Protocol to the Convention on the Elaboration of a European Pharmacopoeia

Preamble

The member States of the Council of Europe which are Parties to the Convention on the Elaboration of a European Pharmacopoeia of 22 July 1964 drawn up within the Council of Europe's Partial Agreement in the Social and Public Health Field, hereinafter called “the Convention”,

Having regard to the Convention and particularly to the provisions of Article 1 thereof;

Considering that the European Economic Community has adopted rules particularly in the form of directives which apply to the matters covered by the Convention and that it is competent in this field;

Considering therefore that, for the purpose of implementing Article 1 of the Convention, it is necessary for the European Economic Community to be able to become a Party to the Convention;

Considering that, to that end, it is necessary to amend certain provisions of the Convention,

Have agreed as follows:

Article 1

Article 7

  • 1 This Protocol shall be open for signature by the member States of the Council of Europe having signed or acceded to the Convention which may express their consent to be bound by:

    • a. signature without reservation as to ratification, acceptance or approval; or

    • b. signature subject to ratification, acceptance of approval, followed by ratification, acceptance or approval.

  • 2 No member State of the Council of Europe shall sign without reservation as to ratification, acceptance or approval, or deposit an instrument of ratification, acceptance or approval, unless it is already or becomes simultaneously Party to the Convention.

  • 3 Any State not a member of the Council of Europe which has acceded to the Convention may also accede to this Protocol.

  • 4 Instruments of ratification, acceptance, approval or accession shall be deposited with the Secretary General of the Council of Europe.

Article 8

This Protocol shall enter into force on the first day of the month following the expiration of a period of one month after the date on which all Parties to the Convention have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 7.

Article 9

The Secretary General of the Council of Europe shall notify the member States of the Council, any other Contracting State to the Convention and the European Economic Community of:

  • a. any signature;

  • b. the deposit of any instrument of ratification, acceptance, approval or accession;

  • c. any date of entry into force of this Protocol in accordance with Article 8;

  • d. any other act, notification or communication relating to this Protocol.

IN WITNESS WHEREOF the undersigned, being duly authorised thereto, have signed this Protocol.

DONE at Strasbourg, the 16th day of November 1989, in English and in French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe, to any other Contracting State of the Convention and to the European Economic Community.

Protocol bij het Verdrag inzake de samenstelling van een Europese farmacopee

Preambule

De Lidstaten van de Raad van Europa, Partij bij het Verdrag inzake de samenstelling van een Europese farmacopee van 22 juli 1964, opgesteld in het kader van het Partieel Akkoord van de Raad van Europa op sociaal gebied en op het gebied van de volksgezondheid, hierna te noemen „het Verdrag”,

Gelet op het Verdrag en met name de bepalingen in artikel 1;

Overwegende dat de Europese Economische Gemeenschap regels heeft aangenomen, in de vorm van richtlijnen, die van toepassing zijn op de onderwerpen die het Verdrag bestrijkt en dat zij terzake bevoegd is;

Overwegende dat het derhalve voor de toepassing van artikel 1 van het Verdrag van belang is dat de Europese Economische Gemeenschap Partij bij het Verdrag kan worden;

Overwegende dat hiertoe enkele bepalingen van het Verdrag dienen te worden gewijzigd,

Zijn het volgende overeengekomen:

Artikel 1

Artikel 7

  • 1 Dit Protocol staat open ter ondertekening door de Lidstaten van de Raad van Europa die het Verdrag hebben ondertekend of daartoe zijn toegetreden en die hun instemming kunnen betuigen erdoor te worden gebonden, door:

    • a. ondertekening zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring; of

    • b. ondertekening onder voorbehoud van bekrachtiging, aanvaarding of goedkeuring, gevolgd door bekrachtiging, aanvaarding of goedkeuring.

  • 2 Een Lidstaat van de Raad van Europa kan dit Protocol niet ondertekenen zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring of zijn akte van bekrachtiging, aanvaarding of goedkeuring nederleggen, tenzij hij reeds Partij bij het Verdrag is of dat tegelijkertijd wordt.

  • 3 De Staten die geen lid zijn van de Raad van Europa en die tot het Verdrag zijn toegetreden, kunnen eveneens toetreden tot dit Protocol.

  • 4 De akten van bekrachtiging, aanvaarding of goedkeuring worden nedergelegd bij de Secretaris-Generaal van de Raad van Europa.

Artikel 8

Dit Protocol treedt in werking op de eerste dag van de maand die volgt op het verstrijken van een tijdvak van een maand na de datum waarop alle Partijen bij het Verdrag hun instemming tot uitdrukking hebben gebracht door het Protocol te worden gebonden overeenkomstig de bepalingen van artikel 7.

Artikel 9

De Secretaris-Generaal van de Raad van Europa doet de Lidstaten van de Raad, de andere Verdragsluitende Staten en de Europese Economische Gemeenschap mededeling van:

  • a. iedere ondertekening;

  • b. de nederlegging van iedere akte van bekrachtiging, aanvaarding, goedkeuring of toetreding;

  • c. iedere datum van inwerkingtreding van dit Protocol overeenkomstig het bepaalde in artikel 8;

  • d. iedere andere handeling, kennisgeving of mededeling betrekking hebbend op dit Protocol.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe behoorlijk gemachtigd, dit Protocol hebben ondertekend.

GEDAAN te Straatsburg, de zestiende november 1989, in de Franse en de Engelse taal, zijnde beide teksten gelijkelijk gezaghebbend, in één enkel exemplaar, dat zal worden nedergelegd in het archief van de Raad van Europa. De Secretaris-Generaal van de Raad van Europa doet een voor eensluidend gewaarmerkt afschrift toekomen aan elk der Lidstaten van de Raad van Europa, aan de andere Verdragsluitende Staten en aan de Europese Economische Gemeenschap.
