Verdrag tussen het Koninkrijk der Nederlanden en de Organisatie voor het Verbod van Chemische Wapens (OVCW) betreffende de zetel van de OVCW

de Organisatie voor het Verbod van Chemische Wapens

Overwegende dat het Verdrag tot verbod van de ontwikkeling, de productie, de aanleg van voorraden en het gebruik van chemische wapens en inzake de vernietiging van deze wapens ter oprichting van de Organisatie voor het Verbod van Chemische Wapens in werking is getreden op 29 april 1997,

Overwegende dat krachtens artikel VIII, derde lid, van het Verdrag de zetel van de Organisatie voor het Verbod van Chemische Wapens zal worden gevestigd te 's-Gravenhage, het Koninkrijk der Nederlanden,

Gelet op de bepalingen van het Verdrag betreffende de rechtspositie, voorrechten en immuniteiten van de Organisatie voor het Verbod van Chemische Wapens en haar organen, alsmede de voorrechten en immuniteiten van de Delegatieleiders, plaatsvervangers en adviseurs verbonden aan de Delegatieleiders, Permanente Vertegenwoordigers, leden van de Permanente Vertegenwoordigingen, afgevaardigden van de Staten die Partij zijn, en de Directeur-Generaal en de personeelsleden van de Organisatie voor het Verbod van Chemische Wapens,

Mede gelet op de bepalingen in de Bijlagen 2 en 3 van de Resolutie inzake de oprichting van de Voorbereidende Commissie voor de Organisatie voor het Verbod van Chemische Wapens,

Overwegende dat voor de vestiging van de zetel van de Organisatie voor het Verbod van Chemische Wapens op het grondgebied van het Koninkrijk der Nederlanden ('s-Gravenhage) een verdrag dient te worden gesloten;

Zijn het volgende overeengekomen:

Artikel 1. Begripsomschrijvingen

In dit Verdrag wordt verstaan onder:

  • a. „het Verdrag”: het Verdrag tot verbod van de ontwikkeling, de productie, de aanleg van voorraden en het gebruik van chemische wapens en inzake de vernietiging van deze wapens van 13 januari 1993;

  • b. „OVCW”: de Organisatie voor het Verbod van Chemische Wapens;

  • c. „Regering”: de Regering van het Koninkrijk der Nederlanden;

  • d. „Desbetreffende autoriteiten van het Koninkrijk der Nederlanden”: de nationale, lokale of andere overheden van het Koninkrijk der Nederlanden die bevoegd zijn in verband en in overeenstemming met de in het Koninkrijk der Nederlanden geldende wetten en gebruiken;

  • e. „Partijen”: de OVCW en het Koninkrijk der Nederlanden;

  • f. „Zetel”: het terrein en alle gebouwen, met inbegrip van alle laboratoria, magazijnen, vergadervoorzieningen, gedeelten van gebouwen, daarbij behorende grond en voorzieningen van de OVCW, ongeacht eigendom, permanent of af en toe bij de OVCW in gebruik voor de uitoefening van haar officiële taken;

  • g. „Directeur-Generaal”: de Directeur-Generaal bedoeld in artikel VIII, eenenveertigste lid, van het Verdrag;

  • h. „Staat die Partij is”: een Staat die Partij is bij het Verdrag;

  • i. „Delegatieleider”: het bij de Vergadering van de Staten die Partij zijn, en/of de Uitvoerende Raad geaccrediteerde hoofd van de delegatie van een Staat die Partij is;

  • j. „Plaatsvervangers en adviseurs van de Delegatieleiders”: plaatsvervangers voor en adviseurs verbonden aan de Delegatieleiders;

  • k. „Permanente Vertegenwoordiger”: de belangrijkste door een Staat die Partij is, bij de OVCW geaccrediteerde vertegenwoordiger;

  • l. „Leden van de Permanente Vertegenwoordiging van een Staat die Partij is”: alle leden van de Permanente Vertegenwoordiging bij de OVCW;

  • m. „Afgevaardigden van de Staten die Partij zijn”: de door Staten die Partij zijn, aangewezen vertegenwoordigers en leden van hun delegaties bij alle vergaderingen van de OVCW niet zijnde de Vergadering van Staten die Partij zijn, of de Uitvoerende Raad;

  • n. „Deskundigen”: personen die opdrachten van de OVCW uitvoeren, in dienst zijn van organen van de OVCW of op enigerlei andere wijze op haar verzoek een adviserende functie voor de OVCW vervullen, met dien verstande dat zij geen functionarissen van de OVCW zijn of verbonden zijn aan de Permanente Vertegenwoordigers;

  • o. „Functionarissen van de OVCW”: de Directeur-Generaal en alle personeelsleden van het Technisch Secretariaat van de OVCW, behalve die welke plaatselijk zijn aangeworven en op basis van een uurtarief worden uitbetaald;

  • p. „Inspecteurs op dienstreis”: leden van een inspectieteam als bedoeld in het Verdrag (paragraaf 17 van Afdeling I van de Verificatiebijlage) die in het bezit zijn van een door de Directeur-Generaal uitgegeven inspectiemandaat om een inspectie uit te voeren in overeenstemming met het Verdrag;

  • q. „Door de OVCW bijeengeroepen vergaderingen”: alle vergaderingen van een van de organen of ondersteunende organen van de OVCW of internationale conferenties of andere door de OVCW bijeengeroepen of onder haar auspiciën gehouden bijeenkomsten;

  • r. „Eigendom”: alle eigendommen, bezittingen en fondsen, behorend tot de OVCW of gehouden of beheerd door de OVCW in het kader van haar functies krachtens het Verdrag, alsmede alle inkomsten van de OVCW;

  • s. „Monsters”: monsters zoals omschreven in het Verdrag;

  • t. „Archieven van de OVCW”: alle dossiers, correspondentie, documenten, manuscripten, computer- en mediagegevens, foto's, films en video- en geluidsopnamen die de OVCW of haar personeel in het kader van een officiële functie bezit of onder zich heeft, en al het overige materiaal waarover de Directeur-Generaal en de Regering eventueel overeenkomen dat het deel uitmaakt van de archieven van de OVCW;

  • u. „Het Verdrag van Wenen”: het Verdrag van Wenen inzake Diplomatiek Verkeer van 18 april 1961.

Artikel 2. Rechtspersoonlijkheid

De OVCW bezit volledige rechtspersoonlijkheid. Zij heeft met name de bevoegdheid:

  • a. overeenkomsten te sluiten;

  • b. roerende en onroerende zaken te verwerven en te vervreemden;

  • c. juridische procedures in te stellen en in rechte op te treden.

Artikel 3. Vrijheid van vergadering

  • 1 De Regering erkent het recht van de OVCW naar eigen goeddunken vergaderingen te beleggen in haar zetel te 's-Gravenhage of, met instemming van de Regering of de door haar aangewezen bevoegde autoriteiten van het Koninkrijk der Nederlanden, elders in het Koninkrijk der Nederlanden.

  • 2 De Regering garandeert de OVCW volledige vrijheid van vergadering, van discussie en van besluitvorming. De Regering stelt alles in het werk om te waarborgen dat de voortgang van door de OVCW bijeengeroepen vergaderingen op geen enkele wijze wordt belemmerd.

Artikel 4. Immuniteit van rechtsvervolging

  • 1 Binnen de reikwijdte van haar officiële activiteiten geniet de OVCW immuniteit van alle vormen van rechtsvervolging, behalve in geval van:

    • a. civiele actie van een derde partij wegens schade die het gevolg is van een ongeval veroorzaakt door een voertuig dat eigendom is van of dat werd bestuurd namens de OVCW, indien de schade niet verhaalbaar is op een verzekering;

    • b. civiele actie die verband houdt met een overlijdensgeval of persoonlijk letsel veroorzaakt door een handeling of nalatigheid van de OVCW of haar functionarissen in het Koninkrijk der Nederlanden.

  • 2 Onverminderd de bepalingen van het eerste lid van dit artikel zijn eigendommen en bezittingen, waar deze ook gelegen zijn en wie deze ook onder zich heeft, vrijgesteld van onderzoek, vordering, executie, inbeslagneming, alle vormen van beslaglegging, gerechtelijke bevelen of andere vormen van rechtsvervolging, behalve voorzover de OVCW uitdrukkelijk van haar immuniteit afstand heeft gedaan. Zulks echter met dien verstande dat afstand van immuniteit zich nooit zal uitstrekken tot executiemaatregelen.

Artikel 5. Vrijstelling van bezittingen van andere maatregelen, onschendbaarheid van de archieven, monsters, apparatuur en ander materiaal

  • 1 De eigendommen en bezittingen van de OVCW, waar deze ook gelegen zijn en wie deze ook onder zich heeft, zijn vrijgesteld van onderzoek, vordering, confiscatie, onteigening of iedere andere vorm van ingrijpen, ongeacht of het optreden van uitvoerende, administratieve, rechterlijke of wetgevende aard betreft.

  • 2 De archieven en monsters van de OVCW, waar deze ook gelegen zijn en wie deze ook onder zich heeft, zijn te allen tijde onschendbaar.

  • 3 De apparatuur en het overige voor de activiteiten van de OVCW benodigde materiaal zijn te allen tijde onschendbaar.

Artikel 6. De zetel

De desbetreffende autoriteiten van het Koninkrijk der Nederlanden stellen al het nodige in het werk om te voorkomen dat de OVCW het bezit van de zetel of een gedeelte daarvan verliest.

Artikel 7. Recht en gezag in de zetel

  • 1 De Regering erkent de te allen tijde geldende onschendbaarheid van de zetel, dat onder het beheer en het gezag van de OVCW staat zoals bepaald in dit Verdrag.

  • 2 De OVCW is bevoegd tot het uitvaardigen van binnen de zetel geldende regelingen met het oog op het aldaar scheppen van de noodzakelijke voorwaarden voor de onbelemmerde uitoefening van haar taken. Binnen de zetel zijn geen wetten van het Koninkrijk der Nederlanden van toepassing voorzover zij onverenigbaar zijn met een op grond van dit artikel mogelijk gemaakte regeling van de OVCW. Elk geschil tussen de OVCW en het Koninkrijk der Nederlanden over de toelaatbaarheid volgens dit artikel van een regeling van de OVCW of de onverenigbaarheid van een wet van het Koninkrijk der Nederlanden met een regeling van de OVCW, wordt onmiddellijk beslecht volgens de procedure van artikel 26, tweede lid, van dit Verdrag. In afwachting van een dergelijke beslechting is de regeling van de OVCW van toepassing en is de wet van het Koninkrijk der Nederlanden in de zetel van de OVCW niet van toepassing voorzover de OVCW stelt dat deze in strijd is met de regeling van de OVCW.

  • 3 De OVCW brengt regelingen die vallen onder het tweede lid van dit artikel ter kennis van de Regering.

  • 4 Een persoon die op grond van een wettelijke bepaling de bevoegdheid heeft een plaats te betreden oefent deze bevoegdheid niet uit ten aanzien van de zetel, tenzij daartoe tevoren uitdrukkelijk toestemming is verleend door of namens de Directeur-Generaal. Een persoon die de zetel betreedt met toestemming van de Directeur-Generaal dient de zetel onmiddellijk te verlaten wanneer hij daartoe door of namens de Directeur-Generaal wordt verzocht.

  • 5 Dit artikel zal de redelijke toepassing van de regelingen met betrekking tot brandbestrijding van de desbetreffende autoriteiten van het Koninkrijk der Nederlanden niet beletten. De toestemming van de Directeur-Generaal voor betreding van de zetel wordt voorondersteld wanneer hij of zijn ter zake bevoegde vertegenwoordiger niet op tijd kan worden bereikt.

  • 6 Uitoefening van rechtsvervolging vindt binnen de zetel alleen plaats met voorafgaande toestemming van en onder voorwaarden goedgekeurd door de Directeur-Generaal.

  • 7 De Directeur-Generaal voorkomt dat de zetel wordt gebruikt om personen in bescherming te nemen die arrestatie op grond van een wettelijke bepaling van het Koninkrijk der Nederlanden ontlopen, door de Regering worden gezocht voor uitlevering aan een ander land, of die pogen te ontsnappen aan de uitoefening van rechtsvervolging.

Artikel 8. Bescherming van de zetel

  • 1 De desbetreffende autoriteiten van het Koninkrijk der Nederlanden betrachten de nodige zorgvuldigheid om ervoor te zorgen dat de veiligheid en de rust van de zetel niet wordt verstoord door onbevoegde personen of groepen personen die de onmiddellijke omgeving van de zetel trachten te betreden, of hierin ordeverstoringen veroorzaken. Wanneer nodig bieden de desbetreffende autoriteiten voldoende politiebescherming aan de grenzen en in de omgeving van de zetel.

  • 2 Indien de Directeur-Generaal daarom verzoekt, stellen de desbetreffende autoriteiten van het Koninkrijk der Nederlanden voldoende politie ter beschikking voor de handhaving van de openbare orde in en om de zetel.

  • 3 De desbetreffende autoriteiten van het Koninkrijk der Nederlanden treffen alle redelijke maatregelen om erop toe te zien dat het ongestoord gebruik van de zetel niet nadelig wordt beïnvloed en dat de zetel kan worden gebruikt voor de doeleinden waarvoor het is bestemd zonder hinder door de wijze van gebruik van de terreinen of gebouwen in de omgeving van de zetel. De OVCW treft alle redelijke maatregelen om erop toe te zien dat het ongestoord gebruik van de terreinen in de omgeving van de zetel niet nadelig wordt beïnvloed door de wijze van gebruik van de terreinen of gebouwen van de zetel.

Artikel 9. Openbare voorzieningen ten behoeve van de zetel

  • 1 De desbetreffende autoriteiten van het Koninkrijk der Nederlanden wenden binnen hun bevoegdheden en voorzover de Directeur-Generaal daarom verzoekt, hun invloed aan om te waarborgen dat de zetel tegen gunstige en redelijke voorwaarden de beschikking krijgt over de nodige openbare voorzieningen, waaronder elektriciteit, water, riolering, gas, post, telefoon, telegraaf, alle nodige communicatiemiddelen, plaatselijk vervoer, afvoer, ophalen van vuilnis, brandbestrijding, en verwijdering van sneeuw van de openbare weg.

  • 2 In geval van onderbreking of dreiging van onderbreking van dergelijke openbare voorzieningen zal aan de OVCW de voorrang worden gegeven die ook aan instellingen en organen van wezenlijk belang van de Regering wordt gegeven, en de Regering treft de daartoe benodigde maatregelen om te waarborgen dat de werkzaamheden van de OVCW niet nadelig worden beïnvloed.

  • 3 De Directeur-Generaal treft, op verzoek, passende maatregelen om bevoegde vertegenwoordigers van de desbetreffende nutsbedrijven in staat te stellen om binnen de zetel openbare voorzieningen, leidingen, buizen en rioleringen te inspecteren, repareren, onderhouden, reconstrueren of verplaatsen zonder de uitoefening van de taken van de OVCW in onredelijke mate te verstoren. Ondergrondse werkzaamheden in de zetel kunnen alleen worden uitgevoerd na overleg met de Directeur-Generaal of een door hem aangewezen functionaris, en zonder de uitoefening van de taken van de OVCW te verstoren.

  • 4 Wanneer de openbare voorzieningen bedoeld in het eerste lid van dit artikel worden geleverd of de prijzen daarvan worden bepaald door de desbetreffende autoriteiten van het Koninkrijk der Nederlanden, worden aan de OVCW tarieven in rekening gebracht die niet hoger zijn dan de laagste tarieven voor instellingen en organen van wezenlijk belang van de Regering.

Artikel 10. Faciliteiten en immuniteiten met betrekking tot communicatie en publicaties

  • 1 De Regering staat het de OVCW toe vrijelijk en zonder vereiste bijzondere toestemming te communiceren voor alle officiële doeleinden, en beschermt haar recht hiertoe. De OVCW heeft het recht codes te gebruiken en officiële correspondentie en andere officiële berichten te verzenden en te ontvangen per koerier of in verzegelde tassen, ten aanzien waarvan dezelfde voorrechten en immuniteiten gelden als voor diplomatieke koeriers en tassen.

  • 2 De OVCW geniet, voor zover verenigbaar met het Internationaal Verdrag betreffende de Telecommunicatie van 6 november 1982, wat haar officiële communicatie betreft een niet minder gunstige behandeling dan die welke door de Regering wordt toegekend aan andere organisaties of regeringen, met inbegrip van diplomatieke zendingen van die andere regeringen ter zake van prioriteiten en tarieven voor poststukken, kabeltelegrammen, telegrammen, telexberichten, radiogrammen, televisie, telefoon, telefax en andere vormen van communicatie, alsmede perstarieven voor mededelingen aan de pers en de radio.

  • 3 De Regering erkent het recht van de OVCW om binnen het Koninkrijk der Nederlanden vrijelijk berichten te publiceren en uit te zenden voor de doeleinden die zijn omschreven in het Verdrag. Alle aan de OVCW gerichte en door de OVCW verzonden officiële berichten, ongeacht de wijze van verzending, zijn onschendbaar. Deze onschendbaarheid heeft onder andere betrekking op publicaties, stilstaande en bewegende beelden, video's, films, geluidsopnamen en computerprogrammatuur. Deze opsomming is niet limitatief.

  • 4 De OVCW mag een radiozender installeren en gebruiken met toestemming van de Regering; nadat de golflengte is overeengekomen, wordt deze toestemming niet op onredelijke gronden geweigerd.

  • 5 Niets in het derde en vierde lid van dit artikel wordt zodanig uitgelegd als zou de OVCW worden vrijgesteld van de naleving van de wetten van het Koninkrijk der Nederlanden alsmede alle verdragen waarbij het Koninkrijk der Nederlanden partij is met betrekking tot auteursrechten.

Artikel 11. Vrijstelling van de OVCW en haar eigendommen van belastingen en heffingen

  • 1 Binnen het kader van haar officiële taken worden de OVCW, haar bezittingen, inkomsten en andere eigendommen vrijgesteld van alle directe en indirecte belastingen die door de nationale, provinciale of plaatselijke overheid of andere overheden worden geheven.

  • 2 Binnen het kader van haar officiële taken wordt de OVCW in het bijzonder vrijgesteld van:

    • a. motorrijtuigenbelasting;

    • b. belasting op personenvoertuigen en motorfietsen (BPM);

    • c. omzetbelasting (BTW) betaald over alle zaken en diensten die herhaaldelijk worden geleverd of verleend of aanzienlijke uitgaven met zich meebrengen;

    • d. accijnzen als inbegrepen in de prijs van alcoholhoudende dranken en koolwaterstoffen;

    • e. belastingen bij invoer en uitvoer alsmede heffingen;

    • f. assurantiebelasting;

    • g. overdrachtsbelasting voor onroerende zaken;

    • h. andere belastingen en heffingen van een in hoofdzaak vergelijkbare aard als de in dit lid genoemde belastingen en heffingen die na de datum van ondertekening van dit Verdrag door Nederland worden ingesteld.

