Overeenkomst tussen het Koninkrijk der Nederlanden en de Europese Octrooiorganisatie betreffende het onderdeel van het Europees Octrooibureau in ’s-Gravenhage, inclusief Afzonderlijke overeenkomst

Het Koninkrijk der Nederlanden

en

De Europese Octrooiorganisatie,

Gelet op het Verdrag inzake de verlening van Europese octrooien van 5 oktober 1973,

Gelet op artikel 25 van het Protocol inzake voorrechten en immuniteiten van de Europese Octrooiorganisatie,

Overwegende dat ingevolge artikel 6 van genoemd Verdrag het Europees Octrooibureau een onderdeel heeft in ’s-Gravenhage,

Zijn overeengekomen als volgt:

Artikel 1. Begripsomschrijvingen

In deze Overeenkomst:

  • a. wordt onder „Verdrag’’ verstaan het Verdrag inzake de verlening van Europese octrooien van 5 oktober 1973;

  • b. wordt onder „Protocol’’ verstaan het Protocol inzake voorrechten en immuniteiten van de Europese Octrooiorganisatie;

  • c. wordt onder „Organisatie’’ verstaan de Europese Octrooiorganisatie;

  • d. wordt onder „Regering’’ verstaan de Regering van het Koninkrijk der Nederlanden;

  • e. wordt onder „Bureau’’ verstaan het Europees Octrooibureau;

  • f. wordt onder „onderdeel’’ verstaan het onderdeel van het Europees Octrooibureau in ’s-Gravenhage (Rijswijk);

  • g. wordt onder „Verdrag van Wenen’’ verstaan het Verdrag van Wenen inzake Diplomatiek Verkeer van 18 april 1961;

  • h. wordt onder „Afzonderlijke overeenkomst’’ verstaan de Afzonderlijke overeenkomst houdende de omschrijving van inwonende gezinsleden van een personeelslid.

Artikel 2. Onschendbaarheid van het archief

De in artikel 2 van het Protocol bedoelde onschendbaarheid geldt voor het gehele archief, de correspondentie, documenten, manuscripten, foto’s, films, geluidsopnamen, computer- en mediagegevens, gegevensdragers en alle overige, soortgelijke materialen die aan de Organisatie toebehoren of die zij onder zich houdt, ongeacht waar deze zich bevinden en bij wie zij berusten, en voor alle daarin vervatte informatie.

Artikel 3. Afstand van immuniteit

In geval van beslaglegging door een derde, ingevolge een beslissing van de administratieve of gerechtelijke autoriteiten, op de salarissen en emolumenten die de Organisatie aan een personeelslid verschuldigd is, doet de Organisatie afstand van de immuniteit die zij ingevolge artikel 3, eerste lid, van het Protocol geniet, tenzij zij de bevoegde autoriteiten binnen veertien dagen na de datum van kennisgeving van de beslissing mededeelt, dat zij geen afstand doet van haar immuniteit.

Artikel 4. Vrijstelling van belasting

  • 1 Voor de toepassing van artikel 4, eerste lid, van het Protocol omvat „directe belastingen’’ alle directe rijksbelastingen en alle directe belastingen, rechten en heffingen opgelegd door een provincie, gemeente of waterschap, zulks onverminderd het bepaalde in het derde lid van genoemd artikel.

  • 2 De Organisatie wordt op verzoek vrijgesteld van motorrijtuigenbelasting voor haar motorrijtuigen die voor officiële doeleinden worden gebruikt.

Artikel 5. Terugbetaling van belastingen en rechten

  • 1 De onderstaande belastingen en rechten worden met name geacht te vallen onder artikel 4, tweede lid, van het Protocol:

    • a. omzetbelasting op aan de Organisatie geleverde goederen of ten behoeve van haar verrichte diensten;

    • b. accijnzen op goederen;

    • c. overdrachtsbelasting, assurantiebelasting en beursbelasting.

  • 2 De in verband met geleverde goederen of verrichte diensten betaalde omzetbelasting wordt op verzoek aan de Organisatie terugbetaald.

    De belasting op minerale oliën zoals huisbrandolie en brandstoffen voor motorrijtuigen die de Organisatie voor officiële doeleinden nodig heeft, wordt op verzoek aan de Organisatie terugbetaald.

    Accijnzen betaald op voor officiële doeleinden geleverde en benodigde goederen worden op verzoek aan de Organisatie terugbetaald.

    De Organisatie dient de verzoeken voor terugbetaling in binnen drie maanden na het kwartaal gedurende hetwelk betaling werd verricht voor geleverde goederen of verrichte diensten en voegt de desbetreffende documenten bij de verzoeken.

    De Organisatie verbindt zich ertoe de verificatie door de bevoegde autoriteiten van de feiten waarop de vrijstelling of terugbetaling van belasting kan worden gebaseerd, te vergemakkelijken.

    Er wordt geen terugbetaling verleend, indien de prijs van de geleverde goederen of de verrichte diensten niet hoger is dan 225 euro per transactie.

