Agreement between the Government of the Kingdom of the Netherlands and the Government of the Hong Kong Special Administrative Region of the People's Republic of China concerning mutual legal assistance in criminal matters

The Government of the Kingdom of the Netherlands and the Government of the Hong Kong Special Administrative Region of the People's Republic of China (“Hong Kong Special Administrative Region”), having been duly authorised by the Central People's Government of the People's Republic of China, hereinafter referred to as the Parties;

Desiring to improve the effectiveness of their co-operation in criminal matters and in the confiscation of proceeds of crime;

Have agreed as follows:

Article 1. Scope of assistance

  • 1 The Parties shall provide each other, in accordance with the provisions of this Agreement, the widest measure of mutual assistance in investigations, prosecutions or proceedings in respect of offences the punishment of which, at the time of the request for assistance, falls within the jurisdiction of the Requesting Party.

  • 2 Assistance shall include, in particular:

    • a) identifying and locating persons;

    • b) taking testimony or other statements in the Requested Party;

    • c) providing information, objects, documents, records and evidence, including exhibits;

    • d) facilitating the personal appearance of persons in the Requesting Party to give testimony or to provide other assistance;

    • e) executing requests for search and seizure;

    • f) identifying, tracing, restraining and confiscating proceeds of crime as defined in Article 16; and

    • g) serving of documents.

  • 3 Assistance under this Agreement shall include assistance in connection with offences against a law relating to taxation, customs duties or other revenue matters, but not in connection with non criminal investigations or proceedings relating thereto.

Article 2. Central authority

  • 1 The Central Authorities of the Parties shall process all requests for assistance made in accordance with the provisions of this Agreement and handle all other communications concerning the application, interpretation and implementation of the Agreement.

  • 2 For the purposes of this Agreement, “Central Authority” means:

    • a) for the Hong Kong Special Administrative Region: the Secretary for Justice;

    • b) for the Kingdom of the Netherlands: the Minister of Justice of the Netherlands, the Minister of Justice of Curaçao, or the Minister of Justice of Sint Maarten, or the Minister of Justice of Aruba, as the case may be.

Article 3. Other assistance

This Agreement shall not preclude assistance being provided pursuant to other agreements or arrangements that are applicable to the Parties.

Article 4. Grounds of refusal

The Requested Party shall refuse assistance if:

  • a) the request relates to acts or omissions which would not have constituted an offence under the law of the Requested Party, if they had taken place within its jurisdiction;

  • b) the Requested Party being the Government of the Kingdom of the Netherlands, the execution of the request would impair the sovereignty, security, public order, or essential interests of the Kingdom of the Netherlands;

  • c) the Requested Party being the Government of the Hong Kong Special Administrative Region, the execution of the request would impair:

    • (i) the sovereignty, security or public order of the People's Republic of China; or

    • (ii) the essential interests of the Hong Kong Special Administrative Region;

  • d) the request relates to an offence of a political character;

  • e) the request relates to an offence under military law which is not an offence under ordinary criminal law;

  • f) the Requested Party has substantial grounds for believing that the request has been made for the purpose of prosecuting a person on account of his race, religion, nationality or political opinions;

  • g) the request relates to the prosecution of a person who is or who has become, for any reasons provided under the law of the Requested Party, immune from prosecution for the offence that underlies the request;

  • h) the Requesting Party cannot comply with conditions in relation to confidentiality or limitation as to the use of information or evidence to be provided.

Article 5. Requests

  • 1 Requests shall be made in writing or, where appropriate, through electronic means that are capable of leaving a written record.

  • 2 Requests for assistance shall include:

    • a) the name of the authority on behalf of which the request is made;

    • b) a description of the nature of the investigation, prosecution or proceeding and of the acts or omissions which constitute the offence underlying the request, as well as a summary of the relevant laws or the text of the applicable provisions, including the maximum penalty prescribed for the offence;

    • c) the purpose of the request, the nature of the assistance being sought and its relevance to the investigation, prosecution or proceeding;

    • d) where appropriate, a description of the formalities or procedures to be followed by the Requested Party in executing the request and the reasons therefor;

    • e) any requirements for confidentiality and the reasons therefor; and

    • f) a specification of any time limit within which compliance with the request is required and the reasons therefor.

  • 3 The Requesting Party may provide any other information it deems helpful for the execution of the request, including a description of the evidence or the information sought.

  • 4 The Requesting Party may require that the Requested Party keep confidential the fact and substance of the request, except to the extent necessary to execute the request. If the Requested Party cannot comply with the required confidentiality, it shall promptly consult with the Requesting Party.

  • 5 The Requested Party may request additional information considered necessary to execute the request.

  • 6 A request and documents submitted in support of the request shall, if they are not in English, be accompanied by translation into English.

Article 6. Execution of requests

  • 1 A request shall be promptly executed and in accordance with time limits set out in the request. However, if there are circumstances which prevent compliance within the time limits or which are likely to cause a significant delay in executing the request, the Requested Party shall promptly inform the Requesting Party.

  • 2 A request shall be executed in accordance with the provisions of this Agreement, the law of the Requested Party and, provided that they are not contrary to that Party's law, with any formalities and procedures expressly set out in the request.

  • 3 If the Requesting Party expressly requests, the Central Authority of the Requested Party shall inform it of the date and place of the execution of the request.

  • 4 Without prejudice to Article 10, paragraph (3), the Requested Party shall give favourable consideration to a request by the Requesting Party that the authorities involved and interested persons, and their legal representatives be present at the execution of a request.

  • 5 The Requested Party may postpone assistance if the execution of the request would interfere with an ongoing investigation or prosecution in the Requested Party.

  • 6 Before refusing or postponing assistance, the Requested Party shall promptly inform the Requesting Party of the reasons for considering refusal or postponement and consult with that Party to determine whether assistance may be given subject to such terms and conditions as the Requested Party deems necessary.

  • 7 The Requested Party shall inform the Requesting Party in writing of a decision to refuse assistance and the reasons therefor.

