Agreement between the Kingdom of the Netherlands and the Republic of Finland on mutual assistance in customs matters

The Governments of the Kingdom of the Netherlands and the Republic of Finland,

Considering that offences against customs laws are prejudicial to the economic and fiscal interests of their respective countries as well as to the legitimate interests of trade, industry and agriculture;

Convinced that prevention of offences against customs laws and efforts to ensure accurate collection of customs duties and other taxes and charges on importation or exportation can be rendered more effective through co-operation between their customs authorities;

Having regard to the existing international instruments governing the provision of mutual assistance in customs matters;

Have agreed as follows:

DEFINITIONS

Article 1

For the purposes of this Agreement:

  • (a) the term "State" means one of the Contracting States;

  • (b) the term "customs laws" means provisions laid down by law or regulation concerning the importation, exportation and transit of goods, whether relating to customs duties, taxes or any other charges, or to measures of prohibition, restriction or control;

  • (c) the term "customs authorities" means the central administration of a State which is responsible for the implementation of customs laws; The States shall supply each other with all relevant information on this subject.

SCOPE

Article 2

The States shall, through their customs authorities and in accordance with the provisions of this Agreement, afford each other mutual assistance with a view to:

  • (a) ensuring proper application of customs laws; and

  • (b) preventing, investigating and combating contraventions of customs laws.

EXCHANGE OF INFORMATION

Article 3

  • 1 The customs authorities shall, upon request, supply to each other any information which may help to ensure proper collection of customs duties and other taxes and charges upon importation or exportation, and, in particular information which may help to determine the value of goods for customs purposes, their tariff classification and origin.

  • 2 If the authority so requested does not have the information asked for, it shall initiate inquiries in accordance with the provisions which by law or regulation apply in its country to the collection of customs duties, taxes and other import and export charges.

  • 3 In initiating these inquiries the requested authority shall proceed as though it were acting on its own account or at the request of another authority in its own country.

Article 4

The customs authorities shall, upon request, furnish each other with information necessary to ensure that:

  • (a) goods imported into one State have been lawfully exported from the other State;

  • (b) goods exported from one State have been lawfully imported into the other State;

  • (c) goods which are granted favourable treatment upon exportation from one State have been duly imported into the other State, it being understood that information shall also be provided on any customs control measures to which the goods have been subjected.

Article 5

  • 1 The customs authorities shall, spontaneously or on request, provide each other with any information concerning contraventions of the customs laws, in particular, information regarding:

    • (a) new means and methods which are used or suspected to be used in committing offences against customs laws;

    • (b) goods known to be or suspected of being smuggled;

    • (c) vehicles, ships, aircraft or other means of transport which have been or are suspected of having been used in committing offences against customs laws or which are suspected of being used to commit such offences.

  • 2 The customs authorities of one State shall, on their own initiative or upon request, supply to the customs authorities of the other State, reports, records of evidence or certified copies of documents giving all available information on transactions, detected or planned, which constitute or appear to constitute a contravention of the customs laws of that State.

SURVEILLANCE OF PERSONS, GOODS AND MEANS OF TRANSPORT

Article 6

Within the limits of their regional competence and to the extent of their powers and ability, the customs authorities of one State shall, at their own initiative or at the request of the customs authorities of the other State, maintain surveillance over:

  • (a) the movements, particularly the entry into and exit from their territory, of persons who have or are suspected of having committed offences against customs laws of the other State or who are suspected of committing such offences;

  • (b) vehicles, ships, aircraft and other means of transport which have been or are suspected of having been used for committing offences against customs laws of the other State or which are suspected of being used to commit such offences;

  • (c) movements of goods which are reported by the customs authorities of the other State as giving rise to substantial illicit traffic to their territory;

  • (d) places where unusual stocks of goods have been built up, giving reason to assume that they are to be used for illicit importation into the territory of the other State.