  • 3 De in het tweede lid, letters c, d, f en g van dit artikel genoemde vrijstellingen kunnen worden toegekend in de vorm van een teruggave onder nader door de OVCW en de Regering overeen te komen voorwaarden.

  • 4 Goederen verworven of ingevoerd op de in het tweede lid van dit artikel omschreven voorwaarden worden niet verkocht, weggegeven of op andere wijze vervreemd, behalve overeenkomstig de met de Regering overeengekomen voorwaarden.

  • 5 De OVCW kan voor de verkoop van beperkte hoeveelheden van bepaalde voor persoonlijk gebruik of verbruik en niet voor schenking of verkoop bestemde artikelen een belastingvrije winkel instellen onder nader door Partijen overeen te komen voorwaarden. Van deze belastingvrije winkel kan gebruik worden gemaakt door functionarissen van de OVCW, behalve door functionarissen die Nederlands staatsburger zijn of permanent ingezetene zijn in het Koninkrijk der Nederlanden. Het gebruik van deze faciliteit kan eveneens toegestaan worden voor delegatieleiders, permanente vertegenwoordigers, plaatsvervangers en adviseurs van delegatieleiders, leden van de permanente vertegenwoordigingen en afgevaardigden van Staten die Partij zijn, die de diplomatieke status hebben.

Artikel 12. Vrijheid van beperkingen ten aanzien van financiële bezittingen

De OVCW is niet onderworpen aan financiële controles, regelingen, kennisgevingsvereisten met betrekking tot financiële transacties, of moratoria van enigerlei aard, en kan vrijelijk:

  • a. valuta's van welke aard ook langs de toegestane kanalen kopen, bezitten en vervreemden;

  • b. rekeningen aanhouden in welke valuta ook;

  • c. fondsen, effecten en goud langs de toegestane kanalen kopen, bezitten en vervreemden;

  • d. haar fondsen, effecten, goud en valuta's overbrengen naar of uit het Koninkrijk der Nederlanden, uit of naar enig ander land, of binnen het Koninkrijk der Nederlanden, en valuta's die zij bezit omwisselen in welke andere valuta ook; en

  • e. fondsen werven op elke door haar wenselijk geachte wijze, met dien verstande dat de OVCW met betrekking tot de werving van fondsen binnen het Koninkrijk der Nederlanden toestemming van de Regering dient te verkrijgen.

Artikel 13. Vrijstelling van invoer- en uitvoerbeperkingen

Door de OVCW voor officiële doeleinden ingevoerde of uitgevoerde goederen zijn vrijgesteld van alle door de Regering op invoer en uitvoer ingestelde verboden en beperkingen.

Artikel 14. Doorreis en verblijf

  • 1 De Regering neemt alle noodzakelijke maatregelen om de toegang en het verblijf op het grondgebied van het Koninkrijk der Nederlanden mogelijk te maken en te vergemakkelijken, werpt geen belemmeringen op voor het vertrek van het grondgebied van het Koninkrijk der Nederlanden van de hieronder genoemde personen van welke nationaliteit ook, waarborgt dat zij onbelemmerd kunnen doorreizen naar en van de zetel en biedt hen bij hun doorreis alle nodige bescherming:

    • a. Delegatieleiders, plaatsvervangers en adviseurs van delegatieleiders, permanente vertegenwoordigers en leden van de permanente vertegenwoordigingen van de Staten die Partij zijn, hun gezinnen en andere leden van hun huishouding, alsmede administratief en technisch personeel verbonden aan de delegatieleiders of de permanente vertegenwoordigers, en de echtgenoten en kinderen ten laste van dat personeel;

    • b. Afgevaardigden van de Staten die Partij zijn, hun echtgenoten, en kinderen ten laste alsmede administratief en technisch personeel verbonden aan afgevaardigden van de Staten die Partij zijn en de echtgenoten en kinderen ten laste van dat personeel;

    • c. functionarissen van de OVCW, hun gezinnen en de hun ten laste komende leden van hun huishoudingen;

    • d. vertegenwoordigers en functionarissen van internationale organisaties waarmee de OVCW overeenkomsten of regelingen heeft gesloten dan wel getroffen overeenkomstig het Verdrag, die voor officiële aangelegenheden contact met de OVCW hebben, en hun echtgenoten en kinderen ten laste;

    • e. deskundigen en hun echtgenoten en kinderen ten laste.

  • 2 Dit artikel is niet van toepassing in geval van algemene onderbrekingen van het vervoer, waarop artikel 9, tweede lid, van dit Verdrag van toepassing is, en doet geen afbreuk aan de geldigheid van algemeen geldende wettelijke bepalingen met betrekking tot het functioneren van transportmiddelen.

  • 3 De benodigde visa voor de in dit artikel genoemde personen worden kosteloos verstrekt. De Regering treft alle nodige maatregelen om ervoor te zorgen dat de visa zo snel mogelijk worden verstrekt met het oog op een vlotte afwerking van de officiële aangelegenheden met de OVCW.

  • 4 Geen enkele activiteit van de in dit artikel genoemde personen in hun officiële hoedanigheid met betrekking tot de OVCW bedoeld in het eerste lid van dit artikel, kan aanleiding geven om hun binnenkomst op of vertrek van het grondgebied van het Koninkrijk der Nederlanden te verhinderen of van hen te verlangen dit grondgebied te verlaten.

  • 5 Geen van de in het eerste lid, letters d tot en met e, van dit artikel genoemde personen, behalve functionarissen van internationale organisaties voor wie de uitzettingsprocedures worden geregeld in bijzondere overeenkomsten waarbij het Koninkrijk der Nederlanden partij is, kan door de Regering worden gedwongen het Koninkrijk der Nederlanden te verlaten, behalve in het geval van misbruik van het verblijfsrecht. Er wordt geen procedure ingesteld om een zodanige persoon te dwingen het Koninkrijk der Nederlanden te verlaten behalve met voorafgaande toestemming van de Minister van Buitenlandse Zaken van het Koninkrijk der Nederlanden. Deze toestemming wordt slechts gegeven in overleg met de Directeur-Generaal. Indien een uitzettingsprocedure tegen een van de genoemde personen in gang worden gezet heeft de Directeur-Generaal het recht in deze procedure te verschijnen of te worden vertegenwoordigd namens de persoon tegen wie de procedure is ingesteld.

  • 6 Dit artikel laat onverlet de mogelijkheid voor de Regering om te verlangen dat personen die zich beroepen op de rechten van dit artikel zich onderwerpen aan de bepalingen inzake quarantaine en volksgezondheid.

  • 7 De Directeur-Generaal en de desbetreffende autoriteiten van het Koninkrijk der Nederlanden plegen op verzoek van een van hen overleg over de wijze van vergemakkelijking van de binnenkomst in het Koninkrijk der Nederlanden door personen uit het buitenland die de zetel wensen te bezoeken en die niet de in dit artikel geregelde voorrechten genieten.

Artikel 15. Permanente vertegenwoordigingen bij de OVCW

De in het Koninkrijk der Nederlanden gevestigde permanente vertegenwoordigingen van de Staten die Partij zijn, met inbegrip van hun terreinen en gebouwen zoals omschreven in het Verdrag van Wenen, genieten dezelfde voorrechten en immuniteiten als die welke aan in Koninkrijk der Nederlanden gevestigde diplomatieke zendingen worden verleend overeenkomstig het Verdrag van Wenen.

Artikel 16. Voorrechten en immuniteiten van delegatieleiders, permanente vertegenwoordigers bij de OVCW en van personeelsleden van permanente vertegenwoordigingen

  • 1 Alle delegatieleiders en permanente vertegenwoordigers genieten binnen het Koninkrijk der Nederlanden dezelfde voorrechten en immuniteiten als die welke door de Regering aan hoofden van bij het Koninkrijk der Nederlanden geaccrediteerde diplomatieke zendingen worden verleend overeenkomstig het Verdrag van Wenen.

  • 2 Personeelsleden van permanente vertegenwoordigingen van Staten die Partij zijn, genieten dezelfde voorrechten en immuniteiten als die welke door de Regering aan in het Koninkrijk der Nederlanden gevestigde diplomatieke zendingen worden verleend overeenkomstig het Verdrag van Wenen.

  • 3 De echtgenoten, kinderen en ten laste komende leden van het huishouden van de in dit artikel bedoelde personen genieten dezelfde voorrechten en immuniteiten als de echtgenoten, kinderen en ten laste komende leden van het huishouden van personen in diplomatieke zendingen met vergelijkbare rang, overeenkomstig het Verdrag van Wenen.

Artikel 17. Voorrechten en immuniteiten van vertegenwoordigers en van plaatsvervangers en adviseurs van delegatieleiders

  • 1 Vertegenwoordigers van de Staten die Partij zijn en plaatsvervangers en adviseurs van de delegatieleiders genieten, onverminderd de andere voorrechten en immuniteiten die zij genieten bij de uitoefening van hun functies en gedurende hun reizen van en naar de zetel, binnen en ten aanzien van het Koninkrijk der Nederlanden de volgende voorrechten en immuniteiten:

    • a. immuniteit van arrestatie of detentie van hun persoon;

    • b. immuniteit van enigerlei rechtsvervolging met betrekking tot door hen gesproken of geschreven woorden en alle door hen in de uitoefening van hun officiële functies verrichte handelingen; deze immuniteit blijft ook gelden wanneer de betrokkenen deze functies niet meer uitoefenen;

    • c. onschendbaarheid van al hun stukken, documenten en ander officieel materiaal;

    • d. het recht codes te gebruiken en officiële correspondentie en ander officieel materiaal te verzenden en te ontvangen per koerier of in verzegelde tassen;

    • e. vrijstelling met betrekking tot henzelf, hun echtgenoten, en de hun ten laste komende kinderen, van inreisbeperkingen, registratieverplichtingen voor vreemdelingen en verplichtingen met betrekking tot de militaire dienst;

    • f. dezelfde bescherming en repatriëringsfaciliteiten als die welke bij internationale crises gelden voor leden met vergelijkbare rang van het personeel van bij het Koninkrijk der Nederlanden gevestigde diplomatieke zendingen;

    • g. dezelfde voorrechten met betrekking tot valuta- en wisselbeperkingen als die welke de Regering toekent aan vertegenwoordigers van andere regeringen bij tijdelijke officiële zendingen; en

    • h. dezelfde immuniteiten en faciliteiten met betrekking tot hun persoonlijke en officiële bagage als die welke de Regering toekent aan leden met vergelijkbare rang van het personeel van in het Koninkrijk der Nederlanden gevestigde diplomatieke zendingen.

  • 2 Het hierboven onder e tot en met h bepaalde is niet van toepassing op vertegenwoordigers van Staten die Partij zijn die Nederlands staatsburger zijn of hun permanente verblijfplaats in het Koninkrijk der Nederlanden hebben.

  • 3 Voorzover het vaststellen van enige vorm van belasting wordt gebaseerd op het ingezetenschap worden periodes, gedurende welke de in het eerste lid van dit artikel genoemde personen in het Koninkrijk der Nederlanden aanwezig zijn voor de uitoefening van hun functies, niet beschouwd als periodes van ingezetenschap. Deze personen zijn met name vrijgesteld van belastingen op hun salarissen en emolumenten gedurende deze periodes.

Artikel 18. Voorrechten en immuniteiten van de Directeur-Generaal en andere functionarissen van de OVCW

  • 1 Functionarissen van de OVCW genieten binnen en met betrekking tot het Koninkrijk der Nederlanden de volgende voorrechten en immuniteiten:

    • a. immuniteit van arrestatie of detentie en van inspectie of inbeslagneming van hun persoonlijke en officiële bagage, in de mate bepaald in het tweede lid, letters c en d, van dit artikel;

    • b. immuniteit van enigerlei rechtsvervolging met betrekking tot door hen gesproken of geschreven woorden en alle door hen in de uitoefening van hun officiële functies verrichte handelingen; deze immuniteit blijft ook gelden wanneer de betrokkenen geen functionarissen meer zijn van de OVCW; deze immuniteit, alsmede die welke is geregeld in het tweede lid, letters c en d, van dit artikel, strekt zich evenwel in geen geval uit tot een civiele actie van een derde wegens schade die het gevolg is van een ongeval veroorzaakt door een motorvoertuig dat eigendom is van of dat werd bestuurd door of bediend namens een functionaris van de OVCW of met betrekking tot een verkeersovertreding waarbij een dergelijk voertuig was betrokken;

    • c. vrijstelling van belasting op al dan niet rechtstreeks aan hen betaalde salarissen, emolumenten, loon en vergoedingen betreffende hun dienstbetrekking bij de OVCW; de Regering laat de aldus vrijgestelde inkomsten buiten beschouwing bij het vaststellen van de belasting over inkomsten uit andere bronnen;

    • d. vrijstelling met betrekking tot henzelf, hun echtgenoten, de hun ten laste komende gezinsleden en andere leden van hun huishouding van inreisbeperkingen en vreemdelingenregistratie;

    • e. vrijstelling, met betrekking tot henzelf, hun echtgenoten, de hun ten laste komende gezinsleden en andere leden van hun huishouding, van verplichtingen met betrekking tot de militaire dienst, met dien verstande dat met betrekking tot staatsburgers van het Koninkrijk der Nederlanden een dergelijke vrijstelling beperkt blijft tot functionarissen van wie de namen op grond van hun functie voorkomen op een door de Directeur-Generaal opgestelde en door de Regering goedgekeurde lijst; voorts met dien verstande dat wanneer andere functionarissen dan die welke op de lijst voorkomen en die staatsburger van het Koninkrijk der Nederlanden zijn, worden opgeroepen voor militaire dienst, de Regering op verzoek van de Directeur-Generaal tijdelijke ontheffingen daarvan verleent in de mate waarin dit noodzakelijk is voor het vermijden van onderbreking van de noodzakelijke werkzaamheden van de OVCW;

    • f. het recht om binnen het Koninkrijk der Nederlanden of elders buitenlandse effecten, vreemde-valutarekeningen en andere roerende zaken te verwerven en aan te houden, en onder dezelfde voorwaarden als ingezetenen van het Koninkrijk der Nederlanden onroerende zaken te verwerven en aan te houden; en het recht om hun fondsen bij beëindiging van hun dienstbetrekking met de OVCW uit het Koninkrijk der Nederlanden langs de wettige kanalen mee te nemen zonder verbod of beperking;

    • g. dezelfde bescherming en repatriëringsfaciliteiten met betrekking tot henzelf, hun echtgenoten, de hun ten laste komende gezinsleden en andere leden van hun huishouding als die welke bij internationale crises gelden voor leden met vergelijkbare rang van het personeel van in het Koninkrijk der Nederlanden gevestigde diplomatieke zendingen.

  • 2 In aanvulling op de voorrechten en immuniteiten genoemd in het eerste lid van dit artikel:

    • a. geniet de Directeur-Generaal dezelfde voorrechten en immuniteiten, vrijstellingen en faciliteiten als die welke worden toegekend aan de hoofden van bij het Koninkrijk der Nederlanden geaccrediteerde diplomatieke zendingen overeenkomstig het Verdrag van Wenen;

    • b. genieten de Adjunct Directeuren-Generaal eveneens dezelfde voorrechten en immuniteiten, vrijstellingen en faciliteiten als die welke worden toegekend aan de hoofden van bij het Koninkrijk der Nederlanden geaccrediteerde diplomatieke zendingen overeenkomstig het Verdrag van Wenen;

    • c. genieten functionarissen met de rang P-5 en hoger alsmede eventueel nader te bepalen bijkomende categorieën functionarissen die in overleg met de Regering door de Directeur-Generaal na raadpleging van de Uitvoerende Raad op grond van de verantwoordelijkheden van hun positie in de OVCW worden benoemd, dezelfde voorrechten en immuniteiten, vrijstellingen en faciliteiten als die welke door de Regering worden toegekend aan diplomaten met vergelijkbare rang van de in het Koninkrijk der Nederlanden gevestigde diplomatieke zendingen overeenkomstig het Verdrag van Wenen;

    • d. genieten functionarissen met de rang P-4 of lager dezelfde voorrechten en immuniteiten, vrijstellingen en faciliteiten als die welke door de Regering worden toegekend aan leden van het administratief en technisch personeel van de in het Koninkrijk der Nederlanden gevestigde diplomatieke zendingen overeenkomstig het Verdrag van Wenen, met dien verstande dat de immuniteit ten aanzien van de rechtsmacht in strafzaken en de persoonlijke onschendbaarheid zich niet uitstrekken tot handelingen verricht buiten hun officiële taken;

    • e. is het inspecteurs op dienstreis toegestaan het grondgebied van het Koninkrijk der Nederlanden met hun uitrusting en met monsters te verlaten en binnen te komen met alle vervoermiddelen. De desbetreffende autoriteiten van het Koninkrijk der Nederlanden verlenen hun en hun bagage de nodige voorrang bij douane- en veiligheidscontroles. Het vervoer van giftige stoffen dient te voldoen aan de wetten en regelingen van het Koninkrijk der Nederlanden met betrekking tot de behandeling van dergelijke goederen.

  • 3 Functionarissen van de OVCW die Nederlands staatsburger zijn of permanent ingezetenen van het Koninkrijk der Nederlanden, genieten dezelfde voorrechten en immuniteiten, vrijstellingen en faciliteiten als die welke worden toegekend ingevolge dit Verdrag voorzover erkend door het internationale recht, met dien verstande dat artikel 22, eerste lid, en artikel 18, eerste lid, letter a, met betrekking tot hun officiële bagage, en artikel 18, eerste lid, letters b, c en e, van dit Verdrag altijd op hen van toepassing zijn.

Artikel 19. Voorrechten en immuniteiten van deskundigen

  • 1 Deskundigen genieten binnen en ten aanzien van het Koninkrijk der Nederlanden de volgende voorrechten en immuniteiten voorzover nodig voor de doelmatige uitoefening van hun functie en gedurende hun reizen in verband met deze functies en gedurende hun aanwezigheid op de zetel:

    • a. immuniteit van arrestatie of detentie van hun persoon en van inspectie of inbeslagneming van hun officiële bagage;

    • b. immuniteit van enigerlei rechtsvervolging met betrekking tot door hen gesproken of geschreven woorden en alle door hen in de uitoefening van hun officiële functies verrichte handelingen; deze immuniteit blijft ook gelden wanneer de betrokkenen geen functionarissen meer zijn van, op dienstreis zijn voor, in commissies zitting hebben van of als consultant optreden voor de OVCW, of niet langer aanwezig zijn op de zetel of niet langer de door de OVCW bijeengeroepen vergaderingen bijwonen. Deze immuniteit strekt zich in geen geval uit tot civiele actie van een derde wegens schade die het gevolg is van een ongeval veroorzaakt door een motorvoertuig dat eigendom is van of dat werd bestuurd door of bediend namens de deskundige of met betrekking tot een verkeersovertreding waarbij een dergelijk voertuig was betrokken;

    • c. onschendbaarheid van alle stukken, documenten, en ander officieel materiaal;

    • d. het recht om ten behoeve van alle communicatie met de OVCW codes gebruiken en stukken, correspondentie of ander officieel materiaal te verzenden of te ontvangen per koerier of in verzegelde tassen;

    • e. vrijstelling met betrekking tot hen zelf en hun echtgenoten van inreisbeperkingen, vreemdelingenregistratie en verplichtingen met betrekking tot de militaire dienst;

    • f. dezelfde bescherming en repatriëringsfaciliteiten als die welke in geval van een internationale crisis gelden voor leden met vergelijkbare rang van het personeel van in het Koninkrijk der Nederlanden gevestigde diplomatieke zendingen; en

    • g. dezelfde voorrechten met betrekking tot valuta- en wisselbeperkingen als die welke worden toegekend aan vertegenwoordigers van buitenlandse Regeringen op tijdelijke officiële zendingen.

