Protocol to the 1979 Convention on Long-range Transboundary Air Pollution on Heavy Metals

The Parties,

Determined to implement the Convention on Long-range Transboundary Air Pollution,

Concerned that emissions of certain heavy metals are transported across national boundaries and may cause damage to ecosystems of environmental and economic importance and may have harmful effects on human health,

Considering that combustion and industrial processes are the predominant anthropogenic sources of emissions of heavy metals into the atmosphere,

Acknowledging that heavy metals are natural constituents of the Earth's crust and that many heavy metals in certain forms and appropriate concentrations are essential to life,

Taking into consideration existing scientific and technical data on the emissions, geochemical processes, atmospheric transport and effects on human health and the environment of heavy metals, as well as on abatement techniques and costs,

Aware that techniques and management practices are available to reduce air pollution caused by the emissions of heavy metals,

Recognizing that countries in the region of the United Nations Economic Commission for Europe (UN/ECE) have different economic conditions, and that in certain countries the economies are in transition,

Resolved to take measures to anticipate, prevent or minimize emissions of certain heavy metals and their related compounds, taking into account the application of the precautionary approach, as set forth in principle 15 of the Rio Declaration on Environment and Development,

Reaffirming that States have, in accordance with the Charter of the United Nations and the principles of international law, the sovereign right to exploit their own resources pursuant to their own environmental and development policies, and the responsibility to ensure that activities within their jurisdiction or control do not cause damage to the environment of other States or of areas beyond the limits of national jurisdiction,

Mindful that measures to control emissions of heavy metals would also contribute to the protection of the environment and human health in areas outside the UN/ECE region, including the Arctic and international waters,

Noting that abating the emissions of specific heavy metals may provide additional benefits for the abatement of emissions of other pollutants,

Aware that further and more effective action to control and reduce emissions of certain heavy metals may be needed and that, for example, effects-based studies may provide a basis for further action,

Noting the important contribution of the private and non-governmental sectors to knowledge of the effects associated with heavy metals, available alternatives and abatement techniques, and their role in assisting in the reduction of emissions of heavy metals,

Bearing in mind the activities related to the control of heavy metals at the national level and in international forums,

Have agreed as follows:

Article 1. Definitions

For the purposes of the present Protocol,

  • 1. “Convention” means the Convention on Long-range Transboundary Air Pollution, adopted in Geneva on 13 November 1979;

  • 2. “EMEP” means the Cooperative Programme for Monitoring and Evaluation of Long-range Transmission of Air Pollutants in Europe;

  • 3. “Executive Body” means the Executive Body for the Convention constituted under article 10, paragraph 1, of the Convention;

  • 4. “Commission” means the United Nations Economic Commission for Europe;

  • 5. “Parties” means, unless the context otherwise requires, the Parties to the present Protocol;

  • 6. “Geographical scope of EMEP” means the area defined in article 1, paragraph 4, of the Protocol to the 1979 Convention on Long-range Transboundary Air Pollution on Long-term Financing of the Cooperative Programme for Monitoring and Evaluation of the Long-range Transmission of Air Pollutants in Europe (EMEP), adopted in Geneva on 28 September 1984;

  • 7. “Heavy metals” means those metals or, in some cases, metalloids which are stable and have a density greater than 4.5 g/cm3 and their compounds;

  • 8. “Emission” means a release from a point or diffuse source into the atmosphere;

  • 9. “Stationary source” means any fixed building, structure, facility, installation, or equipment that emits or may emit a heavy metal listed in annex I directly or indirectly into the atmosphere;

  • 10. “New stationary source” means any stationary source of which the construction or substantial modification is commenced after the expiry of two years from the date of entry into force for a Party of the present Protocol. A Party may decide not to treat as a new stationary source any stationary source for which approval has already been given by the appropriate competent national authority at the time of entry into force of the Protocol for that Party and provided that the construction or substantial modification is commenced within five years of that date. It shall be a matter for the competent national authorities to decide whether a modification is substantial or not, taking into account such factors as the environmental benefits of the modification;

  • 11. “Major stationary source category” means any stationary source category that is listed in annex II and that contributes at least one per cent to a Party's total emissions from stationary sources of a heavy metal listed in annex I for the reference year specified in accordance with annex I.

  • 12. The terms “this Protocol”, “the Protocol” and “the present Protocol” mean the 1998 Protocol on Heavy Metals, as amended from time to time.

Article 2. Objective

The objective of the present Protocol is to control emissions of heavy metals caused by anthropogenic activities that are subject to long-range transboundary atmospheric transport and are likely to have significant adverse effects on human health or the environment, in accordance with the provisions of the following articles.

Article 3. Basic obligations

  • 1 Each Party shall reduce its total annual emissions into the atmosphere of each of the heavy metals listed in annex I from the level of the emission in the reference year set in accordance with that annex by taking effective measures, appropriate to its particular circumstances.

  • 2 Subject to paragraphs 2 bis and 2 ter, each Party shall, no later than the timescales specified in annex IV, apply:

    • a) The best available techniques, taking into consideration annex III, to each new stationary source within a major stationary source category for which guidance adopted by the Parties at a session of the Executive Body identifies best available techniques;

    • b) The limit values specified in annex V to each new stationary source within a major stationary source category. A Party may, as an alternative, apply different emission reduction strategies that achieve equivalent overall emission levels;

    • c) The best available techniques, taking into consideration annex III, to each existing stationary source within a major stationary source category for which guidance adopted by the Parties at a session of the Executive Body identifies best available techniques. A Party may, as an alternative, apply different emission reduction strategies that achieve equivalent overall emission reductions;

    • d) The limit values specified in annex V to each existing stationary source within a major stationary source category, insofar as this is technically and economically feasible. A Party may, as an alternative, apply different emission reduction strategies that achieve equivalent overall emission reductions.

  • 2 bis A Party that was already a Party to the present Protocol prior to the entry into force of an amendment that introduces new source categories may apply the limit values applicable to an “existing stationary source” to any source in such a new category the construction or substantial modification of which is commenced before the expiry of two years from the date of entry into force of that amendment for that Party, unless and until that source later undergoes substantial modification.

  • 2 ter A Party that was already a Party to the present Protocol prior to the entry into force of an amendment that introduces new limit values applicable to a “new stationary source” may continue to apply the previously applicable limit values to any source the construction or substantial modification of which is commenced before the expiry of two years from the date of entry into force of that amendment for that Party, unless and until that source later undergoes substantial modification.

  • 3 Each Party shall apply product control measures in accordance with the conditions and timescales specified in annex VI.

  • 4 Each Party should consider applying additional product management measures, taking into consideration annex VII.

  • 5 Each Party shall develop and maintain emission inventories for the heavy metals listed in annex I. Parties within the geographic scope of EMEP shall use the methodologies specified in guidelines prepared by the Steering Body of EMEP and adopted by the Parties at a session of the Executive Body. Parties in areas outside the geographic scope of EMEP shall use as guidance the methodologies developed through the workplan of the Executive Body.

  • 6 A Party that, after applying paragraphs 2 and 3 above, cannot achieve the requirements of paragraph 1 above for a heavy metal listed in annex I, shall be exempted from its obligations in paragraph 1 above for that heavy metal.

  • 7 Any Party whose total land area is greater than 6,000,000 km2 shall be exempted from its obligations in paragraphs 2 b), (c), and (d) above, if it can demonstrate that, no later than eight years after the date of entry into force of the present Protocol, it will have reduced its total annual emissions of each of the heavy metals listed in annex I from the source categories specified in annex II by at least 50 per cent from the level of emissions from these categories in the reference year specified in accordance with annex I. A Party that intends to act in accordance with this paragraph shall so specify upon signature of, or accession to, the present Protocol.

  • 8 Each Party should actively participate in programmes under the Convention on the effects of air pollution on human health and the environment and programmes on atmospheric monitoring and modelling.

Article 3 bis. Flexible transitional arrangements

  • 1 Notwithstanding article 3, paragraphs 2 (c) and 2 (d), a Party to the Convention that becomes a Party to the present Protocol between 1 January 2014 and 31 December 2019 may apply flexible transitional arrangements for the implementation of best available techniques and limit values to existing stationary sources in specific stationary source categories under the conditions specified in this article.

  • 2 Any Party electing to apply the flexible transitional arrangements under this article shall indicate in its instrument of ratification, acceptance, approval or accession to the present Protocol the following:

    • a) The specific stationary source categories listed in annex II for which the Party is electing to apply flexible transitional arrangements, provided that no more than four such categories may be listed;

    • b) Stationary sources for which construction or the last substantial modification commenced prior to 1990 or an alternative year of the period 1985–1995 inclusive, specified by a Party upon ratification, acceptance, approval or accession, which are eligible for flexible transitional arrangements as set out in paragraph 5; and

    • c) An implementation plan consistent with paragraphs 3 and 4 identifying a timetable for full implementation of the specified provisions.

  • 3 A Party shall, as a minimum, apply best available techniques for existing stationary sources in categories 1, 2, 5 and 7 of annex II no later than eight years after the entry into force of the present Protocol for the Party, or 31 December 2022, whichever is sooner, except as provided in paragraph 5.

  • 4 In no case may a Party’s application of best available techniques or limit values for any existing stationary sources be postponed past 31 December 2030.

  • 5 With respect to any source or sources indicated pursuant to paragraph 2 (b), a Party may decide, no later than eight years after entry into force of the present Protocol for the Party, or 31 December 2022, whichever is sooner, that such source or sources will be closed down. A list of such sources shall be provided as part of the Party’s next report pursuant to paragraph 6. Requirements for application of best available techniques and limit values will not apply to any such source or sources, provided the source or sources are closed down no later than 31 December 2030. For any such source or sources not closed down as of that date, a Party must thereafter apply the best available techniques and limit values applicable to new sources in the applicable source category.

  • 6 A Party electing to apply the flexible transitional arrangements under this article shall provide the Executive Secretary of the Commission with triennial reports of its progress towards implementation of best available techniques and limit values to the stationary sources in the stationary source categories identified pursuant to this article. The Executive Secretary of the Commission will make such triennial reports available to the Executive Body.

Article 4. Exchange of information and technology

  • 1 The Parties shall, in a manner consistent with their laws, regulations and practices, facilitate the exchange of technologies and techniques designed to reduce emissions of heavy metals, including but not limited to exchanges that encourage the development of product management measures and the application of best available techniques, in particular by promoting:

    • a) The commercial exchange of available technology;

    • b) Direct industrial contacts and cooperation, including joint ventures;

    • c) The exchange of information and experience; and

    • d) The provision of technical assistance.

  • 2 In promoting the activities specified in paragraph 1 above, the Parties shall create favourable conditions by facilitating contacts and cooperation among appropriate organizations and individuals in the private and public sectors that are capable of providing technology, design and engineering services, equipment or finance.

Article 5. Strategies, policies, programmes and measures

  • 1 Each Party shall develop, without undue delay, strategies, policies and programmes to discharge its obligations under the present Protocol.

  • 2 A Party may, in addition:

    • a) Apply economic instruments to encourage the adoption of cost-effective approaches to the reduction of heavy metal emissions;

    • b) Develop government/industry covenants and voluntary agreements;

    • c) Encourage the more efficient use of resources and raw materials;

    • d) Encourage the use of less polluting energy sources;

    • e) Take measures to develop and introduce less polluting transport systems;

    • f) Take measures to phase out certain heavy metal emitting processes where substitute processes are available on an industrial scale;

    • g) Take measures to develop and employ cleaner processes for the prevention and control of pollution.

  • 3 The Parties may take more stringent measures than those required by the present Protocol.

Article 6. Research, development and monitoring

The Parties shall encourage research, development, monitoring and cooperation, primarily focusing on the heavy metals listed in annex I, related, but not limited, to:

  • a) Emissions, long-range transport and deposition levels and their modelling, existing levels in the biotic and abiotic environment, the formulation of procedures for harmonizing relevant methodologies;

  • b) Pollutant pathways and inventories in representative ecosystems;

  • c) Relevant effects on human health and the environment, including quantification of those effects;

  • d) Best available techniques and practices and emission control techniques currently employed by the Parties or under development;

  • e) Collection, recycling and, if necessary, disposal of products or wastes containing one or more heavy metals;

  • f) Methodologies permitting consideration of socio-economic factors in the evaluation of alternative control strategies;

  • g) An effects-based approach which integrates appropriate information, including information obtained under subparagraphs a) to (f) above, on measured or modelled environmental levels, pathways, and effects on human health and the environment, for the purpose of formulating future optimized control strategies which also take into account economic and technological factors;

  • h) Alternatives to the use of heavy metals in products listed in annexes VI and VII;

  • i) Gathering information on levels of heavy metals in certain products, on the potential for emissions of those metals to occur during the manufacture, processing, distribution in commerce, use, and disposal of the product, and on techniques to reduce such emissions.