INVESTIGATIONS

Article 7

  • 1 At the request of the customs authorities of one State, the customs authorities of the other State shall initiate official investigations into any acts which are or may be assumed to be in contravention of customs laws of the requesting State. The customs authorities of the requested State shall communicate the results of the investigation to the customs authorities of the requesting State.

  • 2 These inquiries shall be conducted under the laws and regulations of the State which has been requested to make them; the requested authority shall proceed as though it were acting on its own account or at the request of another authority in its own country.

Article 8

The officials of the customs authorities of one State, authorised to investigate contraventions of customs laws may, in particular cases, with the agreement of the authorised officials of the customs authorities of the other State, be present in the territory of that State when those officials are investigating contraventions which are of concern to the authorities first mentioned.

Article 9

While in the territory of one State as provided for in this Agreement, the customs authorities of the other State shall, whenever requested to do so, furnish proof of their official capacity. They shall enjoy the same legal protection as applies to the customs authorities of the State in the territory of which they are present. With respect to legal consequences for offences committed against them or which they might commit, they shall be treated in a manner similar to that applied to the customs authorities of the State in the territory of which they are present.

USE OF INFORMATION AND DOCUMENTS

Article 10

  • 1 The information and documents received under this Agreement shall not be used for purposes other than those specified in this Agreement. They may be made available to persons other than those who require them for the purposes of this Agreement only with the consent of the customs authorities who furnished them and provided that this is not contrary to any legal provisions binding upon the customs authorities who have received such information or documents.

  • 2 The requests, information, reports of experts and other communications received by one State shall be accorded the same legal protection and they shall be subjected to the same official secrecy as apply in that State to the same kind of information and documents.

Article 11

  • 1 The customs authorities may, in accordance with the purpose of this Agreement and within the scope thereof, use information and documents received under this Agreement as evidence in their records, reports or statements as well as in judicial or administrative proceedings.

  • 2 The use of such information and documents shall be as laid down in the national legislation of the State having received them.

EXCEPTIONS FROM THE OBLIGATION TO PROVIDE ASSISTANCE

Article 12

  • 1 If the requested customs authorities consider that the assistance sought would infringe upon the public order or other essential interests of the requested State, or would involve violation of an industrial, commercial or professional secret in that State, they may refuse to provide such assistance, provide it partly or provide it subject to certain conditions or requirements.

  • 2 If a request for assistance cannot be complied with, the State which has asked for assistance shall be notified without delay and shall also be informed of the reasons for the refusal to provide assistance.

  • 3 The obligation to provide assistance shall not cover the provision of information or documents obtained by the customs authorities under powers exercised by them at the request of the judicial authority. However, where assistance is requested, such information or documents shall be provided in all cases where the judicial authority, which must be consulted to that effect, gives its consent.

Article 13

If the customs authorities of one State request assistance which they themselves would be unable to give if requested to do so by the other State, they shall draw attention to that fact in their request. Compliance with such a request shall be within the discretion of the requested customs authorities.

NOTIFICATION OF ADMINISTRATIVE MEASURES AND DECISIONS

Article 14

At the request of the customs authorities of one State, the customs authorities of the other State shall, in accordance with the laws and regulations in force in their territory, notify the parties concerned, either directly or through the competent authority, of all measures and decisions taken by the administrative authorities in application of customs laws.

COSTS AND EXPENSES

Article 15

Excepting expenses incurred in use of expert services, the requesting State shall not be held responsible for any costs incurred in the execution of this Agreement.

EXCHANGE OF ASSISTANCE

Article 16

  • 1 Assistance provided under this Agreement shall be exchanged directly between the customs authorities of the States. Those authorities shall mutually agree on the detailed arrangements for implementation.

  • 2 The customs authorities of the States may arrange for their investigation services to be in direct communication with each other.

FIELD OF APPLICATION

Article 17

  • 1 As far as the Republic of Finland is concerned this Agreement shall apply to its territory.

  • 2 As far as the Kingdom of the Netherlands is concerned this Agreement shall apply to its territory in Europe. It may, however, be extended, either in its entirety or with any necessary modifications, to the Netherlands Antilles.

