Agreement between the Norwegian Government and the Netherlands Government regarding compensation for: 1. Certain Norwegian bonds lost by Netherlands owners during the Second World War. 2. War damage to the Scandinavian Seamen's Home in Rotterdam

The Royal Netherlands Government and the Royal Norwegian Government,

Desiring to settle the claims of the Netherlands Government regarding certain bonds lost by Netherlands owners during the Second World War as well as the claim for the compensation of war damage to the Scandinavian Seamen's Home in Rotterdam;

Have agreed as follows:

Article I

As the Government of the Netherlands has informed the Government of Norway that Netherlands citizens domiciled in the Netherlands during the Second World War have lost certain Norwegian securities partly as a result of war operations and conditions during the occupation, and partly as a result of the fact that the securities were stolen from them by the occupying power, the Norwegian Government has arrived at the conclusion that it should compensate these Netherlands subjects for the loss, through no fault of their own, of their bonds in Norwegian state loans in accordance with the regulations contained in the present Agreement and Annex 1 hereto.

The Norwegian Government has communicated with Norges Kommunalbank (Municipal Bank), Akershus County, the Oslo Municipal Authorities, the Bergen Municipal Authorities, the Fredrikstad Municipal Authorities, Norsk Hydro-Elektrisk Kvaelstofaktieselskab and Kristiania Hypotek- og Realkreditbank, who have stated their willingness to compensate Netherlands subjects for the loss of bonds issued by these institutions, in accordance with the regulations contained in this Agreement and Annex 2 hereto.

Details of those bonds covered by the present Agreement are contained in Annexes 1 and 2 to the present Agreement. The Annexes shall be regarded as forming an integral part of the present Agreement.

The following procedure shall be followed when applying for compensation:

  • 1. The owner of a lost bond shall notify the loss, through the appropriate Netherlands authorities, to the following Norwegian institutions:

    • (a) The Ministry of Commerce, Foreign Loans Division, in the case of Norwegian state bonds issued in foreign currencies,

    • (b) Norges Kommunalbank, in the case of bonds issued by this bank,

    • (c) Akershus Elektrisitetsverk, in the case of bonds issued by Akershus Country,

    • (d) The Principal of the Finance Department of the Oslo Municipal Authorities, in the case of bonds issued by the Oslo Municipal Authorities,

    • (e) The Municipal Treasurer of Bergen, in the case of a bond issued by the Bergen Municipal Authorities,

    • (f) Fredrikstad og Omegns Bank A/S, in the case of bonds issued by the Fredrikstad Municipal Authorities,

    • (g) Norsk Hydro-Elektrisk Kvaelstofaktieselskab, in the case of bonds issued by this company,

    • (h) Kristiania Hypotek- og Realkreditbank, Oslo, in the case of bonds issued by this bank.

  • 2. The notification shall contain information regarding:

    • (a) the loan in question - rate of interest, year, series,

    • (b) whether the loss relates to the actual bond, to the coupons or to both,

    • (c) the bond's letter, number and face value,

    • (d) which coupon sheet and coupon periods are lost,

    • (e) who the owner was as per 9th September, 1945, and his name and address. If the present owner is not the same as the owner on 9th September, 1945, the present owner's name and address shall also be stated,

    • (f) proof of the fact that the applicant, or the person from whom he has acquired his right, was the owner of the bond when it was lost, e.g. attestation from an authority of assessment, bank, probate court notary public,

    • (g) when and how the bond or coupons were stolen, destroyed or lost as a result of war operations or circumstances prevailing during the occupation,

    • (h) if the bond has been registered in Norway by a Netherlands subject other than the one applying for compensation, and the bond has not already been redeemed, a declaration or a copy of the decision, whereby the person who has registered the bond has relinquished or has been deprived of any right to it, shall also be attached.

    The appropriate Netherlands authority shall certify that the information contained in the notification is correct.

