Agreement on the Importation of Educational, Scientific and Cultural Materials

Preamble

The Contracting States,

Considering that the free exchange of ideas and knowledge and, in general, the widest possible dissemination of the diverse forms of self-expression used by civilisations are vitally important both for intellectual progress and international understanding, and consequently for the maintenance of world peace;

Considering that this interchange is accomplished primarily by means of books, publications and educational, scientific and cultural materials;

Considering that the Constitution of the United Nations Educational, Scientific and Cultural Organisation urges co-operation between nations in all branches of intellectual activity, including “the exchange of publications, objects of artistic and scientific interest and other materials of information” and provides further that the Organisation shall “collaborate in the work of advancing the mutual knowledge and understanding of peoples, through all means of mass communication, and to that end recommend such international agreements as may be necessary to promote the free flow of ideas by word and image”;

Recognise that these aims will be effectively furthered by an international agreement facilitating the free flow of books, publications and educational, scientific and cultural materials; and

Have, therefore, agreed to the following provisions:—

Article I

  • 1 The Contracting States undertake not to apply customs duties or other charges on, or in connexion with, the importation of—

    • (a) Books, publications and documents, listed in annex A to this Agreement;

    • (b) Educational, scientific and cultural materials, listed in annexes B, C, D and E to this Agreement;

    which are the products of another Contracting State, subject to the conditions laid down in those annexes.

  • 2 The provisions of paragraph 1 of this article shall not prevent any Contracting State from levying on imported materials—

    • (a) Internal taxes or any other internal charges of any kind, imposed at the time of importation or subsequently, not exceeding those applied directly or indirectly to like domestic products;

    • (b) Fees and charges, other than customs duties, imposed by governmental authorities on, or in connexion with, importation, limited in amount to the approximate cost of the services rendered, and representing neither an indirect protection to domestic products nor a taxation of imports for revenue purposes.

Article II

  • 1 The Contracting States undertake to grant the necessary licences and/or foreign exchange for the importation of the following articles:—

    • (a) Books and publications consigned to public libraries and collections and to the libraries and collections of public educational, research or cultural institutions;

    • (b) Official government publications, that is, official, parliamentary and administrative documents published in their country of origin;

    • (c) Books and publications of the United Nations or any of its specialised agencies;

    • (d) Books and publications received by the United Nations Educational, Scientific and Cultural Organisation and distributed free of charge by it or under its supervision;

    • (e) Publications intended to promote tourist travel outside the country of importation, sent and distributed free of charge;

    • (f) Articles for the blind:

      • (i) Books, publications and documents of all kinds in raised characters for the blind;

      • (ii) Other articles specially designed for the educational, scientific or cultural advancement of the blind, which are imported directly by institutions or organisations concerned with the welfare of the blind, approved by the competent authorities of the importing country for the purpose of duty-free entry of these types of articles.

  • 2 The Contracting States which at any time apply quantitative restrictions and exchange control measures undertake to grant, as far as possible, foreign exchange and licences necessary for the importation of other educational, scientific or cultural materials, and particularly the materials referred to in the annexes to this Agreement.

Article III

  • 1 The Contracting States undertake to give every possible facility to the importation of educational, scientific or cultural materials, which are imported exclusively for showing at a public exhibition approved by the competent authorities of the importing country and for subsequent re-exportation. These facilities shall include the granting of the necessary licences and exemption from customs duties and internal taxes and charges of all kinds payable on importation, other than fees and charges corresponding to the approximate cost of services rendered.

  • 2 Nothing in this article shall prevent the authorities of an importing country from taking such steps as may be necessary to ensure that the materials in question shall be re-exported at the close of their exhibition.

Article IV

The Contracting States undertake that they will as far as possible—

  • (a) Continue their common efforts to promote by every means the free circulation of educational, scientific or cultural materials, and abolish or reduce any restrictions to that free circulation which are not referred to this Agreement;

  • (b) Simplify the administrative procedure governing the importation of educational, scientific or cultural materials;

  • (c) Facilitate the expeditious and safe customs clearance of educational, scientific or cultural materials.

Article V

Nothing in this Agreement shall affect the right of Contracting States to take measures, in conformity with their legislation, to prohibit or limit the importation, or the circulation after importation, of articles on grounds relating directly to national security, public order or public morals.

Article VI

This Agreement shall not modify or affect the laws and regulations of any Contracting State or any of its international treaties, conventions, agreements or proclamations, with respect to copyright, trademarks or patents.

Article VII

Subject to the provisions of any previous conventions to which the Contracting States may have subscribed for the settlement of disputes, the Contracting States undertake to have recourse to negotiations or conciliation, with a view to settlement of any disputes regarding the interpretation or the application of this Agreement.

Article VIII

In case of a dispute between Contracting States relating to the educational, scientific or cultural character of imported materials, the interested Parties may, by common agreement, refer it to the Director-General of the United Nations Educational, Scientific and Cultural Organisation for an advisory opinion.