Article 7. Representation and expenses

  • 1 The Requested Party shall represent the interests of the Requesting Party in any proceedings arising out of a request for assistance.

  • 2 The Requested Party shall meet the costs of executing the request except that the Requesting Party shall bear:

    • a) the expenses associated with conveying any person to or from the Requested Party, and any fees, allowances or expenses payable to that person whilst in the Requesting Party pursuant to a request; and

    • b) the expenses associated with conveying custodial or escorting officers.

  • 3 If before or during the execution of the request it becomes apparent that execution of the request would impose an excessive burden on the Requested Party's resources or involve expenses of an extraordinary nature, the Parties shall consult to determine the terms and conditions under which the execution of the request may proceed or continue.

Article 8. Limitations on use

  • 1 The Requested Party may require that the Requesting Party not use any information or evidence obtained under this Agreement in any investigation, prosecution, or proceeding other than that described in the request without the prior consent of the Central Authority of the Requested Party. In such a situation, the Requesting Party shall comply with the requirement.

  • 2 The Requested Party may require that information or evidence furnished under this Agreement be kept confidential or be used only subject to terms and conditions it may specify. If the Central Authority of the Requesting Party accepts the information or evidence subject to such conditions, the Requesting Party shall comply with the conditions.

Article 9. Taking of evidence

Where a request is made that evidence be taken, the Requested Party shall arrange to have such evidence taken. The taking of evidence shall include the production of objects, documents, records and exhibits.

Article 10. Taking of testimony in the requested party

  • 1 Where a request is made that testimony be taken in the Requested Party, that Party shall arrange to have such testimony taken.

  • 2 In addition to the information referred to in Article 5, paragraph (2), the Requesting Party shall specify in its request the questions to be put to the person who is required to give testimony or the subject matter about which he or she is to be examined.

  • 3 The authorities involved in the Requesting Party and interested persons, and their legal representatives, may, subject to the law of the Requested Party, be present and question the person giving the testimony.

  • 4 A person who is required to give testimony may decline to do so where either:

    • a) the law of the Requested Party would permit him or her to decline to give testimony in similar circumstances in proceedings which originated in the Requested Party; or

    • b) the law of the Requesting Party would permit him or her to decline to give testimony in such proceedings in the Requesting Party.

  • 5 If a person claims that there is a right to decline to give testimony under the law of the Requesting Party, the Central Authority of the Requested Party shall, where appropriate, consult with the Central Authority of the Requesting Party and rely on a declaration provided by that Authority.

Article 11. Video conference

Where possible and consistent with their laws, the Parties may agree on a case by case basis that the taking of testimony takes place by means of video conference under specified conditions.

Article 12. Taking of testimony and providing assistance in the requesting party

  • 1 If the Requesting Party considers the appearance of a person in the Requesting Party necessary for the purpose of giving testimony or providing other assistance, it may ask the Requested Party to invite that person to appear.

  • 2 In addition to the information referred to in Article 5, paragraph (2), a request pursuant to this Article shall contain information as to:

    • a) the reason why the person's appearance in the Requesting Party is considered necessary;

    • b) the approximate dates on which the person is required to appear;

    • c) the person's rights, protections and obligations under the law of the Requesting Party;

    • d) where appropriate, arrangements for the person's security;

    • e) arrangements for the person's travel to and stay in the Requesting Party as well as his return; and

    • f) the amount of allowances payable to the person, including travel and accommodation expenses.

  • 3 The Requested Party shall, if satisfied that appropriate arrangements for that person's safety will be made by the Requesting Party, invite the person to appear in the Requesting Party and seek that person's concurrence thereto.

  • 4 A person who declines to appear shall not by reason thereof be liable to any penalty or coercive measure pursuant to the law of either Party.

Article 13. Transfer of persons in custody to the requesting party

  • 1 A person in custody in the Requested Party whose appearance is requested in the Requesting Party for the purpose of giving testimony or providing other assistance shall, if the Requested Party consents, be transferred to the Requesting Party for that purpose, provided that the Requesting Party has guaranteed maintaining the person in custody and his or her subsequent return as soon as the person's presence is no longer required, but no later than the time specified by the Requested Party.

  • 2 Transfer may be refused if:

    • a) the person concerned does not consent to appear;

    • b) his or her presence is required for an investigation or proceeding pending in the Requested Party; or

    • c) there are other overriding grounds against transfer.

  • 3 Where a person in custody who is transferred, becomes entitled under the law of the Requested Party to be released from custody whilst he or she is in the Requesting Party, the Requested Party shall inform the Requesting Party which shall ensure the person's release and thereafter treat the person as a person referred to in Article 12.

  • 4 A person who does not consent to be transferred shall not by reason thereof be liable to any penalty or coercive measure pursuant to the law of either Party.

Article 14. Safe conduct

  • 1 A person who consents to appear in the Requesting Party pursuant to Articles 12 or 13 shall not be prosecuted, detained, or restricted in his or her personal liberty in the Requesting Party for any criminal offence or be subject to any civil suit or any proceeding to which the person could not be subjected if he or she were not in the Requesting Party, in respect of any act or omission which preceded the person's departure from the Requested Party.

  • 2 Paragraph (1) shall cease to apply if the person, being free to leave, has not left the Requesting Party within a period of 15 days after having been officially notified that his or her presence is no longer required, or having left the Requesting Party, has returned.

  • 3 A person who consents to give testimony in the Requesting Party pursuant to Articles 12 or 13 shall not be subject to prosecution based on the testimony given, except in relation to perjury.

  • 4 A person who consents to give testimony in the Requesting Party pursuant to Articles 12 or 13 may decline to give testimony where either:

    • a) the law of the Requested Party would permit him or her to decline to give testimony in similar circumstances in proceedings which originated in the Requested Party; or

    • b) the law of the Requesting Party would permit him or her to decline to give testimony.

  • 5 If a person claims that there is a right to decline to give testimony under the law of the Requested Party, the Central Authority of the Requesting Party shall, where appropriate, consult with the Central Authority of the Requested Party and rely on a declaration provided by that Authority.