  • 3 Such extension shall take effect from such date and be subject to such modifications and conditions, including conditions as to termination, as may be specified and agreed in notes to be exchanged through diplomatic channels.

ENTRY INTO FORCE AND TERMINATION

Article 18

  • 1 This Agreement shall enter into force 30 days after the States have notified each other in writing that the constitutional requirements for the entry into force of this Agreement have been complied with.

  • 2 This Agreement shall be of unlimited duration but either State may denounce it at any time.

  • 3 The denunciation shall be notified at least six months before the end of a calendar year. The Agreement will then cease to have effect at the end of the said calendar year.

  • 4 Unless otherwise agreed the termination of this Agreement shall not also terminate its application to the Netherlands Antilles if it has been extended thereto in conformity with the provisions of paragraph 2 of Article 17.

IN WITNESS WHEREOF the undersigned, being duly authorized thereto, have signed this Agreement.

De Regering van het Koninkrijk der Nederlanden en de Regering van de Republiek Finland,

Overwegende dat strafbare feiten op het gebied van de douanewetten nadeel toebrengen aan de economische en fiscale belangen van hun onderscheiden landen, alsook aan de rechtmatige belangen van handel, nijverheid en landbouw,

Ervan overtuigd dat het voorkomen van strafbare feiten op het gebied van de douanewetten en het streven naar verzekering van een juiste toepassing van douanerechten en andere belastingen en heffingen op invoer of uitvoer doeltreffender worden als gevolg van samenwerking tussen hun douaneautoriteiten,

Gelet op de bestaande internationale instrumenten die betrekking hebben op het verlenen van wederzijdse bijstand in douanezaken,

Zijn het volgende overeengekomen:

BEGRIPSBEPALINGEN

Artikel 1

Voor de toepassing van deze Overeenkomst wordt verstaan onder:

  • a. „Staat” een van de Overeenkomstsluitende Staten;

  • b. „douanewetten”, de wettelijke bepalingen of voorschriften inzake de in-, uit- en doorvoer van goederen, zowel die welke de douanerechten, belastingen of alle andere heffingen betreffen, als die welke maatregelen inzake verboden, beperkingen of controle betreffen;

  • c. „douaneautoriteiten”, de centrale administratie van een Staat die verantwoordelijk is voor de toepassing van de douanewetten. De Staten verstrekken elkaar daartoe de nodige inlichtingen.

WERKINGSSFEER

Artikel 2

De Staten verlenen elkaar wederzijds bijstand door tussenkomst van hun douaneautoriteiten en onder de in deze Overeenkomst vermelde voorwaarden:

  • a. ter verzekering van een juiste naleving van de douanewetten;

  • b. ter voorkoming, opsporing en bestrijding van strafbare feiten op het gebied van de douanewetten.

UITWISSELING VAN INLICHTINGEN

Artikel 3

  • 1 De douaneautoriteiten verstrekken elkaar op verzoek alle inlichtingen welke ertoe kunnen bijdragen de juiste heffing van de douanerechten en andere belastingen en heffingen bij in- of uitvoer te verzekeren en meer in het bijzonder die inlichtingen welke de vaststelling van de douanewaarde, de tariefsoort en de oorsprong van de goederen kunnen vergemakkelijken.

  • 2 Indien de aangezochte autoriteit niet over de gevraagde inlichtingen beschikt, doet zij onderzoeken instellen overeenkomstig de wettelijke bepalingen en voorschriften die in haar land van toepassing zijn bij de heffing van douanerechten, belastingen en andere heffingen wegens in- of uitvoer.

  • 3 Bij het instellen van deze onderzoeken gaat de aangezochte autoriteit te werk als handelde zij ten eigen behoeve of op verzoek van een andere autoriteit uit eigen land.

