Protocol between The States of the Benelux (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and Bosnia and Herzegovina implementing the agreement between the European Community and Bosnia and Herzegovina on the readmission of persons residing without authorisation (Implementing protocol)

The States of the Benelux (the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands), and Bosnia and Herzegovina hereinafter referred to as the “Parties”,

Desiring to facilitate the implementation of the Agreement between the European Community and Bosnia and Herzegovina on the readmission of persons residing without authorization, hereinafter referred to as the “Agreement”,

Pursuant to the provisions of Article 19 of the Agreement,

Have agreed as follows:

Article 1. Competent Authorities

The Parties shall exchange lists of the authorities competent to implement the Agreement ultimately 30 days after the conclusion of this Implementing Protocol. They shall inform one another immediately of any change in this list.

Article 2. Border Crossing Points

  • 1 The Parties shall inform one another in writing of the border crossings at which persons shall be actually transferred and admitted pursuant to the Agreement, ultimately 30 days after the conclusion of this Implementing Protocol. They shall inform one another immediately of any changes in this connection.

  • 2 The competent authorities may agree on the use of other border crossing points for readmission or transit on a case by case basis.

Article 3. Submission and Reply to Readmission Applications

  • 1 A readmission application in accordance with Article 7 paragraph (1) and (2) of the Agreement shall be submitted using the form, attached as Annex 6 to the Agreement. The competent authority of the Requesting Party shall submit the form to the competent authority of the Requested Party by e-mail or fax. An e-mail or a fax delivery report shall constitute proof of delivery.

  • 2 In addition to the readmission application, the Requesting Party shall also submit if available, the documents listed in Annex 1 to 5 of the Agreement and, as a principle, the fingerprints of the person to be readmitted. When fingerprints are not included, reasons will be given.

    The submitted documents should be as clear and precise as possible in order to enable their verification.

  • 3 The Requested Party shall send its response to the competent authority of the Requesting Party, using the form attached as Annex 1 to this Implementing Protocol, by e-mail or fax and within the time limits mentioned in Article 10 (2) and (3) of the Agreement. An e-mail or a fax delivery report shall constitute proof of delivery.

Article 4. Transfer modalities

  • 1 After receiving notification of readmission approval from the Requested Party, the Requesting Party shall notify the Requested Party about the intended transfer, using the form attached as annex 2 to this Implementing Protocol. The Transfer Form shall be submitted by e-mail or fax to the competent authority of the Requested Party, not later than three days before the transfer date.

  • 2 The Requested Party shall immediately inform the Requesting Party of practical obstacles that may prevent the transfer on the proposed transfer date.

  • 3 If the transfer date is postponed by the Requesting Party, it shall immediately inform the competent authority of the Requested Party thereof. As soon as the actual transfer of the person concerned can take place, the competent authority of the Requesting Party shall inform the Requested Party, in accordance with the procedure and time limits set forth in paragraph (1) of this Article.

Article 5. Transit Application

  • 1 In addition to the provisions of Article 14 (1) of the Agreement, a Transit Application shall contain the following, if applicable:

    • a) Information on special needs related to the nursing care or care for elderly because of illness or age of the person in transit;

    • b) Information on the needed assistance by the Requested Party;

    • c) Information on possible need for security or protection measures.

  • 2 Aforementioned information shall be indicated in the section C (“Remarks”) in the Transit Application (Annex 7 of the Agreement).

  • 3 Pursuant to Articles 13 and 14 of the Agreement, the Parties have agreed as follows:

    • a) A transit application shall be submitted to the competent authority of the Requested Party, as referred to in Article 1 of this Implementing Protocol, by e-mail or fax at the latest 7 days prior to the planned transit.

    • b) The competent authority of the Requested Party shall send its response by e-mail or fax within 5 days after the date of receipt of a Transit Application, using the form attached as annex 3 to this Implementing protocol. In its reply to the transit application, the competent authority of the Requested Party shall indicate if it agrees with transit, date, designated border crossing point and transportation mode. It shall also state whether it can provide the requested assistance.