  • 6 A person who consents to appear in the Requesting Party pursuant to Articles 12 or 13 shall not be required to give testimony or to provide assistance in any proceedings other than those mentioned in the request.

Article 15. Search and seizure

  • 1 The Requested Party shall, insofar as its law permits, carry out requests for search, seizure or the production of documents, records or articles and transfer any material thus obtained, or copies thereof, to the Requesting Party.

  • 2 The Requested Party shall provide such information as may be required by the Requesting Party concerning the result of a search, the place and circumstances of seizure and the subsequent custody of the material seized.

  • 3 The Requesting Party shall observe any conditions imposed by the Requested Party in relation to any seized material which is delivered to the Requesting Party.

Article 16. Confiscation

  • 1 For the purpose of this Agreement, “proceeds of crime” shall mean:

    • a) assets of every kind, whether corporeal or incorporeal, movable or immovable, tangible or intangible, and legal documents or instruments evidencing title to or interest in such assets derived from or obtained, directly or indirectly, through the commission of an offence or the value which corresponds to such assets; and

    • b) property, equipment or other instrumentalities used in or destined for use in the commission of an offence.

  • 2 The Requested Party shall, upon request, endeavour to:

    • a) identify and trace any proceeds of crime located within its jurisdiction; and

    • b) restrain with a view to preventing any dealing in, transfer or disposal of such proceeds of crime.

  • 3 The Requested Party shall execute requests referred to in paragraph (2) in accordance with its law, pending a final determination in respect of those proceeds by a court of the Requesting Party. The Requested Party shall notify the Requesting Party immediately of the result of the execution of the request.

  • 4 The Requested Party shall, upon request, confiscate proceeds of crime in accordance with its law.

  • 5 In addition to the information referred to in Article 5, paragraph (2), requests made under this Article shall:

    • a) indicate, as precisely as possible, the description and the location of the proceeds of crime and their connection with the person suspected of, charged with or convicted of the offence; and

    • b) where the request is made under paragraph (4), be accompanied by a copy of any order of confiscation made by a judicial authority of the Requesting Party and a declaration by the Central Authority of the Requesting Party that the order is final and enforceable.

  • 6 Proceeds of crime confiscated pursuant to this Article shall be retained by the Requested Party. However, a Party may, to the extent permitted by its law, offer to transfer the proceeds of crime, or part thereof, to the other Party upon such terms as may be agreed.

  • 7 In the application of this Article, the rights of bona fide third parties shall be respected.

Article 17. Service of documents

  • 1 The Requested Party shall serve any document relating to a criminal matter transmitted to it for the purpose of service, provided that the document is accompanied by a translation into an official language of the Requested Party or at the minimum, a translation of the essential passages thereof.

  • 2 The Requesting Party shall transmit a request for the service of a document pertaining to a response within a reasonable time before the scheduled response.

  • 3 The Requesting Party shall transmit a request for the service of a document pertaining to an appearance in the Requesting Party at least thirty days before the scheduled appearance.

  • 4 The Requested Party shall give proof of service:

    • a) by means of a receipt dated and signed by the person served; or

    • b) by means of a declaration made by the Requested Party consistent with its domestic law that service has been effected and stating the form and date of such service.

  • 5 A person who fails to comply with a document served on him or her pursuant to this Article shall not by reason thereof be liable to any penalty or coercive measure pursuant to the law of either Party.

Article 18. Publicly available and official documents

  • 1 Subject to its law the Requested Party shall, upon request, provide copies of publicly available documents.

  • 2 The Requested Party may provide copies of any document, record or information in the possession of a government department or agency, but not publicly available, to the same extent and under the same conditions as such document, record or information would be available to its own law enforcement and judicial authorities.

Article 19. Certification

Evidence, documents, transcripts, records, statements or other material which are to be transmitted to the Requesting Party shall only be certified if the Requesting Party so requests. For that purpose certification by the Central Authority of the Requested Party shall be sufficient.

Article 20. Provision of information in connection with proceedings

Where an offence has been committed in one of the Parties and that offence may also be prosecuted by the other Party, the Party where the offence was committed may, if it decides not to prosecute the offence, inform the other Party. Upon request, the Party where the offence was committed, may assist the other Party, in particular by providing information and evidence in relation to that offence, with a view to prosecution of the offence in the latter Party.

Article 21. Settlement of disputes

Any dispute arising out of the interpretation, application or implementation of this Agreement shall be resolved through diplomatic channels if the Central Authorities themselves are unable to reach agreement.

Article 22. Territorial application

As regards the Kingdom of the Netherlands this Agreement shall apply to the part of the Kingdom in Europe only and may be extended to Curaçao, Sint Maarten and the Caribbean part of the Netherlands (the islands of Bonaire, Sint Eustasius and Saba) and/or to Aruba at the request of the Kingdom of the Netherlands.

Article 23. Entry into force

  • 1 This Agreement shall enter into force on the first day of the second month following the date on which the Parties have notified each other in writing that their respective legal requirements have been complied with.

  • 2 This Agreement shall apply to any requests presented after its entry into force even if the relevant acts and omissions occurred before that date.

Article 24. Termination

Either Party may terminate this Agreement at any time by written notification. Termination shall become effective six months after the date of the receipt of such notification. In case of extension of the applicability of this Agreement to Curaçao, Sint Maarten and the Caribbean part of the Netherlands (the islands of Bonaire, Sint Eustasius and Saba) and/or Aruba, the Kingdom of the Netherlands shall be entitled to terminate the application of this Agreement in respect of any of the constituent parts of the Kingdom of the Netherlands.

IN WITNESS whereof the undersigned, being duly authorised by their respective Governments, have signed this Agreement.

DONE at the Hong Kong Special Administrative Region this twenty-sixth day of August Two Thousand and Two in duplicate in the Dutch, Chinese and English languages, each version being equally authentic.