Artikel 4

De douaneautoriteiten verstrekken elkaar op verzoek inlichtingen welke nodig zijn om te verzekeren dat:

  • a. goederen die in de ene Staat zijn ingevoerd op wettige wijze uit de andere Staat zijn uitgevoerd;

  • b. goederen die uit de ene Staat zijn uitgevoerd op wettige wijze in de andere Staat zijn ingevoerd;

  • c. goederen waarvoor bij uitvoer uit de ene Staat een gunstige behandeling is toegestaan, op regelmatige wijze in de andere Staat zijn ingevoerd, met dien verstande dat tevens inlichtingen worden verstrekt omtrent de aard van het douaneregime waaraan die goederen zijn onderworpen.

Artikel 5

  • 1 De douaneautoriteiten verstrekken elkaar, uit eigen beweging of op verzoek, alle inlichtingen welke betrekking hebben op strafbare feiten op het gebied van de douanewetten, en wel in het bijzonder inlichtingen met betrekking tot:

    • a. nieuwe middelen en werkwijzen welke worden aangewend, of waarvan vermoed wordt dat zij worden aangewend, om strafbare feiten op het gebied van de douanewetten te begaan;

    • b. goederen waarvan bekend is, of vermoed wordt dat zij worden gesmokkeld;

    • c. voertuigen, schepen, luchtvaartuigen en andere vervoermiddelen die zijn gebruikt, of waarvan vermoed wordt dat zij zijn gebruikt om strafbare feiten op het gebied van de douanewetten te begaan of waarvan vermoed wordt dat zij worden gebruikt om dergelijke strafbare feiten te begaan.

  • 2 De douaneautoriteiten van de ene Staat verstrekken, uit eigen beweging of op verzoek, aan de douaneautoriteiten van de andere Staat, rapporten, processen-verbaal of voor eensluidend gewaarmerkte afschriften van documenten, houdende alle beschikbare inlichtingen met betrekking tot vastgestelde of voorgenomen handelingen die een strafbaar feit op het gebied van de douanewetten van laatstgenoemde Staat opleveren of lijken op te leveren.

TOEZICHT OP PERSONEN, GOEDEREN EN VERVOERMIDDELEN

Artikel 6

De douaneautoriteiten van de ene Staat houden, uit eigen beweging of op verzoek van de douaneautoriteiten van de andere Staat, binnen het gebied waarvoor zij de verantwoordelijkheid dragen, binnen de grenzen van hun bevoegdheden en in de mate van het mogelijke, toezicht op:

  • a. de bewegingen, inzonderheid het betreden en verlaten van hun grondgebied, van personen die strafbare feiten hebben begaan of die ervan worden verdacht strafbare feiten te hebben begaan op het gebied van de douanewetten van de andere Staat, of waarvan wordt vermoed dat zij dergelijke strafbare feiten begaan;

  • b. voertuigen, schepen, luchtvaartuigen en andere vervoermiddelen die zijn gebruikt of waarvan vermoed wordt dat ze zijn gebruikt voor het begaan van strafbare feiten op het gebied van de douanewetten van de andere Staat, of waarvan wordt vermoed dat zij worden gebruikt voor het begaan van dergelijke strafbare feiten;

  • c. verplaatsingen van goederen ten aanzien waarvan door de douaneautoriteiten van de andere Staat is medegedeeld dat zij het voorwerp uitmaken van een omvangrijk ongeoorloofd verkeer naar hun grondgebied;

  • d. plaatsen waar abnormale goederenvoorraden zijn aangelegd, waardoor er aanleiding bestaat aan te nemen dat deze zullen worden gebruikt voor ongeoorloofde invoer in het grondgebied van de andere Staat.

ONDERZOEKEN

Artikel 7

  • 1 Op verzoek van de douaneautoriteiten van de ene Staat gaan de douaneautoriteiten van de andere Staat over tot ambtelijke onderzoeken met betrekking tot alle handelingen die in strijd zijn of in strijd lijken te zijn met de douanewetten van de verzoekende Staat. De douaneautoriteiten van de aangezochte Staat verstrekken de douaneautoriteiten van de verzoekende Staat de resultaten van deze onderzoeken.