Article 7. Reporting

  • 1 Subject to its laws governing the confidentiality of commercial information:

    • a) Each Party shall report, through the Executive Secretary of the Commission, to the Executive Body, on a periodic basis as determined by the Parties meeting within the Executive Body, information on the measures that it has taken to implement the present Protocol. Moreover:

      • (i) Where a Party applies different emission reduction strategies under article 3 paragraphs 2 (b), (c) or (d), it shall document the strategies applied and its compliance with the requirements of those paragraphs;

      • (ii) Where a Party judges the application of certain limit values, as specified in accordance with article 3, paragraph 2 (d), not to be technically and economically feasible, it shall report and justify this;

    • b) Each Party within the geographical scope of EMEP shall report to EMEP, through the Executive Secretary of the Commission, information on the levels of emissions of heavy metals listed in annex I, using the methodologies specified in guidelines prepared by the Steering Body of EMEP and adopted by the Parties at a session of the Executive Body. Parties in areas outside the geographical scope of EMEP shall report available information on levels of emissions of the heavy metals listed in annex I. Each Party shall also provide information on the levels of emissions of the substances listed in annex I for the reference year specified in that annex;

    • c) Each Party within the geographical scope of EMEP should report available information to the Executive Body, through the Executive Secretary of the Commission, on its air pollution effects programmes on human health and the environment and atmospheric monitoring and modelling programmes under the Convention using guidelines adopted by the Executive Body;

    • d) Parties in areas outside the geographical scope of EMEP should make available information similar to that specified in subparagraph (c), if requested to do so by the Executive Body.

  • 2 The information to be reported in accordance with paragraph 1 a) above shall be in conformity with a decision regarding format and content to be adopted by the Parties at a session of the Executive Body. The terms of this decision shall be reviewed as necessary to identify any additional elements regarding the format or the content of the information that is to be included in the reports.

  • 3 Upon the request of and in accordance with timescales decided by the Executive Body, EMEP and other subsidiary bodies shall provide relevant information on the long-range transport and deposition of heavy metals.

Article 8. Calculations

Upon the request of and in accordance with timescales decided by the Executive Body, EMEP and its technical bodies and centres shall, using appropriate models and measurements,, provide to the Executive Body calculations of transboundary fluxes and depositions of heavy metals within the geographical scope of EMEP. In areas outside the geographical scope of EMEP, models appropriate to the particular circumstances of Parties to the Convention shall be used.

Article 9. Compliance

Compliance by each Party with its obligations under the present Protocol shall be reviewed regularly. The Implementation Committee established by decision 1997/2 of the Executive Body at its fifteenth session shall carry out such reviews and report to the Parties meeting within the Executive Body in accordance with the terms of the annex to that decision, including any amendments thereto.

Article 10. Reviews by the parties at sessions of the executive body

  • 1 The Parties shall, at sessions of the Executive Body, pursuant to article 10, paragraph 2a., of the Convention, review the information supplied by the Parties, EMEP and other subsidiary bodies and the reports of the Implementation Committee referred to in article 9 of the present Protocol.

  • 2 The Parties shall, at sessions of the Executive Body, keep under review the progress made towards meeting the obligations set out in the present Protocol.

  • 3 The Parties shall, at sessions of the Executive Body, review the sufficiency and effectiveness of the obligations set out in the present Protocol.

    • a) Such reviews will take into account the best available scientific information on the effects of the deposition of heavy metals, assessments of technological developments, and changing economic conditions;

    • b) Such reviews will, in the light of the research, development, monitoring and cooperation undertaken under the present Protocol:

      • i) Evaluate progress towards meeting the objective of the present Protocol;

      • ii) Evaluate whether additional emission reductions beyond the levels required by this Protocol are warranted to reduce further the adverse effects on human health or the environment; and

      • iii) Take into account the extent to which a satisfactory basis exists for the application of an effects-based approach;

    • c) The procedures, methods and timing for such reviews shall be specified by the Parties at a session of the Executive Body.

  • 4 The Parties shall consider, based on the conclusion of the reviews referred to in paragraph 3 above and as soon as practicable after completion of the review, developing a work plan on further steps.

Article 11. Settlement of disputes

  • 1 In the event of a dispute between any two or more Parties concerning the interpretation or application of the present Protocol, the Parties concerned shall seek a settlement of the dispute through negotiation or any other peaceful means of their own choice. The Parties to the dispute shall inform the Executive Body of their dispute.

  • 2 When ratifying, accepting, approving or acceding to the present Protocol, or at any time thereafter, a Party which is not a regional economic integration organization may declare in a written instrument submitted to the Depositary that, in respect of any dispute concerning the interpretation or application of the Protocol, it recognizes one or both of the following means of dispute settlement as compulsory ipso facto and without special agreement, in relation to any Party accepting the same obligation:

    • a) Submission of the dispute to the International Court of Justice;

    • b) Arbitration in accordance with procedures to be adopted by the Parties at a session of the Executive Body, as soon as practicable, in an annex on arbitration.

    A Party which is a regional economic integration organization may make a declaration with like effect in relation to arbitration in accordance with the procedures referred to in subparagraph b. above.

  • 3 A declaration made under paragraph 2 above shall remain in force until it expires in accordance with its terms or until three months after written notice of its revocation has been deposited with the Depositary.

  • 4 A new declaration, a notice of revocation or the expiry of a declaration shall not in any way affect proceedings pending before the International Court of Justice or the arbitral tribunal, unless the Parties to the dispute agree otherwise.

  • 5 Except in a case where the Parties to a dispute have accepted the same means of dispute settlement under paragraph 2, if after twelve months following notification by one Party to another that a dispute exists between them, the Parties concerned have not been able to settle their dispute through the means mentioned in paragraph 1 above, the dispute shall be submitted, at the request of any of the Parties to the dispute, to conciliation.

  • 6 For the purpose of paragraph 5, a conciliation commission shall be created. The commission shall be composed of equal numbers of members appointed by each Party concerned or, where the Parties in conciliation share the same interest, by the group sharing that interest, and a chairman chosen jointly by the members so appointed. The commission shall render a recommendatory award, which the Parties shall consider in good faith.

Article 12. Annexes

The annexes to the present Protocol shall form an integral part of the Protocol. Annexes III and VII are recommendatory in character.

Article 13. Amendments to the protocol

  • 1 Any Party may propose amendments to the present Protocol.

  • 2 Proposed amendments shall be submitted in writing to the Executive Secretary of the Commission, who shall communicate them to all Parties. The Parties meeting within the Executive Body shall discuss the proposed amendments at its next session, provided that the proposals have been circulated by the Executive Secretary to the Parties at least ninety days in advance.

  • 3 Amendments to the present Protocol other than to annexes III and VII shall be adopted by consensus of the Parties present at a session of the Executive Body, and shall enter into force for the Parties which have accepted them on the ninetieth day after the date on which two thirds of those that were Parties at the time of their adoption have deposited with the Depositary their instruments of acceptance thereof. Amendments shall enter into force for any other Party on the ninetieth day after the date on which that Party has deposited its instrument of acceptance thereof.

  • 4 Amendments to annexes III and VII shall be adopted by consensus of the Parties present at a session of the Executive Body. On the expiry of 180 days from the date of its communication to all Parties by the Executive Secretary of the Commission, an amendment to any such annex shall become effective for those Parties which have not submitted to the Depositary a notification in accordance with the provisions of paragraph 5 below, provided that at least sixteen Parties have not submitted such a notification.

  • 5 Any Party that is unable to approve an amendment to annex III or VII shall so notify the Depositary in writing within 180 days from the date of the communication of its adoption.

    The Depositary shall without delay notify all Parties of any such notification received. A Party may at any time substitute an acceptance for its previous notification and, upon deposit of an instrument of acceptance with the Depositary, the amendment to such an annex shall become effective for that Party.

  • 5 bis For those Parties having accepted it, the procedure set out in paragraph 5 ter supersedes the procedure set out in paragraph 3 in respect of amendments to annexes II, IV, V and VI.

  • 5 ter Amendments to annexes II, IV, V and VI shall be adopted by consensus of the Parties present at a session of the Executive Body. On the expiry of one year from the date of its communication to all Parties by the Executive Secretary of the Commission, an amendment to any such annex shall become effective for those Parties which have not submitted to the Depositary a notification in accordance with the provisions of subparagraph (a):

    • a) Any Party that is unable to approve an amendment to annexes II, IV, V and VI shall so notify the Depositary in writing within one year from the date of the communication of its adoption. The Depositary shall without delay notify all Parties of any such notification received. A Party may at any time substitute an acceptance for its previous notification and, upon deposit of an instrument of acceptance with the Depositary, the amendment to such an annex shall become effective for that Party;

    • b) Any amendment to annexes II, IV, V and VI shall not enter into force if an aggregate number of 16 or more Parties have either:

      • (i) Submitted a notification in accordance with the provisions of subparagraph (a); or

      • (ii) Not accepted the procedure set out in this paragraph and not yet deposited an instrument of acceptance in accordance with the provisions of paragraph 3.

  • 6 In the case of a proposal to amend annex I, VI or VII by adding a heavy metal, a product control measure or a product or product group to the present Protocol:

    • a) The proposer shall provide the Executive Body with the information specified in Executive Body decision 1998/1, including any amendments thereto; and

    • b) The Parties shall evaluate the proposal in accordance with the procedures set forth in Executive Body decision 1998/1, including any amendments thereto.

  • 7 Any decision to amend Executive Body decision 1998/1 shall be taken by consensus of the Parties meeting within the Executive Body and shall take effect sixty days after the date of adoption.

Article 14. Signature

  • 1 The present Protocol shall be open for signature at Aarhus (Denmark) from 24 to 25 June 1998, then at United Nations Headquarters in New York until 21 December 1998 by States members of the Commission as well as States having consultative status with the Commission pursuant to paragraph 8 of Economic and Social Council resolution 36 (IV) of 28 March 1947, and by regional economic integration organizations, constituted by sovereign States members of the Commission, which have competence in respect of the negotiation, conclusion and application of international agreements in matters covered by the Protocol, provided that the States and organizations concerned are Parties to the Convention.

  • 2 In matters within their competence, such regional economic integration organizations shall, on their own behalf, exercise the rights and fulfil the responsibilities which the present Protocol attributes to their member States. In such cases, the member States of these organizations shall not be entitled to exercise such rights individually.

Article 15. Ratification, acceptance, approval and accession

  • 1 The present Protocol shall be subject to ratification, acceptance or approval by Signatories.

  • 2 The present Protocol shall be open for accession as from 21 December 1998 by the States and organizations that meet the requirements of article 14, paragraph 1.

  • 3 A State or regional economic integration organization shall declare in its instrument of ratification, acceptance, approval or accession if it does not intend to be bound by the procedures set out in article 13, paragraph 5 ter, as regards the amendment of annexes II, IV, V and VI.

Article 16. Depositary

The instruments of ratification, acceptance, approval or accession shall be deposited with the Secretary-General of the United Nations, who will perform the functions of Depositary.

Article 17. Entry into force

  • 1 The present Protocol shall enter into force on the ninetieth day following the date on which the sixteenth instrument of ratification, acceptance, approval or accession has been deposited with the Depositary.

  • 2 For each State and organization referred to in article 14, paragraph 1, which ratifies, accepts or approves the present Protocol or accedes thereto after the deposit of the sixteenth instrument of ratification, acceptance, approval or accession, the Protocol shall enter into force on the ninetieth day following the date of deposit by such Party of its instrument of ratification, acceptance, approval or accession.

Article 18. Withdrawal

At any time after five years from the date on which the present Protocol has come into force with respect to a Party, that Party may withdraw from it by giving written notification to the Depositary. Any such withdrawal shall take effect on the ninetieth day following the date of its receipt by the Depositary, or on such later date as may be specified in the notification of the withdrawal.

Article 19. Authentic texts

I. INTRODUCTION

1.

Installations or parts of installations for research, development and the testing of new products and processes are not covered by this annex.

2.

The threshold values given below generally refer to production capacities or output. Where one operator carries out several activities falling under the same subheading at the same installation or the same site, the capacities of such activities are added together.

II. LIST OF CATEGORIES

Annex III. Best available techniques for controlling emissions of heavy metals and their compounds from the source categories listed in annex II

  • 1. This annex aims to provide Parties with guidance on identifying best available techniques for stationary sources to enable them to meet the obligations of the Protocol. Further description of and guidance on such best available techniques are provided in a guidance document adopted by the Parties at a session of the Executive Body and may be updated as necessary by a consensus of the Parties meeting within the Executive Body.

