Protocol to the 1979 Convention on Long-range Transboundary Air Pollution on further Reduction of Sulphur Emissions

The Parties,

Determined to implement the Convention on Long-range Transboundary Air Pollution,

Concerned that emissions of sulphur and other air pollutants continue to be transported across international boundaries and, in exposed parts of Europe and North America, are causing widespread damage to natural resources of vital environmental and economic importance, such as forests, soils and waters, and to materials, including historic monuments, and, under certain circumstances, have harmful effects on human health,

Resolved to take precautionary measures to anticipate, prevent or minimize emissions of air pollutants and mitigate their adverse effects,

Convinced that where there are threats of serious or irreversible damage, lack of full scientific certainty should not be used as a reason for postponing such measures, taking into account that such precautionary measures to deal with emissions of air pollutants should be cost-effective,

Mindful that measures to control emissions of sulphur and other air pollutants would also contribute to the protection of the sensitive Arctic environment,

Considering that the predominant sources of air pollution contributing to the acidification of the environment are the combustion of fossil fuels for energy production, and the main technological processes in various industrial sectors, as well as transport, which lead to emissions of sulphur, nitrogen oxides, and other pollutants,

Conscious of the need for a cost-effective regional approach to combating air pollution that takes account of the variations in effects and abatement costs between countries,

Desiring to take further and more effective action to control and reduce sulphur emissions,

Cognizant that any sulphur control policy, however cost-effective it may be at the regional level, will result in a relatively heavy economic burden on countries with economies that are in transition to a market economy,

Bearing in mind that measures taken to reduce sulphur emissions should not constitute a means of arbitrary or unjustifiable discrimination or a disguised restriction on international competition and trade,

Taking into consideration existing scientific and technical data on emissions, atmospheric processes and effects on the environment of sulphur oxides, as well as on abatement costs,

Aware that, in addition to emissions of sulphur, emissions of nitrogen oxides and of ammonia are also causing acidification of the environment,

Noting that under the United Nations Framework Convention on Climate Change, adopted in New York on 9 May 1992, there is agreement to establish national policies and take corresponding measures to combat climate change, which can be expected to lead to reductions of sulphur emissions,

Affirming the need to ensure environmentally sound and sustainable development,

Recognizing the need to continue scientific and technical cooperation to elaborate further the approach based on critical loads and critical levels, including efforts to assess several air pollutants and various effects on the environment, materials and human health,

Underlining that scientific and technical knowledge is developing and that it will be necessary to take such developments into account when reviewing the adequacy of the obligations entered into under the present Protocol and deciding on further action,

Acknowledging the Protocol on the Reduction of Sulphur Emissions or Their Transboundary Fluxes by at least 30 per cent, adopted in Helsinki on 8 July 1985, and the measures already taken by many countries which have had the effect of reducing sulphur emissions,

Have agreed as follows:

Article 1. Definitions

For the purposes of the present Protocol,

  • 1. “Convention” means the Convention on Long-range Transboundary Air Pollution, adopted in Geneva on 13 November 1979;

  • 2. “EMEP” means the Cooperative Programme for Monitoring and Evaluation of the Long-range Transmission of Air Pollutants in Europe;

  • 3. “Executive Body” means the Executive Body for the Convention constituted under article 10, paragraph 1, of the Convention;

  • 4. “Commission” means the United Nations Economic Commission for Europe;

  • 5. “Parties” means, unless the context otherwise requires, the Parties to the present Protocol;

  • 6. “Geographical scope of EMEP” means the area defined in article 1, paragraph 4, of the Protocol to the 1979 Convention on Long-range Transboundary Air Pollution on Long-term Financing of the Cooperative Programme for Monitoring and Evaluation of the Long-range Transmission of Air Pollutants in Europe (EMEP), adopted in Geneva on 28 September 1984;

  • 7. “SOMA” means a sulphur oxides management area designated in annex III under the conditions laid down in article 2, paragraph 3;

  • 8. “Critical load” means a quantitative estimate of an exposure to one or more pollutants below which significant harmful effects on specified sensitive elements of the environment do not occur, according to present knowledge;

  • 9. “Critical levels” means the concentration of pollutants in the atmosphere above which direct adverse effects on receptors, such as human beings, plants, ecosystems or materials, may occur, according to present knowledge;

  • 10. “Critical sulphur deposition” means a quantitative estimate of the exposure to oxidized sulphur compounds, taking into account the effects of base cation uptake and base cation deposition, below which significant harmful effects on specified sensitive elements of the environment do not occur, according to present knowledge;

  • 11. “Emission” means the discharge of substances into the atmosphere;

  • 12. “Sulphur emissions” means all emissions of sulphur compounds expressed as kilotonnes of sulphur dioxide (kt SO2) to the atmosphere originating from anthropogenic sources excluding from ships in international traffic outside territorial waters;

  • 13. “Fuel” means any solid, liquid or gaseous combustible material with the exception of domestic refuse and toxic or dangerous waste;

  • 14. “Stationary combustion source” means any technical apparatus or group of technical apparatus that is co-located on a common site and is or could be discharging waste gases through a common stack, in which fuels are oxidized in order to use the heat generated;

  • 15. “Major new stationary combustion source” means any stationary combustion source the construction or substantial modification of which is authorized after 31 December 1995 and the thermal input of which, when operating at rated capacity, is at least 50 MWth. It is a matter for the competent national authorities to decide whether a modification is substantial or not, taking into account such factors as the environmental benefits of the modification;

  • 16. “Major existing stationary combustion source” means any existing stationary combustion source the thermal input of which, when operating at rated capacity, is at least 50 MWth;

  • 17. “Gas oil” means any petroleum product within HS 2710, or any petroleum product which, by reason of its distillation limits, falls within the category of middle distillates intended for use as fuel and of which at least 85% by volume, including distillation losses, distils at 350°C;

  • 18. “Emission limit value” means the permissible concentration of sulphur compounds expressed as sulphur dioxide in the waste gases from a stationary combustion source expressed in terms of mass per volume of the waste gases expressed in mg SO2 /Nm3, assuming an oxygen content by volume in the waste gas of 3% in the case of liquid and gaseous fuels and 6% in the case of solid fuels;

  • 19. “Emission limitation” means the permissible total quantity of sulphur compounds expressed as sulphur dioxide discharged from a combustion source or group of combustion sources located either on a common site or within a defined geographical area, expressed in kilotonnes per year;

  • 20. “Desulphurization rate” means the ratio of the quantity of sulphur which is separated at the combustion source site over a given period to the quantity of sulphur contained in the fuel which is introduced into the combustion source facilities and which is used over the same period;

  • 21. “Sulphur budget” means a matrix of calculated contributions to the deposition of oxidized sulphur compounds in receiving areas, originating from the emissions from specified areas.

Article 2. Basic obligations

  • 1 The Parties shall control and reduce their sulphur emissions in order to protect human health and the environment from adverse effects, in particular acidifying effects, and to ensure, as fas as possible, without entailing excessive costs, that depositions of oxidized sulphur compounds in the long term do not exceed critical loads for sulphur given, in annex I, as critical sulphur depositions, in accordance with present scientific knowledge.

  • 2 As a first step, the Parties shall, as a minimum, reduce and maintain their annual sulphur emissions in accordance with the timing and levels specified in annex II.

  • 3 In addition, any Party:

    • a) Whose total land area is greater than 2 million square kilometres;

    • b) Which has committed itself under paragraph 2 above to a national sulphur emission ceiling no greater than the lesser of its 1990 emissions or its obligation in the 1985 Helsinki Protocol on the Reduction of Sulphur Emissions or Their Transboundary Fluxes by at least 30 per cent, as indicated in annex II;

    • c) Whose annual sulphur emissions that contribute to acidification in areas under the jurisdiction of one or more other Parties originate only from within areas under its jurisdiction that are listed as SOMAs in annex III, and has presented documentation to this effect; and

    • d) Which has specified upon signature of, or accession to, the present Protocol its intention to act in accordance with this paragraph,

    shall, as a minimum, reduce and maintain its annual sulphur emissions in the area so listed in accordance with the timing and levels specified in annex II.

  • 4 Furthermore, the Parties shall make use of the most effective measures for the reduction of sulphur emissions, appropriate in their particular circumstances, for new and existing sources, which include, inter alia:

    • - Measures to increase energy efficiency;

    • - Measures to increase the use of renewable energy;

    • - Measures to reduce the sulphur content of particular fuels and to encourage the use of fuel with a low sulphur content, including the combined use of high-sulphur with low-sulphur or sulphur-free fuel;

    • - Measures to apply best available control technologies not entailing excessive cost,

    using the guidance in annex IV.

  • 5 Each Party, except those Parties subject to the United States/Canada Air Quality Agreement of 1991, shall as a minimum:

    • a) Apply emission limit values at least as stringent as those specified in annex V to all major new stationary combustion sources;

    • b) No later than 1 July 2004 apply, as far as possible without entailing excessive costs, emission limit values at least as stringent as those specified in annex V to those major existing stationary combustion sources the thermal input of which is above 500 MWth taking into account the remaining lifetime of a plant, calculated from the date of entry into force of the present Protocol, or apply equivalent emission limitations or other appropriate provisions, provided that these achieve the sulphur emission ceilings specified in annex II and, subsequently, further approach the critical loads as given in annex I; and no later than 1 July 2004 apply emission limit values or emission limitations to those major existing stationary combustion sources the thermal input of which is between 50 and 500 MWth using annex V as guidance;

    • c) No later than two years after the date of entry into force of the present Protocol apply national standards for the sulphur content of gas oil at least as stringent as those specified in annex V. In cases where the supply of gas oil cannot otherwise be ensured, a State may extend the time period given in this subparagraph to a period of up to ten years. In this case it shall specify, in a declaration to be deposited together with the instrument of ratification, acceptance, approval or accession, its intention to extend the time period.

  • 6 The Parties may, in addition, apply economic instruments to encourage the adoption of cost-effective approaches to the reduction of sulphur emissions.

  • 7 The Parties to this Protocol may, at a session of the Executive Body, in accordance with rules and conditions which the Executive Body shall elaborate and adopt, decide whether two or more Parties may jointly implement the obligations set out in annex II. These rules and conditions shall ensure the fulfilment of the obligations set out in paragraph 2 above and also promote the achievement of the environment objectives set out in paragraph 1 above.

  • 8 The Parties shall, subject to the outcome of the first review provided for under article 8 and no later than one year after the completion of that review, commence negotiations on further obligations to reduce emissions.

Article 3. Exchange of technology

  • 1 The Parties shall, consistent with their national laws, regulations and practices, facilitate the exchange of technologies and techniques, including those that increase energy efficiency, the use of renewable energy and the processing of low-sulphur fuels, to reduce sulphur emissions, particularly through the promotion of:

    • a) The commercial exchange of available technology;

    • b) Direct industrial contacts and cooperation, including joint ventures;

    • c) The exchange of information and experience;

    • d) The provision of technical assistance.

  • 2 In promoting the activities specified in paragraph 1 above, the Parties shall create favourable conditions by facilitating contacts and cooperation among appropriate organizations and individuals in the private and public sectors that are capable of providing technology, design and engineering services, equipment or finance.

  • 3 The Parties shall, no later than six months after the date of entry into force of the present Protocol, commence consideration of procedures to create more favourable conditions for the exchange of technology to reduce sulphur emissions.

Article 4. National strategies, policies, programmes, measures and information

  • 1 Each Party shall, in order to implement its obligations under article 2:

    • a) Adopt national strategies, policies and programmes, no later than six months after the present Protocol enters into force for it; and

    • b) Take and apply national measures to control and reduce its sulphur emissions.

  • 2 Each Party shall collect and maintain information on:

    • a) Actual levels of sulphur emissions, and of ambient concentrations and depositions of oxidized sulphur and other acidifying compounds, taking into account, for those Parties within the geographical scope of EMEP, the work plan of EMEP, and

    • b) The effects of depositions of oxidized sulphur and other acidifying compounds.

Article 5. Reporting

  • 1 Each Party shall report, through the Executive Secretary of the Commission, to the Executive Body, on a periodic basis as determined by the Executive Body, information on:

    • a) The implementation of national strategies, policies, programmes and measures referred to in article 4, paragraph 1;

    • b) The levels of national annual sulphur emissions, in accordance with guidelines adopted by the Executive Body, containing emission data for all relevant source categories; and

    • c) The implementation of other obligations that it has entered into under the present Protocol,

    in conformity with a decision regarding format and content to be adopted by the Parties at a session of the Executive Body. The terms of this decision shall be reviewed as necessary to identify any additional elements regarding the format and/or content of the information that are to be included in the reports.

  • 2 Each Party within the geographical scope of EMEP shall report, through the Executive Secretary of the Commission, to EMEP, on a periodic basis to be determined by the Steering Body of EMEP and approved by the Parties at a session of the Executive Body, information on the levels of sulphur emissions with temporal and spatial resolution as specified by the Steering Body of EMEP.

