Agreement between the Kingdom of the Netherlands and the Republic of the Philippines on mutual administrative assistance in customs matters

The Kingdom of the Netherlands

and

the Republic of the Philippines,

hereafter referred to as the Contracting Parties;

Considering the importance of accurate assessment of customs duties and other taxes collected at importation or exportation and of ensuring proper enforcement of measures of prohibition, restriction and control;

Considering that offences against customs law are prejudicial to their economic, fiscal, social, cultural, public health and commercial interests;

Considering that cross-frontier trafficking in narcotic drugs and psychotropic substances, hazardous goods, endangered species and toxic waste constitutes a danger to society;

Considering that illegal cross-border trafficking in weapons, explosives, chemical, biological and nuclear substances constitutes a danger to society;

Considering that both the business community as customs administrations will benefit from the development of facilitation and security in the international trade supply chain;

Recognizing the need for international co-operation in matters related to the application and enforcement of their customs laws;

Convinced that action against customs offences can be made more effective by close co-operation between their customs administrations based on clear legal provisions;

Having regard to the Recommendation on Mutual Administrative Assistance and the Declaration on the Improvement of Customs Co-operation and Mutual Administrative Assistance (the Cyprus Declaration), adopted in December 1953 and June 2000 respectively by the Customs Co-operation Council, now known as the World Customs Organization;

Having Regard also to international conventions containing prohibitions, restrictions and special measures of control in respect of specific goods;

Have agreed as follows:

CHAPTER I. DEFINITIONS

Article 1

For the purposes of this Agreement:

  • a) the term “customs administration” shall mean:

    • for the Kingdom of the Netherlands: the central administration responsible for the implementation of customs law in each part of the Kingdom of the Netherlands mentioned in the second paragraph of Article 21;

    • for the Republic of the Philippines: the Bureau of Customs;

  • b) the term “customs law” shall mean: any legal and administrative provisions applicable or enforceable by the customs administrations in connection with the importation, exportation, transshipment, transit, storage and circulation of goods, including legal and administrative provisions relating to measures of prohibition, restriction and control;

  • c) the term “customs offence” shall mean: any breach or attempted breach of customs law as defined by the legislation of each Contracting Party;

  • d) the term “customs claim” shall mean: any amount of Customs duties that cannot be collected in one of the Contracting Parties;

  • e) the term “customs duties” shall mean all duties, taxes, fees or any other charges which are levied in the territories of the Contracting Parties in application of Customs law, but not including fees and charges for services rendered;

  • f) the term “person” shall mean: both natural and legal persons, unless otherwise required;

  • g) the term “personal data” shall mean: any data concerning an identified or identifiable natural person;

  • h) the term “information” shall mean: any data, documents, reports, certified or authenticated copies thereof or other communications in any format, including electronic;

  • i) the term “international trade supply chain” shall mean all processes involved in the cross-border movement of goods from the place of origin to the place of final destination;

  • j) the term “official” shall mean: any Customs officer or other government agent designated to apply Customs law;

  • k) the term “requesting administration” shall mean: the customs administration which requests assistance;

  • l) the term “requested administration” shall mean: the customs administration from which assistance is requested.

CHAPTER II. SCOPE OF THE AGREEMENT

Article 2

  • 1 The Contracting Parties shall through their customs administrations afford each other administrative assistance under the terms set out in this Agreement, for the proper application of customs law and for the prevention, investigation and combating of customs offences, as well as for the recovery of customs claims.

  • 2 All assistance under this Agreement by either Contracting Party shall be performed in accordance with its legal and administrative provisions and within the limits of its customs administration’s competence and available resources.

  • 3 This Agreement is without prejudice to the present and future obligations of the Contracting Parties resulting from other international agreements.

  • 4 This Agreement is intended solely for the mutual administrative assistance between the Contracting Parties; the provisions of this Agreement shall not give rise to a right on the part of any private person to obtain, suppress or exclude any evidence or to impede the execution of a request.

  • 5 This Agreement is without prejudice to rules governing mutual assistance in criminal matters. If mutual assistance should be afforded in accordance with another agreement in force between the Contracting Parties, the requested administration shall indicate which relevant authorities are concerned.

CHAPTER III. SCOPE OF ASSISTANCE

Article 3

  • 1 The customs administrations shall provide each other, either on request or on their own initiative, with information which helps to ensure the proper application of customs law and the prevention, investigation and combating of customs offences and the security of the international supply chain as well as the recovery of customs claims.

  • 2 Either customs administration shall, in making inquiries on behalf of the other customs administration, act as if the inquiries were being made on its own account or at the request of another authority of its own state.

Article 4

  • 1 On request, the requested administration shall provide all information about customs law and procedures applicable in that Contracting Party and relevant to inquiries relating to a customs offence.