  • 3. The representatives of the bond issuers (the debtors) mentioned under No. 1 shall decide in each individual case whether the information submitted gives sufficient proof that the claimant is entitled to submit the claim as the legitimate owner, and whether the bond has been lost in such a manner that the loss entitles him to compensation.

  • 4. The Netherlands Government shall guarantee any loss which the Norwegian Government, Norges Kommunalbank, Akershus County, the Oslo Municipal Authorities, the Bergen Municipal Authorities, the Fredrikstad Municipal Authorities, Norsk Hydro-Elektrisk Kvaelstofaktieselskab or Kristiania Hypotek- og Realkreditbank might sustain as a result of payments of compensation without bonds and coupons being presented.

    Those lost bonds and coupons for which compensation is paid shall remain blocked.

    The Netherlands authorities shall be informed if any effort is made to present such securities for redemption, and redemption shall not take place until after the lapse of a reasonable period.

    If, however, the bonds and coupons presented are redeemed, either as a result of an unintentional mistake on the part of an employee or fiscal agent or because the debtor, after considering all the circumstances, finds no reason for refusing redemption, the Netherlands Government shall on demand immediately compensate the debtor for all expenses involved in the payment. The parties agree that the Netherlands Government as the guarantor shall not be entitled to make any objection to the Norwegian debtor's appraisal as to whether payment was necessary in such cases.

    The provisions regarding guarantee liability in cases where lost bonds and coupons are presented after compensation has been paid, shall also apply if a claim is submitted by a legitimate creditor who is unable to present the bond or coupon concerned.

    The abovementioned instances of guarantee liability are not intended to be exhaustive but are mentioned as examples.

    The Netherlands Government's guarantee shall apply until the bonds and the coupons which are covered by the present Agreement are prescribed according to the Norwegian legislation in force at any time. However, when the bonds have face values in several currencies or in a currency other than Norwegian crowns, the guarantee shall also apply until prescription has come into force in conformity with the general regulations which the debtor in question applies in relation to foreigners.

Article II

On the basis of the Netherlands „Wet op de Materiële Oorlogsschade” the Government of the Netherlands shall pay to the Society for Scandinavian Seamen's Homes in Foreign Ports a compensation of h.fl. 92,400.- for war damage to the Scandinavian Seamen's Home in Rotterdam. To this amount there will be added 4 % interest p.a. for the period June 1, 1940 to March 1, 1950 and 3½ % interest p.a. from March 1, 1950 till February 29, 1952, inclusive.

Article III

The present Agreement shall come into force on the date on which each Government shall receive from the other Government a Note in which it is stated, that the constitutional requirements for the entry into force of such Agreement have been fulfilled.

II

The Ministry of Commerce will make a settlement on the following lines:

  • 1. Drawn bonds. Bond and coupon sheet lost

    Payment will be made of the bonds' face value and of all coupons matured up to the day of drawing. In the case of bonds drawn during the war interest will be paid up to 1st February, 1946, and 15th December, 1945, for the 1888 and 1904 loans respectively.

  • 2. Drawn bonds. Bond lost, coupon sheet not lost

    Coupons for these bonds have been cashed up to the day the bonds were drawn. The face value of the bonds will be paid on condition that all coupons maturing after the day of drawing are handed into Norges Bank.

  • 3. Undrawn bonds. Bond and coupon sheet lost

    The Ministry of Commerce will purchase the right to the bonds at a rate based on the average rate for purchase for amortisation purposes in 1955. The rate will be £ 18-8-0d. both for bonds having a face value of £ 20-0-0d. (the 1888 loan) and for bonds having a face value of £ 19-16-5d. (the 1904 loan). With regard to bonds having a face value of £ 100-0-0d. (the 1888 loan) the rate will be £ 92-0-0d. Uncashed matured coupons will be paid at face value.

  • 4. Undrawn bonds. Bond lost, coupon sheet not lost

    The Ministry of Commerce will purchase the right to the lost bonds on the conditions mentioned under II, 3., above, provided that all non-matured coupons up to until the last interest period are handed in at the same time. Those matured coupons of this group which have not been lost are excluded from the general settlement.

