Authentiek : EN

Joint Protocol relating to the application of the Vienna Convention and the Paris Convention

The Contracting Parties

Gezamenlijk Protocol betreffende de toepassing van het Verdrag van Wenen en het Verdrag van Parijs

De Verdragsluitende Partijen,

Gelet op het Verdrag van Wenen inzake wettelijke aansprakelijkheid voor kernschade van 21 mei 1963;

Gelet op het Verdrag van Parijs inzake wettelijke aansprakelijkheid op het gebied van de kernenergie van 29 juli 1960, zoals gewijzigd bij het Aanvullend Protocol van 28 januari 1964 en het Protocol van 16 november 1982;

Overwegende dat het Verdrag van Wenen en het Verdrag van Parijs in hoofdzaak gelijk zijn en dat geen enkele Staat thans Partij is bij beide Verdragen;

Ervan overtuigd dat toetreding tot één van de Verdragen door Partijen bij het andere Verdrag zou kunnen leiden tot moeilijkheden ten gevolge van de gelijktijdige toepassing van beide Verdragen op een kernongeval;

Geleid door de wens een verbinding tussen het Verdrag van Wenen en het Verdrag van Parijs tot stand te brengen door het voordeel van het bijzondere stelsel van wettelijke aansprakelijkheid voor kernschade dat door elk Verdrag wordt geregeld wederzijds uit te breiden en conflicten voortvloeiende uit de gelijktijdige toepassing van beide Verdragen op een kernongeval te vermijden;

Zijn als volgt overeengekomen:

  • (b) is de exploitant van een kerninstallatie gelegen op het grondgebied van een Partij bij het Verdrag van Parijs overeenkomstig dat Verdrag aansprakelijk voor kernschade geleden op het grondgebied van een Partij bij zowel het Verdrag van Wenen als bij dit Protocol.
