Vienna Convention on Diplomatic Relations

The States Parties to the present Convention,

Recalling that peoples of all nations from ancient times have recognized the status of diplomatic agents,

Having in mind the purposes and principles of the Charter of the United Nations concerning the sovereign equality of States, the maintenance of international peace and security, and the promotion of friendly relations among nations,

Believing that an international convention on diplomatic intercourse, privileges and immunities would contribute to the development of friendly relations among nations, irrespective of their differing constitutional and social systems,

Realizing that the purpose of such privileges and immunities is not to benefit individuals but to ensure the efficient performance of the functions of diplomatic missions as representing States,

Affirming that the rules of customary international law should continue to govern questions not expressly regulated by the provisions of the present Convention,

Have agreed as follows:

Article 1

For the purpose of the present Convention, the following expressions shall have the meanings hereunder assigned to them:

  • (a) the “head of the mission” is the person charged by the sending State with the duty of acting in that capacity;

  • (b) the “members of the mission” are the head of the mission and the members of the staff of the mission;

  • (c) the “members of the staff of the mission” are the members of the diplomatic staff, of the administrative and technical staff and of the service staff of the mission;

  • (d) the “members of the diplomatic staff” are the members of the staff of the mission having diplomatic rank;

  • (e) a “diplomatic agent” is the head of the mission or a member of the diplomatic staff of the mission;

  • (f) the “members of the administrative and technical staff” are the members of the staff of the mission employed in the administrative and technical service of the mission;

  • (g) the “members of the service staff” are the members of the staff of the mission in the domestic service of the mission;

  • (h) a “private servant” is a person who is in the domestic service of a member of the mission and who is not an employee of the sending State;

  • (i) the “premises of the mission” are the buildings or parts of buildings and the land ancillary thereto, irrespective of ownership, used for the purposes of the mission including the residence of the head of the mission.

Article 2

The establishment of diplomatic relations between States, and of permanent diplomatic missions, takes place by mutual consent.

Article 3

  • 1 The functions of a diplomatic mission consist inter alia in:

    • (a) representing the sending State in the receiving State;

    • (b) protecting in the receiving State the interests of the sending State and of its nationals, within the limits permitted by international law;

    • (c) negotiating with the Government of the receiving State;

    • (d) ascertaining by all lawful means conditions and developments in the receiving State, and reporting thereon to the Government of the sending State;

    • (e) promoting friendly relations between the sending State and the receiving State, and developing their economic, cultural and scientific relations.

  • 2 Nothing in the present Convention shall be construed as preventing the performance of consular functions by a diplomatic mission.

Article 4

  • 1 The sending State must make certain that the agrément of the receiving State has been given for the person it proposes to accredit as head of the mission to that State.

  • 2 The receiving State is not obliged to give reasons to the sending State for a refusal of agrément.

Article 5

  • 1 The sending State may, after it has given due notification to the receiving States concerned, accredit a head of mission or assign any member of the diplomatic staff, as the case may be, to more than one State, unless there is express objection by any of the receiving States.

  • 2 If the sending State accredits a head of mission to one or more other States it may establish a diplomatic mission headed by a chargé d'affaires ad interim in each State where the head of mission has not his permanent seat.

  • 3 A head of mission or any member of the diplomatic staff of the mission may act as representative of the sending State to any international organization.

Article 6

Two or more States may accredit the same person as head of mission to another State, unless objection is offered by the receiving State.

Article 7

Subject to the provisions of Articles 5, 8, 9 and 11, the sending State may freely appoint the members of the staff of the mission. In the case of military, naval or air attaches, the receiving State may require their names to be submitted beforehand, for its approval.

Article 8

  • 1 Members of the diplomatic staff of the mission should in principle be of the nationality of the sending State.

  • 2 Members of the diplomatic staff of the mission may not be appointed from among persons having the nationality of the receiving State, except with the consent of that State which may be withdrawn at any time.

  • 3 The receiving State may reserve the same right with regard to nationals of a third State who are not also nationals of the sending State.

Article 9

  • 1 The receiving State may at any time and without having to explain its decision, notify the sending State that the head of the mission or any member of the diplomatic staff of the mission is persona non grata or that any other member of the staff of the mission is not acceptable. In any such case, the sending Stale shall, as appropriate, either recall the person concerned or terminate his functions with the mission. A person may be declared non grata or not acceptable before arriving in the territory of the receiving State.

  • 2 If the sending State refuses or fails within a reasonable period to carry out its obligations under paragraph 1 of this Article, the receiving State may refuse to recognize the person concerned as a member of the mission.

Article 10

  • 1 The Ministry for Foreign Affairs of the receiving State, or such other ministry as may be agreed, shall be notified of:

    • (a) the appointment of members of the mission, their arrival and their final departure or the termination of their functions with the mission;

    • (b) the arrival and final departure of a person belonging to the family of a member of the mission and, where appropriate, the fact that a person becomes or ceases to be a member of the family of a member of the mission;

    • (c) the arrival and final departure of private servants in the employ of persons referred to in sub-paragraph (a) of this paragraph and, where appropriate, the fact that they are leaving the employ of such persons;

    • (d) the engagement and discharge of persons resident in the receiving State as members of the mission or private servants entitled to privileges and immunities.

  • 2 Where possible, prior notification of arrival and final departure shall also be given.

Article 11

  • 1 In the absence of specific agreement as to the size of the mission, the receiving State may require that the size of a mission be kept within limits considered by it to be reasonable and normal, having regard to circumstances and conditions in the receiving State and to the needs of the particular mission.

  • 2 The receiving State may equally, within similar bounds and on a non-discriminatory basis, refuse to accept officials of a particular category.

Article 12

The sending State may not without the prior express consent of the receiving State, establish offices forming part of the mission in localities other than those in which the mission itself is established.

Article 13

  • 1 The head of the mission is considered as having taken up his functions in the receiving State either when he has presented his credentials or when he has notified his arrival and a true copy of his credentials has been presented to the Ministry for Foreign Affairs of the receiving State, or such other ministry as may be agreed, in accordance with the practice prevailing in the receiving State which shall be applied in a uniform manner.

  • 2 The order of presentation of credentials or of a true copy thereof will be determined by the date and time of the arrival of the head of the mission.

Article 14

  • 1 Heads of mission are divided into three classes, namely:

    • (a) that of ambassadors or nuncios accredited to Heads of State, and other heads of mission of equivalent rank;

    • (b) that of envoys, ministers and internuncios accredited to Heads of State;

    • (c) that of chargés d'affaires accredited to Ministers for Foreign Affairs.

  • 2 Except as concerns precedence and etiquette, there shall be no differentiation between heads of mission by reason of their class.

Article 15

The class to which the heads of their missions are to be assigned shall be agreed between States.

Article 16

  • 1 Heads of mission shall take precedence in their respective classes in the order of the date and time of taking up their functions in accordance with Article 13.

  • 2 Alterations in the credentials of a head of mission not involving any change of class shall not affect his precedence.

  • 3 This article is without prejudice to any practice accepted by the receiving State regarding the precedence of the representative of the Holy See.

Article 17

The precedence of the members of the diplomatic staff of the mission shall be notified by the head of the mission to the Ministry for Foreign Affairs or such other ministry as may be agreed.

Article 18

The procedure to be observed in each State for the reception of heads of mission shall be uniform in respect of each class.

Article 19

  • 1 If the post of head of the mission is vacant, or if the head of the mission is unable to perform his functions, a chargé d'affaires ad interim shall act provisionally as head of the mission. The name of the chargé d'affaires ad interim shall be notified, either by the head of the mission or, in case he is unable to do so, by the Ministry for Foreign Affairs of the sending State to the Ministry for Foreign Affairs of the receiving State or such other ministry as may be agreed.

  • 2 In cases where no member of the diplomatic staff of the mission is present in the receiving State, a member of the administrative and technical staff may, with the consent of the receiving State, be designated by the sending State to be in charge of the current administrative affairs of the mission.

Article 20

The mission and its head shall have the right to use the flag and emblem of the sending State on the premises of the mission, including the residence of the head of the mission, and on his means of transport.

Article 21

  • 1 The receiving State shall either facilitate the acquisition on its territory, in accordance with its laws, by the sending State of premises necessary for its mission or assist the latter in obtaining accommodation in some other way.

  • 2 It shall also, where necessary, assist missions in obtaining suitable accommodation for their members.

Article 22

  • 1 The premises of the mission shall be inviolable. The agents of the receiving State may not enter them, except with the consent of the head of the mission.

  • 2 The receiving State is under a special duty to take all appropriate steps to protect the premises of the mission against any intrusion or damage and to prevent any disturbance of the peace of the mission or impairment of its dignity.

  • 3 The premises of the mission, their furnishings and other property thereon and the means of transport of the mission shall be immune from search, requisition, attachment or execution.

Article 23

  • 1 The sending State and the head of the mission shall be exempt from all national, regional or municipal dues and taxes in respect of the premises of the mission, whether owned or leased, other than such as represent payment for specific services rendered.

  • 2 The exemption from taxation referred to in this Article shall not apply to such dues and taxes payable under the law of the receiving State by persons contracting with the sending State or the head of the mission.

Article 24

The archives and documents of the mission shall be inviolable at any time and wherever they may be.

Article 25

The receiving State shall accord full facilities for the performance of the functions of the mission.

Article 26

Subject to its laws and regulations concerning zones entry into which is prohibited or regulated for reasons of national security, the receiving State shall ensure to all members of the mission freedom of movement and travel in its territory.

Article 27

  • 1 The receiving State shall permit and protect free communication on the part of the mission for all official purposes. In communicating with the Government and the other missions and consulates of the sending State, wherever situated, the mission may employ all appropriate means, including diplomatic couriers and messages in code or cipher. However, the mission may install and use a wireless transmitter only with the consent of the receiving State.

  • 2 The official correspondence of the mission shall be inviolable. Official correspondence means all correspondence relating to the mission and its functions.

  • 3 The diplomatic bag shall not be opened or detained.

  • 4 The packages constituting the diplomatic bag must bear visible external marks of their character and may contain only diplomatic documents or articles intended for official use.

  • 5 The diplomatic courier, who shall be provided with an official document indicating his status and the number of packages constituting the diplomatic bag, shall be protected by the receiving State in the performance of his functions. He shall enjoy personal inviolability and shall not be liable to any form of arrest or detention.

  • 6 The sending State or the mission may designate diplomatic couriers ad hoc. In such cases the provisions of paragraph 5 of this Article shall also apply, except that the immunities therein mentioned shall cease to apply when such a courier has delivered to the consignee the diplomatic bag in his charge.

  • 7 A diplomatic bag may be entrusted to the captain of a commercial aircraft scheduled to land at an authorized port of entry. He shall be provided with an official document indicating the number of packages constituting the bag but he shall not be considered to be a diplomatic courier. The mission may send one of its members to take possession of the diplomatic bag directly and freely from the captain of the aircraft.

Article 28

The fees and charges levied by the mission in the course of its official duties shall be exempt from all dues and taxes.

Article 29

The person of a diplomatic agent shall be inviolable. He shall not be liable to any form of arrest or detention. The receiving State shall treat him with due respect and shall take all appropriate steps to prevent any attack on his person, freedom or dignity.

Article 30

  • 1 The private residence of a diplomatic agent shall enjoy the same inviolability and protection as the premises of the mission.

  • 2 His papers, correspondence and, except as provided in paragraph 3 of Article 31, his property, shall likewise enjoy inviolability.

Article 31

  • 1 A diplomatic agent shall enjoy immunity from the criminal jurisdiction of the receiving State. He shall also enjoy immunity from its civil and administrative jurisdiction, except in the case of:

    • (a) a real action relating to private immovable property situated in the territory of the receiving State, unless he holds it on behalf of the sending State for the purposes of the mission;

    • (b) an action relating to succession in which the diplomatic agent is involved as executor, administrator, heir or legatee as a private person and not on behalf of the sending State;

    • (c) an action relating to any professional or commercial activity exercised by the diplomatic agent in the receiving State outside his official functions.

  • 2 A diplomatic agent is not obliged to give evidence as a witness.

  • 3 No measures of execution may be taken in respect of a diplomatic agent except in the cases coming under sub-paragraphs (a), (b) and (c) of paragraph 1 of this Article, and provided that the measures concerned can be taken without infringing the inviolability of his person or of his residence.

  • 4 The immunity of a diplomatic agent from the jurisdiction of the receiving State does not exempt him from the jurisdiction of the sending State.