  • 2. The expression “best available techniques” (BAT) means the most effective and advanced stage in the development of activities and their methods of operation which indicate the practical suitability of particular techniques for providing the basis for emission limit values (and other permit conditions) designed to prevent and, where that is not practicable, to reduce emissions and their impact on the environment as a whole:

    • a) “Techniques” includes both the technology used and the way in which the installation is designed, built, maintained, operated and decommissioned;

    • b) “Available” techniques means those developed on a scale which allows implementation in the relevant industrial sector, under economically and technically viable conditions, taking into consideration the costs and advantages, whether or not the techniques are used or produced inside the territory of the Party in question, as long as they are reasonably accessible to the operator;

    • c) “Best” means most effective in achieving a high general level of protection of the environment as a whole.

  • 3. Criteria for determining BAT are as follows:

    • a) The use of low-waste technology;

    • b) The use of less hazardous substances;

    • c) The furthering of recovery and recycling of substances generated and used in the process and of waste, where appropriate;

    • d) Comparable processes, facilities or methods of operation which have been tried with success on an industrial scale;

    • e) Technological advances and changes in scientific knowledge and understanding;

    • f) The nature, effects and volume of the emissions concerned;

    • g) The commissioning dates for new or existing installations;

    • h) The length of time needed to introduce the best available technique;

    • i) The consumption and nature of raw materials (including water) used in the process and energy efficiency;

    • j) The need to prevent or reduce to a minimum the overall impact of the emissions on the environment and the risks to it;

    • k) The need to prevent accidents and to minimize their consequences for the environment;

    • l) Information published by national and international organizations.

    The concept of BAT is not aimed at the prescription of any specific technique or technology, but at taking into account the technical characteristics of the installation concerned, its geographical location and the local environmental conditions.

  • 4. Experience with new products and new plants incorporating low-emission techniques, as well as with the retrofitting of existing plants, is growing continuously; the guidance document referred to in paragraph 1 may, therefore, need updating.

Annex IV. Timescales for the application of limit values and best available techniques to new and existing stationary sources

  • 1. The timescales for the application of limit values and best available techniques are:

    • a) For new stationary sources: two years after the date of entry into force of the present Protocol for a Party;

    • b) For existing stationary sources: two years after the date of entry into force of the present Protocol for a Party or 31 December 2020, whichever is the later.

  • 2. Notwithstanding paragraph 1, but subject to paragraph 3, a Party to the Convention that becomes a Party to the present Protocol between 1 January 2014, and 31 December 2019, may declare upon ratification, acceptance, approval of, or accession to, the present Protocol that it will extend the timescales for application of the limit values referred to in article 3, paragraph 2 (d) up to 15 years after the date of entry into force of the present Protocol for the Party in question.

  • 3. A Party that has made an election pursuant to article 3 bis of the present Protocol with respect to a particular stationary source category may not also make a declaration pursuant to paragraph 2 applicable to the same source category.

Annex V. Limit values for controlling emissions from major stationary sources

  • 1. Two types of limit value are important for heavy metal emission control:

    • a) Values for specific heavy metals or groups of heavy metals; and

    • b) Values for emissions of particulate matter in general.

  • 2. In principle, limit values for particulate matter cannot replace specific limit values for cadmium, lead and mercury because the quantity of metals associated with particulate emissions differs from one process to another. However, compliance with these limits contributes significantly to reducing heavy metal emissions in general. Moreover, monitoring particulate emissions is generally less expensive than monitoring individual species and continuous monitoring of individual heavy metals is in general not feasible. Therefore, particulate matter limit values are of great practical importance and are also laid down in this annex in most cases to complement specific limit values for cadmium or lead or mercury.

  • 3. Section A applies to Parties other than the United States of America. Section B applies to the United States of America.

A. Parties other than the United States of America

  • 4. In this section only, “dust” means the mass of particles, of any shape, structure or density, dispersed in the gas phase at the sampling point conditions which may be collected by filtration under specified conditions after representative sampling of the gas to be analysed, and which remain upstream of the filter and on the filter after drying under specified conditions.

  • 5. For the purpose of this section, “emission limit value” (ELV) or “limit value” means the quantity of dust and specific heavy metals under this Protocol contained in the waste gases from an installation that is not to be exceeded. Unless otherwise specified, it shall be calculated in terms of mass of pollutant per volume of the waste gases (expressed as mg/m3), assuming standard conditions for temperature and pressure for dry gas (volume at 273.15 K, 101.3 kPa). With regard to the oxygen content of the waste gas, the values given for selected major stationary source categories shall apply. Dilution for the purpose of lowering concentrations of pollutants in waste gases is not permitted. Start-up, shutdown and maintenance of equipment are excluded.

  • 6. Emissions shall be monitored in all cases via measurements or through calculations achieving at least the same accuracy. Compliance with limit values shall be verified through continuous or discontinuous measurements, or any other technically sound method including verified calculation methods. Measurements of relevant heavy metals shall be made at least once every three years for each industrial source. Guidance documents on the methods for undertaking measurements and calculations adopted by the Parties at the session of the Executive Body shall be taken into account. In case of continuous measurements, compliance with the limit value is achieved if the validated monthly emission average does not exceed the ELV. In case of discontinuous measurements or other appropriate determination or calculation procedures, compliance with the ELVs is achieved if the mean value based on an appropriate number of measurements under representative conditions does not exceed the value of the emission standard. The inaccuracy of the measurement methods may be taken into account for verification purposes. Indirect monitoring of substances is also possible via sum parameters/cumulative parameters (e.g., dust as a sum parameter for heavy metals). In some cases using a certain technique to treat emissions can assure a value/limit value is maintained or met.

  • 7. Monitoring of relevant polluting substances and measurements of process parameters, as well as the quality assurance of automated measuring systems and the reference measurements to calibrate those systems, shall be carried out in accordance with CEN standards. If CEN standards are not available, ISO standards, national standards or international standards which will ensure the provisions of data of an equivalent scientific quality shall apply.

  • 9. Special provisions for combustion plants referred to in paragraph 8:

    • a) A Party may derogate from the obligation to comply with the ELVs provided for in paragraph 8 in the following cases:

      • (i) For combustion plants normally using gaseous fuel which have to resort exceptionally to the use of other fuels because of a sudden interruption in the supply of gas and for this reason would need to be equipped with a waste gas purification facility;

      • (ii) For existing combustion plants not operated more than 17,500 operating hours, starting from 1 January 2016 and ending no later than 31 December 2023;

    • b) Where a combustion plant is extended by at least 50 MWth, the ELV specified in paragraph 8 for new installations shall apply to the extensional part affected by the change. The ELV is calculated as an average weighted by the actual thermal input for both the existing and the new part of the plant;

    • c) Parties shall ensure that provisions are made for procedures relating to malfunction or breakdown of the abatement equipment;

    • d) In the case of a multi-fuel firing combustion plant involving the simultaneous use of two or more fuels, the ELV shall be determined as the weighted average of the ELVs for the individual fuels, on the basis of the thermal input delivered by each fuel.

Annex VI. Product control measures

1.

No later than the date of entry into force of the present Protocol for a Party, the lead content of marketed petrol intended for on-road vehicles shall not exceed 0.013 g/l. Parties marketing unleaded petrol with a lead content lower than 0.013 g/l shall endeavour to maintain or lower that level.

2.

Each Party shall endeavour to ensure that the change to fuels with a lead content as specified in paragraph 1 above results in an overall reduction in the harmful effects on human health and the environment.

4.

Notwithstanding paragraph 1, a Party is permitted to market small quantities, up to 0.5 per cent of its total petrol sales, of leaded petrol with a lead content not exceeding 0.15 g/l to be used by old on-road vehicles.

5.

Each Party shall, no later than the date of entry into force of this Protocol for that Party, achieve concentration levels which do not exceed:

  • a) 0.05 per cent of mercury by weight in alkaline manganese batteries for prolonged use in extreme conditions (e.g. temperature below 0°C or above 50°C, exposed to shocks); and

  • b) 0.025 per cent of mercury by weight in all other alkaline manganese batteries.

The above limits may be exceeded for a new application of a battery technology, or use of a battery in a new product, if reasonable safeguards are taken to ensure that the resulting battery or product without an easily removable battery will be disposed of in an environmentally sound manner. Alkaline manganese button cells and batteries composed of button cells shall also be exempted from this obligation.

Annex VII. Product management measures

1.

This annex aims to provide guidance to Parties on product management measures.

2.

The Parties may consider appropriate product management measures such as those listed below, where warranted as a result of the potential risk of adverse effects on human health or the environment from emissions of one or more of the heavy metals listed in annex I, taking into account all relevant risks and benefits of such measures, with a view to ensuring that any changes to products result in an overall reduction of harmful effects on human health and the environment:

  • a) The substitution of products containing one or more intentionally added heavy metals listed in annex I, if a suitable alternative exists;

  • b) The minimization or substitution in products of one or more intentionally added heavy metals listed in annex I;

  • c) The provision of product information including labelling to ensure that users are informed of the content of one or more intentionally added heavy metals listed in annex I and of the need for safe use and waste handling;

  • d) The use of economic incentives or voluntary agreements to reduce or eliminate the content in products of the heavy metals listed in annex I; and

  • e) The development and implementation of programmes for the collection, recycling or disposal of products containing one of the heavy metals in annex I in an environmentally sound manner.

3.

Each product or product group listed below contains one or more of the heavy metals listed in annex I and is the subject of regulatory or voluntary action by at least one Party to the Convention based for a significant part on the contribution of that product to emissions of one or more of the heavy metals in annex I. However, sufficient information is not yet available to confirm that they are a significant source for all Parties, thereby warranting inclusion in annex VI. Each Party is encouraged to consider available information and, where satisfied of the need to take precautionary measures, to apply product management measures such as those listed in paragraph 2 above to one or more of the products listed below:

  • a) Mercury-containing electrical components, i.e. devices that contain one or several contacts/sensors for the transfer of electrical current such as relays, thermostats, level switches, pressure switches and other switches (actions taken include a ban on most mercury-containing electrical components; voluntary programmes to replace some mercury switches with electronic or special switches; voluntary recycling programmes for switches; and voluntary recycling programmes for thermostats);

  • b) Mercury-containing measuring devices such as thermometers, manometers, barometers, pressure gauges, pressure switches and pressure transmitters (actions taken include a ban on mercury-containing thermometers and ban on measuring instruments);

  • c) Mercury-containing fluorescent lamps (actions taken include reductions in mercury content per lamp through both voluntary and regulatory programmes and voluntary recycling programmes);

  • d) Mercury-containing dental amalgam (actions taken include voluntary measures and a ban with exemptions on the use of dental amalgams and voluntary programmes to promote capture of dental amalgam before release to water treatment plants from dental surgeries);

  • e) Mercury-containing pesticides including seed dressing (actions taken include bans on all mercury pesticides including seed treatments and a ban on mercury use as a disinfectant);

  • f) Mercury-containing paint (actions taken include bans on all such paints, bans on such paints for interior use and use on children's toys; and bans on use in antifouling paints); and

  • g) Mercury-containing batteries other than those covered in annex VI (actions taken include reductions in mercury content through both voluntary and regulatory programmes and environmental charges and voluntary recycling programmes).

Executive Body decision 1998/1 on the criteria and procedures for adding heavy metals and products to the Protocol on heavy metals

The Executive Body,

Resolved to act as early as possible to develop criteria and procedures for adding heavy metals and products to the forthcoming protocol on heavy metals,

Adopts with reference to article 13, paragraphs 6 and 7 of the protocol, the criteria and procedures for adding heavy metals and products to annexes I, VI, or VII set out below.

CRITERIA AND PROCEDURES FOR ADDING HEAVY METALS AND PRODUCTS TO ANNEXES I, VI OR VII TO THE PROTOCOL ON HEAVY METALS

1.

A Party submitting a proposal to amend:

  • a) Annex I to add a heavy metal; or

  • b) Annex VI to add a product control measure; or

  • c) Annex VII to add a product or product group

to the protocol in accordance with article 13, paragraph 6, shall provide the Executive Body with information in accordance with paragraphs 2, 3 or 4 below, as appropriate.

2.

Proposals to amend annex I to add a heavy metal shall include:

  • a) A risk profile and the following information:

    • (i) Environmental measurement and source apportionment data in areas remote from anthropogenic sources or data on long-range transboundary atmospheric transport modelling, including methodology, for the species that has known adverse effects which demonstrate the potential for longrange transboundary atmospheric transport;

    • (ii) Partitioning in environmental compartments, bioavailability, transformation processes, biomagnification, and accumulation which demonstrate environmental fate at locations remote from anthropogenic sources; and

    • (iii) Toxicity data which demonstrate the potential to cause adverse effects on human health or the environment;

  • b) Information, as available, on:

    • (i) Production/use/emissions;

    • (ii) Proposed control measures (e.g. technological equipment, process modification, and alternatives);

    • (iii) The efficacy, applicability, risks and the quantifiable and non-monetary costs and benefits of the proposed controle measures and alternatives; and

    • (iv) The handling and disposal of the heavy metal resulting from the control measures.