  • 2 Voorzover het vaststellen van enige vorm van belasting wordt gebaseerd op het ingezetenschap worden periodes, gedurende welke de in het eerste lid van dit artikel genoemde personen die niet reeds ingezetenen van het Koninkrijk der Nederlanden zijn, maar in het Koninkrijk der Nederlanden aanwezig zijn ter vervulling van hun taken, niet beschouwd als periodes van ingezetenschap. Deze personen zijn met name vrijgesteld van belastingen op de door hen gedurende deze periodes van de OVCW ontvangen salarissen en emolumenten.

  • 3 Deskundigen die Nederlands staatsburger zijn of permanent ingezetene zijn in het Koninkrijk der Nederlanden genieten slechts de voorrechten, immuniteiten en faciliteiten die hun ingevolge het eerste lid, letter a, met betrekking tot hun officiële bagage, en ingevolge het eerste lid, letters b, c, d en g, worden verleend.

Artikel 20. Vertegenwoordigers en functionarissen van Staten die geen Partij zijn bij het Verdrag

De status van vertegenwoordigers en functionarissen van Staten die geen partij zijn bij het Verdrag en waarmee de OVCW in overeenstemming met het Verdrag overeenkomsten of regelingen heeft gesloten dan wel getroffen, en die officiële contacten met de OVCW hebben, wordt bepaald in de genoemde overeenkomsten en regelingen.

Artikel 21. Kennisgeving

  • 1 De OVCW doet de Regering onmiddellijk kennisgeving van:

    • a. de lijst van Delegatieleiders, Permanente Vertegenwoordigers, afgevaardigden van de Staten die Partij zijn en andere personen op wie de artikelen 16, 17 en 19 van dit Verdrag van toepassing zijn, en herziet deze lijst steeds wanneer dit nodig is;

    • b. de benoeming van de Directeur-Generaal, de Plaatsvervangend Directeuren-Generaal en andere functionarissen van de OVCW, hun aankomst en hun definitieve vertrek, of de beëindiging van hun functies bij de OVCW;

    • c. de aankomst en het definitieve vertrek van gezinsleden die deel uitmaken van het huishouden van de personen bedoeld in het eerste lid, letter b, van dit artikel en, waar van toepassing, het feit dat een persoon niet langer deel van het huishouden uitmaakt; en

    • d. de aankomst en het definitieve vertrek van huishoudelijk personeel van personen bedoeld in het eerste lid, letter b, van dit artikel en, waar van toepassing, het feit dat zij de dienst van die personen verlaten.

  • 2 De Regering verstrekt identiteitskaarten met een foto van de houder aan de Delegatieleiders, Permanente Vertegenwoordigers, Afgevaardigden van de Staten die Partij zijn en andere personen op wie de artikelen 16, 17 en 19 van dit Verdrag van toepassing zijn alsmede aan de gezinsleden die deel uitmaken van hun huishouden en aan het huishoudelijk personeel van de personen bedoeld in het eerste lid, letter a, van dit artikel. Deze identiteitskaart strekt tot bewijs van de identiteit van de houder tegenover alle autoriteiten van het Koninkrijk der Nederlanden.

  • 3 De Regering verstrekt identiteitskaarten met een foto van de houder aan de Directeur-Generaal, de Plaatsvervangend Directeuren-Generaal en aan andere functionarissen van de OVCW en hun gezinsleden die deel uitmaken van hun huishouden en aan huishoudelijk personeel van de in het eerste lid, letter b, van dit artikel genoemde personen. Deze identiteitskaart strekt tot bewijs van de identiteit van de houder tegenover alle autoriteiten van het Koninkrijk der Nederlanden.

Artikel 22. Sociale zekerheid

  • 1 Voor zover er door de OVCW regelingen voor sociale zekerheid worden vastgesteld of uitgevoerd, worden de OVCW en de functionarissen op wie bedoelde regelingen van toepassing zijn, vrijgesteld van alle verplichte bijdragen aan organisaties van het Koninkrijk der Nederlanden voor sociale zekerheid. Hieruit volgt dat zij niet vallen onder de regelingen voor sociale zekerheid van het Koninkrijk der Nederlanden.

  • 2 Alle door de OVCW opgerichte of beheerde voorzorgsfondsen genieten in het Koninkrijk der Nederlanden rechtspersoonlijkheid indien de OVCW dit wenst en genieten dezelfde vrijstellingen, voorrechten en immuniteiten als de OVCW zelf.

  • 3 De bepalingen van het eerste lid van dit artikel zijn mutatis mutandis van toepassing op echtgenoten en de ten laste komende familieleden die deel uitmaken van het huishouden van personen bedoeld in het eerste lid van dit artikel, tenzij zij in het Koninkrijk der Nederlanden in dienst zijn bij een andere werkgever dan de OVCW, of uitkeringen ingevolge het Nederlandse stelsel van sociale zekerheid ontvangen.

Artikel 23. Tewerkstelling

Aan echtgenoten en ten laste komende leden van de huishoudens van functionarissen van de OVCW worden tijdelijke werkvergunningen verleend voor de duur van de tewerkstelling van deze functionarissen bij de OVCW in het Koninkrijk der Nederlanden.

Artikel 24. Aanvullende bepalingen met betrekking tot voorrechten en immuniteiten

  • 1 De krachtens de bepalingen van dit Verdrag verleende voorrechten en immuniteiten worden verleend in het belang van de OVCW en niet tot persoonlijk voordeel van de betrokken1 zelf. Het is de plicht van de OVCW en alle personen die dergelijke voorrechten en immuniteiten genieten in alle overige opzichten de wetten en regelingen van het Koninkrijk der Nederlanden in acht te nemen.

  • 2 Dit Verdrag is van toepassing ongeacht het bestaan van diplomatieke betrekkingen van de Regering met de betrokken Staat en ongeacht de verlening door de betrokken Staat van vergelijkbare voorrechten en immuniteiten aan de diplomatieke afgezanten of staatsburgers van het Koninkrijk der Nederlanden.

  • 3 De krachtens de bepalingen van dit Verdrag aan functionarissen van de OVCW en deskundigen verleende voorrechten en immuniteiten worden verleend met dien verstande dat de OVCW afstand doet van de immuniteit van de betrokken personen in omstandigheden waarin de OVCW van mening is dat deze immuniteit de rechtsgang zou belemmeren, en in alle gevallen waarin daarvan afstand kan worden gedaan zonder afbreuk te doen aan het doel waarvoor deze immuniteit werd verleend.

  • 4 De OVCW werkt te allen tijde samen met de daarvoor in aanmerking komende autoriteiten van het Koninkrijk der Nederlanden teneinde de goede rechtsbedeling te vergemakkelijken en misbruik van de krachtens de bepalingen van dit Verdrag verleende voorrechten en immuniteiten door functionarissen van de OVCW te voorkomen.

  • 5 Indien de Regering van mening is dat sprake is van misbruik van krachtens dit Verdrag verleende voorrechten of immuniteiten door een functionaris van de OVCW of een deskundige, pleegt de Directeur-Generaal desgevraagd met de desbetreffende Nederlandse autoriteiten overleg om vast te stellen of van genoemd misbruik sprake is. Wanneer dit overleg naar de mening van de Directeur-Generaal en de Regering niet tot een bevredigend resultaat leidt, wordt over de kwestie beslist overeenkomstig de in artikel 26, tweede lid, van dit Verdrag genoemde procedure.

  • 6 De Directeur-Generaal heeft het recht en de plicht afstand van de immuniteit van een functionaris van de OVCW te doen in gevallen waarin de immuniteit de rechtsgang zou belemmeren en deze afstand mogelijk is zonder nadelige invloed op de belangen van de OVCW. Met betrekking tot de Directeur-Generaal heeft de OVCW dezelfde rechten en plichten, die door de Uitvoerende Raad worden uitgeoefend dan wel vervuld.

Artikel 25. Internationale aansprakelijkheid van het Koninkrijk der Nederlanden

Het feit dat de zetel zich bevindt op het grondgebied van het Koninkrijk der Nederlanden brengt geen internationale aansprakelijkheid van het Koninkrijk der Nederlanden met zich mee voor een handeling of nalatigheid van de OVCW of haar functionarissen die een handeling verrichten of nalaten te verrichten in de uitoefening van hun functie, behoudens de aansprakelijkheid die het Koninkrijk der Nederlanden zou hebben op dezelfde grondslag als andere Staten die Partij zijn.

Artikel 26. Beslechting van geschillen

  • 1 De OVCW stelt nadere bepalingen vast ten behoeve van een geschikte wijze van beslechting van:

    • a. geschillen die voortvloeien uit contracten en uit geschillen van privaatrechtelijke aard waarbij de OVCW partij is; en

    • b. geschillen waarbij een functionaris van de OVCW of een deskundige is betrokken die krachtens zijn officiële positie immuniteit geniet, indien door de OVCW geen afstand van deze immuniteit is gedaan.

  • 2 Geschillen tussen de OVCW en de Regering betreffende de uitlegging of toepassing van dit Verdrag, of kwesties ter zake van de zetel of de betrekkingen tussen de OVCW en de Regering, die niet in der minne kunnen worden geschikt, worden op verzoek van een van beide Partijen bij het geschil ter finale beoordeling voorgelegd aan een tribunaal van drie scheidsmannen. Elke Partij benoemt één scheidsman, en de twee aldus benoemde scheidsmannen benoemen samen een derde scheidsman als hun voorzitter.

  • 3 Indien een van de Partijen nalaat een scheidsman te benoemen en geen stappen daartoe heeft gedaan binnen twee maanden na een verzoek van de andere Partij om die benoeming te verrichten, kan de andere Partij de President van het Internationale Gerechtshof verzoeken deze benoeming te verrichten.

  • 4 Indien de twee scheidsmannen er niet in slagen binnen twee maanden na hun benoeming overeenstemming te bereiken over de keuze van de derde scheidsman, kan elk van beide Partijen de President van het Internationale Gerechtshof verzoeken de benoeming te verrichten.

  • 5 Het tribunaal hanteert de procedures overeenkomstig het Facultatief Reglement van het Permanente Hof van Arbitrage voor arbitrage waarbij internationale organisaties en staten betrokken zijn, zoals die gelden op de datum van ondertekening van dit Verdrag.

  • 6 Het tribunaal komt tot een uitspraak met meerderheid van stemmen. Een uitspraak van het tribunaal is onherroepelijk en bindend voor de partijen bij het geschil.

Artikel 27. Werking van dit Verdrag

  • 1 Dit Verdrag wordt uitgelegd tegen de achtergrond van zijn voornaamste doelstelling om de OVCW in haar zetel in het Koninkrijk der Nederlanden in staat te stellen zich volledig en doelmatig van haar verantwoordelijkheden te kwijten en haar doelstellingen te verwezenlijken.

  • 2 Waar dit Verdrag verplichtingen oplegt aan de desbetreffende autoriteiten van het Koninkrijk der Nederlanden, ligt de uiteindelijke verantwoordelijkheid voor de vervulling van deze verplichtingen bij de Regering.

Artikel 28. Beëindiging van dit Verdrag

Dit Verdrag wordt beëindigd door wederzijdse instemming hiermee van de OVCW en de Regering.

Artikel 29. Wijzigingen

  • 1 Dit Verdrag kan te allen tijde worden gewijzigd.

  • 2 Wijzigingen komen tot stand met wederzijdse instemming en krijgen rechtsgeldigheid door middel van een notawisseling.

  • 3 Op verzoek van een van de Partijen wordt door de OVCW en de Regering overleg gepleegd met betrekking tot de wijziging van dit Verdrag.

Artikel 30. De status van de Afzonderlijke Regeling

De gelijktijdig met dit Verdrag gesloten Afzonderlijke Regeling is een integrerend onderdeel van dit Verdrag. Iedere verwijzing naar dit Verdrag omvat mede de Afzonderlijke Regeling.

Artikel 31. Inwerkingtreding

  • 1 Dit Verdrag treedt in werking daags nadat beide Partijen elkaar er schriftelijk van in kennis hebben gesteld dat aan de wettelijke vereisten voor de inwerkingtreding is voldaan.

  • 2 Ten aanzien van het Koninkrijk der Nederlanden is dit Verdrag alleen van toepassing op het Koninkrijk in Europa.

Afzonderlijke Regeling met betrekking tot het Verdrag tussen het Koninkrijk der Nederlanden en de Organisatie voor het Verbod van Chemische Wapens betreffende de zetel van de OVCW

1. Artikel 11, tweede lid, letter c: „aanzienlijke uitgaven"

Voor het doel van de vrijstelling van BTW op voor de officiële activiteiten van de OVCW benodigde goederen en diensten die aanzienlijke uitgaven met zich meebrengen wordt onder „aanzienlijke uitgaven" overeenkomstig de bestaande bepalingen verstaan een bedrag boven de drempel van Hfl. 500 per factuur.

2. Artikel 11, vierde lid: „de met de Regering overeengekomen voorwaarden”

De Regering maakt bij deze de voorwaarden bekend waaronder de verworven of ingevoerde goederen als bedoeld in artikel 11, vierde lid, kunnen worden verkocht, weggegeven of op andere wijze kunnen worden vervreemd.

  • a In beginsel kent de Regering de OVCW een vaste periode van vijf jaar toe voor de verlaging van de waarde bij verkoop/vervreemding met het oog op de vrijstellingen van heffingen en belastingen van alle roerende zaken, behalve motorvoertuigen, tot nul. Na deze periode van vijf jaar kunnen zaken vrij van belastingen en heffingen worden verkocht. Deze „verlaging” van de waarde van alle goederen tot de waarde nul in de periode van vijf jaar wordt bereikt in tranches van 10 procent per zes maanden. Indien echter de lokale marktwaarde van bovengenoemde zaken daalt tot onder het aldus berekende bedrag, geldt het lagere bedrag.

  • b Voorts wordt overeengekomen dat de OVCW in beginsel het recht heeft te allen tijde haar goederen te verkopen aan een persoon of rechtspersoon die in het Koninkrijk der Nederlanden recht heeft op vrijstelling van belastingen en/of heffingen op die goederen. Te gelegener tijd verschaft de Regering informatie over de vereiste vaste procedure voor de behandeling van de vrijstelling in die gevallen, niet alleen voor motorvoertuigen maar ook voor andere goederen.

  • c In het geval van motorvoertuigen kent de Regering aan de OVCW de volgende rechten toe:

    • i. motorvoertuigen die belastingvrij van binnen de Europese Unie zijn ingevoerd, mogen twee jaar na verkrijging worden verkocht, op voorwaarde dat deze voertuigen worden verkocht aan ondernemers die de vaste procedures met betrekking tot de BTW in het Koninkrijk der Nederlanden in acht moeten nemen; en

    • ii. motorvoertuigen die vrij van heffingen en belastingen van buiten de Europese Unie zijn ingevoerd, mogen twee jaar na verkrijging worden verkocht, op voorwaarde dat deze voertuigen worden verkocht aan ondernemers die de vaste procedures met betrekking tot de BTW en invoerheffingen in het Koninkrijk der Nederlanden in acht moeten nemen.

  • d Met betrekking tot apparatuur voor gegevensverwerking en communicatie kent de Regering aan de OVCW een vaste periode van vijf jaar toe voor de vermindering van de waarde tot nul als hierboven beschreven onder a. Na een periode van twee jaar heeft de OVCW ook het recht de apparatuur te verkopen aan ondernemers die de vaste procedures met betrekking tot de BTW en/of invoerheffingen in het Koninkrijk der Nederlanden in acht moeten nemen. Als in de praktijk blijkt dat de OVCW bepaalde apparatuur niet meer nodig heeft binnen de periode van twee jaar en deze nog aan een ondernemer kan worden verkocht, is de Regering bereid een oplossing op ad hoc-basis aan te bieden. Indien de lokale marktwaarde van bovengenoemde zaken daalt tot onder het aldus berekende bedrag, geldt dit lagere bedrag.

  • e Overeengekomen wordt dat de OVCW ook het recht heeft om op elk moment zonder betaling van belastingen en/of heffingen onder vrijstelling gekochte goederen te vervreemden door uitvoer naar een land buiten de Europese Unie of deze zaken te vernietigen.

  • f De OVCW brengt de Regering op de hoogte van de vervreemding van onder vrijstelling gekochte goederen. De procedure voor de kennisgeving aan de Regering is zodanig dat de administratieve last zo klein mogelijk is.

3. Functionarissen van de OVCW

  • a Onverminderd het bepaalde in artikel 18 van het Zetelverdrag worden functionarissen van de OVCW die geen Nederlands staatsburger of permanent ingezetene van het Koninkrijk der Nederlanden zijn, voor zover het de heffing van Nederlandse inkomstenbelasting betreft, alleen belast over het in Nederland buiten het kader van de functie bij de OVCW verdiende binnenlands inkomen in de zin van de artikelen 48 en 49 van de Wet op de Inkomstenbelasting 1964. Ten aanzien van de vermogensbelasting wordt alleen binnenlands vermogen in de zin van artikel 12 en 13 van de Wet op de Vermogensbelasting 1964 belast. In dit opzicht worden de betrokken functionarissen hetzelfde behandeld als leden van diplomatieke zendingen.

  • b Functionarissen van de OVCW met de rang P-5 en hoger wordt vrijstelling van BTW verleend krachtens artikel 33 juncto artikel 36 van Belastingregeling voor het Koninkrijk, die verband houdt met de Algemene wet inzake rijksbelastingen 1959. De voorwaarde van wederkerigheid hoeft niet te worden vervuld.

  • c Functionarissen van de OVCW die in aanmerking komen voor de in het Verdrag van Wenen vervatte voorrechten en immuniteiten, krijgen vrijstelling van alle belastingen en heffingen wanneer zij in de Europese Unie een motorvoertuig voor particulier gebruik aanschaffen of invoeren. Na betaling van belastingen en heffingen over de restwaarde van een dergelijk voertuig, of nadat het voertuig buiten de Europese Unie is verkocht, kan een volgend voertuig belastingvrij worden gekocht. Deze vrijstelling geldt ook voor motorrijtuigenbelasting en accijnzen op motorbrandstoffen. Functionarissen in rang P-5 en hoger met inwonende echtgenote genieten eveneens vrijstelling van alle belastingen met betrekking tot een tweede motorvoertuig overeenkomstig de geldende regelingen.