Article 32

  • 1 The immunity from jurisdiction of diplomatic agents and of persons enjoying immunity under Article 37 may be waived by the sending State.

  • 2 Waiver must always be express.

  • 3 The initiation of proceedings by a diplomatic agent or by a person enjoying immunity from jurisdiction under Article 37 shall preclude him from invoking immunity from jurisdiction in respect of any counter-claim directly connected with the principal claim.

  • 4 Waiver of immunity from jurisdiction in respect of civil or administrative proceedings shall not be held to imply waiver of immunity in respect of the execution of the judgment, for which a separate waiver shall be necessary.

Article 33

  • 1 Subject to the provisions of paragraph 3 of this Article, a diplomatic agent shall with respect to services rendered for the sending State be exempt from social security provisions which may be in force in the receiving State.

  • 2 The exemption provided for in paragraph 1 of this Article shall also apply to private servants who are in the sole employ of a diplomatic agent, on condition:

    • (a) that they are not nationals of or permanently resident in the receiving State; and

    • (b) that they are covered by the social security provisions which may be in force in the sending State or a third State.

  • 3 A diplomatic agent who employs persons to whom the exemption provided for in paragraph 2 of this Article does not apply shall observe the obligations which the social security provisions of the receiving State impose upon employers.

  • 4 The exemption provided for in paragraphs 1 and 2 of this Article shall not preclude voluntary participation in the social security system of the receiving State provided that such participation is permitted by that State.

  • 5 The provisions of this Article shall not affect bilateral or multilateral agreements concerning social security concluded previously and shall not prevent the conclusion of such agreements in the future.

Article 34

A diplomatic agent shall be exempt from all dues and taxes, personal or real, national, regional or municipal, except:

  • (a) indirect taxes of a kind which are normally incorporated in the price of goods or services;

  • (b) dues and taxes on private immovable property situated in the territory of the receiving State, unless he holds it on behalf of the sending State for the purposes of the mission;

  • (c) estate, succession or inheritance duties levied by the receiving State subject to the provisions of paragraph 4 of Article 39;

  • (d) dues and taxes on private income having its source in the receiving State and capital taxes on investments made in commercial undertakings in the receiving State;

  • (e) charges levied for specific services rendered;

  • (f) registration, court or record fees, mortgage dues and stamp duty, with respect to immovable property, subject to the provisions of Article 23.

Article 35

The receiving State shall exempt diplomatic agents from all personal services, from all public service of any kind whatsoever, and from military obligations such as those connected with requisitioning, military contributions and billeting.

Article 36

  • 1 The receiving State shall, in accordance with such laws and regulations as it may adopt, permit entry of and grant exemption from all customs duties, taxes, and related charges other than charges for storage, cartage and similar services, on:

    • (a) articles for the official use of the mission;

    • (b) articles for the personal use of a diplomatic agent or members of his family forming part of his household, including articles intended for his establishment.

  • 2 The personal baggage of a diplomatic agent shall be exempt from inspection, unless there are serious grounds for presuming that it contains articles not covered by the exemptions mentioned in paragraph 1 of this Article, or articles the import or export of which is prohibited by the law or controlled by the quarantine regulations of the receiving State. Such inspection shall be conducted only in the presence of the diplomatic agent or of his authorized representative.

Article 37

  • 1 The members of the family of a diplomatic agent forming part of his household shall, if they are not nationals of the receiving State, enjoy the privileges and immunities specified in Articles 29 to 36.

  • 2 Members of the administrative and technical staff of the mission, together with members of their families forming part of their respective households, shall, if they are not nationals of or permanently resident in the receiving State, enjoy the privileges and immunities specified in Articles 29 to 35, except that the immunity from civil and administrative jurisdiction of the receiving State specified in paragraph 1 of Article 31 shall not extend to acts performed outside the course of their duties. They shall also enjoy the privileges specified in Article 36, paragraph 1, in respect of articles imported at the time of first installation.

  • 3 Members of the service staff of the mission who are not nationals of or permanently resident in the receiving State shall enjoy immunity in respect of acts performed in the course of their duties, exemption from dues and taxes on the emoluments they receive by reason of their employment and the exemption contained in Article 33.

  • 4 Private servants of members of the mission shall, if they are not nationals of or permanently resident in the receiving State, be exempt from dues and taxes on the emoluments they receive by reason of their employment. In other respects, they may enjoy privileges and immunities only to the extent admitted by the receiving State. However, the receiving State must exercise its jurisdiction over those persons in such a manner as not to interfere unduly with the performance of the functions of the mission.

Article 38

  • 1 Except insofar as additional privileges and immunities may be granted by the receiving State, a diplomatic agent who is a national of or permanently resident in that State shall enjoy only immunity from jurisdiction, and inviolability, in respect of official acts performed in the exercise of his functions.

  • 2 Other members of the staff of the mission and private servants who are nationals of or permanently resident in the receiving State shall enjoy privileges and immunities only to the extent admitted by the receiving State. However, the receiving State must exercise its jurisdiction over those persons in such a manner as not to interfere unduly with the performance of the functions of the mission.

Article 39

  • 1 Every person entitled to privileges and immunities shall enjoy them from the moment he enters the territory of the receiving State on proceeding to take up his post or, if already in its territory, from the moment when his appointment is notified to the Ministry for Foreign Affairs or such other ministry as may be agreed.

  • 2 When the functions of a person enjoying privileges and immunities have come to an end, such privileges and immunities shall normally cease at the moment when he leaves the country, or on expiry of a reasonable period in which to do so, but shall subsist until that time, even in case of armed conflict. However, with respect to acts performed by such a person in the exercise of his functions as a member of the mission, immunity shall continue to subsist.

  • 3 In case of the death of a member of the mission, the members of his family shall continue to enjoy the privileges and immunities to which they are entitled until the expiry of a reasonable period in which to leave the country.

  • 4 In the event of the death of a member of the mission not a national of or permanently resident in the receiving State or a member of his family forming part of his household, the receiving State shall permit the withdrawal of the movable property of the deceased, with the exception of any property acquired in the country the export of which was prohibited at the time of his death. Estate, succession and inheritance duties shall not be levied on movable property the presence of which in the receiving State was due solely to the presence there of the deceased as a member of the mission or as a member of the family of a member of the mission.

Article 40

  • 1 If a diplomatic agent passes through or is in the territory of a third State, which has granted him a passport visa if such visa was necessary, while proceeding to take up or to return to his post, or when returning to his own country, the third State shall accord him inviolability and such other immunities as may be required to ensure his transit or return. The same shall apply in the case of any members of his family enjoying privileges or immunities who are accompanying the diplomatic agent, or travelling separately to join him or to return to their country.

  • 2 In circumstances similar to those specified in paragraph 1 of this Article, third States shall not hinder the passage of members of the administrative and technical or service staff of a mission, and of members of their families, through their territories.

  • 3 Third States shall accord to official correspondence and other official communications in transit, including messages in code or cipher, the same freedom and protection as is accorded by the receiving State. They shall accord to diplomatic couriers, who have been granted a passport visa if such visa was necessary, and diplomatic bags in transit the same inviolability and protection as the receiving State is bound to accord.

  • 4 The obligations of third States under paragraphs 1, 2 and 3 of this Article shall also apply to the persons mentioned respectively in those paragraphs, and to official communications and diplomatic bags, whose presence in the territory of the third State is due to force majeure.

Article 41

  • 1 Without prejudice to their privileges and immunities, it is the duty of all persons enjoying such privileges and immunities to respect the laws and regulations of the receiving State. They also have a duty not to interfere in the internal affairs of that State.

  • 2 All official business with the receiving State entrusted to the mission by the sending State shall be conducted with or through the Ministry for Foreign Affairs of the receiving State or such other ministry as may be agreed.

  • 3 The premises of the mission must not be used in any manner incompatible with the functions of the mission as laid down in the present Convention or by other rules of general international law or by any special agreements in force between the sending and the receiving State.

Article 42

A diplomatic agent shall not in the receiving State practise for personal profit any professional or commercial activity.

Article 43

The function of a diplomatic agent comes to an and, inter alia:

  • (a) on notification by the sending State to the receiving State that the function of the diplomatic agent has come to an end;

  • (b) on notification by the receiving State to the sending State that, in accordance with paragraph 2 of Article 9, it refuses to recognise the diplomatic agent as a member of the mission.

Article 44

The receiving State must, even in case of armed conflict, grant facilities in order to enable persons enjoying privileges and immunities, other than nationals of the receiving State, and members of the families of such persons irrespective of their nationality, to leave at the earliest possible moment. It must, in particular, in case of need, place at their disposal the necessary means of transport for themselves and their property.

Article 45

If diplomatic relations are broken off between two States, or if a mission is permanently or temporarily recalled:

  • (a) the receiving State must, even in case of armed conflict, respect and protect the premises of the mission, together with its property and archives;

  • (b) the sending State may entrust the custody of the premises of the mission, together with its property and archives, to a third State acceptable to the receiving State;

  • (c) the sending State may entrust the protection of its interests and those of its nationals to a third State acceptable to the receiving State.

Article 46

A sending State may with the prior consent of a receiving State, and at the request of a third State not represented in the receiving State, undertake the temporary protection of the interests of the third State and of its nationals.

Article 47

  • 1 In the application of the provisions of the present Convention, the receiving State shall not discriminate as between States.

  • 2 However, discrimination shall not be regarded as taking place:

    • (a) where the receiving State applies any of the provisions of the present Convention restrictively because of a restrictive application of that provision to its mission in the sending State;

    • (b) where by custom or agreement States extend to each other more favourable treatment than is required by the provisions of the present Convention.

Article 48

The present Convention shall be open for signature by all States Members of the United Nations or of any of the specialised agencies or Parties to the Statute of the International Court of Justice, and by any other State invited by the General Assembly of the United Nations to become a Party to the Convention, as follows: until 31 October 1961 at the Federal Ministry for Foreign Affairs of Austria and subsequently, until 31 March 1962, at the United Nations Headquarters in New York.

Article 49

The present Convention is subject to ratification. The instruments of ratification shall be deposited with the Secretary-General of the United Nations.

Article 50

The present Convention shall remain open for accession by any State belonging to any of the four categories mentioned in Article 48. The instruments of accession shall be deposited with the Secretary-General of the United Nations.

Article 51

  • 1 The present Convention shall enter into force on the thirtieth day following the date of deposit of the twenty-second instrument of ratification or accession with the Secretary-General of the United Nations.

  • 2 For each State ratifying or acceding to the Convention after the deposit of the twenty-second instrument of ratification or accession, the Convention shall enter into force on the thirtieth day after deposit by such State of its instrument of ratification or accession.

Article 52

The Secretary-General of the United Nations shall inform all States belonging to any of the four categories mentioned in Article 48:

  • (a) of signatures to the present Convention and of the deposit of instruments of ratification or accession, in accordance with Articles 48, 49 and 50;

  • (b) of the date on which the present Convention will enter into force, in accordance with Article 51.

Article 53

The original of the present Convention, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations, who shall send certified copies thereof to all States belonging to any of the four categories mentioned in Article 48.

IN WITNESS WHEREOF the undersigned Plenipotentiaries, being duly authorised thereto by their respective Governments, have signed the present Convention.

DONE at Vienna, this eighteenth day of April one thousand nine hundred and sixty-one.

Final Act of the United Nations Conference on Diplomatic Intercourse

  • 1. The General Assembly of the United Nations, by resolution 1450 (XIV) of 7 December 1959, decided to convene an international conference of plenipotentiaries to consider the question of diplomatic intercourse and immunities and to embody the results of its work in an international convention, together with such ancillary instruments as might be necessary. The General Assembly, accepting an invitation extended by the Federal Government of Austria, also asked the Secretary-General to convoke the conference at Vienna not later than the spring of 1961.

  • 2. The United Nations Conference on Diplomatic Intercourse and Immunities met at the Neue Hofburg in Vienna, Austria, from 2 March to 14 April 1961.

  • 3.   • 11. The General Assembly, by its resolution 1450 (XIV) convening the Conference, referred to the Conference chapter III of the Report of the International Law Commission covering the Work of its Tenth Session as the basis for its consideration of the question of diplomatic intercourse and immunities. The General Assembly, by its resolution 1504(XV) of 12 December 1960, also referred to the Conference the draft articles on special missions contained in chapter III of the Report of the International Law Commission covering the Work of its Twelfth Session, so that they might be considered together with the draft articles on diplomatic intercourse and immunities included in the Commission's report on its tenth session.