  • 2 Deze onderzoeken worden verricht in overeenstemming met de wetten en voorschriften welke in de aangezochte Staat van toepassing zijn. De aangezochte autoriteit gaat daarbij te werk als handelde zij ten eigen behoeve of op verzoek van een andere autoriteit in eigen land.

Artikel 8

De ambtenaren van de douaneautoriteiten van de ene Staat, bevoegd tot opsporing van strafbare feiten op het gebied van de douanewetten, kunnen in bijzondere gevallen, met goedvinden van de bevoegde ambtenaren van de douaneautoriteiten van de andere Staat, op het grondgebied van die Staat aanwezig zijn bij het opsporen door die ambtenaren van strafbare feiten die voor de eerstbedoelde autoriteiten van belang zijn.

Artikel 9

Wanneer de douaneautoriteiten van de ene Staat zich, in de gevallen waarin deze Overeenkomst voorziet, bevinden op het grondgebied van de andere Staat, moeten zij, indien hun daarom verzocht wordt, te allen tijde hun ambtelijke hoedanigheid aantonen. Zij genieten dezelfde wettelijke bescherming als die welke is toegekend aan de douaneautoriteiten van de Staat op wiens grondgebied zij zich bevinden. Met betrekking tot de wettelijke gevolgen van strafbare feiten jegens hen begaan of welke zij zelf mochten begaan, worden zij op gelijke wijze behandeld als de douaneautoriteiten van de Staat op wiens grondgebied zij zich bevinden.

GEBRUIK VAN GEGEVENS EN DOCUMENTEN

Artikel 10

  • 1 De door toepassing van deze Overeenkomst verkregen inlichtingen en documenten mogen niet worden gebruikt voor andere doeleinden dan die waarin deze Overeenkomst voorziet. Zij mogen aan andere personen dan aan hen die belast zijn met het gebruik daarvan voor de doeleinden van deze Overeenkomst alleen worden meegedeeld, indien de douaneautoriteit die ze heeft verstrekt, daartoe toestemming heeft gegeven en voor zover dit niet in strijd is met enige wettelijke bepaling die van toepassing is op de douaneautoriteit die dergelijke inlichtingen en documenten heeft ontvangen.

  • 2 De verzoeken, inlichtingen, rapporten van deskundigen en andere mededelingen welke een Staat heeft ontvangen, genieten dezelfde wettelijke bescherming en vallen onder hetzelfde ambtsgeheim als die waarin in die Staat is voorzien voor gelijksoortige documenten en inlichtingen.

Artikel 11

  • 1 De douaneautoriteiten kunnen, in overeenstemming met de doeleinden en binnen de werkingssfeer van deze Overeenkomst, zowel in hun processen-verbaal, rapporten en getuigenissen als bij administratieve procedures en vervolgingen in rechte, de volgens de bepalingen van deze Overeenkomst verkregen inlichtingen en documenten als bewijsmiddel aanvoeren.

  • 2 Het gebruik van dergelijke inlichtingen en documenten wordt beheerst door het nationale recht van de Staat die ze heeft ontvangen.

UITZONDERINGEN OP DE VERPLICHTING TOT HET VERLENEN VAN BIJSTAND

Artikel 12

  • 1 Als de aangezochte douaneautoriteiten van mening zijn dat de gevraagde bijstand zou leiden tot aantasting van de openbare orde of van andere wezenlijke belangen van de aangezochte Staat, of de schending van een nijverheids-, handels- of beroepsgeheim met zich zou brengen, mogen zij weigeren die bijstand te verlenen, dan wel verlenen zij die bijstand slechts gedeeltelijk of onder zekere voorwaarden of beperkingen.

  • 2 Als aan een verzoek om bijstand niet kan worden voldaan, wordt de Staat die om bijstand heeft verzocht onverwijld daarvan in kennis gesteld en tevens op de hoogte gebracht van de redenen voor de weigering bijstand te verlenen.