  • 3 In good time before each annual session of the Executive Body, EMEP shall provide information on:

    • a) Ambient concentrations and deposition of oxidized sulphur compounds; and

    • b) Calculations of sulphur budgets.

    Parties in areas outside the geographical scope of EMEP shall make available similar information if requested to do so by the Executive Body.

  • 5 The Parties shall, at sessions of the Executive Body, arrange for the preparation, at regular intervals, of revised information on calculated and internationally optimized allocations of emission reductions for the States within the geographical scope of EMEP, with integrated assessment models, with a view to reducing further, for the purposes of article 2, paragraph 1, of the present Protocol, the difference between actual depositions of oxidized sulphur compounds and critical load values.

Article 6. Research, development and monitoring

The Parties shall encourage research, development, monitoring and cooperation related to:

  • a) The international harmonization of methods for the establishment of critical loads and critical levels ans the elaboration of procedures for such harmonization;

  • b) The improvement of monitoring techniques and systems and of the modelling of transport, concentrations and deposition of sulphur compounds;

  • c) Strategies for the further reduction of sulphur emissions based on critical loads and critical levels as well as on technical developments, and the improvement of integrated assessment modelling to calculate internationally optimized allocations of emission reductions taking into account an equitable distribution of abatement costs;

  • d) The understanding of the wider effects of sulphur emissions on human health, the environment, in particular acidification, and materials, including historic and cultural monuments, taking into account the relationship between sulphur oxides, nitrogen oxides, ammonia, volatile organic compounds and tropospheric ozone;

  • e) Emission abatement technologies, and technologies and techniques to enhance energy efficiency, energy conservation and the use of renewable energy;

  • f) The economic evaluation of benefits for the environment and human health resulting from the reduction of sulphur emissions.

Article 7. Compliance

  • 1 An Implementation Committee is hereby established to review the implementation of the present Protocol and compliance by the Parties with their obligations. It shall report to the Parties at sessions of the Executive Body and may make such recommendations to them as it considers appropriate.

  • 2 Upon consideration of a report, and any recommendations, of the Implementation Committee, the Parties, taking into account the circumstances of a matter and in accordance with Convention practice, may decide upon and call for action to bring about full compliance with the present Protocol, including measures to assist a Party's compliance with the Protocol, and to further the objectives of the Protocol.

  • 3 The Parties shall, at the first session of the Executive Body after the entry into force of the present Protocol, adopt a decision that sets out the structure and functions of the Implementation Committee as well as procedures for its review of compliance.

  • 4 The application of the compliance procedure shall be without prejudice to the provisions of article 9 of the present Protocol.

Article 8. Reviews by the Parties at sessions of the Executive Body

  • 1 The Parties shall, at sessions of the Executive Body, pursuant to article 10, paragraph 2 (a), of the Convention, review the information supplied by the Parties and EMEP, the data on the effects of depositions of sulphur and other acidifying compounds and the reports of the Implementation Committee referred to in article 7, paragraph 1, of the present Protocol.

  • 2

    • a) The Parties shall, at sessions of the Executive Body, keep under review the obligations set out in the present Protocol, including:

      • i) Their obligations in relation to their calculated and internationally optimized allocations of emission reductions referred to in article 5, paragraph 5; and

      • ii) The adequacy of the obligations and the progress made towards the achievement of the objectives of the present Protocol;

    • b) Reviews shall take into account the best available scientific information on acidification, including assessments of critical loads, technological developments, changing economic conditions and the fulfilment of the obligations on emission levels;

    • c) In the context of such reviews, any Parties whose obligations on sulphur emission ceilings under annex II hereto do not conform to the calculated and internationally optimized allocations of emission reductions for that Party, required to reduce the difference between depositions of sulphur in 1990 and critical sulphur depositions within the geographical scope of EMEP by at least 60%, shall make every effort to undertake revised obligations;

    • d) The procedures, methods and timing for such reviews shall be specified by the Parties at a session of the Executive Body. The first such review shall be completed in 1997.

Article 9. Settlement of disputes

  • 1 In the event of a dispute between any two or more Parties concerning the interpretation or application of the present Protocol, the Parties concerned shall seek a settlement of the dispute through negotiation or any other peaceful means of their own choice. The parties to the dispute shall inform the Executive Body of their dispute.

  • 2 When ratifying, accepting, approving or acceding to the present Protocol, or at any time thereafter, a Party which is not a regional economic integration organization may declare in a written instrument submitted to the Depositary that, in respect of any dispute concerning the interpretation or application of the Protocol, it recognizes one or both of the following means of dispute settlement as compulsory ipso facto and without agreement, in relation to any Party accepting the same obligation:

    • a) Submission of the dispute to the International Court of Justice;

    • b) Arbitration in accordance with procedures to be adopted by the Parties at a session of the Executive Body as soon as praticable, in an annex on arbitration.

    A Party which is a regional economic integration organization may make a declaration with like effect in relation to arbitration in accordance with the procedures referred to in subparagraph (b) above.

  • 3 A declaration made under paragraph 2 above shall remain in force until it expires in accordance with its terms or until three months after written notice of its revocation has been deposited with the Depositary.

  • 4 A new declaration, a notice of revocation or the expiry of a declaration shall not in any way affect proceedings pending before the International Court of Justice or the arbitral tribunal, unless the parties to the dispute agree otherwise.

  • 5 Except in a case where the parties to a dispute have accepted the same means of dispute settlement under paragraph 2, if after twelve months following notification by one Party to another that a dispute exists between them, the Parties concerned have not been able to settle their dispute through the means mentioned in paragraph 1 above, the dispute shall be submitted, at the request of any of the parties to the dispute, to conciliation.

  • 6 For the purpose of paragraph 5, a conciliation commission shall be created. The commission shall be composed of an equal number of members appointed by each party concerned or, where parties in conciliation share the same interest, by the group sharing that interest, and a chairman chosen jointly by the members so appointed. The commission shall render a recommendatory award, which the parties shall consider in good faith.

Article 10. Annexes

The annexes to the present Protocol shall form an integral part of the Protocol. Annexes I and IV are recommendatory in character.

Article 11. Amendments and adjustments

  • 1 Any Party may propose amendments to the present Protocol. Any Party to the Convention may propose an adjustment to annex II to the present Protocol to add to it its name, together with emission levels, sulphur emission ceilings and percentage emission reductions.

  • 2 Such proposed amendments and adjustments shall be submitted in writing to the Executive Secretary of the Commission, who shall communicate them to all Parties. The Parties shall discuss the proposed amendments and adjustments at the next session of the Executive Body, provided that those proposals have been circulated by the Executive Secretary to the Parties at least ninety days in advance.

  • 3 Amendments to the present Protocol and to its annexes II, III and V shall be adopted by consensus of the Parties present at a session of the Executive Body, and shall enter into force for the Parties which have accepted them on the ninetieth day after the date on which two thirds of the Parties have deposited with the Depositary their instruments of acceptance thereof. Amendments shall enter into force for any other Party on the ninetieth day after the date on which that Party has deposited its instrument of acceptance thereof.

  • 4 Amendments to the annexes to the present Protocol, other than to the annexes referred to in paragraph 3 above, shall be adopted by consensus of the Parties present at a session of the Executive Body. On the expiry of ninety days from the date of its communication by the Executive Secretary of the Commission, an amendment to any such annex shall become effective for those Parties which have not submitted to the Depositary a notification in accordance with the provisions of paragraph 5 below, provided that at least sixteen Parties have not submitted such a notification.

  • 5 Any Party that is unable to approve an amendment to an annex, other than to an annex referred to in paragraph 3 above, shall so notify the Depositary in writing within ninety days from the date of the communication of its adoption. The Depositary shall without delay notify all Parties of any such notification received. A Party may at any time substitute an acceptance for its previous notification and, upon deposit of an instrument of acceptance with the Depositary, the amendment to such an annex shall become effective for that Party.

  • 6 Adjustments to annex II shall be adopted by consensus of the Parties present at a session of the Executive Body and shall become effective for all Parties to the present Protocol on the ninetieth day following the date on which the Executive Secretary of the Commission notifies those Parties in writing of the adoption of the adjustment.

Article 12. Signature

  • 1 The present Protocol shall be open for signature at Oslo on 14 June 1994, then at United Nations Headquarters in New York until 12 December 1994 by States members of the Commission as well as States having consultative status with the Commission, pursuant to paragraph 8 of Economic and Social Council resolution 36 (IV) of 28 March 1947, and by regional economic integration organizations, constituted by sovereign States members of the Commission, which have competence in respect of the negotiation, conclusion and application of international agreements in matters covered by the Protocol, provided that the States and organizations concerned are Parties to the Convention and are listed in annex II.

  • 2 In matters within their competence, such regional economic integration organizations shall, on their own behalf, exercise the rights and fulfil the responsibilities which the present Protocol attributes to their member States. In such cases, the Member States of these organizations shall not be entitled to exercise such rights individually.

Article 13. Ratification, acceptance, approval and accession

  • 1 The present Protocol shall be subject to ratification, acceptance or approval by Signatories.

  • 2 The present Protocol shall be open for accession as from 12 December 1994 by the States and organizations that meet the requirements of article 12, paragraph 1.

Article 14. Depositary

The instruments of ratification, acceptance, approval or accession shall be deposited with the Secretary-General of the United Nations, who will perform the functions of Depositary.

Article 15. Entry into force

  • 1 The present Protocol shall enter into force on the ninetieth day following the date on which the sixteenth instrument of ratification, acceptance, approval or accession has been deposited with the Depositary.

  • 2 For each State and organization referred to in article 12, paragraph 1, which ratifies, accepts or approves the present Protocol or accedes thereto after the deposit of the sixteenth instrument of ratification, acceptance, approval or accession, the Protocol shall enter into force on the ninetieth day following the date of deposit by such Party of its instrument of ratification, acceptance, approval or accession.

Article 16. Withdrawal

At any time after five years from the date on which the present Protocol has come into force with respect to a Party, that Party may withdraw from it by giving written notification to the Depositary. Any such withdrawal shall take effect on the ninetieth day following the date of its receipt by the Depositary, or on such later date as may be specified in the notification of the withdrawal.

Article 17. Authentic texts

The original of the present Protocol, of which the English, French and Russian texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

IN WITNESS WHEREOF the undersigned, being duly authorized thereto, have signed the present Protocol.

DONE at Oslo, this fourteenth day of June one thousand nine hundred and ninety-four.

Annex II. Sulphur emission ceilings and percentage emission reductions

The sulphur emission ceilings listed in the table below give the obligations referred to in paragraphs 2 and 3 of article 2 of the present Protocol. The 1980 and 1990 emission levels and the percentage emission reductions listed are given for information purposes only.

  • a) If, in a given year before 2005, a Party finds that, due to a particularly cold winter, a particularly dry summer and un unforeseen short-term loss of capacity in the power supply system, domestically or in a neighbouring country, it cannot comply with its obligations under this annex, it may fulfil those obligations by averaging its national annual sulphur emissions for the year in question, the year preceding that year and the year following it, provided that the emission level in any single year is not more than 20% above the sulphur emission ceiling.

    The reason for exceedance in any given year and the method by which the three-year average figure will be achieved, shall be reported to the Implementation Committee.

  • b) For Greece and Portugal percentage emission reductions given are based on the sulphur emission ceilings indicated for the year 2000.

  • c) European part within the EMEP area.

Annex III. Designation of sulphur oxides management areas (SOMAs)

The following SOMA is listed for the purposes of the present Protocol:

South-east Canada SOMA

This is an area of 1 million km2 which includes all the territory of the provinces of Prince Edward Island, Nova Scotia and New Brunswick, all the territory of the province of Quebec south of a straight line between Havre-St.Pierre on the north coast of the Gulf of Saint Lawrence and the point where the Quebec-Ontario boundary intersects the James Bay coastline, and all the territory of the province of Ontario south of a straight line between the point where the Ontario-Quebec boundary intersects the James Bay coastline and Nipigon River near the north shore of Lake Superior.

Annex IV. Control technologies for sulphur emissions from stationary sources

1. INTRODUCTION

1.

The aim of this annex is to provide guidance for identifying sulphur control options and technologies for giving effect to the obligations of the present Protocol.

2.

The annex is based on information on general options for the reduction of sulphur emissions and in particular on emission control technology performance and costs contained in official documentation of the Executive Body and its subsidiary bodies.

3.

Unless otherwise indicated, the reduction measures listed are considered, on the basis of operational experience of several years in most cases, to be the most well-established and economically feasible best available technologies. However, the continuously expanding experience of low-emission measures and technologies at new plants as well as of the retrofitting of existing plants will necessitate regular review of this annex.

4.

Although the annex lists a number of measures and technologies spanning a wide range of costs and efficiencies, it cannot be considered as an exhaustive statement of control options. Moreover, the choice of control measures and technologies for any particular case will depend on a number of factors, including current legislation and regulatory provisions and, in particular, control technology requirements, primary energy patterns, industrial infrastructure, economic circumstances and specific in-plant conditions.

