Nagoya Protocol on access to genetic resources and the fair and equitable sharing of benefits arising from their utilization to the Convention on biological diversity

The Parties to this Protocol,

Being Parties to the Convention on Biological Diversity, hereinafter referred to as “the Convention”,

Recalling that the fair and equitable sharing of benefits arising from the utilization of genetic resources is one of three core objectives of the Convention, and recognizing that this Protocol pursues the implementation of this objective within the Convention,

Reaffirming the sovereign rights of States over their natural resources and according to the provisions of the Convention,

Recalling further Article 15 of the Convention,

Recognizing the important contribution to sustainable development made by technology transfer and cooperation to build research and innovation capacities for adding value to genetic resources in developing countries, in accordance with Articles 16 and 19 of the Convention,

Recognizing that public awareness of the economic value of ecosystems and biodiversity and the fair and equitable sharing of this economic value with the custodians of biodiversity are key incentives for the conservation of biological diversity and the sustainable use of its components,

Acknowledging the potential role of access and benefit-sharing to contribute to the conservation and sustainable use of biological diversity, poverty eradication and environmental sustainability and thereby contributing to achieving the Millennium Development Goals,

Acknowledging the linkage between access to genetic resources and the fair and equitable sharing of benefits arising from the utilization of such resources,

Recognizing the importance of providing legal certainty with respect to access to genetic resources and the fair and equitable sharing of benefits arising from their utilization,

Further recognizing the importance of promoting equity and fairness in negotiation of mutually agreed terms between providers and users of genetic resources,

Recognizing also the vital role that women play in access and benefitsharing and affirming the need for the full participation of women at all levels of policymaking and implementation for biodiversity conservation,

Determined to further support the effective implementation of the access and benefit-sharing provisions of the Convention,

Recognizing that an innovative solution is required to address the fair and equitable sharing of benefits derived from the utilization of genetic resources and traditional knowledge associated with genetic resources that occur in transboundary situations or for which it is not possible to grant or obtain prior informed consent,

Recognizing the importance of genetic resources to food security, public health, biodiversity conservation, and the mitigation of and adaptation to climate change,

Recognizing the special nature of agricultural biodiversity, its distinctive features and problems needing distinctive solutions,

Recognizing the interdependence of all countries with regard to genetic resources for food and agriculture as well as their special nature and importance for achieving food security worldwide and for sustainable development of agriculture in the context of poverty alleviation and climate change and acknowledging the fundamental role of the International Treaty on Plant Genetic Resources for Food and Agriculture and the FAO Commission on Genetic Resources for Food and Agriculture in this regard,

Mindful of the International Health Regulations (2005) of the World Health Organization and the importance of ensuring access to human pathogens for public health preparedness and response purposes,

Acknowledging ongoing work in other international forums relating to access and benefit-sharing,

Recalling the Multilateral System of Access and Benefit-sharing established under the International Treaty on Plant Genetic Resources for Food and Agriculture developed in harmony with the Convention,

Recognizing that international instruments related to access and benefit-sharing should be mutually supportive with a view to achieving the objectives of the Convention,

Recalling the relevance of Article 8(j) of the Convention as it relates to traditional knowledge associated with genetic resources and the fair and equitable sharing of benefits arising from the utilization of such knowledge,

Noting the interrelationship between genetic resources and traditional knowledge, their inseparable nature for indigenous and local communities, the importance of the traditional knowledge for the conservation of biological diversity and the sustainable use of its components, and for the sustainable livelihoods of these communities,

Recognizing the diversity of circumstances in which traditional knowledge associated with genetic resources is held or owned by indigenous and local communities,

Mindful that it is the right of indigenous and local communities to identify the rightful holders of their traditional knowledge associated with genetic resources, within their communities;

Further recognizing the unique circumstances where traditional knowledge associated with genetic resources is held in countries, which may be oral, documented or in other forms, reflecting a rich cultural heritage relevant for conservation and sustainable use of biological diversity,

Noting the United Nations Declaration on the Rights of Indigenous Peoples, and

Affirming that nothing in this Protocol shall be construed as diminishing or extinguishing the existing rights of indigenous and local communities,

Have agreed as follows:

Article 1. Objective

The objective of this Protocol is the fair and equitable sharing of the benefits arising from the utilization of genetic resources, including by appropriate access to genetic resources and by appropriate transfer of relevant technologies, taking into account all rights over those resources and to technologies, and by appropriate funding, thereby contributing to the conservation of biological diversity and the sustainable use of its components.

Article 2. Use of terms

The terms defined in Article 2 of the Convention shall apply to this Protocol. In addition, for the purposes of this Protocol:

  • a) “Conference of the Parties” means the Conference of the Parties to the Convention;

  • b) “Convention” means the Convention on Biological Diversity;

  • c) “Utilization of genetic resources” means to conduct research and development on the genetic and/or biochemical composition of genetic resources, including through the application of biotechnology as defined in Article 2 of the Convention;

  • d) “Biotechnology” as defined in Article 2 of the Convention means any technological application that uses biological systems, living organisms, or derivatives thereof, to make or modify products or processes for specific use;

  • e) “Derivative” means a naturally occurring biochemical compound resulting from the genetic expression or metabolism of biological or genetic resources, even if it does not contain functional units of heredity.

Article 3. Scope

This Protocol shall apply to genetic resources within the scope of Article 15 of the Convention and to the benefits arising from the utilization of such resources. This Protocol shall also apply to traditional knowledge associated with genetic resources within the scope of the Convention and to the benefits arising from the utilization of such knowledge.

Article 4. Relationship with international agreements and instruments

  • 1 The provisions of this Protocol shall not affect the rights and obligations of any Party deriving from any existing international agreement, except where the exercise of those rights and obligations would cause a serious damage or threat to biological diversity. This paragraph is not intended to create a hierarchy between this Protocol and other international instruments.

  • 2 Nothing in this Protocol shall prevent the Parties from developing and implementing other relevant international agreements, including other specialized access and benefit-sharing agreements, provided that they are supportive of and do not run counter to the objectives of the Convention and this Protocol.

  • 3 This Protocol shall be implemented in a mutually supportive manner with other international instruments relevant to this Protocol. Due regard should be paid to useful and relevant ongoing work or practices under such international instruments and relevant international organizations, provided that they are supportive of and do not run counter to the objectives of the Convention and this Protocol.

  • 4 This Protocol is the instrument for the implementation of the access and benefit-sharing provisions of the Convention. Where a specialized international access and benefit-sharing instrument applies that is consistent with, and does not run counter to the objectives of the Convention and this Protocol, this Protocol does not apply for the Party or Parties to the specialized instrument in respect of the specific genetic resource covered by and for the purpose of the specialized instrument.

Article 5. Fair and equitable benefit-sharing

  • 1 In accordance with Article 15, paragraphs 3 and 7 of the Convention, benefits arising from the utilization of genetic resources as well as subsequent applications and commercialization shall be shared in a fair and equitable way with the Party providing such resources that is the country of origin of such resources or a Party that has acquired the genetic resources in accordance with the Convention. Such sharing shall be upon mutually agreed terms.

  • 2 Each Party shall take legislative, administrative or policy measures, as appropriate, with the aim of ensuring that benefits arising from the utilization of genetic resources that are held by indigenous and local communities, in accordance with domestic legislation regarding the established rights of these indigenous and local communities over these genetic resources, are shared in a fair and equitable way with the communities concerned, based on mutually agreed terms.

  • 3 To implement paragraph 1 above, each Party shall take legislative, administrative or policy measures, as appropriate.

  • 4 Benefits may include monetary and non monetary benefits, including but not limited to those listed in the Annex.

  • 5 Each Party shall take legislative, administrative or policy measures as appropriate, in order that the benefits arising from the utilization of traditional knowledge associated with genetic resources are shared in a fair and equitable way with indigenous and local communities holding such knowledge. Such sharing shall be upon mutually agreed terms.

Article 6. Access to genetic resources

  • 1 In the exercise of sovereign rights over natural resources, and subject to domestic access and benefit-sharing legislation or regulatory requirements, access to genetic resources for their utilization shall be subject to the prior informed consent of the Party providing such resources that is the country of origin of such resources or a Party that has acquired the genetic resources in accordance with the Convention, unless otherwise determined by that Party.

  • 2 In accordance with domestic law, each Party shall take measures, as appropriate, with the aim of ensuring that the prior informed consent or approval and involvement of indigenous and local communities is obtained for access to genetic resources where they have the established right to grant access to such resources.

  • 3 Pursuant to paragraph 1 above, each Party requiring prior informed consent shall take the necessary legislative, administrative or policy measures, as appropriate, to:

    • a) Provide for legal certainty, clarity and transparency of their domestic access and benefit sharing legislation or regulatory requirements;

    • b) Provide for fair and non-arbitrary rules and procedures on accessing genetic resources;

    • c) Provide information on how to apply for prior informed consent;

    • d) Provide for a clear and transparent written decision by a competent national authority, in a cost-effective manner and within a reasonable period of time;

    • e) Provide for the issuance at the time of access of a permit or its equivalent as evidence of the decision to grant prior informed consent and of the establishment of mutually agreed terms, and notify the Access and Benefit-sharing Clearing-House accordingly;

    • f) Where applicable, and subject to domestic legislation, set out criteria and/or processes for obtaining prior informed consent or approval and involvement of indigenous and local communities for access to genetic resources; and

    • g) Establish clear rules and procedures for requiring and establishing mutually agreed terms. Such terms shall be set out in writing and may include, inter alia:

      • (i) A dispute settlement clause;

      • (ii) Terms on benefit-sharing, including in relation to intellectual property rights;

      • (iii) Terms on subsequent third-party use, if any; and

      • (iv) Terms on changes of intent, where applicable.

Article 7. Access to traditional knowledge associated with genetic resources

In accordance with domestic law, each Party shall take measures, as appropriate, with the aim of ensuring that traditional knowledge associated with genetic resources that is held by indigenous and local communities is accessed with the prior and informed consent or approval and involvement of these indigenous and local communities, and that mutually agreed terms have been established.

Article 8. Special considerations

In the development and implementation of its access and benefit-sharing legislation or regulatory requirements, each Party shall:

  • a) Create conditions to promote and encourage research which contributes to the conservation and sustainable use of biological diversity, particularly in developing countries, including through simplified measures on access for non-commercial research purposes, taking into account the need to address a change of intent for such research;

  • b) Pay due regard to cases of present or imminent emergencies that threaten or damage human, animal or plant health, as determined nationally or internationally. Parties may take into consideration the need for expeditious access to genetic resources and expeditious fair and equitable sharing of benefits arising out of the use of such genetic resources, including access to affordable treatments by those in need, especially in developing countries;

  • c) Consider the importance of genetic resources for food and agriculture and their special role for food security.

Article 9. Contribution to conservation and sustainable use

The Parties shall encourage users and providers to direct benefits arising from the utilization of genetic resources towards the conservation of biological diversity and the sustainable use of its components.

Article 10. Global multilateral benefit-sharing mechanism

Parties shall consider the need for and modalities of a global multilateral benefit-sharing mechanism to address the fair and equitable sharing of benefits derived from the utilization of genetic resources and traditional knowledge associated with genetic resources that occur in transboundary situations or for which it is not possible to grant or obtain prior informed consent. The benefits shared by users of genetic resources and traditional knowledge associated with genetic resources through this mechanism shall be used to support the conservation of biological diversity and the sustainable use of its components globally.