    • c) In the event of escorted travel by air, the competent authority of the Requested Party shall secure and provide the assistance for a boarding of a person who is a subject of transit.

  • 4 The Requesting Party shall readmit the person who is a subject of transit, as referred to in Article 13 (4) of the Agreement, without any delay, if:

    • a) approval for transit has been denied or withdrawn as referred to in Article 13 (3) of the Agreement, or

    • b) approval for transit or readmission has been denied by another transit or final destination country, or

    • c) the person who is subject of transit has illegally entered into the territory of the Requested Party.

Article 6. The use of escorts in readmission or transit

Pursuant to article 19 (1), alinea b) of the Agreement, the Parties agree to the following terms related to escorted transfers or transit on their territories:

  • a) Escort(s) are person(s) assigned by the Requesting Party to accompany the person to be readmitted, or who is in transit.

  • b) Escorts shall perform their duties unarmed and dressed in civilian clothes. They shall be in possession of documents proving that the readmission or transit has been approved by the Requested Party and their official identification documents.

  • c) The authorities of the Requested Party shall grant the same protection and assistance to the escorts, while the latter are performing their duties within the framework of the Agreement, as they grant to their own officials who are authorized to take such action.

  • d) At the territory of the Requested Party, escorts shall adhere to the laws of the Requested Party. The authority of escorts accompanying a person in transit is limited to self-defense. In case of inability of the Requested Party to provide adequate assistance or in case of supporting the assisting personnel in direct hazardous situations, escorts are authorized to react rationally and proportionally to prevent the person who is subject of readmission or transit to escape, injuring himself/herself or third parties or causing damage to property.

  • e) Escorts shall be responsible for carrying the travel documents and any other documents or data related to the person who is a subject of readmission or transit, as well as for the delivery of these documents to the representative of the competent authority of the country of destination.

  • f) Escorts shall be responsible for the person to be readmitted until the admission has taken place. During transit, escorts shall be responsible until the person has been admitted to the country of destination.

Article 7. Costs

  • 1 Costs incurred by the Requested Party in connection with readmission and transit that are to be borne by the Requesting Party pursuant to article 15 of the Agreement shall be reimbursed by the Requesting Party via bank transfer within 60 days after the submission of an invoice.

  • 2 All transport and escort costs related to readmission in error, in accordance with Article 12 of the Agreement, shall be borne by the Requesting Party.

  • 3 Banking details shall be included in the invoice.

Article 8. Expert Commission

  • 1 The Parties shall co-operate to analyse and resolve the issues relating to the application of the Agreement and this Implementing Protocol.

  • 2 For this purpose, the Parties shall arrange the establishment of an expert commission.

  • 3 The commission shall have meetings at the request of one of the Parties.

  • 4 Members of this expert commission shall be appointed by the competent authorities of the Parties.

Article 9. Language of Communication

The Parties shall use the English language in the procedures carried out under the Agreement and the Implementing Protocol.

Article 10. Annexes

Annexes 1, 2 and 3 shall constitute an integral part of this Implementing Protocol.

Article 11. Amendments

This Implementing Protocol and its Annexes may be amended by mutual agreement between the Parties. Such amendments shall be initiated in a written form through diplomatic channels and shall enter into force in accordance with the procedures described in Article 15 of this Implementing Protocol.

Article 12. Relation to other Treaties

This Implementing Protocol shall be without prejudice to the rights, obligations and responsibilities of the Parties arising from other international treaties.

Article 13. Settlement of disputes

Any disputes in connection with the interpretation and/or application of the present Implementing Protocol which haven’t been settled by the expert commission as provided by Article 8 shall be settled by means of consultation through diplomatic channels.

Article 14. Territorial application

This Implementing Protocol shall apply to the territory of Bosnia and Herzegovina, to the territory of the Kingdom of Belgium, to the territory of the Grand Duchy of Luxembourg and to the territory of the Kingdom of the Netherlands in which the Treaty on the Functioning of the European Union is applicable.