3.

Proposals to amend annex VI to add a product control measure shall include:

  • a) A description of:

    • (i) The product or product group, including its Harmonized Tariff Code, if applicable, to be subject to the control measure; and

    • (ii) The proposed product control measure;

  • b) Information, as available, on:

    • (i) The manufacture, use and disposal of the product or product group to be subject to the control measure;

    • (ii) The contribution of the product or product group to the total emissions of a heavy metal listed in annex I within the territory of the Party to the Convention and the UN/ECE region as a whole prior to any product management measure to reduce such contribution and the methodology used; and

    • (iii) The efficacy, applicability, risks and quantifiable and non-monetary costs and benefits of taking the proposed measure.

4.

Proposals to amend annex VII to add a product or product group shall include:

  • a) A description of:

    • (i) The action taken by any Party to the Convention to reduce emissions to the atmosphere from the product or product group; and

    • (ii) The product or product group, including its Harmonized Tariff Code, if applicable, which is subject to the action taken;

  • b) Information, as available, on:

    • (i) The contribution of the product or product group to the total emissions of a heavy metal listed in annex I within the territory of the Party to the Convention and the UN/ECE region as a whole prior to any product management measure to reduce such contribution and the methodology used; and

    • (ii) The rationale for the action taken, including the perceived risk and the cost or benefit of such a measure and the emission reduction achieved.

5.

Upon receipt of a proposal prepared in accordance with paragraph 2, 3, or 4 above, and if the risk profile is deemed acceptable, the Parties shall, at a meeting of the Executive Body and by consensus, ensure that one or more technical reviews of the proposal are conducted if, on the basis of the proposal and any other relevant information submitted to the Executive Body, further consideration of the heavy metal, product, product group or product control measure is determined to be warranted. Any such technical reviews shall be in writing and evaluate:

  • a) For addition of a heavy metal to annex I:

    • (i) The monitoring or equivalent scientific evidence documenting long-range transboundary atmospheric transport from anthropogenic sources;

    • (ii) Whether emissions to the atmosphere of the heavy metal have the potential to lead to a bioavailable form which can accumulate or biomagnify to harmful levels;

    • (iii) Whether sufficient information exists that the levels resulting from the long-range transboundary atmospheric transport of the heavy metal have the potential to cause significant adverse effects on human health or the environment;

    • (iv) Information concerning the sources of the heavy metal in the atmosphere, including the use of products, estimates of the total emissions from these sources and the methodologies used; and

    • (v) Whether measures exist to reduce the risk of adverse effects on human health and/or the environment as a result of its long-range transboundary atmospheric transport, and whether they are technically feasible, as well as their associated effects and costs;

  • b) For addition of a product controle measure to annex VI:

    • (i) Whether the product or product group intentionally contains one or more of the heavy metals specified in annex I;

    • (ii) Whether atmospheric emissions occurring during manufacture, processing, distribution in commerce, use, and disposal of the product or product group, have the potential to lead to a bioavailable form and, taking into account controls in place at each point of this process, account for a significant contribution to total transboundary atmospheric emissions of a heavy metal specified in annex I within the UN/ECE region that cause adverse effects on human health or the environment; and

    • (iii) The extent to which the proposed measure reduces emissions, and an assessment of its costs, benefits, and, as appropriate, its efficacy and risks or the extent to which suitable alternative measures exist;

  • c) For addition of a product or product group to annex VII:

    • (i) Whether it intentionally contains one or more of the heavy metals specified in annex I;

    • (ii) The action taken by any Party to the Convention and its estimated efficiency in reducing emissions to the atmosphere of the heavy metal;

    • (iii) The rationale, emissions reduction, costs and benefits of this action; and

    • (iv) Whether its atmospheric emissions have the potential to lead to a bioavailable form, occurring during its manufacture, processing, distribution in commerce, use, and disposal, and taking into account controls in place at each point of this process, account for a significant contribution to total atmospheric emissions of a heavy metal specified in annex I within the territory of the Party to the Convention that cause adverse effects on human health or the environment.

The term risk profile mentioned in paragraphs 2 and 5 above refers to a comprehensive review of the scientific information related to the determination of general human health and environmental risks associated with the uses and releases of a substance. Such a review need not explicitly address risks associated with long-range transboundary air pollution, but must provide suitable information for the assessment of such risk.

7.

On the basis of the submission specified in paragraph 2, 3, or 4 above and any technical reviews that may have been prepared in accordance with paragraph 5 above, the Parties shall, at a meeting of the Executive Body, complete their evaluation of the proposal taking into account the objective of the protocol set out in article 2.

De Partijen,

Vastbesloten het Verdrag betreffende grensoverschrijdende luchtverontreiniging over lange afstand uit te voeren,

Verontrust vanwege het feit dat emissies van bepaalde zware metalen over nationale grenzen heen worden meegevoerd en schade kunnen veroorzaken aan ecosystemen die voor het milieu en de economie van belang zijn, en schadelijke gevolgen voor de gezondheid van de mens kunnen hebben,

Overwegende dat verbranding en industriële processen de voornaamste antropogene bronnen vormen van emissies van zware metalen in de lucht,

Erkennend dat zware metalen natuurlijke bestanddelen van de aardkorst vormen en dat veel zware metalen in bepaalde vormen en geschikte concentraties voor het leven van essentieel belang zijn,

In overweging nemend de bestaande wetenschappelijke en technische gegevens inzake emissies, geochemische processen, atmosferische bewegingen en effecten van zware metalen op de volksgezondheid en het milieu alsook inzake de kosten en technieken van bestrijding,

Zich ervan bewust dat technieken en beheerspraktijken beschikbaar zijn om door de emissies van zware metalen veroorzaakte luchtverontreiniging te beperken,

Erkennend dat de economische omstandigheden van de landen in de regio van de Economische Commissie voor Europa van de Verenigde Naties (VN/ECE) verschillen en dat in bepaalde landen de economie zich in een overgangsfase bevindt,

Met het vaste voornemen voorzorgsmaatregelen te treffen teneinde emissies van bepaalde zware metalen en verbindingen ervan voor te zijn, deze te vermijden of tot een minimum terug te brengen, rekening houdend met de toepassing van de aanpak volgens het voorzorgsbeginsel, zoals bedoeld in beginsel 15 van de Verklaring van Rio inzake milieu en ontwikkeling,

Nogmaals bevestigend dat de Staten, overeenkomstig het Handvest van de Verenigde Naties en de beginselen van internationaal recht, het soevereine recht hebben hun eigen hulpbronnen te exploiteren volgens hun eigen milieu- en ontwikkelingsbeleid alsmede ervoor verantwoordelijk zijn dat activiteiten die onder hun rechtsmacht of toezicht worden verricht, geen schade veroorzaken aan het milieu van andere Staten of van gebieden die buiten de grenzen van de nationale rechtsmacht vallen,

Indachtig het feit dat maatregelen ter beheersing van emissies van zware metalen tevens zouden bijdragen tot de bescherming van het milieu en de volksgezondheid in gebieden buiten de VN/ECE-regio, met inbegrip van de arctische en internationale wateren,

Erop wijzend dat bestrijding van de emissies van specifieke zware metalen extra voordelen voor de bestrijding van emissies van andere verontreinigende stoffen kan opleveren,

In het besef dat verdergaande en doeltreffendere maatregelen ter beheersing en vermindering van de emissies van bepaalde zware metalen noodzakelijk kunnen zijn en dat bijvoorbeeld effectstudies een grondslag voor verdere maatregelen kunnen verschaffen,

Wijzend op de belangrijke bijdrage van de particuliere en de niet-gouvernementele sector aan de kennis van de effecten van zware metalen, beschikbare alternatieven en bestrijdingstechnieken alsook op de rol die zij mede spelen bij de vermindering van emissies van zware metalen,

Indachtig de activiteiten in verband met de beheersing van zware metalen op nationaal niveau en in internationale forums,

Zijn overeengekomen als volgt:

Artikel 1. Begripsomschrijvingen

Voor de toepassing van dit Protocol wordt verstaan onder:

  • 1. „Verdrag” het Verdrag betreffende grensoverschrijdende luchtverontreiniging over lange afstand, aangenomen te Genève op 13 november 1979;

  • 2. „EMEP” het programma voor samenwerking inzake de bewaking en evaluatie van het transport van luchtverontreinigende stoffen over lange afstand in Europa;

  • 3. „Uitvoerend orgaan” het uitvoerend orgaan voor het Verdrag, opgericht ingevolge artikel 10, eerste lid, van het Verdrag;

  • 4. „Commissie” de Economische Commissie voor Europa van de Verenigde Naties;

  • 5. „Partijen” tenzij in de context anders bedoeld, de Partijen bij dit Protocol;

  • 6. „Geografische reikwijdte van het EMEP” het gebied, als omschreven in artikel 1, vierde punt, van het Protocol bij het Verdrag van 1979 betreffende grensoverschrijdende luchtverontreiniging over lange afstand aangaande de langlopende financiering van het programma voor samenwerking inzake de bewaking en evaluatie van het transport van luchtverontreinigende stoffen over lange afstand in Europa (EMEP), aangenomen te Genève op 28 september 1984;

  • 7. „Zware metalen” alle metalen of, in bepaalde gevallen, metalloïden die stabiel zijn en waarvan de dichtheid meer bedraagt dan 4.5 g/cm3, en verbindingen daarvan;

  • 8. „Emissie” uitstoot in de atmosfeer vanuit een punt of een diffuse bron;

  • 9. „Stationaire bron” alle vaste gebouwen, constructies, inrichtingen, installaties of apparaten die een in bijlage I vermeld zwaar metaal direct of indirect in de atmosfeer uitstoten of kunnen uitstoten;

  • 10. „Nieuwe stationaire bron” een stationaire bron met de bouw of ingrijpende wijziging waarvan een aanvang is gemaakt na het verstrijken van twee jaar na de datum van inwerkingtreding van onderhavig Protocol voor een Partij. Een Partij kan besluiten een stationaire bron niet als nieuwe stationaire bron te behandelen indien voor deze bron reeds toestemming is gegeven door de desbetreffende bevoegde nationale autoriteit ten tijde van de inwerkingtreding van het Protocol voor die Partij en op voorwaarde dat binnen vijf jaar na die datum is begonnen met de bouw of ingrijpende wijziging. Het is aan de bevoegde nationale autoriteiten om te beslissen of een wijziging al dan niet ingrijpend is, rekening houdend met factoren als de voordelen van de wijziging in milieuopzicht;

  • 11. „Belangrijke categorie van stationaire bronnen” een in bijlage II vermelde categorie van stationaire bronnen die ten minste 1% bijdraagt aan de totale nationale emissies van een in bijlage I vermeld zwaar metaal uit stationaire bronnen, overeenkomstig het in bijlage I opgegeven referentiejaar;

  • 12. „dit Protocol”, „het Protocol” en „het onderhavige Protocol”: het Protocol van 1998 inzake zware metalen, zoals van tijd tot tijd gewijzigd.

Artikel 2. Doel

Het doel van dit Protocol is het beheersen van door antropogene activiteiten veroorzaakte emissies van zware metalen die voor grensoverschrijdend atmosferisch transport over lange afstand vatbaar zijn en die belangrijke schadelijke gevolgen voor de volksgezondheid of het milieu kunnen hebben, in overeenstemming met het bepaalde in de volgende artikelen.

Artikel 3. Basisverplichtingen

  • 1 De Partijen nemen doeltreffende maatregelen, die aan hun bijzondere omstandigheden zijn aangepast, ter vermindering van hun totale jaarlijkse emissies in de atmosfeer van elk in bijlage I vermeld zwaar metaal ten opzichte van het emissieniveau in het overeenkomstig die bijlage vastgestelde referentiejaar.

  • 2 Met inachtneming van de leden 2 bis en ter passen de Partijen uiterlijk op de in bijlage IV vermelde tijdstippen het volgende toe:

    • a. De beste beschikbare technieken, rekening houdend met bijlage III, op elke nieuwe stationaire bron binnen een belangrijke categorie van stationaire bronnen waarvoor de leidraad aangenomen door de Partijen tijdens een zitting van het uitvoerend orgaan de beste beschikbare technieken vermeldt;

    • b. De in bijlage V vermelde grenswaarden op elke nieuwe stationaire bron binnen een belangrijke categorie van stationaire bronnen. Bij wijze van alternatief kan een partij verschillende strategieën ter vermindering van emissies toepassen die in totaal equivalente emissieniveaus opleveren;

    • c. De beste beschikbare technieken, rekening houdend met bijlage III, op elke bestaande stationaire bron binnen een belangrijke categorie van stationaire bronnen waarvoor de leidraad aangenomen door de Partijen tijdens een zitting van het uitvoerend orgaan de beste beschikbare technieken vermeldt. Bij wijze van alternatief kan een partij andere strategieën voor emissievermindering toepassen die in totaal gelijkwaardige emissie-verminderingen opleveren;

    • d. De in bijlage V vermelde grenswaarden op elke bestaande stationaire bron binnen een belangrijke categorie van stationaire bronnen, voor zover dit technisch uitvoerbaar en economisch verantwoord is. Bij wijze van alternatief kan een partij andere strategieën voor emissievermindering toepassen die in totaal gelijkwaardige emissieverminderingen opleveren.