Article 11. Transboundary cooperation

  • 1 In instances where the same genetic resources are found in situ within the territory of more than one Party, those Parties shall endeavour to cooperate, as appropriate, with the involvement of indigenous and local communities concerned, where applicable, with a view to implementing this Protocol.

  • 2 Where the same traditional knowledge associated with genetic resources is shared by one or more indigenous and local communities in several Parties, those Parties shall endeavour to cooperate, as appropriate, with the involvement of the indigenous and local communities concerned, with a view to implementing the objective of this Protocol.

Article 12. Traditional knowledge associated with genetic resources

  • 1 In implementing their obligations under this Protocol, Parties shall in accordance with domestic law take into consideration indigenous and local communities’ customary laws, community protocols and procedures, as applicable, with respect to traditional knowledge associated with genetic resources.

  • 2 Parties, with the effective participation of the indigenous and local communities concerned, shall establish mechanisms to inform potential users of traditional knowledge associated with genetic resources about their obligations, including measures as made available through the Access and Benefit-sharing Clearing-House for access to and fair and equitable sharing of benefits arising from the utilization of such knowledge.

  • 3 Parties shall endeavour to support, as appropriate, the development by indigenous and local communities, including women within these communities, of:

    • a) Community protocols in relation to access to traditional knowledge associated with genetic resources and the fair and equitable sharing of benefits arising out of the utilization of such knowledge;

    • b) Minimum requirements for mutually agreed terms to secure the fair and equitable sharing of benefits arising from the utilization of traditional knowledge associated with genetic resources; and

    • c) Model contractual clauses for benefit-sharing arising from the utilization of traditional knowledge associated with genetic resources.

  • 4 Parties, in their implementation of this Protocol, shall, as far as possible, not restrict the customary use and exchange of genetic resources and associated traditional knowledge within and amongst indigenous and local communities in accordance with the objectives of the Convention.

Article 13. National focal points and competent national authorities

  • 1 Each Party shall designate a national focal point on access and benefit-sharing.

    The national focal point shall make information available as follows:

    • a) For applicants seeking access to genetic resources, information on procedures for obtaining prior informed consent and establishing mutually agreed terms, including benefit-sharing;

    • b) For applicants seeking access to traditional knowledge associated with genetic resources, where possible, information on procedures for obtaining prior informed consent or approval and involvement, as appropriate, of indigenous and local communities and establishing mutually agreed terms including benefit-sharing; and

    • c) Information on competent national authorities, relevant indigenous and local communities and relevant stakeholders.

    The national focal point shall be responsible for liaison with the Secretariat.

  • 2 Each Party shall designate one or more competent national authorities on access and benefit sharing. Competent national authorities shall, in accordance with applicable national legislative, administrative or policy measures, be responsible for granting access or, as applicable, issuing written evidence that access requirements have been met and be responsible for advising on applicable procedures and requirements for obtaining prior informed consent and entering into mutually agreed terms.

  • 3 A Party may designate a single entity to fulfil the functions of both focal point and competent national authority.

  • 4 Each Party shall, no later than the date of entry into force of this Protocol for it, notify the Secretariat of the contact information of its national focal point and its competent national authority or authorities. Where a Party designates more than one competent national authority, it shall convey to the Secretariat, with its notification thereof, relevant information on the respective responsibilities of those authorities. Where applicable, such information shall, at a minimum, specify which competent authority is responsible for the genetic resources sought. Each Party shall forthwith notify the Secretariat of any changes in the designation of its national focal point or in the contact information or responsibilities of its competent national authority or authorities.

  • 5 The Secretariat shall make information received pursuant to paragraph 4 above available through the Access and Benefit-sharing Clearing-House.

Article 14. The Access and Benefit-sharing Clearing-House and information sharing

  • 1 An Access and Benefit-sharing Clearing-House is hereby established as part of the clearing house mechanism under Article 18, paragraph 3, of the Convention. It shall serve as a means for sharing of information related to access and benefit-sharing. In particular, it shall provide access to information made available by each Party relevant to the implementation of this Protocol.

  • 2 Without prejudice to the protection of confidential information, each Party shall make available to the Access and Benefit-sharing Clearing-House any information required by this Protocol, as well as information required pursuant to the decisions taken by the Conference of the Parties serving as the meeting of the Parties to this Protocol. The information shall include:

    • a) Legislative, administrative and policy measures on access and benefit-sharing;

    • b) Information on the national focal point and competent national authority or authorities; and

    • c) Permits or their equivalent issued at the time of access as evidence of the decision to grant prior informed consent and of the establishment of mutually agreed terms.

  • 3 Additional information, if available and as appropriate, may include:

    • a) Relevant competent authorities of indigenous and local communities, and information as so decided;

    • b) Model contractual clauses;

    • c) Methods and tools developed to monitor genetic resources; and

    • d) Codes of conduct and best practices.

  • 4 The modalities of the operation of the Access and Benefit-sharing Clearing-House, including reports on its activities, shall be considered and decided upon by the Conference of the Parties serving as the meeting of the Parties to this Protocol at its first meeting, and kept under review thereafter.

Article 15. Compliance with domestic legislation or regulatory requirements on access and benefit-sharing

  • 1 Each Party shall take appropriate, effective and proportionate legislative, administrative or policy measures to provide that genetic resources utilized within its jurisdiction have been accessed in accordance with prior informed consent and that mutually agreed terms have been established, as required by the domestic access and benefit-sharing legislation or regulatory requirements of the other Party.

  • 2 Parties shall take appropriate, effective and proportionate measures to address situations of non compliance with measures adopted in accordance with paragraph 1 above.

  • 3 Parties shall, as far as possible and as appropriate, cooperate in cases of alleged violation of domestic access and benefit-sharing legislation or regulatory requirements referred to in paragraph 1 above.

Article 16. Compliance with domestic legislation or regulatory requirements on access and benefit-sharing for traditional knowledge associated with genetic resources

  • 1 Each Party shall take appropriate, effective and proportionate legislative, administrative or policy measures, as appropriate, to provide that traditional knowledge associated with genetic resources utilized within their jurisdiction has been accessed in accordance with prior informed consent or approval and involvement of indigenous and local communities and that mutually agreed terms have been established, as required by domestic access and benefit sharing legislation or regulatory requirements of the other Party where such indigenous and local communities are located.

  • 2 Each Party shall take appropriate, effective and proportionate measures to address situations of non-compliance with measures adopted in accordance with paragraph 1 above.

  • 3 Parties shall, as far as possible and as appropriate, cooperate in cases of alleged violation of domestic access and benefit-sharing legislation or regulatory requirements referred to in paragraph 1 above.

Article 17. Monitoring the utilization of genetic resources

  • 1 To support compliance, each Party shall take measures, as appropriate, to monitor and to enhance transparency about the utilization of genetic resources. Such measures shall include:

    • a) The designation of one or more checkpoints, as follows:

      • (i) Designated checkpoints would collect or receive, as appropriate, relevant information related to prior informed consent, to the source of the genetic resource, to the establishment of mutually agreed terms, and/or to the utilization of genetic resources, as appropriate;

      • (ii) Each Party shall, as appropriate and depending on the particular characteristics of a designated checkpoint, require users of genetic resources to provide the information specified in the above paragraph at a designated checkpoint. Each Party shall take appropriate, effective and proportionate measures to address situations of non-compliance;

      • (iii) Such information, including from internationally recognized certificates of compliance where they are available, will, without prejudice to the protection of confidential information, be provided to relevant national authorities, to the Party providing prior informed consent and to the Access and Benefit-sharing Clearing-House, as appropriate;

      • (iv) Check points must be effective and should have functions relevant to implementation of this subparagraph (a). They should be relevant to the utilization of genetic resources, or to the collection of relevant information at, inter alia, any stage of research, development, innovation, pre-commercialization or commercialization.

    • b) Encouraging users and providers of genetic resources to include provisions in mutually agreed terms to share information on the implementation of such terms, including through reporting requirements; and

    • c) Encouraging the use of cost-effective communication tools and systems.

  • 2 A permit or its equivalent issued in accordance with Article 6, paragraph 3 (e) and made available to the Access and Benefit-sharing Clearing-House, shall constitute an internationally recognized certificate of compliance.

  • 3 An internationally recognized certificate of compliance shall serve as evidence that the genetic resource which it covers has been accessed in accordance with prior informed consent and that mutually agreed terms have been established, as required by the domestic access and benefit-sharing legislation or regulatory requirements of the Party providing prior informed consent.

  • 4 The internationally recognized certificate of compliance shall contain the following minimum information when it is not confidential:

    • a) Issuing authority;

    • b) Date of issuance;

    • c) The provider;

    • d) Unique identifier of the certificate;

    • e) The person or entity to whom prior informed consent was granted;

    • f) Subject-matter or genetic resources covered by the certificate;

    • g) Confirmation that mutually agreed terms were established;

    • h) Confirmation that prior informed consent was obtained; and

    • i) Commercial and/or non-commercial use.

Article 18. Compliance with mutually agreed terms

  • 1 In the implementation of Article 6, paragraph 3 (g) (i) and Article 7, each Party shall encourage providers and users of genetic resources and/or traditional knowledge associated with genetic resources to include provisions in mutually agreed terms to cover, where appropriate, dispute resolution including:

    • a) The jurisdiction to which they will subject any dispute resolution processes;

    • b) The applicable law; and/or

    • c) Options for alternative dispute resolution, such as mediation or arbitration.

  • 2 Each Party shall ensure that an opportunity to seek recourse is available under their legal systems, consistent with applicable jurisdictional requirements, in cases of disputes arising from mutually agreed terms.

  • 3 Each Party shall take effective measures, as appropriate, regarding:

    • a) Access to justice; and

    • b) The utilization of mechanisms regarding mutual recognition and enforcement of foreign judgments and arbitral awards.

  • 4 The effectiveness of this article shall be reviewed by the Conference of the Parties serving as the meeting of the Parties to this Protocol in accordance with Article 31 of this Protocol.

Article 19. Model contractual clauses

  • 1 Each Party shall encourage, as appropriate, the development, update and use of sectoral and cross-sectoral model contractual clauses for mutually agreed terms.

  • 2 The Conference of the Parties serving as the meeting of the Parties to this Protocol shall periodically take stock of the use of sectoral and cross-sectoral model contractual clauses.

Article 20. Codes of conduct, guidelines and best practices and/or standards

  • 1 Each Party shall encourage, as appropriate, the development, update and use of voluntary codes of conduct, guidelines and best practices and/or standards in relation to access and benefit-sharing.

  • 2 The Conference of the Parties serving as the meeting of the Parties to this Protocol shall periodically take stock of the use of voluntary codes of conduct, guidelines and best practices and/or standards and consider the adoption of specific codes of conduct, guidelines and best practices and/or standards.

Article 21. Awareness-raising

Each Party shall take measures to raise awareness of the importance of genetic resources and traditional knowledge associated with genetic resources, and related access and benefit sharing issues. Such measures may include, inter alia:

  • a) Promotion of this Protocol, including its objective;

  • b) Organization of meetings of indigenous, and local communities and relevant stakeholders;

  • c) Establishment and maintenance of a help desk for indigenous and local communities and relevant stakeholders;

  • d) Information dissemination through a national clearing-house;

  • e) Promotion of voluntary codes of conduct, guidelines and best practices and/or standards in consultation with indigenous and local communities and relevant stakeholders;

  • f) Promotion of, as appropriate, domestic, regional and international exchanges of experience;

  • g) Education and training of users and providers of genetic resources and traditional knowledge associated with genetic resources about their access and benefit-sharing obligations;

  • h) Involvement of indigenous and local communities and relevant stakeholders in the implementation of this Protocol; and

  • i) Awareness-raising of community protocols and procedures of indigenous and local communities.