Article IX

  • 1 This Agreement, of which the English and French texts are equally authentic, shall bear to-day's date and remain open for signature by all Member States of the United Nations Educational, Scientific and Cultural Organisation, all Member States of the United Nations and any non-member State to which an invitation may have been adressed by the Executive Board of the United Nations Educational, Scientific and Cultural Organisation.

  • 2 The Agreement shall be ratified on behalf of the signatory States in accordance with their respective constitutional procedure.

  • 3 The instruments of ratification shall be deposited with the Secretary-General of the United Nations.

Article X

The States referred to in paragraph 1 of article IX may accept this Agreement from 22nd November, 1950. Acceptance shall become effective on the deposit of a formal instrument with the Secretary-General of the United Nations.

Article XI

This Agreement shall come into force on the date on which the Secretary-General of the United Nations receives instruments of ratification or acceptance from ten States.

Article XII

  • 1 The States Parties to this Agreement on the date of its coming into force shall each take all the necessary measures for its fully effective operation within a period of six months after that date.

  • 2 For States which may deposit their instruments of ratification or acceptance after the date of the Agreement coming into force, these measures shall be taken within a period of three months from the date of deposit.

  • 3 Within one month of the expiration of the periods mentioned in paragraphs 1 and 2 of this article, the Contracting States to this Agreement shall submit a report to the United Nations Educational, Scientific and Cultural Organisation of the measures which they have taken for such fully effective operation.

  • 4 The United Nations Educational, Scientific and Cultural Organisation shall transmit this report to all signatory States to this Agreement and to the International Trade Organisation (provisionally, to its Interim Commission).

Article XIII

Any Contracting State may, at the time of signature or the deposit of its instrument of ratification or acceptance, or at any time thereafter, declare by notification adressed to the Secretary-General of the United Nations that this Agreement shall extend to all or any of the territories for the conduct of whose foreign relations that Contracting State is responsible.

Article XIV

  • 1 Two years after the date of the coming into force of this Agreement, any Contracting State may, on its own behalf or on behalf of any of the territories for the conduct of whose foreign relations that Contracting State is responsible, denounce this Agreement by an instrument in writing deposited with the Secretary-General of the United Nations.

  • 2 The denunciation shall take effect one year after the receipt of the instrument of denunciation.

Article XV

The Secretary-General of the United Nations shall inform the States referred to in paragraph 1 of article IX, as well as the United Nations Educational, Scientific and Cultural Organisation, and the International Trade Organisation (provisionally, its Interim Commission), of the deposit of all the instruments of ratification and acceptance provided for in articles IX and X, as well as of the notifications and denunciations provided for respectively in articles XIII and XIV.

Article XVI

At the request of one-third of the Contracting States to this Agreement, the Director-General of the United Nations Educational, Scientific and Cultural Organisation shall place on the agenda on the next session of the General Conference of that Organisation the question of convoking a meeting for the revision of this Agreement.

Article XVII

Annexes A, B, C, D and E, as well as the Protocol annexed to this Agreement, are hereby made an integral part of this Agreement.

Article XVIII

  • 2 In faith whereof the undersigned, duly authorised, have signed this Agreement on behalf of their respective Governments.

Done at Lake Success, New York, this twenty-second day of November, one thousand nine hundred and fifty, in a single copy, which shall remain deposited in the archives of the United Nations and certified true copies of which shall be delivered to all the States referred to in paragraph 1 of article IX, as well as to the United Nations Educational, Scientific and Cultural Organisation and to the International Trade Organisation (provisionally, to its Interim Commission).

ANNEX A. Books, Publications and Documents

  • (i) Printed books.

  • (ii) Newspapers and periodicals.

  • (iii) Books and documents produced by duplicating processes other than printing.

  • (iv) Official government publications, that is, official, parliamentary and administration documents published in their country of origin.

  • (v) Travel posters and travel literature (pamphlets, guides, timetables, leaflets and similar publications), whether illustrated or not, including those published by private commercial enterprises, whose purpose is to stimulate travel outside the country of importation.

  • (vi) Publications whose purpose is to stimulate study outside the country of importation.

  • (vii) Manuscripts, including typescripts.

  • (viii) Catalogues of books and publications, being books and publications offered for sale by publishers or booksellers established outside the country of importation.

  • (ix) Catalogues of films, recordings or other visual and auditory material of an educational, scientific or cultural character, being catalogues issued by or on behalf of the United Nations, or any of its specialised agencies.

  • (x) Music in manuscript or printed form, or reproduced by duplicating processes other than printing.

  • (xi) Geographical, hydrographical or astronomical maps and charts.

  • (xii) Architectural, industrial or engineering plans and designs, and reproductions thereof, intended for study in scientific establishments or educational institutions approved by the competent authorities of the importing country for the purpose of duty-free admission of these types of articles.