  • 2 bis Een Partij die reeds Partij was bij het onderhavige Protocol voor de inwerkingtreding van een wijziging waarmee nieuwe broncategorieën werden ingevoerd mag de grenswaarden die van toepassing zijn op een „bestaande stationaire bron” toepassen op elke bron in een nieuwe broncategorie met de bouw of ingrijpende wijziging waarvan een aanvang is gemaakt voor het verstrijken van twee jaar na de datum van inwerkingtreding van die wijziging voor die Partij, tenzij en totdat die bron nadien een ingrijpende wijziging ondergaat.

  • 2 ter Een Partij die reeds Partij was bij het onderhavige Protocol voor de inwerkingtreding van een wijziging waarmee nieuwe grenswaarden werden ingevoerd die van toepassing zijn op een „nieuwe stationaire bron” mag de daarvoor reeds van toepassing zijnde grenswaarden blijven toepassen op elke bron met de bouw of ingrijpende wijziging waarvan een aanvang is gemaakt voor het verstrijken van twee jaar na de datum van inwerkingtreding van die wijziging voor die Partij, tenzij en totdat die bron nadien een ingrijpende wijziging ondergaat.

  • 3 De Partijen passen maatregelen voor productbeheersing toe in overeenstemming met de in bijlage VI vermelde voorwaarden en tijdschema's.

  • 4 De Partijen nemen de toepassing van aanvullende maatregelen inzake productbeheer in overweging, rekening houdend met bijlage VII.

  • 5 De Partijen maken voor de in bijlage I vermelde zware metalen emissie-inventarisaties op en houden deze bij. Partijen binnen de geografische reikwijdte van het EMEP gebruiken de methoden die omschreven staan in de leidraad die is opgesteld door het bestuursorgaan van het EMEP en aangenomen door de Partijen tijdens een zitting van het uitvoerend orgaan. Partijen in gebieden buiten de geografische reikwijdte van het EMEP gebruiken de methoden die op basis van het werkplan van het uitvoerend orgaan zijn ontwikkeld, als richtlijn.

  • 6 Een Partij die na toepassing van de leden 2 en 3 voor een in bijlage I vermeld zwaar metaal niet aan het in lid 1 vereiste kan voldoen, wordt vrijgesteld van de in lid 1 bedoelde verplichtingen voor dat zware metaal.

  • 7 Een Partij waarvan het totale grondoppervlak groter is dan 6.000.000 km2, wordt vrijgesteld van de verplichtingen in lid 2, onder b, c, en d, indien zij kan aantonen dat uiterlijk acht jaar na de datum van inwerkingtreding van dit Protocol zij haar totale jaarlijkse emissies van elk van de in bijlage I vermelde zware metalen uit de in bijlage II vermelde broncategorieën met ten minste 50% zal hebben verminderd ten opzichte van het emissieniveau van deze categorieën in het overeenkomstig bijlage I opgegeven referentiejaar. Een partij die voornemens is in overeenstemming met het bepaalde in dit lid te handelen, geeft dit te kennen bij de ondertekening van of toetreding tot dit Protocol.

  • 8 Elke Partij dient actief deel te nemen aan programma’s uit hoofde van het Verdrag over de gevolgen van luchtverontreiniging voor de menselijke gezondheid en het milieu en programma’s voor luchtmonitoring en atmosferische modellering.

Artikel 3 bis. Flexibele overgangsregelingen

  • 1 Onverminderd artikel 3, lid 2, onder c en d, kan een Partij bij het Verdrag die tussen 1 januari 2014 en 31 december 2019 Partij wordt bij het onderhavige Protocol, flexibele overgangsregelingen toepassen voor de implementatie van de beste beschikbare technieken en de waarden beperken tot bestaande stationaire bronnen in specifieke stationaire broncategorieën onder de voorwaarden omschreven in dit artikel.

  • 2 Een Partij die kiest voor toepassing van de flexibele overgangsregelingen ingevolge dit artikel dient in haar akte van bekrachtiging, aanvaarding of goedkeuring van of toetreding tot het onderhavige Protocol het volgende te vermelden:

    • a. de specifieke broncategorieën vermeld in bijlage II waarvoor de Partij besluit flexibele overgangsregelingen toe te passen, op voorwaarde dat ten hoogste vier van deze categorieën mogen worden vermeld;

    • b. de stationaire bronnen waarvan de bouw of laatste ingrijpende wijziging is aangevangen voor 1990 of in een ander jaar uit de periode van 1985 tot en met 1995, door de Partij vermeld bij de bekrachtiging, aanvaarding, goedkeuring of toetreding, die in aanmerking komen voor flexibele overgangsregelingen, zoals vervat in lid 5; en

    • c. een implementatieplan dat voldoet aan de leden 3 en 4 en een tijdschema bevat voor de volledige implementatie van de omschreven bepalingen.

  • 3 Elke Partij past uiterlijk acht jaar na de inwerkingtreding van het onderhavige Protocol voor die Partij of op 31 december 2022, naar gelang van welke datum het eerst is, ten minste de beste beschikbare technieken toe voor bestaande stationaire bronnen van de categorieën 1, 2, 5 en 7 van bijlage II, behalve zoals bepaald in lid 5.

  • 4 In geen geval mag de toepassing door een Partij van de beste beschikbare technieken of grenswaarden voor bestaande stationaire bronnen worden uitgesteld tot na 31 december 2030.

  • 5 Ten aanzien van een bron of bronnen aangewezen uit hoofde van lid 2, onder b, kan een Partij uiterlijk acht jaar na de inwerkingtreding van het onderhavige Protocol voor die Partij of op 31 december 2022, naar gelang van welke datum het eerst is, besluiten dat deze bron of bronnen worden gesloten. Van deze bronnen wordt een lijst verstrekt die deel uitmaakt van het volgende rapport van de Partij uit hoofde van lid 6. De vereisten voor de toepassing van beste beschikbare technieken en grenswaarden zijn niet van toepassing op deze bron of bronnen, mits deze bron of bronnen uiterlijk 31 december 2030 worden gesloten. Voor bronnen die op die datum niet gesloten zijn, dient de Partij daarna de beste beschikbare technieken en grenswaarden te hanteren die van toepassing zijn op nieuwe bronnen in de desbetreffende categorie.

  • 6 Een Partij die besluit de flexibele overgangsregelingen uit hoofde van dit artikel toe te passen doet de uitvoerend secretaris van de Commissie driejaarlijkse rapporten toekomen van haar voortgang met de implementatie van de beste beschikbare technieken en grenswaarden voor de stationaire bronnen in de uit hoofde van dit artikel geïdentificeerde categorieën van stationaire bronnen. De uitvoerend secretaris van de Commissie stelt deze driejaarlijkse rapporten beschikbaar aan het uitvoerend orgaan.

Artikel 4. Uitwisseling van informatie en technologie

  • 1 De Partijen vergemakkelijken, in overeenstemming met hun nationale wetten, voorschriften en gewoonten, de uitwisseling van technologieën en technieken ter vermindering van emissies van zware metalen, met inbegrip van, maar niet beperkt tot uitwisselingen die de ontwikkeling van maatregelen inzake productbeheer en de toepassing van de beste beschikbare technieken aanmoedigen, met name door het bevorderen van:

    • a. Commerciële uitwisseling van beschikbare technologie;

    • b. Rechtstreekse contacten en samenwerking tussen industrieën, met inbegrip van gezamenlijke ondernemingen (joint ventures);

    • c. Uitwisseling van informatie en ervaring;

    • d. Verlening van technische bijstand.

  • 2 Ter bevordering van de in het eerste lid van dit artikel genoemde activiteiten scheppen de Partijen gunstige voorwaarden door contacten en samenwerking te vergemakkelijken tussen daarvoor in aanmerking komende organisaties en personen in de particuliere en de openbare sector die technologie, ontwerp- en constructiediensten, apparatuur of financiële middelen kunnen verschaffen.

Artikel 5. Strategieën, beleidslijnen, programma's en maatregelen

  • 1 De Partijen stellen zonder onnodig uitstel strategieën, beleidslijnen en programma's op, teneinde hun verplichtingen ingevolge dit Protocol na te komen.

  • 2 Een partij kan bovendien:

    • a. Economische instrumenten hanteren ter stimulering van een kosteneffectieve aanpak voor de vermindering van emissies van zware metalen;

    • b. Convenanten en vrijwillige overeenkomsten tussen regering en bedrijfsleven tot stand brengen;

    • c. Efficiënter gebruik van hulpbronnen en grondstoffen stimuleren;

    • d. Het gebruik van minder vervuilende energiebronnen aanmoedigen;

    • e. Maatregelen nemen om minder vervuilende transportsystemen tot ontwikkeling te brengen en in te voeren;

    • f. Maatregelen nemen met het oog op het geleidelijk uitfaseren van processen waarbij zware metalen worden uitgestoten en waarvoor vervangingsprocessen op industriële schaal beschikbaar zijn;

    • g. Maatregelen nemen om schonere processen voor de preventie en beheersing van verontreiniging te ontwikkelen en toe te passen.

  • 3 De Partijen kunnen strengere maatregelen nemen dan die welke in dit Protocol zijn voorgeschreven.

Artikel 6. Onderzoek, ontwikkeling en monitoring

De Partijen stimuleren onderzoek, ontwikkeling, monitoring en samenwerking, die vooral worden toegespitst op de in bijlage I vermelde zware metalen, met betrekking maar niet beperkt tot:

  • a. Emissies, transport over lange afstand en depositieniveaus en hun modellering daarvan, bestaande niveaus in het biotische en abiotische milieu, formulering van procedures voor harmonisatie van desbetreffende methodologieën;

  • b. Verspreiding en inventarisatie van verontreinigende stoffen in representatieve ecosystemen;

  • c. Relevante effecten op de volksgezondheid en het milieu, met kwantificering van die effecten;

  • d. Beste beschikbare technieken en praktijken en momenteel door de Partijen toegepaste of ontwikkelde technieken voor emissiebeperking;

  • e. Inzameling, recycling en, indien nodig, verwijdering van producten of afvalstoffen die één of meer zware metalen bevatten;

  • f. Methoden die het mogelijk maken bij de beoordeling van alternatieve beheersingsstrategieën rekening te houden met sociaal-economische factoren;

  • g. Een op de effecten gebaseerde aanpak waarbij relevante informatie, met inbegrip van informatie die ingevolge de punten a tot en met f is verkregen, inzake gemeten of met een model berekende niveaus in het milieu, verspreiding en effecten op de volksgezondheid en het milieu, teneinde toekomstige geoptimaliseerde beheersingsstrategieën te formuleren, waarbij eveneens rekening wordt gehouden met economische en technologische factoren;

  • h. Alternatieven voor het gebruik van zware metalen in producten die in de bijlagen VI en VII zijn vermeld;

  • i. Verzameling van informatie over niveaus van zware metalen in bepaalde producten, over de mogelijkheid dat emissies van deze metalen ontstaan bij productie, verwerking, distributie, gebruik en verwijdering van het product en over technieken om die emissies te beperken.