Article 22. Capacity

  • 1 The Parties shall cooperate in the capacity-building, capacity development and strengthening of human resources and institutional capacities to effectively implement this Protocol in developing country Parties, in particular the least developed countries and small island developing States among them, and Parties with economies in transition, including through existing global, regional, subregional and national institutions and organizations. In this context, Parties should facilitate the involvement of indigenous and local communities and relevant stakeholders, including nongovernmental organizations and the private sector.

  • 2 The need of developing country Parties, in particular the least developed countries and small island developing States among them, and Parties with economies in transition for financial resources in accordance with the relevant provisions of the Convention shall be taken fully into account for capacity building and development to implement this Protocol.

  • 3 As a basis for appropriate measures in relation to the implementation of this Protocol, developing country Parties, in particular the least developed countries and small island developing States among them, and Parties with economies in transition should identify their national capacity needs and priorities through national capacity self-assessments. In doing so, such Parties should support the capacity needs and priorities of indigenous and local communities and relevant stakeholders, as identified by them, emphasizing the capacity needs and priorities of women.

  • 4 In support of the implementation of this Protocol, ,capacity-building and development may address, inter alia, the following key areas:

    • a) Capacity to implement, and to comply with the obligations of, this Protocol;

    • b) Capacity to negotiate mutually agreed terms;

    • c) Capacity to develop, implement and enforce domestic legislative, administrative or policy measures on access and benefit-sharing; and

    • d) Capacity of countries to develop their endogenous research capabilities to add value to their own genetic resources.

  • 5 Measures in accordance with paragraphs 1 to 4 above may include, inter alia:

    • a) Legal and institutional development;

    • b) Promotion of equity and fairness in negotiations, such as training to negotiate mutually agreed terms;

    • c) 'The monitoring and enforcement of compliance;

    • d) Employment of best available communication tools and Internet-based systems for access and benefit-sharing activities;

    • e) Development and use of valuation methods;

    • f) Bioprospecting, associated research and taxonomic studies;

    • g) Technology transfer, and infrastructure and technical capacity to make such technology transfer sustainable;

    • h) Enhancement of the contribution of access and benefit-sharing activities to the conservation of biological diversity and the sustainable use of its components;

    • i) Special measures to increase the capacity of relevant stakeholders in relation to access and benefit-sharing; and

    • j) Special measures to increase the capacity of indigenous and local communities with emphasis on enhancing the capacity of women within those communities in relation to access to genetic resources and/or traditional knowledge associated with genetic resources.

  • 6 Information on capacity-building and development initiatives at national, regional and international levels, undertaken in accordance with paragraphs 1 to 5 above, should be provided to the Access and Benefit-sharing Clearing-House with a view to promoting synergy and coordination on capacity-building and development for access and benefit-sharing.

Article 23. Technology transfer, collaboration and cooperation

In accordance with Articles 15, 16, 18 and 19 of the Convention, the Parties shall collaborate and cooperate in technical and scientific research and development programmes, including biotechnological research activities, as a means to achieve the objective of this Protocol. The Parties undertake to promote and encourage access to technology by, and transfer of technology to, developing country Parties, in particular the least developed countries and small island developing States among them, and Parties with economies in transition, in order to enable the development and strengthening of a sound and viable technological and scientific base for the attainment of the objectives of the Convention and this Protocol. Where possible and appropriate such collaborative activities shall take place in and with a Party or the Parties providing genetic resources that is the country or are the countries of origin of such resources or a Party or Parties that have acquired the genetic resources in accordance with the Convention.

Article 24. Non-parties

The Parties shall encourage non-Parties to adhere to this Protocol and to contribute appropriate information to the Access and Benefit-sharing Clearing-House.

Article 25. Financial mechanism and resources

  • 1 In considering financial resources for the implementation of this Protocol, the Parties shall take into account the provisions of Article 20 of the Convention.

  • 2 The financial mechanism of the Convention shall be the financial mechanism for this Protocol.

  • 3 Regarding the capacity-building and development referred to in Article 22 of this Protocol, the Conference of the Parties serving as the meeting of the Parties to this Protocol, in providing guidance with respect to the financial mechanism referred to in paragraph 2 above, for consideration by the Conference of the Parties, shall take into account the need of developing country Parties, in particular the least developed countries and small island developing States among them, and of Parties with economies in transition, for financial resources, as well as the capacity needs and priorities of indigenous and local communities, including women within these communities.

  • 4 In the context of paragraph 1 above, the Parties shall also take into account the needs of the developing country Parties, in particular the least developed countries and small island developing States among them, and of the Parties with economies in transition, in their efforts to identify and implement their capacity-building and development requirements for the purposes of the implementation of this Protocol.

  • 5 The guidance to the financial mechanism of the Convention in relevant decisions of the Conference of the Parties, including those agreed before the adoption of this Protocol, shall apply, mutatis mutandis, to the provisions of this Article.

  • 6 The developed country Parties may also provide, and the developing country Parties and the Parties with economies in transition avail themselves of, financial and other resources for the implementation of the provisions of this Protocol through bilateral, regional and multilateral channels.

Article 26. Conference of the parties serving as the meeting of the parties to this Protocol

  • 1 The Conference of the Parties shall serve as the meeting of the Parties to this Protocol.

  • 2 Parties to the Convention that are not Parties to this Protocol may participate as observers in the proceedings of any meeting of the Conference of the Parties serving as the meeting of the Parties to this Protocol. When the Conference of the Parties serves as the meeting of the Parties to this Protocol, decisions under this Protocol shall be taken only by those that are Parties to it.

  • 3 When the Conference of the Parties serves as the meeting of the Parties to this Protocol, any member of the Bureau of the Conference of the Parties representing a Party to the Convention but, at that time, not a Party to this Protocol, shall be substituted by a member to be elected by and from among the Parties to this Protocol.

  • 4 The Conference of the Parties serving as the meeting of the Parties to this Protocol shall keep under regular review the implementation of this Protocol and shall make, within its mandate, the decisions necessary to promote its effective implementation. It shall perform the functions assigned to it by this Protocol and shall:

    • a) Make recommendations on any matters necessary for the implementation of this Protocol;

    • b) Establish such subsidiary bodies as are deemed necessary for the implementation of this Protocol.

    • c) Seek and utilize, where appropriate, the services and cooperation of, and information provided by, competent international organizations and intergovernmental and non-governmental bodies;

    • d) Establish the form and the intervals for transmitting the information to be submitted in accordance with Article 29 of this Protocol and consider such information as well as reports submitted by any subsidiary body;

    • e) Consider and adopt, as required, amendments to this Protocol and its Annex, as well as any additional annexes to this Protocol, that are deemed necessary for the implementation of this Protocol; and

    • f) Exercise such other functions as may be required for the implementation of this Protocol.

  • 5 The rules of procedure of the Conference of the Parties and financial rules of the Convention shall be applied, mutatis mutandis, under this Protocol, except as may be otherwise decided by consensus by the Conference of the Parties serving as the meeting of the Parties to this Protocol.

  • 6 The first meeting of the Conference of the Parties serving as the meeting of the Parties to this Protocol shall be convened by the Secretariat and held concurrently with the first meeting of the Conference of the Parties that is scheduled after the date of the entry into force of this Protocol. Subsequent ordinary meetings of the Conference of the Parties serving as the meeting of the Parties to this Protocol shall be held concurrently with ordinary meetings of the Conference of the Parties, unless otherwise decided by the Conference of the Parties serving as the meeting of the Parties to this Protocol.

  • 7 Extraordinary meetings of the Conference of the Parties serving as the meeting of the Parties to this Protocol shall be held at such other times as may be deemed necessary by the Conference of the Parties serving as the meeting of the Parties to this Protocol, or at the written request of any Party, provided that, within six months of the request being communicated to the Parties by the Secretariat, it is supported by at least one third of the Parties.

  • 8 The United Nations, its specialized agencies and the International Atomic Energy Agency, as well as any State member thereof or observers thereto not party to the Convention, may be represented as observers at meetings of the Conference of the Parties serving as the meeting of the Parties to this Protocol. Any body or agency, whether national or international, governmental or non-governmental, that is qualified in matters covered by this Protocol and that has informed the Secretariat of its wish to be represented at a meeting of the Conference of the Parties serving as a meeting of the Parties to this Protocol as an observer, may be so admitted, unless at least one third of the Parties present object. Except as otherwise provided in this Article, the admission and participation of observers shall be subject to the rules of procedure, as referred to in paragraph 5 above.

Article 27. Subsidiary bodies

  • 1 Any subsidiary body established by or under the Convention may serve this Protocol, including upon a decision of the Conference of the Parties serving as the meeting of the Parties to this Protocol. Any such decision shall specify the tasks to be undertaken.

  • 2 Parties to the Convention that are not Parties to this Protocol may participate as observers in the proceedings of any meeting of any such subsidiary bodies. When a subsidiary body of the Convention serves as a subsidiary body to this Protocol, decisions under this Protocol shall be taken only by Parties to this Protocol.

  • 3 When a subsidiary body of the Convention exercises its functions with regard to matters concerning this Protocol, any member of the bureau of that subsidiary body representing a Party to the Convention but, at that time, not a Party to this Protocol, shall be substituted by a member to be elected by and from among the Parties to this Protocol.

Article 28. Secretariat

  • 3 To the extent that they are distinct, the costs of the secretariat services for this Protocol shall be met by the Parties hereto. The Conference of the Parties serving as the meeting of the Parties to this Protocol shall, at its first meeting, decide on the necessary budgetary arrangements to this end.

Article 29. Monitoring and reporting

Each Party shall monitor the implementation of its obligations under this Protocol, and shall, at intervals and in the format to be determined by the Conference of the Parties serving as the meeting of the Parties to this Protocol, report to the Conference of the Parties serving as the meeting of the Parties to this Protocol on measures that it has taken to implement this Protocol.

Article 30. Procedures and mechanisms to promote compliance with this Protocol

The Conference of the Parties serving as the meeting of the Parties to this Protocol shall, at its first meeting, consider and approve cooperative procedures and institutional mechanisms to promote compliance with the provisions of this Protocol and to address cases of non-compliance. These procedures and mechanisms shall include provisions to offer advice or assistance, where appropriate. They shall be separate from, and without prejudice to, the dispute settlement procedures and mechanisms under Article 27 of the Convention.

Article 31. Assessment and review

The Conference of the Parties serving as the meeting of the Parties to this Protocol shall undertake, four years after the entry into force of this Protocol and thereafter at intervals determined by the Conference of the Parties serving as the meeting of the Parties to this Protocol, an evaluation of the effectiveness of this Protocol.

Article 32. Signature

This Protocol shall be open for signature by Parties to the Convention at the United Nations Headquarters in New York, from 2 February 2011 to 1 February 2012.

Article 33. Entry into force

  • 1 This Protocol shall enter into force on the ninetieth day after the date of deposit of the fiftieth instrument of ratification, acceptance, approval or accession by States or regional economic integration organizations that are Parties to the Convention.