  • 2 Either customs administration shall communicate, on its own initiative and without delay, any available information relating to:

    • a) new customs law enforcement techniques having proved their effectiveness;

    • b) new trends, means or methods of committing customs offences;

    • c) other data that can assist Customs administrations with risk assessment for control and facilitation purposes.

Article 5

The customs administrations may provide each other technical assistance in customs matters including:

  • a) exchange of customs officers when mutually beneficial for the purpose of advancing the understanding of each other’s techniques;

  • b) training and assistance in developing specialized skills of customs officers;

  • c) exchange of information and experience relating to the usage of interdiction and detection equipment;

  • d) exchange of experts knowledgeable about customs matters;

  • e) exchange of professional, scientific and technical data relating to customs law and procedures.

CHAPTER IV. SPECIAL INSTANCES OF ASSISTANCE

Article 6

On request, the requested administration shall in particular provide the requesting administration with the following information:

  • a) whether goods which are imported into the customs territory of the requesting Contracting Party have been lawfully exported from the customs territory of the requested Contracting Party;

  • b) whether goods which are exported from the customs territory of the requesting Contracting Party have been lawfully imported into the customs territory of the requested Contracting Party and about the customs procedure, if any, under which the goods have been placed.

Article 7

  • 1 On request, the requested administration shall maintain special surveillance over:

    • a) persons known to the requesting administration to have committed a customs offence or suspected of doing so, particularly those moving into and out of the customs territory of the requested Contracting Party;

    • b) goods either in transport or in storage notified by the requesting administration as giving rise to suspected illicit traffic towards the customs territory of the requesting Contracting Party;

    • c) means of transport suspected by the requesting administration of being used to commit customs offences in the customs territory of the requesting Contracting Party;

    • d) premises in the territory of the requested Contracting Party known to have been used or suspected of being used in connection with the commission of a Customs offence in the territory of the requesting Contracting Party.

  • 2 The customs administrations may permit, according to their national legislation, by mutual agreement and arrangement, under their supervision, the controlled importation into, exportation from or transit via the customs territory of their respective states of goods involved in illicit traffic in order to suppress such illicit traffic.

Article 8

  • 1 The customs administrations shall provide each other, either on request or on their own initiative, with information on transactions, completed or planned, which constitute or appear to constitute a customs offence.

  • 2 In serious cases that could involve substantial damage to the economy, public health, public security or any other vital interest of one Contracting Party, the customs administration of the other Contracting Party shall, wherever possible, supply such information without delay on its own initiative.

Article 9

The customs administrations may, by mutual arrangement exchange any information covered by this Agreement on an automatic basis. Such exchange will be arranged in accordance with paragraph 2 of Article 20 of this Agreement.

Article 10

  • 1 The customs administrations shall afford each other assistance with a view to the recovery of customs claims in accordance with their respective national legal and administrative provisions for the recovery of their own duty and tax claims.

  • 2 The customs administrations shall, subject to the consent which may be required from other national government agencies, by common agreement prescribe rules concerning the application of this Article in accordance with paragraph 2 of Article 20 of this Agreement.

CHAPTER V. INFORMATION

Article 11

  • 1 Original information shall only be requested in cases where certified or authenticated copies or computer-based information would be insufficient, and shall be returned as soon as possible; rights of the requested administration or of third parties relating thereto shall remain unaffected.

  • 2 Any information to be exchanged under this Agreement shall be accompanied by all relevant information for interpreting or utilizing it.

CHAPTER VI. EXPERTS AND WITNESSES

Article 12

On request, the requested administration may authorize its officials to appear before a court or tribunal or before an administrative or quasi-judicial body in the territory of the requesting Contracting Party as experts or witnesses in a matter related to the application of customs law.

CHAPTER VII. COMMUNICATION OF REQUESTS

Article 13

  • 1 Requests for assistance under this Agreement shall be addressed directly to the customs administration of the other Contracting Party, shall be made in writing and shall be accompanied by any documents deemed useful. In urgent circumstances, requests may also be made verbally. Such requests shall be promptly confirmed in writing.

  • 2 Requests made pursuant to paragraph 1 of this Article, shall include the following details:

    • a) the administration making the request;

    • b) the subject of and reason for the request;

    • c) a brief description of the matter, the legal elements and the nature of the proceeding;

    • d) the names and addresses of the parties concerned with the proceeding, if known.

  • 3 A request by either customs administration that a certain procedure be followed shall be complied with, subject to the legal and administrative provisions of the requested Contracting Party.

  • 4 The information referred to in this Agreement shall be communicated only to officials who are designated for this purpose by each customs administration. A list of officials so designated shall be furnished to the customs administration of the other Contracting Party in accordance with paragraph 2 of Article 20 of this Agreement.

CHAPTER VIII. EXECUTION OF REQUESTS

Article 14

If the requested administration does not have the information requested, it shall initiate inquiries to obtain that information in accordance with its national legal and administrative provisions.