The annex mainly addresses the control of oxidized sulphur emissions considered as the sum of sulphur dioxide (SO2) and sulphur trioxide (SO3), expressed as SO2. The share of sulphur emitted as either sulphur oxides or other sulphur compounds from non-combustion processes and other sources is small compared to sulphur emissions from combustion.

When measures or technologies are planned for sulphur sources emitting other components, in particular nitrogen oxides, (NOx), particulates, heavy metals and volatile organic compounds (VOCs), it is worthwile to consider them in conjunction with pollutant-specific control options in order to maximize the overall abatement effect and minimize the impact on the environment and, especially, to avoid the transfer of air pollution problems to other media (such as waste water and solid waste).

II. MAJOR STATIONARY SOURCES FOR SULPHUR EMISSIONS

7.

Fossil fuel combustion processes are the main source of anthropogenic sulphur emissions from stationary sources. In addition, some non-combustion processes may contribute considerably to the emissions. The major stationary source categories, based on EMEP/CORINAIR’90, include:

  • i) Public power, cogeneration and district heating plants:

    • a) Boilers;

    • b) Stationary combustion turbines and internal combustion engines;

  • ii) Commercial, institutional and residential combustion plants:

    • a) Commercial boilers;

    • b) Domestic heaters;

  • iii) Industrial combustion plants and processes with combustion:

    • a) Boilers and process heaters;

    • b) Processes, e.g. metallurgical operations such as roasting and sintering, coke oven plants, processing of titanium dioxide (TiO2), etc);

    • c) Pulp production;

  • iv) Non-combustion processes, e.g. sulphuric acid production, specific organic synthesis processes, treatment of metallic surfaces;

  • v) Extraction, processing and distribution of fossil fuels;

  • vi) Waste treatment and disposal, e.g. thermal treatment of municipal and industrial waste.

Overall data (1990) for the ECE region indicate that about 88% of total sulphur emissions originate from all combustion processes (20% from industrial combustion), 5% from production processes and 7% from oil refineries. The power plant sector in many countries is the major single contributor to sulphur emissions. In some countries, the industrial sector (including refineries) is also an important SO2 emitter. Although emissions from refineries in the ECE region are relatively small, their impact on sulphur emissions from other sources is large due to the sulphur in the oil products. Typically 60% of the sulphur intake present in the crudes remains in the products, 30% is recovered as elemental sulphur and 10% is emitted from refinery stacks.

III. GENERAL OPTIONS FOR REDUCTION OF SULPHUR EMISSIONS FROM COMBUSTION

General options for reduction of sulphur emissions are:

  • i) Energy management measures:1

    • a) Energy saving

      The rational use of energy (improved energy efficiency/process operation, cogeneration and/or demand-side management) usually results in a reduction in sulphur emissions.

    • b) Energy mix

      In general, sulphur emissions can be reduced by increasing the proportion of non-combustion energy sources (i.e. hydro, nuclear, wind, etc) to the energy mix. However, further environmental impacts to be considered.

  • ii) Technological options:

    • a) Fuel switching

      The SO2 emissions during combustion are directly related to the sulphur content of the fuel used.

      Fuel switching (e.g. from high- to low-sulphur coals and/or liquid fuels, or from coal to gas) leads to lower sulphur emissions, but there may be certain restrictions, such as the availability of low-sulphur fuels and the adaptability of existing combustion systems to different fuels. In many ECE countries, some coal or oil combustion plants are being replaced by gas-fired combustion plants. Dual-fuel plants may facilitate fuel switching.

    • b) Fuel cleaning

      Cleaning of natural gas is state-of-the-art technology and widely applied for operational reasons.

      Cleaning of process gas (acid refinery gas, coke oven gas, biogas, etc.) is alo state-of-the-art technology.

      Desulphurization of liquid fuels (light and middle fractions) is state-of-the-art technology.

      Desulphurization of heavy fractions is technically feasible; nevertheless, the crude properties should be kept in mind. Desulphurization of atmospheric residue (bottom products from atmospheric crude distillation units) for the production of low-sulphur fuel oil is not, however, commonly practised; processing low-sulphur crude is usually preferable. Hydro-cracking and full conversion technology have matured and combine high sulphur retention with improved yield of light products. The number of full conversion refineries is as yet limited. Such refineries typically recover 80 to 90% of the sulphur intake and convert all residues into light products or other marketable products. For this type of refinery, energy consumption and investment costs are increased. Typical sulphur content for refinery products is given in table 1 below.

      Current technologies to clean hard coal can remove approximately 50% of the inorganic sulphur (depending on coal properties) but none of the organic sulphur. More effective technologies are being developed which, however, involve higher specific investment and costs. Thus the efficiency of sulphur removal by coal cleaning is limited compared to flue gas desulphurization. There may be a country-specific optimization potential for the best combination of fuel cleaning and flue gas cleaning.

    • c) Advanced combustion technologies

      These combustion technologies with improved thermal efficiency and reduced sulphur emissions include: fluidized-bed combustion (FBC): bubbling (BFBC), circulating (CFBC) and pressurized (PFBC); integrated gasification combined-cycle (IGCC); and combined-cycle gas turbines (CCGT)

      Stationary combustion turbines can be integrated into combustion systems in existing conventional power plants which can increase overall efficiency by 5 to 7 % leading, for example, to a significant reduction in SO2-emissions. However, major alternations to the existing furnace system become necessary.

      Fluidized-bed combustion is a combustion technology for burning hard coal and brown coal, but it can also burn other solid fuels such as petroleum coke and low-grade fuels such as waste, peat and wood. Emissions can additionally be reduced by integrated combustion control in the system due to the addition of lime/limestone to the bed material. The total installed capacity of FBC has reached approximately 30.000 MWth (250 to 350 plants), incuding 8,000 MWth in the capacity range of greater than 50 MWth. By-products from this process may cause problems with respect to use and/or disposal, and further development is required.

      The IGCC process includes coal gasification and combined-cycle power generation in a gas and steam turbine. The gasified coal is burnt in the combustion chamber of the gas turbine. Sulphur emission control is achieved by the use of state-of-the-art technology for raw gas cleaningfacilities upstream of the gas turbine. The technology also exists for heavy oil residues and bitumen emulsions. The installed capacity is presently about 1,000 MWel (5 plants).

      Combined-cycle gas-turbine power stations using natural gas as fuel with an energy efficiency of approximately 48 to 52% are currently being planned.

    • d) Process and combustion modifications

      Combustion modifications comparable to the measures used for NOx emission control do not exist, as during combustion the organically and/or inorganically bound sulphur is almost completely oxidized (a certain percentage depending on the fuel properties and combustion technology is retained in the ash).

      In this annex dry additive processes for conventional boilers are considered as process modifications due to the injection of an agent into the combustion unit. However, experience has shown that, when applying these processes, thermal capacity is lowered, the Ca/S ratio is high and sulphur removal low. Problems with the further utilization of the by-product have to be considered, so that this solution should usually be applied as an intermediate measure and for smaller units (table 2).

      • a) For high sulphur content in the fuel the removal efficiency has to be adapted. However, the scope for doing so may be process-specific. Availability of these processes is usually 95%.

      • b) Limited applicability for high-sulphur fuels.

      • c) Emission in mg/m3 (STP), dry, 6% oxygen for solid fuels, 3% oxygen for liquid fuels.

      • d) Conversion factor depends on fuel properties, specific fuel gas volume and thermal efficiency of boiler (conversion factors (m3 kWhel, thermal efficiency: 36%) used: hard coal: 3.50; brown coal: 4.20; heavy oil: 2.80).

      • e) Specific investment cost relates to a small sample of installations.

      • f) Specific investment cost includes denitrification process.

      The table was established mainly for large combustion installations in the public sector. However, the control options are also valid for other sectors with similar exhaust gases.

    • e) Flue gas desulphurization (FGD) processes

      These processes aim at removing already formed sulphur oxides, and are also referred to as secondary measures. The state-of-the-art technologies for flue gas treatment processes are all based on the removal of sulphur by wet, dry or semi-dry and catalytic chemical processes.

    To achieve the most efficient programme for sulphur emission reductions beyond the energy management measures listed in (i) above a combination of technological options identified in (ii) above should be considered.

    In some cases options for reducing sulphur emissions may also result in the reduction of emissions of CO2, NOx and other pollutants.

    In public power, cogeneration and district heating plants, flue gas treatment processes used include: lime/limestone wet scrubbing (LWS); spray dry absorption (SDA); Wellman Lord process (WL); ammonia scrubbing (AS); and combined NOX/SOX removal processes (activated carbon process (AC) and combined catalytic NOx/SOx removal).

    In the power generation sector, LWS and SDA cover 85% and 10% respectively, of the installed FGD capacity.

    Several new flue gas desulphurization processes, such as electron beam dry scrubbing (EBDS) and Mark 13A, have not yet passed the pilot stage.

    Table 2 above shows the efficiency of the above-mentioned secondary measures based on the practical experience gathered from a large number of implemented plants. The implemented capacity as well as the capacity range are also mentioned. Despite comparable characteristics for several sulphur abatement technologies, local or plant-specific influences may lead to the exclusion of a given technology.

    Table 2 also includes the usual investment cost ranges for the sulphur abatement technologies listed in sections (ii) (c), (d) and (e). However, when applying these technologies to individual cases it should be noted that investment costs of emission reduction measures will depend amongst other things on the particular technologies used, the required control systems, the plant size, the extent of the required reduction and the time-scale of planned maintenance cycles. The table thus gives only a broad range of investment costs. Investment costs for retrofit generally exceed those for new plants.

IV. CONTROL TECHNIQUES FOR OTHER SECTORS

The control techniques listed in section 9 (ii) (a) to (e) are valid not only in the power plant sector but also in various other sectors of industry. Several years of operational experience have been acquired, in most cases in the power plant sector.

11.

The application of sulphur abatement technologies in the industrial sector merely depends on the process’s specific limitations in the relevant sectors. Important contributors to sulphur emissions and corresponding reduction measures are presented in table 3 below.

In the sectors listed in table 3, process-integrated measures, including raw material changes (if necessary combined with sector-specific flue gas treatment), can be used to achieve the most effective reduction of sulphur emissions.

13.

Reported examples are the following:

  • a) In new kraft pulp mills, sulphur emission of less than 1 kg of sulphur per tonne of pulp AD (air dried) can be achieved;2

  • b) In sulphite pulp mills, 1 to 1.5 kg of sulphur per tonne of pulp AD can be achieved;

  • c) In the case of roasting of sulphides, removal efficiencies of 80 to 99% for 10,000 to 200,000 m3/h units have been reported (depending on the process);

  • d) For one iron or sintering plant, an FGD unit of 320,000 m3/h capacity achieves a clean gas value below 100 mg SO x /Nm3 at 6% 02;

  • e) Coke ovens are achieving less than 400 mg SOx/Nm3at 6% 02;

  • f) Sulphuric acid plants achieve a conversion rate larger than 99%;

  • g) Advanced Claus plant achieves sulphur recovery of more than 99%.

V. BY-PRODUCTS AND SIDE-EFFECTS

14.

As efforts to reduce sulphur emissions from stationary sources are increased in the countries of the ECE region, the quantities of by-products will also increase.

15.

Options which would lead to usable by-products should be selected. Furthermore, options that lead to increased thermal efficiency and minimize the waste disposal issue whenever possible should be selected. Although most by-products are usable or recyclable products such as gypsum, ammonia salts, sulphuric acid or sulphur, factors such as market conditions and quality standards need to be taken into account. Further utilization of FBC and SDA by-products have to be improved and investigated, as disposal sites and disposal criteria limit disposal in several countries.

The following side-effects will not prevent the implementation of any technology or method but should be considered when several sulphur abatement options are possible:

  • a) Eenergy requirements of the gas treatment processes;

  • b) Corrosion attack due to the formation of sulphuric acid by the reaction of sulphur oxides with water vapour;

  • c) Increased use of water and waste water treatment;

  • d) Reagent requirements;

  • e) Solid waste disposal.

VI. MONITORING AND REPORTING

17.

The measures taken to carry out national strategies and policies for the abatement of air pollution include: legislation and regulatory provisions, economic incentives and disincentives; as well as technological requirements (best available technology).

18.

In general, standards are set, per emission source, according to plant size, operating mode, combustion technology, fuel type and whether it is a new or existing plant. An alternative approach also used is to set a target for the reduction of total sulphur emissions from a group of sources and to allow a choice of where to take action to reach this target (the bubble concept).

19.

Efforts to limit the sulphur emissions to the levels set out in the national framework legislation have to be controlled by a permanent monitoring and reporting system and reported to the supervising authorities.

20.

Several monitoring systems, using both continuous and discontinuous measurement methods, are available. However, quality requirements vary. Measurements are to be carried out by qualified institutes using measuring and monitoring systems. To this end, a certification system can provide the best assurance.

21.

In the framework of modern automated monitoring systems and process control equipment, reporting does not create a problem. The collection of data for further use is a state-of-the-art technique, however, data to be reported to competent authorities differ from case to case. To obtain better comparability, data sets and prescribing regulations should be harmonized. Harmonization is also desirable for quality assurance of measuring and monitoring systems. This should be taken into account when comparing data.