(The exemptions provided by annex A shall not apply to—

  • (a) Stationery;

  • (b) Books, publications and documents (except catalogues, travel posters and travel literature referred to above) published by or for a private commercial enterprise, essentially for advertising purposes;

  • (c) Newspapers and periodicals in which the advertising matter is in excess of 70 per cent. by space;

  • (d) All other items (except catalogues referred to above) in which the advertising matter is in excess of 25 per cent. by space. In the case of travel posters and literature, this percentage shall apply only to private commercial advertising matter.)

ANNEX B. Works of Art and Collectors’ Pieces of an Educational, Scientific or Cultural Character

  • (i) Paintings and drawings, including copies, executed entirely by hand, but excluding manufactured decorated wares.

  • (ii) Hand-printed impressions, produced from hand-engraved or hand-etched blocks, plates or other material, and signed and numbered by the artist.

  • (iii) Original works of art of statuary or sculpture, whether in the round, in relief, or in intaglio, excluding mass-produced reproductions and works of conventional craftsmanship of a commercial character.

  • (iv) Collectors' pieces and objects of art consigned to public galleries, museums and other public institutions, approved by the competent authorities of the importing country for the purpose of duty-free entry of these types of articles, not intended for resale.

  • (v) Collections and collectors' pieces in such scientific fields as anatomy, zoology, botany, mineralogy, palæontology, archæology and ethnography, not intended for resale.

  • (vi) Antiques, being articles in excess of 100 years of age.

ANNEX C. Visual and Auditory Materials of an Educational, Scientific or Cultural Character

  • (i) Films, filmstrips, microfilms and slides, of an educational, scientific or cultural character, when imported by organisations (including, at the discretion of the importing country, broadcasting organisations), approved by the competent authorities of the importing country for the purpose of duty-free admission of these types of articles, exclusively for exhibition by these organisations or by other public or private educational, scientific or cultural institutions or societies approved by the aforesaid authorities.

  • (ii) Newsreels (with or without sound track), depicting events of current news value at the time of importation, and imported in either negative form, exposed and developed, or positive form, printed and developed, when imported by organisations (including, at the discretion of the importing country, broadcasting organisations) approved by the competent authorities of the importing country for the purpose of duty-free admission of such films, provided that free entry may be limited to two copies of each subject for copying purposes.

  • (iii) Sound recordings of an educational, scientific or cultural character for use exclusively in public or private educational, scientific or cultural institutions or societies (including, at the discretion of the importing country, broadcasting organisations) approved by the competent authorities of the importing country for the purpose of duty-free admission of these types of articles.

  • (iv) Films, filmstrips, microfilms and sound recordings of an educational, scientific of cultural character produced by the United Nations or any of its specialised agencies.

  • (v) Patterns, models and wall charts for use exclusively for demonstrating and teaching purposes in public or private educational, scientific of cultural institutions approved by the competent authorities of the importing country for the purpose of duty-free admission of these types of articles.

ANNEX D. Scientific Instruments or Apparatus

Scientific instruments or apparatus, intended exclusively for educational purposes of pure scientific research, provided:

  • (a) That such scientific instruments or apparatus are consigned to public or private scientific or educational institutions approved by the competent authorities of the importing country for the purpose of duty-free entry of these types of articles, and used under the control and responsibility of these institutions;

  • (b) That instruments or apparatus of equivalent scientific value are not being manufactured in the country of importation.

ANNEX E. Articles for the Blind

  • (i) Books, publications and documents of all kinds in raised characters for the blind.

  • (ii) Other articles specially designed for the educational, scientific or cultural advancement of the blind, which are imported directly by institutions or organisations concerned with the welfare of the blind, approved by the competent authorities of the importing country for the purpose of duty-free entry of these types of articles.

Protocol annexed to the Agreement on the Importation of Educational, Scientific and Cultural Materials

The Contracting States,

In the interest of facilitating the participation of the United States of America in the Agreement on the Importation of Educational, Scientific and Cultural Materials, have agreed to the following:—

  • 1. The United States of America shall have the option of ratifying this Agreement, under article IX, or of accepting it, under article X, with the inclusion of the reservation hereunder.

  • 2. In the event of the United States of America becoming Party to this Agreement with the reservation provided for in the preceding paragraph 1, the provisions of that reservation may be invoked by the Government of the United States of America with regard to any of the Contracting States to this Agreement, or by any Contracting State with regard to the United States of America, provided that any measure imposed pursuant to such reservation shall be applied on a non-discriminatory basis.

  • (a) If, as a result of the obligations incurred by a Contracting State under this Agreement, any product covered by this Agreement is being imported into the territory of a Contracting State in such relatively increased quantities and under such conditions as to cause or threaten serious injury to the domestic industry in that territory producing like or directly competitive products, the Contracting State, under the conditions provided for by paragraph 2 above, shall be free, in respect of such product and to the extent and for such time as may be necessary to prevent or remedy such injury, to suspend, in whole or in part, any obligation under this Agreement with respect to such product.

