European Convention on the compensation of victims of violent crimes

The member States of the Council of Europe, signatory hereto,

Considering that the aim of the Council of Europe is to achieve a greater unity between its members;

Considering that for reasons of equity and social solidarity it is necessary to deal with the situation of victims of intentional crimes of violence who have suffered bodily injury or impairment of health and of dependants of persons who have died as a result of such crimes;

Considering that it is necessary to introduce or develop schemes for the compensation of these victims by the State in whose territory such crimes were committed, in particular when the offender has not been identified or is without resources;

Considering that it is necessary to establish minimum provisions in this field;

Having regard to Resolution (77)27 of the Committee of Ministers of the Council of Europe on the compensation of victims of crime,

Have agreed as follows:

PART I. Basis Principles

Article 1

The Parties undertake to take the necessary steps to give effect to the principles set out in Part I of this Convention.

Article 2

  • 1 When compensation is not fully available from other sources the State shall contribute to compensate:

    • a. those who have sustained serious bodily injury or impairment of health directly attributable to an intentional crime of violence:

    • b. the dependants of persons who have died as a result of such crime.

  • 2 Compensation shall be awarded in the above cases even if the offender cannot be prosecuted or punished.

Article 3

Compensation shall be paid by the State on whose territory the crime was committed:

  • a. to nationals of the States party to this Convention;

  • b. to nationals of all member States of the Council of Europe who are permanent residents in the State on whose territory the crime was committed.

Article 4

Compensation shall cover, according to the case under consideration, at least the following items: loss of earnings, medical and hospitalisation expenses and funeral expenses, and, as regards dependants, loss of maintenance.

Article 5

The compensation scheme may, if necessary, set for any or all elements of compensation an upper limit above which and a minimum threshold below which such compensation shall not be granted.

Article 6

The compensation scheme may specify a period within which any application for compensation must be made.

Article 7

Compensation may be reduced or refused on account of the applicant's financial situation.

Article 8

  • 1 Compensation may be reduced or refused on account of the victim's or the applicant's conduct before, during or after the crime, or in relation to the injury or death.

  • 2 Compensation may also be reduced or refused on account of the victim's or the applicant's involvement in organised crime or his membership of an organisation which engages in crimes of violence.

  • 3 Compensation may also be reduced or refused if an award or a full award would be contrary to a sense of justice or to public policy ("ordre public").

Article 9

With a view to avoiding double compensation, the Sate or the competent authority may deduct from the compensation awarded or reclaim from the person compensated any amount of money received, in consequence of the injury or death, from the offender, social security or insurance, or coming from any other source.

Article 10

The State or the competent authority may be subrogated to the rights of the person compensated for the amount of the compensation paid.

Article 11

Each Party shall take appropriate steps to ensure that information about the scheme is available to potential applicants.

PART II. International Co-operation

Article 12

Subject to the application of bilateral or multilateral agreements on mutual assistance concluded between Contracting States, the competent authorities of each Party shall, at the request of the appropriate authorities of any other Party, give the maximum possible assistance in connection with the matters covered by this Convention. To this end, each Contracting State shall designate a central authority to receive, and to take action on, requests for such assistance, and shall inform thereof the Secretary General of the Council of Europe when depositing its instrument of ratification, acceptance, approval or accession.

Article 13

  • 1 The European Committee on Crime Problems (CDPC) of the Council of Europe shall be kept informed regarding the application of the Convention.

  • 2 To this end, each Party shall transmit to the Secretary General of the Council of Europe any relevant information about its legislative or regulatory provisions concerning the matters covered by the Convention.

PART III. Final Clauses

Article 14

This Convention shall be open for signature by the member States of the Council of Europe. It is subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 15

  • 1 This Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date on which three member States of the Council of Europe have expressed their consent to be bound by the Convention in accordance with the provisions of Article 14.

  • 2 In respect of any member State which subsequently expresses its consent to be bound by it, the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of the deposit of the instrument of ratification, acceptance or approval.

Article 16

  • 1 After the entry into force of this Convention, the Committee of Ministers of the Council of Europe may invite any State not a member of the Council of Europe to accede to this Convention by a decision taken by the majority provided for in Article 20.d of the Statute of the Council of Europe and by the unanimous vote of the representatives of the Contracting States entitled to sit on the Committee.

  • 2 In respect of any acceding State, the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of deposit of the instrument of accession with the Secretary General of the Council of Europe.

Article 17

  • 1 Any State may at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, specify the territory or territories to which this Convention shall apply.

  • 2 Any State may at any later date, by a declaration addressed to the Secretary General of the Council of Europe, extend the application of this Convention to any other territory specified in the declaration. In respect of such territory the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of receipt of such declaration by the Secretary General.

  • 3 Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn by a notification addressed to the Secretary General. The withdrawal shall become effective on the first day of the month following the expiration of a period of six months after the date of receipt of such notification by the Secretary General.

Article 18

  • 1 Any State may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, declare that it avails itself of one or more reservations.

  • 2 Any Contracting State which has made a reservation under the preceding paragraph may wholly or partly withdraw it by means of a notification addressed to the Secretary General of the Council of Europe. The withdrawal shall take effect on the date of receipt of such notification by the Secretary General.

  • 3 A Party which has made a reservation in respect of a provision of this Convention may not claim the application of that provision by any other Party; it may, however, if its reservation is partial or conditional, claim the application of that provision in so far as it has itself accepted it.

Article 19

  • 1 Any Party may at any time denounce this Convention by means of a notification addressed to the Secretary General of the Council of Europe.

  • 2 Such a denunciation shall become effective on the first day of the month following the expiration of a period of six months after the date of receipt of the notification by the Secretary General.