Artikel 7. Verslaglegging

  • 1 Met inachtneming van de wetgeving betreffende de vertrouwelijkheid van commerciële informatie:

    • a. Verstrekt elke Partij, via de uitvoerend secretaris van de Commissie, met een tijdens een zitting van het uitvoerend orgaan door de Partijen vastgestelde regelmaat, aan het uitvoerend orgaan informatie over de maatregelen die zij heeft genomen om dit Protocol ten uitvoer te leggen. Voorts:

      • i. wanneer een Partij verschillende strategieën ter vermindering van emissies uit hoofde van artikel 3, lid 2, onder b, c of d toepast, dient zij de toegepaste strategieën vast te leggen en aan te geven of zij voldaan heeft aan de daarin vervatte vereisten;

      • ii. indien een Partij oordeelt dat de toepassing van bepaalde grenswaarden, zoals omschreven in overeenstemming met artikel 3, lid 2, onder d, technisch en economisch onhaalbaar zijn, dient zij dit te rapporteren en te onderbouwen;

    • b. Verstrekt elke Partij binnen de geografische reikwijdte van het EMEP, via de uitvoerend secretaris van de Commissie, aan het EMEP informatie over de emissieniveaus van de in bijlage I vermelde zware metalen, waarbij gebruik wordt gemaakt van de methoden omschreven in de door het bestuursorgaan van het EMEP opgestelde richtlijnen en aangenomen door de Partijen tijdens een zitting van het uitvoerend orgaan. Partijen in gebieden buiten de geografische reikwijdte van het EMEP stellen informatie over de emissieniveaus van de in bijlage I vermelde zware metalen beschikbaar. Elke Partij verstrekt bovendien informatie betreffende de emissieniveaus van andere stoffen vermeld in bijlage I voor het in die bijlage vermelde referentiejaar;

    • c. Verstrekt elke Partij binnen de geografische reikwijdte van het EMEP, via de uitvoerend secretaris van de Commissie, aan het uitvoerend orgaan de beschikbare informatie over haar programma's inzake de gevolgen van luchtverontreiniging voor de menselijke gezondheid en het milieu en programma's voor luchtmonitoring en atmosferische modellering ingevolge het Verdrag, gebruikmakend van de door het uitvoerend orgaan aangenomen richtlijnen;

    • d. Partijen in gebieden buiten de geografische reikwijdte van het EMEP maken informatie beschikbaar die vergelijkbaar is met die omschreven onder c, indien hen daarom door het uitvoerend orgaan wordt verzocht.

  • 2 De overeenkomstig lid 1, onder a, te verstrekken informatie moet in overeenstemming zijn met het tijdens een zitting van het uitvoerend orgaan door de Partijen aan te nemen besluit betreffende vorm en inhoud. De bepalingen van dit besluit worden indien nodig nader bezien, teneinde na te gaan of aanvullende elementen betreffende de vorm of de inhoud van de informatie in de rapporten moeten worden opgenomen.

  • 3 Op verzoek van en in overeenstemming met de tijdschema’s vastgesteld door het uitvoerend orgaan en andere hulporganen verstrekt het EMEP relevante informatie over het transport over lange afstand en de depositie van zware metalen.

Artikel 8. Berekeningen

Op verzoek van en in overeenstemming met de tijdschema's vastgesteld door het uitvoerend orgaan, verstrekken het EMEP en zijn technische organen en centra, met gebruikmaking van passende modellen en metingen, berekeningen van grensoverschrijdende stromen en deposities van zware metalen binnen de geografische reikwijdte van het EMEP. In gebieden buiten de geografische reikwijdte van het EMEP worden modellen gebruikt die passen bij de bijzondere omstandigheden van de Partijen bij het Verdrag in die gebieden.

Artikel 9. Naleving

De naleving door elke Partij van haar uit dit Protocol voortvloeiende verplichtingen wordt op gezette tijden getoetst. Het bij Besluit 1997/2 van het uitvoerend orgaan op zijn 15e zitting ingestelde implementatiecomité is belast met die toetsingen en brengt verslag uit aan de Partijen op zittingen van het uitvoerend orgaan overeenkomstig de bepalingen van de bijlage bij dat besluit, met inbegrip van eventuele wijzigingen daarvan.

Artikel 10. Toetsing door de Partijen op zittingen van het uitvoerend orgaan

  • 1 Op zittingen van het uitvoerend orgaan toetsen de Partijen overeenkomstig artikel 10, lid 2, onder a, van het Verdrag de door de Partijen, het EMEP en andere afhankelijke instanties verstrekte informatie en de verslagen van het implementatiecomité, als bedoeld in artikel 9 van dit Protocol.

  • 2 Op zittingen van het uitvoerend orgaan onderwerpen de Partijen de voortgang in het nakomen van de in dit Protocol vermelde verplichtingen aan een toetsing.

  • 3 Op zittingen van het uitvoerend orgaan onderwerpen de Partijen de adequaatheid en de doeltreffendheid van de in dit Protocol vermelde verplichtingen aan een toetsing.

    • a. Bij de toetsingen wordt rekening gehouden met de beste beschikbare wetenschappelijke gegevens over de gevolgen van de depositie van zware metalen, evaluaties van technologische ontwikkelingen en veranderende economische omstandigheden;

    • b. Bij de toetsingen wordt in het licht van ingevolge dit Protocol ondernomen onderzoek, ontwikkeling, monitoring en samenwerking:

      • i. de voortgang bij het verwezenlijken van de doelstelling van dit Protocol beoordeeld;

      • ii. beoordeeld of verdere emissieverminderingen dan de door dit Protocol vereiste niveaus gerechtvaardigd zijn om de nadelige effecten op de volksgezondheid of het milieu verder te beperken;

      • iii. rekening gehouden met de mate waarin een toereikende basis bestaat voor de toepassing van een op de effecten gebaseerde aanpak;

    • c. De procedures, de methoden en het tijdschema voor deze toetsingen worden nader bepaald door de Partijen op een zitting van het uitvoerend orgaan.

  • 4 Op basis van de conclusie van de in lid 3 bedoelde toetsingen overwegen de Partijen zo spoedig mogelijk na voltooiing van de toetsing een werkprogramma op te stellen met verdere maatregelen

Artikel 11. Beslechting van geschillen

  • 1 In geval van een geschil tussen twee of meer Partijen betreffende de uitleg of toepassing van dit Protocol trachten de betrokken Partijen het geschil te beslechten door middel van onderhandelingen of op een andere vreedzame wijze van hun eigen keuze. De Partijen bij het geschil stellen het uitvoerend orgaan in kennis van hun geschil.

  • 2 Bij de bekrachtiging, aanvaarding of goedkeuring van dan wel toetreding tot dit Protocol of op enig tijdstip daarna kan een Partij die geen regionale organisatie voor economische integratie is, in een schriftelijke bij de depositaris ingediende akte verklaren dat zij, met betrekking tot een geschil betreffende de uitleg of toepassing van het Protocol, beide onderstaande wijzen van geschillenbeslechting of een daarvan ipso facto en zonder bijzondere overeenkomst als dwingend erkent ten opzichte van elke Partij die dezelfde verplichting aanvaardt:

    • a. Voorlegging van het geschil aan het Internationale Gerechtshof;

    • b. Arbitrage in overeenstemming met procedures die zo spoedig mogelijk door de Partijen op een zitting van het uitvoerend orgaan moeten worden aangenomen in een bijlage inzake arbitrage.

    Een Partij die een regionale organisatie voor economische integratie is, kan een verklaring van gelijke strekking met betrekking tot arbitrage afleggen in overeenstemming met de onder b bedoelde procedures.

  • 3 Een ingevolge lid 2 afgelegde verklaring blijft van kracht totdat zij overeenkomstig haar bepalingen haar geldigheid verliest dan wel tot drie maanden nadat een schriftelijke kennisgeving van opzegging is nedergelegd bij de depositaris.

  • 4 Een nieuwe verklaring, een kennisgeving van opzegging of het vervallen van de geldigheid van een verklaring zijn op generlei wijze van invloed op de procedure voor het Internationale Gerechtshof of het scheidsgerecht, tenzij de Partijen bij het geschil anders overeenkomen.

  • 5 Indien de Partijen bij het geschil, behalve ingeval de betrokken Partijen dezelfde wijze van geschillenbeslechting overeenkomstig lid 2 hebben aanvaard, er na twaalf maanden te rekenen vanaf de kennisgeving van de ene Partij aan de andere dat tussen hen een geschil bestaat, niet in zijn geslaagd hun geschil te beslechten op de in lid 1 bedoelde wijzen, wordt het geschil op verzoek van een van de Partijen bij het geschil onderworpen aan een conciliatie.

  • 6 Voor de toepassing van lid 5 wordt een conciliatiecommissie opgericht. De commissie bestaat uit een gelijk aantal leden, die zijn benoemd door elke betrokken Partij of, wanneer bij de conciliatie betrokken Partijen eenzelfde belang hebben, door de groep die datzelfde belang heeft, en een voorzitter die door de aldus benoemde leden gezamenlijk is gekozen. De commissie doet uitspraak in de vorm van een aanbeveling, die de Partijen te goeder trouw in overweging nemen.

Artikel 12. Bijlagen

De bijlagen bij dit Protocol vormen een integrerend deel van het Protocol. De bijlagen III en VII dragen het karakter van een aanbeveling.

Artikel 13. Wijzigingen van het Protocol

  • 1 Elke Partij kan wijzigingen in dit Protocol voorstellen.

  • 2 Voorgestelde wijzigingen worden schriftelijk ingediend bij de uitvoerend secretaris van de Commissie, die ze aan alle Partijen bekendmaakt. De Partijen bespreken de voorgestelde wijzigingen op de eerstvolgende zitting van het uitvoerend orgaan, op voorwaarde dat deze voorstellen ten minste 90 dagen van tevoren door de uitvoerend secretaris aan de Partijen zijn toegezonden.

  • 3 Wijzigingen in dit Protocol anders dan in de bijlagen III en VII worden bij consensus aangenomen door de Partijen die aanwezig zijn op een zitting van het uitvoerend orgaan, en worden voor de Partijen die ze hebben aanvaard van kracht op de negentigste dag na de datum waarop twee derde van degenen die Partij waren ten tijde van de aanneming ervan hun akte van aanvaarding daarvan heeft nedergelegd bij de depositaris. Voor elke andere Partij worden wijzigingen van kracht op de negentigste dag na de datum waarop die Partij haar akte van aanvaarding daarvan heeft nedergelegd.

  • 4 Wijzigingen in de bijlagen III en VII worden bij consensus aangenomen door de Partijen die aanwezig zijn op een zitting van het uitvoerend orgaan. Na het verstrijken van 180 dagen na de datum van bekendmaking daarvan aan alle Partijen door de uitvoerend secretaris van de Commissie wordt een wijziging in bedoelde bijlagen van kracht voor de Partijen die geen kennisgeving als bedoeld in lid 5 van dit artikel bij de depositaris hebben ingediend, op voorwaarde dat ten minste zestien Partijen niet een dergelijke kennisgeving hebben ingediend.

  • 5 Een Partij die een wijziging in bijlage III of VII niet kan goedkeuren, stelt de depositaris daarvan schriftelijk in kennis binnen 180 dagen na de datum van bekendmaking van de aanneming. De depositaris stelt alle Partijen onverwijld in kennis van de ontvangst van dergelijke kennisgevingen. Een Partij kan te allen tijde een aanvaarding in de plaats stellen van haar eerdere kennisgeving en na nederlegging van een akte van aanvaarding bij de depositaris wordt de wijziging in die bijlage dan terstond van kracht voor die Partij.

  • 5 bis Voor de Partijen die haar hebben aanvaard, treedt de procedure vervat in lid 5 ter in de plaats van de procedure vervat in lid 3 ter zake van wijzigingen van de bijlagen II, IV, V en VI.

  • 5 ter Wijzigingen van de bijlagen II, IV, V en VI worden bij consensus aangenomen door de Partijen die aanwezig zijn bij een zitting van het uitvoerend orgaan. Na het verstrijken van een jaar na de datum van de mededeling ervan aan alle Partijen door de uitvoerend secretaris van de Commissie, wordt een wijziging van een dergelijke bijlage van kracht voor de Partijen die geen kennisgeving in overeenstemming met de bepalingen onder a bij de depositaris hebben ingediend:

    • a. Een Partij die een wijziging van de bijlagen II, IV, V en VI niet kan goedkeuren, stelt de depositaris daarvan, binnen een jaar na de datum van mededeling omtrent de aanneming ervan, schriftelijk in kennis. De depositaris stelt alle Partijen onverwijld in kennis van elke ontvangen kennisgeving. Een Partij kan haar eerdere kennisgeving te allen tijde vervangen door een aanvaarding en bij de nederlegging bij de depositaris van een akte van aanvaarding wordt de wijziging van die bijlage voor die Partij van kracht;

    • b. Een wijziging van de bijlagen II, IV, V en VI wordt niet van kracht indien in totaal 16 of meer Partijen:

      • i. een kennisgeving in overeenstemming met de bepalingen onder a hebben ingediend; of

      • ii. de procedure vervat in dit lid niet hebben aanvaard en nog geen akte van aanvaarding in overeenstemming met de bepalingen van lid 3 hebben nedergelegd.

  • 6 Indien een voorstel tot wijziging van bijlage I, VI of VII betrekking heeft op de toevoeging van een zwaar metaal, een maatregel inzake productbeheersing dan wel een product of een productengroep aan dit Protocol:

    • a. verstrekt de indiener van het voorstel het uitvoerend orgaan de informatie, als bedoeld in Besluit 1998/1 van het uitvoerend orgaan, met inbegrip van eventuele wijzigingen daarvan;

    • b. beoordelen de Partijen het voorstel overeenkomstig de procedures van Besluit 1998/1 van het uitvoerend orgaan, met inbegrip van eventuele wijzigingen daarvan.