  • (b) Before any Contracting State shall take action pursuant to the provisions of paragraph (a) above, it shall give notice in writing to the United Nations Educational, Scientific and Cultural Organisation as far in advance as may be practicable and shall afford the Organisation and the Contracting States which are Parties to this Agreement an opportunity to consult with it in respect of the proposed action.

  • (c) In critical circumstances where delay would cause damage which it would be difficult to repair, action under paragraph (a) above may be taken provisionally without prior consultation, on the condition that consultation be effected immediately after taking such action.

Preambule

De Overeenkomstsluitende Staten,

Overwegende dat de vrije uitwisseling van denkbeelden en kennis, en, in het algemeen, de verbreiding op zo ruim mogelijke schaal van de verschillende manieren waarop de beschavingen zich kenbaar maken, van het allergrootste belang zijn zowel voor de intellectuele vooruitgang als voor een goede internationale verstandhouding en mitsdien voor het handhaven van de wereldvrede;

Overwegende dat deze uitwisseling voornamelijk tot stand wordt gebracht door middel van boeken, publicaties en materiaal van opvoedkundige, wetenschappelijke en culturele aard;

Overwegende dat het Statuut van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur aandringt op de samenwerking tussen de naties op alle gebieden van intellectuele werkzaamheid met inbegrip van „de uitwisseling van publicaties, voorwerpen van belang uit artistiek en wetenschappelijk oogpunt en ander materiaal dat tot voorlichting kan dienen” en anderzijds bepaalt, dat de Organisatie zal „medewerken aan het bevorderen van de kennis en het begrip der volken onderling door alle middelen van volksvoorlichting en te dien einde iedere internationale overeenkomst aanbevelen, die dienstig kan zijn om de ongestoorde loop der denkbeelden door woord en beeld te vergemakkelijken”,

Erkennen, dat een internationale overeenkomst strekkend om de ongestoorde loop van boeken, publicaties en van materiaal van opvoedkundige, wetenschappelijke en culturele aard te vergemakkelijken, een doeltreffend middel zal zijn om deze doeleinden te verwezenlijken;

Hebben te dien einde overeenstemming bereikt t.a.v. de volgende bepalingen:

Artikel I

  • 1 De Overeenkomstsluitende Staten verplichten zich geen douanerechten en andere heffingen te doen gelden op of in verband met de invoer van:

    • (a) Boeken, publicaties en documenten, opgesomd in bijlage A van deze Overeenkomst;

    • (b) Voorwerpen van opvoedkundige, wetenschappelijke en culturele aard, opgesomd in de bijlagen B, C, D en E van deze Overeenkomst,

    welke vervaardigd zijn in een andere Overeenkomstsluitende Staat, behoudens de bepalingen neergelegd in die Bijlagen.

  • 2 Het bepaalde in het eerste lid van dit artikel zal geen enkele Overeenkomstsluitende Staat beletten op het ingevoerde materiaal te heffen:

    • (a) Binnenlandse belastingen of andere binnenlandse heffingen van welke aard ook, geheven bij of na de invoer, mits deze niet uitgaan boven hetgeen direct of indirect geheven wordt van soortgelijke binnenlandse voortbrengselen;

    • (b) Leges en heffingen, andere dan douane-rechten, geheven door overheids- of administratieve instanties bij of in verband met de invoer, mits zij beperkt zijn tot de geschatte kosten van de bewezen diensten en geen verkapte bescherming van binnenlandse voortbrengselen inhouden of fiscale invoerrechten zijn.

Artikel II

  • 1 De Overeenkomstsluitende Staten verbinden zich de noodzakelijke vergunningen en/of deviezen af te geven voor de invoer van de volgende voorwerpen:

    • (a) Boeken en publicaties bestemd voor openbare bibliotheken en verzamelingen, en voor bibliotheken en verzamelingen van openbare instellingen op het gebied van opvoeding, wetenschappelijk onderzoek of cultuur;

    • (b) Officiële overheidspublicaties, d.w.z. officiële parlementaire en administratieve documenten, gepubliceerd in het land van herkomst;

    • (c) Boeken en publicaties van de Verenigde Naties en van haar gespecialiseerde organisaties;

    • (d) Boeken en publicaties, ontvangen van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur en gratis door haar of onder haar toezicht verspreid;

    • (e) Publicaties ter aanmoediging van het vreemdelingenverkeer buiten het land van invoer, gratis verzonden en verspreid;

    • (f) Voorwerpen voor blinden:

      • (i) Alle soorten boeken, publicaties en documenten in brailleschrift;

      • (ii) Andere voorwerpen, speciaal vervaardigd voor de opvoedkundige, wetenschappelijke en culturele ontwikkeling van blinden, rechtstreeks ingevoerd door blinden-inrichtingen of door verenigingen tot hulp aan blinden, die toestemming hebben van de bevoegde autoriteiten in het land van invoer om deze goederen vrij van rechten in te voeren.