  • 2 This Protocol shall enter into force for a State or regional economic integration organization that ratifies, accepts or approves this Protocol or accedes thereto after the deposit of the fiftieth instrument as referred to in paragraph 1 above, on the ninetieth day after the date on which that State or regional economic integration organization deposits its instrument of ratification, acceptance, approval or accession, or on the date on which the Convention enters into force for that State or regional economic integration organization, whichever shall be the later.

  • 3 For the purposes of paragraphs 1 and 2 above, any instrument deposited by a regional economic integration organization shall not be counted as additional to those deposited by member States of such organization.

Article 34. Reservations

No reservations may be made to this Protocol.

Article 35. Withdrawal

  • 1 At any time after two years from the date on which this Protocol has entered into force for a Party, that Party may withdraw from this Protocol by giving written notification to the Depositary.

  • 2 Any such withdrawal shall take place upon expiry of one year after the date of its receipt by the Depositary, or on such later date as may be specified in the notification of the withdrawal.

Article 36. Authentic texts

The original of this Protocol, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

IN WITNESS WHEREOF the undersigned, being duly authorized to that effect, have signed this Protocol on the dates indicated.

Annex Monetary and non-monetary benefits

  • 1. Monetary benefits may include, but not be limited to:

    • a) Access fees/fee per sample collected or otherwise acquired;

    • b) Up-front payments;

    • c) Milestone payments;

    • d) Payment of royalties;

    • e) Licence fees in case of commercialization;

    • f) Special fees to be paid to trust funds supporting conservation and sustainable use of biodiversity;

    • g) Salaries and preferential terms where mutually agreed;

    • h) Research funding;

    • i) Joint ventures;

    • j) Joint ownership of relevant intellectual property rights.

  • 2. Non-monetary benefits may include, but not be limited to:

    • a) Sharing of research and development results;

    • b) Collaboration, cooperation and contribution in scientific research and development programmes, particularly biotechnological research activities, where possible in the Party providing genetic resources;

    • c) Participation in product development;

    • d) Collaboration, cooperation and contribution in education and training;

    • e) Admittance to ex situ facilities of genetic resources and to databases;

    • f) Transfer to the provider of het genetic resources of knowledge and technology under fair and most favourable terms, including on concessional and preferential terms where agreed, in particular, knowledge and technology that make use of genetic resources, including biotechnology, or that are relevant to the conservation and sustainable utilization of biological diversity;

    • g) Strengthening capacities for technology transfer;

    • h) Institutional capacity-building;

    • i) Human and material resources to strengthen the capacities for the administration and enforcement of access regulations;

    • j) Training related to genetic resources with the full participation of countries providing genetic resources, and where possible, in such countries;

    • k) Access to scientific information relevant to conservation and sustainable use of biological diversity, including biological inventories and taxonomic studies;

    • l) Contributions to the local economy;

    • m) Research directed towards priority needs, such as health and food security, taking into account domestic uses of genetic resources in the Party providing genetic resources;

    • n) Institutional and professional relationships that can arise from an access and benefit-sharing agreement and subsequent collaborative activities;

    • o) Food and livelihood security benefits;

    • p) Social recognitions;

    • q) Joint ownership of relevant intellect property rights.

De partijen bij dit Protocol,

Partij zijnde bij het Verdrag inzake biologische diversiteit, hierna te noemen „het Verdrag”,

In herinnering roepende dat de eerlijke en billijke verdeling van voordelen voortvloeiende uit het gebruik van genetische rijkdommen een van de drie kerndoelen van het Verdrag is en erkennende dat met dit Protocol wordt beoogd dit doel binnen het kader van het Verdrag te verwezenlijken,

Opnieuw de soevereine rechten van staten bevestigende met betrekking tot hun natuurlijke rijkdommen en overeenkomstig de bepalingen van het Verdrag,

Voorts in herinnering roepende artikel 15 van het Verdrag,

Vastbesloten de daadwerkelijke tenuitvoerlegging van de bepalingen omtrent toegang en verdeling van voordelen uit het Verdrag te blijven ondersteunen,

Erkennende dat een innovatieve oplossing nodig is voor de eerlijke en billijke verdeling van de voordelen die voortvloeien uit het gebruik van genetische rijkdommen en traditionele kennis met betrekking tot genetische rijkdommen in grensoverschrijdende situaties of wanneer het onmogelijk is voorafgaande geïnformeerde toestemming te verlenen of te verkrijgen,

Het belang erkennende van genetische rijkdommen voor voedselzekerheid, volksgezondheid, behoud van biodiversiteit en het beperken van en aanpassen aan klimaatverandering,

De bijzondere aard erkennende van agrarische biodiversiteit, haar onderscheidende kenmerken en problemen waarvoor specifieke oplossingen nodig zijn,

De onderlinge afhankelijkheid erkennende van alle landen wat betreft genetische rijkdommen voor voedsel en landbouw alsmede hun bijzondere aard en het belang daarvan voor de verwezenlijking van wereldwijde voedselzekerheid en voor de duurzame ontwikkeling van de landbouw in het kader van armoedeverlichting en klimaatverandering en de fundamentele rol in dit verband erkennende van het Internationaal Verdrag inzake plantgenetische bronnen voor voedsel en landbouw en de Commissie voor Genetische Hulpbronnen voor Voeding en Landbouw van de FAO,

Indachtig de Internationale Gezondheidsregeling (2005) van de Wereldgezondheidsorganisatie en het belang van het waarborgen van toegang tot menselijke pathogenen voor paraatheid en bestrijdingsdoeleinden op het gebied van de volksgezondheid,

De lopende werkzaamheden van andere internationale fora erkennende ten behoeve van de toegang tot en verdeling van voordelen,

In herinnering roepende het multilateraal systeem van toegang en verdeling van voordelen ingesteld krachtens het Internationaal Verdrag inzake plantgenetische bronnen voor voedsel en landbouw dat in lijn met het Verdrag is ontwikkeld,

Erkennende dat internationale instrumenten over toegang en verdeling van voordelen elkaar zouden moeten ondersteunen ten einde de doelen van het Verdrag te verwezenlijken,

Het belang van artikel 8, onderdeel j, van het Verdrag in herinnering roepende, aangezien het betrekking heeft op traditionele kennis met betrekking tot genetische rijkdommen en de eerlijke en billijke verdeling van voordelen die voortvloeien uit het gebruik van die kennis,

Gelet op het onderlinge verband tussen genetische rijkdommen en traditionele kennis, die voor inheemse en lokale gemeenschappen niet los van elkaar kunnen worden gezien, het belang van traditionele kennis voor het behoud van biologische diversiteit en het duurzaam gebruik van de bestanddelen daarvan en voor de duurzame wijze van levensonderhoud van deze gemeenschappen,

Zich rekenschap gevende van de uiteenlopende omstandigheden waaronder inheemse en lokale gemeenschappen bezitter of eigenaar zijn van traditionele kennis met betrekking tot genetische rijkdommen,

Zich bewust van het feit dat inheemse en lokale gemeenschappen het recht hebben vast te stellen wie de rechtmatige bezitters zijn van hun traditionele kennis met betrekking tot genetische rijkdommen binnen hun gemeenschap,

Voorts de unieke omstandigheden erkennende waaronder traditionele kennis met betrekking tot genetische rijkdommen in landen wordt bezeten, ongeacht of dat in mondelinge, gedocumenteerde of enige andere vorm gebeurt en dat een rijk cultureel erfgoed vertegenwoordigt dat van belang is voor het behoud en duurzaam gebruik van biologische diversiteit,

Gelet op de verklaring van de Verenigde Naties inzake de rechten van inheemse volken, en

Bevestigend dat niets in dit Protocol mag worden uitgelegd als een beperking of beëindiging van bestaande rechten van inheemse en lokale gemeenschappen,

Zijn het volgende overeengekomen:

Artikel 1. Doel

Het doel van dit Protocol is de eerlijke en billijke verdeling van de voordelen die voortvloeien uit het gebruik van genetische rijkdommen, onder meer via passende toegang tot genetische rijkdommen en passende overdracht van relevante technologieën, rekening houdend met alle rechten ter zake van die bronnen en technologieën, en via passende financiering, zodat wordt bijgedragen aan het behoud van biologische diversiteit en het duurzaam gebruik van de bestanddelen daarvan.

Artikel 2. Begripsomschrijvingen

De termen omschreven in artikel 2 van het Verdrag zijn van toepassing op dit Protocol. Voor de toepassing van dit Protocol wordt voorts verstaan onder:

  • a. „Conferentie van de partijen”: de Conferentie van de partijen bij het Verdrag;

  • b. „Verdrag”: het Verdrag inzake biologische diversiteit;

  • c. „gebruik van genetische rijkdommen”: het verrichten van onderzoek naar en de ontwikkeling op de genetische en/of biochemische samenstelling van genetische rijkdommen, mede door de toepassing van biotechnologie zoals omschreven in artikel 2 van het Verdrag;

  • d. „biotechnologie” zoals omschreven in artikel 2 van het Verdrag: elke technologische toepassing waarbij biologische systemen, levende organismen of afleidingen daarvan, worden gebruikt om producten of processen tot stand te brengen of te veranderen voor specifieke doeleinden;

  • e. „derivaat”: een in de natuur voorkomende biochemische verbinding die voortkomt uit de genetische expressie of het metabolisme van biologische of genetische rijkdommen, ook wanneer deze geen functionele eenheden van erfelijkheid bevat.

Artikel 3. Werkingssfeer

Dit Protocol is van toepassing op de genetische rijkdommen binnen de werkingssfeer van artikel 15 van het Verdrag en op de voordelen die voortvloeien uit het gebruik van deze rijkdommen. Dit Protocol is tevens van toepassing op traditionele kennis met betrekking tot genetische rijkdommen binnen de werkingssfeer van het Verdrag en op de voordelen die voortvloeien uit het gebruik van deze kennis.

Artikel 4. Verhouding tot internationale verdragen en instrumenten

  • 1 De bepalingen van dit Protocol laten de rechten en verplichtingen van elke partij die voortvloeien uit bestaande internationale verdragen onverlet, behalve indien de uitoefening van die rechten of de nakoming van die verplichtingen een ernstige schade zou veroorzaken aan, of een bedreiging zou vormen voor, de biologische diversiteit. Met dit lid wordt niet beoogd een hiërarchie aan te brengen tussen dit Protocol en andere internationale instrumenten.

  • 2 Niets in dit Protocol belet de partijen andere relevante internationale verdragen, waaronder specifieke verdragen voor toegang tot en verdeling van voordelen, op te stellen en uit te voeren, mits deze de doelen van het Verdrag en dit Protocol ondersteunen en er niet tegen indruisen.

  • 3 Dit Protocol wordt tezamen met andere voor dit Protocol relevante internationale instrumenten op een wederzijds ondersteunende wijze uitgevoerd. Voldoende rekening zou moeten worden gehouden met nuttige en relevante lopende werkzaamheden of praktijken uit hoofde van deze internationale instrumenten en die van relevante internationale organisaties, mits deze de doelen van het Verdrag en dit Protocol ondersteunen en er niet tegen indruisen.