  • d Functionarissen van de OVCW die in aanmerking komen voor de in het Verdrag van Wenen vervatte voorrechten en immuniteiten, wordt diplomatieke vrijstelling verleend van gemeentelijke belastingen met inbegrip van de gebruikerscomponent van de onroerende zaakbelasting.

  • e Functionarissen van de OVCW genieten overeenkomstig de geldende regelingen ontheffing van invoerheffingen en belastingen, behalve betalingen voor diensten, met betrekking tot hun meubilair en persoonlijke bezittingen en hebben het recht hun meubilair en persoonlijke bezittingen bij beëindiging van hun functie in Nederland vrij van heffingen uit te voeren. Persoonlijke bezittingen omvatten mede een redelijk aantal auto's die bij de huishouding in gebruik zijn geweest en ouder zijn dan zes maanden.

  • f Wanneer de regelingen betreffende diplomatiek personeel of internationale functionarissen die worden geacht dezelfde status te hebben als functionarissen van de OVCW worden gewijzigd, worden de op functionarissen van de OVCW toepasselijke regelingen eveneens gewijzigd.

4. Aanvullende bepaling

  • a Indien en voor zover de Regering in de toekomst met een intergouvernementele organisatie een verdrag aangaat waarin voorwaarden zijn vervat die voor die organisatie gunstiger zijn dan de vergelijkbare voorwaarden van dit Verdrag, kent de Regering deze gunstigere voorwaarden ook toe aan de OVCW of aan een ieder die krachtens dit Verdrag recht heeft op voorrechten en immuniteiten.

  • b De Regering stelt de OVCW in kennis van de keuze van het kantoor dat door het Ministerie van Buitenlandse Zaken wordt aangewezen als officieel en primair verantwoordelijk aanspreekpunt ten aanzien van alle aangelegenheden met betrekking tot dit Verdrag. De OVCW wordt onverwijld op de hoogte gebracht van deze aanwijzing en van eventuele wijzigingen ter zake.

Agreement between the Kingdom of the Netherlands and the Organisation for the Prohibition of Chemical Weapons (OPCW) concerning the headquarters of the OPCW

The Kingdom of the Netherlands,

and

the Organisation for the Probition of Chemical Weapons,

Whereas the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction establishing the Organisation for the Prohibition of Chemical Weapons entered into force on 29 April 1997,

Whereas the seat of the headquarters of the Organisation for the Prohibition of Chemical Weapons shall be The Hague, the Kingdom of the Netherlands, pursuant to Article VIII, paragraph 3, of the Convention,

Having regard to the provisions set forth under the Convention, concerning the legal capacity and the privileges and immunities of the Organisation for the Prohibition of Chemical Weapons and its organs, as well as to the privileges and immunities of the Heads of Delegation, alternates and advisers attached to Heads of Delegation, Permanent Representatives, members of the Permanent Missions, Delegates of States Parties, and the Director-General and the staff of the Organisation for the Prohibition of Chemical Weapons,

Also having regard to the provisions set forth in Annexes 2 and 3 of the Resolution Establishing the Preparatory Commission for the Organisation for the Prohibition of Chemical Weapons,

Considering that the establishment of the seat of the headquarters of the Organisation for the Prohibition of Chemical Weapons in the territory of the Kingdom of the Netherlands (The Hague) requires the conclusion of an agreement,

Have agreed as follows:

Article 1. Definitions

In this Agreement:

  • (a) “Convention” means the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction of 13 January 1993;

  • (b) “OPCW” means the Organisation for the Prohibition of Chemical Weapons;

  • (c) “Government” means the Government of the Kingdom of the Netherlands;

  • (d) “Appropriate authorities of the Kingdom of the Netherlands” means such state, municipal or other authorities of the Kingdom of the Netherlands as may be appropriate in the context of the relevant provisions of this Agreement and in accordance with the laws and customs applicable in the Kingdom of the Netherlands;

  • (e) “Parties” means the OPCW and the Kingdom of the Netherlands;

  • (f) “Headquarters” means the area and any building, including any OPCW laboratory, equipment store, conference facilities, parts of buildings, land or facilities ancillary thereto, irrespective of ownership, used by the OPCW on a permanent basis or from time to time, to carry out its official functions;

  • (g) “Director-General” means the Director-General referred to in Article VIII, paragraph 41, of the Convention;

  • (h) “State Party” means a State Party to the Convention;

  • (i) “Head of Delegation” means the accredited head of the delegation of a State Party to the Conference of the States Parties and/or to the Executive Council;

  • (j) “Alternates for and advisers attached to Heads of Delegation” means alternates for and advisers attached to Heads of Delegation;

  • (k) “Permanent Representative” means the principal representative of a State Party accredited to the OPCW;

  • (l) “Members of the Permanent Mission of a State Party” includes any staff member of the mission of the Permanent Representative to the OPCW;

  • (m) “Delegates of States Parties” means the designated representatives of States Parties and members of their delegations to any meeting of the OPCW which is not the Conference of the States Parties or the Executive Council;

  • (n) “Experts” means persons performing missions authorised by, serving on subsidiary bodies of, or in any way, at its request, consulting with the OPCW, provided that they are neither officials of the OPCW nor attached to Permanent Representatives;

  • (o) “Officials of the OPCW” means the Director-General and all members of the staff of the Technical Secretariat of the OPCW, except those who are locally recruited and remunerated on an hourly basis;

  • (p) “Inspectors on mission” means members of an inspection team as referred to in the Convention (Verification Annex, Part I, paragraph 17) who are in possession of an inspection mandate issued by the Director-General to conduct an inspection in accordance with the Convention;

  • (q) “Meetings convened by the OPCW” means any meeting of any of the organs or subsidiary organs of the OPCW, or any international conferences or other gatherings convened by the OPCW or under its sponsorship;

  • (r) “Property” means all property, assets and funds, belonging to the OPCW or held or administered by the OPCW in furtherance of its functions under the Convention and all income of the OPCW;

  • (s) “Samples” means samples as defined in the Convention;

  • (t) “Archives of the OPCW” means all records, correspondence, documents, manuscripts, computer and media data, photographs, films, video and sound recordings belonging to or held by the OPCW or any of its staff members in an official function, and any other material which the Director-General and the Government may agree shall form part of the archives of the OPCW;

  • (u) “The Vienna Convention” means the Vienna Convention on Diplomatic Relations of 18 April 1961.

Article 2. Legal personality

The OPCW shall possess full legal personality. In particular, it shall have the capacity:

  • (a) to contract;

  • (b) to acquire and dispose of movable and immovable property;

  • (c) to institute and act in legal proceedings.

Article 3. Freedom of assembly

  • 1 The Government recognises the right of the OPCW to convene meetings at its discretion within the headquarters in The Hague or, with the concurrence of the Government or of any appropriate authorities of the Kingdom of the Netherlands designated by the Government, elsewhere in the Kingdom of the Netherlands.

  • 2 The Government guarantees to the OPCW full freedom of assembly, of discussion, and of decision. The Government shall take all proper steps to guarantee that no impediment is placed in the way of conducting the proceedings of any meeting convened by the OPCW.

Article 4. Immunity from legal process

  • 1 Within the scope of its official activities the OPCW shall enjoy immunity from any form of legal process, except in the case of:

    • (a) civil action by a third party for damages arising out of an accident caused by a vehicle belonging to or operated on behalf of the OPCW where these damages are not recoverable from insurance;

    • (b) civil action relating to death or personal injury caused by an act or omission of the OPCW or officials of the OPCW in the Kingdom of the Netherlands.

  • 2 Notwithstanding the provisions of paragraph 1 of this Article, the property, wherever located and by whomsoever held, shall be immune from search, foreclosure, seizure, all forms of attachment, injunction or other legal process except in so far as in any particular case the OPCW shall have expressly waived its immunity. It is, however, understood that no waiver of immunity shall extend to any measure of execution.

Article 5. Immunity of property from other actions, inviolability of the archives, samples, equipment, and other material

  • 1 The property, wherever located and by whomsoever held, shall enjoy immunity from search, requisition, seizure, confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action.

  • 2 The archives and samples of the OPCW, wherever located and by whomsoever held, shall be inviolable at any time.

  • 3 The equipment and other material necessary for the OPCW's activities shall be inviolable at any time.

Article 6. The headquarters

The appropriate authorities of the Kingdom of the Netherlands shall take whatever action may be necessary to ensure that the OPCW shall not be dispossessed of all or any part of the headquarters.

Article 7. Law and authority in the headquarters

  • 1 The Government recognises the inviolability at any time of the headquarters, which shall be under the control and authority of the OPCW as provided in this Agreement.

  • 2 The OPCW shall have the power to make regulations, operative within the headquarters, for the purpose of establishing therein any conditions necessary for the full execution of its functions. No laws of the Kingdom of the Netherlands which are inconsistent with a regulation of the OPCW authorised by this Article shall, to the extent of such inconsistency, be applicable within the headquarters. Any dispute between the OPCW and the Kingdom of the Netherlands as to whether a regulation of the OPCW is authorised by this Article or as to whether a law of the Kingdom of the Netherlands is inconsistent with any regulation of the OPCW authorised by this Article, shall be promptly settled by the procedure set out in Article 26, paragraph 2, of this Agreement. Pending such settlement, the regulation of the OPCW shall apply and the law of the Kingdom of the Netherlands shall be inapplicable in the headquarters to the extent that the OPCW claims it to be inconsistent with the regulation of the OPCW.

  • 3 The OPCW shall inform the Government of regulations made which fall within paragraph 2 of this Article.

  • 4 Any person authorised to enter any place under any legal provision shall not exercise that authority in respect of the headquarters unless prior express permission to do so has been given by or on behalf of the Director-General. Any person who enters the headquarters with the permission of the Director-General shall, if so requested by or on behalf of the Director-General, leave the headquarters immediately.

  • 5 This Article shall not prevent the reasonable application of fire protection regulations of the appropriate authorities of the Kingdom of the Netherlands. The consent of the Director-General to entry into the headquarters shall be presumed if he or his authorised representative cannot be reached in time.

  • 6 Service of legal process may take place within the headquarters only with the prior consent of, and under conditions approved by, the Director-General.

  • 7 The Director-General shall prevent the headquarters from being used to harbour persons who are avoiding arrest under any law of the Kingdom of the Netherlands, who are wanted by the Government for extradition to another country, or who are endeavouring to evade service of legal process.

Article 8. Protection of the headquarters

  • 1 The appropriate authorities of the Kingdom of the Netherlands shall exercise due diligence to ensure that the security and tranquillity of the headquarters are not impaired by any person or group of persons attempting unauthorised entry into, or creating disturbances in, the immediate vicinity of the headquarters. As may be required for this purpose, the appropriate authorities shall provide adequate police protection on the boundaries and in the vicinity of the headquarters.

  • 2 If so requested by the Director-General, the appropriate authorities of the Kingdom of the Netherlands shall provide a sufficient number of police for the preservation of law and order in the headquarters.

  • 3 The appropriate authorities of the Kingdom of the Netherlands shall take all reasonable steps to ensure that the amenities of the headquarters are not prejudiced and that the purposes for which the headquarters are required are not obstructed by any use made of the land or buildings in the vicinity of the headquarters. The OPCW shall take all reasonable steps to ensure that the amenities of the land in the vicinity of the headquarters are not prejudiced by any use made of the land or buildings in the headquarters.

Article 9. Public services to the headquarters

  • 1 The appropriate authorities of the Kingdom of the Netherlands shall exercise, as far as it is within their competence, and to the extent requested by the Director-General, their respective powers to ensure that the headquarters shall be supplied, on fair conditions and on equitable terms, with the necessary services including, without limitation by reason of this enumeration, electricity, water, sewerage, gas, post, telephone, telegraph, any means of communication, local transportation, drainage, collection of refuse, fire protection and snow removal from public streets.

  • 2 In case of any interruption or threatened interruption of any such services, the OPCW shall be accorded the priority given to essential agencies and organs of the Government, and the Government shall take steps accordingly to ensure that the work of the OPCW is not prejudiced.

  • 3 The Director-General shall, upon request, make suitable arrangements to enable duly authorised representatives of the appropriate bodies to inspect, repair, maintain, reconstruct or relocate utilities, conduits, mains and sewers within the headquarters under conditions which shall not unreasonably disturb the carrying out of the functions of the OPCW. Underground work may be undertaken in the headquarters only in consultation with the Director-General or an official designated by him, and under conditions which shall not disturb the carrying out of the functions of the OPCW.

  • 4 Where the services referred to in paragraph 1 of this Article are supplied by appropriate authorities of the Kingdom of the Netherlands, or where the prices thereof are under their control, the OPCW shall be supplied at tariffs which shall not exceed the lowest rates accorded to essential agencies and organs of the Government.

Article 10. Facilities and immunities in respect of communications and publications

  • 1 The Government shall permit the OPCW to communicate, freely and without a need for special permission, for all official purposes, and shall protect the right of the OPCW to do so. The OPCW shall have the right to use codes and to dispatch and receive official correspondence and other official communications by courier or in sealed bags, which shall be subject to the same privileges and immunities as diplomatic couriers and bags.

  • 2 The OPCW shall enjoy, as far as may be compatible with the International Telecommunications Convention of 6 November 1982, for its official communications, treatment not less favourable than that accorded by the Government to any other organisation or government, including diplomatic missions of such other governments, in the matter of priorities and rates for mails, cables, telegrams, telexes, radiograms, television, telephone, fax, and other communications, and press rates for information to the press and radio.

  • 3 The Government recognises the right of the OPCW to publish and broadcast freely within the Kingdom of the Netherlands for purposes specified in the Convention. All official communications directed to the OPCW and all outward official communications of the OPCW, by whatever means or whatever form transmitted, shall be inviolable. Such inviolability shall extend, without limitation by reason of this enumeration, to publications, still and moving pictures, videos, films, sound recordings and software.

  • 4 The OPCW may install and use a wireless transmitter with the consent of the Government, which shall not be unreasonably withheld once the wave length has been agreed upon.

  • 5 Nothing in paragraphs 3 and 4 in this Article shall be interpreted as exempting the OPCW from the application of any laws of the Kingdom of the Netherlands, or of any international conventions to which the Kingdom of the Netherlands is a party, relating to copyrights.

Article 11. Exemption of the OPCW and its property from taxes and duties

  • 1 Within the scope of its official activities, the OPCW, its assets, income and other property shall be exempt from all direct taxes, whether levied by national, provincial or local authorities.

  • 2 Within the scope of its official activities, the OPCW shall be exempt from:

    • (a) motor vehicle tax (motorrijtuigenbelasting);

    • (b) tax on passenger motor vehicles and motorcycles (BPM);

    • (c) value-added tax paid on all goods and services supplied on a recurring basis or involving considerable expenditure (omzetbelasting);

    • (d) excise duty (accijns) included in the price of alcoholic beverages and hydrocarbons;

    • (e) import (and export) taxes and duties (belastingen bij invoer en uitvoer);

    • (f) insurance tax (assurantiebelasting);

    • (g) real property transfer tax (overdrachtsbelasting);

    • (h) any other taxes and duties of a substantially similar character to the taxes and duties provided for in this paragraph, imposed by the Netherlands subsequent to the date of signature of this Agreement.

  • 3 The exemptions provided for in subparagraphs 2(c), 2(d), 2(f), 2(g) of this Article may be granted by way of a refund under conditions to be agreed upon by the OPCW and the Government.

  • 4 Goods acquired or imported under the terms set out in paragraph 2 of this Article shall not be sold, given away or otherwise disposed of, except in accordance with conditions agreed upon with the Government.

  • 5 The OPCW may establish a tax- and duty-free commissary for the sale of limited quantities of certain articles for personal use or consumption and not for gift or sale, under conditions to be agreed upon by the Parties. This commissary will be open to officials of the OPCW, except for officials who are Netherlands citizens or permanently resident in the Kingdom of the Netherlands. It may also be open to Heads of Delegation, Permanent Representatives, alternates for and advisers attached to Heads of Delegation, and Members of the Permanent Missions and Delegates of States Parties who have diplomatic status.

Article 12. Freedom of financial assets from restrictions

Without being subject to any financial controls, regulations, notification requirements in respect of financial transactions, or moratoria of any kind, the OPCW may freely:

  • (a) purchase any currencies through authorised channels and hold and dispose of them;

  • (b) operate accounts in any currency;

  • (c) purchase through authorised channels, hold and dispose of funds, securities and gold;

  • (d) transfer its funds, securities, gold and currencies to or from the Kingdom of the Netherlands, to or from any other country, or within the Kingdom of the Netherlands and convert any currency held by it into any other currency; and

  • (e) raise funds in any manner which it deems desirable, except that with respect to the raising of funds within the Kingdom of the Netherlands, the OPCW shall obtain the concurrence of the Government.

Article 13. Exemption from import and export restrictions

Articles imported or exported by the OPCW for official purposes shall be exempt from all prohibitions and restrictions imposed by the Government on imports and exports.

Article 14. Transit and residence

  • 1 The Government shall take all necessary measures to facilitate and allow the entry into and sojourn in the territory of the Kingdom of the Netherlands and shall place no impediment in the way of the departure from the territory of the Kingdom of the Netherlands of the persons listed below, whatever their nationality, and shall ensure that no impediment is placed in the way of their transit to or from the headquarters and shall afford them any necessary protection in transit:

    • (a) Heads of Delegation, alternates for and advisers attached to Heads of Delegation, Permanent Representatives and Members of the Permanent Missions of States Parties, their families and other members of their households, as well as administrative and technical staff attached to Heads of Delegation or Permanent Representatives and the spouses and dependent children of such personnel;

    • (b) Delegates of States Parties, their spouses and dependent children, as well as administrative and technical staff attached to delegates of States Parties and the spouses and dependent children of such personnel;

    • (c) officials of the OPCW, their families and dependent members of their households;

    • (d) representatives and officials of international organisations with which the OPCW has concluded agreements or arrangements in accordance with the Convention, who have official business with the OPCW, and their spouses and dependent children;

    • (e) experts and their spouses and dependent children.

  • 2 This Article shall not apply in the case of general interruptions of transportation, which shall be dealt with as provided in Article 9, paragraph 2 of this Agreement, and shall not impair the effectiveness of generally applicable laws relating to the operation of means of transportation.

  • 3 Visas which may be required for persons referred to in this Article shall be granted without charge. The Government shall take all necessary measures to ensure that visas are issued as promptly as possible in order to allow the timely conduct of official business with the OPCW.

  • 4 No activity performed by any person referred to in this Article in his official capacity with respect to the OPCW as indicated in paragraph 1 of this Article shall constitute a reason for preventing his entry into or his departure from the territory of the Kingdom of the Netherlands or for requiring him to leave such territory.