  • 12. The Conference also had before it observations submitted by Governments on the drafts prepared by the International Law Commission during successive stages of its work, preparatory documentation prepared by the Secretariat of the United Nations, the text of the final report of the Asian-African Legal Consultative Committee on functions, privileges and immunities of diplomatic envoys or agents, adopted at the Committee's third session, and the text of the Convention regarding diplomatic officers adopted by the Sixth International American Conference and signed at Havana, 20 February 1928.

  • 13. On the basis of the deliberations, as recorded in the records and report of the Committee of the Whole and in the records of the plenary meetings, the Conference prepared the following Convention and Protocols:

    • Vienna Convention on Diplomatic Relations;

      Optional Protocol concerning Acquisition of Nationality;

      Optional Protocol concerning the Compulsory Settlement of Disputes.

      The foregoing Convention and Protocols, which are subject to ratification, were adopted by the Conference on 14 April 1961, and opened for signature on 18 April 1961, in accordance with their provisions, until 31 October 1961 at the Federal Ministry for Foreign Affairs of Austria and subsequently, until 31 March 1962, at the United Nations Headquarters in New York. The same instruments were also opened for accession, in accordance with their provisions, and will be deposited with the Secretary-General of the United Nations.

  • 14. In addition the Conference adopted the following resolutions which are annexed to this Final Act:

    • Resolution on Special Missions;

      Resolution on Consideration of Civil Claims;

      Resolution expressing a tribute to the International Law Commission;

      Resolution expressing a tribute to the Government and people of the Republic of Austria.

IN WITNESS WHEREOF the representatives have signed this Final Act.

DONE at Vienna this eighteenth day of April, one thousand nine hundred and sixty-one, in a single copy in the Chinese, English, French, Russian and Spanish languages, each text being equally authentic. By unanimous decision of the Conference the original of this Final Act shall be deposited in the archives of the Federal Ministry for Foreign Affairs of Austria.

I. Special Missions

Resolution adopted at the 4th plenary meeting on April 10, 1961

The United Nations Conference on Diplomatic Intercourse and Immunities,

Recalling that the General Assembly of the United Nations, by its resolution 1504 (XV) of 12 December 1960, referred to the Conference the draft articles on special missions contained in chapter III of the Report of the International Law Commission covering the Work of its Twelfth Session,

Recognizing the importance of the subject of special missions,

Taking note of the comments of the International Law Commission that the draft articles on special missions constituted only a preliminary survey and that the time at its disposal had not permitted the Commission to undertake a thorough study of the matter,

Considering the limited time available to the Conference to study the subject in full,

Recommends to the General Assembly of the United Nations that it refer to the International Law Commission further study of the subject of special missions in the light of the Vienna Convention on Diplomatic Relations adopted at the present Conference.

II. Consideration of Civil Claims

Resolution adopted at the 12th plenary meeting on April 14, 1961

The United Nations Conference on Diplomatic Intercourse and Immunities,

Taking note that the Vienna Convention on Diplomatic Relations adopted by the Conference provides for immunity from the jurisdiction of the receiving State of members of the diplomatic mission of the sending State,

Recalling that such immunity may be waived by the sending State,

Recalling further the statement made in the Preamble to the Convention that the purpose of such immunities is not to benefit individuals but to ensure the efficient performance of the functions of diplomatic missions,

Mindful of the deep concern expressed during the deliberations of the Conference that claims of diplomatic immunity might, in certain cases, deprive persons in the receiving State of remedies to which they are entitled by law,

Recommends that the sending State should waive the immunity of members of its diplomatic mission in respect of civil claims of persons in the receiving State when this can be done without impeding the performance of the functions of the mission, and that, when immunity is not waived, the sending State should use its best endeavours to bring about a just settlement of the claims.

III. Tribute to the International Law Commission

Resolution adopted at the 12th plenary meeting on April 14, 1961

The United Nations Conference on Diplomatic Intercourse and Immunities,

Having adopted the Vienna Convention on Diplomatic Relations on the basis of draft articles prepared by the International Law Commission,

Resolves to express its deep gratitude to the International Law Commission for its outstanding contribution to the codification and development of the rules of international law on diplomatic intercourse and immunities.

IV. Tribute to the Government and People of the Republic of Austria

Conscients des buts et des principes de la Charte des Nations Unies concernant l'égalité souveraine des Etats, le maintien de la paix et de la sécurité internationales et le développement de relations amicales entre les nations,

Persuadés qu'une convention internationale sur les relations, privilèges et immunités diplomatiques contribuerait à favoriser les relations d'amitié entre les pays quelle que soit la diversité de leurs régimes constitutionnels et sociaux,

Affirmant que les règles du droit international coutumier doivent continuer à régir les questions qui n'ont pas été expressément réglées dans les dispositions de la présente Convention,

Sont convenus de ce qui suit:

Article premier

Aux fins de la présente Convention, les expressions suivantes s'entendent comme il est précisé ci-dessous:

  • a) l'expression „chef de mission” s'entend de la personne chargée par l'Etat accréditant d'agir en cette qualité;

  • b) l'expression „membres de la mission” s'entend du chef de la mission et des membres du personnel de la mission;

  • c) l'expression „membres du personnel de la mission” s'entend des membres du personnel diplomatique, du personnel administratif et technique et du personnel de service de la mission;

  • d) l'expression „membres du personnel diplomatique” s'entend des membres du personnel de la mission qui ont la qualité de diplomates;

  • e) l'expression „agent diplomatique” s'entend du chef de la mission ou d'un membre du personnel diplomatique de la mission;

  • f) l'expression „membres du personnel administratif et technique” s'entend des membres du personnel de la mission employés dans le service administratif et technique de la mission;

  • g) l'expression „membres du personnel de service” s'entend des membres du personnel de la mission employés au service domestique de la mission;

  • h) l'expression „domestique privé” s'entend des personnes employées au service domestique d'un membre de la mission, qui ne sont pas des employés de l'Etat accréditant;

  • i) l'expression „locaux de la mission” s'entend des bâtiments ou des parties de bâtiments et du terrain attenant qui, quel qu'en soit le propriétaire, sont utilisés aux fins de la mission, y compris la résidence du chef de la mission.

Article 2

L'établissement de relations diplomatiques entre Etats et l'envoi de missions diplomatiques permanentes se font par consentement mutuel.

Article 3

  • 1 Les fonctions d'une mission diplomatique consistent notamment à:

    • a) représenter l'Etat accréditant auprès de l'Etat accréditaire;

    • b) protéger dans l'Etat accréditaire les intérêts de l'Etat accréditant et de ses ressortissants, dans les limites admises par le droit international;

    • c) négocier avec le gouvernement de l'Etat accréditaire;

    • d) s'informer par tous les moyens licites des conditions et de l'évolution des événements dans l'Etat accréditaire et faire rapport à ce sujet au gouvernement de l'Etat accréditant;

    • e) promouvoir des relations amicales et développer les relations économiques, culturelles et scientifiques entre l'Etat accréditant et l'Etat accréditaire.

  • 2 Aucune disposition de la présente Convention ne saurait être interprétée comme interdisant l'exercice de fonctions consulaires par une mission diplomatique.

Article 4

  • 1 L'Etat accréditant doit s'assurer que la personne qu'il envisage d'accréditer comme chef de la mission auprès de l'Etat accréditaire a reçu l'agrément de cet Etat.

  • 2 L'Etat accréditaire n'est pas tenu de donner à l'Etat accréditant les raisons d'un refus d'agrément.

Article 5

  • 1 L'Etat accréditant, après due notification aux Etats accréditaires intéressés, peut accréditer un chef de mission ou affecter un membre du personnel diplomatique, suivant le cas, auprès de plusieurs Etats, à moins que l'un des Etats accréditaires ne s'y oppose expressément.

  • 2 Si l'Etat accréditant accrédite un chef de mission auprès d'un ou de plusieurs autres Etats, il peut établir une mission diplomatique dirigée par un chargé d'affaires ad interim dans chacun des Etats où le chef de la mission n'a pas sa résidence permanente.

  • 3 Un chef de mission ou un nombre du personnel diplomatique de la mission peut représenter l'Etat accréditant auprès de toute organisation internationale.

Article 6

Plusieurs Etats peuvent accréditer la même personne en qualité de chef de mission auprès d'un autre Etat, à moins que l'Etat accréditaire ne s'y oppose.

Article 7

Sous réserve des dispositions des articles 5, 8, 9 et 11, l'Etat accréditant nomme à son choix les membres du personnel de la mission. En ce qui concerne les attachés militaires, navals ou de l'air, l'Etat accréditaire peut exiger que leurs noms lui soient soumis à l'avance aux fins d'approbation.

Article 8

  • 1 Les membres du personnel diplomatique de la mission auront en principe la nationalité de l'Etat accréditant.

  • 2 Les membres du personnel diplomatique de la mission ne peuvent être choisis parmi les ressortissants de l'Etat accréditaire qu'avec le consentement de cet Etat, qui peut en tout temps le retirer.

  • 3 L'Etat accréditaire peut se réserver le même droit en ce qui concerne les ressortissants d'un Etat tiers qui ne sont pas également ressortissants de l'Etat accréditant.

Article 9

  • 1 L'Etat accréditaire peut, à tout moment et sans avoir à motiver sa décision, informer l'Etat accréditant que le chef ou tout autre membre du personnel diplomatique de la mission est persona non grata ou que tout autre membre du personnel de la mission n'est pas acceptable. L'Etat accréditant rappellera alors la personne en cause ou mettra fin à ses fonctions auprès de la mission, selon le cas. Une personne peut être déclarée non grata ou non acceptable avant d'arriver sur le territoire de l'Etat accréditaire.

  • 2 Si l'Etat accréditant refuse d'exécuter, ou n'exécute pas dans un délai raisonnable, les obligations qui lui incombent aux termes du paragraphe 1 du présent article, l'Etat accréditaire peut refuser de reconnaître à la personne en cause la qualité de membre de la mission.

Article 10

  • 1 Sont notifiés au Ministère des Affaires étrangères de l'Etat accréditaire ou à tel autre ministère dont il aura été convenu:

    • a) la nomination des membres de la mission, leur arrivée et leur départ définitif ou la cessation de leurs fonctions dans la mission;

    • b) l'arrivée et le départ définitif d'une personne appartenant à la famille d'un membre de la mission, et, s'il y a lieu, le fait qu'une personne devient ou cesse d'être membre de la famille d'un membre de la mission;

    • c) l'arrivée et le départ définitif de domestiques privés au service des personnes visées à l'alinéa a) ci-dessus, et, s'il y a lieu, le fait qu'ils quittent le service desdites personnes;

    • d) l'engagement et le congédiement de personnes résidant dans l'Etat accréditaire, en tant que membres de la mission ou en tant que domestiques privés ayant droit aux privilèges et immunités.

  • 2 Toutes les fois qu'il est possible, l'arrivée et le départ définitif doivent également faire l'objet d'une notification préalable.

Article 11

  • 1 A défaut d'accord explicite sur l'effectif de la mission, l'Etat accréditaire peut exiger que cet effectif soit maintenu dans les limites de ce qu'il considère comme raisonnable et normal, eu égard aux circonstances et conditions qui règnent dans cet Etat et aux besoins de la mission en cause.

  • 2 L'Etat accréditaire peut également, dans les mêmes limites et sans discrimination, refuser d'admettre des fonctionnaires d'une certaine catégorie.

Article 12

L'Etat accréditant ne doit pas, sans avoir obtenu au préalable le consentement exprès de l'Etat accréditaire, établir des bureaux faisant partie de la mission dans d'autres localités que celles où la mission elle-même est établie.

Article 13

  • 1 Le chef de la mission est réputé avoir assumé ses fonctions dans l'Etat accréditaire dès qu'il a présenté ses lettres de créance ou dès qu'il a notifié son arrivée et qu'une copie figurée de ses lettres de créance a été présentée au Ministère des Affaires étrangères de l'Etat accréditaire, ou à tel autre ministère dont il aura été convenu, selon la pratique en vigueur dans l'Etat accréditaire, qui doit être appliquée d'une manière uniforme.

  • 2 L'ordre de présentation des lettres de créance ou d'une copie figurée de ces lettres est déterminé par la date et l'heure d'arrivée du chef de la mission.