  • 3 De verplichting bijstand te verlenen geldt niet voor het verstrekken van inlichtingen of documenten die de douaneautoriteiten hebben verkregen in het kader van bevoegdheden die zij in opdracht van de rechterlijke autoriteit uitoefenen. In geval om bijstand is verzocht, worden deze inlichtingen of documenten echter wel verstrekt in alle gevallen waarin de rechterlijke autoriteit, die hiertoe moet worden geraadpleegd, daarmee instemt.

Artikel 13

Indien de douaneautoriteiten van de ene Staat verzoeken om bijstand die zij zelf, indien zij daarom door de andere Staat mochten worden gevraagd, niet zouden kunnen verlenen, vestigen zij daarop in hun verzoek de aandacht. Het inwilligen van een dergelijk verzoek staat ter beoordeling van de douaneautoriteiten aan wie het verzoek is gedaan.

MEDEDELING VAN ADMINISTRATIEVE MAATREGELEN EN BESLISSINGEN

Artikel 14

Op verzoek van de douaneautoriteiten van de ene Staat reiken de douaneautoriteiten van de andere Staat, met inachtneming van de op hun grondgebied van kracht zijnde wetten en voorschriften, rechtstreeks, dan wel door tussenkomst van de bevoegde autoriteit aan de betrokken partijen alle stukken uit, houdende maatregelen en beslissingen van de administratieve autoriteiten inzake de toepassing van de douanewetten.

KOSTEN

Artikel 15

Met uitzondering van kosten welke verbonden zijn aan het gebruik van de diensten van deskundigen, wordt de verzoekende Staat niet verantwoordelijk gesteld voor enige kosten die voortvloeien uit de toepassing van deze Overeenkomst.

WIJZE VAN BIJSTANDVERLENING

Artikel 16

  • 1 De in deze Overeenkomst voorziene bijstand geschiedt rechtstreeks tussen de douaneautoriteiten van de Staten. Deze autoriteiten stellen in onderling overleg de praktische uitvoering ervan vast.

  • 2 De douaneautoriteiten van de Staten kunnen hun opsporingsdiensten in de gelegenheid stellen onderling rechtstreekse betrekkingen te onderhouden.

TOEPASSINGSGEBIED

Artikel 17

  • 1 Wat de Republiek Finland betreft, is deze Overeenkomst van toepassing op haar grondgebied.

  • 2 Wat het Koninkrijk der Nederlanden betreft, is deze Overeenkomst van toepassing op het grondgebied in Europa. Zij kan echter, hetzij in haar geheel, hetzij met de noodzakelijke wijzigingen, worden uitgebreid tot de Nederlandse Antillen.

  • 3 Zulk een uitbreiding wordt van kracht met ingang van een datum en met inachtneming van wijzigingen en voorwaarden, daaronder begrepen voorwaarden ten aanzien van de beëindiging, nader vast te stellen en overeen te komen bij diplomatieke notawisseling.

INWERKINGTREDING EN BEËINDIGING

Artikel 18

  • 1 Deze Overeenkomst treedt in werking 30 dagen nadat de Staten elkaar schriftelijk ervan in kennis hebben gesteld dat aan de grondwettelijk vereiste formaliteiten voor de inwerkingtreding is voldaan.

  • 2 Deze Overeenkomst wordt voor onbepaalde tijd gesloten, maar elk van de beide Staten kan haar te allen tijde opzeggen.

  • 3 Van de opzegging wordt ten minste zes maanden voor het einde van het kalenderjaar kennisgeving gedaan. De Overeenkomst houdt dan op van kracht te zijn aan het einde van dat kalenderjaar.

  • 4 Tenzij anderszins overeengekomen, wordt door de beëindiging van deze Overeenkomst niet tegelijkertijd de toepassing daarvan op de Nederlandse Antillen beëindigd, indien zij daartoe is uitgebreid overeenkomstig de bepalingen van het tweede lid van artikel 17.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe behoorlijk gemachtigd, deze Overeenkomst hebben ondertekend.