Article 15

  • 1 On written request, officials designated by the requesting administration may, with the authorization of the requested administration and subject to conditions the latter may impose, for the purpose of investigating a customs offence:

    • a) examine in the offices of the requested administration the documents, registers and other relevant data to extract any information in respect of that customs offence;

    • b) take copies of the documents, registers and other data relevant in respect of that customs offence;

    • c) be present in an advisory role during an inquiry conducted by the requested administration in the customs territory of the requested Contracting Party and relevant to the requesting administration.

  • 2 When officials of either customs administration are present in the territory of the other Contracting Party under the terms of this Agreement, they must at all times be able to furnish proof of their official capacity.

  • 3 They shall, while there, enjoy the same protection as that accorded to customs officials of the other Contracting Party, in accordance with the laws in force there, and be responsible for any offence they might commit.

CHAPTER IX. CONFIDENTIALITY OF INFORMATION

Article 16

  • 1 Any information received under this Agreement shall be used solely for the purposes of this Agreement and by the customs administrations, except in cases in which the customs administration which furnished such information expressly approves its use for other purposes or by other authorities. Such use shall then be subject to any restrictions laid down by the customs administration which furnished the information. Any such information may, if the national law of the furnishing Contracting Party so prescribes, only be used in criminal prosecutions after the public prosecution of judicial authorities in the furnishing Contracting Party have agreed to such use.

  • 2 Any information received under this Agreement shall at least be subject to the same protection and confidentiality as the same kind of information is subject to under the national law having regard to the citizens of the Contracting Party where it is received irrespective of the nationality, citizenship or residence of the persons concerned.

Article 17

  • 1 Personal data exchanged under this Agreement shall be subject to a level of protection equivalent to the level of protection maintained by the Contracting Party providing the data.

  • 2 Contracting Parties shall provide each other with all legislation relevant to this Article, concerning personal data protection of their respective States.

  • 3 Personal data exchange shall not begin until the Contracting Parties have agreed in accordance with paragraph 2 of Article 20 of this Agreement that the level of protection is equivalent in either Contracting Party.

CHAPTER X. EXEMPTIONS

Article 18

  • 1 The requested administration shall not be required to give the assistance provided for by this Agreement if it is likely to jeopardize public order or any other essential interest of the requested Contracting Party or would involve the violation of an industrial, commercial or professional secret.

  • 2 If the requesting administration would be unable to comply if a similar request were made by the requested administration, it shall draw attention to that fact in its request. Compliance with such a request shall be at the discretion of the requested administration.

  • 3 Assistance may be postponed by the requested administration on the ground that it will interfere with an ongoing investigation, prosecution or proceeding. In such a case the requested administration shall consult with the requesting administration to determine if assistance can be given subject to such terms or conditions as the requested administration may require.

  • 4 Where assistance is denied or postponed, reasons for the denial or postponement shall be given.

CHAPTER XI. COSTS

Article 19

  • 1 The customs administrations shall waive all claims for reimbursement of costs incurred in the execution of this Agreement, except for expenses and allowances paid to experts and to witnesses as well as costs of interpreters other than Government employees, which shall be borne by the requesting administration.

  • 2 Pecuniary consequences of acts of recovery which have been found unjustified in respect of the reality of the customs claim concerned or of the validity of the instrument permitting enforcement in the requesting Contracting Party, shall be borne by the requesting administration.

  • 3 If expenses of a substantial and extraordinary nature are or will be required to execute the request, the Contracting Parties shall consult to determine the terms and conditions under which the request is or will be made as well as the manner in which the costs shall be borne.

CHAPTER XII. IMPLEMENTATION OF THE AGREEMENT

Article 20

  • 1 The customs administrations shall take measures so that their officials responsible for the investigation or combating of customs offences maintain personal and direct relations with each other.

  • 2 The customs administrations shall decide on further detailed arrangements, within the framework of this Agreement, to facilitate the implementation of this Agreement.

  • 3 The customs administrations shall endeavor to resolve by mutual accord any problem or doubt arising from the interpretation or application of this Agreement.

  • 4 Conflicts, for which no solutions are found, shall be settled through diplomatic channels.

CHAPTER XIII. TERRITORIAL APPLICATION

Article 21

  • 1 This Agreement will be applicable in the territories of both States in accordance with international law.

  • 2 As far as the Kingdom of the Netherlands is concerned, this Agreement shall be applicable in the European part of the Netherlands, in Aruba, Curaçao and Sint Maarten, and in the Caribbean part of the Netherlands (Bonaire, Saba and Sint Eustatius).

CHAPTER XIV. ENTRY INTO FORCE AND TERMINATION

Article 22

This Agreement shall enter into force on the first day of the second month after the Contracting Parties have notified each other in writing through diplomatic channels that the constitutional or internal requirements for the entry into force of this Agreement have been complied with.

Article 23

  • 1 This Agreement is intended to be of unlimited duration but either Contracting Party may terminate it at any time by notification through diplomatic channels.