Artikel 6. Vervreemding van goederen

  • 1 Door de Organisatie op de voorwaarden vervat in artikel 4, tweede lid, van het Protocol verworven goederen mogen niet worden verkocht, weggegeven, verhuurd of op andere wijze vervreemd, tenzij de bevoegde autoriteiten vooraf daarvan in kennis zijn gesteld en de desbetreffende omzetbelasting is betaald. De te betalen belasting wordt berekend op basis van de alsdan geldende waarde van de goederen.

  • 2 Indien de Organisatie goederen ingevoerd op de voorwaarden vervat in artikel 5 van het Protocol verkoopt, weggeeft, verhuurt of op andere wijze vervreemdt, dient zij de goederen aan te geven ten invoer en de belastingen, rechten en heffingen met betrekking tot zodanige goederen te betalen.

  • 3 De op de aangifte ten invoer aangegeven waarde dient te zijn de waarde van de goederen op de dag van aangifte; het op de datum van aangifte van kracht zijnde tarief is van toepassing.

Artikel 7. Tewerkstellingsvergunning, verblijfsvergunning, verplichte registratie

  • 1 Personeelsleden van het Bureau die hun werkzaamheden in Nederland uitoefenen:

    • a. behoeven geen tewerkstellingsvergunning te hebben;

    • b. behoeven geen verblijfsvergunning te hebben en zijn niet onderworpen aan de bepalingen betreffende de registratie van vreemdelingen, mits zij in het bezit zijn van de identiteitskaart bedoeld in artikel 8; hetzelfde geldt voor hun inwonende gezinsleden;

    • c. zijn niet onderworpen aan de toepassing van de voorschriften met betrekking tot de vermelding van de kerkelijke gezindte in de Nederlandse bevolkingsregisters; hetzelfde geldt voor hun inwonende gezinsleden.

  • 2 Inwonende gezinsleden van een personeelslid van het Bureau zoals omschreven in het eerste lid van de Afzonderlijke overeenkomst behoeven voor de duur van het dienstverband van het personeelslid bij het Bureau geen tewerkstellingsvergunning te hebben.

  • 3 De aan personeelsleden van het Bureau tijdens de periode van hun dienstverband en aan hun inwonende gezinsleden verleende rechten vervallen bij het definitieve vertrek van het personeelslid of bij het verstrijken van een redelijke termijn als bedoeld in artikel 39, tweede en derde lid, van het Verdrag van Wenen, welke termijn wordt geteld vanaf de datum waarop het personeelslid zijn taak beëindigt of het gezinslid niet langer inwonend is.

  • 4 Onverminderd het bepaalde in het derde lid, hebben voormalige personeelsleden van het Bureau en hun inwonende gezinsleden of voormalige inwonende gezinsleden aanspraak op verblijfsrecht in Nederland conform de Nederlandse vreemdelingenwetgeving. Voor de verkrijging van het verblijfsrecht ingevolge de Nederlandse vreemdelingenwetgeving wordt elke periode van legitiem verblijf in Nederland, als geprivilegieerd persoon of ingevolge de vreemdelingenwetgeving, opgebouwd vóór of tijdens het dienstverband van het betrokken personeelslid bij het onderdeel, in aanmerking genomen en meegeteld.

Artikel 8. Identiteitskaarten

  • 1 De Organisatie zal de Regering onverwijld in kennis stellen van:

    • a. de namen van personeelsleden van het Bureau die hun werkzaamheden in Nederland uitoefenen;

    • b. hun aankomst en definitieve vertrek en de data waarop zij hun functie aanvangen en beëindigen;

    • c. de namen en de aankomst en het definitieve vertrek van inwonende gezinsleden van een personeelslid en het feit dat iemand niet langer inwonend is; en

    • d. de namen en de aankomst en het definitieve vertrek van particuliere en huisbedienden van personeelsleden van het Bureau en het feit dat zij uit hun dienstbetrekking bij het personeelslid zijn getreden.

  • 2 De Regering zal aan de volgende personen identiteitskaarten verstrekken:

    • a. de personeelsleden van het Bureau die hun werkzaamheden in Nederland uitoefenen;

    • b. hun inwonende gezinsleden die niet de Nederlandse nationaliteit hebben;

    • c. hun inwonende gezinsleden die de Nederlandse nationaliteit hebben, indien het Bureau aantoont dat zulks in het belang van de Organisatie noodzakelijk is;

    • d. niet de Nederlandse nationaliteit en geen geldige verblijfsvergunning voor onbepaalde tijd bezittende particuliere en huisbedienden van personeelsleden van het Bureau.

  • 3 De door de Regering verstrekte identiteitskaarten vermelden slechts de naam, het geslacht, de geboortedatum en -plaats en de nationaliteit van de houder en zijn voorzien van een pasfoto van de houder. De kaart heeft ten doel de houder voor de Regering en haar autoriteiten te identificeren en dient de status van de houder ingevolge het Protocol en deze Overeenkomst weer te geven.

  • 4 De Organisatie zal de op de identiteitskaart te vermelden persoonsgegevens aan de Regering ter hand stellen. De ontvangende Regeringsinstantie zal de gegevens slechts voor de toepassing van het Protocol en deze Overeenkomst aan andere Regeringsinstanties ter hand stellen. De gegevens zijn onderworpen aan de Nederlandse wetgeving inzake gegevensbescherming.