  • 4 Dit Protocol is het instrument voor de tenuitvoerlegging van de bepalingen van het Verdrag voor toegang en verdeling van voordelen. Indien een specifiek internationaal instrument voor toegang tot en verdeling van voordelen van toepassing is dat verenigbaar is met en niet indruist tegen de doelen van het Verdrag en dit Protocol, is dit Protocol niet van toepassing op de partij of partijen bij het specifieke instrument voor wat de specifieke genetische rijkdom betreft die onder dat specifieke instrument valt en voor wat het doel van dat instrument betreft.

Artikel 5. Eerlijke en billijke verdeling van voordelen

  • 1 Overeenkomstig artikel 15, derde en zevende lid, van het Verdrag worden voordelen die voortvloeien uit het gebruik van genetische rijkdommen alsmede uit daaruit voortvloeiende toepassingen en de commercialisering daarvan op een eerlijke en billijke wijze gedeeld met de partij die de rijkdommen heeft geleverd en het land van oorsprong daarvan is of een partij is die de genetische rijkdommen heeft verworven in overeenstemming met het Verdrag. De verdeling geschiedt op grond van onderling overeengekomen voorwaarden.

  • 2 Elke partij neemt maatregelen van wetgevende of bestuurlijke aard, dan wel beleidsmaatregelen, waar passend, met de bedoeling te waarborgen dat de voordelen die voortvloeien uit het gebruik van genetische rijkdommen die gehouden worden door inheemse en lokale gemeenschappen, in overeenstemming met de interne wetgeving ter zake van de verworven rechten van deze inheemse en lokale gemeenschappen op deze genetische rijkdommen op een eerlijke en billijke wijze met de betrokken gemeenschappen worden gedeeld op grond van onderling overeengekomen voorwaarden.

  • 3 Ter uitvoering van het eerste lid neemt elke partij maatregelen van wetgevende of bestuurlijke aard, dan wel beleidsmaatregelen, waar passend.

  • 4 Voordelen kunnen van financiële of niet-financiële aard zijn, met inbegrip van maar niet beperkt tot de voordelen vermeld in de Bijlage.

  • 5 Elke partij neemt maatregelen van wetgevende of bestuurlijke aard, dan wel beleidsmaatregelen, waar passend, teneinde te bewerkstelligen dat de voordelen die voortvloeien uit het gebruik van traditionele kennis met betrekking tot genetische rijkdommen op een eerlijke en billijke wijze worden gedeeld met de inheemse en lokale gemeenschappen die deze kennis houden. De verdeling geschiedt op grond van onderling overeengekomen voorwaarden.

Artikel 6. Toegang tot genetische rijkdommen

  • 1 Bij de uitoefening van soevereine rechten over natuurlijke rijkdommen en met inachtneming van de eisen krachtens interne wet- of regelgeving over toegang en verdeling van voordelen, is de toegang tot genetische rijkdommen voor hun gebruik onderworpen aan de voorafgaande geïnformeerde toestemming van de partij die deze rijkdommen levert en het land van oorsprong van deze rijkdommen is of van een partij die de genetische rijkdommen in overeenstemming met het Verdrag heeft verworven, tenzij anderszins bepaald door die partij.

  • 2 In overeenstemming met het interne recht neemt elke partij maatregelen, waar passend, met de bedoeling te waarborgen dat de voorafgaande geïnformeerde toestemming of goedkeuring en betrokkenheid van inheemse en lokale gemeenschappen wordt verkregen voor de toegang tot genetische rijkdommen, indien zij het recht tot het verlenen van toegang tot deze rijkdommen hebben verworven.

  • 3 Ingevolge het eerste lid van dit artikel neemt elke partij die voorafgaande geïnformeerde toestemming vereist de nodige maatregelen van wetgevende of bestuurlijke aard, dan wel beleidsmaatregelen, waar passend, teneinde:

    • a. te voorzien in rechtszekerheid, duidelijkheid en transparantie van hun interne wet- en regelgeving over toegang en verdeling van voordelen;

    • b. te voorzien in eerlijke en niet-willekeurige regels en procedures voor de toegang tot genetische rijkdommen;

    • c. informatie te verschaffen over hoe om voorafgaande geïnformeerde toestemming kan worden verzocht;

    • d. op kosteneffectieve wijze en binnen een redelijke termijn te voorzien in een duidelijke en transparante schriftelijke beslissing van een bevoegde nationale instantie;

    • e. te voorzien dat op het tijdstip van toegang een vergunning of een vergelijkbaar document wordt verstrekt als bewijs van de beslissing tot het verlenen van voorafgaande geïnformeerde toestemming en van de vaststelling van onderling overeengekomen voorwaarden, en dat het uitwisselingscentrum voor toegang en verdeling van voordelen dienovereenkomstig in kennis wordt gesteld;

    • f. indien van toepassing en met inachtneming van interne wetgeving, criteria en/of procedures vast te stellen voor het verwerven van voorafgaande geïnformeerde toestemming of goedkeuring en betrokkenheid van inheemse en lokale gemeenschappen voor de toegang tot genetische rijkdommen; en

    • g. duidelijke regels en procedures vast te stellen voor het vereisen en vaststellen van onderling overeen te komen voorwaarden. Deze voorwaarden worden schriftelijk vastgesteld en kunnen mede het volgende omvatten:

      • i. een geschillenbeslechtingsclausule;

      • ii. voorwaarden voor verdeling van voordelen, waaronder met betrekking tot

        intellectuele-eigendomsrechten;

      • iii. voorwaarden voor later gebruik door een derde; en

      • iv. waar toepasselijk, voorwaarden voor het wijzigen van het doel.

Artikel 7. Toegang tot traditionele kennis met betrekking tot genetische rijkdommen

In overeenstemming met het interne recht neemt elke partij maatregelen, waar passend, met de bedoeling te waarborgen dat toegang tot traditionele kennis met betrekking tot genetische rijkdommen die gehouden worden door inheemse en lokale gemeenschappen wordt verkregen met de voorafgaande en geïnformeerde toestemming of goedkeuring en betrokkenheid van deze inheemse en lokale gemeenschappen, en dat onderling overeengekomen voorwaarden zijn vastgesteld.

Artikel 8. Bijzondere overwegingen

Bij het uitwerken en uitvoeren van zijn wet- en regelgeving over toegang tot en verdeling van voordelen, dient elke partij:

  • a. voorwaarden te scheppen ter bevordering en aanmoediging van onderzoek dat bijdraagt aan het behoud en het duurzaam gebruik van biologische diversiteit, met name in ontwikkelingslanden, onder meer door vereenvoudigde maatregelen voor toegang voor niet-commerciële onderzoeksdoelen, rekening houdend met de behoefte dat een wijziging van het onderzoeksdoel in aanmerking moet worden genomen;

  • b. naar behoren rekening te houden met de kans op bestaande of dreigende noodsituaties die gevaarlijk of schadelijk (kunnen) zijn voor de gezondheid van mensen, dieren of planten, zoals nationaal of internationaal vastgesteld. Partijen kunnen rekening houden met de behoefte aan snelle toegang tot genetische rijkdommen en spoedige eerlijke en billijke verdeling van voordelen die voortvloeien uit het gebruik van die genetische rijkdommen, waaronder toegang tot betaalbare behandelingen voor hen in nood, met name in ontwikkelingslanden;

  • c. zich rekenschap te geven van het belang van genetische rijkdommen voor voedsel en landbouw en hun bijzondere betekenis voor de voedselzekerheid.

Artikel 9. Bijdrage aan behoud en duurzaam gebruik

De partijen moedigen gebruikers en leveranciers aan de voordelen die voortvloeien uit het gebruik van genetische rijkdommen in te zetten voor het behoud van de biologische diversiteit en het duurzame gebruik van de bestanddelen daarvan.

Artikel 10. Mondiaal multilateraal mechanisme voor de verdeling van voordelen

Partijen overwegen de behoefte aan en modaliteiten van een mondiaal multilateraal mechanisme voor de verdeling van voordelen ten behoeve van de eerlijke en billijke verdeling van voordelen die voortvloeien uit het gebruik van genetische rijkdommen en traditionele kennis met betrekking tot genetische rijkdommen die voorkomen in grensoverschrijdende situaties of voor situaties waarin het onmogelijk is voorafgaande geïnformeerde toestemming te verlenen of te verkrijgen. De voordelen die door gebruikers van genetische rijkdommen en traditionele kennis met betrekking tot genetische rijkdommen via dit mechanisme worden gedeeld, worden ingezet ter ondersteuning van het wereldwijde behoud van biologische diversiteit en duurzaam gebruik van de bestanddelen daarvan.

Artikel 11. Grensoverschrijdende samenwerking

  • 1 In situaties waarin dezelfde genetische rijkdommen in situ worden gevonden binnen het grondgebied van meer dan een partij, trachten deze partijen waar passend samen te werken, met de betrokkenheid van de desbetreffende inheemse en lokale gemeenschappen, waar toepasselijk, ten behoeve van de tenuitvoerlegging van dit Protocol.

  • 2 Indien dezelfde traditionele kennis met betrekking tot genetische rijkdommen wordt gedeeld door een of meer inheemse en lokale gemeenschappen in verschillende partijen, trachten deze partijen waar passend samen te werken, met de betrokkenheid van de desbetreffende inheemse en lokale gemeenschappen ten behoeve van de verwezenlijking van het doel van dit Protocol.

Artikel 12. Traditionele kennis met betrekking tot genetische rijkdommen

  • 1 Bij de uitvoering van hun verplichtingen krachtens dit Protocol houden de partijen in overeenstemming met hun interne recht rekening met het gewoonterecht, de gemeenschapsprotocollen en de procedures van inheemse en lokale gemeenschappen, al naargelang van toepassing, op het gebied van traditionele kennis met betrekking tot genetische rijkdommen.

  • 2 Partijen stellen met daadwerkelijke betrokkenheid van de desbetreffende inheemse en lokale gemeenschappen mechanismen vast teneinde mogelijke gebruikers van traditionele kennis met betrekking tot genetische rijkdommen te informeren over hun verplichtingen, met inbegrip van maatregelen die beschikbaar zijn via het uitwisselingscentrum voor toegang en verdeling van voordelen voor de toegang tot en de eerlijke en billijke verdeling van voordelen die voortvloeien uit het gebruik van deze kennis.

  • 3 Partijen spannen zich in, waar passend, om de ontwikkeling te ondersteunen door inheemse en lokale gemeenschappen, met inbegrip van de vrouwen binnen deze gemeenschappen, van:

    • a. gemeenschapsprotocollen inzake toegang tot traditionele kennis met betrekking tot genetische rijkdommen en de eerlijke en billijke verdeling van voordelen die voortvloeien uit het gebruik van deze kennis;

    • b. minimumvereisten voor onderling overeen te komen voorwaarden ter waarborging van de eerlijke en billijke verdeling van voordelen die voortvloeien uit het gebruik van traditionele kennis met betrekking tot genetische rijkdommen; en

    • c. contractuele modelbepalingen voor de verdeling van voordelen die voortvloeien uit het gebruik van traditionele kennis met betrekking tot genetische rijkdommen.

  • 4 Bij de tenuitvoerlegging van dit Protocol onthouden partijen zich zoveel mogelijk van beperking van het op de gewoonte stoelende gebruik en uitwisseling van genetische rijkdommen en daarmee verbonden traditionele kennis binnen en tussen inheemse en lokale gemeenschappen in overeenstemming met de doelen van het Verdrag.