  • 5. Undrawn bonds. Bond not lost, coupon sheet lost

    The Ministry of Commerce will purchase these bonds against delivery of the bonds at the price as mentioned under II, 3., above, and uncashed matured coupons will be paid at face value.

In the case of settlement made in accordance with this Agreement the shortened statutory limits for coupons in conformity with Art. 41 of the law relating to Bonds of 17th February, 1939, shall not apply.

Settlement in respect of multi-currency loans will be made on the basis of the face value in pounds sterling.

As far as bonds dealt with in II, 3 and 5, are concerned, interest will not be paid for the expired part of the term in which settlement is made. With regard to bonds mentioned under II, 4., the current period's coupon must be handed in without such interest being paid.

Norges Kommunalbank's 4½ % loan of 1933, letter C. No. 17864, face value Kr. 500.-. The bonds has been registered by the Netherlands owner.

Norges Kommunalbank's 5 % Dollar loan of 1930, bond No. 1584, face value $ 1,000.-.

When paying compensation Norges Kommunalbank shall base itself on the regulations applying to bonds in Norwegian state loans in conformity with the present Agreement and Annex I.

Bonds issued by Akershus County

Akershus County's 5 % loan of 1931, letter C. face value Kr. 1,000.- No. 10420, 13405, 13406, 10810 and 10811. The bonds have been registered by two Netherlands subjects.

Akershus County when paying compensation shall base itself on the regulations applying to bonds in Norwegian state loans in conformity with the present Agreement and Annex I.

III

Bonds issued by the Oslo Municipal Authorities

The Oslo Municipal Authorities' 4½ % loan of 1914, face value £ 100-0-0; Nos. 1703 (only coupon sheet lost) and 1791.

The Oslo Municipal Authorities will only pay compensation for the bonds and coupons which are still uncashed in the municipal authorities' books. When paying compensation the Oslo Municipal Authorities shall base themselves on the regulations applying to bonds in Norwegian state loans in conformity with the present Agreement and Annex I. However, with regard to the current (undrawn) municipal bonds in the Oslo Municipal Authorities' 4½ % loan of 1937 offered in the Netherlands, the Oslo Municipal Authorities shall base themselves on the par value (100 %) when purchasing the right to the bonds.

The Oslo Municipal Authorities also reserve the right to demand supplementary information as regards the circumstances connected with the loss of the bonds after the notification has been submitted in accordance with Article I, 1, of the present Agreement.

IV

Bond issued by the Bergen Municipal Authorities

The Bergen Municipal Authorities' 5 % loan of 1931, letter B. No 6676, face value Kr. 1,000.-. The bond has been registered by a Netherlands citizen.

When paying compensation the Bergen Municipal Authorities shall base themselves on the regulations applying to bonds in Norwegian state loans in conformity with the present Agreement and Annex 1.

V

Bonds issued by Fredrikstad Municipal Authorities

The Fredrikstad Municipal Authorities' 4 % loan of 1917, Nos. 413, 416, 1253 and 1254.

Bond No. 413 was drawn on August 1st, 1942, but has not been redeemed.

Bonds Nos. 416, 1253 and 1254 have not been presented for conversion when the loan was converted on February 1st, 1944. Compensation for unredeemed and unprescribed coupons will be paid through Fredrikstad og Omegns Bank A/S in conformity with the rules applying to Norwegian state loans according to the present Agreement and Annex 1.

When paying compensation the Kristiania Hypotek- og Realkreditbank shall base itself on the regulations applying to bonds in Norwegian state loans in conformity with the present Agreement and Annex 1.

Compensation will be paid in accordance with the amounts in Norwegian crowns which are stated on the bonds and coupons.