22.

To avoid discrepancies and inconsistencies, key issues and parameters, including the following, must be well defined:

  • a) Definition of standards expressed as ppmv, mg/Nm3, g/GJ, kg/h or kg/tonne of product. Most of these units need to be calculated and need specification in terms of gas temperature, humidity, pressure, oxygen content or heat input value;

  • b) Definition of the period over which standards are to be averaged, expressed as hours, months or a year;

  • c) Definition of failure times and corresponding emergency regulations regarding bypass of monitoring systems or shut-down of the installation;

  • d) Definition of methods for back-filling of data missed or lost as a result of equipment failure;

  • e) Definition of the parameter set to be measured. Depending on the type of industrial process, the necessary information may differ. This also involves the location of the measurement point within the system.

  • a) As guidance, for a plant with a multi-fuel firing unit involving the simultaneous use of two or more types of fuels, the competent authorities shall set emission limit values taking into account the emission limit values from column (ii) relevant for each individual fuel the rate of thermal input delivered by each fuel and, for refineries, the relevant specific characteristics of the plant. For refineries, such a combined limit value shall under no circumstances exceed 1700 mg SO2/NM3.

    In particular, the limit values shall not apply to the following plants:

    • - Plants in which the products of combustion are used for direct heating, drying, or any other treatment of objects or materials, e.g. reheating furnaces, furnaces for heat treatment;

    • - Post-combustion plants, i.e. any technical apparatus designed to purify the waste gases by combustion which is not operated as an independent combustion plant;

    • - Facilities for the regeneration of catalytic cracking catalysts;

    • - Facilities for the conversion of hydrogen sulphide into sulphur;

    • - Reactors used in the chemical industry;

    • - Coke battery furnaces;

    • - Cowpers;

    • - Waste incinerators;

    • - Plants powered by diesel, petrol and gas engines or by gas turbines, irrespective of the fuel used.

    In a case where a Party, due to the high sulphur content of indigenous solid or liquid fuels, cannot meet the emission limit values set forth in column (ii), it may apply the desulphurization rates set forth in column (iii) or a maximum limit value of 800 mg S02/Nm3 (although preferably not more than 650 mg SO2/Nm3.

    The Party shall report any such application to the Implementation Committee in the calendar year n which it is made.

    Where two or more separate new plants are installed in such a way that, taking technical and economic factors into account, their waste gases could, in the judgement of the competent authorities, be discharged through a common stack, the combination formed by such plants is to be regarded as a single unit.

  • b) mg SO2 /Nm3is defined at a temperature of 273°K and a pressure of 101.3 kPa, after correction for the water vapour content.

Met het vaste voornemen voorzorgsmaatregelen te treffen teneinde emissies van luchtverontreinigende stoffen voor te zijn, deze te vermijden of tot een minimum terug te brengen en de schadelijke gevolgen ervan te beperken,

Ervan overtuigd dat waar sprake is van dreiging van ernstige of onherstelbare schade, het ontbreken van volledige wetenschappelijke zekerheid niet mag worden aangevoerd als reden voor uitstel van bedoelde maatregelen, met dien verstande dat deze voorzorgsmaatregelen met betrekking tot emissies van luchtverontreinigende stoffen kosteneffectief dienen te zijn,

Indachtig het feit dat maatregelen ter beheersing van emissies van zwavel en andere luchtverontreinigende stoffen tevens zouden bijdragen tot de bescherming van het kwetsbare arctische milieu,

Overwegende dat de voornaamste bronnen van luchtverontreiniging die tot verzuring van het milieu bijdragen, de verbranding van fossiele brandstoffen voor de opwekking van energie en de belangrijkste technische processen in verschillende takken van de industrie, alsmede het vervoer zijn, die leiden tot emissies van zwavel, stikstofoxiden en andere verontreinigende stoffen,

Zich bewust van de noodzaak van een kosteneffectieve regionale aanpak voor de bestrijding van luchtverontreiniging, die rekening houdt met de van land tot land uiteenlopende effecten en kosten van bestrijding,

Geleid door de wens verdergaande en doeltreffendere maatregelen te nemen ter beheersing en vermindering van zwavelemissies,

Beseffend dat elk beleid inzake zwavelbeheersing, hoe kosteneffectief dit ook moge zijn op regionaal niveau, een betrekkelijk zware economische last met zich zal meebrengen voor landen die de overgang naar een markteconomie doormaken,

In aanmerking nemend dat maatregelen ter vermindering van zwavel-emissies niet als middel tot willekeurige of ongerechtvaardigde discriminatie of als verkapte beperking van de internationale concurrentie of handel mogen dienen,

In overweging nemend de bestaande wetenschappelijke en technische gegevens inzake emissies, atmosferische processen en de effecten op het milieu van zwaveloxiden, alsmede de kosten van bestrijding,

In het besef dat, naast zwavelemissies, ook emissies van stikstofoxiden en van ammoniak leiden tot verzuring van het milieu,

Vaststellend dat in het kader van het Raamverdrag van de Verenigde Naties inzake klimaatverandering, aangenomen te New York op 9 mei 1992, overeenstemming is bereikt over het vaststellen van nationaal beleid en het nemen van overeenkomstige maatregelen ter bestrijding van klimaatverandering, hetgeen naar verwachting zal leiden tot vermindering van zwavelemissies,

Bevestigend de noodzaak van milieuverantwoorde en duurzame ontwikkeling,

Erkennend de noodzaak om de wetenschappelijke en technische samenwerking voort te zetten, teneinde de op kritische belasting en kritisch niveau gebaseerde aanpak verder uit te werken, met inbegrip van inspanningen om verscheidene luchtverontreinigende stoffen en verschillende gevolgen voor het milieu, materialen en de gezondheid van de mens te evalueren,

Onderstrepend dat de wetenschappelijke en technische kennis zich verder ontwikkelt en dat het noodzakelijk zal zijn deze ontwikkelingen in aanmerking te nemen wanneer wordt getoetst of de ingevolge dit Protocol aangegane verplichtingen toereikend zijn en over verdere maatregelen wordt beslist,

Bevestigend het Protocol inzake de vermindering van zwavelemissies of van de grensoverschrijdende stromen van deze zwavelverbindingen met ten minste 30 procent, aangenomen te Helsinki op 8 juli 1985, en de reeds door veel landen genomen maatregelen, die tot een vermindering van zwavelemissies hebben geleid,

Zijn het volgende overeengekomen:

Artikel 1. Begripsomschrijvingen

Voor de toepassing van dit Protocol wordt verstaan onder:

  • 1. „Verdrag”: het Verdrag betreffende grensoverschrijdende luchtverontreiniging over lange afstand, aangenomen te Genève op 13 november 1979;

  • 2. „EMEP”: het Programma voor samenwerking inzake de bewaking en evaluatie van het transport van luchtverontreinigende stoffen over lange afstand in Europa;

  • 3. „Uitvoerend Orgaan”: het Uitvoerend Orgaan voor het Verdrag, opgericht ingevolge artikel 10, eerste lid, van het Verdrag;

  • 4. „Commissie”: de Economische Commissie voor Europa van de Verenigde Naties.

  • 5. „Partijen”: de Partijen bij dit Protocol, tenzij de context anders vereist;

  • 6. „Geografische reikwijdte van het EMEP”: het gebied, omschreven in artikel 1, vierde punt, van het Protocol bij het Verdrag van 1979 betreffende grensoverschrijdende luchtverontreiniging over lange afstand aangaande de langlopende financiering van het programma voor samenwerking inzake de bewaking en evaluatie van het transport van luchtverontreinigende stoffen over lange afstand in Europa (EMEP), aangenomen te Genève op 28 september 1984;

  • 7. „SOMA”: een zwaveloxiden-beheersgebied (sulpher oxides management area) in Bijlage III als zodanig aangemerkt onder de in artikel 2, derde lid, genoemde voorwaarden;

  • 8. „Kritische belasting”: een kwantitatieve schatting van de blootstelling aan één of meer verontreinigende stoffen, beneden welke zich volgens de huidige kennis geen aanzienlijke schadelijke gevolgen voor nader omschreven gevoelige bestanddelen van het milieu voordoen;

  • 9. „Kritisch niveau”: de concentratie van verontreinigende stoffen in de atmosfeer, boven welke zich volgens de huidige kennis rechtstreekse schadelijke gevolgen voor mensen, planten, ecosystemen of materialen, kunnen voordoen;

  • 10. „Kritische zwaveldepositie”: een kwantitatieve schatting van de blootstelling aan geoxydeerde zwavelverbindingen, rekening houdend met de gevolgen van de opname van basische kationen en de depositie van basische kationen, beneden welke zich volgens de huidige kennis geen aanzienlijke schadelijke gevolgen voor nader omschreven bestanddelen van het milieu voordoen:

  • 11. „Emissies”: de uitstoot van stoffen in de atmosfeer;

  • 12. „Zwavelemissies”: alle emissies in de atmosfeer van zwavelverbindingen, uitgedrukt in kiloton zwaveldioxide (kt SO2), afkomstig uit antropogene bronnen, met uitzondering van schepen in het internationale verkeer buiten de territoriale wateren;

  • 13. „Brandstof”: elk vast, vloeibaar of gasvormig brandbaar materiaal, met uitzondering van huisvuil en giftige of gevaarlijke afvalstoffen;

  • 14. „Stationaire verbrandingsbron”: een technisch toestel, of groep technische toestellen bijeengeplaatst op een gemeenschappelijk terrein, die via een gemeenschappelijke schoorsteen rookgassen uitstoot of zou kunnen uitstoten, waarin brandstoffen worden geoxydeerd teneinde de opgewekte warmte te gebruiken;

  • 15. „Belangrijke nieuwe stationaire verbrandingsbron”: een stationaire verbrandingsbron voor de bouw of ingrijpende wijziging waarvan na 31 december 1995 vergunning is verleend en waarvan de thermische belasting, bij functioneren op het nominale vermogen, ten minste 50 MWth is. Het is aan de bevoegde nationale autoriteiten om te beslissen of een wijziging al dan niet ingrijpend is, rekening houdend met factoren als de voordelen van de wijziging in milieu-opzicht;

  • 16. „Belangrijke bestaande stationaire verbrandingsbron”: een bestaande stationaire verbrandingsbron waarvan de thermische belasting, bij functioneren op het nominale vermogen, ten minste 50 MWth is;

  • 17. „Gasolie”: een aardolieprodukt dat onder GS-code 2710 valt of een aardolieprodukt dat op grond van zijn destillatiegrenzen behoort tot de middeldestillaten die bestemd zijn voor gebruik als brandstof en die, destillatieverliezen inbegrepen, voor ten minste 85% van hun volume overdestilleren bij 350° C;

  • 18. „Emissiegrenswaarde”: de toelaatbare concentratie van zwavelverbindingen, uitgedrukt als zwaveldioxide, in de rookgassen uit een stationaire verbrandingsbron, uitgedrukt in massa per volume van de rookgassen, weergegeven als mg SO2/Nm3, uitgaande van een zuurstofgehalte in het rookgas van 3 volumepercenten in het geval van vloeibare of gasvormige brandstoffen en 6 volumepercenten in het geval van vaste brandstoffen;

  • 19. „Emissiebegrenzing”: de toelaatbare totale hoeveelheid zwavelverbindingen, uitgedrukt als zwaveldioxide, afkomstig uit een verbrandingsbron of een groep verbrandingsbronnen, gelegen hetzij op een gemeenschappelijk terrein, hetzij in een bepaald geografisch gebied, uitgedrukt in kiloton per jaar;

  • 20. „Ontzwavelingspercentage”: de verhouding van de hoeveelheid zwavel die over een bepaalde periode op de locatie van de verbrandingsbron wordt afgescheiden ten opzichte van de hoeveelheid zwavel die de brandstof bevat die wordt ingebracht in de verbrandingsbron met de daarbij behorende voorzieningen en die in die zelfde periode wordt verbruikt;

  • 21. „Zwavelbudget”: een matrix van berekende bijdragen aan de depositie van geoxydeerde zwavelverbindingen in ontvangstgebieden, afkomstig van de emissies vanuit nader omschreven gebieden.

Artikel 2. Fundamentele verplichtingen

  • 1 De Partijen zullen hun zwavelemissies beheersen en verminderen teneinde de gezondheid van de mens en het milieu te beschermen tegen schadelijke gevolgen, met name de gevolgen van verzuring, en ervoor te zorgen, voor zover mogelijk, zonder dat zulks buitensporige kosten met zich meebrengt, dat deposities van geoxydeerde zwavelverbindingen op de lange termijn de kritische belasting voor zwavel die in Bijlage I als kritische zwaveldepositie is vermeld, overeenkomstig de huidige wetenschappelijke kennis, niet overschrijden.

  • 2 Als eerste stap zullen de Partijen, minimaal, hun jaarlijkse zwavelemissies verminderen en handhaven in overeenstemming met het tijdschema en de niveaus genoemd in Bijlage II.