Artikel 13. Nationale contactpunten en bevoegde nationale instanties

  • 1 Elke partij wijst een nationaal contactpunt aan voor toegang en verdeling van voordelen. Het nationale contactpunt stelt informatie op de volgende wijze beschikbaar:

    • a. voor verzoekers om toegang tot genetische rijkdommen, informatie over de procedures voor het verkrijgen van voorafgaande geïnformeerde toestemming en het vaststellen van onderling overeen te komen voorwaarden, met inbegrip van de verdeling van voordelen;

    • b. voor verzoekers om toegang tot traditionele kennis met betrekking tot genetische rijkdommen, waar mogelijk, informatie over de procedures voor het verkrijgen van voorafgaande geïnformeerde toestemming of goedkeuring en betrokkenheid, waar passend, van inheemse en lokale gemeenschappen en het vaststellen van onderling overeen te komen voorwaarden, met inbegrip van de verdeling van voordelen; en

    • c. informatie over bevoegde nationale instanties, relevante inheemse en lokale gemeenschappen en relevante belanghebbenden.

    Het nationale contactpunt is verantwoordelijk voor de contacten met het Secretariaat.

  • 2 Elke partij wijst een of meer bevoegde nationale instanties aan voor toegang en verdeling van voordelen. De bevoegde instanties zijn, in overeenstemming met de toepasselijke nationale maatregelen van wetgevende of bestuurlijke aard, dan wel beleidsmaatregelen, verantwoordelijk voor het verlenen van toegang, of, indien van toepassing, de afgifte van schriftelijk bewijs dat voldaan is aan de vereisten voor toegang en zijn verantwoordelijk voor advisering over de toepasselijke procedures en vereisten voor het verkrijgen van voorafgaande geïnformeerde toestemming en het aangaan van onderling overeengekomen voorwaarden.

  • 3 Een partij mag één entiteit aanwijzen om de functies van zowel contactpunt als bevoegde nationale instantie te vervullen.

  • 4 Elke partij stelt uiterlijk op de datum van inwerkingtreding van dit Protocol voor die partij het Secretariaat in kennis van de contactgegevens van haar nationale contactpunt en haar bevoegde nationale instantie of instanties. Wanneer een partij meer dan een bevoegde nationale instantie aanwijst, verstrekt zij het Secretariaat tegelijk met de kennisgeving daarvan relevante informatie over de respectieve taken van die instanties. Waar van toepassing wordt in deze informatie minimaal gespecificeerd welke bevoegde instantie verantwoordelijk is voor welke genetische rijkdommen. Elke partij stelt het Secretariaat onmiddellijk in kennis van eventuele wijzigingen in de aanwijzing van haar nationale contactpunt of in de contactgegevens of de taken van haar bevoegde nationale instantie of instanties.

  • 5 Het Secretariaat stelt de krachtens het vierde lid ontvangen informatie ter beschikking via het uitwisselingscentrum voor toegang en verdeling van voordelen.

Artikel 14. Uitwisselingscentrum voor toegang en verdeling van voordelen en het delen van informatie

  • 1 Als onderdeel van het uitwisselingsmechanisme overeenkomstig artikel 18, derde lid, van het Verdrag wordt een uitwisselingscentrum voor toegang en verdeling van voordelen opgericht. Het fungeert als een middel om informatie te delen met betrekking tot toegang en verdeling van voordelen. Het verschaft in het bijzonder toegang tot door partijen ter beschikking gestelde informatie relevant voor de tenuitvoerlegging van dit Protocol.

  • 2 Onverminderd de bescherming van vertrouwelijke informatie, stelt elke partij de krachtens dit Protocol vereiste informatie alsmede de ingevolge besluiten genomen door de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert vereiste informatie, ter beschikking aan het uitwisselingscentrum voor toegang en verdeling van voordelen. De informatie omvat:

    • a. maatregelen van wetgevende en bestuurlijke aard alsmede beleidsmaatregelen ter zake van toegang en verdeling van voordelen;

    • b. informatie over het nationale contactpunt en de bevoegde nationale instantie of instanties; en

    • c. vergunningen of vergelijkbare documenten afgegeven op het tijdstip van toegang als bewijs van de beslissing tot het verlenen van voorafgaande geïnformeerde toestemming en van de vaststelling van onderling overeengekomen voorwaarden.

  • 3 Aanvullende informatie indien beschikbaar en waar passend kan omvatten:

    • a. relevante bevoegde instanties van inheemse en lokale gemeenschappen en informatie waartoe aldus besloten wordt;

    • b. contractuele modelbepalingen;

    • c. methodes en middelen ontwikkeld voor het controleren van genetische rijkdommen; en

    • d. gedragscodes en beste praktijken.

  • 4 De werkwijze van het uitwisselingscentrum voor toegang en verdeling van voordelen, met inbegrip van de rapportage over zijn activiteiten, wordt door de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, tijdens haar eerste vergadering besproken en vastgesteld en vervolgens periodiek getoetst.

Artikel 15. Naleving van interne wet- of regelgeving over toegang en verdeling van voordelen

  • 1 Elke partij neemt passende, doeltreffende en evenredige maatregelen van wetgevende of bestuurlijke aard, dan wel beleidsmaatregelen, om te bewerkstelligen dat de toegang tot genetische rijkdommen, die onder haar rechtsmacht worden gebruikt, is verkregen met voorafgaande geïnformeerde toestemming en dat er onderling overeengekomen voorwaarden zijn vastgesteld, zoals bepaald in de interne wet- en regelgeving over toegang en verdeling van voordelen van de andere partij.

  • 2 Partijen nemen passende, doeltreffende en evenredige maatregelen om situaties aan te pakken waarin de maatregelen genomen in overeenstemming met het eerste lid niet worden nageleefd.

  • 3 Partijen werken voor zover mogelijk en passend samen in gevallen van vermeende schending van interne wet- en regelgeving over toegang en verdeling van voordelen, bedoeld in het eerste lid.

Artikel 16. Naleving van interne wet- of regelgeving over toegang en verdeling van voordelen van traditionele kennis met betrekking tot genetische rijkdommen

  • 1 Elke partij neemt, waar passend, passende, doeltreffende en evenredige maatregelen van wetgevende of bestuurlijke aard, dan wel beleidsmaatregelen, om te bewerkstelligen dat de toegang tot traditionele kennis met betrekking tot genetische rijkdommen, die onder haar rechtsmacht worden gebruikt, is verkregen met voorafgaande geïnformeerde toestemming of goedkeuring en betrokkenheid van inheemse en lokale gemeenschappen en dat er onderling overeengekomen voorwaarden zijn vastgesteld, zoals bepaald in de interne wet- en regelgeving over toegang en verdeling van voordelen van de andere partij waar deze inheemse en lokale gemeenschappen zich bevinden.

  • 2 Elke partij neemt passende, doeltreffende en evenredige maatregelen om situaties aan te pakken waarin de maatregelen genomen in overeenstemming met het eerste lid niet worden nageleefd.

  • 3 Partijen werken voor zover mogelijk en passend samen in gevallen van vermeende schending van interne wet- en regelgeving over toegang en verdeling van voordelen, bedoeld in het eerste lid.

Artikel 17. Het volgen van het gebruik van genetische rijkdommen

  • 1 Teneinde naleving te ondersteunen, neemt elke partij maatregelen, waar passend, om het gebruik van genetische rijkdommen te volgen en de transparantie over het gebruik daarvan te vergroten. Dergelijke maatregelen omvatten:

    • a. het als volgt aanwijzen van een of meer controlepunten:

      • i. aangewezen controlepunten verzamelen of ontvangen, waar passend en al naargelang van het geval, relevante informatie met betrekking tot voorafgaande geïnformeerde toestemming, de herkomst van de genetische rijkdom, de vaststelling van onderling overeengekomen voorwaarden en/of het gebruik van genetische rijkdommen;

      • ii. elke partij verlangt, waar passend en afhankelijk van de specifieke kenmerken van een aangewezen controlepunt, van gebruikers van genetische rijkdommen dat zij de onder i omschreven informatie verschaffen aan een aangewezen controlepunt. Elke partij neemt passende, doeltreffende en evenredige maatregelen om situaties van niet-naleving aan te pakken;

      • iii. deze informatie, met inbegrip van deze uit internationaal erkende certificaten betreffende naleving, indien beschikbaar, wordt, waar passend en onverminderd de bescherming van vertrouwelijke informatie, verschaft aan de relevante nationale instanties, de partij die de voorafgaande geïnformeerde toestemming heeft verleend en het uitwisselingscentrum voor toegang en verdeling van voordelen.

      • iv. de controlepunten moeten doeltreffend zijn en zouden taken moeten hebben die relevant zijn voor de tenuitvoerlegging van dit onderdeel a. Zij zouden relevant moeten zijn voor het gebruik van genetische rijkdommen of voor het verzamelen van relevante informatie tijdens onder meer elk stadium van onderzoek, ontwikkeling, innovatie, voorbereiding van commercialisering of commercialisering;

    • b. het aanmoedigen van gebruikers en leveranciers van genetische rijkdommen in de onderling overeen te komen voorwaarden ook bepalingen op te nemen voor het delen van informatie over de uitvoering van die voorwaarden, waaronder via rapportagevereisten; en

    • c. het aanmoedigen van het gebruik van kosteneffectieve communicatiemiddelen en -systemen.

  • 2 Een vergunning of vergelijkbaar document afgegeven in overeenstemming met artikel 6, derde lid, onderdeel e, en ter beschikking gesteld aan het uitwisselingscentrum voor toegang en verdeling van voordelen vormt een internationaal erkend certificaat betreffende naleving.

  • 3 Een internationaal erkend certificaat betreffende naleving fungeert als bewijs dat de toegang tot de genetische rijkdom waarop het betrekking heeft is verkregen met voorafgaande geïnformeerde toestemming en dat er onderling overeengekomen voorwaarden zijn vastgesteld, zoals vereist door de interne wet- of regelgeving over toegang en verdeling van voordelen van de partij die de voorafgaande geïnformeerde toestemming heeft verleend.

  • 4 Het internationaal erkende certificaat betreffende naleving bevat ten minste de volgende informatie, tenzij die vertrouwelijk is:

    • a. instantie van afgifte;

    • b. datum van afgifte;

    • c. de leverancier;

    • d. unieke identificatiecode van het certificaat;

    • e. persoon of entiteit aan wie/waaraan de voorafgaande geïnformeerde toestemming is verleend;

    • f. onderwerp of genetische rijkdommen waarop het certificaat betrekking heeft;

    • g. bevestiging dat er onderling overeengekomen voorwaarden zijn vastgesteld;

    • h. bevestiging dat voorafgaande geïnformeerde toestemming is verkregen; en

    • i. commerciële en/of niet-commerciële toepassing.

Artikel 18. Naleving van onderling overeengekomen voorwaarden

  • 1 Bij de tenuitvoerlegging van artikel 6, derde lid, onderdeel g, onder i, en artikel 7, moedigt elke partij leveranciers en gebruikers van genetische rijkdommen en/of traditionele kennis met betrekking tot genetische rijkdommen aan in hun onderling overeen te komen voorwaarden, waar passend, bepalingen voor de regeling van geschillen op te nemen, waaronder:

    • a. aan welke rechtsmacht zij geschillenbeslechtingsprocessen onderwerpen;

    • b. het toepasselijke recht; en/of

    • c. opties voor alternatieve geschillenbeslechting, zoals bemiddeling of arbitrage.