  • 2 The Contracting Parties may terminate the application of this Agreement in respect of each separate part of the Kingdom of the Netherlands.

  • 3 The termination shall take effect three months from the date of the notification of denunciation to the other Contracting Party. Ongoing proceedings at the time of termination shall nonetheless be completed in accordance with the provisions of this Agreement.

Article 24

The Contracting Parties shall meet in order to review this Agreement on request or at the end of five years from the date of its entry into force, unless they notify one another in writing that no such review is necessary.

IN WITNESS WHEREOF the undersigned, being duly authorized thereto, have signed this Agreement.

en

de Republiek der Filipijnen,

hierna te noemen de verdragsluitende partijen;

Gelet op het belang van een juiste vaststelling van de douanerechten en andere belastingen die bij invoer of uitvoer worden geïnd en van het waarborgen van een juiste handhaving van verbods-, beperkings- en controlemaatregelen;

Overwegend dat inbreuken op de douanewetgeving hun economische, fiscale, sociale en culturele belangen en de belangen op het gebied van de volksgezondheid en handel schaden;

Overwegend dat de grensoverschrijdende handel in verdovende middelen en psychotrope stoffen, gevaarlijke stoffen, bedreigde dier- en plantensoorten en giftig afval een gevaar voor de samenleving vormt;

Overwegend dat de illegale grensoverschrijdende handel in wapens, explosieven, chemische, biologische en nucleaire stoffen een gevaar voor de samenleving vormt;

Overwegend dat zowel het bedrijfsleven als de douaneadministraties zullen profiteren van de bevordering van de facilitatie en veiligheid van de internationale logistieke keten;

Erkennend de noodzaak van internationale samenwerking ter zake van aangelegenheden die verband houden met de toepassing en handhaving van hun douanewetgeving;

Ervan overtuigd dat het optreden tegen inbreuken op de douanewetgeving doeltreffender kan worden door middel van nauwe samenwerking tussen hun douaneadministraties op basis van duidelijke wettelijke bepalingen;

Gelet op de Aanbeveling inzake wederzijdse administratieve bijstand en de Verklaring inzake verbetering van douanesamenwerking en wederzijdse administratieve bijstand (Verklaring van Cyprus), aangenomen door de Internationale Douaneraad, tegenwoordig bekend als de Wereld-douaneorganisatie, in respectievelijk december 1953 en juni 2000;

Tevens gelet op internationale verdragen die verboden, beperkingen en bijzondere controlemaatregelen met betrekking tot bepaalde goederen bevatten;

Zijn het volgende overeengekomen:

HOOFDSTUK I. BEGRIPSOMSCHRIJVINGEN

Artikel 1

Voor de toepassing van dit Verdrag:

  • a. wordt onder de uitdrukking „douaneadministratie” verstaan:

    • wat het Koninkrijk der Nederlanden betreft: de centrale administratie die verantwoordelijk is voor de uitvoering van de douanewetgeving in alle delen van het Koninkrijk der Nederlanden genoemd in artikel 21, tweede lid;

    • wat de Republiek der Filipijnen betreft: het Douanebureau;

  • b. wordt onder de uitdrukking „douanewetgeving” verstaan: alle wettelijke en administratieve bepalingen die door de douaneadministraties worden toegepast of gehandhaafd in verband met de invoer, uitvoer, overslag, doorvoer, opslag en het vervoer van goederen, met inbegrip van wettelijke en administratieve bepalingen met betrekking tot verbods-, beperkings- en controlemaatregelen;

  • c. wordt onder de uitdrukking „inbreuk op de douanewetgeving” verstaan: elke schending van de douanewetgeving zoals omschreven in de wetgeving van elke verdragsluitende partij, alsmede elke poging tot een dergelijke schending;

  • d. wordt onder de uitdrukking „douanevordering” verstaan: elk bedrag aan douanerechten dat niet in een van de verdragsluitende partijen geïnd kan worden;

  • e. wordt onder de uitdrukking „douanerechten” verstaan: alle rechten, belastingen of andere heffingen die geheven worden op de grondgebieden van de verdragsluitende partijen bij toepassing van de douanewetgeving, maar met uitzondering van heffingen voor verleende diensten;

  • f. wordt onder de uitdrukking „persoon” verstaan: zowel natuurlijke als rechtspersonen, tenzij anderszins vereist;

  • g. wordt onder de uitdrukking „persoonsgegevens” verstaan: alle gegevens betreffende een geïdentificeerde of identificeerbare natuurlijke persoon;

  • h. wordt onder de uitdrukking „informatie” verstaan: alle gegevens, documenten, rapporten, gewaarmerkte of gelegaliseerde afschriften daarvan, of andere mededelingen ongeacht in welke vorm, met inbegrip van de elektronische vorm;

  • i. wordt onder de uitdrukking „internationale logistieke keten” verstaan: alle processen die van toepassing zijn bij het grensoverschrijdend verkeer van goederen van de plaats van herkomst naar de uiteindelijke plaats van bestemming;

  • j. wordt onder de uitdrukking „functionaris” verstaan: elke douaneambtenaar of andere regeringsambtenaar aangewezen voor de toepassing van de douanewetgeving;

  • k. wordt onder de uitdrukking „verzoekende administratie” verstaan: de douaneadministratie die verzoekt om bijstand;

  • l. wordt onder de uitdrukking „aangezochte administratie” verstaan: de douaneadministratie die om bijstand wordt verzocht.