  • 2 De Overeenkomstsluitende Staten, welke te eniger tijd kwantitatieve beperkingen en deviezencontrôle-maatregelen toepassen, verbinden zich, zoveel mogelijk, de noodzakelijke deviezen en invoervergunningen te verstrekken voor ander materiaal van opvoedkundige, wetenschappelijke of culturele aard, en met name voor het materiaal, als bedoeld in de bijlagen van deze Overeenkomst.

Artikel III

  • 1 De Overeenkomstsluitende Staten verbinden zich alle mogelijke faciliteiten te verlenen bij de invoer van materiaal van opvoedkundige, wetenschappelijke of culturele aard, dat uitsluitend wordt ingevoerd om te worden ten toon gesteld op een voor het publiek toegankelijke tentoonstelling, waarvoor de bevoegde autoriteiten in het land van invoer toestemming hebben verleend, en dat bestemd is om daarna weer te worden uitgevoerd. Deze faciliteiten zullen mede omvatten toekenning van de noodzakelijke vergunningen en de vrijstelling van douanerechten en alle soorten binnenlandse belastingen en heffingen te betalen bij de invoer, met uitzondering van leges en heffingen, welke zouden overeenkomen met de geschatte kosten van de bewezen diensten.

  • 2 Geen bepaling in dit artikel zal de autoriteiten van het land van invoer beletten de noodzakelijke maatregelen te nemen ten einde te verzekeren, dat het bedoelde materiaal wederom zal worden uitgevoerd na sluiting der tentoonstelling.

Artikel IV

De Overeenkomstsluitende Staten verplichten zich zoveel mogelijk

  • (a) Hun gezamenlijke pogingen voort te zetten om met alle ten dienste staande middelen het vrije verkeer van materiaal van opvoedkundige, wetenschappelijke of culturele aard te bevorderen en alle beperkingen van dat vrije verkeer waarin deze Overeenkomst niet voorziet af te schaffen dan wel te verminderen;

  • (b) De administratieve formaliteiten, verbonden aan de invoer van materiaal van opvoedkundige, wetenschappelijke of culturele aard, te vereenvoudigen;

  • (c) Een vlugge en met alle gewenste voorzorgsmaatregelen gepaard gaande inklaring van materiaal van opvoedkundige, wetenschappelijke en culturele aard te bevorderen.

Artikel V

Geen bepaling der onderhavige Overeenkomst maakt inbreuk op het recht der Overeenkomstsluitende Staten om in overeenstemming met hun nationale wetgeving maatregelen te treffen met het doel de invoer, of het verkeer na invoer, te verbieden of te beperken van bepaalde voorwerpen, wanneer deze maatregelen hun grond vinden in beweegredenen welke onmiddellijk verband houden met de nationale veiligheid, de openbare orde of goede zeden van de Overeenkomstsluitende Staat.

Artikel VI

Deze Overeenkomst brengt geen wijziging in, en maakt geen inbreuk op de wetten en verordeningen van een Overeenkomstsluitende Staat, of een van zijn internationale verdragen, overeenkomsten of proclamaties inzake de bescherming van het auteursrecht, handelsmerken of octrooien.

Artikel VII

De Overeenkomstsluitende Staten verbinden zich hun toevlucht te nemen tot onderhandelingen of verzoening ter oplossing van enig geschil ter zake van de interpretatie of de toepassing van deze Overeenkomst, onverminderd de bepalingen van vroegere verdragen, waaraan zij onderworpen zouden kunnen zijn met betrekking tot de oplossing van geschillen welke tussen hen zouden kunnen rijzen.

Artikel VIII

Bij een geschil tussen Overeenkomstsluitende Staten over de opvoedkundige, wetenschappelijke of culturele aard van ingevoerd materiaal, kunnen de belanghebbende partijen in gemeen overleg het geschil voorleggen aan de Directeur-Generaal van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur voor advies.

Artikel IX

  • 1 Deze Overeenkomst, waarvan de Engelse en de Franse tekst gelijkelijk authentiek zijn, zal de dagtekening van heden dragen en zal openstaan ter ondertekening door alle Staten, welke Lid zijn van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur, alle Staten welke Lid zijn van de Verenigde Naties en alle Staten, welke geen Lid zijn en tot welke een daartoe strekkende uitnodiging is gericht door de Uitvoerende Raad van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur.

  • 2 Deze Overeenkomst zal worden bekrachtigd door de Staten, welke de Overeenkomst ondertekenen, in overeenstemming met hun onderscheidene grondwettelijke voorschriften.

  • 3 De akten van bekrachtiging zullen worden nedergelegd bij de Secretaris-Generaal der Verenigde Naties.

Artikel X

De in lid 1 van Artikel IX bedoelde Staten kunnen deze Overeenkomst aanvaarden met ingang van 22 November 1950. De aanvaarding wordt van kracht na het nederleggen van een officiële akte bij de Secretaris-Generaal der Verenigde Naties.

Artikel XI

Deze Overeenkomst treedt in werking op de dag waarop de Secretaris-Generaal van de Verenigde Naties akten van bekrachtiging of aanvaarding heeft ontvangen van tien Staten.