  • 5 Elektronisch toegankelijke gegevens op de identiteitskaarten zijn beperkt tot de in het derde lid vermelde gegevens. De Regering kan evenwel nadere elektronisch toegankelijke gegevens toevoegen indien zij daartoe om redenen van openbare veiligheid een internationale verplichting heeft, voor zover dit geen afbreuk doet aan rechten ingevolge het Protocol en deze Overeenkomst. De Regering zal de Organisatie zo vroeg mogelijk voorafgaand aan de uitvoering van de beoogde wijzigingen daarvan in kennis stellen.

  • 6 De Organisatie zal de identiteitskaarten van de in het tweede lid genoemde personen onmiddellijk na beëindiging van de tewerkstelling van de betrokken personen terugzenden, met inachtneming van de in artikel 7, derde lid, gestelde redelijke termijn.

Artikel 9. Voorrechten en immuniteiten van de Voorzitter en het hoofd van het onderdeel

  • 1 De Voorzitter van het Bureau geniet bij bezoeken aan Nederland dezelfde voorrechten en immuniteiten als die welke door Nederland worden verleend aan hoofden van diplomatieke vertegenwoordigingen in Nederland overeenkomstig het Verdrag van Wenen.

  • 2 Het hoofd van het onderdeel geniet dezelfde voorrechten en immuniteiten als die welke door Nederland worden verleend aan hoofden van diplomatieke vertegenwoordigingen in Nederland overeenkomstig het Verdrag van Wenen.

  • 3 Dezelfde regelingen gelden voor hun inwonende gezinsleden.

  • 4 Dit artikel doet geen afbreuk aan regelingen in deze Overeenkomst of het Protocol.

  • 5 Dit artikel is niet van toepassing op personen die de Nederlandse nationaliteit bezitten of duurzaam verblijf houden in Nederland.

Artikel 10. Voorrechten en immuniteiten van de personeelsleden van het Bureau

  • 1 Personeelsleden van het Bureau die hun werkzaamheden in Nederland uitoefenen,

    • a. in rang A5 en hoger, of

    • b. in rang A4, mits zij langer dan twee jaar in die rang zijn geweest en een basissalaris niet lager dan A5 periodiek 1 hebben, vanaf 1 januari van het jaar volgend op het jaar waarin aan beide eisen is voldaan

    genieten dezelfde voorrechten en immuniteiten als die welke door Nederland worden verleend aan diplomatieke ambtenaren van de diplomatieke vertegenwoordigingen die in Nederland zijn gevestigd overeenkomstig het Verdrag van Wenen, met dien verstande dat immuniteit ten aanzien van de rechtsmacht in strafzaken en persoonlijke onschendbaarheid zich niet uitstrekken tot handelingen verricht buiten hun officiële taken.

  • 2 Personeelsleden van het Bureau die hun werkzaamheden in Nederland uitoefenen, die geen bedienend personeel zijn en die niet onder het bepaalde in het eerste lid vallen, genieten dezelfde voorrechten en immuniteiten als die welke door Nederland worden verleend aan administratief en technisch personeel van de diplomatieke vertegenwoordigingen die in Nederland zijn gevestigd overeenkomstig het Verdrag van Wenen, met dien verstande dat immuniteit ten aanzien van de rechtsmacht in strafzaken en persoonlijke onschendbaarheid zich niet uitstrekken tot handelingen verricht buiten hun officiële taken.

  • 3 Dezelfde regelingen gelden voor hun inwonende gezinsleden.

  • 4 De vrijstelling van rechtsvordering geldt niet in geval van een door derden ingediende civiele rechtsvordering ter zake van schade die voortvloeit uit een verkeersovertreding.

  • 5 Dit artikel doet geen afbreuk aan regelingen in deze Overeenkomst of het Protocol.

  • 6 Dit artikel is niet van toepassing op personen die de Nederlandse nationaliteit bezitten of duurzaam verblijf houden in Nederland.

Artikel 11. Bedienden

  • 1 Voor de tijdsduur van hun verblijf in Nederland is het personeelsleden van het Bureau die hun werkzaamheden in Nederland uitoefenen toegestaan om huisbedienden of, waar van toepassing, particuliere bedienden in dienst te hebben.

  • 2 De in het eerste lid bedoelde huis- of particuliere bedienden behoeven geen tewerkstellingsvergunning en geen verblijfsvergunning te hebben.

Artikel 12. Progressie

Bij de berekening van de belasting die verschuldigd is over inkomsten uit andere bronnen zal Nederland geen door de Organisatie verrichte betalingen in aanmerking nemen die ingevolge het Protocol zijn vrijgesteld van nationale inkomstenbelasting.

Artikel 13. Rijbewijs

Voor de tijdsduur van hun tewerkstelling is het personeelsleden van het Bureau, hun inwonende gezinsleden en hun huis- of particuliere bedienden toegestaan een Nederlands rijbewijs te verkrijgen onder overlegging van hun geldige buitenlandse rijbewijs dan wel met hun eigen, geldige buitenlandse rijbewijs te blijven rijden, mits de houder in het bezit is van een door de Regering afgegeven identiteitskaart.