  • 3 Daarnaast zal elke Partij:

    • a. waarvan het totale grondoppervlak groter is dan 2.000.000 vierkante kilometer;

    • b. die zich ingevolge het tweede lid heeft verplicht tot een nationaal plafond voor zwavelemissies dat niet hoger ligt dan hetzij haar emissies in 1990, hetzij haar verplichting ingevolge het Protocol van Helsinki van 1985 inzake de vermindering van zwavelemissies of van de grensoverschrijdende stromen daarvan met ten minste 30 procent, naargelang van welk niveau het laagst is, als aangegeven in Bijlage II;

    • c. waarvan de jaarlijkse zwavelemissies die bijdragen tot verzuring in gebieden onder de rechtsmacht van één of meer andere Partijen uitsluitend afkomstig zijn uit gebieden onder haar rechtsmacht die in Bijlage III als SOMA zijn aangemerkt, en die hiertoe bescheiden heeft ingediend; en

    • d. die bij de ondertekening van of toetreding tot dit Protocol blijk heeft gegeven van haar voornemen te handelen in overeenstemming met dit lid, minimaal haar jaarlijkse zwavelemissies in het aldus vermelde gebied verminderen en handhaven in overeenstemming met het tijdschema en de niveaus genoemd in Bijlage II.

  • 4 Voorts zullen de Partijen gebruik maken van de meest doeltreffende maatregelen ter vermindering van zwavelemissies die, gezien hun bijzondere omstandigheden, passend zijn voor nieuwe en bestaande bronnen die, onder andere, omvatten:

    • - maatregelen gericht op verhoging van het rendement;

    • - maatregelen gericht op toeneming van het gebruik van duurzame energie;

    • - maatregelen gericht op verlaging van het zwavelgehalte van bepaalde brandstoffen en op stimulering van het gebruik van brandstof met een laag zwavelgehalte, waaronder het gecombineerd gebruik van hoogzwavelige en laagzwavelige of zwavelvrije brandstof;

    • - maatregelen gericht op de toepassing van de beste beschikbare beheersingstechnologieën die geen buitensporige kosten met zich meebrengen,

    waarbij Bijlage IV als richtsnoer dient.

  • 5 Elke Partij, met uitzondering van de Partijen die onder de United States/Canada Air Quality Agreement van 1991 vallen, zal minimaal:

    • a. emissiegrenswaarden, die ten minste even stringent zijn als de in Bijlage V genoemde, toepassen op alle belangrijke nieuwe stationaire verbrandingsbronnen;

    • b. uiterlijk 1 juli 2004, voor zover mogelijk zonder dat zulks buitensporige kosten met zich meebrengt, emissiegrenswaarden, die ten minste even stringent zijn als de in Bijlage V genoemde, toepassen op belangrijke bestaande stationaire verbrandingsbronnen boven 500 MWth, rekening houdend met de resterende levensduur van een installatie, berekend vanaf de datum van inwerkingtreding van dit Protocol, dan wel gelijkwaardige emissiebegrenzingen of andere passende voorschriften toepassen, mits daarmee de in Bijlage II genoemde plafonds voor zwavelemissies worden bereikt en vervolgens de in Bijlage I vermelde kritische belasting dichter wordt benaderd; uiterlijk 1 juli 2004 zal elke Partij emissiegrenswaarden of emissiebegrenzingen toepassen op belangrijke bestaande verbrandingsbronnen waarvan de thermische belasting ligt tussen 50 en 500 MWth, en daarbij Bijlage V als richtsnoer gebruiken;

    • c. uiterlijk twee jaar na de datum van inwerkingtreding van dit Protocol nationale normen voor het zwavelgehalte van gasolie toepassen, die ten minste even stringent zijn als de in Bijlage V genoemde. Ingeval de gasolievoorziening niet anderszins kan worden gewaarborgd, kan een Staat de in deze letter bedoelde termijn verlengen tot een termijn van tien jaar. In dit geval geeft de Partij in een verklaring die te zamen met de akte van bekrachtiging, aanvaarding, goedkeuring of toetreding wordt nedergelegd, blijk van haar voornemen de termijn te verlengen.

  • 6 De Partijen kunnen bovendien economische instrumenten hanteren ter stimulering van het toepassen van kosteneffectieve wijzen van aanpak voor de vermindering van zwavelemissies.

  • 7 De Partijen bij dit Protocol kunnen op een zitting van het Uitvoerend Orgaan, overeenkomstig door het Uitvoerend Orgaan uit te werken en aan te nemen regels en voorwaarden, besluiten of twee of meer Partijen gezamenlijk uitvoering kunnen geven aan de in Bijlage II uiteengezette verplichtingen. Deze regels en voorwaarden dienen de nakoming van de in het tweede lid van dit artikel verwoorde verplichtingen te garanderen en tevens de verwezenlijking van de in het eerste lid van dit artikel verwoorde milieudoelstellingen te bevorderen.

  • 8 De Partijen zullen, met inachtneming van het resultaat van de eerste toetsing ingevolge artikel 8 en uiterlijk een jaar na de afronding van die toetsing, onderhandelingen aangaan inzake verdere verplichtingen ter vermindering van de emissies.

Artikel 3. Uitwisseling van technologie

  • 1 De Partijen vergemakkelijken, in overeenstemming met hun nationale wetten, voorschriften en gewoonten, de uitwisseling van technologieën en technieken, waaronder die welke zijn gericht op verhoging van het energierendement, het gebruik van duurzame energie en de verwerking van laagzwavelige brandstoffen, ter vermindering van zwavelemissies, met name door het bevorderen van:

    • a. commerciële uitwisseling van beschikbare technologie;

    • b. rechtstreekse contacten en samenwerking tussen industrieën, met inbegrip van gezamenlijke ondernemingen (joint ventures);

    • c. uitwisseling van informatie en ervaring;

    • d. verlening van technische bijstand.

  • 2 Ter bevordering van de in het eerste lid van dit artikel genoemde activiteiten scheppen de Partijen gunstige voorwaarden door contacten en samenwerking te vergemakkelijken tussen daarvoor in aanmerking komende organisaties en personen in de particuliere en de publieke sector die in staat zijn technologie, ontwerp- en constructiediensten, apparatuur of financiële middelen ter beschikking te stellen.

  • 3 De Partijen vangen uiterlijk zes maanden na de datum van inwerkingtreding van dit Protocol aan met de bestudering van procedures om gunstigere voorwaarden te scheppen voor de uitwisseling van technologie ter vermindering van zwavelemissies.

Artikel 4. Nationale strategieën, beleidslijnen, programma’s, maatregelen en informatie

  • 1 Teneinde haar verplichtingen ingevolge artikel 2 na te komen, neemt elke Partij:

    • a. uiterlijk zes maanden nadat dit Protocol in werking is getreden, nationale strategieën, beleidslijnen en programma’s aan; en

    • b. nationale maatregelen en past zij deze toe, ter beheersing en vermindering van haar zwavelemissies.

  • 2 Elke Partij verzamelt en houdt informatie bij over:

    • a. de feitelijke niveaus van zwavelemissies en van omgevingsconcentraties en deposities van geoxydeerde zwavelverbindingen en andere verzurende verbindingen, waarbij de Partijen binnen de geografische reikwijdte van het EMEP rekening houden met het werkplan van het EMEP; en

    • b. de effecten van deposities van geoxydeerde zwavelverbindingen en andere verzurende verbindingen.

Artikel 5. Rapportage

  • 1 Elke Partij verstrekt, via de Uitvoerend Secretaris van de Commissie, met een door het Uitvoerend Orgaan vastgestelde regelmaat, aan het Uitvoerend Orgaan informatie over:

    • a. de uitvoering van nationale strategieën, beleidslijnen, programma’s en maatregelen, bedoeld in artikel 4, eerste lid;

    • b. de niveaus van nationale jaarlijkse zwavelemissies in overeenstemming met de door het Uitvoerend Orgaan aangenomen richtlijnen, die emissiegegevens bevatten voor alle relevante categorieën bronnen; en

    • c. de nakoming van andere verplichtingen die zij ingevolge dit Protocol is aangegaan,

    in overeenstemming met een tijdens een zitting van het Uitvoerend Orgaan door de Partijen aan te nemen besluit betreffende vorm en inhoud. De bewoordingen van dit besluit worden indien nodig nader bezien teneinde na te gaan of er aanvullende elementen zijn betreffende de vorm en/of de inhoud van de informatie die in de rapportage moeten worden opgenomen.

  • 2 Elke Partij binnen de geografische reikwijdte van het EMEP verstrekt, via de Uitvoerend Secretaris van de Commissie, met een door het Bestuursorgaan van het EMEP vastgestelde, en tijdens een zitting van het Uitvoerend Orgaan door de Partijen goedgekeurde regelmaat, aan het EMEP informatie over de niveaus van zwavelemissies met oplossend vermogen, wat tijd en ruimte betreft, als aangegeven door het Bestuursorgaan van het EMEP.

  • 3 Tijdig voor elke jaarlijkse zitting van het Uitvoerend Orgaan verstrekt het EMEP informatie over:

    • a. omgevingsconcentraties en de depositie van geoxydeerde zwavelverbindingen; en

    • b. berekeningen van de zwavelbudgetten.

    Partijen in gebieden buiten de geografische reikwijdte van het EMEP stellen soortgelijke informatie beschikbaar indien het Uitvoerend Orgaan daarom verzoekt.

  • 4 Het Uitvoerend Orgaan draagt, in overeenstemming met artikel 10, tweede lid, letter b, van het Verdrag zorg voor het opstellen van informatie over de gevolgen van deposities van geoxydeerde zwavelverbindingen en andere verzurende verbindingen.

  • 5 De Partijen dragen op zittingen van het Uitvoerend Orgaan zorg voor het opstellen, met regelmatige tussenpozen, van herziene informatie over berekende en internationaal geoptimaliseerde toedeling voor emissievermindering aan de Staten binnen de geografische reikwijdte van het EMEP, met geïntegreerde evaluatiemodellen, teneinde, voor de toepassing van artikel 2, eerste lid, van dit Protocol het verschil tussen de feitelijke deposities van geoxydeerde zwavelverbindingen en de waarden van de kritische belasting verder te verkleinen.

Artikel 6. Onderzoek, ontwikkeling en monitoring

De Partijen stimuleren het onderzoek, de ontwikkeling, de monitoring en de samenwerking met betrekking tot:

  • a. de internationale harmonisering van methoden voor de vaststelling van kritische belastingen en kritische niveaus en het uitwerken van procedures voor bedoelde harmonisering;

  • b. de verbetering van monitoringtechnieken en -systemen en van modellen voor de verplaatsing, de concentraties en de depositie van zwavelverbindingen;

  • c. strategieën voor de verdere vermindering van zwavelemissies gebaseerd op kritische belastingen en kritische niveaus, alsmede op technische ontwikkelingen, en de verbetering van geïntegreerde evaluatiemodellen ter berekening van internationaal geoptimaliseerde toedeling voor emissievermindering, rekening houdend met een billijke verdeling van de bestrijdingskosten;

  • d. inzicht in de bredere gevolgen van zwavelemissies voor de gezondheid van de mens, het milieu, in het bijzonder verzuring, en materialen, waaronder historische en culturele monumenten, rekening houdend met het verband tussen zwaveloxiden, stikstofoxiden, ammoniak, vluchtige organische verbindingen en ozon in de troposfeer;

  • e. technologieën ter bestrijding van emissies en technologieën en technieken ter verhoging van het energierendement, energiebesparing en uitbreiding van het gebruik van duurzame energie;

  • f. de economische evaluatie van de uit de vermindering van zwavelemissies voortvloeiende baten voor het milieu en de gezondheid van de mens.

Artikel 7. Naleving

  • 1 Hierbij wordt een Implementatiecomité ingesteld, dat is belast met de toetsing van de implementatie van dit Protocol en de nakoming door de Partijen van hun verplichtingen. Het brengt verslag uit aan de Partijen op zittingen van het Uitvoerend Orgaan en doet de Partijen aanbevelingen die het passend acht.

  • 2 Na bestudering van een rapport, en eventuele aanbevelingen, van het Implementatiecomité kunnen de Partijen, rekening houdend met de omstandigheden van een kwestie en in overeenstemming met de verdragspraktijk, een besluit nemen over en oproepen tot het nemen van maatregelen om volledige naleving van het Protocol te bewerkstelligen, met inbegrip van maatregelen om een Partij bij te staan bij de naleving van het Protocol, en de doelstellingen van dit Protocol te bevorderen.

  • 3 De Partijen nemen, op de eerste zitting van het Uitvoerend Orgaan na de inwerkingtreding van dit Protocol, een besluit waarbij de structuur en de taken van de Toepassingscommissie, alsmede procedures voor haar toetsing van de naleving, worden vastgesteld.

  • 4 De toepassing van de procedure betreffende de naleving laat de bepalingen van artikel 9 van dit Protocol onverlet.