The Consulate-General of the Kingdom of the Netherlands presents its compliments to the Department of Justice of the Hong Kong Special Administrative Region of the People's Republic of China and, at the occasion of the signing of the Agreement between the Government of the Kingdom of the Netherlands and the Government of the Hong Kong Special Administrative Region of the People's Republic of China concerning mutual legal assistance in criminal matters (hereinafter referred to as “the Agreement”), has the honour to put on record the common understanding regarding the interpretation of the following provisions of the Agreement.

  • 1. Article 1, paragraph 2, contains a non-limitative list of the types of assistance covered by the Agreement. Notwithstanding the absence of a substantive provision, both Parties may request that voluntary statements be obtained from persons.

  • 2. The “essential interests” ground of refusal mentioned in Article 4, subparagraphs b and c, will permit the refusal of assistance if the death penalty could be imposed for the offence in respect of which assistance is sought. The same ground of refusal can be invoked, where the execution of the request could prejudice the safety of a person and the requested Party does not receive sufficient guarantees for the protection of the interests of that person.

  • 3. Notwithstanding further technological and legal developments, the reference in Article 5, paragraph 1, to “electronic means that are capable of leaving a written record” is intended to cover the use of facsimile transmissions and electronic mail. The use of electronic mail is intended for extremely urgent cases and will always be followed by a request in writing.

  • 4. Where a request under Article 10 is executed in the presence of the authorities of the requesting Party or their legal representatives, they are considered to be competent to give advice on the law of the requesting Party. In such cases it will not be appropriate to consult the Central Authority of the requesting Party or to insist on a declaration by the authority as envisaged in Article 10, paragraph 5. This interpretation will apply mutatis mutandis to Article 14, paragraph 5.

  • 5. The taking of testimony and providing of other assistance is intended for witnesses and experts, but not for defendants. Given the geographical distance between the Hong Kong SAR and the Kingdom of the Netherlands it is envisaged that Articles 12 and 13 will primarily be applied for the purpose of giving of testimony.

  • 6. Certification by the Central Authority within the meaning of Article 19 can be achieved by sealing the material with an official seal.

The Consulate General of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Department of Justice of the Hong Kong Special Administrative Region of the People's Republic of China the assurances of its highest consideration.

De Regering van het Koninkrijk der Nederlanden en de Regering van de Speciale Administratieve Regio Hong Kong van de Volksrepubliek China („Speciale Administratieve Regio Hong Kong”), daartoe naar behoren gemachtigd door de Centrale Volksregering van de Volksrepubliek China, hierna te noemen de Partijen;

Geleid door de wens de doeltreffendheid van hun samenwerking in strafzaken en bij de confiscatie van de opbrengst van misdrijven te verbeteren;

Zijn het volgende overeengekomen:

Artikel 1. Reikwijdte van de rechtshulp

  • 1 De Partijen verlenen elkaar, overeenkomstig de bepalingen van dit Verdrag, in zo ruim mogelijke mate wederzijdse rechtshulp bij onderzoeken, strafvervolging of gerechtelijke procedures die betrekking hebben op strafbare feiten waarvan de bestraffing, op het tijdstip waarop rechtshulp wordt gevraagd, tot de bevoegdheid behoort van de verzoekende Partij.

  • 2 Rechtshulp omvat, onder meer:

    • a. het identificeren en opsporen van personen;

    • b. het horen van getuigen of het verkrijgen van andere verklaringen in de aangezochte Partij;

    • c. het verstrekken van gegevens, voorwerpen, schriftelijke bescheiden, bestanden en bewijs met inbegrip van bewijsmiddelen;

    • d. het bevorderen van de persoonlijke verschijning van personen in de verzoekende Partij om verklaringen af te leggen of andere medewerking te verlenen;

    • e. het uitvoeren van verzoeken om doorzoeking en inbeslagneming;

    • f. het identificeren, volgen, inbeslagnemen en verbeurd verklaren van de opbrengsten van misdrijven als omschreven in artikel 16; en

    • g. het betekenen van stukken.

  • 3 De rechtshulp op basis van dit Verdrag omvat rechtshulp in verband met overtreding van de wetgeving inzake belastingheffing, douaneheffingen of andere aangelegenheden op het gebied van rijksinkomsten, echter niet met het oog op ander dan strafrechtelijk onderzoek of daarmee verband houdende gerechtelijke procedures.

Artikel 2. Centrale autoriteit

  • 1 De centrale autoriteiten van de Partijen behandelen alle verzoeken om rechtshulp die overeenkomstig de bepalingen van dit Verdrag zijn gedaan en behandelen alle overige mededelingen inzake de toepassing, uitleg en uitvoering van het Verdrag.

  • 2 Voor de toepassing van dit Verdrag wordt verstaan onder „centrale autoriteit”:

    • a. voor de Speciale Administratieve Regio Hong Kong: de Minister van Justitie;

    • b. voor het Koninkrijk der Nederlanden: de Minister van Justitie van Nederland, de Minister van Justitie van Curaçao, de Minister van Justitie van Sint Maarten of de Minister van Justitie van Aruba, naar gelang het geval.

Artikel 3. Overige rechtshulp

Dit Verdrag sluit niet uit dat rechtshulp wordt verleend ingevolge andere overeenkomsten en regelingen die tussen de Partijen van toepassing zijn.

Artikel 4. Weigeringsgronden

De aangezochte Partij weigert rechtshulp indien:

  • a. het verzoek betrekking heeft op handelen of nalaten dat volgens de wetgeving van de aangezochte Partij geen strafbaar feit zou zijn, indien dit binnen haar rechtsgebied zou hebben plaatsgevonden;

  • b. de aangezochte Partij de Regering van het Koninkrijk der Nederlanden is en de soevereiniteit, veiligheid, openbare orde of wezenlijke belangen van het Koninkrijk der Nederlanden door de uitvoering van het verzoek zouden worden aangetast;

  • c. de aangezochte Partij de Regering van de Speciale Administratieve Regio Hong Kong is, en:

    • i. de soevereiniteit, veiligheid of openbare orde van de Volksrepubliek China; of

    • ii. wezenlijke belangen van de Speciale Administratieve Regio Hong Kong door de uitvoering van het verzoek zouden worden aangetast;

  • d. het verzoek betrekking heeft op een strafbaar feit van politieke aard;

  • e. het verzoek betrekking heeft op een militair delict en dat feit niet tevens een strafbaar feit naar de gewone strafwet is;

  • f. de aangezochte Partij gegronde redenen heeft aan te nemen dat het verzoek is gedaan met de bedoeling een persoon op grond van zijn ras, godsdienst, nationaliteit of politieke gezindheid te vervolgen;

  • g. het verzoek betrekking heeft op de vervolging van een persoon die, naar het recht van de aangezochte Partij, niet kan of niet langer kan worden vervolgd terzake van het strafbare feit dat aanleiding tot het verzoek geeft;

  • h. de verzoekende Partij niet kan voldoen aan de voorwaarden inzake vertrouwelijkheid of de beperking van het gebruik van de te verstrekken gegevens of het te verstrekken bewijs.