Article 14

  • 1 Les chefs de mission sont répartis en trois classes, à savoir:

    • a) celle des ambassadeurs ou nonces accrédités auprès des chefs d'Etat et des autres chefs de mission ayant un rang équivalent;

    • b) celle des envoyés, ministres ou internonces accrédités auprès des chefs d'Etat;

    • c) celle des chargés d'affaires accrédités auprès des Ministres des Affaires étrangères.

  • 2 Sauf en ce qui touche la préséance et l'étiquette, aucune différence n'est faite entre les chefs de mission en raison de leur classe.

Article 15

Les Etats conviennent de la classe à laquelle doivent appartenir les chefs de leurs missions.

Article 16

  • 1 Les chefs de mission prennent rang dans chaque classe suivant la date et l'heure à laquelle ils ont assumé leurs fonctions conformément à l'article 13.

  • 2 Les modifications apportées aux lettres de créance d'un chef de mission qui n'impliquent pas de changements de classe n'affectent pas son rang de préséance.

  • 3 Le présent article n'affecte pas les usages qui sont ou seraient acceptés par l'Etat accréditaire en ce qui concerne la préséance du représentant du Saint-Siège.

Article 17

L'ordre de préséance des membres du personnel diplomatique de la mission est notifié par le chef de mission au Ministère des Affaires étrangères ou à tel autre ministère dont il aura été convenu.

Article 18

Dans chaque Etat, la procédure à suivre pour la réception des chefs de mission doit être uniforme à l'égard de chaque classe.

Article 19

  • 1 Si le poste de chef de la mission est vacant, ou si le chef de la mission est empêché d'exercer ses fonctions, un chargé d'affaires ad interim agit à titre provisoire comme chef de la mission. Le nom du chargé d'affaires ad interim sera notifié soit par le chef de la mission, soit, au cas où celui-ci est empêché de le faire, par le Ministère des Affaires étrangères de l'Etat accréditant, au Ministère des Affaires étrangères de l'Etat accréditaire ou à tel autre ministère dont il aura été convenu.

  • 2 Au cas où aucun membre du personnel diplomatique de la mission n'est présent dans l'Etat accréditaire, un membre du personnel administratif et technique peut, avec le consentement de l'Etat accréditaire, être désigné par l'Etat accréditant pour gérer les affaires administratives courantes de la mission.

Article 20

La mission et son chef ont le droit de placer le drapeau et l'emblème de l'Etat accréditant sur les locaux de la mission, y compris la résidence du chef de la mission, et sur les moyens de transport de celui-ci.

Article 21

  • 1 L'Etat accréditaire doit, soit faciliter l'acquisition sur son territoire, dans le cadre de sa législation, par l'Etat accréditant des locaux nécessaires à sa mission, soit aider l'Etat accréditant à se procurer des locaux d'une autre manière.

  • 2 Il doit également, s'il en est besoin, aider les missions à obtenir des logements convenables pour leurs membres.

Article 22

  • 1 Les locaux de la mission sont inviolables. Il n'est pas permis aux agents de l'Etat accréditaire d'y pénétrer, sauf avec le consentement du chef de la mission.

  • 2 L'Etat accréditaire a l'obligation spéciale de prendre toutes mesures appropriées afin d'empêcher que les locaux de la mission ne soient envahis ou endommagés, la paix de la mission troublée ou sa dignité amoindrie.

  • 3 Les locaux de la mission, leur ameublement et les autres objets qui s'y trouvent, ainsi que les moyens de transport de la mission, ne peuvent faire l'objet d'aucune perquisition, réquisition, saisie ou mesure d'exécution.

Article 23

  • 1 L'Etat accréditant et le chef de la mission sont exempts de tous impôts et taxes nationaux, régionaux ou communaux, au titre des locaux de la mission dont ils sont propriétaires ou locataires, pourvu qu'il ne s'agisse pas d'impôts ou taxes perçus en rémunération de services particuliers rendus.

  • 2 L'exemption fiscale prévue dans le présent article ne s'applique pas à ces impôts et taxes lorsque, d'après la législation de l'Etat accréditaire, ils sont à la charge de la personne qui traite avec l'Etat accréditant ou avec le chef de la mission.

Article 24

Les archives et documents de la mission sont inviolables à tout moment et en quelque lieu qu'ils se trouvent.

Article 25

L'Etat accréditaire accorde toutes facilités pour l'accomplissement des fonctions de la mission.

Article 26

Sous réserve de ses lois et règlements relatifs aux zones dont l'accès est interdit ou réglementé pour des raisons de sécurité nationale, l'Etat accréditaire assure à tous les membres de la mission la liberté de déplacement et de circulation sur son territoire.

Article 27

  • 1 L'Etat accréditaire permet et protège la libre communication de la mission pour toutes fins officielles. En communiquant avec le gouvernement ainsi qu'avec les autres missions et consulats de l'Etat accréditant, où qu'ils se trouvent, la mission peut employer tous les moyens de communication appropriés, y compris les courriers diplomatiques et les messages en code ou en chiffre. Toutefois, la mission ne peut installer et utiliser un poste émetteur de radio qu'avec l'assentiment de l'Etat accréditaire.

  • 2 La correspondance officielle de la mission est inviolable. L'expression „correspondance officielle” s'entend de toute la correspondance relative à la mission et à ses fonctions.

  • 3 La valise diplomatique ne doit être ni ouverte ni retenue.

  • 4 Les colis constituant la valise diplomatique doivent porter des marques extérieures visibles de leur caractère et ne peuvent contenir que des documents diplomatiques ou des objets à usage officiel.

  • 5 Le courrier diplomatique, qui doit être porteur d'un document officiel attestant sa qualité et précisant le nombre de colis constituant la valise diplomatique, est, dans l'exercice de ses fonctions, protégé par l'Etat accréditaire. Il jouit de l'inviolabilité de sa personne et ne peut être soumis à aucune forme d'arrestation ou de détention.

  • 6 L'Etat accréditant, ou la mission, peut nommer des courriers diplomatiques ad hoc. Dans ce cas, les dispositions du paragraphe 5 du présent article seront également applicables, sous réserve que les immunités qui y sont mentionnées cesseront de s'appliquer dès que le courrier aura remis au destinataire la valise diplomatique dont il a la charge.

  • 7 La valise diplomatique peut être confiée au commandant d'un aéronef commercial qui doit atterrir à un point d'entrée autorisé. Ce commandant doit être porteur d'un document officiel indiquant le nombre de colis constituant la valise, mais il n'est pas considéré comme un courrier diplomatique. La mission peut envoyer un de ses membres prendre, directement et librement, possession de la valise diplomatique des mains du commandant de l'aéronef.

Article 28

Les droits et redevances perçus par la mission pour des actes officiels sont exempts de tous impôts et taxes.

Article 29

La personne de l'agent diplomatique est inviolable. Il ne peut être soumis à aucune forme d'arrestation ou de détention. L'Etat accréditaire le traite avec le respect qui lui est dû, et prend toutes mesures appropriées pour empêcher toute atteinte à sa personne, sa liberté et sa dignité.

Article 30

  • 1 La demeure privée de l'agent diplomatique jouit de la même inviolabilité et de la même protection que les locaux de la mission.

  • 2 Ses documents, sa correspondance et, sous réserve du paragraphe 3 de l'article 31, ses biens jouissent également de l'inviolabilité.

Article 31

  • 1 L'agent diplomatique jouit de l'immunité de la juridiction pénale de l'Etat accréditaire. Il jouit également de l'immunité de sa juridiction civile et administrative, sauf s'il s'agit:

    • a) d'une action réelle concernant un immeuble privé situé sur le territoire de l'Etat accréditaire, à moins que l'agent diplomatique ne le possède pour le compte de l'Etat accréditant aux fins de la mission;

    • b) d'une action concernant une succession, dans laquelle l'agent diplomatique figure comme exécuteur testamentaire, administrateur, héritier ou légataire, à titre privé et non pas au nom de l'Etat accréditant;

    • c) d'une action concernant une activité professionnelle ou commerciale, quelle qu'elle soit, exercée par l'agent diplomatique dans l'Etat accréditaire en dehors de ses fonctions officielles.

  • 2 L'agent diplomatique n'est pas obligé de donner son témoignage.

  • 3 Aucune mesure d'exécution ne peut être prise à l'égard de l'agent diplomatique, sauf dans les cas prévus aux alinéas a), b) et c) du paragraphe 1 du présent article, et pourvu que l'exécution puisse se faire sans qu'il soit porté atteinte à l'inviolabilité de sa personne ou de sa demeure.

  • 4 L'immunité de juridiction d'un agent diplomatique dans l'Etat accréditaire ne saurait exempter cet agent de la juridiction de l'Etat accréditant.

Article 32

  • 1 L'Etat accréditant peut renoncer à l'immunité de juridiction des agents diplomatiques et des personnes qui bénéficient de l'immunité en vertu de l'article 37.

  • 2 La renonciation doit toujours être expresse.

  • 3 Si un agent diplomatique ou une personne bénéficiant de l'immunité de juridiction en vertu de l'article 37 engage une procédure, il n'est plus recevable à invoquer l'immunité de juridiction à l'égard de toute demande reconventionnelle directement liée à la demande principale.

  • 4 La renonciation à l'immunité de juridiction pour une action civile ou administrative n'est pas censée impliquer la renonciation à l'immunité quant aux mesures d'exécution du jugement, pour lesquelles une renonciation distincte est nécessaire.

Article 33

  • 1 Sous réserve des dispositions du paragraphe 3 du présent article, l'agent diplomatique est, pour ce qui est des services rendus à l'Etat accréditant, exempté des dispositions de sécurité sociale qui peuvent être en vigueur dans l'Etat accréditaire.

  • 2 L'exemption prévue au paragraphe 1 du présent article s'applique également aux domestiques privés qui sont au service exclusif de l'agent diplomatique, à condition

    • a) qu'ils ne soient pas ressortissants de l'Etat accréditaire ou n'y aient pas leur résidence permanente; et

    • b) qu'ils soient soumis aux dispositions de sécurité sociale qui peuvent être en vigueur dans l'Etat accréditant ou dans un Etat tiers.

  • 3 L'agent diplomatique qui a à son service des personnes auxquelles l'exemption prévue au paragraphe 2 du présent article ne s'applique pas doit observer les obligations que les dispositions de sécurité sociale de l'Etat accréditaire imposent à l'employeur.

  • 4 L'exemption prévue aux paragraphes 1 et 2 du présent article n'exclut pas la participation volontaire au régime de sécurité sociale de l'Etat accréditaire pour autant qu'elle est admise par cet Etat.

  • 5 Les dispositions du présent article n'affectent pas les accords bilatéraux ou multilatéraux relatifs à la sécurité sociale qui ont été conclus antérieurement et elles n'empêchent pas la conclusion ultérieure de tels accords.

Article 34

L'agent diplomatique est exempt de tous impôts et taxes, personnels ou réels, nationaux, régionaux ou communaux à l'exception;

  • a) des impôts indirects d'une nature telle qu'ils sont normalement incorporés dans le prix des marchandises ou des services;

  • b) des impôts et taxes sur les biens immeubles privés situés sur le territoire de l'Etat accréditaire, à moins que l'agent diplomatique ne les possède pour le compte de l'Etat accréditant, aux fins de la mission;

  • c) des droits de succession perçus par l'Etat accréditaire, sous réserve des dispositions du paragraphe 4 de l'article 39;

  • d) des impôts et taxes sur les revenus privés qui ont leur source dans l'Etat accréditaire et des impôts sur le capital prélevés sur les investissements effectués dans des entreprises commerciales situées dans l'Etat accréditaire;

  • e) des impôts et taxes perçus en rémunération de services particuliers rendus;

  • f) des droits d'enregistrement, de greffe, d'hypothèque et de timbre en ce qui concerne les biens immobiliers, sous réserve des dispositions de l'article 23.

Article 35

L'Etat accréditaire doit exempter les agents diplomatiques de toute prestation personnelle, de tout service public de quelque nature qu'il soit et des charges militaires telles que les réquisitions, contributions et logements militaires.

Article 36

  • 1 Suivant les dispositions législatives et réglementaires qu'il peut adopter, l'Etat accréditaire accorde l'entrée et l'exemption de droits de douane, taxes et autres redevances connexes autres que frais d'entreposage, de transport et frais afférents à des services analogues sur:

    • a) les objets destinés à l'usage officiel de la mission;

    • b) les objets destinés à l'usage personnel de l'agent diplomatique ou des membres de sa famille qui font partie de son ménage, y compris les effets destinés à son installation.