Article 15. Entry into force, duration and termination

  • 1 The Parties shall notify the depositary, as well as each other, of the completion of their national legal procedures necessary for the entry into force of the Implementing Protocol.

  • 2 This Implementing Protocol shall, in accordance with Article 19 (2) of the Agreement, enter into force the first day of the second month after the Joint Readmission Committee has been notified by the depositary that all Parties have completed their respective internal procedures necessary therefore, a copy of the notification to the Joint Readmission Committee shall be distributed by the depositary among all Parties.

  • 3 In accordance with Article 20 of the Agreement this Implementing Protocol shall, in the relation between Bosnia and Herzegovina and the States of the Benelux, take precedence over the provisions of the Agreement between the States of the Benelux (the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands) and Bosnia and Herzegovina concerning the readmission and reconduction of persons who have entered and/or are residing without authorisation (Readmission and Reconduction Agreement), done at Sarajevo on 19 July 2006. This Agreement shall remain in force between Curaçao, Sint Maarten and the Caribbean part of the Netherlands (Bonaire, Sint Eustatius and Saba) and Bosnia and Herzegovina.

  • 4 If the Agreement becomes ineffective this Implementing Protocol shall also become ineffective.

Article 16. Depositary

The Kingdom of Belgium is depositary of this Implementing Protocol for the Benelux countries. The depositary shall issue each Party with a true copy of the original.

DONE in Brussels on the 5th day of the month of November of 20131, in duplicate; each in official languages of Bosnia and Herzegovina (Bosnian, Croatian and Serbian) the Dutch, French and English languages, each being equally authentic. In case of differences in interpretation, the English text shall prevail.

Protocol tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg, het Koninkrijk der Nederlanden) en Bosnië en Herzegovina ter uitvoering van de Overeenkomst tussen de Europese Gemeenschap en Bosnië en Herzegovina betreffende de overname van personen die zonder vergunning op het grondgebied verblijven (Uitvoeringsprotocol)

De Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden), en Bosnië en Herzegovina hierna de „Partijen” genoemd,

Geleid door de wens de uitvoering te vergemakkelijken van de Overeenkomst tussen de Europese Gemeenschap en Bosnië en Herzegovina betreffende de overname van personen die zonder vergunning op het grondgebied verblijven, hierna de „Overeenkomst” genoemd,

Overeenkomstig het bepaalde in artikel 19 van de Overeenkomst,

Zijn het volgende overeengekomen:

Artikel 1. Bevoegde autoriteiten

De Partijen wisselen uiterlijk dertig dagen na het sluiten van dit Uitvoeringsprotocol een lijst van de voor de uitvoering van de Overeenkomst bevoegde autoriteiten uit. Iedere wijziging in deze lijst delen zij elkaar onverwijld mede.

Artikel 2. Grensovergangen

  • 1 De Partijen delen elkaar uiterlijk dertig dagen na het sluiten van dit Uitvoeringsprotocol schriftelijk mede via welke grensovergangen personen krachtens de Overeenkomst daadwerkelijk worden overgedragen en toegelaten. Iedere wijziging in dit verband delen zij elkaar onverwijld mede.

  • 2 De bevoegde autoriteiten kunnen van geval tot geval overeenkomen gebruik te maken van andere grensovergangen voor de terug- of overname of doorgeleiding.

Artikel 3. Indiening van en antwoord op een terug- of overnameverzoek

  • 1 Voor de indiening van een terug- of overnameverzoek op grond van artikel 7, eerste en tweede lid, van de Overeenkomst wordt gebruik gemaakt van het formulier dat als bijlage 6 aan de Overeenkomst is gehecht. Het formulier wordt door de bevoegde autoriteit van de verzoekende Partij per e-mail of telefax ingediend bij de bevoegde autoriteit van de aangezochte Partij. Het verzendingsrapport van het e-mail- of telefaxbericht geldt als bewijs van verzending.