Artikel XII

  • 1 De Staten, welke partij zijn bij deze Overeenkomst op de dag van haar inwerkingtreding, zullen elk alle nodige maatregelen nemen voor haar doeltreffende werking binnen een periode van zes maanden na die datum.

  • 2 Voor Staten, welke hun akten van bekrachtiging of aanvaarding nederleggen na de datum van inwerkingtreding dezer Overeenkomst, zullen deze maatregelen genomen worden binnen een termijn van drie maanden na de datum van nederlegging.

  • 3 Binnen een maand na het verstrijken van de termijnen, bedoeld in het eerste en tweede lid van dit Artikel, zullen de Overeenkomstsluitende Staten een rapport zenden aan de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur over de maatregelen, welke zij hebben genomen voor een doeltreffende werking van de Overeenkomst.

  • 4 De Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur zal dit rapport doen toekomen aan alle Staten, die deze Overeenkomst hebben ondertekend en aan de Internationale Handelsorganisatie (voorlopig aan haar Interim-Commissie).

Artikel XIII

Elke Overeenkomstsluitende Staat kan, ten tijde van de ondertekening, of van de nederlegging van zijn akte van bekrachtiging of aanvaarding, of te eniger tijd nadien, door een kennisgeving aan de Secretaris-Generaal der Verenigde Naties verklaren, dat deze Overeenkoms mede van toepassing zal zijn op alle of enige van de gebieden voor welker buitenlandse betrekkingen bij verantwoordelijk is.

Artikel XIV

  • 1 Twee jaren na de datum waarop deze Overeenkomst in werking treedt, kan elke Overeenkomstsluitende Staat, namens zichzelf of namens een van de gebieden voor welker buitenlandse betrekkingen hij verantwoordelijk is, deze Overeenkomst opzeggen, door een schriftelijke akte, nedergelegd bij de Secretaris-Generaal der Verenigde Naties.

  • 2 De opzegging wordt van kracht een jaar na ontvangen van de akte van opzegging.

Artikel XV

De Secretaris-Generaal der Verenigde Naties zal de Staten, bedoeld in het eerste lid van artikel IX alsmede de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur en de Internationale Handelsorganisatie (voorlopig haar Interim-Commissie) verwittigen van de nederlegging van alle akten van bekrachtiging en aanvaarding vermeld in de artikelen IX en X, alsmede van de kennisgevingen en opzeggingen, vermeld in de artikelen XIII en XIV.

Artikel XVI

Op verzoek van een derde der Overeenkomstsluitende Staten zal de Directeur-Generaal van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur op de agenda voor de eerstvolgende zitting van de algemene conferentie dezer Organisatie het Verzoek plaatsen tot bijeenroepen van een vergadering voor de herziening dezer Overeenkomst.

Artikel XVII

De bijlagen A, B, C, D en E alsmede het aan deze Overeenkomst gehecht Protocol vormen een integrerend onderdeel dezer Overeenkomst.

Artikel XVIII

  • 2 Ten blijke waarvan de ondergetekenden, behoorlijk gevolmachtigd, deze Overeenkomst hebben ondertekend uit naam van hun onderscheidene Regeringen.

Gedaan te Lake Success, New York, de twee en twintigste November negentienhonderd en vijftig, in een enkel exemplaar dat zal worden nedergelegd in het archief der Verenigde Naties, en waarvan gewaarmerkte afschriften zullen worden gezonden aan alle Staten, bedoeld in artikel XI, lid 1, alsmede aan de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur en aan de Internationale Handelsorganisatie (voorlopig aan haar Interim-Commissie).

BIJLAGE A. Boeken, publicaties en documenten

  • (i) Gedrukte boeken.

  • (ii) Kranten en tijdschriften.

  • (iii) Boeken en documenten, welke anders dan door middel van de drukpers zijn vermenigvuldigd.

  • (iv) Officiële overheidspublicaties, d.w.z. officiële, parlementaire en administratieve documenten, gepubliceerd in het land van herkomst.

  • (v) Aanplakbiljetten en andere drukwerken op het gebied van het vreemdelingenverkeer (zoals brochures, reisgidsen, dienstregelingen, vouwbladen e.d.), al of niet geïllustreerd, waaronder begrepen uitgaven van particuliere ondernemingen, welke zich ten doel stellen het reizen te stimuleren buiten het land van invoer.

  • (vi) Publicaties, welke tot doel hebben om het studeren buiten het land van invoer te stimuleren.

  • (vii) Publicaties en documenten in machineschrift.

  • (viii) Catalogi van boeken en publicaties, in de handel gebracht door uitgevers of door boekhandelaars, gevestigd buiten het land van invoer.

  • (ix) Catalogi van films, van geluidsopnamen of van alle andere soorten visueel en auditief materiaal van opvoedkundige, wetenschappelijke of culturele aard, welke catalogi zijn uitgegeven door of namens de Verenigde Naties of van een van haar gespecialiseerde organisaties.