Artikel 5. Verzoeken

  • 1 Verzoeken worden schriftelijk gedaan of, waar passend, met behulp van zodanige elektronische middelen dat zij schriftelijk kunnen worden vastgelegd.

  • 2 De verzoeken om rechtshulp omvatten:

    • a. de naam van de autoriteit namens welke het verzoek wordt gedaan;

    • b. een omschrijving van de aard van het onderzoek, de strafvervolging of gerechtelijke procedure en van het handelen of nalaten dat het strafbare feit vormt naar aanleiding waarvan het verzoek wordt gedaan, alsmede een samenvatting van de relevante wetgeving of de tekst van de toepasselijke wetsbepalingen, onder vermelding van de maximumstraf die op het strafbare feit is gesteld;

    • c. het doel van het verzoek, de aard van de verlangde rechtshulp en het belang hiervan voor het onderzoek, de strafvervolging of de gerechtelijke procedure;

    • d. voor zover van toepassing, een omschrijving van de formaliteiten of procedures die door de aangezochte Partij bij de uitvoering van het verzoek dienen te worden gevolgd en de redenen daarvoor;

    • e. eventuele eisen inzake vertrouwelijkheid en de redenen daarvoor; en

    • f. vermelding van enige termijn waarbinnen inwilliging van het verzoek wordt verlangd en de redenen daarvoor.

  • 3 De verzoekende Partij kan alle overige gegevens verstrekken die zij nuttig acht voor de uitvoering van het verzoek, met inbegrip van een omschrijving van het bewijs of de gegevens die worden gevraagd.

  • 4 De verzoekende Partij kan verlangen dat de aangezochte Partij het verzoek en de inhoud ervan vertrouwelijk behandelt, behalve voor zover nodig is voor de uitvoering van het verzoek. Indien de aangezochte Partij de verlangde vertrouwelijkheid niet kan waarborgen, pleegt zij onverwijld overleg met de verzoekende Partij.

  • 5 De aangezochte Partij kan vragen om aanvullende inlichtingen die zij noodzakelijk acht voor de uitvoering van het verzoek.

  • 6 Een verzoek en stukken ter ondersteuning van het verzoek gaan, indien deze niet in het Engels zijn gesteld, vergezeld van een vertaling in het Engels.

Artikel 6. Uitvoering van verzoeken

  • 1 Een verzoek wordt onverwijld uitgevoerd met inachtneming van de in het verzoek vermelde termijn. Indien echter omstandigheden inwilliging binnen de termijn onmogelijk maken of naar alle waarschijnlijkheid aanzienlijke vertraging in de uitvoering van het verzoek zullen veroorzaken, stelt de aangezochte Partij de verzoekende Partij hiervan onverwijld op de hoogte.

  • 2 Een verzoek wordt uitgevoerd in overeenstemming met het bepaalde in dit Verdrag, het recht van de aangezochte Partij en met de uitdrukkelijk in het verzoek vermelde formaliteiten en procedures, tenzij deze onverenigbaar zijn met het recht van die Partij.

  • 3 Indien de verzoekende Partij hierom uitdrukkelijk verzoekt, stelt de centrale autoriteit van de aangezochte Partij haar in kennis van de datum en plaats van uitvoering van het verzoek.

  • 4 Onverminderd artikel 10, derde lid, neemt de aangezochte Partij een verzoek van de verzoekende Partij inhoudende dat de betrokken autoriteiten en belanghebbenden alsmede hun wettelijke vertegenwoordigers bij de uitvoering van een verzoek aanwezig mogen zijn, welwillend in overweging.

  • 5 De aangezochte Partij kan de rechtshulp uitstellen indien de uitvoering van het verzoek een lopend onderzoek of lopende strafvervolging in de aangezochte Partij zou doorkruisen.

  • 6 Voordat de rechtshulp wordt geweigerd of uitgesteld, stelt de aangezochte Partij de verzoekende Partij onverwijld in kennis van de redenen van de voorgenomen weigering of het voorgenomen uitstel en pleegt zij overleg met die Partij teneinde vast te stellen of rechtshulp kan worden verleend onder de door de aangezochte Partij noodzakelijk geachte voorwaarden.

  • 7 De aangezochte Partij stelt de verzoekende Partij schriftelijk in kennis van een besluit tot weigering van rechtshulp en van de redenen hiervoor.

Artikel 7. Vertegenwoordiging en kosten

  • 1 De aangezochte Partij vertegenwoordigt de belangen van de verzoekende Partij in gerechtelijke procedures die verband houden met een rechtshulpverzoek.

  • 2 De aangezochte Partij draagt de kosten die gemoeid zijn met de uitvoering van verzoeken, met uitzondering van de door de verzoekende Partij te dragen:

    • a. kosten die verband houden met de overkomst van een persoon naar of uit de aangezochte Partij, alsook alle honoraria, toelagen en onkostenvergoedingen die aan die persoon verschuldigd zijn tijdens zijn verblijf in de verzoekende Partij; en

    • b. kosten die verband houden met de ambtenaren belast met de overkomst, detentie of begeleiding.