Artikel 14. Binnenkomst, verblijf en vertrek

  • 1 De Regering vergemakkelijkt het binnenkomen, het verblijf en het vertrek van de hierna vermelde personen:

    • a. personeelsleden in actieve dienst van het Bureau en hun inwonende gezinsleden;

    • b. huis- en particuliere bedienden van personeelsleden van het Bureau;

    • c. deskundigen;

    • d. andere, door de Organisatie voor officiële doeleinden uitgenodigde personen.

  • 2 Visa of, indien van toepassing, meervoudige inreisvisa die de in het eerste lid bedoelde personen nodig hebben, worden kosteloos en zo spoedig mogelijk afgegeven.

  • 3 Deze regeling laat de mogelijkheid onverlet om te verlangen dat redelijk bewijs wordt geleverd waaruit blijkt dat personen die zich beroepen op de behandeling waarin deze regeling voorziet, tot de in het eerste lid omschreven categorieën behoren.

Artikel 15. Onderdanen en personen die duurzaam verblijf houden

  • 1 Personen van Nederlandse nationaliteit en personen zoals bedoeld in artikel 22, letter (b), van het Protocol die hun werkzaamheden in Nederland uitoefenen, genieten niet de voorrechten en immuniteiten vervat in artikel 12, eerste lid, letters (a), (e) en (f), artikel 13, artikel 14, letters (b), (e) en (g), en artikel 15, letter (c) van het Protocol, en artikel 7, eerste lid, letter (c), van deze Overeenkomst.

  • 2 Personeelsleden van het Bureau die de Nederlandse nationaliteit bezitten of de personeelsleden bedoeld in artikel 22, letter (b), van het Protocol, die hun werkzaamheden in Nederland uitoefenen, wier namen, uit hoofde van hun taak, zijn opgenomen op een door de Organisatie opgestelde en door de Minister van Defensie van het Koninkrijk der Nederlanden goedgekeurde lijst, zijn vrijgesteld van militaire dienstplicht. Ingeval andere personen van Nederlandse nationaliteit en andere personen duurzaam verblijf houden in Nederland, worden opgeroepen voor militaire dienst, verleent de Minister van Defensie van het Koninkrijk der Nederlanden hun op verzoek van de Organisatie zodanig uitstel als vereist is om onderbreking van noodzakelijk werk te vermijden.

Artikel 16. Bureaufaciliteiten

De Regering erkent dat bepaalde diensten, voorzieningen en ondersteuning nodig zijn voor het naar behoren en efficiënte functioneren van het Bureau en zal zich inspannen om het Bureau bij te staan bij het bewerkstelligen en in stand houden van het naar behoren functioneren van de faciliteiten van het Bureau in Nederland.

Artikel 17. Kantoorruimten van het onderdeel

De kantoorruimten van het onderdeel in de zin van artikel 1 van het Protocol omvatten gebouwen, delen van gebouwen en daarbij behorende grond of voorzieningen, daaronder begrepen installaties en voorzieningen die aan de Organisatie in Nederland ter beschikking zijn gesteld of door haar worden onderhouden, ingenomen of gebruikt voor de uitoefening van haar officiële werkzaamheden. De Voorzitter van het Bureau doet de Regering een plattegrond hiervan toekomen.

Artikel 18. Gezamenlijke overlegcommissie

  • 1 Een Gezamenlijke overlegcommissie vergemakkelijkt de uitvoering van deze Overeenkomst en kan zich via overleg tussen de desbetreffende autoriteiten van het Koninkrijk der Nederlanden en de Organisatie ook over andere administratieve vraagstukken buigen. De Commissie vergadert ten minste eenmaal per jaar en kan op verzoek van de Regering of de Organisatie op elk ander tijdstip bijeenkomen.

  • 2 De Voorzitter van de Commissie wordt benoemd bij wederzijdse overeenkomst tussen de Regering en de Organisatie.

Artikel 19. Geschillen

Geschillen voortvloeiend uit de uitleg of toepassing van deze Overeenkomst die niet rechtstreeks tussen de partijen kunnen worden beslecht, kunnen door een der partijen worden voorgelegd aan een scheidsgerecht. Artikel 23, vierde lid, en artikel 24 van het Protocol zijn van toepassing.

Artikel 20. Wijzigingen

Op verzoek van de Regering of van de Organisatie vindt overleg plaats omtrent de uitvoering of wijziging van deze Overeenkomst.

Artikel 21. Gunstigste behandeling

Indien en voor zover de Regering in de toekomst een overeenkomst aangaat met, of haar beleid wijzigt ten aanzien van, een intergouvernementele organisatie met in deze overeenkomst of dit beleid voorwaarden die voor die organisatie gunstiger zijn dan vergelijkbare voorwaarden in deze Overeenkomst, zal op verzoek van de Organisatie overleg worden aangegaan met als doel te bespreken of dezelfde behandeling aan de Organisatie kan worden verleend.

Artikel 22. Status van de Afzonderlijke overeenkomst

De gelijktijdig met deze Overeenkomst gesloten Afzonderlijke overeenkomst is een integrerend onderdeel van deze Overeenkomst. Iedere verwijzing naar deze Overeenkomst omvat mede de Afzonderlijke overeenkomst.