  • 2 Elke partij waarborgt dat in haar rechtsstelsel de mogelijkheid bestaat om beroep in te dienen, overeenkomstig toepasselijke bevoegdheidsvereisten, in geval er zich geschillen voordoen die voortvloeien uit onderling overeengekomen voorwaarden.

  • 3 Elke partij neemt, waar passend, effectieve maatregelen betreffende:

    • a. toegang tot de rechter; en

    • b. het gebruik van mechanismen over de wederzijdse erkenning en tenuitvoerlegging van buitenlandse vonnissen en scheidsrechterlijke uitspraken.

  • 4 De Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, toetst de doeltreffendheid van dit artikel in overeenstemming met artikel 31 van dit Protocol.

Artikel 19. Contractuele modelbepalingen

  • 1 Elke partij moedigt, waar passend, de ontwikkeling, de modernisering en het gebruik aan van sectorale en sectoroverschrijdende contractuele modelbepalingen voor onderling over te komen voorwaarden.

  • 2 De Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, inventariseert periodiek het gebruik van sectorale en sectoroverschrijdende contractuele modelbepalingen.

Artikel 20. Gedragscodes, richtlijnen en beste praktijken en/of normen

  • 1 Elke partij moedigt, waar passend, de ontwikkeling, de modernisering en het gebruik aan van vrijwillige gedragscodes, richtlijnen en beste praktijken en/of normen voor toegang en verdeling van voordelen.

  • 2 De Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert inventariseert periodiek het gebruik van vrijwillige gedragscodes, richtlijnen en beste praktijken en/of normen en neemt de aanneming van specifieke gedragscodes, richtlijnen en beste praktijken en/of normen in overweging.

Artikel 21. Bewustmaking

Elke partij neemt maatregelen ter bewustmaking van het belang van genetische rijkdommen en traditionele kennis met betrekking tot genetische rijkdommen en daarmee samenhangende kwesties op het gebied van toegang en verdeling van voordelen. Deze maatregelen kunnen onder andere omvatten:

  • a. bekendheid geven aan dit Protocol en zijn doel;

  • b. organiseren van bijeenkomsten van inheemse en lokale gemeenschappen en relevante belanghebbenden;

  • c. instellen en instandhouden van een loket ter ondersteuning van inheemse en lokale gemeenschappen en relevante belanghebbenden;

  • d. verspreiden van informatie via een nationaal uitwisselingsmechanisme;

  • e. in overleg met inheemse en lokale gemeenschappen en relevante belanghebbenden bekendheid geven aan vrijwillige gedragscodes, richtlijnen en beste praktijken en/of normen;

  • f. bevorderen van, waar passend, het intern, regionaal en internationaal uitwisselen van ervaringen;

  • g. voorlichting en training voor gebruikers en leveranciers van genetische rijkdommen en traditionele kennis met betrekking tot genetische rijkdommen over hun verplichtingen op het gebied van toegang en verdeling van voordelen;

  • h. betrekken van inheemse en lokale gemeenschappen en relevante belanghebbenden bij de tenuitvoerlegging van dit Protocol; en

  • i. bewustmaking van gemeenschapsprotocollen en procedures van inheemse en lokale gemeenschappen.

Artikel 22. Capaciteit

  • 1 De partijen werken samen bij de capaciteitsvorming, capaciteitsontwikkeling en versterking van de personele middelen en institutionele capaciteiten om dit Protocol effectief uit te voeren in partijen die ontwikkelingslanden zijn, met name de minstontwikkelde landen en kleine eilandstaten in ontwikkeling, en partijen met een economie in overgang, onder andere via bestaande mondiale, regionale, subregionale en nationale instellingen en organisaties. In dit verband zouden partijen de betrokkenheid van inheemse en lokale gemeenschappen en relevante belanghebbenden, met inbegrip van non-gouvernementele organisaties en de private sector, moeten bevorderen.

  • 2 Voor de capaciteitsvorming en -ontwikkeling bij de tenuitvoerlegging van dit Protocol wordt in overeenstemming met de relevante bepalingen van het Verdrag ten volle rekening gehouden met de behoefte aan financiële middelen van partijen die ontwikkelingslanden zijn, met name de minstontwikkelde landen en kleine eilandstaten in ontwikkeling, en partijen met een economie in overgang.

  • 3 Ten behoeve van passende maatregelen met betrekking tot de tenuitvoerleggging van dit Protocol, zouden partijen die ontwikkelingslanden zijn, met name de minstontwikkelde landen en kleine eilandstaten in ontwikkeling, en partijen met een economie in overgang hun nationale capaciteitsbehoeften en -prioriteiten moeten vaststellen door middel van zelfevaluatie van nationale capaciteit. Daarbij zouden deze partijen de capaciteitsbehoeften en -prioriteiten van inheemse en lokale gemeenschappen en relevante belanghebbenden die door hen zijn geïdentificeerd moeten ondersteunen, de capaciteitsbehoeften en -prioriteiten van vrouwen benadrukkend.

  • 4 Ter ondersteuning van de tenuitvoerlegging van dit Protocol kunnen de capaciteitsvorming en -ontwikkeling zich onder andere richten op de volgende kerngebieden:

    • a. capaciteit voor de tenuitvoerlegging van dit Protocol en de naleving van de verplichtingen daarin;

    • b. capaciteit voor het onderhandelen over onderling overeen te komen voorwaarden;

    • c. capaciteit voor de ontwikkeling, uitvoering en handhaving van interne maatregelen van wetgevende en bestuurlijke aard, dan wel beleidsmaatregelen, inzake toegang en verdeling van voordelen; en

    • d. capaciteit van landen voor de ontwikkeling van eigen onderzoeksmogelijkheden teneinde waarde aan hun eigen genetische rijkdommen toe te voegen.

  • 5 Maatregelen in overeenstemming met het eerste tot en met het vierde lid kunnen onder andere omvatten:

    • a. juridische en institutionele ontwikkeling;

    • b. bevorderen van eerlijkheid en billijkheid bij onderhandelingen, zoals scholing voor onderhandelingen over onderling overeen te komen voorwaarden;

    • c. toezicht houden op en handhaven van naleving;

    • d. toepassing van de beste beschikbare communicatiemiddelen en op het internet gebaseerde systemen ten behoeve van activiteiten betreffende toegang en verdeling van voordelen;

    • e. ontwikkeling en gebruik van taxatiemethodes;

    • f. bioprospectie, aanverwant onderzoek en taxonomische studies;

    • g. overdracht van technologie, en infrastructuur en technische capaciteit om deze overdracht van technologie duurzaam te maken;

    • h. vergroting van de bijdrage van activiteiten betreffende toegang en verdeling van voordelen aan het behoud van biologische diversiteit en het duurzaam gebruik van de bestanddelen daarvan;

    • i. bijzondere maatregelen ter vergroting van de capaciteit van relevante belanghebbenden wat betreft toegang en verdeling van voordelen; en

    • j. bijzondere maatregelen ter vergroting van de capaciteit van inheemse en lokale gemeenschappen met nadruk op de versterking van de capaciteit van de vrouwen binnen die gemeenschappen wat betreft de toegang tot genetische rijkdommen en/of traditionele kennis met betrekking tot genetische rijkdommen.

  • 6 Aan het uitwisselingcentrum voor de toegang tot en verdeling van voordelen zou informatie moeten worden verstrekt over capaciteitsvorming en ontwikkelingsinitiatieven die in overeenstemming met het eerste tot en met vijfde lid op nationaal, regionaal en internationaal niveau zijn ontplooid ten einde synergie en afstemming op het gebied van capaciteitsvorming en ontwikkeling voor de toegang tot en verdeling van voordelen te bevorderen.

Artikel 23. Overdracht van technologie en samenwerking

In overeenstemming met de artikelen 15, 16, 18 en 19 van het Verdrag werken de partijen met elkaar samen bij technische en wetenschappelijke onderzoeks- en ontwikkelingsprogramma's, met inbegrip van biotechnologische onderzoeksactiviteiten, ter verwezenlijking van het doel van dit Protocol. De partijen verplichten zich de toegang tot technologie door en de overdracht daarvan aan partijen die ontwikkelingslanden zijn, met name de minstontwikkelde landen en kleine eilandstaten in ontwikkeling, en partijen met een economie in overgang te bevorderen en aan te moedigen, teneinde de ontwikkeling en versterking van een gedegen en levensvatbare technologische en wetenschappelijke basis mogelijk te maken ter verwezenlijking van de doelen van het Verdrag en dit Protocol. Waar mogelijk en passend vindt zulke samenwerking plaats in en met een partij of partijen die genetische rijkdommen levert of leveren en het land of de landen van herkomst van deze rijkdommen is of zijn of een partij of partijen die de genetische rijkdommen heeft of hebben verkregen in overeenstemming met het Verdrag.

Artikel 24. Niet-partijen

De partijen moedigen niet-partijen aan zich aan dit Protocol te houden en het uitwisselingscentrum voor toegang en verdeling van voordelen relevante informatie te verstrekken.

Artikel 25. Financieel mechanisme en middelen

  • 1 Bij de bestudering van financiële middelen voor de tenuitvoerlegging van dit Protocol houden de partijen rekening met de bepalingen van artikel 20 van het Verdrag.

  • 2 Het financiële mechanisme van het Verdrag is het financiële mechanisme voor dit Protocol.

  • 3 Ten aanzien van de in artikel 22 van dit Protocol bedoelde capaciteitsvorming en -ontwikkeling houdt de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, bij het geven van richtsnoeren voor het in het tweede lid bedoelde financiële mechanisme, ter overweging door de Conferentie van de partijen, rekening met de behoefte aan financiële middelen van partijen die ontwikkelingslanden zijn, met name de minstontwikkelde landen en kleine eilandstaten in ontwikkeling, en van partijen met een economie in overgang, alsmede met de capaciteitsbehoeften en -prioriteiten van inheemse en lokale gemeenschappen, met inbegrip van de vrouwen binnen die gemeenschappen.

  • 4 In het kader van het eerste lid houden de partijen eveneens rekening met de behoeften van de partijen die ontwikkelingslanden zijn, met name de minstontwikkelde landen en kleine eilandstaten in ontwikkeling, en van de partijen met een economie in overgang wanneer zij trachten hun behoeften aan capaciteitsvorming en -ontwikkeling met het oog op de tenuitvoerlegging van dit Protocol te bepalen en daaraan te voldoen.

  • 5 De richtsnoeren voor het financiële mechanisme van het Verdrag in relevante besluiten van de Conferentie van de partijen, met inbegrip van die welke vóór de vaststelling van dit Protocol zijn goedgekeurd, zijn van overeenkomstige toepassing op de bepalingen van dit artikel.

  • 6 Langs bilaterale, regionale en multilaterale kanalen kunnen de partijen die ontwikkelde landen zijn tevens financiële en andere middelen verschaffen voor de tenuitvoerlegging van de bepalingen van dit Protocol, waarvan de partijen die ontwikkelingslanden zijn en de partijen met een economie in overgang gebruik kunnen maken.

Artikel 26. Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert

  • 1 De Conferentie van de partijen fungeert als de vergadering van de partijen bij dit Protocol.

  • 2 Partijen bij het Verdrag die geen partij bij dit Protocol zijn, kunnen als waarnemer deelnemen aan de werkzaamheden van elke vergadering van de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert. Wanneer de Conferentie van de partijen als vergadering van de partijen bij dit Protocol fungeert, worden besluiten krachtens dit Protocol uitsluitend genomen door de partijen bij dit Protocol.