  • 5 No person referred to in paragraph 1(d) - (e) of this Article, except for officials of international organisations whose expulsion procedures are covered by special agreements to which the Kingdom of the Netherlands is a party, shall be required by the Government to leave the Kingdom of the Netherlands except in the event of an abuse of the right of residence. No proceeding shall be instituted to require any such person to leave the Kingdom of the Netherlands except with the prior approval of the Minister for Foreign Affairs of the Kingdom of the Netherlands. Such approval shall be given only in consultation with the Director-General. If expulsion proceedings are taken against any such person, the Director-General shall have the right to appear or to be represented in such proceedings on behalf of the person against whom such proceedings are instituted.

  • 6 This Article shall not prevent the Government from requiring that persons claiming the rights granted by this Article comply with quarantine and health regulations.

  • 7 The Director-General and the appropriate authorities of the Kingdom of the Netherlands shall, at the request of either of them, consult as to methods of facilitating entrance into the Kingdom of the Netherlands by persons coming from abroad who wish to visit the headquarters and who do not enjoy the privileges provided by this Article.

Article 15. Permanent missions to the OPCW

Permanent Missions of States Parties established in the Kingdom of the Netherlands, including their premises as defined in the Vienna Convention, shall enjoy the same privileges and immunities as are accorded to diplomatic missions established in the Kingdom of the Netherlands in accordance with the Vienna Convention.

Article 16. Privileges and immunities of heads of delegation, permanent representatives to the OPCW and staff members of permanent missions

  • 1 Each Head of Delegation and Permanent Representative shall be entitled, within the Kingdom of the Netherlands, to the same privileges and immunities as the Government accords to heads of diplomatic missions accredited to the Kingdom of the Netherlands in accordance with the Vienna Convention.

  • 2 Staff members of Permanent Missions of States Parties shall be entitled to the same privileges and immunities as the Government accords to members, having comparable rank, of the staff of diplomatic missions established in the Kingdom of the Netherlands in accordance with the Vienna Convention.

  • 3 The spouses, children and dependent members of the households of persons referred to in this Article shall enjoy the same privileges and immunities as the spouses, children and dependent members of the households of persons in diplomatic missions having comparable rank under the Vienna Convention.

Article 17. Privileges and immunities of delegates and alternates for and advisers attached to heads of delegation

  • 1 Delegates of States Parties, and alternates for and advisers attached to Heads of Delegation, shall, without prejudice to any other privileges and immunities which they may enjoy while exercising their functions and during their journeys to and from the headquarters, enjoy within and with respect to the Kingdom of the Netherlands the following privileges and immunities:

    • (a) immunity from personal arrest or detention;

    • (b) immunity from legal process of any kind in respect of words spoken or written, and of all acts done by them, in the performance of their official functions; such immunity to continue although the persons concerned may no longer be engaged in the performance of such functions;

    • (c) inviolability of all papers, documents and other official material;

    • (d) the right to use codes and to dispatch or receive papers, correspondence or other official material by courier or in sealed bags;

    • (e) exemption with respect to themselves, their spouses and their dependent children from immigration restrictions, alien registration and national service obligations;

    • (f) the same protection and repatriation facilities as are accorded in time of international crisis to members, having comparable rank, of the staff of diplomatic missions established in the Kingdom of the Netherlands;

    • (g) the same privileges with respect to currency and exchange restrictions as the Government accords to representatives of foreign governments on temporary official missions; and

    • (h) the same immunities and facilities with respect to their personal and official baggage as the Government accords to members, having comparable rank, of the staff of diplomatic missions established in the Kingdom of the Netherlands.

  • 2 Subparagraphs (e) - (h) of paragraph 1 of this Article shall not apply to Delegates of States Parties who are Netherlands citizens or permanently resident in the Kingdom of the Netherlands.

  • 3 Where the incidence of any form of taxation depends upon residence, periods during which the persons designated in paragraph 1 of this Article may be present in the Kingdom of the Netherlands for the discharge of their duties shall not be considered as periods of residence. In particular, such persons shall be exempt from taxation on their salaries and emoluments during such periods of duty.

Article 18. Privileges and immunities of the director-general and other officials of the OPCW

  • 1 Officials of the OPCW shall enjoy within and with respect to the Kingdom of the Netherlands the following privileges and immunities:

    • (a) immunity from arrest or detention and from inspection or seizure of their official baggage, to the extent provided under subparagraphs 2(c) and 2(d) of this Article;

    • (b) immunity from legal process of any kind in respect of words spoken or written, and of acts performed by them, in their official capacity; such immunity to continue although the persons concerned may have ceased to be officials of the OPCW; in any event, such immunity, as well as any immunity provided under subparagraphs 2(c) and 2(d) of this Article, shall not extend to civil action by a third party for damage arising from an accident caused by a motor vehicle belonging to, driven by or operated on behalf of an official of the OPCW or in respect of a motor traffic offence involving such vehicle;

    • (c) exemption from taxation in respect of the salaries, emoluments, pay and indemnities paid to them, directly or indirectly, in respect of their employment with the OPCW; the Government shall not take income so exempted into account when assessing the amount of tax to be applied to income from other sources;

    • (d) exemption, with respect to themselves, their spouses, their dependent relatives and other members of their households, from immigration restrictions and alien registration;

    • (e) exemption, with respect to themselves, their spouses, their dependent relatives and other members of their households, from national service obligations, provided that, with respect to citizens of the Kingdom of the Netherlands, such exemption shall be confined to officials whose names have, by reason of their duties, been placed upon a list compiled by the Director-General and approved by the Government; provided further that should officials other than those listed, who are citizens of the Kingdom of the Netherlands, be called up for national service, the Government shall, upon request of the Director-General, grant such temporary deferments in the call-up of such officials as may be necessary to avoid interruption of the essential work of the OPCW;

    • (f) freedom to acquire or maintain within the Kingdom of the Netherlands or elsewhere foreign securities, foreign currency accounts and other movable and, under the same conditions applicable to citizens of the Kingdom of the Netherlands, immovable property; and at the termination of their employment with the OPCW the right to take out of the Kingdom of the Netherlands through authorised channels without prohibition, or restriction, their funds;

    • (g) the same protection and repatriation facilities with respect to themselves, their spouses, their dependent relatives and other members of their households as are accorded in time of international crisis to members, having comparable rank, of the staff of diplomatic missions established in the Kingdom of the Netherlands.

  • 2 In addition to the privileges and immunities specified in paragraph 1 of this Article:

    • (a) the Director-General shall be accorded the privileges and immunities, exemptions and facilities accorded to heads of diplomatic missions accredited to the Government in accordance with the Vienna Convention;

    • (b) the Deputy Directors-General shall also be accorded the privileges and immunities, exemptions and facilities accorded to heads of diplomatic missions accredited to the Government in accordance with the Vienna Convention;

    • (c) officials having the professional grade of P-5 and above, and such additional categories of officials as may be designated, in agreement with the Government, by the Director-General, in consultation with the Executive Council, on the grounds of the responsibilities of their positions in the OPCW, shall be accorded the same privileges and immunities, exemptions and facilities as the Government accords to diplomatic agents of comparable rank of the diplomatic missions established in the Kingdom of the Netherlands, in conformity with the Vienna Convention;

    • (d) officials having the grade of P-4 and below shall be accorded the same privileges and immunities, exemption and facilities as the Government accords to members of the administrative and technical staff of the diplomatic missions established in the Kingdom of the Netherlands, in conformity with the Vienna Convention, provided that the immunity from criminal jurisdiction and personal inviolability shall not extend to acts performed outside the course of their official duties;

    • (e) inspectors on mission shall be permitted to leave and enter the territory of the Kingdom of the Netherlands, by whatsoever means of transportation, with their equipment and with samples. The appropriate authorities of the Kingdom of the Netherlands shall provide them, where appropriate, with priority treatment and priority luggage handling with regard to customs and security controls. The transport of toxic chemicals shall comply with the rules and regulations of the Kingdom of the Netherlands concerning the handling of such articles.

  • 3 Officials of the OPCW who are Netherlands citizens or permanently resident in the Kingdom of the Netherlands shall enjoy the privileges and immunities, exemptions and facilities accorded by this Agreement to the extent recognised by international law, provided, however, that Article 22, paragraph 1 and Article 18, subparagraph 1(a) regarding their official baggage, and subparagraphs 1(b), 1(c) and 1(e) of this Agreement, shall, in any event, apply to them.

Article 19. Privileges and immunities of experts

  • 1 Experts shall enjoy, within and with respect to the Kingdom of the Netherlands, the following privileges and immunities so far as may be necessary for the effective exercise of their functions and during their journeys in connection with such functions and during attendance at the headquarters:

    • (a) immunity from personal arrest or detention and from inspection or seizure of their official baggage;

    • (b) immunity from legal process of any kind with respect to words spoken or written, and all acts done by them, in the performance of their official functions, such immunity to continue although the persons concerned may no longer be employed on missions for, serving on committees of, or acting as consultants for, the OPCW, or may no longer be present at the headquarters or attending meetings convened by the OPCW. In any event, such immunity shall not extend to civil action by a third party for damage arising from an accident caused by a motor vehicle belonging to, driven by or operated on behalf of the expert or in respect of a motor traffic offence involving such vehicle;

    • (c) inviolability of all papers, documents and other official material;

    • (d) the right, for the purpose of all communications with the OPCW, to use codes and to dispatch or receive papers, correspondence or other official material by courier or in sealed bags;

    • (e) exemption with respect to themselves and their spouses from immigration restrictions, alien registration and national service obligations;

    • (f) the same protection and repatriation facilities as are accorded in time of international crisis to members having comparable rank, of the staff of diplomatic missions established in the Kingdom of the Netherlands; and

    • (g) the same privileges with respect to currency and exchange restrictions as are accorded to representatives of foreign Governments on temporary official missions.

  • 2 Where the incidence of any form of taxation depends upon residence, periods during which the persons designated in paragraph 1 of this Article and who are not already residents of the Kingdom of the Netherlands, may be present in the Kingdom of the Netherlands for the discharge of their duties shall not be considered as periods of residence. In particular, such persons shall be exempt from taxation on their salaries and emoluments received from the OPCW during such periods of duty.

  • 3 Experts who are citizens of, or permanently resident in, the Kingdom of the Netherlands shall enjoy only the privileges and immunities, exemptions and facilities accorded by subparagraph 1(a) regarding their official baggage and subparagraphs 1(b), 1(c), 1(d) and 1(g) of this Article.

Article 20. Representatives and officials of states not Party to the Convention

The status of representatives and officials of States not Party to the Convention with which the OPCW has concluded agreements or arrangements in accordance with the Convention, who have official business with the OPCW, will be determined in such agreements or arrangements.

Article 21. Notification

  • 1 The OPCW shall promptly notify the Government of:

    • (a) the list of Heads of Delegation, Permanent Representatives, Delegates of States Parties and other persons within the scope of Articles 16, 17 and 19 of this Agreement, and shall revise such list from time to time as may be necessary;

    • (b) the appointment of the Director-General, the Deputy Directors-General, and other officials of the OPCW, their arrival and their final departure, or the termination of their functions with the OPCW;

    • (c) the arrival and final departure of members of the families forming part of the households of the persons referred to in subparagraph 1(b) of this Article and, where appropriate, the fact that a person has ceased to form part of the household; and

    • (d) the arrival and final departure of domestic employees of persons referred to in subparagraph 1(b) of this Article and, where appropriate, the fact that they are leaving the employ of such persons.

  • 2 The Government shall issue to Heads of Delegation, Permanent Representatives, Delegates of States Parties, other persons within the scope of Articles 16, 17 and 19 of this Agreement and members of their families who form part of their households and domestic employees of persons referred to under subparagraph 1(a) of this Article an identity card bearing the photograph of the holder. This card shall serve to identify the holder in relation to all authorities of the Kingdom of the Netherlands.

  • 3 The Government shall issue to the Director-General, the Deputy Directors-General and other officials of the OPCW and members of their families who form part of their households and domestic employees of persons referred to under subparagraph 1(b) of this Article an identity card bearing the photograph of the holder. This card shall serve to identify the holder in relation to all authorities of the Kingdom of the Netherlands.

Article 22. Social security

  • 1 For the social security scheme established by or conducted under the authority of the OPCW, the OPCW and the officials of the OPCW to whom the above-mentioned scheme applies shall be exempt from all compulsory contributions to the social security organisations of the Kingdom of the Netherlands. Consequently, they shall not be covered by the social security regulations of the Kingdom of the Netherlands.

  • 2 Any provident fund established by or conducted under the authority of the OPCW shall enjoy legal capacity in the Kingdom of the Netherlands if the OPCW so requests and shall enjoy the same exemptions, privileges and immunities as the OPCW itself.

  • 3 The provisions of paragraph 1 of this Article shall apply, mutatis mutandis, to spouses and dependent relatives forming part of the households of the persons referred to in paragraph 1 of this Article, unless they are employed in the Kingdom of the Netherlands by an employer other than the OPCW or receive Netherlands social security benefit.

Article 23. Employment

Spouses and members of the family forming part of the households of officials of the OPCW shall be granted temporary working permits for the duration of the employment of those officials with the OPCW in the Kingdom of the Netherlands.

Article 24. Additional provisions on privileges and immunities

  • 1 The privileges and immunities granted under the provisions of this Agreement are conferred in the interests of the OPCW and not for the personal benefit of the individuals themselves. It is the duty of the OPCW and all persons enjoying such privileges and immunities to observe in all other respects the laws and regulations of the Kingdom of the Netherlands.

  • 2 This Agreement shall apply irrespective of whether the Government maintains or does not maintain diplomatic relations with the State concerned and irrespective of whether the State concerned grants a similar privilege or immunity to the diplomatic envoys or citizens of the Kingdom of the Netherlands.

  • 3 The privileges and immunities granted to officials of the OPCW and experts under the provisions of this Agreement are granted on the understanding that the OPCW shall waive the immunity of the persons concerned in any circumstances in which the OPCW considers that such immunity would impede the course of justice, and whenever it can be waived without prejudice to the purpose for which it was granted.

  • 4 The OPCW shall cooperate at all times with the appropriate authorities of the Kingdom of the Netherlands to facilitate the proper administration of justice and shall prevent any abuse of the privileges and immunities granted under the provisions of this Agreement by officials of the OPCW.

  • 5 Should the Government consider that an abuse by an official of the OPCW or an expert of a privilege or immunity conferred by this Agreement has occurred, the Director-General shall, upon request, consult with the appropriate Netherlands authorities to determine whether any such abuse has occurred. If such consultations fail to achieve a result satisfactory to the Director-General and to the Government, the matter shall be determined in accordance with the procedure set out in Article 26, paragraph 2, of this Agreement.

  • 6 The Director-General shall have the right and the duty to waive the immunity of any official of the OPCW or of an expert in cases when the immunity would impede the course of justice and can be waived without prejudice to the interests of the OPCW. In respect of the Director-General, the OPCW has a similar right and duty, which shall be performed by the Executive Council.

Article 25. International responsibility of the Kingdom of The Netherlands

The Kingdom of the Netherlands shall not incur by reason of the location of the headquarters of the OPCW within its territory any international responsibility for acts or omissions of the OPCW or of its officials acting or abstaining from acting within the scope of their functions, other than the international responsibility which the Kingdom of the Netherlands would incur on the same footing as other States Parties.

Article 26. Settlement of disputes

  • 1 The OPCW shall make provision for appropriate methods of settlement of:

    • (a) disputes arising out of contracts and disputes of a private law character to which the OPCW is a party; and

    • (b) disputes involving an official of the OPCW or an expert who, by reason of his official position, enjoys immunity, if such immunity has not been waived by the OPCW.

  • 2 Any dispute between the OPCW and the Government concerning the interpretation or application of this Agreement, or any question affecting the headquarters or the relationship between the OPCW and the Government, which is not settled amicably, shall be referred for final decision to a tribunal of three arbitrators, at the request of either Party to the dispute. Each Party shall appoint one arbitrator. The third, who shall be chairman of the tribunal, is to be chosen by the first two arbitrators.

  • 3 If one of the Parties fails to appoint an arbitrator and has not taken steps to do so within two months following a request from the other Party to make such an appointment, the other Party may request the President of the International Court of Justice to make such an appointment.

  • 4 Should the first two arbitrators fail to agree upon the third within two months following their appointment, either Party may request the President of the International Court of Justice to make such an appointment.

  • 5 The tribunal shall conduct its proceedings in accordance with the Permanent Court of Arbitration Optional Rules for Arbitration Involving International Organisations and States, as in force on the date of the signature of this Agreement.

  • 6 The tribunal shall reach its decision by a majority of votes. Such decision shall be final and binding on the Parties to the dispute.

Article 27. Operation of this Agreement

  • 1 This Agreement shall be construed in the light of its primary purpose of enabling the OPCW at its headquarters in the Kingdom of the Netherlands fully and efficiently to discharge its responsibilities and fulfil its purposes.

  • 2 Whenever this Agreement imposes obligations on the appropriate authorities of the Kingdom of the Netherlands, the ultimate responsibility for the fulfilment of such obligations shall rest with the Government.

Article 28. Termination of the Agreement

This Agreement shall cease to be in force by mutual consent of the OPCW and the Government.

Article 29. Amendments

  • 1 This Agreement may be amended at any time.

  • 2 Any such amendment shall be agreed by mutual consent and shall be effected by an Exchange of Notes.

  • 3 Consultations with respect to amendment of this Agreement may be entered into by the OPCW and the Government at the request of either Party.

Article 30. The status of the Separate Arrangement

The Separate Arrangement concluded together with this Agreement forms an integral part thereof. Any reference to the Agreement includes the Separate Arrangement.

Article 31. Entry into force

  • 1 This Agreement shall enter into force on the day after both Parties have notified each other in writing that the legal requirements for entry into force have been complied with.

  • 2 With respect to the Kingdom of the Netherlands, this Agreement shall apply to the part of the Kingdom in Europe only.

Separate Arrangement with respect to the Agreement between the Organisation for the Prohibition of Chemical Weapons and the Kingdom of the Netherlands concerning the headquarters of the OPCW

1. Article 11, paragraph 2(c): “considerable expenditure”

For the purposes of exemption from value-added tax on any goods or services necessary for the OPCW's official activities involving considerable expenditure, “considerable expenditure” means, in accordance with the regulations in force, an amount above the threshold of Dfl. 500 per invoice.

2. Article 11, paragraph 4: “conditions agreed with the Government”

The Government hereby sets forth the conditions under which goods acquired or imported under the terms set out in paragraph 4 of Article 11 may be sold, given away, or otherwise disposed of.

  • (a) As a general principle, the Government grants the OPCW a fixed time period of five years for reducing to zero the value on sale/disposal, for the purpose of duties and tax exemptions, of all movable goods, except motor vehicles. After this five-year time period, goods may be sold free of taxes and duties. This “reduction” of all goods to zero value in a five-year period is accomplished in steps of 10% for each period of six months. However, if the local market value of the above-mentioned goods has declined to an amount lower than calculated above, this lower amount shall prevail.