Artikel 23. Inwerkingtreding en duur

  • 1 Deze Overeenkomst treedt in werking op de dag van ondertekening. Zij blijft van kracht zolang het Verdrag en het Protocol van kracht blijven voor het Koninkrijk der Nederlanden.

  • 2 Bij de inwerkingtreding van deze Overeenkomst zijn de Overeenkomst tussen de Europese Octrooiorganisatie en het Koninkrijk der Nederlanden betreffende het onderdeel van het Europees Octrooibureau in ’s-Gravenhage van 19 oktober 1977, de bij Notawisseling tussen het Koninkrijk der Nederlanden en de Europese Octrooiorganisatie gesloten overeenkomst inzake de tewerkstelling van gezinsleden van 6 april 2005 alsmede de in het licht van het Beleidskader werving en opvang van internationale organisaties van de Nederlandse Regering bij Notawisseling tussen het Koninkrijk der Nederlanden en de Europese Octrooiorganisatie gesloten overeenkomst van 28 november 2005 en 13 december 2005, niet langer van kracht.

  • 3 Ten aanzien van het Koninkrijk der Nederlanden is deze Overeenkomst alleen van toepassing op het Koninkrijk in Europa.

Gedaan te Den Haag op 27 juni in het jaar 2006 in twee exemplaren in de Nederlandse, Duitse, Engelse en Franse taal, zijnde de vier teksten gelijkelijk authentiek.

AFZONDERLIJKE OVEREENKOMST

  • 1 Voor de toepassing van de Overeenkomst tussen het Koninkrijk der Nederlanden en de Europese Octrooiorganisatie betreffende het onderdeel van het Europees Octrooibureau in ’s-Gravenhage worden de volgende personen aangemerkt als inwonend gezinslid van een personeelslid:

    • a. de echtgenoot of geregistreerd partner van een personeelslid van het Bureau;

    • b. kinderen jonger dan 18 jaar van een personeelslid van het Bureau, van diens echtgenoot of van diens geregistreerd partner;

    • c. kinderen tussen 18 en 27 jaar van een personeelslid van het Bureau, van diens echtgenoot of van diens geregistreerd partner, mits zij:

      • i. ongehuwd zijn,

      • ii. financieel afhankelijk zijn van het personeelslid van het Bureau, diens echtgenoot of diens geregistreerd partner, en

      • iii. in Nederland onderwijs volgen of studeren dan wel een beroepsopleiding of beroepsonderwijs volgen, al dan niet met inbegrip van een stageprogramma, of het voornemen daartoe hebben;

    • d. kinderen jonger dan 18 jaar, alsook kinderen die voldoen aan de eisen onder letter (c), voor wie een adoptieaanvraag is ingediend en waarbij de adoptieprocedure door een personeelslid van het Bureau, diens echtgenoot of diens geregistreerd partner in gang is gezet;

    • e. ongeacht hun leeftijd, invalide kinderen ten laste, of kinderen ten laste die wegens ernstige ziekte of invaliditeit tijdens de gehele periode van die ziekte of invaliditeit niet in hun levensonderhoud kunnen voorzien, van een personeelslid van het Bureau, van diens echtgenoot of van diens geregistreerd partner, mits het Bureau een verklaring van die strekking aan de Regering levert.

  • 2 Kinderen tussen 18 en 24 jaar van een personeelslid van het Bureau, van diens echtgenoot of van diens geregistreerd partner worden, ook indien zij niet aan de voorwaarde in het eerste lid, letter (c), punt (iii) voldoen, als inwonend gezinslid aangemerkt, zolang zij voldoen aan de overige, onder die letter genoemde voorwaarden.

  • 3 Bij wederzijdse overeenkomst tussen de Regering en het Bureau kunnen anderen dan de in het eerste en tweede lid bedoelde personen:

    • a. als gezinslid overeenkomstig het eerste lid worden aangemerkt, met de uitzondering dat een tewerkstellingsvergunning slechts dan wordt afgegeven indien de Nederlandse wet- en regelgeving zulks toestaat; of

    • b. kosteloos en zo spoedig mogelijk een meervoudig inreisvisum uitgereikt krijgen teneinde het personeelslid, diens echtgenoot of diens geregistreerd partner te bezoeken.

Agreement between the Kingdom of the Netherlands and the European Patent Organisation concerning the branch of the European Patent Office at The Hague, including Separate agreement

Having regard to the Convention on the Grant of European Patents of 5 October 1973,

Having regard to Article 25 of the Protocol on Privileges and Immunities of the European Patent Organisation,

Whereas, pursuant to Article 6 of the said Convention, the European Patent Office shall have a branch at The Hague,

Have agreed as follows:

Article 1. Definitions

In this Agreement:

  • a. “Convention” means the Convention on the Grant of European Patents of 5 October 1973;

  • b. “Protocol” means the Protocol on Privileges and Immunities of the European Patent Organisation;

  • c. “Organisation” means the European Patent Organisation;

  • d. “Government” means the Government of the Kingdom of the Netherlands;

  • e. “Office” means the European Patent Office;

  • f. “branch” means the branch of the European Patent Office at The Hague (Rijswijk);

  • g. “Vienna Convention” means the Vienna Convention on Diplomatic Relations of 18 April 1961;

  • h. “Separate Agreement” means the Separate Agreement containing the definition of members of the family forming part of the employee’s household.