De Regering van het Koninkrijk der Nederlanden en de Regering van het Koninkrijk Noorwegen,

Verlangend te komen tot een regeling van aanspraken van de Nederlandse Regering inzake bepaalde tijdens de Tweede Wereldoorlog door Nederlandse eigenaars verloren obligaties, alsmede van de aanspraak op schadeloosstelling voor oorlogsschade toegebracht aan het Scandinavisch Zeemanshuis te Rotterdam,

Zijn overeengekomen als volgt:

Artikel I

Daar de Nederlandse Regering de Noorse Regering heeft medegedeeld, dat Nederlandse onderdanen die tijdens de Tweede Wereldoorlog in Nederland gevestigd waren, bepaalde Noorse effecten hebben verloren deels ten gevolge van oorlogshandelingen en oorlogsomstandigheden tijdens de bezetting en deels ten gevolge van het feit, dat de effecten hun ontstolen zijn door de bezettende mogendheid, is de Noorse Regering tot de slotsom gekomen, dat zij deze Nederlandse onderdanen voor dit, niet door hun schuld ontstane verlies van hun obligaties van Noorse staatsleningen schadeloos dient te stellen overeenkomstig de bepalingen, vervat in deze Overeenkomst en de daarbij behorende Bijlage 1.

De Noorse Regering heeft zich in verbinding gesteld met Norges Kommunalbank (Gemeentelijke Bank), de Provincie Akershus, de Gemeentelijke Autoriteiten van Oslo, de Gemeentelijke Autoriteiten van Bergen, de Gemeentelijke Autoriteiten van Fredrikstad, de Norsk Hydro-Elektrisk Kvaelstofaktieselskab en de Kristiania Hypotek- og Realkreditbank, die zich bereid hebben verklaard Nederlandse onderdanen schadeloos te stellen voor het verlies van door deze instellingen uitgegeven obligaties, overeenkomstig de bepalingen van deze Overeenkomst en de daarbij behorende Bijlage 2.

De bijzonderheden betreffende de onder deze Overeenkomst vallende obligaties zijn vervat in de Bijlagen 1 en 2 van deze Overeenkomst. De Bijlagen zullen worden beschouwd een integrerend deel van deze Overeenkomst te vormen.

Bij het aanvragen van schadeloosstelling dient de volgende procedure te worden gevolgd:

  • 1. De eigenaar van een verloren gegane obligatie doet van dit verlies, door bemiddeling van de bevoegde Nederlandse autoriteiten, mededeling aan de volgende Noorse instellingen:

    • (a) Het Ministerie van Handel, Afdeling Buitenlandse Leningen, indien het in vreemde valuta uitgegeven Noorse staatsobligaties betreft;

    • (b) Norges Kommunalbank, indien het door deze bank uitgegeven obligaties betreft;

    • (c) Akershus Elektrisitetsverk, indien het door de Provincie Akershus uitgegeven obligaties betreft;

    • (d) Het Hoofd van de Financiële Afdeling van de Gemeentelijke Autoriteiten van Oslo, indien het door de Gemeentelijke Autoriteiten van Oslo uitgegeven obligaties betreft;

    • (e) Het Hoofd van de Financiële Afdeling van de Gemeente Bergen, indien het een door de Gemeentelijke Autoriteiten van Bergen uitgegeven obligatie betreft;

    • (f) Fredrikstad og Omegns Bank A/S, indien het door de Gemeentelijke Autoriteiten van Fredrikstad uitgegeven obligaties betreft;

    • (g) Norsk Hydro-Elektrisk Kvaelstofaktieselskab, indien het door deze maatschappij uitgegeven obligaties betreft;

    • (h) Kristiania Hypotek- og Realkreditbank, Oslo, indien het door deze bank uitgegeven obligaties betreft.