  • 2 Naast het terug- of overnameverzoek verstrekt de verzoekende Partij indien beschikbaar tevens de in de bijlagen 1 tot en met 5 bij de Overeenkomst vermelde documenten alsook, in beginsel, de vingerafdrukken van de terug- of over te nemen persoon. Indien er geen vingerafdrukken worden verstrekt, wordt dit met redenen omkleed.

    De ingediende documenten dienen voor een goede verificatie zo duidelijk en nauwkeurig mogelijk te zijn.

  • 3 Het antwoord op een terug- of overnameverzoek wordt binnen de in artikel 10, tweede en derde lid, van de Overeenkomst genoemde termijnen door de aangezochte Partij per e-mail of telefax verzonden aan de bevoegde autoriteit van de verzoekende Partij door middel van het formulier dat als bijlage 1 aan dit Uitvoeringsprotocol is gehecht. Het verzendingsrapport van het e-mail- of telefaxbericht geldt als bewijs van verzending.

Artikel 4. Wijze van overdracht

  • 1 Nadat de verzoekende Partij van de aangezochte Partij een kennisgeving tot instemming met de terug- of overname heeft ontvangen, stelt zij de aangezochte Partij in kennis van de beoogde overdracht en maakt zij daartoe gebruik van het formulier dat als bijlage 2 aan dit Uitvoeringsprotocol is gehecht. Het overdrachtsformulier wordt uiterlijk drie dagen vóór de datum van overdracht per e-mail of telefax toegezonden aan de bevoegde autoriteit van de aangezochte Partij.

  • 2 De aangezochte Partij stelt de verzoekende Partij onverwijld in kennis van praktische belemmeringen die overdracht op de voorgestelde datum van overdracht in de weg kunnen staan.

  • 3 Indien de datum van overdracht wordt uitgesteld door de verzoekende Partij, stelt zij de bevoegde autoriteit van de aangezochte Partij daarvan onverwijld in kennis. Zodra de overdracht van de betrokkene daadwerkelijk kan plaatsvinden, stelt de bevoegde autoriteit van de verzoekende Partij de aangezochte Partij daarvan in kennis overeenkomstig de in het eerste lid van dit artikel vervatte procedure en termijnen.

Artikel 5. Doorgeleidingsverzoek

  • 1 Naast het bepaalde in artikel 14, eerste lid, van de Overeenkomst bevat een doorgeleidingsverzoek in voorkomend geval de volgende gegevens:

    • a) informatie over specifieke behoeften op het gebied van verpleging of ouderenzorg wegens ziekte of leeftijd van de door te geleiden persoon;

    • b) informatie over de van de aangezochte Partij benodigde ondersteuning;

    • c) informatie over eventueel te treffen veiligheids- of beschermingsmaatregelen.

  • 2 Bovengenoemde informatie wordt in het doorgeleidingsverzoek (bijlage 7 bij de Overeenkomst) in rubriek C („Opmerkingen”) vermeld.

  • 3 De Partijen zijn ingevolge de artikelen 13 en 14 van de Overeenkomst het volgende overeengekomen:

    • a) Een doorgeleidingsverzoek wordt uiterlijk zeven dagen vóór de geplande doorgeleiding per e-mail of telefax ingediend bij de bevoegde autoriteit van de aangezochte Partij als bedoeld in artikel 1 van dit Uitvoeringsprotocol.

    • b) Het antwoord op een doorgeleidingsverzoek wordt binnen vijf dagen na de datum van ontvangst van het verzoek door de bevoegde autoriteit van de aangezochte Partij per e-mail of telefax verzonden door middel van het formulier dat als bijlage 3 aan dit Uitvoeringsprotocol is gehecht. In het antwoord op het doorgeleidingsverzoek wordt door de bevoegde autoriteit van de aangezochte Partij aangegeven of zij instemt met de doorgeleiding, de datum, de aangewezen grensovergang en de wijze van vervoer. Voorts wordt meegedeeld of in de gevraagde ondersteuning kan worden voorzien.