  • (b) It is also understood as a general principle that the OPCW has the right to sell any of its goods at any time to a person or entity who/which is entitled in the Kingdom of the Netherlands to an exemption from taxes and/or duties on those goods. At an appropriate time, the Government will provide information concerning the standing procedure required to handle the exemption in those cases, not only for motor vehicles, but also for other goods.

  • (c) In the case of motor vehicles, the Government grants the OPCW the following rights:

    • (i) motor vehicles imported tax-exempt from within the European Union may be sold two years after their acquisition on condition that those cars be sold to entrepreneurs who have to take into account the standing procedures in the Kingdom of the Netherlands with respect to VAT; and

    • (ii) motor vehicles imported from outside the European Union exempt from duties and taxes may be sold two years after their acquisition on condition that those cars be sold to entrepreneurs whohave to take into account the standing procedures in the Kingdom of the Netherlands with respect to VAT and import duties.

  • (d) With respect to data processing and communications equipment, the Government grants the OPCW a fixed-term period of five years for reducing the value of the equipment to zero, as described in subparagraph 2(a) above. After a period of two years, the OPCW is also granted the right to sell the equipment to entrepreneurs who have to take into account the standing procedure in the Kingdom of the Netherlands with respect to VAT and/or import duties. If in practice certain equipment turns out to be no longer of use to the OPCW within a period shorter than two years, while it could still be sold to an entrepreneur, the Government is willing to favour a solution on an ad hoc basis. If the local market value of the above-mentioned goods has declined to an amount lower than calculated above, this lower amount shall prevail.

  • (e) It is understood that the OPCW also has the right to dispose of exempt purchased goods at any moment without payment or taxes and/or duties, through exportation to a country outside the European Union or by destroying them.

  • (f) The OPCW shall inform the Government of its disposal of exempt purchased goods. The procedure for informing the Government shall be effected in such a manner as to minimise the administrative burden.

3. Officials of the OPCW

  • (a) Subject to the provisions of Article 18 of the Headquarters Agreement, officials of the OPCW who are neither Netherlands citizens nor persons permanently resident in the Kingdom of the Netherlands shall, as far as the levying of Netherlands income tax is concerned, be taxed only on domestic income within the meaning of sections 48 and 49 of the 1964 Income Tax Act, received outside the OPCW function. As far as the levying of Netherlands wealth tax is concerned, only domestic wealth within the meaning of sections 12 and 13 of the 1964 Wealth Tax Act will be taxed. In this respect, the officials of the OPCW concerned are subject to the same treatment as members of diplomatic missions.

  • (b) Officials of the OPCW of grade P-5 and above shall be granted exemption from VAT, under article 33 in conjunction with article 36 of the Regulations implementing the 1959 State Taxes Act (Algemene wet inzake rijksbelastingen). The condition of reciprocity is not required.

  • (c) Officials of the OPCW who are eligible for the privileges and immunities laid down in the Vienna Convention shall be granted exemption from all taxes and duties if they import into or purchase within the European Union a motor vehicle intended for private use. After taxes and duties have been paid on the residual value of such a vehicle or after the car has been sold outside the European Union, another motor vehicle may be purchased tax-free. The exemption also applies to motor vehicle tax and excise duty on engine fuels. Officials of grade P-5 and above who live with their spouse shall also be granted exemption from all taxes related to a second motor vehicle in accordance with the regulations in force.

  • (d) Officials of the OPCW who are eligible for the privileges and immunities laid down in the Vienna Convention shall be granted diplomatic exemption from municipal taxes, including the user component of property tax.

  • (e) Officials of the OPCW shall, in accordance with the regulations in force, have relief from import duties, taxes, except payments for services, in respect of their furniture and personal effects and the right to export furniture and personal effects with relief from duty on termination of their duties in the Netherlands. Personal effects may include a reasonable number of cars that have been in use in the household and that are older than six months.

  • f. If the regulations relating to diplomatic staff or international officials who are deemed to be of the same status as officials of the OPCW are amended, the regulations applicable to officials of the OPCW will also be amended.

4. Additional provision

  • (a) If and to the extent that the Government shall, in the future, enter into an agreement with any intergovernmental organisation containing terms or conditions more favourable to that organisation than comparable terms or conditions in this Agreement, the Government shall extend such more favourable terms or conditions to the OPCW or to any person entitled to privileges and immunities under this Agreement.

  • (b) The Government shall inform the OPCW of the office designated by the Ministry of Foreign Affairs to serve as official contact point and to be primarily responsible for all matters in relation to this Agreement. The OPCW shall be informed promptly about this designation and of any subsequent changes in this regard.

Considérant que la Convention sur l'interdiction de la mise au point, de la fabrication, du stockage et de l'emploi des armes chimiques et sur leur destruction instituant l'Organisation pour l'interdiction des armes chimiques est entrée en vigueur le 29 avril 1997,

Considérant que l'Organisation pour l'interdiction des armes chimiques a son siège à La Haye (Royaume des Pays-Bas), conformément au paragraphe 3 de l'Article VIII de la Convention,

Ayant à l'esprit les dispositions de la Convention concernant le statut juridique et les privilèges et immunités de l'Organisation pour l'interdiction des armes chimiques et de ses organes, ainsi que les privilèges et immunités des chefs de délégation, des suppléants et des conseillers attachés aux chefs de délégation, des représentants permanents, des membres des missions permanentes, des délégués des Etats parties et du Directeur général de l'Organisation pour l'interdiction des armes chimiques et de ses fonctionnaires,

Ayant également à l'esprit les dispositions des annexes 2 et 3 de la Résolution sur la constitution de la Commission préparatoire de l'Organisation pour l'interdiction des armes chimiques,

Considérant que l'établissement du siège de l'Organisation pour l'interdiction des armes chimiques sur le territoire du Royaume des Pays-Bas, à La Haye, exige la conclusion d'un accord,

Sont convenus de ce qui suit:

Article premier. Définitions

Aux fins du présent accord:

  • a) l'expression «Convention» désigne la Convention du 13 janvier 1993 sur l'interdiction de la mise au point, de la fabrication, du stockage et de l'emploi des armes chimiques et sur leur destruction;

  • b) l'expression «OIAC» désigne l'Organisation pour l'interdiction des armes chimiques;

  • c) l'expression «Gouvernement» désigne le Gouvernement du Royaume des Pays-Bas;

  • d) l'expression «autorités compétentes du Royaume des Pays-Bas» désigne les autorités nationales, municipales ou autres du Royaume des Pays-Bas compétentes à l'égard des dispositions pertinentes du présent accord et en conformité avec les lois et coutumes applicables dans le Royaume des Pays-Bas;

  • e) l'expression «parties» désigne l'OIAC et le Royaume des Pays-Bas;

  • f) l'expression «siège» désigne le site et tout bâtiment, y compris tout laboratoire de l'OIAC, magasin de matériel, salle de conférences, partie de bâtiment, terrain et installation en dépendant, quelle qu'en soit la propriété, utilisés par l'OIAC de façon permanente ou temporaire, pour l'exercice de ses fonctions officielles;

  • g) l'expression «Directeur général» désigne le Directeur général visé au paragraphe 41 de l'Article VIII de la Convention;

  • h) l'expression «Etat partie» désigne un Etat qui est partie à la Convention;

  • i) l'expression «chef de délégation» désigne le chef accrédité de la délégation d'un Etat partie à la Conférence des Etats parties et/ou au Conseil exécutif;

  • j) l'expression «suppléants et conseillers des chefs de délégation» désigne les suppléants et les conseillers attachés aux chefs de délégation;

  • k) l'expression «représentant permanent» désigne le représentant principal d'un Etat partie accrédité auprès de l'OIAC;

  • l) l'expression «membre de la mission permanente d'un Etat partie» désigne tout membre de la mission du représentant permanent auprès de l'OIAC;

  • m) l'expression «délégués des Etats parties» désigne les représentants désignés des Etats parties et les membres de leurs délégations à toute réunion de l'OIAC autre que la Conférence des Etats parties ou une réunion du Conseil exécutif;

  • n) l'expression «experts» désigne les personnes effectuant des missions autorisées par l'OIAC, participant aux travaux de l'un de ses organes auxiliaires ou donnant, de quelque manière, des avis à l'OIAC à sa demande, à condition qu'elles ne soient ni fonctionnaires de l'OIAC ni attachées à des représentants permanents;

  • o) l'expression «fonctionnaires de l'OIAC» désigne le Directeur général et tous les membres du personnel du Secrétariat technique de l'OIAC, à l'exception de ceux qui sont recrutés sur place et payés à l'heure;

  • p) l'expression «inspecteurs en mission» désigne les membres d'une équipe d'inspection visée par la Convention (paragraphe 17 de la première partie de l'Annexe sur la vérification) qui détiennent un mandat d'inspection émis par le Directeur général pour mener une inspection conformément à la Convention;

  • q) l'expression «réunions convoquées par l'OIAC» désigne les réunions des organes ou organes auxiliaires de l'OIAC, ou toute conférence internationale ou autre assemblée convoquée par l'OIAC ou organisée sous son égide;

  • r) l'expression «biens» désigne tous les biens, avoirs et fonds appartenant à l'OIAC ou détenus ou gérés par elle dans l'exercice de ses fonctions en vertu de la Convention, ainsi que tous les revenus de l'OIAC;

  • s) l'expression «échantillons» désigne des échantillons au sens où ce terme est défini dans la Convention;

  • t) l'expression «archives de l'OIAC» désigne tous les comptes rendus, la correspondance, les documents, les manuscrits, les états informatisés et sur supports d'information, les photographies, les pellicules, les vidéos et les enregistrements sonores appartenant à l'OIAC ou détenus par elle ou par ses fonctionnaires dans l'exercice de leurs fonctions officielles, ainsi que tout autre matériel dont le Directeur général et le Gouvernement pourront convenir qu'il fait partie des archives de l'OIAC;

  • u) l'expression «Convention de Vienne» désigne la Convention de Vienne sur les relations diplomatiques du 18 avril 1961.

Article 2. Personnalité juridique

L'OIAC possède la pleine personnalité juridique. En particulier, elle a la capacité:

  • a) de passer des contrats;

  • b) d'acquérir et d'aliéner des biens meubles et immeubles;

  • c) d'ester en justice.

Article 3. Liberté de réunion

  • 1 Le Gouvernement reconnaît le droit de l'OIAC de convoquer des réunions à son gré à son siège de La Haye ou, avec l'accord du Gouvernement ou des autorités néerlandaises compétentes désignées par lui, en d'autres lieux sur le territoire du Royaume des Pays-Bas.

  • 2 Le Gouvernement garantit à l'OIAC la pleine liberté de réunion ainsi que la pleine liberté des débats et des décisions. Le Gouvernement prendra toutes mesures appropriées pour qu'aucun obstacle ne soit mis au déroulement des travaux des réunions convoquées par l'OIAC.

Article 4. Immunité de juridiction

  • 1 L'OIAC, dans le cadre de ses activités officielles, jouit de l'immunité de juridiction, sauf dans le cas:

    • a) d'une action civile intentée par un tiers à raison de dommages découlant d'un accident causé par un véhicule appartenant à l'Organisation ou utilisé pour son compte, si lesdits dommages ne sont pas couverts par une assurance;

    • b) d'une action civile concernant un acte ou une omission de l'Organisation ou de ses fonctionnaires ayant causé mort d'homme ou des dommages corporels sur le territoire du Royaume des Pays-Bas.

  • 2 Nonobstant les dispositions du paragraphe 1 du présent article, les biens de l'OIAC, en quelque endroit qu'ils se trouvent et quel qu'en soit le détenteur, sont exempts de perquisition, forclusion, saisie-exécution et saisie-arrêt sous toutes leurs formes, injonction ou autres actions judiciaires, sauf dans la mesure où l'OIAC, dans un cas particulier, a expressément renoncé à son immunité. Toutefois, la renonciation ne peut s'étendre aux mesures d'exécution.

Article 5. Autres formes d'immunité de juridiction des biens de l'OIAC, inviolabilité des archives, échantillons, matériel et autres biens

  • 1 Les biens de l'OIAC, en quelque endroit qu'ils se trouvent et quel qu'en soit le détenteur, sont exempts de perquisition, réquisition, saisie, confiscation, expropriation et de toute autre forme de contrainte résultant d'une décision gouvernementale, administrative ou judiciaire ou prescrite par le législateur.

  • 2 Les archives et les échantillons de l'OIAC, où qu'ils se trouvent et quel qu'en soit le détenteur, sont inviolables en tout temps.

  • 3 Le matériel et les autres biens nécessaires aux activités de l'OIAC sont inviolables en tout temps.

Article 6. Siège

Les autorités compétentes du Royaume des Pays-Bas prennent toutes les mesures nécessaires pour que l'OIAC ne soit pas dépossédée du siège, ou d'une partie du siège.

Article 7. Loi et autorité au siège

  • 1 Le Gouvernement reconnaît l'inviolabilité en tout temps du siège, qui est sous le contrôle et l'autorité de l'OIAC conformément aux dispositions du présent accord.

  • 2 L'OIAC a le droit d'édicter des règlements, applicables au siège, pour y créer les conditions nécessaires au plein exercice de ses attributions. Dans la mesure où les lois du Royaume des Pays-Bas seraient incompatibles avec l'un desdits règlements de l'OIAC, elles ne sont pas applicables au siège. Tout différend entre l'OIAC et le Royaume des Pays-Bas sur la question de savoir si un règlement de l'OIAC est conforme au présent article, ou si une loi du Royaume des Pays-Bas est incompatible avec l'un des règlements édictés par l'OIAC en vertu du présent article, doit être rapidement réglé selon la procédure prévue au paragraphe 2 de l'article 26 du présent accord. Jusqu'à la solution du différend, le règlement de l'OIAC reste applicable et la loi du Royaume des Pays-Bas n'est pas applicable à l'intérieur du siège dans la mesure où l'OIAC la déclare incompatible avec ledit règlement.

  • 3 L'OIAC informe le Gouvernement des règlements qu'elle a édictés en vertu du paragraphe 2 du présent article.

  • 4 Les personnes autorisées à pénétrer dans un lieu en vertu des dispositions juridiques applicables s'abstiennent d'exercer ce pouvoir en ce qui concerne le siège, sauf à y avoir été expressément autorisées par le Directeur général ou en son nom. Toute personne ayant pénétré dans les locaux du siège avec l'autorisation du Directeur général les quitte immédiatement si la demande lui en est faite par le Directeur général ou en son nom.

  • 5 Le présent article ne fait pas obstacle à l'application raisonnable des règlements de protection contre l'incendie édictés par les autorités néerlandaises compétentes. L'autorisation du Directeur général d'entrer à l'intérieur du siège est présumée s'il n'est pas possible de le joindre ou de joindre son représentant autorisé à temps.

  • 6 La signification des actes de procédure ne peut avoir lieu au siège qu'avec le consentement préalable du Directeur général et dans les conditions acceptées par lui.

  • 7 Le Directeur général empêche que le siège ne devienne le refuge de personnes tentant d'échapper à une arrestation ordonnée en exécution d'une loi du Royaume des Pays-Bas, ou recherchées par le Gouvernement pour être extradées vers un autre pays, ou cherchant à se dérober à la signification d'un acte de procédure.

Article 8. Protection du siège

  • 1 Les autorités compétentes du Royaume des Pays-Bas prennent toutes mesures appropriées afin que la sécurité et la tranquillité du siège ne soient pas troublées par des personnes ou des groupes de personnes qui chercheraient à y pénétrer sans autorisation ou qui provoqueraient des désordres dans son voisinage immédiat. A cette fin et en tant que de besoin, les autorités compétentes assurent une protection policière adéquate aux limites et dans le voisinage du siège.

  • 2 A la demande du Directeur général, les autorités néerlandaises compétentes fournissent des forces de police suffisantes pour assurer le maintien de l'ordre à l'intérieur du siège.

  • 3 Les autorités néerlandaises compétentes prennent toutes mesures raisonnables pour que l'usage qui pourrait être fait des terrains ou bâtiments avoisinant le siège ne diminue pas les agréments de celui-ci et ne gêne pas son utilisation aux fins prévues. L'OIAC prend, de son côté, toutes mesures raisonnables pour que l'usage qui pourrait être fait des terrains et bâtiments situés dans le siège ne diminue pas les agréments des terrains situés dans le voisinage de ce dernier.

Article 9. Services publics fournis au siège

  • 1 Les autorités néerlandaises compétentes font usage de leurs pouvoirs, dans les limites de leurs compétences et dans la mesure où le Directeur général le demande, pour assurer, à des conditions justes et équitables, la fourniture au siège des services publics nécessaires, notamment, mais sans que cette énumération soit limitative: l'électricité, l'eau, le service des égouts, le gaz, les services postaux, téléphoniques et télégraphiques, les moyens de communication quels qu'ils soient, les transports locaux, l'évacuation des eaux, l'enlèvement des ordures, les services d'incendie et l'enlèvement de la neige sur la voie publique.

  • 2 En cas d'interruption ou de risque d'interruption de l'un de ces services, l'OIAC jouit de la priorité accordée aux administrations et organes essentiels du Gouvernement, qui prend les mesures appropriées pour éviter que les travaux de l'OIAC ne soient entravés.

  • 3 Le Directeur général prend, sur demande, les dispositions voulues pour que les représentants dûment autorisés des organismes compétents puissent inspecter, réparer, entretenir, reconstruire ou déplacer les installations des services publics, canalisations, conduites et égouts, à l'intérieur du siège, d'une manière qui ne gêne pas outre mesure l'exercice des fonctions de l'OIAC. Des travaux souterrains ne peuvent être entrepris dans le siège qu'en consultation avec le Directeur général ou un fonctionnaire qu'il aura désigné et dans des conditions qui ne gênent pas l'exercice des fonctions de l'OIAC.

  • 4 Si les services publics visés au paragraphe 1 sont fournis par des autorités néerlandaises compétentes, ou si les prix de ces fournitures sont soumis à leur contrôle, l'OIAC bénéficie de tarifs qui ne dépassent pas les plus bas tarifs consentis aux administrations et organes essentiels du Gouvernement.

Article 10. Facilités et immunités en matière de communications et de publications

  • 1 Le Gouvernement autorise l'OIAC à communiquer librement et sans avoir besoin d'autorisation expresse, à toutes fins officielles, et protège son droit de le faire. L'OIAC a le droit d'employer des codes, ainsi que d'expédier et de recevoir sa correspondance et ses autres communications officielles par des courriers ou des valises scellées qui bénéficient des mêmes privilèges et immunités que les courriers et valises diplomatiques.