HOOFDSTUK II. REIKWIJDTE VAN HET VERDRAG

Artikel 2

  • 1 De verdragsluitende partijen verlenen elkaar door tussenkomst van hun douaneadministraties administratieve bijstand onder de in dit Verdrag genoemde voorwaarden ten behoeve van de juiste toepassing van de douanewetgeving, met het oog op het voorkomen, onderzoeken en bestrijden van inbreuken op die wetgeving, alsmede de invordering van douanevorderingen.

  • 2 Alle bijstand uit hoofde van dit Verdrag door een verdragsluitende partij wordt verleend in overeenstemming met haar wettelijke en administratieve bepalingen en binnen de grenzen van de bevoegdheden en beschikbare middelen van haar douaneadministratie.

  • 3 Dit Verdrag doet geen afbreuk aan de huidige en toekomstige verplichtingen van de verdragsluitende partijen die voortvloeien uit andere internationale overeenkomsten.

  • 4 Dit Verdrag is uitsluitend bedoeld voor de wederzijdse administratieve bijstand tussen de verdragsluitende partijen; particulieren kunnen aan de bepalingen van dit Verdrag niet het recht ontlenen bewijsmateriaal te verkrijgen, achter te houden of uit te sluiten dan wel de uitvoering van een verzoek te beletten.

  • 5 Dit Verdrag laat onverlet de regelgeving inzake wederzijdse rechtshulp in strafzaken. Indien wederzijdse bijstand dient te worden verleend in overeenstemming met een andere geldende overeenkomst tussen de verdragsluitende partijen, geeft de aangezochte administratie aan welke autoriteiten het betreft.

HOOFDSTUK III. REIKWIJDTE VAN DE BIJSTAND

Artikel 3

  • 1 De douaneadministraties verstrekken elkaar op verzoek of uit eigen beweging informatie met het oog op de juiste toepassing van de douanewetgeving, de voorkoming, opsporing en bestrijding van inbreuken op de douanewetgeving en de veiligheid van de internationale logistieke keten, alsmede de invordering van douanevorderingen.

  • 2 Elk van beide douaneadministraties handelt bij het instellen van een onderzoek namens de andere douaneadministratie alsof het onderzoek werd ingesteld ten behoeve van haarzelf of op verzoek van een andere autoriteit van haar eigen staat.

Artikel 4

  • 1 De aangezochte administratie verstrekt, op verzoek, alle informatie over de in die verdragsluitende partij toepasselijke douanewetgeving en -regelingen die van belang zijn voor het onderzoek met betrekking tot een inbreuk op de douanewetgeving.

  • 2 Elk van beide douaneadministraties verstrekt, uit eigen beweging en onverwijld, alle beschikbare informatie met betrekking tot:

    • a. nieuwe handhavingstechnieken betreffende de douanewetgeving die hun doeltreffendheid hebben bewezen;

    • b. nieuwe trends, middelen of werkwijzen betreffende het maken van inbreuken op de douanewetgeving;

    • c. alle andere gegevens die de douaneadministraties van nut kunnen zijn bij de risicobeoordeling voor controle- en facilitatiedoeleinden.

Artikel 5

De douaneadministraties kunnen elkaar technische bijstand verlenen bij onder andere de volgende douanezaken:

  • a. de uitwisseling van douaneambtenaren wanneer dat bevorderlijk is voor het wederzijds begrip van elkaars technieken;

  • b. training en bijstand bij de ontwikkeling van gespecialiseerde vaardigheden van douaneambtenaren;

  • c. de uitwisseling van informatie en ervaringen met betrekking tot het gebruik van detectieapparatuur;

  • d. de uitwisseling van deskundigen die goed geïnformeerd zijn over douanezaken;

  • e. de uitwisseling van professionele, wetenschappelijke en technische gegevens met betrekking tot de douanewetgeving en -regelingen.

HOOFDSTUK IV. BIJZONDERE VORMEN VAN BIJSTAND

Artikel 6

De aangezochte administratie verstrekt op verzoek de verzoekende administratie met name de volgende informatie:

  • a. of goederen die worden ingevoerd in het douanegebied van de verzoekende verdragsluitende partij op rechtmatige wijze zijn uitgevoerd uit het douanegebied van de aangezochte verdragsluitende partij;

  • b. of goederen die worden uitgevoerd uit het douanegebied van de verzoekende verdragsluitende partij op rechtmatige wijze zijn ingevoerd in het douanegebied van de aangezochte verdragsluitende partij en over de eventuele douaneregeling waaronder de goederen zijn gebracht.

