The Royal Netherlands Embassy presents its compliments to the Ministry of External Affairs of the Republic of Malawi and has the honour to refer to the Extradition Treaty between the Kingdom of the Netherlands and the United Kingdom of Great Britain and Ireland, signed in London on 26 September 1898, which Treaty was extended, inter alia, to the then territory of Nyasaland by virtue of a Treaty signed at The Hague on 17 August 1914 i.e. before the attainment of independence by Malawi.

The Embassy has been instructed by the Government of the Kingdom of the Netherlands to propose to the Government of the Republic of Malawi that the relations between the two States shall, in conformity with the legislation of both countries, be governed by the provisions of the said Treaty of 26 September 1898, pending the conclusion of a new extradition treaty between them.

If this proposal is acceptable to the Government of the Republic of Malawi, the Embassy has the honour further to propose that this Note and the Ministry's reply, if it is in the affirmative, shall constitute an agreement between the two Governments on this subject, which agreement shall apply, as regards the Kingdom of the Netherlands, to the territory of the Kingdom in Europe and to Surinam, and shall enter into force on the date on which the Government of the Kingdom of the Netherlands notifies the Government of the Republic of Malawi that the formalities constitutionally required in the Kingdom of the Netherlands have been complied with.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Ministry of External Affairs of the Republic of Malawi the assurance of its highest consideration.

Nr. 214

The Ministry of External Affairs of the Republic of Malawi presents its compliments to the Royal Netherlands Embassy in Lusaka and has the honour to refer to the Embassy's Note No. 1940 of the 21st November, 1967 concerning the Extradition Treaty between the Kingdom of the Netherlands and the United Kingdom of Great Britain and Ireland, done at London, 1898, which Treaty was extended, inter alia, to the then territory of Nyasaland by virtue of a Treaty signed at The Hague on 17th August, 1914.

In response to the Embassy's proposal that relations between the two States shall, in conformity with the legislation of both countries, be governed by the provisions of the said Treaty of 26th September, 1898, the Ministry is pleased, on behalf of the Government of Malawi, to accept the Embassy's proposal.

The Ministry accordingly wishes to state that the Government of Malawi agrees that relations between the two Governments with respect to matters of extradition shall, in conformity with the legislation of both countries, be governed by the provisions of the aforementioned Treaty of 26th September, 1898, until a new extradition treaty is concluded between the Governments of the Netherlands and Malawi. The Ministry further agrees that the Embassy's aforementioned Note No. 1940 and the Ministry's present Note constitute an Agreement between the two Governments on this matter, which Agreement applies as regards the Kingdom of the Netherlands to the territory of the Kingdom in Europe and to Surinam, and which shall enter into force on the date that the Government of the Netherlands notifies the Government of Malawi that all constitutional formalities in the Kingdom of the Netherlands have been completed.

The Ministry of External Affairs of the Republic of Malawi avails itself of this opportunity to renew to the Royal Netherlands Embassy in Lusaka the assurance of its highest consideration.

AMBASSADE VAN HET KONINKRIJK

DER NEDERLANDEN

Nr. 1940

De Koninklijke Nederlandse Ambassade biedt het Ministerie van Buitenlandse Zaken van de Republiek Malawi haar complimenten aan en heeft de eer te verwijzen naar het Uitleveringsverdrag tussen het Koninkrijk der Nederlanden en het Verenigd Koninkrijk van Groot-Brittannië en Ierland, ondertekend te Londen op 26 september 1898, welk Verdrag ingevolge een op 17 augustus 1914, d.w.z. voordat Malawi onafhankelijk was geworden, in Den Haag ondertekend Verdrag onder meer tot het toenmalige gebied Nyasaland is uitgebreid.

De Regering van het Koninkrijk der Nederlanden heeft de Ambassade opgedragen aan de Regering van de Republiek Malawi voor te stellen dat, in afwachting van een tussen hen te sluiten nieuw uitleveringsverdrag, de betrekkingen tussen de twee Staten, in overeenstemming met de wetgeving van de beide landen, door de bepalingen van voormeld Verdrag van 26 september 1898 zullen worden beheerst.

Indien dit voorstel voor de Regering van de Republiek Malawi aanvaardbaar is, heeft de Ambassade de eer verder voor te stellen dat deze nota en het antwoord van het Ministerie, indien dit bevestigend luidt, een Overeenkomst ter zake tussen de beide Regeringen vormen, welke Overeenkomst, wat het Koninkrijk der Nederlanden betreft, van toepassing zal zijn op het in Europa gelegen grondgebied van het Koninkrijk en Suriname, en die in werking zal treden op de datum waarop de Regering van het Koninkrijk der Nederlanden de Regering van de Republiek Malawi ervan in kennis stelt dat aan de in het Koninkrijk der Nederlanden constitutioneel vereiste formaliteiten is voldaan.

De Koninklijke Nederlandse Ambassade maakt van deze gelegenheid gebruik om de verzekering van haar zeer bijzondere hoogachting jegens het Ministerie van Buitenlandse Zaken van de Republiek Malawi te hernieuwen.

VAN DE REPUBLIEK MALAWI

Nr. 214

Het Ministerie van Buitenlandse Zaken van de Republiek Malawi biedt de Koninklijke Nederlandse Ambassade in Lusaka zijn complimenten aan en heeft de eer te verwijzen naar de nota van de Ambassade van 21 november 1967, nr. 1940, betreffende het Uitleveringsverdrag tussen het Koninkrijk der Nederlanden en het Verenigd Koninkrijk van Groot-Brittannië en Ierland, gedaan te Londen, 1898, welk Verdrag ingevolge een op 17 augustus 1914 in Den Haag ondertekend Verdrag onder meer tot het toenmalige gebied Nyasaland is uitgebreid.

Naar aanleiding van het voorstel van de Ambassade dat de betrekkingen tussen de twee Staten, in overeenstemming met de wetgeving van de beide landen, door de bepalingen van voormeld Verdrag van 26 september 1898 zullen worden beheerst, heeft het Ministerie het genoegen de Ambassade mede te delen dat het dit voorstel van de Ambassade namens de Regering van Malawi aanvaardt.

Dientengevolge stelt het Ministerie er prijs op te verklaren dat de Regering van Malawi ermede instemt dat de betrekkingen tussen de twee Regeringen ten aanzien van uitleveringskwesties in overeenstemming met de wetgeving van de beide landen zullen worden beheerst door de bepalingen van voormeld Verdrag van 26 september 1898, totdat een nieuw uitleveringsverdrag tussen de Regering van Nederland en de Regering van Malawi zal zijn gesloten. Het Ministerie stemt er tevens mede in dat voornoemde nota nr. 1940 van de Ambassade en deze nota van het Ministerie een Overeenkomst ter zake tussen de beide Regeringen vormen, welke Overeenkomst, wat het Koninkrijk der Nederlanden betreft, van toepassing zal zijn op het in Europa gelegen grondgebied van het Koninkrijk en Suriname, en die in werking zal treden op de datum waarop de Regering van Nederland de Regering van Malawi ervan in kennis stelt dat aan alle in het Koninkrijk der Nederlanden constitutioneel vereiste formaliteiten is voldaan.

Het Ministerie van Buitenlandse Zaken van de Republiek Malawi maakt van deze gelegenheid gebruik om de verzekering van zijn zeer bijzondere hoogachting jegens de Koninklijke Nederlandse Ambassade in Lusaka te hernieuwen.