    • c) Indien de doorgeleiding onder begeleiding door de lucht plaatsvindt, zorgt de bevoegde autoriteit van de aangezochte Partij voor bewaking en ondersteuning bij het aan boord brengen van de betrokkene.

  • 4 De verzoekende Partij neemt de door te geleiden persoon als bedoeld in artikel 13, vierde lid, van de Overeenkomst onverwijld terug indien:

    • a) de toelating voor de doorgeleiding is geweigerd of ingetrokken zoals bedoeld in artikel 13, derde lid, van de Overeenkomst, of

    • b) de toelating voor de doorgeleiding of de overname door een ander land van doorgeleiding of eindbestemming is afgewezen, of

    • c) de door te geleiden persoon het grondgebied van de aangezochte Partij onrechtmatig is binnengekomen.

Artikel 6. Gebruik van begeleiders bij terug- of overname of doorgeleiding

Overeenkomstig artikel 19, eerste lid, onder b), van de Overeenkomst komen de Partijen de volgende voorwaarden voor begeleide overdracht of doorgeleiding op hun grondgebied overeen:

  • a) De begeleiders worden door de verzoekende Partij aangewezen en zijn belast met de begeleiding van de terug- of over te nemen of door te geleiden persoon.

  • b) De begeleiders voeren hun taak ongewapend en in burgerkledij uit. De begeleiders dragen documenten bij zich waaruit blijkt dat de terug- of overname of doorgeleiding is goedgekeurd door de aangezochte Partij, alsmede hun officiële identiteitsdocumenten.

  • c) De autoriteiten van de aangezochte Partij verlenen de begeleiders bij de uitoefening van hun taken in het kader van de Overeenkomst dezelfde bescherming en bijstand als aan de eigen ter zake bevoegde ambtenaren.

  • d) Op het grondgebied van de aangezochte Partij dienen de begeleiders het recht van de aangezochte Partij na te leven. Tijdens de doorgeleiding zijn de bevoegdheden van de begeleiders beperkt tot zelfverdediging. Indien de aangezochte Partij geen adequate ondersteuning kan bieden dan wel bij het bijstaan van ondersteunend personeel in situaties met onmiddellijk gevaar zijn de begeleiders bevoegd op redelijke en proportionele wijze te reageren om te voorkomen dat de terug- of over te nemen of door te geleiden persoon vlucht, zichzelf of derden letsel toebrengt dan wel schade aan goederen veroorzaakt.

  • e) De begeleiders dienen de reisdocumenten en alle andere documenten of gegevens met betrekking tot de terug- of over te nemen of door te geleiden persoon bij zich te hebben en dienen die documenten te overhandigen aan de vertegenwoordiger van de bevoegde autoriteit van het land van bestemming.

  • f) De begeleiders zijn verantwoordelijk voor de terug- of over te nemen persoon tot de toelating heeft plaatsgevonden. Tijdens doorgeleiding zijn de begeleiders verantwoordelijk tot de betrokkene tot het land van bestemming is toegelaten.

Artikel 7. Kosten

  • 1 Door de aangezochte Partij gemaakte kosten in verband met terug- of overname en doorgeleiding welke op grond van artikel 15 van de Overeenkomst ten laste van de verzoekende Partij komen, worden binnen zestig dagen na overlegging van een factuur door middel van een bankoverschrijving door de verzoekende Partij vergoed.

  • 2 Alle kosten van vervoer en begeleiding in verband met een onterechte terug- of overname overeenkomstig artikel 12 van de Overeenkomst komen ten laste van de verzoekende Partij.

  • 3 In de factuur worden tevens de bankgegevens vermeld.

Artikel 8. Commissie van deskundigen

  • 1 De Partijen werken samen bij de uitlegging en oplossing van kwesties omtrent de toepassing van de Overeenkomst en dit Uitvoeringsprotocol.

  • 2 Hiertoe regelen de Partijen de instelling van een commissie van deskundigen.

  • 3 De commissie komt op verzoek van een van de Partijen bijeen.