  • 3 Wanneer de Conferentie van de partijen als vergadering van de partijen bij dit Protocol fungeert, wordt elk lid van het bureau van de Conferentie van de partijen dat een partij bij het Verdrag vertegenwoordigt die op dat moment geen partij bij dit Protocol is, vervangen door een lid dat door en uit de partijen bij dit Protocol wordt gekozen.

  • 4 De Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, toetst geregeld de tenuitvoerlegging van dit Protocol en neemt binnen haar mandaat de besluiten die nodig zijn om de effectieve tenuitvoerlegging daarvan te bevorderen. Zij vervult de functies die haar bij dit Protocol zijn toegewezen en:

    • a. doet aanbevelingen inzake alle aangelegenheden die voor de tenuitvoerlegging van dit Protocol nodig zijn;

    • b. stelt hulporganen in voor zover deze nodig worden geacht voor de tenuitvoerlegging van dit Protocol;

    • c. verzoekt om en gebruikt naar behoefte de diensten van, de samenwerking met en informatie van bevoegde internationale organisaties en intergouvernementele en niet-gouvernementele organen;

    • d. stelt de vorm en de regelmaat vast voor de indiening van informatie die overeenkomstig artikel 29 van dit Protocol dient te worden verstrekt en onderzoekt deze informatie en de door hulporganen ingediende verslagen;

    • e. onderzoekt en aanvaardt indien nodig wijzigingen van dit Protocol en de Bijlage daarvan, alsmede aanvullende bijlagen van dit Protocol die voor de tenuitvoerlegging van dit Protocol nodig worden geacht; en

    • f. vervult alle andere functies die voor de tenuitvoerlegging van dit Protocol nodig kunnen zijn.

  • 5 Het reglement van orde van de Conferentie van de partijen en het financieel reglement van het Verdrag zijn van overeenkomstige toepassing op dit Protocol, tenzij door de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert bij consensus anderszins wordt besloten.

  • 6 De eerste vergadering van de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, wordt door het Secretariaat belegd tegelijkertijd met de eerste vergadering van de Conferentie van de partijen die na de datum van inwerkingtreding van dit Protocol wordt gehouden. Latere gewone vergaderingen van de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, worden tegelijkertijd met gewone vergaderingen van de Conferentie van de partijen gehouden, tenzij door de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert anders wordt besloten.

  • 7 Buitengewone vergaderingen van de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, worden gehouden op andere tijdstippen die door de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, nodig worden geacht of op schriftelijk verzoek van een partij, mits het verzoek binnen zes maanden na de mededeling daarvan aan de partijen door het Secretariaat door minimaal een derde van de partijen wordt gesteund.

  • 8 De Verenigde Naties, haar gespecialiseerde organisaties en de Internationale Organisatie voor Atoomenergie, alsmede elke lidstaat daarvan of waarnemer daarbij die geen partij bij het Verdrag is, kunnen als waarnemer worden vertegenwoordigd op de vergaderingen van de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert. Elke andere instelling of organisatie, nationaal of internationaal, gouvernementeel of niet-gouvernementeel, die bevoegd is op gebieden die onder dit Protocol vallen en het Secretariaat haar wens te kennen heeft gegeven op een vergadering van de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, als waarnemer te zijn vertegenwoordigd, kan als zodanig worden toegelaten, tenzij ten minste een derde van de aanwezige partijen hiertegen bezwaar maakt. Tenzij in dit artikel anders is bepaald, geldt voor de toelating en de deelneming van waarnemers het in het in het vijfde lid bedoelde reglement van orde.

Artikel 27. Hulporganen

  • 1 Bij of krachtens het Verdrag ingestelde hulporganen kunnen, mede na een besluit van de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, ten behoeve van dit Protocol fungeren. Een dergelijk besluit omschrijft de te verrichten taken.

  • 2 Partijen bij het Verdrag die geen partij bij dit Protocol zijn, kunnen als waarnemer deelnemen aan de werkzaamheden van vergaderingen van deze hulporganen. Wanneer een hulporgaan van het Verdrag fungeert als hulporgaan van dit Protocol, worden besluiten krachtens het Protocol uitsluitend door partijen bij dit Protocol genomen.

  • 3 Wanneer een hulporgaan van het Verdrag zijn functies uitoefent met betrekking tot aangelegenheden die verband houden met dit Protocol, wordt elk lid van het bureau van dat hulporgaan dat een partij bij het Verdrag vertegenwoordigt, die op dat tijdstip geen partij bij dit Protocol is, vervangen door een lid dat door en uit de partijen bij dit Protocol wordt gekozen.

Artikel 28. Secretariaat

  • 3 Voorzover zij te onderscheiden zijn, worden de kosten van de diensten van het Secretariaat voor dit Protocol door de partijen bij dit Protocol gedragen. De Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, besluit tijdens haar eerste vergadering over de daartoe benodigde budgettaire bepalingen.

Artikel 29. Toezicht en rapportage

Elke partij houdt toezicht op de tenuitvoerlegging van haar verplichtingen krachtens dit Protocol en brengt met tussenpozen en in de vorm die wordt bepaald door de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, verslag uit aan de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert over maatregelen die zij voor de tenuitvoerlegging van dit Protocol heeft genomen.

Artikel 30. Procedures en mechanismen om de naleving van dit Protocol te bevorderen

De Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, overweegt en aanvaardt tijdens haar eerste vergadering samenwerkingsprocedures en institutionele mechanismen om de naleving van de bepalingen van dit Protocol te bevorderen en gevallen van niet-naleving aan de orde te stellen. De procedures en mechanismen omvatten bepalingen om waar nodig advies of bijstand aan te bieden. Zij staan los van en doen geen afbreuk aan de in artikel 27 van het Verdrag vastgestelde procedures en mechanismen voor de regeling van geschillen.

Artikel 31. Evaluatie en toetsing

De Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert, voert vier jaar na de inwerkingtreding van dit Protocol en daarna met tussenpozen die worden bepaald door de Conferentie van de partijen die als vergadering van de partijen bij dit Protocol fungeert een evaluatie van de doeltreffendheid van dit Protocol uit.

Artikel 32. Ondertekening

Dit Protocol staat open voor ondertekening door partijen bij het Verdrag op het Hoofdkwartier van de Verenigde Naties in New York van 2 februari 2011 tot 1 februari 2012.

Artikel 33. Inwerkingtreding

  • 1 Dit Protocol treedt in werking op de negentigste dag na de datum van nederlegging van de vijftigste akte van bekrachtiging, aanvaarding, goedkeuring of toetreding door staten of regionale organisaties voor economische integratie die partij zijn bij het Verdrag.

  • 2 Voor een staat of regionale organisatie voor economische integratie die dit Protocol bekrachtigt, aanvaardt, goedkeurt dan wel daartoe toetreedt na de nederlegging van de vijftigste akte, bedoeld in het eerste lid, treedt dit Protocol in werking op de negentigste dag na de datum waarop die staat of regionale organisatie voor economische integratie zijn of haar akte van bekrachtiging, aanvaarding, goedkeuring of toetreding heeft nedergelegd of op de datum waarop het Verdrag voor die staat of regionale organisatie voor economische integratie in werking treedt, indien deze datum later valt.

  • 3 Voor de toepassing van het eerste en tweede lid wordt een door een regionale organisatie voor economische integratie nedergelegde akte niet meegeteld naast de door lidstaten van die organisatie nedergelegde akten.

Artikel 34. Voorbehouden

Ten aanzien van dit Protocol kan geen enkel voorbehoud worden gemaakt.

Artikel 35. Opzegging

  • 1 Na het verstrijken van twee jaar te rekenen vanaf de datum waarop dit Protocol voor een partij in werking is getreden, kan die partij dit Protocol te allen tijde opzeggen door middel van een schriftelijke kennisgeving aan de depositaris.

  • 2 De opzegging wordt van kracht na het verstrijken van een jaar na de datum van ontvangst ervan door de depositaris of op enige latere datum vermeld in de kennisgeving van de opzegging.

Artikel 36. Authentieke teksten

Het oorspronkelijke exemplaar van dit Protocol, waarvan de Arabische, de Chinese, de Engelse, de Franse, de Russische en de Spaanse tekst gelijkelijk authentiek zijn, wordt nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd, dit Protocol op de aangegeven data hebben ondertekend.

GEDAAN te Nagoya op 29 oktober tweeduizend tien.

Bijlage Financiële en niet-financiële voordelen

  • 1. Financiële voordelen omvatten, maar zijn niet beperkt tot:

    • a. vergoedingen voor toegang of een vergoeding per verzameld of anderszins verkregen monster;

    • b. betalingen vooraf;

    • c. mijlpaalbetalingen;

    • d. betaling van royalty’s;

    • e. vergoedingen voor licenties in geval van commercialisering;

    • f. bijzondere vergoedingen te betalen aan trustfondsen ter ondersteuning van het behoud en duurzaam gebruik van biodiversiteit;

    • g. salarissen en preferentiële voorwaarden indien onderling overeengekomen;

    • h. financiering van onderzoek;

    • i. joint-ventures;

    • j. gezamenlijke eigendom van relevante intellectuele-eigendomsrechten.

  • 2. Niet-financiële voordelen omvatten, maar zijn niet beperkt tot:

    • a. delen van de resultaten van onderzoek en ontwikkeling;

    • b. samenwerking bij en bijdragen aan wetenschappelijke onderzoeks- en ontwikkelingsprogramma's, met name op het gebied van biotechnologie, waar mogelijk in de partij die de genetische rijkdommen levert;

    • c. participatie in productontwikkeling;

    • d. samenwerking bij en bijdragen aan onderwijs en training;

    • e. toelating tot ex situ voorzieningen voor genetische rijkdommen en tot databases;

    • f. overdracht aan de leverancier van de genetische rijkdommen van kennis en technologie tegen eerlijke en meestbegunstigde voorwaarden, met inbegrip van concessionele en preferentiële voorwaarden, indien overeengekomen, in het bijzonder kennis en technologie die gebruikmaken van genetische rijkdommen, met inbegrip van biotechnologie, of die relevant zijn voor het behoud en duurzaam gebruik van biologische diversiteit;

    • g. versterking van de capaciteit voor de overdracht van technologie;

    • h. institutionele capaciteitsopbouw;

    • i. menselijke en materiële hulpbronnen ter versterking van de capaciteit voor het beheer en handhaving van toegangsvoorschriften;

    • j. training met betrekking tot genetische rijkdommen met volledige deelname van landen die genetische rijkdommen leveren, en waar mogelijk in die landen;

    • k. toegang tot wetenschappelijke informatie die relevant is voor het behoud en duurzaam gebruik van biologische diversiteit, met inbegrip van biologische inventarissen en taxonomische studies;

    • l. bijdragen aan de lokale economie;

    • m. onderzoek gericht op prioritaire behoeften, zoals gezondheid en voedselzekerheid, rekening houdend met lokale toepassingen van genetische rijkdommen in de partij die genetische rijkdommen levert;

    • n. institutionele en professionele relaties die kunnen voortvloeien uit een overeenkomst over toegang en verdeling van voordelen en latere samenwerkingsactiviteiten;

    • o. voordelen inzake zekerheid omtrent voedsel en middelen van bestaan;

    • p. maatschappelijke erkenning;

    • q. gezamenlijke eigendom van relevante intellectuele-eigendomsrechten.