  • 7 Besluiten tot wijziging van Besluit 1998/1 van het uitvoerend orgaan worden door de Partijen op een zitting van het uitvoerend orgaan bij consensus genomen en worden 60 dagen na de datum van aanneming van kracht.

Artikel 14. Ondertekening

  • 1 Dit Protocol staat open voor ondertekening te Aarhus (Denemarken) van 24 tot en met 25 juni 1998, vervolgens op de zetel van de Verenigde Naties te New York tot 21 december 1998 door Staten die lid zijn van de Commissie, alsmede Staten die een raadgevende status bij de Commissie hebben, overeenkomstig paragraaf 8 van Resolutie 36 (IV) van de Economische en Sociale Raad van 28 maart 1947, en door regionale organisaties voor economische integratie, die door soevereine Staten die lid zijn van de Commissie zijn opgericht en die bevoegd zijn te onderhandelen over internationale verdragen met betrekking tot onder dit Protocol vallende aangelegenheden en deze verdragen te sluiten en toe te passen, mits de betrokken Staten en organisaties Partij bij het Verdrag zijn.

  • 2 Deze regionale organisaties voor economische integratie oefenen, wanneer het aangelegenheden betreft die onder hun bevoegdheden vallen, zelf de rechten uit en vervullen zelf de taken die door dit Protocol aan de lidstaten worden toegekend. In deze gevallen mogen de lidstaten van deze organisaties deze rechten niet afzonderlijk uitoefenen.

Artikel 15. Bekrachtiging, aanvaarding, goedkeuring en toetreding

  • 1 Dit Protocol dient te worden bekrachtigd, aanvaard of goedgekeurd door de ondertekenaars.

  • 2 Dit Protocol staat met ingang van 21 december 1998 open voor toetreding door de Staten en organisaties die aan de eisen van artikel 14, lid 1, voldoen.

  • 3 Een Staat of een regionale organisatie voor economische integratie verklaart zulks in zijn of haar akte van bekrachtiging, aanvaarding, goedkeuring of toetreding wanneer hij of zij niet wenst te worden gebonden door de procedures vervat in artikel 13, lid 5 ter, ter zake van de wijziging van de bijlagen II, IV, V en VI.

Artikel 16. Depositaris

De akten van bekrachtiging, aanvaarding, goedkeuring of toetreding dienen te worden nedergelegd bij de secretaris-generaal van de Verenigde Naties, die de taken van depositaris verricht.

Artikel 17. Inwerkingtreding

  • 1 Dit Protocol treedt in werking op de negentigste dag volgend op de datum waarop de zestiende akte van bekrachtiging, aanvaarding, goedkeuring of toetreding is nedergelegd.

  • 2 Voor elke in artikel 14, lid 1, bedoelde Staat of organisatie die dit Protocol bekrachtigt, aanvaardt of goedkeurt of hiertoe toetreedt na de nederlegging van de zestiende akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, treedt het Protocol in werking op de negentigste dag volgend op de datum van nederlegging door deze partij van haar akte van bekrachtiging, aanvaarding, goedkeuring of toetreding.

Artikel 18. Opzegging

Vijf jaar na de datum waarop dit Protocol voor een Partij in werking is getreden, kan deze partij dit Protocol te allen tijde opzeggen door middel van een schriftelijke kennisgeving aan de depositaris. De opzegging wordt van kracht op de negentigste dag na de datum waarop de depositaris de kennisgeving heeft ontvangen, of op een in de kennisgeving van opzegging aangegeven latere datum.

Artikel 19. Authentieke teksten

Het origineel van dit Protocol, waarvan de Engelse, de Franse en de Russische tekst gelijkelijk authentiek zijn, wordt nedergelegd bij de secretaris-generaal van de Verenigde Naties.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd, dit Protocol hebben ondertekend.

Bijlage II. Categorieën van stationaire bronnen

I. INLEIDING

1.

Installaties of delen van installaties voor onderzoek, ontwikkeling en beproeving van nieuwe producten en processen vallen niet onder deze bijlage.

2.

De onderstaande drempelwaarden hebben meestal betrekking op productiecapaciteit of nuttig vermogen. Indien een exploitant in dezelfde installatie of op hetzelfde terrein verschillende activiteiten verricht die onder dezelfde onderverdeling vallen, worden de capaciteiten van die activiteiten bij elkaar opgeteld.

II. LIJST VAN CATEGORIEËN

Bijlage III. Beste beschikbare technieken voor de beperking van de emissie van zware metalen en verbindingen daarvan door in Bijlage II vermelde broncategorieën

  • 1. Deze bijlage is bedoeld om de Partijen bij het Verdrag richtlijnen te geven bij de bepaling van de beste beschikbare technieken zodat ze kunnen voldoen aan de verplichtingen van het Protocol. Een door de Partijen tijdens een zitting van het uitvoerend orgaan aangenomen leidraad bevat een nadere beschrijving van en richtlijnen voor dergelijke beste beschikbare technieken en kan bij consensus van de Partijen bijeen in het uitvoerend orgaan wanneer nodig worden geactualiseerd.

  • 2. Onder de uitdrukking „beste beschikbare technieken” (BBT) wordt verstaan het meest doeltreffende en geavanceerde ontwikkelingsstadium van de activiteiten en exploitatiemethoden daarvan, waarbij de praktische bruikbaarheid van speciale technieken om het uitgangspunt voor de emissiegrenswaarden (en andere vergunningsvoorwaarden) te vormen is aangetoond, met het doel emissies en effecten op het milieu in zijn geheel te voorkomen, of wanneer dat niet mogelijk blijkt te beperken:

    • a. Onder „technieken” wordt verstaan zowel de toegepaste technieken als de wijze waarop de installatie wordt ontworpen, gebouwd, onderhouden, geëxploiteerd en ontmanteld;

    • b. Onder „beschikbare” technieken wordt verstaan op zodanige schaal ontwikkeld dat de betrokken technieken, kosten en baten in aanmerking genomen, economisch en technisch haalbaar in de betrokken industriële context kunnen worden toegepast, onafhankelijk van de vraag of die technieken al dan niet op het grondgebied van de betrokken lidstaat worden toegepast of geproduceerd, mits zij voor de exploitant op redelijke voorwaarden toegankelijk zijn;

    • c. Onder „beste” wordt verstaan het meest doeltreffend voor het bereiken van een hoog algemeen niveau van bescherming van het milieu in zijn geheel.

  • 3. De criteria voor het vaststellen van BBT zijn als volgt:

    • a. het gebruik van technologie die weinig afval oplevert;

    • b. het gebruik van minder gevaarlijke stoffen;

    • c. de bevordering van terugwinning en recycling van stoffen die tijdens het proces ontstaan en worden gebruikt en van afvalstoffen, in voorkomend geval;

    • d. vergelijkbare processen, installaties of exploitatiemethoden die met succes op industriële schaal zijn beproefd;

    • e. de vooruitgang van de techniek en de ontwikkeling van de wetenschappelijke kennis;

    • f. de aard, de effecten en de omvang van de desbetreffende emissies;

    • g. de data van ingebruikneming van de nieuwe of bestaande installaties;

    • h. de tijd die nodig is voor het omschakelen op een beste beschikbare techniek;

    • i. het verbruik en de aard van de grondstoffen (met inbegrip van water) die bij het proces worden gebruikt en het rendement van de energie;

    • j. de noodzaak om de algehele milieu-effecten en milieurisico's van emissies te voorkomen of tot een minimum te beperken;

    • k. de noodzaak om ongevallen te voorkomen en de gevolgen daarvan voor het milieu tot een minimum te beperken;

    • l. door nationale en internationale organisaties gepubliceerde informatie.

    Het is niet de bedoeling om aan de hand van het begrip BBT bepaalde technieken of technologie voor te schrijven, maar om rekening te houden met de technische karakteristieken van de desbetreffende installatie, de geografische locatie en de plaatselijke milieusituatie.

  • 4. De ervaring met nieuwe producten en nieuwe installaties waarbij gebruik wordt gemaakt van technieken met een geringe emissie, alsmede met de aanpassing van bestaande installaties, neemt voortdurend toe; bijgevolg kan het noodzakelijk zijn de leidraad bedoeld in punt 1 te actualiseren.

Bijlage IV. Tijdschema voor de toepassing van grenswaarde en beste beschikbare technieken op nieuwe en bestaande stationaire bronnen

  • 1. Voor de toepassing van grenswaarden en beste beschikbare technieken geldt het volgende tijdschema:

    • a. Voor nieuwe stationaire bronnen: twee jaar na de datum waarop dit Protocol voor een Partij van kracht wordt;

    • b. Voor bestaande stationaire bronnen: twee jaar na de datum waarop dit Protocol van kracht wordt voor een Partij of 31 december 2020, naar gelang van welke datum het laatst valt,

  • 2. Niettegenstaande lid 1, maar met inachtneming van lid 3, kan een Partij bij het Verdrag die tussen 1 januari 2014 en 31 december 2019 Partij wordt bij dit Protocol bij de bekrachtiging, aanvaarding, goedkeuring van of de toetreding tot het onderhavige Protocol verklaren de termijnen voor de toepassing van de grenswaarden bedoeld in artikel 3, lid 2, onder d, met ten hoogste vijftien jaar te verlengen na de datum van inwerkingtreding van het onderhavige Protocol voor de betreffende Partij.

  • 3. Een Partij die ingevolge artikel 3 bis van het onderhavige Protocol een keuze heeft gemaakt ten aanzien van een specifieke categorie stationaire bronnen, mag niet tevens ingevolge lid 2 een verklaring afleggen met betrekking tot dezelfde broncategorie.

Bijlage V. Grenswaarden voor de beperking van emissies door belangrijke stationaire bronnen

  • 1. Twee soorten grenswaarden zijn belangrijk voor beheersing van de emissie van zware metalen:

    • a. Waarden voor specifieke zware metalen of groepen van zware metalen; en

    • b. Waarden voor emissies van zwevende deeltjes in het algemeen.

  • 2. In beginsel kunnen grenswaarden voor zwevende deeltjes niet de specifieke grenswaarden voor cadmium, lood en kwik vervangen, omdat de hoeveelheid metalen bij stofvormige emissies van proces tot proces verschilt. Naleving van deze grenswaarden draagt evenwel aanzienlijk bij tot vermindering van de emissie van zware metalen in het algemeen. Controle van stofvormige emissies is gewoonlijk minder duur dan controle van de verschillende soorten en continue controle van afzonderlijke zware metalen is doorgaans niet uitvoerbaar. Grenswaarden voor zwevende deeltjes zijn bijgevolg van groot praktisch belang en zijn in deze bijlage in de meeste gevallen vastgesteld als aanvulling of vervanging van specifieke grenswaarden voor cadmium of lood of kwik.

  • 3. Afdeling A is van toepassing op Partijen anders dan de Verenigde Staten van Amerika. Afdeling B is van toepassing op de Verenigde Staten van Amerika.

A. Andere Partijen dan de Verenigde Staten van Amerika

  • 4. Uitsluitend in deze afdeling wordt onder „stof” verstaan de massa van deeltjes met elke vorm, dichtheid of structuur die onder de omstandigheden ter plaatse van het monsternemingspunt zwevend in de gasfase voorkomen die na representatieve monsterneming van het te onderzoeken gas verzameld kunnen worden door filtratie onder de vastgelegde omstandigheden en die na drogen onder de vastgelegde omstandigheden bovenstrooms van het filter en op het filter achterblijven.

  • 5. Voor de toepassing van deze afdeling wordt onder „emissiegrenswaarde” (EGW) of „grenswaarde” verstaan de hoeveelheid stof en specifieke zware metalen in de zin van dit Protocol in de afgassen van een installatie die niet mag worden overschreden. Tenzij anders aangegeven wordt deze berekend in termen van massa verontreinigende stof per volume van de afgassen (uitgedrukt in mg/m 3), uitgaande van standaardomstandigheden voor temperatuur en druk voor droog gas (volume bij 273.15 K, 101.3 kPa). Met betrekking tot het zuurstofgehalte van het afgas zijn de waarden van toepassing die voor elke categorie belangrijke stationaire bronnen zijn gegeven. Verdunning om de concentraties aan verontreinigende stoffen in afgassen te verminderen, is niet toegestaan. Het in gebruik nemen, buiten gebruik stellen en onderhoud van apparatuur zijn hiervan uitgezonderd.