  • 2 L'agent diplomatique est exempté de l'inspection de son bagage personnel, a moins qu'il n'existe des motifs sérieux de croire qu'il contient des objets ne bénéficiant pas des exemptions mentionnées au paragraphe I du présent article, ou des objets dont l'importation ou l'exportation est interdite par la législation ou soumise aux règlements de quarantaine de l'Etat accréditaire. En pareil cas, l'inspection ne doit se faire qu'en présence de l'agent diplomatique ou de son représentant autorisé.

Article 37

  • 1 Les membres de la famille de l'agent diplomatique qui font partie de son ménage bénéficient des privilèges et immunités mentionnés dans les articles 29 à 36, pourvu qu'ils ne soient pas ressortissants de l'Etat accréditaire.

  • 2 Les membres du personnel administratif et technique de la mission, ainsi que les membres de leurs familles qui font partie de leurs ménages respectifs, bénéficient, pourvu qu'ils ne soient pas ressortissants de l'Etat accréditaire ou n'y aient pas leur résidence permanente, des privilèges et immunités mentionnés dans les articles 29 à 35, sauf que l'immunité de la juridiction civile et administrative de l'Etat accréditaire mentionnée au paragraphe 1 de l'article 31 ne s'applique pas aux actes accomplis en dehors de l'exercice de leurs fonctions. Ils bénéficient aussi des privilèges mentionnés au paragraphe 1 de l'article 36 pour ce qui est des objets importés lors de leur première installation.

  • 3 Les membres du personnel de service de la mission qui ne sont pas ressortissants de l'Etat accréditaire ou n'y ont pas leur résidence permanente bénéficient de l'immunité pour les actes accomplis dans l'exercice de leurs fonctions, et de l'exemption des impôts et taxes sur les salaires qu'ils reçoivent du fait de leurs services, ainsi que de l'exemption prévue à l'article 33.

  • 4 Les domestiques privés des membres de la mission qui ne sont pas ressortissants de l'Etat accréditaire ou n'y ont pas leur résidence permanente sont exemptés des impôts et taxes sur les salaires qu'ils reçoivent du fait de leurs services. A tous autres égards, ils ne bénéficient des privilèges et immunités que dans la mesure admise par l'Etat accréditaire. Toutefois, l'Etat accréditaire doit exercer sa juridiction sur ces personnes de façon à ne pas entraver d'une manière excessive l'accomplissement des fonctions de la mission.

Article 38

  • 1 A moins que des privilèges et immunités supplémentaires n'aient été accordés par l'Etat accréditaire, l'agent diplomatique qui a la nationalité de l'Etat accréditaire ou y a sa résidence permanente ne bénéficie de l'immunité de juridiction et de l'inviolabilité que pour les actes officiels accomplis dans l'exercice de ses fonctions.

  • 2 Les autres membres du personnel de la mission et les domestiques privés qui sont ressortissants de l'Etat accréditaire ou qui y ont leur résidence permanente ne bénéficient des privilèges et immunités que dans la mesure où cet Etat les leur reconnaît. Toutefois, l'Etat accréditaire doit exercer sa juridiction sur ces personnes de façon à ne pas entraver d'une manière excessive l'accomplissement des fonctions de la mission.

Article 39

  • 1 Tonte personne ayant droit aux privilèges et immunités en bénéficie dès qu'elle pénètre sur le territoire de l'Etat accréditaire pour gagner son poste ou, si elle se trouve déjà sur ce territoire, dès que sa nomination a été notifiée au Ministère des Affaires étrangères ou à tel autre ministère dont il aura été convenu.

  • 2 Lorsque les fonctions d'une personne bénéficiant des privilèges et immunités prennent fin, ces privilèges et immunités cessent normalement au moment où cette personne quitte le pays, ou à l'expiration d'un délai raisonnable qui lui aura été accordé à cette fin, mais ils subsistent jusqu'à ce moment, même en cas de conflit armé. Toutefois, l'immunité subsiste en ce qui concerne les actes accomplis par cette personne dans l'exercice de ses fonctions comme membre de la mission.

  • 3 En cas de décès d'un membre de la mission, les membres de sa famille continuent de jouir des privilèges et immunités dont ils bénéficient, jusqu'à l'expiration d'un délai raisonnable leur permettant de quitter le territoire de l'Etat accréditaire.

  • 4 En cas de décès d'un membre de la mission qui n'est pas ressortissant de l'Etat accréditaire ou n'y a pas sa résidence permanente ou d'un membre de sa famille qui fait partie de son ménage, l'Etat accréditaire permet le retrait des biens meubles du défunt, à l'exception de ceux qui auront été acquis dans le pays et qui font l'objet d'une prohibition d'exportation au moment de son décès. Il ne sera pas prélevé de droits de succession sur les biens meubles dont la présence dans l'Etat accréditaire était due uniquement à la présence dans cet Etat du défunt en tant que membre de la mission ou membre de la famille d'un membre de la mission.

Article 40

  • 1 Si l'agent diplomatique traverse le territoire ou se trouve sur le territoire d'un Etat tiers, qui lui a accordé un visa de passeport au cas où ce visa est requis, pour aller assumer ses fonctions ou rejoindre son poste, ou pour rentrer dans son pays, l'Etat tiers lui accordera l'inviolabilité et toutes autres immunités nécessaires pour permettre son passage ou son retour. Il fera de même pour les membres de sa famille bénéficiant des privilèges et immunités qui accompagnent l'agent diplomatique ou qui voyagent séparément pour le rejoindre ou pour rentrer dans leur pays.

  • 2 Dans des conditions similaires à celles qui sont prévues au paragraphe 1 du présent article, les Etats tiers ne doivent pas entraver le passage sur leur territoire des membres du personnel administratif et technique ou de service de la mission et des membres de leur famille.

  • 3 Les Etats tiers accordent à la correspondance et aux autres communications officielles en transit, y compris les messages en code ou en chiffre, la même liberté et protection que l'Etat accréditaire. Ils accordent aux courriers diplomatiques, auxquels un visa de passeport a été accordé si ce visa était requis, et aux valises diplomatiques en transit la même inviolabilité et la même protection que l'Etat accréditaire est tenu de leur accorder.

  • 4 Les obligations des Etats tiers en vertu des paragraphes 1, 2 et 3 du présent article s'appliquent également aux personnes respectivement mentionnées dans ces paragraphes, ainsi qu'aux communications officielles et aux valises diplomatiques lorsque leur présence sur le territoire de l'Etat tiers est due à la force majeure.

Article 41

  • 1 Sans préjudice de leurs privilèges et immunités, toutes les personnes qui bénéficient de ces privilèges et immunités ont le devoir de respecter les lois et règlements de l'Etat accréditaire. Elles ont également le devoir de ne pas s'immiscer dans les affaires intérieures de cet Etat.

  • 2 Toutes les affaires officielles traitées avec l'Etat accréditaire, confiées à la mission par l'Etat accréditant, doivent être traitées avec le Ministère des Affaires étrangères de l'Etat accréditaire ou par son intermédiaire, ou avec tel autre ministère dont il aura été convenu.

  • 3 Les locaux de la mission ne seront pas utilisés d'une manière incompatible avec les fonctions de la mission telles qu'elles sont énoncées dans la présente Convention, ou dans d'autres règles du droit international général, ou dans les accords particuliers en vigueur entre l'Etat accréditant et l'Etat accréditaire.

Article 42

L'agent diplomatique n'exercera pas dans l'Etat accréditaire une activité professionelle ou commerciale en vue d'un gain personnel.

Article 43

Les fonctions d'un agent diplomatique prennent fin notamment:

  • a) par la notification de l'Etat accréditant à l'Etat accréditaire que les fonctions de l'agent diplomatique ont pris fin;

  • b) par la notification de l'Etat accréditaire à l'Etat accréditant que, conformément au paragraphe 2 de l'article 9, cet Etat refuse de reconnaître l'agent diplomatique comme membre de la mission.

Article 44

L'Etat accréditaire doit, même en cas de conflit armé, accorder des facilités pour permettre aux personnes bénéficiant des privilèges et immunités, autres que les ressortissants de l'Etat accréditaire, ainsi qu'aux membres de la famille de ces personnes, quelle que soit leur nationalité, de quitter son territoire dans les meilleurs délais. Il doit en particulier, si besoin est, mettre à leur disposition les moyens de transports nécessaires pour eux-mêmes et pour leurs biens.

Article 45

En cas de rupture des relations diplomatiques entre deux Etats, ou si une mission est rappelée définitivement ou temporairement:

  • a) l'Etat accréditaire est tenu, même en cas de conflit armé, de respecter et de protéger les locaux de la mission, ainsi que ses biens et ses archives;

  • b) l'Etat accréditant peut confier la garde des locaux de la mission, avec les biens qui s'y trouvent, ainsi que les archives, à un Etat tiers acceptable pour l'Etat accréditaire;

  • c) l'Etat accréditant peut confier la protection de ses intérêts et de ceux de ses ressortissants à un Etat tiers acceptable pour l'Etat accréditaire.

Article 46

Avec le consentement préalable de l'Etat accréditaire, et sur demande d'un Etat tiers non représenté dans cet Etat, l'Etat accréditant peut assumer la protection temporaire des intérêts de l'Etat tiers et de ses ressortissants.

Article 47

  • 1 En appliquant les dispositions de la présente Convention, l'Etat accréditaire ne fera pas de discrimination entre les Etats.

  • 2 Toutefois, ne seront pas considérés comme discriminatoires:

    • a) le fait pour l'Etat accréditaire d'appliquer restrictivement l'une des dispositions de la présente Convention parce qu'elle est ainsi appliquée à sa mission dans l'Etat accréditant;

    • b) le fait pour des Etats de se faire mutuellement bénéficier, par coutume ou par voie d'accord, d'un traitement plus favorable que ne le requièrent les dispositions de la présente Convention.

Article 48

La présente Convention sera ouverte à la signature de tous les Etats Membres de l'Organisation des Nations Unies ou d'une institution spécialisée, ainsi que de tout Etat partie au Statut de la Cour internationale de Justice et de tout autre Etat invité par l'Assemblée générale de l'Organisation des Nations Unies à devenupartie à la Convention, de la manière suivante: jusqu'au 31 octobre 1961, au Ministère fédéral des Affaires étrangères d'Autriche et ensuite, jusqu'au 31 mars 1962, au Siège de l'Organisation des Nations Unies à New York.

Article 49

La présente Convention sera ratifiée. Les instruments de ratification seront déposés auprès du Secrétaire général de l'Organisation des Nations Unies.

Article 50

La présente Convention restera ouverte à l'adhésion de tout Etat appartenant à Tune des quatre catégories mentionnées à l'article 48. Les instruments d'adhésion seront déposés auprès du Secrétaire général de l'Organisation des Nations Unies.

Article 51

  • 1 La présente Convention entrera en vigueur le trentième jour qui suivra la date du dépôt auprès du Secrétaire général de l'Organisation des Nations Unies du vingt-deuxième instrument de ratification ou d'adhésion.

  • 2 Pour chacun des Etats qui ratifieront la Convention ou y adhéreront après le dépôt du vingt-deuxième instrument de ratification ou d'adhésion, la Convention entrera en vigueur le trentième jour après le dépôt par cet Etat de son instrument de ratification ou d'adhésion.

Article 52

Le Secrétaire général de l'Organisation des Nations Unies notifiera à tous les Etats appartenant à l'une des quatre catégories mentionnées à l'article 48:

  • a) les signatures apposées à la présente Convention et le dépôt des instruments de ratification ou d'adhésion, conformément aux articles 48, 49 et 50;

  • b) la date à laquelle la présente Convention entrera en vigueur, conformément à l'article 51.

Article 53

L'original de la présente Convention, dont les textes anglais, chinois, espagnol, français et russe font également foi, sera déposé auprès du Secrétaire général de l'Organisation des Nations Unies, qui en fera tenir copie certifiée conforme à tous les Etats appartenant à l'une des quatre catégories mentionnées à l'article 48.

EN FOI DE QUOI les plénipotentiaires soussignés, dûment autorisés par leurs gouvernements respectifs, ont signé la présente Convention.