  • 3 Indien voor of tijdens de uitvoering van het verzoek blijkt dat de uitvoering van het verzoek een buitensporige belasting van de capaciteit van de aangezochte Partij zou betekenen of dat hiermee kosten van buitengewone aard gemoeid zijn, plegen de Partijen overleg teneinde de voorwaarden vast te stellen waaronder de uitvoering van het verzoek een aanvang kan nemen of kan worden voortgezet.

Artikel 8. Beperkingen

  • 1 De aangezochte Partij kan eisen dat de verzoekende Partij zonder voorafgaande toestemming van de centrale autoriteit van de aangezochte Partij gegevens of bewijs dat met toepassing van dit Verdrag is verkregen, niet gebruikt bij enig andere onderzoeken, strafvervolgingen of gerechtelijke procedures dan die welke zijn omschreven in het verzoek. In een dergelijke situatie zal de verzoekende Partij de voorwaarden naleven.

  • 2 De aangezochte Partij kan eisen dat met toepassing van dit Verdrag verstrekte gegevens of bewijs vertrouwelijk worden behandeld of uitsluitend worden gebruikt met inachtneming van de door haar gestelde voorwaarden. Indien de centrale autoriteit van de verzoekende Partij de gegevens of het bewijs onder dergelijke voorwaarden accepteert, zal de verzoekende Partij de voorwaarden naleven.

Artikel 9. Verkrijging van bewijs

Wanneer een verzoek tot verkrijging van bewijs wordt gedaan, treft de aangezochte Partij de nodige maatregelen om dit bewijs te verkrijgen. De verkrijging van bewijs omvat de overlegging van voorwerpen, schriftelijke bescheiden, bestanden en bewijsmiddelen.

Artikel 10. Het horen van getuigen in de aangezochte Partij

  • 1 Wanneer een verzoek wordt gedaan tot het horen van getuigen in de aangezochte Partij, treft die Partij daartoe de nodige maatregelen.

  • 2 In aanvulling op de in artikel 5, tweede lid, bedoelde gegevens vermeldt de verzoekende Partij in haar verzoek de vragen die aan de te horen persoon moeten worden gesteld of de aangelegenheid waarover hij of zij moet worden gehoord.

  • 3 De in de verzoekende Partij betrokken autoriteiten en belanghebbenden alsmede hun wettelijke vertegenwoordigers, mogen, met inachtneming van het recht van de aangezochte Partij, aanwezig zijn en de te horen persoon ondervragen.

  • 4 Een persoon die wordt gehoord, kan dit weigeren wanneer hetzij:

    • a. het recht van de aangezochte Partij voor hem of haar een verschoningsrecht of -plicht kent onder vergelijkbare omstandigheden in gerechtelijke procedures die zijn ingesteld in de aangezochte Partij; of

    • b. het recht van de verzoekende Partij het voor hem of haar in dergelijke gerechtelijke procedures in de verzoekende Partij een verschoningsrecht of -plicht kent.

  • 5 Indien een persoon zich erop beroept dat ingevolge het recht van de verzoekende Partij een verschoningsrecht of -plicht bestaat, pleegt de centrale autoriteit van de aangezochte Partij, in voorkomend geval, overleg met de centrale autoriteit van de verzoekende Partij en vertrouwt zij op een door die autoriteit verstrekte verklaring.

Artikel 11. Videoconferentie

Voor zover mogelijk en in overeenstemming met hun wetgeving, kunnen Partijen per geval overeenkomen dat het horen van getuigen door middel van videoconferentie, onder duidelijk omschreven voorwaarden, plaatsvindt.

Artikel 12. Het horen van personen en het verlenen van medewerking in de verzoekende Partij

  • 1 Indien de verzoekende Partij de verschijning van een persoon in de verzoekende Partij noodzakelijk acht teneinde te worden gehoord of voor het verlenen van andere medewerking, kan zij de aangezochte Partij vragen die persoon te verzoeken te verschijnen.

  • 2 In aanvulling op de in artikel 5, tweede lid, vermelde gegevens bevat een verzoek ingevolge dit artikel het volgende:

    • a. de reden waarom de verschijning van de persoon in de verzoekende Partij noodzakelijk wordt geacht;

    • b. de data – bij benadering – waarop de persoon dient te verschijnen;

    • c. de rechten, bescherming en verplichtingen van de persoon volgens het recht van de verzoekende Partij;

    • d. voor zover van toepassing, maatregelen voor de veiligheid van de persoon;

    • e. de regeling van de reis naar en het verblijf in de verzoekende Partij, alsmede de terugreis; en

    • f. de hoogte van de aan de persoon te betalen vergoedingen, inclusief reis- en verblijfkosten.

  • 3 Indien zij ervan overtuigd is dat door de verzoekende Partij passende maatregelen worden getroffen voor de veiligheid van die persoon, verzoekt de aangezochte Partij de persoon in de verzoekende Partij te verschijnen en tracht zij de medewerking van deze persoon te verkrijgen.

  • 4 Een persoon die weigert te verschijnen, mag om die reden niet worden blootgesteld aan enige sanctie of dwangmaatregel naar het recht van een van beide Partijen.

Artikel 13. Overbrenging naar de verzoekende Partij van personen die zich in detentie bevinden

  • 1 Een persoon die zich in de aangezochte Partij in detentie bevindt en wiens verschijning verlangd wordt in de verzoekende Partij teneinde te worden gehoord of voor het verlenen van andere medewerking, wordt, indien de aangezochte Partij hiermee instemt, hiertoe overgebracht naar de verzoekende Partij, mits de verzoekende Partij de voortgezette detentie van de persoon en zijn of haar terugkeer zodra de aanwezigheid van de persoon niet langer vereist is, doch uiterlijk op het door de aangezochte Partij vermelde tijdstip, waarborgt.

  • 2 De overbrenging kan worden geweigerd indien:

    • a. de betrokken persoon niet instemt met zijn verschijning;

    • b. zijn of haar aanwezigheid vereist is voor een in de aangezochte Partij hangend onderzoek of lopende procedure; of

    • c. er andere zwaarwegende gronden tegen de overbrenging bestaan.