Artikel 7

  • 1 De aangezochte administratie houdt op verzoek bijzonder toezicht op:

    • a. personen ten aanzien van wie het de verzoekende administratie bekend is dat zij een inbreuk op de douanewetgeving hebben gemaakt of die daarvan worden verdacht, met name diegenen die het douanegebied van de aangezochte verdragsluitende partij betreden en verlaten;

    • b. goederen in vervoer of in opslag ten aanzien waarvan door de verzoekende administratie is medegedeeld dat er een vermoeden van ongeoorloofd verkeer naar het douanegebied van de verzoekende verdragsluitende partij bestaat;

    • c. vervoermiddelen waarvan de verzoekende administratie vermoedt dat zij worden gebruikt voor het maken van inbreuken op de douanewetgeving in het douanegebied van de verzoekende verdragsluitende partij;

    • d. panden op het grondgebied van de aangezochte verdragsluitende partij waarvan bekend is dat zij gebruikt zijn of waarvan het vermoeden bestaat dat zij gebruikt worden in verband met het maken van een inbreuk op de douanewetgeving op het grondgebied van de verzoekende verdragsluitende partij.

  • 2 De douaneadministraties kunnen, overeenkomstig hun nationale wetgeving, in wederzijdse overeenstemming en door middel van een wederzijdse regeling, toestemming verlenen voor de onder hun toezicht verrichte invoer in, uitvoer uit of doorvoer via het douanegebied van hun respectieve staten van goederen die betrokken zijn bij ongeoorloofde handel om deze ongeoorloofde handel tegen te gaan.

Artikel 8

  • 1 De douaneadministraties verstrekken elkaar, op verzoek of uit eigen beweging, informatie over verrichte of voorgenomen transacties die een inbreuk op de douanewetgeving vormen of lijken te vormen.

  • 2 In ernstige gevallen die aanzienlijke schade voor de economie, volksgezondheid, openbare veiligheid of enig ander vitaal belang van de ene verdragsluitende partij met zich zouden kunnen meebrengen, verstrekt de douaneadministratie van de andere verdragsluitende partij waar mogelijk onverwijld uit eigen beweging dergelijke informatie.

Artikel 9

De douaneadministraties kunnen elkaar, door middel van een wederzijdse regeling automatisch alle informatie die onder dit Verdrag valt verstrekken. Deze uitwisseling geschiedt in overeenstemming met artikel 20, tweede lid, van dit Verdrag.

Artikel 10

  • 1 De douaneadministraties verlenen elkaar bijstand met het oog op de invordering van douanevorderingen in overeenstemming met hun respectieve nationale wettelijke en administratieve bepalingen voor de invordering van hun eigen vorderingen betreffende rechten en belastingen.

  • 2 De douaneadministraties schrijven in onderlinge overeenstemming regels voor met betrekking tot de toepassing van dit artikel, in overeenstemming met artikel 20, tweede lid, van dit Verdrag. Mogelijk is hiervoor de instemming van de andere nationale overheidsinstanties vereist.

HOOFDSTUK V. INFORMATIE

Artikel 11

  • 1 Om oorspronkelijke documenten wordt slechts verzocht in gevallen waarin niet met gewaarmerkte of gelegaliseerde afschriften of digitale documenten kan worden volstaan, en deze worden zo spoedig mogelijk teruggezonden; zulks laat rechten van de aangezochte administratie of van derden ter zake onverlet.

  • 2 Alle ingevolge dit Verdrag uit te wisselen informatie gaat vergezeld van alle gegevens die van belang zijn om deze te interpreteren of te gebruiken.

HOOFDSTUK VI. DESKUNDIGEN EN GETUIGEN

Artikel 12

De aangezochte administratie kan, op verzoek, haar functionarissen machtigen ter zake van de toepassing van de douanewetgeving als deskundige of getuige te verschijnen voor een rechtbank of gerecht of voor een administratieve of semi-rechterlijke instantie op het grondgebied van de verzoekende verdragsluitende partij.

HOOFDSTUK VII. TOEZENDING VAN VERZOEKEN

Artikel 13

  • 1 Verzoeken om bijstand uit hoofde van dit Verdrag worden, schriftelijk en vergezeld van nuttig geachte documenten, rechtstreeks aan de douaneadministratie van de andere verdragsluitende partij gericht. In urgente gevallen kunnen verzoeken ook mondeling worden gedaan. Dergelijke verzoeken worden onmiddellijk schriftelijk bevestigd.