Article 2. Inviolability of the archives

The inviolability referred to in Article 2 of the Protocol shall apply to the entire archives, correspondence, documents, manuscripts, photographs, films, recordings, computer and media data, data carriers and any other similar material belonging to or held by the Organisation, wherever they are located and by whomsoever they are held, and all the information contained therein.

Article 3. Waiving of immunity

In the case of attachment by a third party, pursuant to a decision by the administrative or judicial authorities, of the salaries or emoluments owed by the Organisation to a member of its staff, the Organisation waives the immunity which it enjoys pursuant to Article 3, paragraph 1, of the Protocol unless it informs the competent authorities that it does not waive its immunity within fourteen days following the date of notification of the decision.

Article 4. Exemption from tax

  • 1 For the purposes of Article 4, paragraph 1, of the Protocol ‘‘direct taxes’’ shall embrace all direct ‘‘Rijksbelastingen’’ (State taxes) and all direct taxes, dues and levies imposed by a province, municipality or ‘‘waterschap’’ without prejudice to the provisions of paragraph 3 of the said Article.

  • 2 The Organisation shall on application be exempted from motor-vehicle tax in respect of its motor vehicles used for official purposes.

Article 5. Reimbursement of taxes and duties

  • 1 The following taxes and duties shall in particular be considered to fall under Article 4, paragraph 2, of the Protocol:

    • a. Turnover tax on goods supplied or services rendered to the Organisation;

    • b. Excise duties on goods;

    • c. Tax on acquisition of real property, insurance tax and stock exchange tax.

  • 2 The turnover tax paid in respect of goods supplied or services rendered shall be refunded to the Organisation on application.

    The tax on hydrocarbons such as fuel oil and motor fuels which the Organisation requires for official purposes shall be refunded to the Organisation on application.

    Excise duty paid on goods supplied and required for official purposes shall be refunded to the Organisation on application.

    The Organisation shall submit applications for reimbursement within three months after the quarter during which payment was made for goods supplied or services rendered and shall send the relevant documents together with the applications.

    The Organisation undertakes to facilitate the verification by the competent authorities of the facts on which the tax exemption or tax refund can be based.

    No refund shall be granted unless the price of the goods supplied or the services rendered exceeds 225 euros per transaction.

Article 6. Disposal of goods

  • 1 Goods acquired by the Organisation under the conditions laid down in Article 4, paragraph 2, of the Protocol may not be sold, given away, hired out or otherwise disposed of unless the competent authorities have been notified beforehand and the relevant turnover tax has been paid. The tax payable shall be calculated on the basis of the current value of the goods.

  • 2 If the Organisation sells, gives away, hires out or otherwise disposes of any of the goods imported under the conditions laid down in Article 5 of the Protocol, it shall declare the goods for importation and pay the taxes, dues and levies in respect of such goods.

  • 3 The value stated on the declaration for importation shall be the value of the goods on the date of declaration; the tariff in force on the date of declaration shall apply.

Article 7. Work permit, residence permit, compulsory registration

  • 1 Employees of the Office exercising their functions in the Netherlands:

    • a. shall not require a work permit;

    • b. shall not require a residence permit, and shall not be subject to the provisions governing aliens’ registration, provided that they hold the personal identity card referred to in Article 8; the same shall apply to members of their family forming part of their household;

    • c. shall not be subject to the application of the regulations regarding the registration of religious denomination in the Netherlands population registers; the same shall apply to members of their family forming part of their household.

  • 2 Members of the family forming part of the household of an employee of the Office, as defined in paragraph 1 of the Separate Agreement, shall not require a work permit for the duration of the employee’s employment with the Office.

  • 3 The rights granted to employees of the Office during their period of employment and to the members of their family forming part of their household shall expire on the employees’ final departure or on expiry of a reasonable period as referred to in Article 39, paragraphs 2 and 3, of the Vienna Convention, such period being counted from the date on which the employees relinquish their duties or the family members cease to form part of their household.

  • 4 Notwithstanding paragraph 3, former employees of the Office and members of their family forming or having formed part of their household shall be entitled to a right of residence in the Netherlands in conformity with the Netherlands’ aliens legislation. For the purpose of acquiring residence rights under the Netherlands’ aliens legislation, any period of legitimate stay in the Netherlands, either as a privileged person or under the aliens legislation, accrued either before or during the employment of the employee concerned with the branch, shall be recognised and counted.

Article 8. Identity cards

  • 1 The Organisation shall promptly notify the Government of:

    • a. the names of employees of the Office exercising their functions in the Netherlands;

    • b. their arrival and final departure and the dates on which they take up and relinquish their duties;

    • c. the names and arrival and final departure of members of an employee’s family forming part of the employee’s household and the fact that a person has ceased to form part of the household; and

    • d. the names and arrival and final departure of private and domestic servants of employees of the Office and the fact that they have left the employ of such employees.

  • 2 The Government shall issue identity cards to the following persons:

    • a. the employees of the Office exercising their functions in the Netherlands;

    • b. the members of their family forming part of their household who are not Netherlands nationals;

    • c. the members of their family forming part of their household who are Netherlands nationals, if the Office shows that it is necessary to do so in the interest of the Organisation;

    • d. private and domestic servants, who are neither Netherlands nationals nor in possession of a valid permanent residence permit, of employees of the Office.