  • 3 Wanneer een persoon die zich in detentie bevindt, wordt overgebracht en volgens het recht van de aangezochte Partij in aanmerking komt voor invrijheidstelling terwijl hij of zij zich in de verzoekende Partij bevindt, stelt de aangezochte Partij de verzoekende Partij hiervan in kennis. Deze ziet erop toe dat de persoon in vrijheid wordt gesteld en de persoon vervolgens wordt behandeld als een in artikel 12 vermelde persoon.

  • 4 Een persoon die weigert te worden overgebracht, mag om die reden niet worden blootgesteld aan enige sanctie of dwangmaatregel naar het recht van een van beide Partijen.

Artikel 14. Vrijgeleide

  • 1 Een persoon die overeenkomstig artikel 12 of 13 ermee instemt in de verzoekende Partij te verschijnen, mag ter zake van handelen of nalaten dat plaatsvond voordat de persoon uit de aangezochte Partij vertrok, in de verzoekende Partij niet worden vervolgd, in detentie worden genomen of in zijn of haar persoonlijke vrijheid worden beperkt wegens een strafbaar feit en niet worden blootgesteld aan een civiele procedure of enige andere procedure waaraan de persoon niet zou kunnen worden blootgesteld indien hij of zij zich niet in de verzoekende Partij zou bevinden.

  • 2 Het eerste lid is niet langer van toepassing wanneer de persoon vrijelijk kan vertrekken, doch de verzoekende Partij niet heeft verlaten binnen een tijdvak van vijftien dagen nadat hij of zij er officieel van in kennis is gesteld dat zijn of haar aanwezigheid niet langer vereist is of, na de verzoekende Partij te hebben verlaten, is teruggekeerd.

  • 3 Een persoon die overeenkomstig artikel 12 of 13 ermee instemt te worden gehoord in de verzoekende Partij, mag niet worden vervolgd wegens de afgelegde getuigenis, behalve in verband met meineed.

  • 4 Een persoon die overeenkomstig artikel 12 of 13 ermee instemt in de verzoekende Partij te worden gehoord, kan weigeren een verklaring af te leggen wanneer hetzij:

    • a. het recht van de aangezochte Partij voor hem of haar een verschoningsrecht of -plicht kent onder vergelijkbare omstandigheden in gerechtelijke procedures die zijn ingesteld in de aangezochte Partij; of

    • b. het recht van de verzoekende Partij het voor hem of haar in dergelijke gerechtelijke procedures in de verzoekende Partij een verschoningsrecht of -plicht kent.

  • 5 Indien een persoon zich erop beroept dat ingevolge het recht van de aangezochte Partij een verschoningsrecht of -plicht bestaat, pleegt de centrale autoriteit van de verzoekende Partij, in voorkomend geval, overleg met de centrale autoriteit van de aangezochte Partij en vertrouwt zij op een door die autoriteit verstrekte verklaring.

  • 6 Van een persoon die overeenkomstig artikel 12 of 13 ermee instemt in de verzoekende Partij te verschijnen, mag niet worden verlangd dat hij een verklaring aflegt of medewerking verleent in enige andere gerechtelijke procedure dan die welke in het verzoek is vermeld.

Artikel 15. Doorzoeking en inbeslagneming

  • 1 De aangezochte Partij geeft, in zoverre haar wetten zulks toelaat, gevolg aan verzoeken om doorzoeking, inbeslagneming of de uitlevering ter inbeslagneming van schriftelijke bescheiden, bestanden of voorwerpen en de overdracht van aldus verkregen bewijsmateriaal, of afschriften daarvan, aan de verzoekende Partij.

  • 2 De aangezochte Partij verstrekt alle gegevens waarom de verzoekende Partij verzoekt met betrekking tot de resultaten van de doorzoeking, de plaats en omstandigheden van inbeslagneming en de daaropvolgende bewaring van het in beslag genomen bewijsmateriaal.

  • 3 De verzoekende Partij voldoet aan alle voorwaarden die door de aangezochte Partij worden gesteld met betrekking tot al het in beslag genomen en aan de verzoekende Partij overgedragen bewijsmateriaal.

Artikel 16. Confiscatie

  • 1 Voor de toepassing van dit Verdrag wordt verstaan onder „opbrengsten van misdrijven”:

    • a. vermogensbestanddelen van enigerlei aard, materieel of immaterieel, roerend of onroerend, stoffelijk of onstoffelijk, alsmede rechtsbescheiden waaruit de eigendom of andere rechten ten aanzien van die vermogensbestanddelen blijken, direct of indirect afkomstig van of verkregen door het plegen van een strafbaar feit, of de waarde die met dergelijke vermogensbestanddelen overeenkomt; en

    • b. voorwerpen, apparatuur of andere hulpmiddelen die zijn gebruikt of zijn bestemd om te worden gebruikt bij het plegen van een strafbaar feit.

  • 2 De aangezochte Partij zal op verzoek trachten:

    • a. opbrengsten van misdrijven die zich in haar rechtsgebied bevinden, vast te stellen en op te sporen; en

    • b. deze opbrengsten van misdrijven vast te houden teneinde de verhandeling, overdracht of vervreemding hiervan te voorkomen.

  • 3 De aangezochte Partij voert de in het tweede lid bedoelde verzoeken uit in overeenstemming met haar wetgeving hangende een definitieve beslissing over deze opbrengsten door een rechtscollege van de verzoekende Partij. De aangezochte Partij stelt de verzoekende Partij onverwijld in kennis van het resultaat van de uitvoering van het verzoek.

  • 4 De aangezochte Partij gaat, op verzoek, over tot confiscatie van de opbrengsten van misdrijven in overeenstemming met haar wetgeving.

  • 5 Naast de in artikel 5, tweede lid, vermelde gegevens bevatten verzoeken uit hoofde van dit artikel:

    • a. een zo precies mogelijke omschrijving en plaatsbepaling van de opbrengsten van misdrijven en hun verband met de persoon die van het strafbare feit wordt verdacht, aan wie dit ten laste wordt gelegd of die ter zake daarvan is veroordeeld; en

    • b. voor zover het verzoek is gedaan uit hoofde van het vierde lid, een afschrift van een bevel tot confiscatie afgegeven door een gerechtelijke autoriteit van de verzoekende Partij en een verklaring van de centrale autoriteit van de verzoekende Partij dat het bevel definitief en voor tenuitvoerlegging vatbaar is.