De Staten die Partij zijn bij dit Verdrag,

In herinnering brengend dat de volkeren van alle landen sedert vele eeuwen de rechtspositie van diplomatieke vertegenwoordigers erkennen,

Indachtig de doelstellingen en beginselen van het Handvest der Verenigde Naties betreffende de soevereine gelijkheid der staten, de handhaving van internationale vrede en veiligheid, alsmede de bevordering van vriendschappelijke betrekkingen tussen de volkeren,

In de overtuiging dat een internationaal verdrag inzake diplomatiek verkeer en diplomatieke voorrechten en immuniteiten een bijdrage zou betekenen tot de ontwikkeling van vriendschappelijke betrekkingen tussen de volkeren, ongeacht de verschillen in hun grondwettelijke en maatschappelijke stelsels,

Beseffend dat het doel van deze voorrechten en immuniteiten niet is personen te bevoorrechten, doch te verzekeren dat diplomatieke zendingen als vertegenwoordigers der staten doelmatig functioneren,

Bevestigend dat de regels van het internationale gewoonterecht van toepassing dienen te blijven op aangelegenheden die door de bepalingen van dit Verdrag niet uitdrukkelijk worden geregeld,

Zijn overeengekomen als volgt:

Artikel 1

In dit Verdrag hebben de navolgende uitdrukkingen de hieronder aangegeven betekenissen:

  • (a) het „hoofd van de zending”, de persoon die door de zendstaat is aangewezen om in die hoedanigheid op te treden;

  • (b) de „leden van de zending”, het hoofd van de zending en de personeelsleden van de zending;

  • (c) de „personeelsleden van de zending”, leden van het diplomatieke personeel of van het administratieve en technische personeel en van het bedienend personeel van de zending;

  • (d) de „leden van het diplomatieke personeel”, de leden van het personeel van de zending die een diplomatieke rang bezitten;

  • (e) een „diplomatiek ambtenaar”, het hoofd van de zending of een lid van het diplomatieke personeel van de zending;

  • (f) de „leden van het administratieve en technische personeel”, de leden van het personeel van de zending die werkzaam zijn bij de administratieve en technische dienst van de zending;

  • (g) de „leden van het bedienend personeel”, de leden van het personeel van de zending die werkzaam zijn bij de huishoudelijke dienst van de zending;

  • (h) een „particuliere bediende”, een persoon die in de huishoudelijke dienst van een lid van het personeel van de zending is en niet in dienst is van de zendstaat;

  • (i) de „gebouwen van de zending”, de gebouwen of delen van gebouwen en de daarbij behorende terreinen, ongeacht wie daarvan de eigenaar is, die gebruikt worden voor de werkzaamheden van de zending, daarbij inbegrepen de ambtswoning van het hoofd van de zending.

Artikel 2

Het aanknopen van diplomatieke betrekkingen tussen de staten, alsmede de vestiging van diplomatieke zendingen, geschiedt met wederzijds goedvinden.

Artikel 3

  • 1 De functies van een diplomatieke zending omvatten o.a.:

    • (a) het vertegenwoordigen van de zendstaat in de ontvangende staat;

    • (b) het behartigen van de belangen van de zendstaat en van zijn onderdanen, binnen de door het volkenrecht toegestane grenzen in de ontvangende staat;

    • (c) het onderhandelen met de regering van de ontvangende staat;

    • (d) het met alle wettige middelen nagaan van de toestanden en ontwikkelingen in de ontvangende staat en het uitbrengen van verslag daarvan aan de regering van de zendstaat;

    • (e) het bevorderen van vriendschappelijke betrekkingen tussen de zendstaat en de ontvangende staat en het tot ontwikkeling brengen van hun economische, culturele en wetenschappelijke betrekkingen.

  • 2 Niets in dit Verdrag mag zodanig worden uitgelegd dat het de uitoefening van consulaire functies door een diplomatieke zending verhindert.

Artikel 4

  • 1 De zendstaat dient er zich van te overtuigen dat de ontvangende staat agrément heeft verleend ten aanzien van de persoon die de zendstaat voornemens is als hoofd van de zending van die staat te accrediteren.

  • 2 De ontvangende staat is niet verplicht om de zendstaat de redenen van een weigering van het agrément mede te delen.

Artikel 5

  • 1 De zendstaat kan, nadat hij de betrokken ontvangende staten daarvan op behoorlijke wijze mededeling heeft gedaan, een hoofd van een zending bij meer dan een staat accrediteren of een lid van het diplomatieke personeel bij meer dan een staat aanmelden, tenzij een der ontvangende staten hiertegen uitdrukkelijk bezwaar maakt.

  • 2 Indien de zendstaat een hoofd van een zending bij een of meer andere staten accrediteert kan deze staat in elke staat waar het hoofd van de zending niet zijn permanente zetel heeft een diplomatieke zending vestigen met een tijdelijk zaakgelastigde aan het hoofd.

  • 3 Een hoofd van een zending of elk lid van het diplomatieke personeel van de zending kan optreden als vertegenwoordiger van de zendstaat bij internationale organisaties.

Artikel 6

Twee of meer staten kunnen dezelfde persoon als hoofd van een zending bij een andere staat accrediteren, tenzij de ontvangende staat hiertegen bezwaar maakt.

Artikel 7

Met inachtneming van de bepalingen van de artikelen 5, 8, 9 en 11 is de zendstaat vrij in het aanstellen van de personeelsleden van de zending. Bij de aanstelling van militaire, marine- of luchtmachtattachés kan de ontvangende staat eisen dat hun naam van tevoren ter goedkeuring wordt medegedeeld.

Artikel 8

  • 1 De leden van het diplomatieke personeel van de zending dienen in beginsel de nationaliteit van de zendstaat te bezitten.

  • 2 Als leden van het diplomatieke personeel van de zending mogen niet worden benoemd personen die de nationaliteit van de ontvangende staat bezitten, behalve met toestemming van die staat, welke toestemming te allen tijde kan worden ingetrokken.

  • 3 De ontvangende staat kan zich hetzelfde recht voorbehouden ten aanzien van onderdanen van een derde staat die niet tevens onderdanen van de zendstaat zijn.

Artikel 9

  • 1 De ontvangende staat kan te allen tijde en zonder dat hij zijn beslissing behoeft te motiveren, de zendstaat ervan verwittigen dat het hoofd van de zending of een lid van het diplomatieke personeel van de zending tot persona non grata is verklaard of dat een ander personeelslid van de zending niet aanvaardbaar is. In dergelijke gevallen roept de zendstaat de betrokken persoon terug of beëindigt zijn werkzaamheden bij de zending. Een persoon kan tot persona non grata, of onaanvaardbaar, worden verklaard voordat hij op het grondgebied van de ontvangende staat is aangekomen.

  • 2 Indien de zendstaat weigert of in gebreke blijft binnen een redelijke termijn aan zijn verplichtingen krachtens lid 1 van dit artikel te voldoen, kan de ontvangende staat weigeren de betrokken persoon als lid van de zending te erkennen.

Artikel 10

  • 1 Aan het ministerie van buitenlandse zaken van de ontvangende staat of een ander overeengekomen ministerie, wordt mededeling gedaan van:

    • (a) de benoeming van leden van de zending, hun aankomst en hun definitief vertrek of de beëindiging van hun werkzaamheden bij de zending;

    • (b) de aankomst en het definitieve vertrek van een persoon die tot het gezin van een lid van de zending behoort en, in daarvoor in aanmerking komende gevallen, het feit dat een persoon gezinslid wordt van een lid van de zending of ophoudt gezinslid te zijn;

    • (c) de aankomst en het definitieve vertrek van particuliere bedienden in dienst van de onder (a) van dit lid bedoelde personen en, in daarvoor in aanmerking komende gevallen, het feit dat zij de dienst van deze personen verlaten;

    • (d) het aannemen en ontslaan van ingezetenen van de ontvangende staat als leden van de zending of als particuliere bedienden die recht hebben op voorrechten en immuniteiten.

  • 2 Indien mogelijk dient tevens van tevoren kennis te worden gegeven van aankomst en definitief vertrek.

Artikel 11

  • 1 Indien er geen bijzondere overeenkomst bestaat ten aanzien van de omvang van de zending, kan de ontvangende staat eisen dat de omvang van de zending wordt gehouden binnen de grenzen die deze staat als redelijk en normaal beschouwt, waarbij de in de ontvangende staat heersende omstandigheden en de behoeften van de betrokken zending in aanmerking worden genomen.

  • 2 De ontvangende staat kan eveneens, binnen soortgelijke grenzen en op niet-discriminatoire grondslag, weigeren ambtenaren van een bepaalde categorie te aanvaarden.

Artikel 12

Zonder voorafgaande en uitdrukkelijke toestemming van de ontvangende staat mag de zendstaat kantoren die deel uitmaken van de zending niet op andere plaatsen vestigen dan waar de zending zelf is gevestigd.

Artikel 13

  • 1 Het hoofd van de zending wordt geacht zijn werkzaamheden in de ontvangende staat te hebben aangevangen wanneer hij zijn geloofsbrieven heeft overhandigd of wanneer hij mededeling heeft gedaan van zijn aankomst en een gewaarmerkt afschrift van zijn geloofsbrieven is aangeboden aan het ministerie van buitenlandse zaken van de ontvangende staat of een ander ter zake overeengekomen ministerie, overeenkomstig het in de ontvangende staat heersende gebruik, dat op eenvormige wijze wordt toegepast.

  • 2 De volgorde van overhandiging der geloofsbrieven of van een gewaarmerkt afschrift daarvan wordt bepaald door de datum en het tijdstip van aankomst van het hoofd van de zending.

Artikel 14

  • 1 De hoofden der zendingen worden in drie klassen verdeeld, n.l.:

    • (a) die van ambassadeur of nuntius, geaccrediteerd bij het staatshoofd, en andere hoofden van zendingen van gelijkwaardige rang;

    • (b) die van gezant of internuntius, geaccrediteerd bij het staatshoofd;

    • (c) die van zaakgelastigde, geaccrediteerd bij de minister van buitenlandse zaken.

  • 2 Behalve wat betreft voorrang en etiquette bestaat er geen onderscheid tussen de hoofden van zendingen wegens hun klasse.

Artikel 16

  • 1 De rangorde van de hoofden van zendingen binnen hun onderscheiden klassen wordt bepaald door de datum en het tijdstip waarop zij hun werkzaamheden overeenkomstig artikel 13 aanvangen.

  • 2 Wijzigingen in de geloofsbrieven van een hoofd van een zending die geen verandering van klasse met zich medebrengen hebben geen invloed op zijn rangorde.

  • 3 Dit artikel heeft geen invloed op een door de ontvangende staat aanvaard gebruik ten aanzien van de voorrang van de vertegenwoordiger van de Heilige Stoel.

Artikel 17

De rangorde van de leden van het diplomatieke personeel van de zending wordt door het hoofd van de zending medegedeeld aan het ministerie van buitenlandse zaken of aan een ander overeengekomen ministerie.

Artikel 18

De in elke staat met betrekking tot de ontvangst van hoofden van zendingen te volgen procedure is ten aanzien van elke klasse eenvormig.

Artikel 19

  • 1 Indien de plaats van hoofd der zending open staat of indien het hoofd der zending niet in staat is zijn functie uit te oefenen, treedt een tijdelijk zaakgelastigde op als voorlopig hoofd van de zending. De naam van de tijdelijk zaakgelastigde wordt, hetzij door het hoofd van de zending, hetzij, indien deze daartoe niet in staat is, door het ministerie van buitenlandse zaken van de zendstaat medegedeeld aan het ministerie van buitenlandse zaken van de ontvangende staat of een ander overeengekomen ministerie.

  • 2 In gevallen waarin in de ontvangende staat geen lid van het diplomatieke personeel van de zending aanwezig is kan de zendstaat, met toestemming van de ontvangende staat, een lid van het administratieve en technische personeel belasten met de waarneming van de dagelijkse administratieve zaken van de zending.

Artikel 20

De zending en het hoofd der zending hebben het recht de vlag en het embleem van de zendstaat te voeren op het terrein van de zending, waaronder begrepen de ambtswoning van het hoofd der zending en zijn vervoermiddelen.

Artikel 21

  • 1 De ontvangende staat is de zendstaat behulpzaam bij het op zijn grondgebied, in overeenstemming met zijn wettelijke voorschriften, verwerven van gebouwen voor de zending, of helpt de zendstaat op andere wijze bij het verkrijgen van woon- en kantoorruimte.

