichting voor de snelheid (tachometer)
- a. Binnen het meetbereik moet de snelheidsschaal gelijkelijk zijn ingedeeld in 1, 2, 5 of 10 km/u. De snelheidswaarde van een onderverdeling (tussenruimte tussen twee achtereenvolgende deelstreepjes) mag niet meer bedragen dan 10% van de hoogste snelheid die op het eind van de schaal is aangegeven.
- b. Het aanwijsbereik boven het meetbereik behoeft niet te zijn becijferd.
- c. De afstand tussen twee achtereenvolgende deelstreepjes overeenkomend met een snelheidsverschil van 10 km/u mag niet minder bedragen dan 10 mm.
- d. Op een afleesinrichting met een wijzer mag de afstand tussen de wijzer en de wijzerplaat niet groter zijn dan 3 mm.