Artikel 8. Toetsingen door de Partijen op zittingen van het Uitvoerend Orgaan

  • 1 Op zittingen van het Uitvoerend Orgaan toetsen de Partijen, overeenkomstig artikel 10, tweede lid, letter a, van het Verdrag, de door de Partijen en het EMEP verstrekte informatie, de gegevens betreffende de gevolgen van deposities van zwavelverbindingen en andere verzurende verbindingen en de verslagen van het Implementatiecomité, bedoeld in artikel 7, eerste lid, van dit Protocol.

  • 2

    • a. Op zittingen van het Uitvoerend Orgaan onderwerpen de Partijen de verplichtingen op grond van dit Protocol aan een toetsing, met inbegrip van:

      • i. hun verplichtingen met betrekking tot hun berekende en internationaal geoptimaliseerde toedelingen voor emissievermindering, bedoeld in artikel 5, vijfde lid, en

      • ii. de adequaatheid van de verplichtingen en de gemaakte vorderingen bij de verwezenlijking van de doelstellingen van dit Protocol;

    • b. Bij de toetsingen dient rekening te worden gehouden met de beste beschikbare wetenschappelijke gegevens over verzuring, waaronder evaluaties van kritische belastingen, technologische ontwikkelingen, veranderende economische omstandigheden en de nakoming van verplichtingen inzake emissieniveaus;

    • c. In de context van deze toetsingen stelt elke Partij waarvan de verplichtingen inzake de plafonds voor zwavelemissies uit hoofde van Bijlage II bij dit Protocol niet in overeenstemming zijn met de berekende en internationaal geoptimaliseerde toedelingen voor emissievermindering voor die Partij, vereist om het verschil tussen de deposities van zwavel in 1990 en de kritische zwaveldeposities binnen de geografische reikwijdte van het EMEP met ten minste 60% te verkleinen, alles in het werk om herziene verplichtingen op zich te nemen;

    • d. De procedures, de methoden en het tijdschema voor deze toetsingen worden nader bepaald door de Partijen op een zitting van het Uitvoerend Orgaan. De eerste toetsing dient in 1997 te zijn afgerond.

Artikel 9. Beslechting van geschillen

  • 1 In geval van een geschil tussen twee of meer Partijen betreffende de uitlegging of toepassing van dit Protocol, streven de betrokken Partijen naar beslechting van het geschil door middel van onderhandelingen of op een andere vreedzame wijze van hun eigen keuze. De partijen bij het geschil stellen het Uitvoerend Orgaan in kennis van hun geschil.

  • 2 Bij de bekrachtiging, aanvaarding of goedkeuring van dan wel toetreding tot dit Protocol, of op enig tijdstip daarna, kan een Partij die geen regionale organisatie voor economische integratie is, in een schriftelijke bij de depositaris ingediende akte verklaren dat zij, met betrekking tot een geschil betreffende de uitlegging of toepassing van het Protocol, beide onderstaande wijzen van geschillenbeslechting, of één daarvan, ipso facto en zonder overeenkomst als dwingend erkent ten opzichte van elke Partij die dezelfde verplichting aanvaardt:

    • a. voorlegging van het geschil aan het Internationale Gerechtshof;

    • b. arbitrage in overeenstemming met procedures, zo spoedig mogelijk door de Partijen op een zitting van het Uitvoerend Orgaan aan te nemen in een bijlage inzake arbitrage.

    Een Partij die een regionale organisatie voor economische integratie is, kan een verklaring van gelijke strekking afleggen met betrekking tot arbitrage in overeenstemming met de in letter b hierboven bedoelde procedures.

  • 3 Een ingevolge het tweede lid hierboven afgelegde verklaring blijft van kracht totdat zij overeenkomstig haar bepalingen haar geldigheid verliest dan wel tot drie maanden nadat een schriftelijke kennisgeving van opzegging is nedergelegd bij de depositaris.

  • 4 Een nieuwe verklaring, een kennisgeving van opzegging of het verlies van de geldigheid van een verklaring zijn op generlei wijze van invloed op de procedure voor het Internationale Gerechtshof of het scheidsgerecht, tenzij de partijen bij het geschil anders overeenkomen.

  • 5 Indien de partijen bij het geschil, behalve ingeval de betrokken partijen dezelfde wijze van geschillenbeslechting krachtens het tweede lid hebben aanvaard, er na twaalf maanden te rekenen vanaf de kennisgeving van de ene Partij aan de andere dat tussen hen een geschil bestaat, niet in zijn geslaagd hun geschil te beslechten op de in het eerste lid hierboven bedoelde wijzen, wordt het geschil op verzoek van één van de partijen bij het geschil onderworpen aan conciliatie.

  • 6 Voor de toepassing van het vijfde lid wordt een conciliaticcommissie gevormd. De commissie bestaat uit een gelijk aantal leden, benoemd door elke betrokken partij of, wanneer bij de conciliatie betrokken partijen een zelfde belang nebben, door de groep die dat zelfde belang heeft, en een voorzitter, gekozen door de aldus benoemde leden gezamenlijk. De commissie doet uitspraak in de vorm van een aanbeveling, die de partijen te goeder trouw in overweging nemen.

Artikel 10. Bijlagen

De Bijlagen bij dit Protocol vormen een integrerend deel van dit Protocol. De Bijlagen I en IV dragen het karakter van een aanbeveling.

Artikel 11. Wijzigingen en aanpassingen

  • 1 Elke Partij kan wijzigingen op dit Protocol voorstellen. Elke Partij bij het Verdrag kan een aanpassing van Bijlage II bij dit Protocol voorstellen, door daaraan haar naam toe te voegen, te zamen met de emissieniveaus, de plafonds voor zwavelemissies en het percentage van de emissievermindering.

  • 2 Deze voorgestelde wijzigingen en aanpassingen worden schriftelijk ingediend bij de Uitvoerend Secretaris van de Commissie, die ze bekendmaakt aan alle Partijen. De Partijen bespreken de voorgestelde wijzigingen en aanpassingen op de eerstvolgende zitting van het Uitvoerend Orgaan, op voorwaarde dat deze voorstellen ten minste 90 dagen van tevoren door de Uitvoerend Secretaris aan de Partijen zijn toegezonden.

  • 3 Wijzigingen op dit Protocol en op de Bijlagen II, III en V dienen bij consensus te worden aangenomen door de Partijen die aanwezig zijn op een zitting van het Uitvoerend Orgaan, en worden voor de Partijen die ze hebben aanvaard van kracht op de negentigste dag na de datum waarop tweederde van de Partijen haar akte van aanvaarding daarvan heeft nedergelegd bij de depositaris. Voor elke andere Partij worden wijzigingen van kracht op de negentigste dag na de datum waarop die Partij haar akte van aanvaarding daarvan heeft nedergelegd.

  • 4 Wijzigingen op de Bijlagen bij dit Protocol, behoudens de in het derde lid hierboven genoemde Bijlagen, dienen bij consensus te worden aangenomen door de Partijen die aanwezig zijn op een zitting van het Uitvoerend Orgaan. Na het verstrijken van negentig dagen na de datum van bekendmaking daarvan door de Uitvoerend Secretaris van de Commissie wordt een wijziging op bedoelde Bijlagen van kracht voor de Partijen die geen kennisgeving als bedoeld in het vijfde lid van dit artikel hebben ingediend bij de depositaris, op voorwaarde dat ten minste zestien Partijen niet een zodanige kennisgeving hebben ingediend.

  • 5 Elke Partij die een wijziging op een Bijlage, behoudens een in het derde lid van dit artikel genoemde Bijlage, niet kan goedkeuren, stelt de depositaris hiervan schriftelijk in kennis binnen negentig dagen na de datum van bekendmaking van de aanneming. De depositaris stelt alle Partijen onverwijld in kennis van de ontvangst van zodanige kennisgevingen. Een Partij kan te allen tijde een aanvaarding in de plaats stellen van haar eerdere kennisgeving, en na nederlegging van een akte van aanvaarding bij de depositaris wordt de wijziging op die Bijlage dan terstond van kracht voor die Partij.

  • 6 Aanpassingen van Bijlage II dienen bij consensus te worden aangenomen door de Partijen die aanwezig zijn op een zitting van het Uitvoerend Orgaan en worden voor alle Partijen bij dit Protocol van kracht op de negentigste dag na de datum waarop de Uitvoerend Secretaris van de Commissie die Partijen schriftelijk in kennis stelt van de aanneming van de aanpassing.

Artikel 12. Ondertekening

  • 1 Dit Protocol staat open voor ondertekening te Oslo op 14 juni 1994, vervolgens op de zetel van de Verenigde Naties te New York tot 12 december 1994 door Staten die lid zijn van de Commissie, alsmede Staten die een raadgevende status bij de Commissie hebben, overeenkomstig paragraaf 8 van resolutie 36 (IV) van de Economische en Sociale Raad van 28 maart 1947, en door regionale organisaties voor economische integratie, opgericht door soevereine Staten die lid zijn van de Commissie, die bevoegd zijn te onderhandelen over verdragen met betrekking tot onder dit Protocol vallende aangelegenheden en deze verdragen te sluiten en toe te passen, mits de betrokken Staten en organisaties Partij bij het Verdrag zijn en zijn vermeld in Bijlage II.

  • 2 Deze regionale organisaties voor economische integratie oefenen, wanneer het aangelegenheden betreft die onder hun bevoegdheden vallen, zelf de rechten uit en vervullen zelf de taken die door dit Protocol aan hun lidstaten worden toegekend. In deze gevallen mogen de lidstaten van deze organisaties deze rechten niet afzonderlijk uitoefenen.

Artikel 13. Bekrachtiging, aanvaarding, goedkeuring en toetreding

  • 1 Dit Protocol behoeft bekrachtiging, aanvaarding of goedkeuring door de ondertekenaars.

  • 2 Dit Protocol staat met ingang van 12 december 1994 open voor toetreding door de Staten en organisaties die voldoen aan de eisen van artikel 12, eerste lid.

Artikel 14. Depositaris

De akten van bekrachtiging, aanvaarding, goedkeuring of toetreding worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties, die de taken van depositaris verricht.

Artikel 15. Inwerkingtreding

  • 1 Dit Protocol treedt in werking op de negentigste dag volgend op de datum waarop de zestiende akte van bekrachtiging, aanvaarding, goedkeuring of toetreding is nedergelegd.

  • 2 Voor elke in artikel 12, eerste lid, bedoelde Staat of organisatie die dit Protocol bekrachtigt, aanvaardt of goedkeurt of hiertoe toetreedt na de nederlegging van de zestiende akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, treedt het Protocol in werking op de negentigste dag volgend op de datum van nederlegging door deze Partij van haar akte van bekrachtiging, aanvaarding, goedkeuring of toetreding.

Artikel 16. Opzegging

Vijf jaar na de datum waarop dit Protocol voor een Partij in werking is getreden, kan deze Partij dit Protocol te allen tijde opzeggen door middel van een schriftelijke kennisgeving aan de depositaris. De opzegging wordt van kracht op de negentigste dag na de datum waarop de depositaris de kennisgeving heeft ontvangen, of op een in de kennisgeving van opzegging aangegeven latere datum.

Artikel 17. Authentieke teksten

Het origineel van dit Protocol, waarvan de Engelse, de Franse en de Russische tekst gelijkelijk authentiek zijn, wordt nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd, dit Protocol hebben ondertekend.

GEDAAN te Oslo op de veertiende juni 1994.

Bijlage II. Plafonds voor zwavelemissies en percentuele emissieverminderingen

Met de in de onderstaande tabel opgenomen plafonds voor zwavelemissies wordt invulling gegeven aan de in artikel 2, lid 2 en lid 3, van dit Protocol bedoelde verplichtingen. De vermelde emissieniveaus voor 1980 en 1990 en de percentuele emissieverminderingen zijn alleen ter informatie gegeven.

a) Indien, in een bepaald jaar vóór 2005, een Partij constateert dat zij, als gevolg van een bijzonder koude winter, een bijzonder droge zomer en een onvoorzien, tijdelijk capaciteitsverlies in de stroomvoorziening, hetzij in eigen land, hetzij in een buurland, niet aan haar in deze bijlage aangegeven verplichtingen kan voldoen, kan zij deze deze verplichtingen nakomen door haar nationale zwavelemissies voor het betrokken jaar, het daaraan voorafgaande jaar en het daaropvolgende jaar te middelen, mits het emissieniveau in geen van die jaren de grenswaarde voor zwavelemissies met meer dan 20% overschrijdt.

De reden voor een overschrijding in een bepaald jaar en de methode die wordt gebruikt voor de berekening van het driejarig gemiddelde moeten worden gemeld bij het Implementatiecomité.

b) De voor Griekenland en Portugal vermelde percentuele emissieverminderingen zijn gebaseerd op de voor het jaar 2000 aangegeven plafonds voor zwavelemissies.

c) Het Europese deel binnen het EMEP-gebied.