  • 2 L'OIAC jouit pour ses communications officielles, dans la mesure où cela est compatible avec la Convention internationale des télécommunications du 6 novembre 1982, d'un traitement qui n'est pas moins favorable que le traitement accordé par le Gouvernement à toute autre organisation ou à tout autre gouvernement, y compris les missions diplomatiques de ce gouvernement, en matière de priorité et tarifs pour les envois postaux, les câblogrammes, les télégrammes, les télex, les radiotélégrammes, les émissions télévisées, les communications téléphoniques, les télécopies et autres communications, ainsi qu'en matière de tarifs de presse pour les informations à la presse et à la radio.

  • 3 Le Gouvernement reconnaît le droit de l'OIAC de publier et de diffuser librement des informations sur le territoire du Royaume des Pays-Bas aux fins spécifiées dans la Convention. Toutes les communications officielles adressées à l'OIAC et toutes les communications officielles émanant de l'OIAC, par quelque moyen ou sous quelque forme que ce soit, sont inviolables. Cette inviolabilité s'étend, sans que cette énumération soit limitative, aux publications, photographies, films cinématographiques, vidéos, pellicules, enregistrements sonores et logiciels.

  • 4 L'OIAC peut installer et utiliser un émetteur sans fil avec le consentement du Gouvernement, ledit consentement ne devant pas être indûment refusé dès lors que la longueur d'ondes aura été arrêtée d'un commun accord.

  • 5 La teneur des paragraphes 3 et 4 ne saurait être interprétée comme exemptant l'OIAC du respect de la législation du Royaume des Pays-Bas ou de toute autre convention internationale à laquelle le Royaume des Pays-Bas est partie en matière de droits d'auteur.

Article 11. Exonération d'impôts et de taxes pour L'OIAC et ses biens

  • 1 Dans le cadre de ses activités officielles, l'OIAC, ses avoirs, ses revenus et ses biens sont exemptés de tous impôts directs, qu'ils soient prélevés par les autorités nationales, provinciales ou locales.

  • 2 Dans le cadre de ses activités officielles, l'OIAC est exonérée:

    • a) de l'impôt sur les véhicules à moteur (motorrijtuigenbelasting);

    • b) de l'impôt sur les véhicules privés et les motocyclettes (BPM);

    • c) de la taxe à la valeur ajoutée payée sur tous les biens ou services fournis sur une base régulière ou représentant des dépenses considérables (omzetbelasting);

    • d) du droit d'accise (accijns) inclus dans le prix des boissons alcoolisées et des hydrocarbures;

    • e) des droits et taxes d'importation et d'exportation (belastingen bij invoer en uitvoer);

    • f) de la taxe d'assurance (assurantiebelasting);

    • g) de la taxe de mutation de biens immobiliers (overdrachtsbelasting);

    • h) de tout autre impôt ou taxe dont le caractère est en grande partie similaire aux impôts et taxes énoncés dans le présent paragraphe, imposé par les Pays-Bas après la date de signature du présent accord.

  • 3 Les exonérations prévues aux alinéas c, d, f et g du paragraphe 2 peuvent être accordées sous forme d'un remboursement à des conditions à convenir entre l'OIAC et le Gouvernement.

  • 4 Les biens acquis ou importés conformément aux dispositions du paragraphe 2 ne seront pas vendus, donnés ou aliénés de toute autre manière, si ce n'est conformément aux conditions convenues avec le Gouvernement.

  • 5 L'OIAC est habilitée à établir un économat hors taxes pour la vente de quantités limitées de certains articles pour usage ou consommation personnels, qu'il sera interdit de donner ou de vendre, à des conditions à convenir entre les parties. L'accès à l'économat est ouvert aux fonctionnaires de l'OIAC, à l'exception des ressortissants néerlandais et des résidents permanents du Royaume des Pays-Bas. Il peut également être ouvert aux chefs de délégation, aux représentants permanents, aux suppléants et conseillers des chefs de délégation, aux membres de missions permanentes et aux délégués des Etats parties jouissant du statut diplomatique.

Article 12. Exonération de restrictions en matière financière

Sans être astreinte à aucun contrôle, réglementation ou moratoire financier ou règles de notification des transactions financières, l'OIAC peut librement:

  • a) acheter toutes monnaies par les voies autorisées, les détenir et en disposer;

  • b) disposer de comptes en toutes monnaies;

  • c) acheter par les voies autorisées ou détenir des fonds, des valeurs et de l'or, et en disposer;

  • d) transférer ses fonds, ses valeurs, son or et ses devises du Royaume des Pays-Bas dans un autre pays, ou inversement, ou à l'intérieur du Royaume des Pays-Bas et convertir toutes devises détenues par elle en toute autre monnaie;

  • e) se procurer des fonds de toute autre manière qu'elle juge souhaitable; toutefois, lorsque cette opération aura lieu sur le territoire du Royaume des Pays-Bas, l'OIAC devra obtenir l'assentiment du Gouvernement.

Article 13. Exonération de restrictions en matière d'importation et d'exportation

Les articles importés ou exportés par l'OIAC à des fins officielles sont exonérés de toute interdiction et restriction imposée par le Gouvernement sur les importations et les exportations.

Article 14. Déplacements et séjours

  • 1 Le Gouvernement prend toutes mesures nécessaires pour faciliter et permettre l'entrée et le séjour sur le territoire du Royaume des Pays-Bas des personnes énumérées ci-après, quelle que soit leur nationalité, ne met aucun obstacle à leur sortie de ce territoire, veille à ce que leurs déplacements à destination ou en provenance du siège ne subissent aucune entrave et leur accorde la protection nécessaire pendant leurs déplacements:

    • a) les chefs de délégation, les suppléants et conseillers attachés aux chefs de délégation, les représentants permanents et les membres des missions permanentes des Etats parties, leurs familles et les autres membres de leur ménage, ainsi que les membres du personnel administratif et technique attachés aux chefs de délégation ou aux représentants permanents, et leurs conjoints et enfants à charge;

    • b) les délégués des Etats parties, leurs conjoints et enfants à charge, ainsi que les membres du personnel administratif et technique attaché aux délégués des Etats parties, et leurs conjoints et enfants à charge;

    • c) les fonctionnaires de l'OIAC, leurs familles et les membres à charge de leur ménage;

    • d) les représentants et les fonctionnaires des organisations internationales avec lesquelles l'OIAC a conclu des accords ou pris des arrangements conformément à la Convention et qui sont en mission auprès de l'OIAC, et leurs conjoints et enfants à charge;

    • e) les experts et leurs conjoints et enfants à charge.

  • 2 Le présent article ne s'applique pas dans les cas d'interruption générale des transports, qui seront traités comme il est prévu au paragraphe 2 de l'article 9 du présent accord, et ne fait pas obstacle à l'exécution des lois généralement applicables en ce qui concerne l'exploitation des moyens de transport.

  • 3 Les visas qui peuvent être nécessaires aux personnes mentionnées au présent article sont accordés libres de droits. Le Gouvernement prend toutes les mesures nécessaires pour que les visas soient délivrés aussi rapidement que possible pour permettre aux intéressés de remplir leur mission auprès de l'OIAC en temps utile.

  • 4 Les activités se rapportant à l'OIAC qu'exercent à titre officiel les personnes visées au paragraphe 1 ne sauraient en aucun cas constituer pour les autorités néerlandaises une raison d'empêcher lesdites personnes d'entrer sur le territoire du Royaume des Pays-Bas ou de le quitter, ou de les contraindre à le quitter.

  • 5 Le Gouvernement ne peut inviter aucune des personnes visées aux alinéas d et e du paragraphe 1, à l'exception des fonctionnaires des organisations internationales dont la procédure d'expulsion est prévue dans des accords spéciaux auxquels le Royaume des Pays-Bas est partie, à quitter le territoire du Royaume des Pays-Bas, sauf en cas d'abus du droit de résidence. Aucune procédure n'est engagée pour contraindre l'une des personnes susvisées à quitter le territoire du Royaume des Pays-Bas, sans l'approbation préalable du Ministre néerlandais des Affaires étrangères. Cette approbation ne peut être donnée qu'en concertation avec le Directeur général. Si une procédure d'expulsion est engagée contre une telle personne, le Directeur général a le droit d'intervenir ou de se faire représenter dans cette procédure pour le compte de la personne contre laquelle elle est engagée.

  • 6 Le présent article n'empêche pas que le Gouvernement exige des personnes qui revendiquent les droits accordés par le présent article qu'elles se plient aux mesures quarantenaires et aux règlements sanitaires.

  • 7 Le Directeur général et les autorités néerlandaises compétentes se consultent, à la demande de l'un d'eux, au sujet de mesures propres à faciliter l'entrée sur le territoire du Royaume des Pays-Bas de personnes venant de l'étranger qui désirent se rendre au siège et qui ne bénéficient pas des privilèges prévus dans le présent article.

Article 15. Missions permanentes aupres de L'OIAC

Les missions permanentes des Etats parties établies au Royaume des Pays-Bas, y compris leurs locaux tels que définis dans la Convention de Vienne, jouissent des privilèges et immunités accordés aux missions diplomatiques établies au Royaume des Pays-Bas conformément à la Convention de Vienne.

Article 16. Privilèges et immunités des chefs de délégation, des répresentants permanents auprès de l'OIAC et des membres du personnel des missions permanentes

  • 1 Les chefs de délégation et les représentants permanents ont droit, sur le territoire du Royaume des Pays-Bas, aux privilèges et immunités que le Gouvernement accorde aux chefs de mission diplomatique accrédités auprès du Royaume des Pays-Bas, conformément à la Convention de Vienne.

  • 2 Les membres du personnel des missions permanentes des Etats parties ont droit aux privilèges et immunités que le Gouvernement accorde au personnel de rang comparable des missions diplomatiques établies au Royaume des Pays-Bas, conformément à la Convention de Vienne.

  • 3 Les conjoints, les enfants et les membres à charge du ménage des personnes visées au présent article jouissent des mêmes privilèges et immunités que les conjoints, les enfants et les membres à charge du ménage des personnes des missions diplomatiques de rang comparable, en vertu de la Convention de Vienne.

Article 17. Privilèges et immunités des délégués et des suppléants et conseillers des chefs de délégation

  • 1 Sans préjudice des autres privilèges et immunités dont ils peuvent bénéficier dans l'exercice de leurs fonctions et au cours de leurs voyages à destination et en provenance du siège, les délégués des Etats parties et les suppléants et conseillers des chefs de délégation jouissent, sur le territoire et à l'égard du Royaume des Pays-Bas, des privilèges et immunités suivants:

    • a) Immunité d'arrestation ou de détention;

    • b) Immunité de juridiction pour leurs paroles, leurs écrits et tous les actes accomplis par eux dans l'exercice de leurs fonctions officielles; cette immunité subsiste même si les intéressés ont cessé d'exercer leurs fonctions;

    • c) Inviolabilité de tous papiers et documents officiels;

    • d) Droit de faire usage de codes et d'expédier ou de recevoir des papiers, de la correspondance et autres documents officiels par courriers ou par valises scellées;

    • e) Exemption, pour eux-mêmes, leurs conjoints et leurs enfants à charge, de toutes mesures restrictives relatives à l'immigration, de toutes formalités d'enregistrement des étrangers et de toutes obligations de service national;

    • f) Protection et facilités de rapatriement identiques à celles qui sont accordées en période de crise internationale au personnel de rang comparable des missions diplomatiques établies au Royaume des Pays-Bas;

    • g) Privilèges, en ce qui concerne les restrictions monétaires et de change, identiques à ceux que le Gouvernement accorde aux représentants de gouvernements étrangers en mission officielle temporaire;

    • h) Privilèges et facilités, en ce qui concerne leurs bagages personnels et officiels, identiques à ceux que le Gouvernement accorde au personnel de rang comparable des missions diplomatiques établies au Royaume des Pays-Bas.

  • 2 Les alinéas e à h du paragraphe 1 ne s'appliquent pas aux délégués des Etats parties qui sont ressortissants néerlandais ou résidents permanents du Royaume des Pays-Bas.

  • 3 Lorsque l'incidence d'un impôt quelconque est subordonnée au lieu de résidence de l'assujetti, les périodes pendant lesquelles les personnes visées au paragraphe 1 se trouvent sur le territoire du Royaume des Pays-Bas pour l'exercice de leurs fonctions ne sont pas considérées comme des périodes de résidence. En particulier, ces personnes sont exemptes de tout impôt sur les traitements et indemnités afférents auxdites périodes de service.

Article 18. Privilèges et immunités du directeur général et des autres fonctionnaires de l'OIAC

  • 1 Les fonctionnaires de l'OIAC jouissent, sur le territoire et à l'égard du Royaume des Pays-Bas, des privilèges et immunités suivants:

    • a) immunité d'arrestation ou de détention et d'inspection ou de saisie de leurs bagages officiels, dans la mesure prévue aux alinéas c et d du paragraphe 2;

    • b) immunité de juridiction pour leurs paroles, leurs écrits et les actes accomplis par eux en leur qualité officielle; cette immunité subsiste même si les intéressés ont cessé d'être fonctionnaires de l'OIAC; en tout état de cause, cette immunité, de même que toute immunité prévue aux alinéas c etd du paragraphe 2 ne s'applique pas à une action civile intentée par un tiers pour des dommages découlant d'un accident causé par un véhicule à moteur appartenant à l'OIAC, conduit par un fonctionnaire de l'OIAC ou utilisé pour son compte, ou au motif d'une infraction impliquant un tel véhicule;

    • c) exemption de tout impôt sur les traitements, émoluments, rémunérations et indemnités qui leur sont versés directement ou indirectement en raison de leur emploi au sein de l'OIAC; le Gouvernement ne prend pas ces revenus ainsi exemptés en considération lors du calcul du montant d'impôt à payer sur les revenus provenant d'autres sources;

    • d) exemption, pour eux-mêmes, leurs conjoints, les membres de leurs familles et les autres membres de leur ménage qui sont à leur charge, de toutes mesures restrictives relatives à l'immigration et de toutes formalités d'enregistrement des étrangers;

    • e) exemption, pour eux-mêmes, leurs conjoints, les membres de leurs familles et les autres membres de leur ménage qui sont à leur charge, de toutes obligations de service national; toutefois, en ce qui concerne les citoyens néerlandais, cette exemption est limitée aux fonctionnaires qui, en raison de leurs attributions, figurent sur une liste dressée par le Directeur général et approuvée par le Gouvernement; de plus, pour les fonctionnaires de nationalité néerlandaise ne figurant pas sur la liste précitée et appelés à remplir des obligations de service national, le Gouvernement accorde, sur la demande du Directeur général, les sursis nécessaires pour éviter toute interruption des activités essentielles de l'OIAC;

    • f) liberté d'acquérir ou de posséder sur le territoire du Royaume des Pays-Bas ou en tout autre lieu, des valeurs étrangères, des comptes en devises et d'autres biens meubles et immeubles, pour les immeubles toutefois exclusivement dans les mêmes conditions que celles applicables aux ressortissants néerlandais; et, lorsque leurs fonctions à l'OIAC prennent fin, droit de sortir leurs avoirs du territoire du Royaume des Pays-Bas, par les voies autorisées et sans aucune interdiction ni restriction;

    • g) protection et facilités de rapatriement, pour eux-mêmes, leurs conjoints, les membres de leurs familles et les autres membres de leur ménage qui sont à leur charge, identiques à celles qui sont accordées en période de crise internationale au personnel de rang comparable des missions diplomatiques établies au Royaume des Pays-Bas.

  • 2 Outre les privilèges et immunités mentionnés au paragraphe 1:

    • a) le Directeur général jouit des privilèges et immunités, exemptions et facilités accordés aux chefs de missions diplomatiques accrédités auprès du Gouvernement, conformément à la Convention de Vienne;

    • b) les Directeurs généraux adjoints jouissent également des privilèges et immunités, exemptions et facilités accordés aux chefs de missions diplomatiques accrédités auprès du Gouvernement, conformément à la Convention de Vienne;

    • c) les fonctionnaires de la classe P-5 et des classes supérieures ainsi que toutes autres catégories de fonctionnaires que le Directeur général, en consultation avec le Conseil exécutif et d'accord avec le Gouvernement, peut désigner en raison des responsabilités qui s'attachent à leurs fonctions à l'OIAC, jouissent des privilèges et immunités, exemptions et facilités que le Gouvernement accorde au personnel diplomatique de rang comparable des missions diplomatiques établies au Royaume des Pays-Bas, conformément à la Convention de Vienne;

    • d) les fonctionnaires de la classe P-4 et des classes inférieures jouis sent des mêmes privilèges et immunités, exemptions et facilités que le Gouvernement accorde aux membres du personnel administratif et technique des missions diplomatiques établies au Royaume des Pays-Bas, conformément à la Convention de Vienne, à condition que l'immunité de juridiction pénale et l'inviolabilité personnelle ne s'appliquent pas aux actes accomplis par eux en dehors de l'exercice de leurs fonctions officielles;

    • e) les inspecteurs en mission sont autorisés à quitter le territoire du Royaume des Pays-Bas et à y rentrer en empruntant n'importe quel moyen de transport, avec leur matériel et échantillons. Le cas échéant, les autorités compétentes du Royaume des Pays-Bas leur accordent un traitement prioritaire, ainsi qu'à leurs bagages, en ce qui concerne les contrôles de douane et de sécurité. Les produits chimiques toxiques doivent être transportés conformément à la réglementation néerlandaise relative à la manipulation de tels produits.

  • 3 Les fonctionnaires de l'OIAC qui sont des ressortissants néerlandais ou qui résident en permanence sur le territoire du Royaume des Pays-Bas jouissent des privilèges et immunités, exemptions et facilités accordés en vertu du présent accord dans la mesure où ceux-ci sont reconnus par la législation internationale, pour autant toutefois que le paragraphe 1 de l'article 22, l'alinéa a du paragraphe 1 de l'article 18, en ce qui concerne leurs bagages officiels, et les alinéas a du paragraphe 1 de l'article 18, en ce qui concerne leurs bagages officiels, et les alinéas b, c et e du paragraphe 1 s'appliquent à eux.

Article 19. Privilèges et immunités des experts

  • 1 Les experts jouissent, sur le territoire et à l'égard du Royaume des Pays-Bas, des privilèges et immunités ci-après, dans la mesure nécessaire à l'exercice satisfaisant de leurs fonctions, et ce au cours des déplacements qu'ils effectuent en vue d'exercer de telles fonctions et pendant qu'ils se trouvent dans le siège :

    • a) immunité d'arrestation ou de détention et d'inspection ou de saisie de leurs bagages officiels;

    • b) immunité de juridiction pour leurs paroles, leurs écrits et tous les actes accomplis par eux dans l'exercice de leurs fonctions officielles; cette immunité subsiste même si les intéressés ont cessé d'être en mission pour le compte de l'OIAC ou d'être membres de commissions de l'OIAC ou d'agir en qualité de consultants auprès de l'OIAC, ou d'être présents dans le siège, ou d'assister à des réunions convoquées par l'OIAC. En tout état de cause, cette immunité ne s'applique pas à une action civile intentée par un tiers pour des dommages découlant d'un accident causé par un véhicule à moteur appartenant à l'expert, conduit par lui ou utilisé pour son compte, ou au motif d'une infraction impliquant un tel véhicule;

    • c) inviolabilité de tous papiers et autres documents officiels;

    • d) droit, dans leurs communications avec l'OIAC, de faire usage de codes et d'expédier ou de recevoir des papiers, de la correspondance et autres documents officiels par courriers ou par valises scellées;

    • e) exemption, pour eux-mêmes et leurs conjoints, des mesures restrictives relatives à l'immigration, des formalités d'enregistrement des étrangers et des obligations de service national;

    • f) protection et facilités de rapatriement identiques à celles qui sont accordées en période de crise internationale au personnel de rang comparable des missions diplomatiques établies au Royaume des Pays-Bas;

    • g) privilèges, en ce qui concerne les restrictions monétaires et de change, identiques à ceux qui sont accordés aux représentants de gouvernements étrangers en mission officielle temporaire.