  • 4 De leden van deze commissie van deskundigen worden door de bevoegde autoriteiten van de Partijen benoemd.

Artikel 9. Taal waarin wordt gecommuniceerd

Bij de procedures die ingevolge de Overeenkomst en het Uitvoeringsprotocol worden uitgevoerd, maken de Partijen gebruik van de Engelse taal.

Artikel 10. Bijlagen

De bijlagen 1, 2 en 3 maken een integrerend deel uit van dit Uitvoeringsprotocol.

Artikel 11. Wijzigingen

Dit Uitvoeringsprotocol en de bijlagen kunnen in onderlinge overeenstemming tussen de Partijen worden gewijzigd. Deze wijzigingen worden schriftelijk langs diplomatieke weg geïnitieerd en worden van kracht overeenkomstig de in artikel 15 van dit Uitvoeringsprotocol omschreven procedures.

Artikel 12. Verhouding tot andere verdragen

Dit Uitvoeringsprotocol doet geen afbreuk aan de rechten, verplichtingen en verantwoordelijkheden van de Partijen die voortvloeien uit andere internationale verdragen.

Artikel 13. Geschillenbeslechting

Geschillen ten aanzien van de uitlegging en/of uitvoering van dit Uitvoeringsprotocol die niet zijn afgehandeld door het commissie van deskundigen overeenkomstig artikel 8, worden door middel van overleg langs diplomatieke weg afgehandeld.

Artikel 14. Territoriale toepassing

Dit Uitvoeringsprotocol is van toepassing op het grondgebied van Bosnië en Herzegovina, het grondgebied van het Koninkrijk België, het grondgebied van het Groothertogdom Luxemburg en het grondgebied van het Koninkrijk der Nederlanden voor zover het Verdrag betreffende de werking van de Europese Unie op dit grondgebied van toepassing is.

Artikel 15. Inwerkingtreding, duur en opzegging

  • 1 De Partijen stellen de depositaris en elkaar ervan in kennis dat de nationale wettelijke procedures voor de inwerkingtreding van het Uitvoeringsprotocol zijn voltooid.

  • 2 Overeenkomstig artikel 19, tweede lid, van de Overeenkomst treedt dit Uitvoeringsprotocol in werking op de eerste dag van de tweede maand volgend op de datum van kennisgeving door de depositaris aan het Gemengd Comité overname dat de daarvoor noodzakelijke interne procedures door alle Partijen zijn voltooid. Een afschrift van de kennisgeving aan het Gemengd Comité overname wordt door de depositaris aan alle Partijen verstrekt.

  • 3 Overeenkomstig artikel 20 van de Overeenkomst heeft dit Uitvoeringsprotocol, in de relaties tussen Bosnië en Herzegovina en de Benelux-Staten, voorrang boven de bepalingen van de op 19 juli 2006 te Sarajevo tot stand gekomen Overeenkomst tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden) en Bosnië- Herzegovina betreffende de terug- en overname van onregelmatig binnengekomen en/of verblijvende personen (terug- en overnameovereenkomst). Deze Overeenkomst blijft van kracht tussen Curaçao, Sint Maarten en het Caribische deel van Nederland (Bonaire, Sint Eustatius en Saba) en Bosnië en Herzegovina.

  • 4 Indien de Overeenkomst buiten werking treedt, treedt ook dit Uitvoeringsprotocol buiten werking.

Artikel 16. Depositaris

Het Koninkrijk België is depositaris van dit Uitvoeringsprotocol voor de Benelux-landen. De depositaris voorziet iedere Partij van een eensluidend gewaarmerkt afschrift daarvan.

GEDAAN te Brussel op 5 december 2013, in tweevoud in de officiële talen van Bosnië en Herzegovina (de Bosnische, de Kroatische en de Servische taal) en de Nederlandse, de Franse en de Engelse taal, waarbij al deze teksten gelijkelijk authentiek zijn. In geval van verschillen in interpretatie is de Engelse tekst doorslaggevend.