  • (x) Met de hand geschreven muziek, gedrukte muziek of muziek, anders dan door middel van de drukpers vermenigvuldigd.

  • (xi) Aardrijkskundige, nautische en sterrekaarten.

  • (xii) Bouwkundige, industriële of machinebouwkundige tekeningen en ontwerpen, reproducties daarvan, bestemd om bestudeerd te worden in wetenschappelijke inrichtingen of onderwijsinstellingen, welke toestemming hebben van de bevoegde autoriteiten in het land van invoer om deze soorten artikelen vrij van invoerrechten in te voeren.

(De vrijdommen neergelegd in deze bijlage A zullen niet van toepassing zijn op de volgende artikelen:

  • (a) schrijfbehoeften;

  • (b) boeken, publicaties en documenten (met uitzondering van catalogi alsmede aanplakbiljetten en publicaties op het gebied van vreemdelingenverkeer, hierboven bedoeld) bepaaldelijk uitgegeven door of voor een particuliere reclame-onderneming, hoofdzakelijk voor reclame-doeleinden;

  • (c) kranten en tijdschriften waarin de ruimte voor meer dan 70 % door advertenties in beslag wordt genomen;

  • (d) al het andere materiaal (behalve de bovenbedoelde catalogi) waarin meer dan 25 % van de ruimte door advertenties in beslag wordt genomen. In geval van publicaties en afspraken op toeristisch gebied heeft dit percentage slechts betrekking op particuliere commerciële advertenties.)

BIJLAGE B. Kunstwerken en voorwerpen welke deel uitmaken van verzamelingen van opvoedkundige, wetenschappelijke of culturele aard

  • (i) Schilderijen en tekeningen, met inbegrip van copieën, geheel met de hand vervaardigd doch met uitzondering van versierde, handgefabriceerde voorwerpen.

  • (ii) Met de hand vervaardigde afdrukken (steendrukken, gravures en prenten) door de kunstenaar gesigneerd en genummerd en vervaardigd door middel van met de hand gegraveerde of met de hand geëtste blokken, platen of ander materiaal.

  • (iii) Oorspronkelijke beeldhouwwerken, in vol reliëf, in reliëf of in diepdruk, uitgezonderd in massa vervaardigde reproducties en werkstukken van handwerkers voor handelsdoeleinden vervaardigd.

  • (iv) Voorwerpen welke deel uitmaken van verzamelingen en kunstvoorwerpen, bestemd voor musea en andere voor het publiek toegankelijke instellingen, die toestemming hebben van de bevoegde autoriteiten in het land van invoer om deze voorwerpen vrij van rechten in te voeren, onder voorwaarde, dat deze voorwerpen niet voor de wederverkoop bestemd zijn.

  • (v) Verzamelingen en voorwerpen welke deel uitmaken van verzamelingen op wetenschappelijk gebied met name op het gebied van anatomie, zoölogie, botanie, mineralogie, paleontologie, archeologie, en ethnografie, niet bestemd voor de wederverkoop.

  • (vi) Antiquiteiten, d.w.z. artikelen ouder dan 100 jaar.

BIJLAGE C. Visueel en auditief materiaal van opvoedkundige, wetenschappelijke en culturele aard

  • (i) Films, filmstroken, microfilms en lantaarnplaatjes van opvoedkundige, wetenschappelijke of culturele aard, ingevoerd door organisaties (omroeporganisaties daaronder begrepen, ter beoordeling van het land van invoer), welke toestemming hebben van de bevoegde autoriteiten in het land van invoer om deze voorwerpen vrij van rechten in te voeren, en uitsluitend bestemd om te worden tentoongesteld door deze organisaties of door andere openbare of particuliere instellingen of verenigingen op het gebied van opvoeding, wetenschap of cultuur, goedgekeurd door de bovengenoemde bevoegde autoriteiten.

  • (ii) Filmjournaals (al of niet met geluidsstroken), welke actuele gebeurtenissen vertonen op het moment van invoer, en voor wedervertoning ingevoerd als negatieven, belicht en ontwikkeld, of als positieven, afgedrukt en ontwikkeld, waarbij de vrijstelling kan worden beperkt tot twee copieën per onderwerp. Filmjournaals genieten slechts dan van deze regeling, wanneer ze worden ingevoerd door organisaties (omroeporganisaties daaronder begrepen, ter beoordeling van het land van invoer), welke van de bevoegde autoriteiten van het land van invoer toestemming hebben om deze journaals vrij van rechten in te voeren.

  • (iii) Geluidsopnamen van opvoedkundige, wetenschappelijke of culturele aard en uitsluitend bestemd voor openbare of particuliere, opvoedkundige, wetenschappelijke of culturele instellingen of verenigingen (omroeporganisaties daaronder begrepen, ter beoordeling van het land van invoer), die toestemming hebben van de bevoegde autoriteiten van het land van invoer om het materiaal vrij van rechten in te voeren.