  • 3 The identity cards issued by the Government shall state only the holder’s name, sex, date and place of birth, and nationality, and shall bear a photograph of the holder. The card shall serve to identify the holder vis-à-vis the Government and its authorities and shall reflect the status of the holder under the Protocol and this Agreement.

  • 4 The Organisation shall make the personal data that will appear on the identity card available to the Government. The recipient Government Authority shall make the data available to other Government Authorities solely for the application of the Protocol and this Agreement. The data shall be subject to the Netherlands’ data protection legislation.

  • 5 Electronically accessible data on the identity cards shall be limited to the data listed in paragraph 3. However, the Government may add further electronically accessible data if it is under an international obligation to do so for reasons of public security and provided this does not affect any of the rights under the Protocol and this Agreement. The Government shall inform the Organisation of the intended changes at the earliest possible date prior to their implementation.

  • 6 The Organisation shall promptly return the identity cards of the persons mentioned in paragraph 2 after termination of employment of the persons involved, with due regard to the reasonable period stipulated in Article 7, paragraph 3.

Article 9. Privileges and immunities of the President and the head of the branch

  • 1 The President of the Office shall, when visiting the Netherlands, enjoy the same privileges and immunities as the Netherlands accords to heads of diplomatic missions in the Netherlands in accordance with the Vienna Convention.

  • 2 The head of the branch shall enjoy the same privileges and immunities as the Netherlands accords to heads of diplomatic missions in the Netherlands in accordance with the Vienna Convention.

  • 3 The same provisions shall apply to the members of their families forming part of their respective households.

  • 4 This Article does not detract from any provisions in this Agreement or the Protocol.

  • 5 This Article shall not apply to nationals or permanent residents of the Netherlands.

Article 10. Privileges and immunities of the employees of the Office

  • 1 Employees of the Office exercising their functions in the Netherlands,

    • a. having the professional grade of A5 and above, or

    • b. having the professional grade of A4, provided they have been in that grade for more than two years and have had a basic salary not lower than A5 step 1, from the first of January following the year in which both requirements were fulfilled

    shall enjoy the same privileges and immunities as the Netherlands accords to diplomatic agents of the diplomatic missions established in the Netherlands in accordance with the Vienna Convention, except that immunity from criminal jurisdiction and personal inviolability shall not extend to acts performed outside the course of their official duties.

  • 2 Employees of the Office exercising their functions in the Netherlands who are not service staff and who do not fall under paragraph 1 shall enjoy the same privileges and immunities as the Netherlands accords to administrative and technical staff of the diplomatic missions established in the Netherlands in accordance with the Vienna Convention, except that immunity from criminal jurisdiction and personal inviolability shall not extend to acts performed outside the course of their official duties.

  • 3 The same provisions shall apply to the members of their families forming part of their respective households.

  • 4 Immunity from jurisdiction shall not apply in the case of a civil action brought by a third party for damage resulting from a motor traffic offence.

  • 5 This Article does not detract from any provisions in this Agreement or the Protocol.

  • 6 This Article shall not apply to nationals or permanent residents of the Netherlands.

Article 11. Servants

  • 1 For the duration of their stay in the Netherlands, employees of the Office exercising their functions in the Netherlands shall be allowed to employ domestic servants or, where applicable, private servants.

  • 2 The domestic or private servants referred to in paragraph 1 shall be required to hold neither a work permit nor a residence permit.

Article 12. Progression

The Netherlands shall not take into account any of the payments made by the Organisation which are exempt from national income tax pursuant to the Protocol when assessing the amount of tax to be applied to income from other sources.

Article 13. Driving licence

During their period of employment, employees of the Office, the members of their family forming part of their household and their domestic or private servants shall be allowed to obtain a Netherlands driving licence on presentation of their valid foreign driving licence or to continue to drive using their own valid foreign driving licence, provided the holder is in possession of an identity card issued by the Government.

Article 14. Entry, stay and departure

  • 1 The Government shall facilitate the entry, stay and departure of the persons listed below:

    • a. serving employees of the Office and members of the family forming part of their household;

    • b. domestic and private servants of employees of the Office;

    • c. experts;

    • d. other persons who are invited by the Organisation for an official purpose.

  • 2 Visas or, if appropriate, multiple entry visas required by persons referred to in paragraph 1, shall be granted without charge and as promptly as possible.

  • 3 This arrangement shall not preclude a request for presentation of reasonable evidence to establish that persons claiming the treatment provided for in this arrangement fall within the categories described in paragraph 1.

Article 15. Nationals and permanent residents

  • 1 Netherlands nationals and persons referred to in Article 22, sub-paragraph (b), of the Protocol exercising their functions in the Netherlands shall not enjoy the privileges and immunities laid down in Article 12, paragraph 1, sub-paragraphs (a), (e) and (f), Article 13, Article 14, sub-paragraphs (b), (e) and (g), and Article 15, sub-paragraph (c), of the Protocol, and Article 7, paragraph 1, sub-paragraph (c), of this Agreement.