Bijlage III. Aanwijzing van beheersgebieden voor zwaveloxiden (SOMA’S)

Ten behoeve van dit Protocol wordt het volgende SOMA afgebakend:

SOMA in Zuidoost-Canada

Het betreft een gebied van 1 miljoen km2 dat het gehele grondgebied omvat van de provincies Prince Edward Island, Nova Scotia en New Brunswick, het gehele grondgebied van de provincie Quebec ten zuiden van een rechte lijn tussen Havre-St. Pierre aan de noordkust van de Golf van Saint Lawrence en het punt waar de grens tussen Quebec en Ontario de kustlijn van James Bay snijdt, alsmede het gehele grondgebied van de provincie Ontario ten zuiden van een rechte lijn tussen het punt waar de grens tussen Ontario en Quebec de kustlijn van James Bay snijdt en de Nipigonrivier dicht bij de noordkust van het Bovenmeer.

Bijlage IV. Technologieën voor beheersing van zwavelemissies uit stationaire bronnen

I. INLEIDING

  • 1 Deze bijlage heeft tot doel een richtsnoer te geven bij de vaststelling van de keuzen en technologieën voor de beheersing van zwavel ter nakoming van de verplichtingen van het huidige Protocol.

  • 2 De bijlage is gebaseerd op de informatie over algemene keuzemogelijkheden voor de vermindering van zwavelemissies en met name over de resultaten en de kosten van de technologie voor emissiebeheersing die is opgenomen in de officiële documentatie van het Uitvoerend Orgaan en de daaraan ondergeschikte lichamen.

  • 3 Tenzij anders aangegeven worden de opgesomde verminderingsmaatregelen, op basis van een in de meeste gevallen jarenlange praktijkervaring, geacht de best beschikbare technologieën te zijn die het meest gangbaar zijn en economisch het meest verantwoord zijn. Gezien het feit dat steeds meer ervaring wordt opgedaan met de toepassing van tot een lage emissie leidende maatregelen en technologieën in nieuwe installaties, alsook met de aanpassing van bestaande installaties, zal deze bijlage echter regelmatig moeten worden herzien.

  • 4 Hoewel in de bijlage een aantal, qua kosten en doeltreffendheid sterk uiteenlopende, maatregelen en technologieën is opgenomen, mag zij echter niet als een uitputtende opsomming van de beschikbare beheersingsmogelijkheden worden beschouwd. Bovendien hangt de keuze van beheersingsmaatregelen en -technologieën voor elk bijzonder geval af van een aantal factoren, waaronder de geldende wet- en regelgeving, en, in het bijzonder, de aan de beheersingstechnologie gestelde eisen, de structuur van de primaire-energievoorziening, de industriële infrastructuur, de economische omstandigheden en de specifieke situatie in de betrokken installatie.

  • 5 De bijlage heeft hoofdzakelijk betrekking op de beheersing van de emissies van zwaveloxiden, namelijk zwaveloxide (SO2) en zwaveltrioxide (SO3), dit laatste uitgedrukt als SO2. Het aandeel van zwavel uitgestoten als zwaveloxiden, of andere zwavelverbindingen vanuit processen waarbij geen verbranding optreedt, en vanuit andere bronnen, is klein vergeleken met zwavelemissies vanuit verbranding.

  • 6 Wanneer maatregelen of technologieën worden gepland voor zwavelbronnen die ook andere stoffen uitstoten, met name stikstofoxiden (NOX), deeltjes, zware metalen en vluchtige organische stoffen (VOS), verdient het aanbeveling deze in samenhang met op specifieke verontreinigende stoffen gerichte beheersingsmethoden te beschouwen teneinde het totale bestrijdingseffect te maximaliseren en de inwerking op het milieu tot een minimum te beperken, en met name de verplaatsing van luchtverontreinigingsproblemen naar andere media (zoals afvalwater en vast afval) te voorkomen.

II. BELANGRIJKE STATIONAIRE BRONNEN VAN ZWAVELEMISSIES

  • 7 Verbranding van fossiele brandstoffen is de belangrijkste bron van antropogene zwavelemissies uit stationaire bronnen. Daarnaast kunnen enkele processen waarbij geen verbranding optreedt, aanzienlijk tot de emissies bijdragen. De belangrijkste categorieën stationaire bronnen, op basis van EMEP/CORINAIR’90, omvatten:

    • i) Openbare elektriciteitscentrales, warmte/krachtkoppeling en stads/blokverwarming:

      • a. stoomketels;

      • b. stationaire verbrandingsturbines en inwendige-verbrandingsmotoren;

    • ii) Verbrandingsinstallaties ten behoeve van winkel-, kantoor- en woonruimten:

      • a. bedrijfsketels;

      • b. verwarmingsinstallaties in woningen;

    • iii) Industriële verbrandingsinstallaties en processen waarbij verbranding optreedt:

      • a. stoomketels en procesfornuizen;

      • b. processen, b.v. metallurgische bewerkingen zoals roosten en sinteren, cokesovens, verwerking van titaandioxide (TiO2), enz;

      • c. pulpproduktie;

    • iv) Processen waarbij geen verbranding optreedt, b.v. produktie van zwavelzuur, specifieke organische syntheseprocessen, behandeling van metalen oppervlakken;

    • v) Winning, be/verwerking en distributie van fossiele brandstoffen;

    • vi) Afvalbehandeling en -verwijdering, b.v. thermische behandeling van stedelijk en industrieel afval.

  • 8 Uit de gegevens (1990) voor het ECE-gebied als geheel blijkt dat circa 88% van de totale zwavelemissies afkomstig is van de diverse verbrandingsprocessen (20% van industriële verbrandingsprocessen), 5% van produktieprocessen en 7% van olieraffinaderijen. De elektriciteitsproduktie is in veel landen de belangrijkste afzonderlijke veroorzaker van zwavelemissies. In sommige landen draagt de industriële sector (inclusief raffinaderijen) eveneens in sterke mate bij aan de SO2-uitstoot. Hoewel de emissies van raffinaderijen in het ECE-gebied betrekkelijk gering zijn, hebben zij een grote invloed op de zwavelemissies uit andere bronnen door de in de olieprodukten aanwezige zwavel. Normaal blijft 60% van de hoeveelheid zwavel in de ruwe olie achter in de geraffineerde produkten, wordt 60% teruggewonnen als zuivere zwavel en ontsnapt 10% via de schoorsteen.

III. ALGEMENE MOGELIJKHEDEN VOOR VERMINDERING VAN DE DOOR VERBRANDING VEROORZAAKTE ZWAVELEMISSIES

  • 9 Algemene mogelijkheden voor vermindering van de zwavelemissies zijn:

    • i) Maatregelen voor energiebeheer:3

      • a. energiebesparing

        Rationeel energiegebruik (verbeterde energie-efficiëntie/procesbesturing, warmte/krachtkoppeling en/of beheersing van de vraag) leidt gewoonlijk tot lagere zwavelemissies.

      • b. samenstelling van het energiepakket

        In het algemeen kunnen zwavelemissies worden verminderd door het aandeel van niet door verbranding vrijkomende vormen van energie (waterkracht, kernenergie, windenergie, enz.) in het energiepakket te verhogen. Daarbij moet wel met bijkomende milieu-effecten rekening worden gehouden.

    • ii) Technologische maatregelen:

      • a. overschakeling op andere brandstoffen

        De omvang van de SO2-emissies bij verbranding houdt rechtstreeks verband met het zwavelgehalte van de gebruikte brandstof.

        Overschakeling op een andere brandstof (b.v. van steenkool met een hoog op steenkool met een laag zwavelgehalte en/of op vloeibare brandstoffen, of van steenkool op gas) leidt tot lagere zwavelemissies, maar er kunnen bepaalde beperkende factoren optreden, zoals de beschikbaarheid van brandstoffen met een laag zwavelgehalte en de mate waarin bestaande verbrandingsinstallaties aan andere brandstoffen kunnen worden aangepast. In veel ECE-landen wordt een aantal op kolen of olie werkende verbrandingsinstallaties vervangen door gasgestookte installaties. Zogenaamde „dual fuel” installaties kunnen overschakeling op andere brandstoffen vergemakkelijken.

      • b. reiniging van brandstof

        Reiniging van aardgas is een geavanceerde technologie en wordt om operationele redenen op grote schaal toegepast.

        Reiniging van procesgas (zuur raffinaderijgas, cokesovengas, biogas, enz.) is eveneens een geavanceerde technologie.

        Ook de ontzwaveling van vloeibare brandstoffen (lichte en middelzware fracties) is een technologisch geavanceerd proces.

        Ontzwaveling van zware fracties is technisch uitvoerbaar; wel moet rekening worden gehouden met de eigenschappen van de betrokken ruwe olie. Ontzwaveling van het atmosferisch residu (bodemprodukten van bij atmosferische druk werkende destillatie-eenheden voor ruwe olie) met het oog op de produkie van stookolie met een laag zwavelgehalte wordt echter niet algemeen toegepast; verwerking van laagzwavelige ruwe olie verdient gewoonlijk de voorkeur. Hydrogenerend kraken en volledige conversie hebben zich tot volwaardige technologieën ontwikkeld; zij combineren een hoge zwavelonttrekking met een verbeterde opbrengst aan lichte produkten. Het aantal raffinaderijen waar volledige conversie plaatsvindt is nog beperkt. Karakteristiek voor dit type raffinaderijen is dat 80 à 90% van de in de ruwe olie aanwezige zwavel wordt teruggewonnen en dat alle residuen omgezet worden in lichte produkten of andere verhandelbare produkten. Het energieverbruik en de investeringskosten zijn bij dergelijke raffinaderijen echter wel hoger. In tabel 1 hierna volgend is het typische zwavelgehalte van raffinageprodukten aangegeven.

        Met de bestaande technologieën voor het zuiveren van steenkool kan anorganische zwavel voor circa 50% (afhankelijk van de eigenschappen van de steenkool), maar organische zwavel in het geheel niet worden verwijderd. Er worden thans doeltreffender technologieën ontwikkeld, maar deze vergen hogere investeringen en kosten. Daardoor is het rendement van ontzwaveling door reiniging van de steenkool lager dan dat van rookgasontzwaveling. Het is mogelijk dat er specifiek voor een land een optimalisatiepotentieel bestaat voor de beste combinatie van brandstofreiniging en rookgasontzwaveling.

      • c. geavanceerde verbrandingstechnologieën

        Verbrandingstechnologieën met verbeterd thermisch rendement en verlaagde zwavelemissies omvatten: wervelbedverbranding (FBC); vastbed (BFBC), circulerend bed (CFBC) en wervelbed onder druk (PFBC); kolenvergassing/stoom- en gasturbine (KV-STEG) (IGCC); gecombineerde stoomcyclus en gasturbines (CCGT).

        Stationaire verbrandingsturbines kunnen worden geïntegreerd in verbrandingssystemen in bestaande conventionele elektriciteitscentrales, waardoor het totale rendement met 5 à 7% kan worden opgevoerd, met onder andere een aanzienlijke verlaging van de SO2-uitstoot tot gevolg. Ingrijpende aanpassingen aan het bestaande ketelsysteem zijn evenwel niet noodzakelijk.

        Wervelbedverbranding is een techniek voor het verbranden van steenkool en bruinkool, maar is ook bruikbaar voor andere vaste brandstoffen zoals petroleumcokes en laagwaardige brandstoffen zoals afval, turf en hout. De emissies kunnen verder worden verlaagd door middel van geïntegreerde verbrandingsregeling in het systeem door toevoeging van kalk/kalksteen aan het bedmateriaal. De totale geïnstalleerde FBC-capaciteit bedraagt thans circa 30 000 MWth (250 à 350 installaties), waarvan 8 000 MWth in de klasse installaties met een capaciteit van meer dan 50 MWth. Het gebruik en/of de verwijdering van de bij dit proces gevormde bijprodukten kan problemen opleveren, en verdere ontwikkeling is vereist.

        Het IGCC-proces omvat kolenvergassing en elektriciteitsopwekking in een gecombineerde cyclus in een gas- en stoomturbine. De vergaste kool wordt verbrand in de verbrandingskamer van de gasturbine. Beheersing van de zwavelemissies wordt gerealiseerd door reiniging van het ruwe gas vóór de gasturbine met gebruikmaking van geavanceerde technologie. Deze technologie bestaat ook voor zware olieresiduen en bitumenemulsies. De geïnstalleerde capaciteit bedraagt thans circa 1 000 MWth (5 installaties).

        Aardgasgestookte elektriciteitscentrales met gecombineerde stoom-/gasturbinecyclus die een energie-efficiëntie van ca. 48 à 52% realiseren zijn thans in het ontwerpstadium.

      • d. wijzigingen in processen en verbranding

        Van wijzigingen in de verbranding die vergelijkbaar zijn met de maatregelen die met het oog op NOx-emissiebeheersing worden toegepast is geen sprake, aangezien tijdens de verbranding vrijwel alle organisch en/of anorganisch gebonden zwavel oxydeert (een bepaald percentage, dat afhankelijk is van de eigenschappen van de brandstof en de toegepaste verbrandingstechnologie, blijft achter in de as).