  • 2 Lorsque l'incidence d'un impôt quelconque est subordonnée au lieu de résidence de l'assujetti, les périodes pendant lesquelles les personnes visées au paragraphe 1 et qui ne résident pas déjà sur le territoire du Royaume des Pays-Bas se trouvent sur le territoire du Royaume des Pays-Bas pour l'exercice de leurs fonctions ne sont pas considérées comme des périodes de résidence. En particulier, ces personnes sont exemptes de tout impôt sur les traitements et les indemnités qu'elles ont reçus de l'OIAC pendant lesdites périodes de service.

  • 3 Les experts qui sont des ressortissants ou des résidents permanents du Royaume des Pays-Bas ne jouissent que des privilèges et immunités, dérogations et facilités accordés au titre de l'alinéa a du paragraphe 1, en ce qui concerne leurs bagages officiels, et au titre des alinéas b, c, d et g du paragraphe 1.

Article 20. Représentants et fonctionnaires d'états non parties à la Convention

Le statut légal des représentants et fonctionnaires d'Etats non parties à la Convention avec lesquels l'OIAC a conclu des accords ou des arrangements en vertu de la Convention et qui entretiennent des relations officielles avec l'OIAC, sera précisé dans lesdits accords ou arrangements.

Article 21. Notification

  • 1 L'OIAC notifie sans tarder au Gouvernement:

    • a) la liste des chefs de délégation, des représentants permanents, des délégués des Etats parties et des autres personnes visées aux articles 16, 17 et 19 du présent accord, et la met à jour chaque fois qu'il y a lieu;

    • b) la nomination du Directeur général, des directeurs généraux adjoints et des autres fonctionnaires de l'OIAC, leur arrivée et leur départ définitif, ou l'achèvement de leurs fonctions à l'OIAC;

    • c) l'arrivée et le départ définitif des membres de la famille des personnes visées à l'alinéa b du paragraphe 1 qui font partie de leur ménage et, lorsqu'il y a lieu, le fait qu'une personne a cessé de faire partie du ménage;

    • d) l'arrivée et le départ définitif des employés de maison des personnes visées à l'alinéa b du paragraphe 1 et, lorsqu'il y a lieu, le fait qu'ils quittent le service desdites personnes.

  • 2 Le Gouvernement délivre des cartes d'identité avec photographie aux chefs de délégation, aux représentants permanents, aux délégués des Etats parties, aux autres personnes visées aux articles 16, 17 et 19 du présent accord, ainsi qu'aux membres de leur famille qui font partie de leur ménage et aux employés de maison des personnes visées à l'alinéa a du paragraphe 1. Ces cartes identifient les titulaires auprès des autorités néerlandaises.

  • 3 Le Gouvernement délivre des cartes d'identité avec photographie au Directeur général, aux directeurs généraux adjoints et aux autres fonctionnaires de l'OIAC, ainsi qu'aux membres de leur famille qui font partie de leur ménage et aux employés de maison des personnes visées à l'alinéa b du paragraphe 1. Ces cartes identifient les titulaires auprès des autorités néerlandaises.

Article 22. Sécurité sociale

  • 1 En ce qui concerne le régime de sécurité sociale créé par l'OIAC, ou administré sous son autorité, l'OIAC et les fonctionnaires de l'OIAC auxquels s'applique ledit régime sont exonérés de toutes cotisations obligatoires aux caisses de sécurité sociale du Royaume des Pays-Bas. En conséquence, ils ne sont pas couverts par les règlements du Royaume des Pays-Bas relatifs à la sécurité sociale.

  • 2 Toute caisse de prévoyance établie par l'OIAC, ou administrée sous son autorité, a capacité juridique au Royaume des Pays-Bas, si l'OIAC en fait la demande, et jouit des mêmes exemptions, privilèges et immunités que l'OIAC.

  • 3 Les dispositions du paragraphe 1 s'appliquent mutatis mutandis aux conjoints et aux membres de la famille qui sont à la charge des personnes visées auparagraphe 1 qui font partie de leur ménage, à moins qu'ils ne soient employés sur le territoire du Royaume des Pays-Bas par un employeur autre que l'OIAC ou ne bénéficient du régime néerlandais de sécurité sociale.

Article 23. Emploi

Les conjoints et les membres de la famille des fonctionnaires de l'OIAC qui font partie de leur ménage reçoivent un permis de travail temporaire pour la durée de service des fonctionnaires à l'OIAC sur le territoire du Royaume des Pays-Bas.

Article 24. Dispositions additionnelles en matière de privilèges et d'immunités

  • 1 Les privilèges et immunités accordés en vertu des dispositions du présent accord sont conférés uniquement dans l'intérêt de l'OIAC et non pour le bénéfice personnel des intéressés. L'OIAC et toutes les personnes qui jouissent desdits privilèges et immunités ont l'obligation d'observer à tous autres égards les lois et règlements en vigueur au Royaume des Pays-Bas.

  • 2 Les dispositions du présent accord sont applicables, que le Gouvernement entretienne ou non des relations diplomatiques avec l'Etat intéressé et que l'Etat intéressé accorde ou non les mêmes privilèges ou immunités aux agents diplomatiques ou ressortissants du Royaume des Pays-Bas.

  • 3 Les privilèges et immunités sont accordés aux fonctionnaires de l'OIAC et aux experts conformément aux dispositions du présent accord étant entendu que l'OIAC lèvera l'immunité accordée aux intéressés dans tous les cas où, de l'avis de l'OIAC, cette immunité empêcherait la justice de suivre son cours et où il est possible de la lever sans porter préjudice aux fins pour lesquelles elle est accordée.

  • 4 L'OIAC collabore en tout temps avec les autorités compétentes du Royaume des Pays-Bas pour faciliter la bonne administration de la justice et prévient tout abus par les fonctionnaires de l'OIAC des privilèges et immunités qui leur sont accordés conformément aux dispositions du présent accord.

  • 5 Si le Gouvernement estime qu'il y a eu abus par un fonctionnaire de l'OIAC ou un expert d'un privilège ou d'une immunité conférés en vertu du présent accord, le Directeur général consulte, sur demande, les autorités néerlandaises compétentes, en vue de déterminer si un tel abus s'est produit. Si ces consultations n'aboutissent pas à un résultat satisfaisant pour le Directeur général et pour le Gouvernement, la question est réglée conformément à la procédure prévue au paragraphe 2 de l'article 26 du présent accord.

  • 6 Le Directeur général a le droit et le devoir de lever l'immunité accordée à un fonctionnaire de l'OIAC ou à un expert dans les cas où cette immunité empêcherait la justice de suivre son cours et où il est possible de la lever sans nuire aux intérêts de l'OIAC. A l'égard du Directeur général, l'OIAC a les mêmes droits et devoirs, lesquels sont exercés par le Conseil exécutif.

Article 25. Responsabilité internationale du Royaume des Pays-Bas

L'établissement du siège de l'OIAC sur son territoire ne confère pas au Royaume des Pays-Bas une responsabilité internationale du fait de l'OIAC ou de ses fonctionnaires agissant ou s'abstenant d'agir dans le cadre de leurs fonctions, en dehors de celle qui lui incomberait sur un pied d'égalité par rapport aux autres Etats parties.

Article 26. Règlement des différends

  • 1 L'OIAC prend des dispositions appropriées en vue du règlement satisfaisant :

    • a) des différends résultant de contrats et des différends de droit privé dans lesquels l'OIAC est partie;

    • b) des différends mettant en cause un fonctionnaire de l'OIAC ou un expert qui jouit de l'immunité en raison de sa fonction officielle, sauf si cette immunité a été levée par l'OIAC.

  • 2 Tout différend entre l'OIAC et le Gouvernement au sujet de l'interprétation ou de l'application du présent accord, ou toute question touchant le siège et les relations entre l'OIAC et le Gouvernement, qui n'est pas réglé à l'amiable, est soumis aux fins de décision définitive à un tribunal composé de trois arbitres, à la demande de l'une ou l'autre des parties. Chacune des parties désigne un arbitre, et les deux arbitres ainsi nommés désignent ensemble le troisième arbitre, qui préside le tribunal.

  • 3 Si l'une des parties ne désigne pas d'arbitre et n'a pas pris de dispositions à cette fin dans les deux mois suivant la demande de l'autre partie de procéder à cette désignation, cette dernière peut demander au Président de la Cour internationale de Justice de le faire.

  • 4 A défaut d'accord entre les deux arbitres sur le choix du troisième arbitre dans les deux mois suivant leur désignation, l'une ou l'autre des parties peut demander au Président de la Cour internationale de Justice de procéder à cette désignation.

  • 5 La procédure du tribunal est conforme au Règlement facultatif d'arbitrage pour les organisations internationales et les Etats de la Cour permanente d'arbitrage en vigueur à la date de la signature du présent accord.

  • 6 Le tribunal statue à la majorité des voix. La sentence est définitive et lie les parties.

Article 27. Application de l'accord

  • 1 Le présent accord sera interprété à la lumière de son but principal, qui est de permettre à l'OIAC d'exercer ses fonctions et d'atteindre ses objectifs pleinement et efficacement à son siège sur le territoire du Royaume des Pays-Bas.

  • 2 Le Gouvernement est responsable en dernier ressort de l'exécution par les autorités néerlandaises compétentes des obligations que le présent accord leur impose.

Article 28. Fin de l'accord

Le présent accord cessera d'être en vigueur si l'OIAC et le Gouvernement en sont ainsi convenus.

Article 29. Amendements

  • 1 Le présent accord peut être modifié à tout moment.

  • 2 Tout amendement doit être décidé d'un commun accord et s'effectue par un échange de notes.

  • 3 Le présent accord peut être amendé à la suite de consultations entamées à la demande de l'OIAC ou du Gouvernement.

Article 30. Statut légal de l'arrangement séparé

L'Arrangement séparé conclu en même temps que le présent accord en fait partie intégrante. Toute référence au présent accord comprend l'Arrangement séparé.

Article 31. Entrée en vigueur

  • 1 Le présent accord entrera en vigueur le lendemain du jour où les deux parties se seront informées réciproquement par écrit de l'accomplissement des formalités légales requises pour son entrée en vigueur.

  • 2 En ce qui concerne le Royaume des Pays-Bas, le présent accord ne s'appliquera qu'à la partie du Royaume située en Europe.

FAIT à La Haye le 22 mai 1997 en deux exemplaires en langues arabe, anglaise, chinoise, espagnole, française, russe et néerlandaise, chaque texte faisant également foi.

Arrangement séparé concernant l'Accord entre l'Organisation pour l'interdiction des armes chimiques et le Royaume des Pays-Bas relatif au siège de l'OIAC

1. Article 11, paragraphe 2 c): «dépenses considérables»

Aux fins de l'exonération de la taxe à la valeur ajoutée sur les biens ou services nécessaires aux activités officielles de l'OIAC qui entraînent des dépenses considérables, l'expression «dépenses considérables» signifie, conformément à la réglementation en vigueur, un montant supérieur à 500 florins par facture.

2. Article 11, paragraphe 4: «conditions convenues avec le Gouvernement»

Le Gouvernement énonce dans le présent arrangement les conditions dans lesquelles les biens acquis ou importés conformément aux dispositions du paragraphe 4 de l'article 11 peuvent être vendus, donnés ou aliénés de toute autre manière.

  • a) A titre de principe général, le Gouvernement accorde à l'OIAC un délai fixe de cinq ans pour ramener à zéro, aux fins de l'exonération de droits et de taxes, la valeur de la vente/de l'aliénation de tous les biens meubles, à l'exception des véhicules à moteur. Une fois écoulée cette période de cinq ans, les biens pourront être vendus en franchise de droits et de taxes. Cette «réduction» de tous les biens à la valeur zéro sur une période de cinq ans s'opère par tranches de 10 % pour chaque période de six mois. Toutefois, si la valeur des biens susmentionnés sur le marché local est ramenée à un montant inférieur à celui calculé ci-dessus, c'est le montant inférieur qui prévaut.

  • b) Il est également entendu à titre de principe général que l'OIAC a le droit de vendre à tout moment l'un quelconque de ses biens à une personne ou une entité qui est exonérée au Royaume des Pays-Bas du paiement de taxes et/ou de droits sur lesdits biens. Le moment venu, le Gouvernement fournira des informations concernant la procédure à suivre aux fins d'exonération dans ces cas, non seulement pour les véhicules à moteur mais aussi pour d'autres biens.

  • c) Dans le cas des véhicules à moteur, le Gouvernement donne à l'OIAC les droits suivants:

    • i) les véhicules à moteur importés hors taxes de pays membres de l'Union européenne peuvent être vendus deux ans après leur acquisition à condition que lesdits véhicules soient vendus à des chefs d'entreprise qui seront tenus de respecter les procédures en vigueur au Royaume des Pays-Bas en ce qui concerne la TVA;

    • ii) les véhicules à moteur importés de pays non membres de l'Union européenne en franchise de droits et de taxes peuvent être vendus deux ans après leur acquisition à condition que lesdits véhiculessoient vendus à des chefs d'entreprise qui seront tenus de respecter les procédures en vigueur au Royaume des Pays-Bas en ce qui concerne la TVA et les droits à l'importation.

  • d) S'agissant de matériel de traitement de données et de communications, le Gouvernement donne à l'OIAC un délai fixe de cinq ans pour ramener à zéro la valeur dudit matériel comme énoncé à l'alinéa a du paragraphe 2 ci-dessus. Une fois écoulée une période de deux ans, l'OIAC a également le droit de vendre ce matériel à des chefs d'entreprise qui seront tenus de respecter les procédures en vigueur au Royaume des Pays-Bas en ce qui concerne la TVA et/ou les droits à l'importation. S'il s'avère dans la pratique que certains éléments de ce matériel ne sont plus utiles à l'OIAC avant l'écoulement d'une période de deux ans, mais qu'ils peuvent encore être vendus à un chef d'entreprise, le Gouvernement est disposé à accepter une solution sur une base ad hoc. Si la valeur des biens susmentionnés sur le marché local est ramenée à un montant inférieur à celui calculé ci-dessus, cest le montant inférieur qui prévaut.

  • e) Il est entendu que l'OIAC a également le droit d'aliéner à tout moment des biens acquis hors taxes sans avoir à acquitter de taxes ni de droits, en les exportant dans un pays non membre de l'Union européenne ou en les détruisant.

  • f) L'OIAC informe le Gouvernement de l'aliénation de tout bien acquis hors taxes. La procédure administrative utilisée dans ce cas sera réduite au minimum.

3. Fonctionnaires de l'OIAC

  • a) Sous réserve des dispositions de l'article 18 de l'Accord de siège, les fonctionnaires de l'OIAC qui ne sont ni des ressortissants néerlandais ni des résidents permanents du Royaume des Pays-Bas ne sont imposés, en ce qui concerne l'impôt néerlandais sur le revenu, que sur les revenus nationaux au sens des sections 48 et 49 de la Loi de 1964 relative à l'impôt sur le revenu, perçus en dehors de l'exercice de leurs fonctions au sein de l'OIAC. En ce qui concerne l'impôt néerlandais sur la fortune, seule la fortune nationale au sens des sections 12 et 13 de la Loi de 1964 relative à l'impôt sur la fortune est imposable. A cet égard, les fonctionnaires concernés sont assujettis au même régime que les membres des missions diplomatiques.

  • b) Les fonctionnaires de l'OIAC de la classe P-5 et des classes supérieures sont exonérés de la TVA aux termes de l'article 33 et de l'article 36 du Décret d'application de la Loi de 1959 sur les impôts de l'Etat (Algemene wet inzake rijksbelastingen). La condition de réciprocité n'est pas requise.

  • c) Les fonctionnaires de l'OIAC qui remplissent les conditions en matière de privilèges et immunités énoncés dans la Convention de Vienne bénéficient de l'exemption de tous droits et taxes s'ils importent ou achètent dans les pays de l'Union européenne un véhicule à moteur pour leur usage personnel. Après paiement des droits et taxes sur la valeur résiduelle dudit véhicule ou après la vente dudit véhicule dans un pays non membre de l'Union européenne, un autre véhicule à moteur peut être acheté hors taxes. L'exemption s'applique également aux taxes sur les véhicules à moteur et aux impôts sur les carburants. Les fonctionnaires de la classe P-5 et des classes supérieures qui vivent avec leur conjoint sont également exonérés de toutes taxes relatives à un second véhicule à moteur, conformément à la réglementation en vigueur.

  • d) Les fonctionnaires de l'OIAC qui remplissent les conditions en matière de privilèges et immunités énoncés dans la Convention de Vienne bénéficient d'une exemption diplomatique des taxes municipales, notamment la partie de la taxe foncière due par l'occupant du logement.

  • e) Les fonctionnaires de l'OIAC, conformément à la réglementation en vigueur, sont exonérés des droits d'importation, des impôts, à l'exception des paiements pour les services, en ce qui concerne leur mobilier et effets personnels et ont le droit d'exporter du mobilier et des effets personnels en franchise lorsqu'ils cessent d'exercer leurs fonctions aux Pays-Bas. Les effets personnels peuvent comprendre un nombre raisonnable d'automobiles qui auront été utilisées dans le ménage et auront plus de six mois d'âge.

  • f) Si la réglementation relative au personnel diplomatique ou aux fonctionnaires internationaux réputés avoir le même statut que les fonctionnaires de l'OIAC est modifiée, la réglementation applicable aux fonctionnaires de l'OIAC sera également modifiée.

4. Disposition additionnelle

  • a) Si le Gouvernement conclut avec une organisation intergouvernementale un accord qui comprend des clauses et conditions plus favorables pour ladite organisation que les clauses et conditions analogues du présent accord, le Gouvernement en fera bénéficier l'OIAC ou toute personne ayant droit aux privilèges et immunités prévus dans le présent accord.

  • b) Le Gouvernement communique à l'OIAC le service désigné par le Ministère des Affaires étrangères pour servir de point de contact officiel auquel incombent au premier chef toutes les questions relatives au présent accord. L'OIAC est promptement informée, en temps utile, de ladite désignation et de toute modification ultérieure à cet égard.
