Your Excellency,
I have the honour to refer to the negotiations between the Government of Trinidad
and Tobago and the Government of the Kingdom of the Netherlands held in Port of Spain,
Trinidad and Tobago, during the period 21-23 January 2002, and to indicate that the
two delegations arrived at the following understandings in respect of Articles 2,
3 and 6 of the Treaty between the Republic of Trinidad and Tobago and the Kingdom
of the Netherlands on Extradition (hereinafter referred to as „the Extradition Treaty"):

Article 2 - Extraditable Offences:
It is understood that offences referred to in paragraphs 1 and 2 include offences
relating to taxation, customs or revenue or offences of a purely fiscal character.

Article 3 - Extradition of Nationals:
It is understood that with respect to paragraph 1 the Kingdom of the Netherlands will
require a guarantee that the person claimed will be returned to the Netherlands, the
Netherlands Antilles, Aruba, as the case may be, to serve his sentence there in accordance
with Article 11 of the Convention on the Transfer of Sentenced Persons, done at Strasbourg
on 21 March 1983, if, following his extradition, a custodial sentence or a measure
depriving him of his liberty is imposed.

Article 6 - Documents to be submitted:
The Parties agreed to exchange information to facilitate the preparation of an extradition
request.
It is understood that these understandings do not alter, modify or vary in any way
the purport or intent of the substantive text contained in Articles 2, 3 and 6 of
the Extradition Treaty.
If the foregoing is acceptable to the Government of the Kingdom of the Netherlands
as a true record of the understandings reached in respect of Articles 2, 3 and 6 of
the Extradition Treaty, I have the further honour to propose that the present Note
and Your Excellency's Note in reply to that effect, shall constitute an agreement
between our two Governments on this matter.
I avail myself of this opportunity to renew to Your Excellency the assurances of my
highest consideration.