  • 2. De mededeling dient gegevens te bevatten ten aanzien van:

    • (a) de betreffende lening - rente, jaar, serie;

    • (b) of de obligatie zelf, de coupons, of beide verloren zijn gegaan;

    • (c) letter, nummer en nominale waarde van de obligatie;

    • (d) welk couponblad en welke coupons (gedefinieerd naar tijdvakken) verloren zijn gegaan;

    • (e) wie de eigenaar was op 9 september 1945, alsmede zijn naam en adres. Indien de huidige eigenaar niet dezelfde is als de eigenaar op 9 september 1945, dienen de naam en het adres van de huidige eigenaar eveneens te worden opgegeven;

    • (f) bewijsstukken van het feit, dat de aanvrager of de persoon van wie hij zijn recht heeft verkregen, de eigenaar van de obligatie was op het ogenblik waarop deze verloren ging, bij voorbeeld een verklaring van een belastingautoriteit, een bank, een rechterlijke autoriteit, een notaris;

    • (g) wanneer en hoe de obligatie of de coupons gestolen of vernietigd zijn of verloren zijn gegaan ten gevolge van oorlogshandelingen of omstandigheden tijdens de bezetting;

    • (h) indien de obligatie in Noorwegen ter registratie is aangemeld door een andere Nederlandse onderdaan dan diegene die schadevergoeding vraagt, en indien de obligatie niet reeds is afgelost, dient eveneens een verklaring of een afschrift van een beslissing te worden bijgevoegd, waarbij de persoon die de obligatie ter registratie heeft aangemeld, van zijn recht afstand heeft gedaan of van dit recht is ontheven.

    De bevoegde Nederlandse autoriteit dient te verklaren, dat de in de mededeling vervatte gegevens juist zijn.

  • 3. De vertegenwoordigers van de onder 1 genoemde uitgevers van obligaties (de schuldenaars) beslissen in ieder afzonderlijk geval, of de verstrekte gegevens voldoende bewijs vormen, dat de eiser het recht heeft als rechtmatige eigenaar een vordering in te stellen en of de obligatie op een zodanige wijze verloren is gegaan, dat het verlies hem recht op schadeloosstelling geeft.

  • 4. De Nederlandse Regering stelt zich garant voor ieder verlies dat eventueel geleden wordt door de Noorse Regering, Norges Kommunalbank, de Provincie Akershus, de Gemeentelijke Autoriteiten van Oslo, de Gemeentelijke Autoriteiten van Bergen, de Gemeentelijke Autoriteiten van Fredrikstad, Norsk Hydro-Elektrisk Kvaelstofaktieselskab of Kristiania Hypotek- og Realkreditbank ten gevolge van betaling van schadeloosstelling zonder overlegging van obligaties en coupons.

    Obligaties en coupons waarvoor schadeloosstelling is betaald, blijven geblokkeerd.

    Aan de Nederlandse Regering zal mededeling worden gedaan van iedere poging dergelijke effecten ter aflossing aan te bieden en de aflossing vindt eerst plaats na verloop van een redelijke termijn.

    Indien de aangeboden obligaties en coupons echter worden afgelost, hetzij ten gevolge van een niet opzettelijke vergissing van een employé of een betaalkantoor, hetzij doordat de schuldenaar, na alle omstandigheden te hebben onderzocht, geen termen aanwezig vindt om aflossing te weigeren, dient de Nederlandse Regering op verzoek de schuldenaar onmiddellijk schadeloos te stellen voor alle met de betaling verband houdende kosten. Partijen komen overeen, dat de Nederlandse Regering als garant niet het recht zal hebben bezwaar te maken tegen het oordeel van de Noorse schuldenaar over de vraag, of de betaling in die gevallen noodzakelijk was.

    De bepalingen ten aanzien van aansprakelijkheid uit hoofde van de gegeven garantie in gevallen waarin verloren gegane obligaties en coupons worden aangeboden nadat schadeloosstelling is betaald, zijn eveneens van toepassing, indien een vordering wordt ingesteld door een rechtmatige schuldeiser die niet in staat is de betreffende obligatie of coupon over te leggen.

    Bovengenoemde gevallen van aansprakelijkheid uit hoofde van de gegeven garantie zijn niet bedoeld als een uitputtende opsomming, doch slechts als voorbeeld.

