Agreement between the government of the Kingdom of the Netherlands and the government of the French Republic on Maritime Delimitations in the Caribbean region

The government of the Kingdom of the Netherlands

and

the government of the French Republic,

hereafter “the Parties”

Considering that it is desirable to delimit the maritime zones in the Caribbean region over which the two States respectively exercise their sovereignty, sovereign rights or jurisdiction;

Considering that the relations between the Kingdom of the Netherlands and the French Republic in the Caribbean region are based on the principle of good neighbourliness;

Having regard to the Treaty of Concordia (Sint Maarten) concluded on 23 March 1648;

Having regard to the United Nations Convention on the Law of the Sea, concluded at Montego Bay on 10 December 1982, to which the Kingdom of the Netherlands and the French Republic are Parties;

have agreed as follows:

Article 1

• 1 This Agreement delimits the maritime zones of the Kingdom of the Netherlands (the autonomous country of Sint Maarten, and the public bodies of Saba and Sint Eustatius) and the French Republic over which the States respectively exercise or will exercise their sovereignty, sovereign rights or jurisdiction.

• 2 If either of the Parties decides to establish, expand or alter maritime zones, it can only do so with due respect for the maritime delimitation established in this Agreement.

Article 2

The geographical coordinates of the points established in this Agreement are expressed in the geodetic reference system WGS 84 (World Geodetic System 1984).

Article 3

The western part of the maritime delimitation is formed by a geodesic line joining, in the order in which they are given, the following points identified by their geographical coordinates:

From point A, the delimitation extends along a geodetic azimuth of 283,5 degrees until the delimitation with the United Kingdom of Great Britain and Northern Ireland is reached.

Article 4

The eastern part of the maritime delimitation is formed by a geodesic line joining, in the order in which they are given, the following points identified by their geographical coordinates:

From point J, the delimitation extends along a geodetic azimuth of 112,9 degrees until the delimitation with the Federation of Saint Christopher and Nevis is reached.

Article 5

The delimitation line as established in articles 3 and 4 is drawn by way of illustration on the map in the Annex to this Agreement.

Article 6

Any dispute between the Parties concerning the interpretation or application of this Agreement shall be settled peacefully by consultation and negotiation, in accordance with international law.

Article 7

Parties shall notify each other in writing of the completion of their domestic procedure necessary to bring into force this Agreement. This Agreement shall enter into force on the first day of the second month following the date of receipt of the last notification.

IN WITNESS WHEREOF the undersigned, duly authorised by their respective Governments, have signed this Agreement.

DONE at Philipsburg, on April 6^th, 2016, in the English and French language, both texts being equally authentic.

Verdrag tussen de regering van het Koninkrijk der Nederlanden en de regering van de Franse Republiek inzake de maritieme afbakening in het Caribisch gebied

De regering van het Koninkrijk der Nederlanden

en

de regering van de Franse Republiek,

hierna „de partijen”,

Overwegend dat het wenselijk is de maritieme zones in het Caribisch gebied waarover de twee staten respectievelijk hun soevereiniteit, soevereine rechten of rechtsmacht uitoefenen, af te bakenen;

Overwegend dat de betrekkingen tussen het Koninkrijk der Nederlanden en de Franse Republiek in het Caribisch gebied gebaseerd zijn op het beginsel van goed nabuurschap;

Gelet op het Verdrag van Concordia (Sint Maarten) tot stand gekomen op 23 maart 1648;

Gelet op het Verdrag van de Verenigde Naties inzake het recht van de zee, tot stand gekomen te Montego Bay op 10 december 1982, waarbij het Koninkrijk der Nederlanden en de Franse Republiek partij zijn;

zijn het volgende overeengekomen:

Artikel 1

• 1 In dit Verdrag worden de maritieme zones van het Koninkrijk der Nederlanden (het autonome land Sint Maarten en de openbare lichamen Saba en Sint Eustatius) en de Franse Republiek waarover de staten respectievelijk hun soevereiniteit, soevereine rechten of rechtsmacht uitoefenen of zullen uitoefenen, afgebakend.

• 2 Indien een van beide partijen besluit maritieme zones in te stellen, uit te breiden of te wijzigen, kan zij dit uitsluitend doen met inachtneming van de in dit Verdrag vastgestelde maritieme afbakening.

Artikel 2

De geografische coördinaten van de in dit Verdrag vastgestelde punten worden uitgedrukt volgens het geodetisch referentiesysteem WGS 84 (World Geodetic System 1984).

Artikel 3

Het westelijke deel van de maritieme afbakening wordt gevormd door een geodetische lijn die de volgende door hun geografische coördinaten uitgedrukte punten met elkaar verbindt, in de volgorde zoals aangegeven:

Vanaf punt A loopt de afbakening langs een geodetische azimut van 283,5 graden totdat de afbakening met het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland wordt bereikt.

Artikel 4

Het oostelijke deel van de maritieme afbakening wordt gevormd door een geodetische lijn die de volgende door hun geografische coördinaten uitgedrukte punten met elkaar verbindt, in de volgorde zoals aangeven:

Vanaf punt J loopt de afbakening langs een geodetische azimut van 112,9 graden totdat de afbakening met de Federatie van Saint Kitts en Nevis wordt bereikt.

Artikel 5

De lijn van de afbakening als vastgesteld in de artikelen 3 en 4 van dit Verdrag is bij wijze van illustratie ingetekend op de kaart in de Bijlage bij dit Verdrag.

Artikel 6

Elk geschil tussen de partijen betreffende de uitlegging of toepassing van dit Verdrag wordt op vreedzame wijze beslecht door middel van overleg en onderhandeling in overeenstemming met het internationale recht.

Artikel 7

Beide partijen stellen elkaar schriftelijk in kennis van de voltooiing van hun onderscheiden nationale procedures die vereist zijn voor de inwerkingtreding van dit Verdrag. Dit Verdrag treedt in werking op de eerste dag van de tweede maand na de datum van ontvangst van de laatste kennisgeving.

TEN BLIJKE WAARVAN de ondergetekenden, naar behoren gemachtigd door hun onderscheiden regeringen, dit Verdrag hebben ondertekend.

GEDAAN te Philipsburg op 6 april 2016 in de Engelse en de Franse taal, waarbij beide teksten gelijkelijk authentiek zijn.