  • 6. Emissies worden in alle gevallen gemonitord door metingen of berekeningen waarbij ten minste dezelfde nauwkeurigheid wordt bereikt. Naleving van de grenswaarden wordt geverifieerd door ononderbroken of onderbroken metingen, of elke andere technisch betrouwbare methode, met inbegrip van geverifieerde berekeningsmethoden. De relevante zware metalen worden ten minste eenmaal per drie jaar gemeten bij iedere industriële bron. Voor de uitvoering van metingen en berekeningen wordt de leidraad in aanmerking genomen die de Partijen hebben aangenomen tijdens de zitting van het uitvoerend orgaan. Bij ononderbroken metingen worden de grenswaarden nageleefd indien het gevalideerde maandelijks gemiddelde van de emissie de grenswaarden niet overschrijdt. Bij onderbroken metingen of andere passende vaststellings- of berekeningsmethoden wordt naleving van de emissiegrenswaarden bereikt indien de gemiddelde waarde op basis van een passend aantal metingen onder representatieve omstandigheden de waarde van de emissienorm niet overschrijdt. Er kan voor verificatiedoeleinden rekening worden gehouden met de onnauwkeurigheid van de meetmethoden. Indirecte monitoring van stoffen is ook mogelijk via de som van parameters / cumulatieve parameters (bijvoorbeeld stof als de som van parameters voor zware metalen). In sommige gevallen kan het gebruik van een bepaalde techniek voor de behandeling van emissies waarborgen dat een waarde of grenswaarde behaald of gehandhaafd wordt.

  • 7. Monitoring van de relevante verontreinigende stoffen en metingen van procesparameters en ook van de kwaliteitsborging van geautomatiseerde meetsystemen en de referentiemetingen om deze systemen te ijken, worden uitgevoerd in overeenstemming met de CEN-normen. Indien CEN-normen ontbreken, zijn ISO-, nationale of internationale normen van toepassing die waarborgen dat gegevens opgeleverd worden van een vergelijkbare wetenschappelijke kwaliteit.

Verbrandingsinstallaties (ketels en procesverhitters) met een nominaal thermisch ingangsvermogen van meer dan 50 MWth 4 (bijlage II, categorie 1)

  • 8. De grenswaarden voor stofemissies voor de verbranding van vaste en vloeibare brandstoffen, anders dan biomassa en turf. 5

  • 9. Bijzondere bepalingen voor in paragraaf 8 bedoelde verbrandingsinstallaties:

    • a. Een Partij mag in de volgende gevallen afwijken van de verplichting de in paragraaf 8 voorziene emissiegrenswaarden na te leven:

      • i. Bij verbrandingsinstallaties die normaliter gasvormige brandstoffen gebruiken en die als gevolg van een plotselinge onderbreking van de gasvoorziening bij wijze van uitzondering een andere brandstof dienen te gebruiken en om die reden zouden moeten worden uitgerust met afgasreinigingsapparatuur;

      • ii. Bij bestaande verbrandingsinstallaties die niet langer dan 17.500 uur in bedrijf zijn in een tijdvak beginnend vanaf 1 januari 2016 en eindigend uiterlijk 31 december 2023;

    • b. Wanneer een verbrandingsinstallatie met ten minste 50 MWth wordt uitgebreid, is de in paragraaf 8 gespecificeerde EGW voor nieuwe installaties van toepassing op het uitgebreide gedeelte van de installatie waarop de verandering betrekking heeft. De EGW wordt berekend als een gewogen gemiddelde van het werkelijke thermische ingangsvermogen van zowel het bestaande als nieuwe deel van de installatie.

    • c. De Partijen waarborgen dat er procedures komen voor storingen aan of uitvallen van de nabehandelingsapparatuur;

    • d. Bij een gemengde verbrandingsinstallatie waarbij twee of meer soorten brandstof gelijktijdig worden gebruikt, wordt de EGW bepaald als gewogen gemiddelde van de EGW voor de afzonderlijke brandstoffen, op basis van het thermische ingangsvermogen van elke brandstof.

Bestaande installaties voor chloor-alkaliproductie door middel van het kwikelektrolyseproces moeten voor 31 december 2020 overschakelen naar kwikvrije technologieën of sluiten; tijdens de periode voorafgaand aan de overschakeling geldt voor de gehaltes aan kwik die een installatie uitstoot in de lucht de grenswaarde van 1 gram per Mg 6 chloorproductiecapaciteit.

  • 18. Nieuwe installaties voor de productie van alkalichloride dienen kwikvrij te worden geëxploiteerd.

Afvalverbranding (bijlage II, categorieën 10 en 11)

Bijlage VI. Maatregelen inzake productbeheersing

Tenzij in deze bijlage anders is bepaald, mag uiterlijk op de datum van inwerkingtreding van dit Protocol voor een Partij het loodgehalte van benzine die voor wegvoertuigen wordt verkocht, niet meer dan 0,013 g/l bedragen. Partijen die ongelode benzine met een loodgehalte van minder dan 0,013 g/l in de handel brengen, trachten dat niveau te behouden of nog te verlagen.

2.

De Partijen streven ernaar dat de overschakeling op brandstoffen met een loodgehalte zoals vermeld in punt 1, resulteert in een algehele vermindering van de schadelijke effecten op de volksgezondheid en het milieu.

Niettegenstaande lid 1 mag een Partij geringe hoeveelheden, tot 0,5% van de totale benzineverkoop, gelode benzine met een loodgehalte van ten hoogste 0,15 g/l in de handel brengen die voor oude wegvoertuigen is bestemd.

Elke partij moet uiterlijk op de datum waarop dit Protocol voor die Partij in werking treedt, concentratieniveaus bereiken die niet hoger zijn dan:

  • a. 0,05 gewichtsprocenten kwik in alkali-mangaanbatterijen voor langdurig gebruik in extreme omstandigheden (bijvoorbeeld temperatuur onder 0°C of boven 50°C, blootstelling aan schokken);

  • b. 0,025 gewichtsprocenten kwik in alle andere alkali-mangaanbatterijen.

De bovengenoemde grenswaarden mogen worden overschreden bij een nieuwe toepassing van een batterijtechnologie of het gebruik van een batterij in een nieuw product, indien redelijke voorzorgsmaatregelen zijn genomen om ervoor te zorgen dat de batterij of het product zonder een gemakkelijk te verwijderen batterij op een milieuvriendelijke manier wordt verwijderd. Alkali-mangaanknoopcellen en batterijen die uit knoopcellen zijn samengesteld zijn eveneens van deze verplichting vrijgesteld.

Bijlage VII. Maatregelen inzake productiebeheer

1.

Deze bijlage heeft tot doel Partijen richtsnoeren te verstrekken voor maatregelen inzake productbeheer.

2.

De Partijen kunnen geëigende maatregelen inzake productbeheer zoals de hieronder vermelde in overweging nemen, waar dat gerechtvaardigd is in verband met de potentiële risico's van schadelijke effecten op de volksgezondheid of het milieu van emissies van één of meer van de in bijlage I vermelde zware metalen, rekening houdend met alle relevante risico's en voordelen van dergelijke maatregelen, teneinde ervoor te zorgen dat eventuele wijzigingen in producten in totaal resulteren in een vermindering van schadelijke effecten voor de volksgezondheid en het milieu:

  • a. Vervanging van producten waaraan één of meer in bijlage I vermelde zware metalen opzettelijk zijn toegevoegd, indien een geschikt alternatief bestaat;

  • b. Minimalisering of vervanging in producten van één of meer in bijlage I vermelde zware metalen die opzettelijk zijn toegevoegd;

  • c. Productinformatie met inbegrip van etikettering die de gebruikers inlicht over het feit dat één of meer in bijlage I vermelde zware metalen opzettelijk zijn toegevoegd en over de noodzaak van veilig gebruik en afvalbehandeling;

  • d. Economische stimuleringsmaatregelen of vrijwillige overeenkomsten teneinde de aanwezigheid van de in bijlage I vermelde zware metalen te beperken of uit te schakelen;

  • e. Uitwerking en implementatie van programma's voor milieuvriendelijke inzameling, recycling of verwijdering van producten die een van de in bijlage I vermelde zware metalen bevatten.

Elk hieronder vermeld product of groep van producten bevat één of meer van de in bijlage I vermelde zware metalen en is door ten minste één partij bij het verdrag onderworpen aan regelgeving of vrijwillige maatregelen, voor een belangrijk gedeelte op basis van de bijdrage van dat product tot emissies van één of meer van de in bijlage I vermelde zware metalen. Er is evenwel nog niet voldoende informatie beschikbaar om te bevestigen dat zij voor alle Partijen een belangrijke bron vormen en dat dus de opname daarvan in bijlage VI gerechtvaardigd is. Elke partij wordt aangemoedigd de beschikbare informatie te onderzoeken en, indien zij ervan overtuigd is dat voorzorgsmaatregelen moeten worden getroffen, maatregelen inzake productbeheer, zoals die welke in punt 2 zijn genoemd, toe te passen op een of meer van de hieronder vermelde producten:

  • a. Kwikhoudende elektrische componenten, d.w.z. apparaten met één of meer contacten/sensoren voor het overbrengen van elektrische stroom, zoals relais, thermostaten, niveauschakelaars, drukschakelaars en andere schakelaars (reeds getroffen maatregelen omvatten een verbod van de meeste kwikhoudende elektrische componenten, vrijwillige programma's ter vervanging van bepaalde kwikschakelaars door elektrische of speciale schakelaars, vrijwillige recyclingprogramma's voor schakelaars en vrijwillige recyclingprogramma's voor thermostaten);

  • b. Kwikhoudende meetmiddelen zoals thermometers, manometers, barometers, drukmeters, drukschakelaars en drukoverbrengers (getroffen maatregelen omvatten een verbod van kwikhoudende thermometers en een verbod van meetinstrumenten);

  • c. Kwikhoudende fluorescentielampen (getroffen maatregelen omvatten vermindering van het kwikgehalte per lamp via zowel vrijwillige programma's als regelgeving en vrijwillige recyclingprogramma's);

  • d. Kwikhoudend tandamalgaam (getroffen maatregelen omvatten vrijwillige programma's en een verbod met vrijstellingen voor het gebruik van tandamalgaam en vrijwillige programma's ter stimulering van het opvangen van tandamalgaam uit de tandartsenpraktijk voordat het naar waterzuiveringsinstallaties wordt geloosd;

  • e. Kwikhoudende bestrijdingsmiddelen, met inbegrip van zaadbehandeling (getroffen maatregelen omvatten een verbod van alle kwikhoudende bestrijdingsmiddelen, met inbegrip van zaadbehandeling, en een verbod van het gebruik van kwik als desinfecteermiddel);

  • f. Kwikhoudende verf (getroffen maatregelen omvatten een verbod van alle dergelijke verfsoorten, een verbod van die verfsoorten voor gebruik binnenshuis en op kinderspeelgoed alsook een verbod van het gebruik in aangroeiwerende verf);

  • g. Andere kwikhoudende batterijen dan de in bijlage VI bedoelde (getroffen maatregelen omvatten vermindering van het kwikgehalte via zowel vrijwillige programma's als regelgeving en milieuheffingen en vrijwillige recyclingprogramma's).

Besluit 1998/1 met betrekking tot criteria en procedures voor het toevoegen van zware metalen en producten aan het Protocol inzake zware metalen

  1. The rated thermal input of the combustion plant is calculated as the sum of the input of all units connected to a common stack. Individual units below 15 MWth shall not be considered when calculating the total rated thermal input. ^ [1]
  2. In particular, the ELVs shall not apply to:
    • Plants using biomass and peat as their only fuel source

    • Plants in which the products of combustion are used for direct heating, drying, or any other treatment of objects or materials;

    • Post-combustion plants designed to purify the waste gases by combustion which are not operated as independent combustion plants;

    • Facilities for the regeneration of catalytic cracking catalysts;

    • Facilities for the conversion of hydrogen sulphide into sulphur;

    • Reactors used in the chemical industry;

    • Coke battery furnaces;

    • Cowpers;

    • Recovery boilers within installations for the production of pulp;

    • Waste incinerators; and

    • Plants powered by diesel, petrol or gas engines or by combustion turbines, irrespective of the fuel used.

  5. EGW zijn met name niet van toepassing op:
    • installaties die uitsluitend biomassa en turf als brandstof gebruiken

    • installaties waarin de verbrandingsproducten worden gebruikt voor het rechtstreeks verhitten, drogen of een andere behandeling van voorwerpen of materialen;

    • naverbrandingsinstallaties ontworpen om afgassen te zuiveren door verbranding en die niet als zelfstandige verbrandingsinstallaties worden gebruikt;

    • voorzieningen voor het regenereren van bij het kraken gebruikte katalysatoren;

    • voorzieningen voor de omzetting van waterstofsulfide in zwavel;

    • in de chemische industrie gebruikte reactoren;

    • cokesovenbatterijen;

    • windverhitters;- terugwinningsketels in installaties voor de productie van pulp;

    • vuilverbrandingsinstallaties; en- door diesel-, benzine- en gasmotoren of gasturbines aangedreven installaties, ongeacht de gebruikte brandstof.