  • (iv) Films, filmstroken, microfilms en geluidsopnamen van opvoedkundige, wetenschappelijke of culturele aard, vervaardigd door de Verenigde Naties of een van haar gespecialiseerde organisaties.

  • (v) Modellen, maquettes en wandkaarten uitsluitend bestemd voor demonstratie en onderwijsdoeleinden in opvoedkundige, wetenschappelijke of culturele instellingen, die van de bevoegde autoriteiten van het land van invoer toestemming hebben om dit materiaal vrij van rechten in te voeren.

BIJLAGE D. Wetenschappelijke instrumenten en apparaten

Wetenschappelijke instrumenten en apparaten, uitsluitend bestemd voor opvoedkundige doeleinden of zuiver wetenschappelijk onderzoek, onder voorwaarde:

  • (a) Dat de bedoelde wetenschappelijke instrumenten en apparaten bestemd zijn voor openbare of particuliere wetenschappelijke of opvoedkundige instellingen, die toestemming hebben van de bevoegde autoriteiten van het land van invoer om deze voorwerpen vrij van rechten in te voeren, en dat zij gebruikt worden onder contrôle en verantwoordelijkheid van deze instellingen;

  • (b) Dat instrumenten en apparaten van overeenkomstige wetenschappelijke waarde niet worden vervaardigd in het land van invoer.

BIJLAGE E. Voorwerpen bestemd voor blinden

  • (i) Alle soorten boeken, publicaties en documenten in brailleschrift.

  • (ii) Andere voorwerpen, speciaal vervaardigd voor de opvoedkundige, wetenschappelijke of culturele ontwikkeling van blinden, rechtstreeks ingevoerd door blindeninrichtingen of door verenigingen tot hulp aan blinden, die toestemming hebben van de bevoegde autoriteiten van het land van invoer om deze goederen vrij van rechten in te voeren.

Protocol gevoegd bij de Overeenkomst inzake de Invoer van Voorwerpen van Opvoedkundige, Wetenschappelijke en Culturele Aard

De Overeenkomstsluitende Staten,

In het belang van een vergemakkelijking van de deelneming der Verenigde Staten van Amerika aan de Overeenkomst inzake de Invoer van Voorwerpen van Opvoedkundige, Wetenschappelijke en Culturele Aard, zijn overeengekomen als volgt:

  • 1. De Verenigde Staten van Amerika hebben de keuze tussen de bekrachtiging van deze Overeenkomst krachtens artikel IX, en de aanvaarding van deze Overeenkomst krachtens artikel X, onder het hieronder vermelde voorbehoud.

  • 2. Indien de Verenigde Staten van Amerika Partij worden bij deze Overeenkomst onder het voorbehoud bedoeld in het voorgaande lid 1, kan de Regering der Verenigde Staten van Amerika ten aanzien van elk der Overeenkomstsluitende Staten een beroep doen op de bepalingen van dat voorbehoud, evenals elk der Overeenkomstsluitende Staten een beroep kan doen op de bepalingen van dat voorbehoud ten aanzien van de Verenigde Staten, mits elke maatregel welke wordt genomen krachtens dat voorbehoud zal worden toegepast zonder het maken van onderscheid.

(Tekst van het voorbehoud:)

  • (a) Indien tengevolge van de verplichtingen welke een Overeenkomstsluitende Staat krachtens deze Overeenkomst op zich heeft genomen, een product dat onder de bepalingen van deze Overeenkomst valt, in naar verhouding zodanig toegenomen hoeveelheden en onder zodanige omstandigheden in het gebied van een overeenkomstsluitende Staat wordt ingevoerd, dat de binnenlandse industrie van dat gebied welke dezelfde of concurrerende producten produceert, ernstige schade ondervindt of bedreigd wordt met ernstige schade, zal het de Overeenkomstsluitende Staat, krachtens de bepalingen van het bovenstaande lid 2, vrij staan om, met betrekking tot dat product en in de mate en gedurende de tijd als nodig zal zijn om een zodanige schade te voorkomen of te herstellen, elke verplichting krachtens deze Overeenkomst met betrekking tot een zodanig product geheel of gedeeltelijk op te schorten.

  • (b) Alvorens een Overeenkomstsluitende Staat maatregelen neemt krachtens de bepalingen van bovenstaand lid (a) zal hij daarvan schriftelijk mededeling doen aan de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur en wel zo tijdig als practisch uitvoerbaar is. De betreffende Staat zal de Organisatie en de Overeenkomstsluitende Staten welke partij zijn bij deze Overeenkomst gelegenheid geven met hem van gedachten te wisselen over de voorgestelde maatregel.

  • (c) In critieke omstandigheden waar vertraging moeilijk te herstellen schade tot gevolg zou hebben, kunnen de maatregelen krachtens bovenstaand lid (a) voorlopig genomen worden zonder voorafgaande bespreking, onder voorwaarde dat een bespreking plaats zal vinden onmiddellijk nadat zodanige maatregelen zijn genomen.