  • 2 Employees of the Office who are Netherlands nationals or who are referred to in Article 22, sub-paragraph (b), of the Protocol, exercising their functions in the Netherlands, whose names have, by reason of their duties, been entered on a list drawn up by the Organisation and approved by the Minister of Defence of the Kingdom of the Netherlands, shall be exempt from military service. In the event of other Netherlands nationals and permanent residents being called up for military service, the Minister of Defence of the Kingdom of the Netherlands shall, at the request of the Organisation, grant them such deferment as may be necessary to avoid the interruption of essential work.

Article 16. Office facilities

The Government recognises that certain services, amenities and support are required for the proper and efficient operation of the Office and shall make every effort to assist the Office in establishing and maintaining the proper functioning of the Office’s facilities in the Netherlands.

Article 17. Premises of the branch

The premises of the branch within the meaning of Article 1 of the Protocol shall be buildings, parts of buildings and land or facilities ancillary thereto, including installations and facilities made available to, or maintained, occupied or used by, the Organisation in the Netherlands for the performance of its official activities. The President of the Office shall communicate plans of these premises to the Government.

Article 18. Joint Consultative Committee

  • 1 A Joint Consultative Committee shall facilitate the implementation of this Agreement and may address other administrative issues through consultations between the relevant authorities of the Kingdom of the Netherlands and the Organisation. It shall meet at least once a year and may convene at any other time at the request of the Government or the Organisation.

  • 2 The Chairman of the Committee shall be appointed by mutual agreement between the Government and the Organisation.

Article 19. Disputes

Any dispute arising from the interpretation or application of this Agreement which cannot be settled directly between the parties may be submitted by either party to an arbitration tribunal. Article 23, paragraph 4, and Article 24 of the Protocol shall apply.

Article 20. Modifications

At the request of the Government or of the Organisation, consultations shall take place on the implementation or modification of this Agreement.

Article 21. Most favourable treatment

If and to the extent that the Government, in the future, enters into an agreement with, or changes its policy with respect to, any intergovernmental organisation, and said agreement or policy contains terms or conditions more favourable to that organisation than comparable terms or conditions in this Agreement, consultations shall be entered into at the request of the Organisation with a view to discussing whether the same treatment may be extended to the Organisation.

Article 22. Status of the Separate Agreement

The Separate Agreement concluded together with this Agreement forms an integral part thereof. Any reference to this Agreement includes the Separate Agreement.

Article 23. Entry into force and duration

  • 1 This Agreement shall enter into force upon signature. It shall apply for as long as the Convention and the Protocol are in force for the Kingdom of the Netherlands.

  • 3 With respect to the Kingdom of the Netherlands, this Agreement shall apply to the part of the Kingdom in Europe only.

SEPARATE AGREEMENT

  • 1 For the purposes of the Agreement between the Kingdom of the Netherlands and the European Patent Organisation concerning the branch of the European Patent Office at The Hague, the following persons shall be recognised as members of the family forming part of the employee’s household:

    • a. the spouse or registered partner of an employee of the Office;

    • b. children of an employee of the Office, of his spouse or of his registered partner who are under the age of 18;

    • c. children of an employee of the Office, of his spouse or of his registered partner who are between 18 and 27 years of age, provided that they:

      • (i) are unmarried,

      • (ii) are financially dependent on the employee of the Office, his spouse or his registered partner, and

      • (iii) are either attending school or studying, or following vocational training, apprenticeship or education, whether or not including a work placement, or intending to do so, in the Netherlands;

    • d. children under the age of 18 and children who fulfil the requirements listed in sub-paragraph (c) for whom an application for adoption has been lodged and the adoption procedure has been started by an employee of the Office, his spouse or his registered partner;

    • e. irrespective of age, dependent disabled children, or children who are prevented by serious illness or invalidity from earning a livelihood throughout the period of that illness or invalidity, of an employee of the Office, of his spouse or of his registered partner, provided that the Office supplies the Government with a certificate to that effect.

  • 2 Children of an employee of the Office, of his spouse or of his registered partner who are between 18 and 24 years of age, shall also be recognised as members of the family forming part of the household if they do not fulfil the condition set out in paragraph 1, sub-paragraph (c), item (iii), as long as they fulfil the other conditions set out in that sub-paragraph.

  • 3 By mutual agreement between the Government and the Office, persons other than those referred to in paragraphs 1 and 2 may either:

    • a. be recognised as a member of the family in accordance with paragraph 1, with the exception that a work permit shall only be issued if permitted by the laws and regulations of the Netherlands; or

    • b. be issued a multiple entry visa without charge and as promptly as possible for the purpose of visiting the employee, his spouse or his registered partner.

  • 4 For the purposes of paragraph 3, the Government shall give favourable consideration:

    • a. to persons who do not fulfil the criteria laid down in paragraphs 1 and 2 but who are recognised as dependants pursuant to the Service Regulations for permanent employees of the Office and are therefore subject to the social security system of the Office; and

    • b. to seriously ill or invalid parents for humanitarian reasons.

  • 5 Members of the family recognised as forming part of the household under this Separate Agreement may be included in that household on the employee’s arrival in the Netherlands or join that household at any time thereafter.