  • 2 Verzoeken ingevolge het eerste lid van dit artikel bevatten de volgende gegevens:

    • a. de administratie die het verzoek doet;

    • b. het onderwerp van en de reden voor het verzoek;

    • c. een korte beschrijving van de zaak, de juridische aspecten en de aard van de procedure;

    • d. de namen en adressen van de betrokken partijen, voor zover bekend.

  • 3 Een verzoek van een van de douaneadministraties een bepaalde procedure te volgen wordt ingewilligd, met inachtneming van de wettelijke en administratieve bepalingen van de aangezochte verdragsluitende partij.

  • 4 De in dit Verdrag bedoelde informatie wordt alleen aan functionarissen medegedeeld die hiertoe door de douaneadministraties zijn aangewezen. Een lijst van aldus aangewezen functionarissen wordt aan de douaneadministratie van de andere verdragsluitende partij verstrekt in overeenstemming met artikel 20, tweede lid, van dit Verdrag.

HOOFDSTUK VIII. UITVOERING VAN VERZOEKEN

Artikel 14

Indien de aangezochte administratie niet over de gevraagde informatie beschikt, stelt zij een onderzoek in om die informatie te verkrijgen in overeenstemming met haar nationale wettelijke en administratieve bepalingen.

Artikel 15

  • 1 Door de verzoekende administratie aangewezen functionarissen kunnen, met instemming van de aangezochte administratie en onder voorwaarden die laatstgenoemde hieraan kan verbinden, ten behoeve van onderzoek naar een inbreuk op de douanewetgeving, op schriftelijk verzoek:

    • a. ten kantore van de aangezochte administratie de documenten, registers en andere van belang zijnde gegevens raadplegen om daaruit alle informatie met betrekking tot die inbreuk op de douanewetgeving over te nemen;

    • b. kopieën maken van de documenten, registers en andere gegevens die met betrekking tot die inbreuk op de douanewetgeving van belang zijn;

    • c. aanwezig zijn bij een door de aangezochte administratie geleid onderzoek in het douanegebied van de aangezochte verdragsluitende partij dat van belang is voor de verzoekende administratie.

  • 2 Wanneer functionarissen van de douaneautoriteit van de ene verdragsluitende partij aanwezig zijn op het grondgebied van de andere verdragsluitende partij uit hoofde van dit Verdrag, dienen zij te allen tijde in staat te zijn hun officiële hoedanigheid aan te tonen.

  • 3 Gedurende hun verblijf aldaar genieten zij dezelfde bescherming als die welke wordt toegekend aan douaneambtenaren van de andere verdragsluitende partij, in overeenstemming met de aldaar geldende wetgeving en zijn zij verantwoordelijk voor de strafbare feiten die zij eventueel begaan.

HOOFDSTUK IX. VERTROUWELIJKHEID VAN INFORMATIE

Artikel 16

  • 1 Alle uit hoofde van dit Verdrag ontvangen informatie mag slechts voor de doeleinden van dit Verdrag en door de douaneadministraties worden gebruikt, behalve in gevallen waarin de douaneadministratie die deze informatie heeft verstrekt, uitdrukkelijk haar goedkeuring hecht aan het gebruik daarvan voor andere doeleinden of door andere autoriteiten. In dat geval is dat gebruik onderworpen aan eventuele beperkingen die zijn vastgelegd door de douaneadministratie die de informatie heeft verstrekt. Deze informatie mag, indien de nationale wetgeving van de verstrekkende verdragsluitende partij dat voorschrijft, slechts bij strafrechtelijke vervolgingen worden gebruikt nadat het openbaar ministerie of de rechterlijke autoriteiten in de verstrekkende verdragsluitende partij met dit gebruik hebben ingestemd.

  • 2 Voor alle uit hoofde van dit Verdrag ontvangen informatie gelden ten minste dezelfde bescherming en vertrouwelijkheid als die welke voor soortgelijke informatie gelden krachtens het op de staatsburgers betrekking hebbende nationale recht van de verdragsluitende partij waar deze wordt ontvangen, ongeacht de nationaliteit, het staatsburgerschap of de woonplaats van de betrokken personen.

Artikel 17

  • 1 Op uit hoofde van dit Verdrag uitgewisselde persoonsgegevens is een beschermingsniveau van toepassing dat gelijk is aan het beschermingsniveau dat wordt gehanteerd door de verdragsluitende partij die de gegevens verstrekt.

  • 2 De verdragsluitende partijen verschaffen elkaar alle wetgeving inzake de bescherming van persoonsgegevens in hun respectieve staten welke van belang is voor dit artikel.

  • 3 Persoonsgegevens worden niet uitgewisseld voordat de verdragsluitende partijen overeenkomstig artikel 20, tweede lid, van dit Verdrag zijn overeengekomen dat het beschermingsniveau in beide verdragsluitende partijen gelijk is.