        In deze bijlage worden de bij conventionele ketels toegepaste processen met behulp van droge additieven beschouwd als proceswijzigingen, aangezien een actieve stof in de verbrandingseenheid wordt gebracht. Uit ervaring is echter gebleken dat bij toepassing van deze processen de thermische capaciteit daalt, de Ca/S-verhouding hoog is en weinig zwavel wordt onttrokken. Ook moet rekening worden gehouden met problemen bij het verdere gebruik van de bijprodukten, zodat deze oplossing doorgaans slechts als een tijdelijke maatregel bruikbaar is, en alleen voor kleinere eenheden (tabel 2).

        • a) Voor brandstof met een hoog zwavelgehalte moet het ontzwavelingsrendement worden aangepast. De mogelijkheden hiertoe kunnen variëren naar gelang van het proces. De beschikbaarheid van deze processen bedraagt gewoonlijk 95%.

        • b) Beperkte toepasbaarheid voor brandstoffen met een hoog zwavelgehalte.

        • c) Emissie in mg/m3 (STP), droog, 6% zuurstof voor vaste brandstoffen, 3% zuurstof voor vloeibare brandstoffen.

        • d) De conversiefactor is afhankelijk van de eigenschappen van de brandstof, het specifieke volume van het rookgas en het thermische rendement van die ketel (gebruikte conversielagen m3/KWh, thermisch rendement: 36%; steenkool: 3,50; bruinkool: 4,20; zware stookolie: 2,80).

        • e) De vermelde specifieke investeringskosten hebben betrekking op een kleine steekproef van installaties.

        • f) De vermelde specifieke investeringskosten omvatten ook voorzieningen voor het verwijderen van stikstofoxiden.

        Deze tabel is hoofdzakelijk opgesteld ten behoeve van grote stookinstallaties in de openbare sector. De beheersingsmethoden zijn echter ook geldig voor andere sectoren met vergelijkbare rookgassen.

      • e. processen voor rookgasontwikkeling (FGD)

        Met deze processen wordt beoogd reeds gevormde zwaveloxiden te verwijderen; zij worden ook als secundaire maatregelen aangeduid. De geavanceerde technologieën voor rookgasbehandeling zijn alle gebaseerd op de verwijdering van zwavel door middel van natte, droge of semi-droge en katalytische chemische processen.

        Om een zo efficiënt mogelijk programma voor vermindering van de zwavelemissies te ontwikkelen naast de onder (i) vermelde maatregelen voor energiebeheer moet een combinatie van onder (ii) aangegeven technologische maatregelen worden overwogen.

        In sommige gevallen kunnen methodes voor vermindering van de zwavelemissies ook leiden tot een vermindering van de emissies van C02, NOx en andere verontreinigende stoffen.

        De in elektriciteitscentrales, warmte/kracht- en stadsverwarmingsinstallaties toegepaste processen voor rookgasbehandeling omvatten: natte reiniging met kalk/kalksteen (LWS), het sproeidroogproces (SDA), het Wellman Lord-proces (WL), reiniging met ammoniak (AS) en processen voor de gecombineerde verwijdering van NOx/SOx (gebruik van geactiveerde kool (AC) en gecombineerde katalytische verwijdering van NOx/SOx).

        In de sector elektriciteitsopwekking bestaat de geïnstalleerde FGD-capaciteit voor 85% resp. 10% uit LWS- en SDA-voorzieningen.

        Verschillende nieuwe rookgasontzwavelingsprocessen, zoals droge reiniging met een elektronenbundel (EBDS) en Mark 13A, bevinden zich nog in het proefstadium.

        In tabel 2 wordt het rendement van bovenvermelde secundaire maatregelen aangegeven op basis van de met een groot aantal installaties opgedane ervaring. De geïnstalleerde capaciteit en het capaciteitsbereik worden eveneens vermeld. Door lokale of met de betrokken installatie samenhangende factoren kan het voorkomen dat van verschillende technologieën voor vermindering van de zwaveluitstoot met vergelijkbare kenmerken een bepaalde technologie in een gegeven geval niet bruikbaar is.

        Tabel 2 vermeldt tevens de marge waarbinnen de investeringskosten voor de onder (ii), c), d) en e), genoemde technologieën zich gewoonlijk bewegen. Bij de toepassing van deze technologieën in individuele gevallen dient er evenwel rekening mee te worden gehouden, dat de met maatregelen voor emissievermindering samenhangende investeringskosten onder andere worden bepaald door de specifieke technologieën die worden toegepast, de benodigde beheersingssystemen, de omvang van de installatie, de mate waarin de zwaveluitstoot moet worden verminderd en het tijdschema voor de geplande onderhoudscycli. De tabel geeft dus alleen een algemene indicatie van de investeringskosten. De investeringskosten voor de aanpassing van bestaande installaties overtreffen doorgaans die voor nieuwe installaties.

IV. BEHEERSINGSTECHNIEKEN VOOR ANDERE SECTOREN

  • 10 De in punt 9. (ii), a) t/m e), vermelde beheersingstechnieken zijn niet alleen geschikt voor de sector elektriciteitsopwekking, maar ook voor diverse andere sectoren van de industrie. Er is reeds gedurende verschillende jaren praktijkervaring mee opgedaan, in de meeste gevallen in elektriciteitscentrales.

  • 11 De keuze van technologieën ter vermindering van zwavelemissies in de industrie wordt uitsluitend bepaald door de specifieke beperkingen van de in de betrokken sectoren toegepaste processen. In tabel 3 hieronder wordt een overzicht gegeven van een aantal belangrijke bronnen van zwavelemissies en de ter bestrijding daarvan genomen maatregelen.

  • 12 In de in tabel 3 vermelde sectoren kan gebruik worden gemaakt van in het proces geïntegreerde maatregelen, inclusief verandering van grondstof (indien nodig gecombineerd met een specifiek op de betrokken sector afgestemde rookgasbehandeling), om de zwavelemissies zo doeltreffend mogelijk terug te dringen.

  • 13 Uit de praktijk kunnen de volgende voorbeelden worden gegeven:

    • a. In nieuwe kraftpulpfabrieken is een emissie van minder dan 1 kg zwavel per ton aan de lucht gedroogde (AD - air dried) pulp haalbaar;4

    • b. In sulfietpulpfabrieken kan een emissie van 1 tot 1,5 kg zwavel per ton pulp AD worden gerealiseerd;

    • c. Bij het roosten van sulfiden zijn verwijderingsrendementen van 80 à 99% gemeld voor installaties met een capaciteit van 10 000 tot 200 000 m3/uur (afhankelijk van het procédé);

    • d. Bij één bepaalde installatie voor het sinteren van ijzererts wordt met een FGD-installatie met een capaciteit van 320 000 m3/uur voor het gezuiverde gas een waarde van minder dan 100 mg SOx/Nm3 bij 6% O2 gehaald;

    • e. In cokesovens wordt een waarde van minder dan 400 mg SOx/Nm3 bij 6% O2 gerealiseerd;

    • f. Installaties voor de produktie van zwavelzuur halen een conversiewaarde van meer dan 99%;

    • g. Bij geavanceerde Clausinstallaties wordt een ontzwavelingsrendement van meer dan 99% gehaald.

V. BIJPRODUKTEN EN NEVENEFFECTEN

  • 14 Naarmate in de landen binnen het ECE-gebied de inspanningen worden opgevoerd om de zwavelemissies uit stationaire bronnen te verminderen, zullen ook de hoeveelheden bijprodukten toenemen.

  • 15 Er moet worden gekozen voor methodes waarbij bruikbare bijprodukten ontstaan, en zoveel mogelijk voor methodes die een verhoogd thermisch rendement opleveren en waardoor het afvalverwijderingsprobleem tot een minimum wordt teruggebracht. Hoewel de meeste bijprodukten bruikbare of recycleerbare produkten zijn zoals gips, ammoniumzouten, zwavelzuur en zwavel, dient rekening te worden gehouden met factoren zoals marktomstandigheden en kwaliteitsnormen. Het gebruik van FBC- en SDA-bijprodukten moet worden verbeterd en tevens moet onderzoek worden gedaan naar verdere gebruiksmogelijkheden, aangezien in verschillende landen de beschikbaarheid van stortplaatsen en de geldende verwijderingscriteria een beperkende factor vormen voor de verwijdering van deze produkten.

  • 16 De volgende neveneffecten vormen weliswaar geen beletsel voor de toepassing van een bepaalde technologie of methode, maar moeten wel degelijk in de overweging worden betrokken wanneer uit verschillende mogelijkheden voor vermindering van de zwavelemissies kan worden gekozen:

    • a. Het energiebeslag van de gasbehandelingsprocessen;

    • b. Corrosie door de vorming van zwavelzuur als gevolg van de reactie van zwaveloxiden met waterdamp;

    • c. Hoger waterverbruik en de noodzaak meer afvalwater te behandelen;

    • d. De eisen inzake reagentia;

    • e. Verwijdering van vast afval.

VI. MONITORING EN RAPPORTAGE

  • 17 De maatregelen die worden genomen ter uitvoering van nationale strategieën en beleidsplannen voor vermindering van de luchtverontreiniging omvatten: wet- en regelgeving, positieve en negatieve economische prikkels, alsook technologische eisen (beste beschikbare technologie).

  • 18 In het algemeen worden per emissiebron normen vastgesteld, afhankelijk van de omvang van de installatie, de wijze waarop deze functioneert, de verbrandingstechnologie, het brandstoftype en het feit of het een nieuwe, dan wel een bestaande installatie betreft. Een alternatieve methode bestaat erin een doelstelling voor vermindering van de totale zwavelemissies van een groep bronnen aan te geven en de keuze van de daartoe te nemen maatregelen vrij te laten („bubble concept”).

  • 19 Om toezicht te houden op de inspanningen die worden gedaan om de zwavelemissies tot de in het kader van nationale wetgeving vastgelegde niveaus te beperken, moet een systeem voor permanente monitoring en rapportage aan de toezichthoudende instanties worden opgezet.

  • 20 Verschillende bewakingssystemen, waarbij zowel continue als incidentele metingen worden uitgevoerd, zijn beschikbaar. De kwaliteitseisen lopen echter uiteen. De metingen moeten worden uitgevoerd door gekwalificeerde instellingen met gebruikmaking van welomschreven meet- en monitoringsystemen. Hiertoe kan een stelsel van certificering de beste garantie bieden.

  • 21 Bij moderne geautomatiseerde monitoringsystemen en procesbeheersingsapparatuur levert rapportage geen problemen op. Het verzamelen van gegevens heeft zich tot een geavanceerde techniek ontwikkeld; de aan de bevoegde instanties te melden gegevens verschillen echter per geval. Voor een betere vergelijkbaarheid moeten de gegevensreeksen en de desbetreffende regelgeving worden geharmoniseerd. Harmonisatie is ook wenselijk voor de kwaliteitsverzekering van meet- en monitoringsystemen. Bij het vergelijken van gegevens dient hiermee rekening te worden gehouden.

  • 22 Om discrepanties en tegenstrijdigheden te voorkomen moet een aantal kernelementen en parameters, waaronder de volgende, duidelijk worden omschreven:

    • a. Normwaarden uitgedrukt in ppmv, mg/Nm3, g/GJ, kg/uur of kg/ton produkt. De meeste van deze eenheden moeten worden berekend en worden gespecificeerd voor een bepaalde gastemperatuur, vochtigheidsgraad, druk, zuurstofgehalte of thermische belasting;

    • b. De periode waarover de normen dienen te worden gemiddeld, uitgedrukt in uren, maanden of jaren;

    • c. Storingsperioden en de bij storing geldende noodmaatregelen met betrekking tot het overbruggen van de monitoringsystemen of het stilleggen van de installatie;

    • d. Methodes voor het achteraf bepalen van door een defect aan de apparatuur gemiste of verloren gegane gegevens;

    • e. De te meten reeks parameters. De informatie die vereist is kan variëren afhankelijk van de aard van het industriële proces. Ook de locatie van het meetpunt binnen het systeem moet worden bepaald.

  • 23 Er moet voor kwaliteitszorg van de metingen worden gezorgd.

    Wanneer een Partij, wegens het hoge zwavelgehalte van de inheemse vaste vloeibare brandstoffen, niet kan voldoen aan de in kolom (ii) vermelde emissiegrenswaarden, dan kan zij de in kolom (iii) aangegeven ontzwavelingspercentages of een grenswaarde van maximaal 800 mg S02/Nm3 (zij het bij voorkeur niet hoger dan 650 mg SO2/Nm3) aanhouden. De Partij meldt deze afwijkingen bij het Implementatiecomité in het kalenderjaar waarin zij worden toegepast.

    Wanneer twee of meer afzonderlijke nieuwe installaties op zodanige wijze worden gebouwd dat, rekening houdend met technische en economische factoren, de afgassen daarvan naar het oordeel van de bevoegde instantie via een gemeenschappelijke schoorsteen zouden kunnen worden afgevoerd, dan wordt de door die installaties gevormde combinatie beschouwd als een enkele eenheid.

  • b) Met mg SO2/Nm3 wordt bedoeld de bij een temperatuur van 273° K en een druk van 101,3 kPa gemeten waarde, gecorrigeerd voor het gehalte aan waterdamp.