    De garantie van de Nederlandse Regering is van kracht tot de obligaties en coupons die onder deze Overeenkomst vallen, verjaren krachtens de op enig ogenblik geldende Noorse wetgeving. Indien de obligaties echter een nominale waarde hebben die in verschillende valuta's is uitgedrukt of in een andere valuta dan Noorse Kronen, is de garantie eveneens van kracht tot de verjaring is ingegaan overeenkomstig de algemene voorschriften welke de betreffende schuldenaar toepast met betrekking tot vreemdelingen.

Artikel II

Op basis van de Nederlandse „Wet op de Materiële Oorlogsschade” betaalt de Nederlandse Regering aan de Vereniging voor Scandinavische Zeemanshuizen in Buitenlandse Havens een schadeloosstelling ten bedrage van f 92 400 voor oorlogsschade aan het Scandinavisch Zeemanshuis te Rotterdam. Dit bedrag wordt verhoogd met 4 % rente per jaar voor de periode van 1 juni 1940 tot 1 maart 1950 en 3½ % rente per jaar van 1 maart 1950 tot en met 29 februari 1952.

Artikel III

Deze Overeenkomst treedt in werking op de datum waarop elk der Regeringen van de andere Regering een nota heeft ontvangen waarin wordt medegedeeld, dat aan de grondwettelijke vereisten voor de inwerkingtreding van een dergelijke Overeenkomst is voldaan.

TEN BLIJKE WAARVAN de ondergetekende gevolmachtigden, daartoe behoorlijk gevolmachtigd, deze Overeenkomst hebben ondertekend.

II

Het Ministerie van Handel zal een regeling treffen op de volgende basis:

  • 1. Uitgelote obligaties. Obligatie en couponblad verloren

    Betaling zal geschieden van de nominale waarde van de obligaties en van alle coupons die op de datum van uitloting vervallen waren. In het geval van obligaties die tijdens de oorlog zijn uitgeloot, zal voor de leningen van 1888 en 1904 onderscheidenlijk rente worden betaald tot 1 februari 1946 en 15 december 1945.

  • 2. Uitgelote obligaties. Obligatie verloren, couponblad niet verloren

    De coupons van deze obligaties zijn verzilverd tot aan de datum waarop de obligaties zijn uitgeloot. De nominale waarde van de obligaties zal worden betaald op voorwaarde, dat alle coupons die na de datum van uitloting vervallen, worden ingeleverd bij Norges Bank.

  • 3. Niet uitgelote obligaties. Obligatie en couponblad verloren

    Het Ministerie van Handel zal het recht op de obligaties kopen tegen een koers die gebaseerd is op de gemiddelde koers voor aankoop voor amortisatiedoeleinden in 1955. De koers bedraagt £ 18.8.- zowel voor obligaties met een nominale waarde van £ 20.-.- (de lening van 1888) als voor obligaties met een nominale waarde van £ 19.16.5 (de lening van 1904). Voor de obligaties met een nominale waarde van £ 100.-.- (de lening van 1888) bedraagt de koers £ 92.-.-. Niet verzilverde vervallen coupons worden betaald tegen de nominale waarde.

  • 4. Niet uitgelote obligaties. Obligatie verloren, couponblad niet verloren

    Het Ministerie van Handel zal het recht op de verloren obligaties kopen op de voorwaarden, hierboven genoemd onder II, 3, mits alle niet vervallen coupons tot en met de laatste rente-periode tegelijkertijd worden ingeleverd. Die vervallen coupons van deze categorie die niet verloren zijn gegaan, worden van deze algemene regeling uitgesloten.

  • 5. Niet uitgelote obligaties. Obligatie niet verloren, couponblad verloren

    Het Ministerie van Handel zal deze obligaties kopen tegen overgave van de obligaties en tegen de koers, hierboven genoemd onder II, 3, en niet verzilverde vervallen coupons worden betaald tegen de nominale waarde.

    In geval een regeling wordt getroffen overeenkomstig deze Overeenkomst, zijn de verkorte verjaringstermijnen voor coupons overeenkomstig artikel 41 van de Wet betreffende obligaties van 17 februari 1939 niet van toepassing.