HOOFDSTUK X. ONTHEFFING

Artikel 18

  • 1 De aangezochte administratie is niet verplicht de in dit Verdrag bedoelde bijstand te verlenen indien deze de openbare orde of enig ander wezenlijk belang van de aangezochte verdragsluitende partij zou kunnen schaden of tot een schending van een industrieel of een commercieel geheim, dan wel van een beroepsgeheim zou kunnen leiden.

  • 2 Indien de verzoekende administratie niet in staat zou zijn een soortgelijk verzoek van de aangezochte administratie in te willigen, wijst zij daarop in haar verzoek. Inwilliging van een dergelijk verzoek wordt overgelaten aan het oordeel van de aangezochte administratie.

  • 3 De bijstand kan door de aangezochte administratie worden uitgesteld op grond van het feit dat een lopend onderzoek of een lopende vervolging of procedure hierdoor wordt doorkruist. In een dergelijk geval pleegt de aangezochte administratie overleg met de verzoekende administratie om te bepalen of de bijstand kan worden verleend onder de voorwaarden die de aangezochte administratie verlangt.

  • 4 Ingeval de bijstand wordt geweigerd of uitgesteld, dienen de redenen voor de weigering of het uitstel te worden gegeven.

HOOFDSTUK XI. KOSTEN

Artikel 19

  • 1 De douaneadministraties zien af van alle vorderingen tot vergoeding van ter uitvoering van dit Verdrag gemaakte kosten, met uitzondering van bedragen en vergoedingen betaald aan deskundigen en getuigen alsook de kosten van tolken die niet in dienst zijn van de regering, welke worden gedragen door de verzoekende administratie.

  • 2 Financiële gevolgen van invorderingshandelingen waarvan is gebleken dat zij niet gerechtvaardigd zijn op grond van de vaststaande feiten met betrekking tot de desbetreffende douanevordering of de geldigheid van de executoriale titel in de verzoekende verdragsluitende partij, worden gedragen door de verzoekende administratie.

  • 3 Indien met de uitvoering van het verzoek aanmerkelijke kosten en kosten van buitengewone aard zijn of zullen zijn gemoeid, plegen de verdragsluitende partijen overleg om de voorwaarden te bepalen waaronder het verzoek wordt of zal worden gedaan, alsmede de wijze waarop de kosten worden gedragen.

HOOFDSTUK XII. UITVOERING VAN HET VERDRAG

Artikel 20

  • 1 De douaneadministraties nemen maatregelen opdat hun met het onderzoek of de bestrijding van inbreuken op de douanewetgeving belaste functionarissen persoonlijke en rechtstreekse betrekkingen met elkaar kunnen onderhouden.

  • 2 De douaneadministraties besluiten over nadere regelingen, binnen het kader van dit Verdrag, ter vergemakkelijking van de uitvoering van dit Verdrag.

  • 3 De douaneadministraties streven ernaar eventuele problemen of twijfels naar aanleiding van de interpretatie of toepassing van dit Verdrag in onderlinge overeenstemming op te lossen.

  • 4 Conflicten waarvoor geen oplossing wordt gevonden, worden langs diplomatieke weg geregeld.

HOOFDSTUK XIII. TERRITORIALE TOEPASSING

Artikel 21

  • 1 Dit Verdrag is in overeenstemming met het internationale recht van kracht op de grondgebieden van beide staten.

  • 2 Wat het Koninkrijk der Nederlanden betreft is dit Verdrag van kracht in het Europese deel van Nederland, op Aruba, Curaçao en Sint Maarten alsmede in het Caribische deel van Nederland (Bonaire, Saba en Sint Eustatius).

HOOFDSTUK XIV. INWERKINGTREDING EN BEËINDIGING

Artikel 22

Dit Verdrag treedt in werking op de eerste dag van de tweede maand nadat de verdragsluitende partijen elkaar langs diplomatieke weg schriftelijk ervan in kennis hebben gesteld dat aan de grondwettelijke of nationale vereisten voor de inwerkingtreding van dit Verdrag is voldaan.

Artikel 23

  • 1 Dit Verdrag wordt in beginsel voor onbepaalde tijd gesloten, maar elk van beide verdragsluitende partijen kan het te allen tijde door middel van een kennisgeving langs diplomatieke weg beëindigen.

  • 2 De verdragsluitende partijen kunnen de toepassing van dit Verdrag voor elk afzonderlijk deel van het Koninkrijk der Nederlanden beëindigen.

  • 3 De beëindiging wordt van kracht drie maanden na de datum van de kennisgeving van opzegging aan de andere verdragsluitende partij. Lopende procedures op het tijdstip van beëindiging worden niettemin voltooid in overeenstemming met de bepalingen van dit Verdrag.

Artikel 24

De verdragsluitende partijen komen op verzoek of na het verstrijken van vijf jaar vanaf de datum van inwerkingtreding van dit Verdrag bijeen om het te heroverwegen, tenzij zij elkaar er schriftelijk van in kennis stellen dat een dergelijke heroverweging niet nodig is.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd, dit Verdrag hebben ondertekend.