  • 2 De ontvangende staat is, in voorkomende gevallen, de zendingen eveneens behulpzaam bij het verkrijgen van geschikte woonruimte voor de personeelsleden der zendingen.

Artikel 22

  • 1 De gebouwen van de zending zijn onschendbaar. Vertegenwoordigers van de ontvangende staat mogen deze alleen betreden met toestemming van het hoofd van de zending

  • 2 Op de ontvangende staat rust de bijzondere verplichting alle geëigende maatregelen te nemen om de gebouwen van de zending tegen indringers en tegen het toebrengen van schade te beschermen en te verhinderen dat de rust van de zending op enigerlei wijze wordt verstoord of aan haar waardigheid afbreuk wordt gedaan.

  • 3 De gebouwen van de zending, het meubilair en andere daar aanwezige voorwerpen, alsmede de vervoermiddelen van de zending, zijn gevrijwaard tegen onderzoek, vordering, beslaglegging of executoriale maatregelen.

Artikel 23

  • 1 De zendstaat en het hoofd van de zending zijn vrijgesteld van alle landelijke, gewestelijke of gemeentelijke belastingen en rechten ten aanzien van de gebouwen van die zending, ongeacht of deze eigendom zijn of zijn gehuurd, met uitzondering van belastingen en rechten die gelden als betaling voor bepaalde verleende diensten.

  • 2 De in dit artikel bedoelde vrijstelling is niet van toepassing op belastingen en rechten die krachtens de wetgeving van de ontvangende staat moeten worden betaald door personen die met de zendstaat of het hoofd van de zending verbintenissen aangaan of hebben.

Artikel 24

Het archief en de documenten van de zending zijn te allen tijde en waar deze zich ook mogen bevinden onschendbaar.

Artikel 25

De ontvangende staat verleent de zending alle faciliteiten ten behoeve van de uitoefening van haar werkzaamheden.

Artikel 26

Met inachtneming van de wetten en regelingen van de ontvangende staat betreffende gebieden waartoe de toegang om redenen van nationale veiligheid verboden of aan beperkingen onderhevig is, draagt de ontvangende staat er zorg voor dat alle leden van de zending zich vrijelijk op zijn grondgebied kunnen bewegen en er vrijelijk kunnen reizen.

Artikel 27

  • 1 Door de ontvangende staat wordt aan de zending toegestaan voor alle officiële doeleinden onbelemmerd verbindingen te onderhouden; deze verbindingen worden door de ontvangende staat beschermd. Teneinde zich met de regering en met andere zendingen en consulaire posten — waar deze zich ook mogen bevinden — van de zendstaat in verbinding te stellen, mag de zending alle daarvoor in aanmerking komende middelen gebruiken, diplomatieke koeriers en codeberichten daarbij inbegrepen. De zending mag evenwel geen radiozender installeren en gebruiken zonder toestemming van de ontvangende staat.

  • 2 De officiële briefwisseling van de zending is onschendbaar. Onder officiële briefwisseling wordt verstaan alle op de zending en haar werkzaamheden betrekking hebbende briefwisseling.

  • 3 De diplomatieke tas mag niet worden geopend of vastgehouden.

  • 4 De pakketten welke de diplomatieke tas vormen moeten aan de buitenkant duidelijk zichtbare kentekenen dragen, waaruit hun aard blijkt en mogen slechts diplomatieke documenten of voor officieel gebruik bestemde goederen bevatten.

  • 5 De diplomatieke koerier, die dient te worden voorzien van een officieel document waaruit zijn status en het aantal pakketten welke de diplomatieke tas vormen blijkt, wordt door de ontvangende staat bij de uitoefening van zijn functie beschermd. Hij geniet persoonlijke onschendbaarheid en is gevrijwaard tegen enigerlei vorm van aanhouding of vrijheidsbeneming.

  • 6 De zendstaat of de zending kan diplomatieke koeriers ad hoc aanwijzen. In deze gevallen zijn de bepalingen van lid 5 van dit artikel eveneens van toepassing, met dien verstande dat de daarin bedoelde immuniteiten niet meer van toepassing zijn wanneer deze koerier de zich onder zijn hoede bevindende diplomatieke tas aan de geadresseerde heeft afgeleverd.

  • 7 Een diplomatieke tas kan worden toevertrouwd aan de gezagvoerder van een burgerluchtvaartuig dat volgens de dienstregeling landt op een officieel erkende landingsplaats. Hij dient te worden voorzien van een officieel document waaruit het aantal pakketten welke de diplomatieke tas vormen blijkt, doch hij wordt niet als diplomatiek koerier beschouwd. De zending kan één van haar leden zenden om de diplomatieke tas rechtstreeks en zonder verdere formaliteiten uit handen van de gezagvoerder van het luchtvaartuig in ontvangst te nemen.

Artikel 28

De door de zending in de uitoefening van haar officiële werkzaamheden geheven leges en heffingen zijn vrijgesteld van alle belastingen en rechten.

Artikel 29

De persoon van de diplomatieke ambtenaar is onschendbaar. Hij is gevrijwaard tegen enigerlei vorm van aanhouding of vrijheidsbeneming. De ontvangende staat behandelt hem met al de eerbied die hem verschuldigd is en neemt alle geëigende maatregelen om te verhinderen dat zijn persoon, vrijheid of waardigheid in gevaar wordt gebracht.

Artikel 30

  • 1 De particuliere woning van de diplomatieke ambtenaar geniet dezelfde onschendbaarheid en bescherming als de gebouwen van de zending.

  • 2 Zijn papieren, briefwisseling en, met uitzondering van de in lid 3 van artikel 31 voorziene gevallen, zijn goederen, genieten eveneens onschendbaarheid.

Artikel 31

  • 1 De diplomatieke ambtenaar geniet immuniteit ten aanzien van de rechtsmacht in strafzaken van de ontvangende staat. Hij geniet eveneens immuniteit ten aanzien van de burger- en administratiefrechtelijke rechtsmacht van die staat, met uitzondering van de volgende gevallen:

    • (a) een zakelijke actie betreffende particulier onroerend goed dat gelegen is op het grondgebied van de ontvangende staat, tenzij hij dit onroerend goed onder zich heeft ten behoeve van de zendstaat voor de werkzaamheden van de zending;

    • (b) een geding betreffende erfopvolging waarin de diplomatieke ambtenaar als particulier en niet ten behoeve van de zendstaat betrokken is als uitvoerder van een uiterste wilsbeschikking, bewindvoerder, erfgenaam of legataris;

    • (c) een geding betreffende een door de diplomatieke ambtenaar in de ontvangende staat buiten zijn officiële werkzaamheden om verrichte beroeps- of bedrijfsbezigheden.

  • 2 Een diplomatieke ambtenaar is niet verplicht om als getuige op te treden.

  • 3 Ten aanzien van een diplomatieke ambtenaar mogen alleen in de onder (a), (b) en (c) van lid 1 van dit artikel bedoelde gevallen executoriale maatregelen worden genomen en alleen dan indien de desbetreffende maatregelen kunnen worden genomen zonder inbreuk te maken op de onschendbaarheid van zijn persoon of zijn woning.

  • 4 De immuniteit van een diplomatieke ambtenaar ten aanzien van de rechtsmacht van de ontvangende staat verleent hem geen immuniteit ten aanzien van die rechtsmacht van de zendstaat.

Artikel 32

  • 1 Van de immuniteit van rechtsmacht van diplomatieke ambtenaren en van personen die immuniteit genieten krachtens artikel 37 kan door de zendstaat afstand worden gedaan.

  • 2 Het afstand doen van immuniteit dient altijd uitdrukkelijk kenbaar te worden gemaakt.

  • 3 Indien een diplomatieke ambtenaar of een persoon die krachtens artikel 37 immuniteit van rechtsmacht geniet een rechtsgeding aanvangt kan hij zich ten aanzien van een eis in reconventie die rechtstreeks verband houdt met de eis in conventie niet beroepen op immuniteit van rechtsmacht.

  • 4 Het afstand doen van immuniteit van rechtsmacht ten aanzien van burger- of administratiefrechtelijke procedures wordt niet geacht in te houden het afstand doen van immuniteit ten aanzien van de tenuitvoerlegging van het vonnis; hiervoor is een afzonderlijk afstand doen van immuniteit noodzakelijk.

Artikel 33

  • 1 Met inachtneming van de bepalingen van lid 3 van dit artikel is een diplomatieke ambtenaar ten aanzien van voor de zendstaat verrichte diensten vrijgesteld van de eventueel in de ontvangende staat van kracht zijnde voorschriften op het terrein van de sociale verzekering.

  • 2 De in lid 1 van dit artikel bedoelde vrijstelling geldt ook voor particuliere bedienden die uitsluitend in dienst zijn van een diplomatieke ambtenaar, op voorwaarde:

    • (a) dat zij geen onderdaan zijn van, of duurzaam verblijf houden in, de ontvangende staat; en

    • (b) dat op hen de voorschriften op het terrein van de sociale verzekering van toepassing zijn, die in de zendstaat of in een derde staat van kracht zijn.

  • 3 Een diplomatieke ambtenaar die personen in dienst heeft waarop de in lid 2 van dit artikel bedoelde vrijstelling niet van toepassing is, dient de verplichtingen in acht te nemen, die de voorschriften op het terrein van de sociale verzekering van de ontvangende staat aan werkgevers opleggen.

  • 4 De in de leden 1 en 2 van dit artikel bedoelde vrijstelling sluit vrijwillige deelneming aan het stelsel van sociale verzekering van de ontvangende staat niet uit, mits deze staat deze deelneming toestaat.

  • 5 De bepalingen van dit artikel hebben geen invloed op reeds eerder gesloten bilaterale of multilaterale overeenkomsten inzake sociale verzekering en staan het sluiten van dergelijke overeenkomsten in de toekomst niet in de weg.

Artikel 34

Een diplomatieke ambtenaar is vrijgesteld van alle belastingen en rechten, zowel persoonlijke als zakelijke, hetzij landelijke, gewestelijke of gemeentelijke belastingen, met uitzondering van:

  • (a) indirecte belastingen die normaal in de prijs van goederen of diensten begrepen zijn;

  • (b) belastingen en rechten op particulier onroerend goed dat gelegen is op het grondgebied van de ontvangende staat tenzij hij dit onroerend goed onder zich heeft ten behoeve van de zendstaat voor de werkzaamheden van de zending;

  • (c) door de ontvangende staat met inachtneming van de bepalingen van lid 4 van artikel 39 geheven successierechten en rechten van overgang;

  • (d) belastingen en rechten op particulier inkomen welks bron is gelegen in de ontvangende staat en vermogensbelastingen op in bedrijven in de ontvangende staat belegd vermogen;

  • (e) heffingen wegens bepaalde verleende diensten;

  • (f) registratie-, griffie- en hypotheekrechten en zegelrecht met betrekking tot onroerend goed, met inachtneming van de bepalingen van artikel 23.

Artikel 35

De ontvangende staat stelt diplomatieke vertegenwoordigers vrij van elk persoonlijk dienstbetoon, van elk openbaar dienstbetoon van welke aard dan ook, en van militaire verplichtingen verband houdende met vordering, militaire bijdragen en inkwartiering.

Artikel 36

  • 1 De ontvangende staat laat de binnenkomst toe van:

    • (a) goederen voor het officiële gebruik van de zending,

    • (b) goederen voor het persoonlijke gebruik van een diplomatieke ambtenaar of van zijn inwonende gezinsleden, met inbegrip van artikelen bestemd voor zijn inrichting,

    en verleent vrijstelling van alle douanerechten, belastingen en daarmee verband houdende heffingen, met uitzondering van heffingen voor opslag, vervoer en dergelijke diensten, ten aanzien van die goederen, een en ander in overeenstemming met eventueel door deze staat aan te nemen wetten en regelingen.

  • 2 De persoonlijke bagage van een diplomatieke ambtenaar is vrijgesteld van onderzoek, tenzij er ernstige redenen zijn om te veronderstellen dat zij goederen bevat, die niet vallen onder de in lid 1 van dit artikel bedoelde vrijstellingen of goederen waarvan de in- of uitvoer verboden is door de wet of onderworpen is aan quarantainebepalingen van de ontvangende staat.

    Onderzoek mag slechts plaats vinden in aanwezigheid van de diplomatieke ambtenaar of van een persoon die gemachtigd is hem te vertegenwoordigen.