Ten aanzien van leningen die in meer dan een valuta zijn uitgegeven, vindt regeling plaats op basis van de nominale waarde in ponden sterling.

Wat obligaties betreft, bedoeld in II, 3 en 5, zal geen rente worden betaald over het verstreken gedeelte van de termijn waarin de regeling wordt getroffen. Ten aanzien van obligaties, genoemd in II, 4, moet de coupon van de lopende periode worden ingeleverd zonder dat daarop interest wordt betaald.

Bijlage 2 bij de Overeenkomst tussen het Koninkrijk Noorwegen en het Koninkrijk der Nederlanden betreffende schadeloosstelling voor: 1. bepaalde Noorse obligaties, door Nederlandse eigenaars tijdens de Tweede Wereldoorlog verloren; 2. oorlogsschade, toegebracht aan het Scandinavisch Zeemanshuis te Rotterdam.

Bij het betalen van schadeloosstelling baseert de Provincie Akershus zich op de regelen die van toepassing zijn op obligaties van Noorse staatsleningen overeenkomstig deze Overeenkomst en Bijlage 1.

De Gemeentelijke Autoriteiten van Oslo zullen slechts schadeloosstelling betalen voor obligaties en coupons die volgens de boeken van de gemeentelijke autoriteiten nog niet verzilverd zijn. Bij het betalen van schadeloosstelling baseren de Gemeentelijke Autoriteiten van Oslo zich op de regelen die van toepassing zijn op obligaties van Noorse staatsleningen overeenkomstig deze Overeenkomst en Bijlage 1. Met betrekking tot de lopende (niet uitgelote) gemeente-obligaties van de 4½ % lening van de Gemeentelijke Autoriteiten van Oslo van 1937, aangeboden in Nederland, baseren de Gemeentelijke Autoriteiten van Oslo zich evenwel op de pari-waarde (100 %) bij het kopen van het recht op de obligaties.

De Gemeentelijke Autoriteiten van Oslo behouden zich tevens het recht voor aanvullende gegevens te vragen met betrekking tot de omstandigheden die verband houden met het verlies van de obligaties nadat de mededeling is gedaan overeenkomstig artikel I, 1 van deze Overeenkomst.

Obligaties uitgegeven door de Gemeentelijke Autoriteiten van Bergen

De 5% lening van de Gemeentelijke Autoriteiten van Bergen van 1931, letter B. nummer 6676, nominale waarde Kr. 1.000,-. De obligatie is ter registratie aangemeld door een Nederlands onderdaan. Bij het betalen van schadeloosstelling baseren de Gemeentelijke Autoriteiten van Bergen zich op de regelen die van toepassing zijn op obligaties van Noorse staatsleningen overeenkomstig deze Overeenkomst en Bijlage 1.

V

Obligaties uitgegeven door de Gemeentelijke Autoriteiten van Fredrikstad

De 4 % lening van de Gemeentelijke Autoriteiten van Fredrikstad van 1917, nummers 413, 416, 1253 en 1254.

Obligatie nummer 413 is uitgeloot op 1 augustus 1942, maar niet afgelost.

Obligaties nummers 416, 1253 en 1254 zijn niet ter omwisseling aangeboden toen de lening op 1 februari 1944 werd geconverteerd. Schadeloosstelling voor niet afgeloste en niet verjaarde coupons zal geschieden door bemiddeling van de Fredrikstad og Omegns Bank A/S in overeenstemming met de regelen welke van toepassing zijn op Noorse staatsleningen overeenkomstig deze Overeenkomst en Bijlage 1.

Bij het betalen van schadeloosstelling baseert Kristiania Hypotek- og Realkreditbank zich op de regelingen welke van toepassing zijn op obligaties van Noorse staatsleningen overeenkomstig deze Overeenkomst en Bijlage 1.

De schadeloosstelling zal worden betaald volgens de op de obligaties en coupons vermelde bedragen in Noorse Kronen.