  • 6 De ingevolge dit artikel geconfisqueerde opbrengsten van misdrijven worden door de aangezochte Partij behouden. Een Partij kan evenwel, voorzover haar wetgeving zulks toestaat, aanbieden de opbrengsten van misdrijven, of een deel daarvan, op nader overeen te komen wijze aan de andere Partij over te dragen.

  • 7 Bij de toepassing van dit artikel worden de rechten van derden te goeder trouw geëerbiedigd.

Artikel 17. Betekening van stukken

  • 1 De aangezochte Partij betekent elk hem ter betekening toegezonden stuk dat betrekking heeft op een strafrechtelijke aangelegenheid, mits dat stuk vergezeld gaat van een vertaling in een officiële taal van de aangezochte Partij of ten minste een vertaling van de essentie daarvan.

  • 2 De verzoekende Partij verzendt een verzoek om betekening van een stuk waarop een reactie wordt verwacht binnen een redelijke termijn vóór het tijdstip waarop de reactie wordt verwacht.

  • 3 De verzoekende Partij zendt een verzoek om betekening van een dagvaarding of oproep om te verschijnen in de verzoekende Partij, ten minste 30 dagen voor de datum waarop de betrokkene moet verschijnen.

  • 4 De aangezochte Partij verstrekt een bewijs van betekening:

    • a. door middel van een door de geadresseerde gedateerd en ondertekend ontvangstbewijs; of

    • b. een verklaring van de aangezochte Partij opgemaakt in overeenstemming met haar wetgeving dat de betekening heeft plaatsgevonden, alsmede de wijze en de datum waarop dit is gebeurd.

  • 5 Een persoon die geen gehoor geeft aan een hem of haar overeenkomstig dit artikel betekend stuk wordt om die reden niet blootgesteld aan sancties of dwangmaatregelen naar het recht van een van beide Partijen.

Artikel 18. Openbare en overheidsstukken

  • 1 Met inachtneming van haar wetgeving verstrekt de aangezochte Partij op verzoek afschriften van voor een ieder toegankelijke stukken.

  • 2 De aangezochte Partij kan afschriften verstrekken van stukken, schriftelijke bescheiden, of gegevens in bezit van een onderdeel van een ministerie of overheidsdienst, doch die niet voor een ieder toegankelijk zijn, in dezelfde mate als waarin en op dezelfde voorwaarden als waarop dergelijke stukken, schriftelijke bescheiden of gegevens toegankelijk zouden zijn voor haar eigen politiefunctionarissen en rechterlijke autoriteiten.

Artikel 19. Waarmerking

Bewijs, schriftelijke bescheiden, afschriften, bestanden, verklaringen of andere bewijsmateriaal die aan de verzoekende Partij moeten worden gezonden, worden slechts gewaarmerkt indien de verzoekende Partij daarom vraagt. In dit verband is waarmerking door de centrale autoriteit van de aangezochte Partij voldoende.

Artikel 20. Verstrekking van gegevens in verband met strafvervolging

Wanneer een strafbaar feit is gepleegd in een van de Partijen en dat strafbare feit eveneens kan worden vervolgd door de andere Partij, kan de Partij waar het strafbare feit is gepleegd, indien zij besluit geen vervolging in te stellen, de andere Partij hiervan in kennis stellen. Op verzoek kan de Partij waar het strafbare feit is gepleegd de andere Partij bijstaan, in het bijzonder door het verstrekken van gegevens en bewijs verband houdende met dat strafbare feit, met het oog op het instellen van een strafvervolging terzake van het strafbare feit in laatstgenoemde Partij.

Artikel 21. Beslechting van geschillen

Geschillen die voortvloeien uit de uitleg, toepassing of uitvoering van dit Verdrag worden langs diplomatieke weg opgelost, indien de centrale autoriteiten zelf niet in staat zijn overeenstemming te bereiken.

Artikel 22. Territoriale toepassing

Wat het Koninkrijk der Nederlanden betreft is dit Verdrag uitsluitend van toepassing op het deel van het Koninkrijk in Europa en kan het op verzoek van het Koninkrijk der Nederlanden worden uitgebreid tot Curaçao, Sint Maarten, het Caribische deel van Nederland (de eilanden Bonaire, Sint Eustasius en Saba) en/of Aruba.

Artikel 23. Inwerkingtreding

  • 1 Dit Verdrag treedt in werking op de eerste dag van de tweede maand volgend op de datum waarop de Partijen elkaar schriftelijk ervan in kennis hebben gesteld dat aan hun respectieve wettelijke vereisten is voldaan.

  • 2 Dit Verdrag is van toepassing op verzoeken die worden ingediend nadat het in werking is getreden, zelfs indien het desbetreffende handelen en nalaten zich voordeden voor die datum.

Artikel 24. Beëindiging

Elk van beide Partijen kan dit Verdrag te allen tijde beëindigen door middel van een schriftelijke kennisgeving. De beëindiging wordt van kracht zes maanden na de datum van ontvangst van een zodanige kennisgeving. In geval van uitbreiding van de toepasselijkheid van dit Verdrag tot Curaçao, Sint Maarten, het Caribische deel van Nederland (de eilanden Bonaire, Sint Eustasius en Saba) en/of Aruba, is het Koninkrijk der Nederlanden gerechtigd de toepassing van dit Verdrag te beëindigen ten aanzien van elk afzonderlijk deel van het Koninkrijk der Nederlanden.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd door hun respectieve Regeringen, dit Verdrag hebben ondertekend.

GEDAAN te Hong Kong op de zesentwintigste augustus twee duizend en twee, in tweevoud, in de Nederlandse, de Chinese en de Engelse taal, zijnde alle teksten gelijkelijk authentiek.