Artikel 37

  • 1 De inwonende gezinsleden van een diplomatieke ambtenaar genieten, indien zij geen onderdaan zijn van de ontvangende staat, de in de artikelen 29 t/m 36 omschreven voorrechten en immuniteiten.

  • 2 Leden van het administratieve en technische personeel van de zending, alsmede inwonende gezinsleden, genieten, indien zij geen onderdaan zijn van, of niet duurzaam verblijf houden in, de ontvangende staat, de in de artikelen 29 t/m 35 omschreven voorrechten en immuniteiten, met dien verstande dat de immuniteit van de burger- en administratiefrechtelijke bevoegdheid van de ontvangende staat omschreven in lid 1 van artikel 31 zich niet uitstrekt tot handelingen die geen ambtshandelingen zijn. Zij genieten voorts de in artikel 36, lid 1, omschreven voorrechten met betrekking tot goederen die worden ingevoerd ten tijde dat zij zich voor het eerst inrichten.

  • 3 Leden van het bedienende personeel van de zending die geen onderdaan zijn van, of niet duurzaam verblijf houden in, de ontvangende staat genieten immuniteit ten aanzien van handelingen verricht in hun dienstbetrekking, vrijstelling van belastingen en rechten op de lonen die zij ontvangen uit hoofde van hun dienstbetrekking, alsmede de in artikel 33 vervatte vrijstelling.

  • 4 Particuliere bedienden van leden van de zending zijn, indien zij geen onderdaan zijn van, of niet duurzaam verblijf houden in, de ontvangende staat, vrijgesteld van belastingen en rechten op de lonen die zij ontvangen uit hoofde van hun dienstbetrekking. In andere opzichten genieten zij slechts voorrechten en immuniteiten voorzover de ontvangende staat dit toestaat. De ontvangende staat moet zijn rechtsmacht over deze personen evenwel uitoefenen op een wijze die de uitoefening van de functies van de zending niet onnodig bemoeilijkt.

Artikel 38

  • 1 Behalve voorzover een ontvangende staat aanvullende voorrechten en immuniteiten verleent, geniet een diplomatieke ambtenaar die onderdaan is van, of duurzaam verblijf houdt in, die staat slechts immuniteit van rechtsmacht en onschendbaarheid ten aanzien van officiële handelingen verricht in de uitoefening van zijn functie.

  • 2 Andere personeelsleden van de zending en particuliere bedienden die onderdaan zijn van, of duurzaam verblijf houden in, de ontvangende staat genieten slechts voorrechten en immuniteiten voorzover deze door de ontvangende staat zijn toegestaan. De ontvangende staat moet zijn rechtsmacht over deze personen evenwel uitoefenen op een wijze die de uitoefening van de functies van de zending niet onnodig bemoeilijkt.

Artikel 39

  • 1 Een ieder die recht heeft op voorrechten en immuniteiten geniet deze vanaf het ogenblik waarop hij het grondgebied van de ontvangende staat betreedt om zijn functie te aanvaarden, of, indien hij zich reeds op het grondgebied van die staat bevindt, vanaf het ogenblik waarop kennisgeving van zijn aanstelling wordt gedaan aan het ministerie van buitenlandse zaken of aan een ander overeengekomen ministerie.

  • 2 Wanneer de taak van een persoon die voorrechten en immuniteiten geniet is beëindigd, houden deze voorrechten en immuniteiten als regel op te bestaan op het ogenblik waarop hij het land verlaat, of na het verstrijken van een redelijke termijn om het land te verlaten, doch zij blijven tot aan dat tijdstip van kracht, zelfs in geval van een gewapend conflict. Met betrekking tot door zulk een persoon in de uitoefening van zijn functie als lid van de zending verrichte handelingen blijft de immuniteit evenwel van kracht.

  • 3 Indien een lid van de zending overlijdt, blijven zijn gezinsleden de voorrechten en immuniteiten genieten waarop zij recht hebben, tot aan het verstrijken van een redelijke termijn om het land te verlaten.

  • 4 Indien een lid van de zending die geen onderdaan is van, of niet duurzaam verblijf houdt in, de ontvangende staat of een inwonend gezinslid overlijdt staat de ontvangende staat toe dat de roerende goederen van de overledene uit het land worden gevoerd, met uitzondering van in dat land verworven goederen waarvan de uitvoer op het tijdstip van zijn overlijden verboden is. Successierechten worden niet geheven op roerende goederen waarvan de aanwezigheid in de ontvangende staat uitsluitend het gevolg was van de aanwezigheid aldaar van de overledene als lid van de zending of als gezinslid van een lid van de zending.

Artikel 40

  • 1 Indien een diplomatieke ambtenaar op doorreis is door, of zich bevindt op, het grondgebied van een derde staat, die hem een visum heeft verleend indien zulk een visum vereist was, terwijl hij op weg is om zijn werkzaamheden op zijn post te aanvaarden of om naar zijn post terug te keren, of wanneer hij naar zijn eigen land terugkeert, verleent de derde staat hem onschendbaarheid en alle overige immuniteiten die noodzakelijk zijn voor zijn doorreis of terugkeer. Hetzelfde geldt voor leden van zijn gezin die voorrechten en immuniteiten genieten en die de (diplomatieke ambtenaar vergezellen of afzonderlijk reizen om zich bij hem te voegen of naar hun land terug te keren.

  • 2 In omstandigheden die van dezelfde aard zijn als die omschreven in lid 1 van dit artikel, belemmeren derde staten niet de doorreis door hun grondgebied van leden van het administratieve en technische of het bedienende personeel van een zending, en van hun gezinsleden.

  • 3 Derde staten verlenen aan officiële briefwisseling en aan andere officiële berichten die via hun grondgebied worden geleid, waaronder begrepen codeberichten, dezelfde vrijheid en bescherming als door de ontvangende staat worden verleend. Zij verlenen de diplomatieke koeriers aan wie een visum is verleend indien zulk een visum vereist was, en diplomatieke tassen die via hun grondgebied worden geleid, dezelfde onschendbaarheid en bescherming als de ontvangende staat moet verlenen.

  • 4 De verplichtingen van derde staten krachtens de leden 1, 2 en 3 van dit artikel zijn ook van toepassing op de in deze leden onderscheidenlijk genoemde personen, alsmede op officiële berichten en diplomatieke tassen waarvan de aanwezigheid op het grondgebied van de derde staat aan overmacht te wijten is.

Artikel 41

  • 1 Ongeacht hun voorrechten en immuniteiten is het die plicht van alle personen die deze voorrechten en immuniteiten genieten de wetten en regelingen van de ontvangende staat te eerbiedigen. Zij hebben ook de plicht zich niet in te laten met de binnenlandse aangelegenheden van die staat.

  • 2 Al het officiële verkeer dat de zending in opdracht van de zendstaat met de ontvangende staat heeft, vindt plaats met of door tussenkomst van het ministerie van buitenlandse zaken van de ontvangende staat of een ander ter zake overeengekomen ministerie.

  • 3 De gebouwen van de zending mogen niet worden gebruikt op een wijze die onverenigbaar is met de functies van de zending als omschreven in dit Verdrag of door andere regelen van algemeen internationaal recht of door bijzondere overeenkomsten die tussen de zendstaat en de ontvangende staat van kracht zijn.

Artikel 42

Een diplomatieke ambtenaar mag in de ontvangende staat geen beroeps- of bedrijfsbezigheid uitoefenen gericht op persoonlijk gewin.

Artikel 43

De taak van een diplomatieke ambtenaar wordt onder meer beëindigd:

  • (a) wanneer de zendstaat de ontvangende staat mededeelt dat de taak van de diplomatieke ambtenaar geëindigd is;

  • (b) wanneer de ontvangende staat de zendstaat mededeelt dat hij, overeenkomstig lid 2 van artikel 9, weigert de diplomatieke ambtenaar als lid van de zending te erkennen.

Artikel 44

De ontvangende staat moet, zelfs in het geval van een gewapend conflict, faciliteiten verlenen teneinde personen die voorrechten en immuniteiten genieten en die geen onderdaan zijn van de ontvangende staat, alsmede de gezinsleden van die personen, ongeacht hun nationaliteit, in staat te stellen binnen de kortst mogelijke tijd te vertrekken. Met name moet de ontvangende staat hun, in geval van nood, de nodige vervoermiddelen voor henzelf zowel als voor hun goederen ter beschikking stellen.

Artikel 45

Indien de diplomatieke betrekkingen tussen twee staten worden verbroken of indien een zending voorgoed of tijdelijk wordt teruggeroepen:

  • (a) dient de ontvangende staat, zelfs in het geval van een gewapend conflict, de gebouwen van de zending, alsmede de zich aldaar bevindende goederen en archieven, te eerbiedigen en te beschermen;

  • (b) kan de zendstaat de zorg voor de gebouwen van de zending, alsmede voor de zich aldaar bevindende goederen en archieven, toevertrouwen aan een derde staat die voor de ontvangende staat aanvaardbaar is;

  • (c) kan de zendstaat de behartiging van zijn belangen en van die van zijn onderdanen toevertrouwen aan een derde staat die voor de ontvangende staat aanvaardbaar is.

Artikel 46

Een zendstaat mag met de voorafgaande toestemming van een ontvangende staat en op verzoek van een derde staat die in de ontvangende staat niet vertegenwoordigd is, de tijdelijke behartiging van de belangen van die derde staat en van diens onderdanen op zich nemen.

Artikel 47

  • 1 Bij de toepassing van de bepalingen van dit Verdrag maakt de ontvangende staat geen onderscheid tussen de staten.

  • 2 Onderscheid wordt evenwel niet geacht te zijn gemaakt:

    • (a) indien de ontvangende staat enigerlei bepaling van dit Verdrag op beperkte wijze toepast omdat die bepaling op zijn zending in de zendstaat beperkt wordt toegepast;

    • (b) indien krachtens gewoonterecht of overeenkomst de staten elkaar een gunstiger behandeling toekennen dan bij dit Verdrag is voorgeschreven.

Artikel 48

Dit Verdrag staat open ter ondertekening door alle staten die lid zijn van de Verenigde Naties of van een der gespecialiseerde organisaties, dan wel partij zijn bij het Statuut van het Internationale Gerechtshof, alsmede door elke andere staat die door de Algemene Vergadering van de Verenigde Naties wordt uitgenodigd partij bij dit Verdrag te worden Tot 31 oktober 1961 staat dit Verdrag ter ondertekening open bij het Bondsministerie van Buitenlandse Zaken van Oostenrijk en na die datum, tot 31 maart 1962, bij de Verenigde Naties te New York.

Artikel 49

Dit Verdrag dient te worden bekrachtigd. De akten van bekrachtiging worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.

Artikel 50

Dit Verdrag blijft open voor toetreding door elke staat die tot een van de vier in artikel 48 bedoelde categorieën behoort. De akten van toetreding worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.

Artikel 51

  • 1 Dit Verdrag treedt in werking op de dertigste dag na de datum van nederlegging van de tweeëntwintigste akte van bekrachtiging of toetreding bij de Secretaris-Generaal van de Verenigde Naties.

  • 2 Ten aanzien van elke staat die dit Verdrag bekrachtigt of ertoe toetreedt na nederlegging van de tweeëntwintigste akte van bekrachtiging of toetreding, treedt het Verdrag in werking op de dertigste dag na de datum waarop die staat zijn akte van bekrachtiging of toetreding heeft nedergelegd.

Artikel 52

De Secretaris-Generaal van de Verenigde Naties doet alle staten die tot een van de vier in artikel 48 bedoelde categorieën behoren, mededeling van:

  • (a) de ondertekeningen van dit Verdrag en van de nederlegging van akten van bekrachtiging of toetreding overeenkomstig de artikelen 48, 49 en 50;

  • (b) de datum waarop dit Verdrag overeenkomstig artikel 51 in werking zal treden.

Artikel 53

Het origineel van dit Verdrag, waarvan de Chinese, Engelse, Franse, Russische en Spaanse teksten gelijkelijk authentiek zijn, wordt nedergelegd bij de Secretaris-Generaal van de Verenigde Naties, die voor eensluidend gewaarmerkte afschriften ervan doet toekomen aan alle staten die behoren tot een van de vier in artikel 48 bedoelde categorieën.

TEN BLIJKE WAARVAN de ondergetekende gevolmachtigden, daartoe behoorlijk gemachtigd door hun onderscheiden Regeringen, dit Verdrag hebben ondertekend.