Article 20

The Secretary General of the Council of Europe shall notify the member States of the Council and any State which has acceded to this Convention, of:

  • a. any signature;

  • b. the deposit of any instrument of ratification, acceptance, approval or accession;

  • c. any date of entry into force of this Convention in accordance with Articles 15, 16 and 17;

  • d. any other act, notification or communication relating to this Convention.

IN WITNESS WHEREOF the undersigned, being duly authorised thereto, have signed this Convention.

DONE at Strasbourg, this 24th day of November 1983, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe and to any State invited to accede to this Convention.

Resolution (77)27 on the compensation of victims of crime

(Adopted by the Committee of Ministers on 28 September 1977, at the 275th meeting of the Ministers' Deputies)

The Committee of Ministers,

Recalling that one of the aims of the Council of Europe is to achieve greater unity among its members;

Believing that for reasons of equity and social solidarity it is necessary to deal with the situation of those who are victims of crime and in particular of those who suffered bodily injury and of dependants of those who are killed by crime;

Considering that the possibilities of compensation which are available to victims are often insufficient, in particular, when the offender has not been identified or is without resources:

Noting that with a view to remedying this situation many member states have already instituted special compensation schemes for victims while other member states are considering similar measures;

Considering that it is important and in the interest of victims to lay down guiding principles with a view to harmonising national provisions in this field,

I.

Recommends that the governments of the member states take into consideration the following principles:

  • 1. When compensation cannot be ensured by other means the state should contribute to compensate:

    • a. anyone who has sustained severe bodily injury as a result of crime,

    • b. the dependants of any person who died as a result of crime:

  • 2. As regards the crimes which caused the bodily injury, at least all intentional crimes of violence should be covered even if the offender could not be prosecuted;

  • 3. The compensation might be effected either within the framework of the social security system, or by the setting up of a special compensation scheme or by recourse to insurance;

  • 4. The compensation should be the fullest and fairest possible, taking into account the nature and the consequences of the injury;

  • 5. The compensation should include, in appropriate cases, at least loss of past and future earnings, increase of expenses, medical expenses, expenses of medical and professional rehabilitation, and funeral expenses;

  • 6. For practical or economic reasons, the compensation scheme might make provision for a minimum or a maximum. It might also be fixed on the basis of prefixed scales or of a percentage assessment of the injury. The payment of compensation might be limited to victims who are in a serious material situation;

  • 7. The compensation might take the form of a lump sum or of periodic payments;

  • 8. The compensation scheme should provide for the possibility of granting in urgent cases interim awards when there would be delay in determining the compensation;

  • 9. With a view to avoiding double compensation, any amount of money received or obtainable from other sources such as the offender, social security or private insurance might be deducted or reclaimed;

  • 10. The scheme might subrogate in the victim's claims, as far as possible without impairing the rehabilitation of the offender;

  • 11. The compensation might be reduced or refused on account of the victim's conduct and his relationship to the offender and his milieu;

  • 12. Except when special conventions apply, compensation shall be paid by the state on whose territory, including its ships and aircraft, the crime was committed;

  • 13. In respect of foreigners, the principle of reciprocity might be wholly or partially applied;

II.

Invites the governments of member states to inform the Secretary General of the Council of Europe every five years of the steps they have taken to implement this resolution.

De Staten die Lid zijn van de Raad van Europa en dit Verdrag hebben ondertekend,

Overwegend dat het doel van de Raad van Europa is het tot stand brengen van een grotere eenheid tussen de Leden van de Raad;

Overwegend dat het om redenen van billijkheid en sociale solidariteit noodzakelijk is een regeling te treffen voor de situatie van slachtoffers van opzettelijke geweldmisdrijven, die lichamelijk letsel of nadeel voor hun gezondheid hebben ondervonden, en van nabestaanden die ten laste kwamen van personen die tengevolge van dergelijke misdrijven zijn overleden;

Overwegend dat het noodzakelijk is regelingen in te voeren of te ontwikkelen voor de schadeloosstelling van deze slachtoffers door de Staat op het grondgebied waarvan die misdrijven werden gepleegd, met name wanneer de dader niet bekend is of geen financiële middelen bezit;

Overwegend dat het noodzakelijk is op dit gebied minimumbepalingen op te stellen;

Gelet op Resolutie (77)27 van het Comité van Ministers van de Raad van Europa inzake de schadeloosstelling van slachtoffers van misdrijven,

Zijn het volgende overeengekomen:

DEEL I. Grondbeginselen

Artikel 1

De Partijen verbinden zich de noodzakelijke maatregelen te nemen om de in Deel I van dit Verdrag opgenomen beginselen uit te voeren.

Artikel 2

  • 1 Wanneer schadeloosstelling niet volledig uit andere bron kan worden verzekerd, draagt de Staat bij aan de schadeloosstelling:

    • a. van hen die ernstig lichamelijk letsel of nadeel voor hun gezondheid hebben ondervonden als rechtstreeks gevolg van een opzettelijk geweldmisdrijf;

    • b. van nabestaanden die ten laste kwamen van personen die tengevolge van een dergelijk misdrijf zijn overleden.

  • 2 In de bovenvermelde gevallen wordt schadeloosstelling toegekend zelfs indien de dader niet kan worden vervolgd of gestraft.

Artikel 3

De schadeloosstelling wordt betaald door de Staat op het grondgebied waarvan het misdrijf werd gepleegd:

  • a. aan onderdanen van de Staten die partij zijn bij dit Verdrag;

  • b. aan onderdanen van alle Lid-Staten van de Raad van Europa, die permanent verblijven in de Staat op het grondgebied waarvan het misdrijf werd gepleegd.

Artikel 4

De schadeloosstelling omvat, afhankelijk van het desbetreffende geval, ten minste de volgende bestanddelen: verlies van inkomsten, medische kosten, ziekenhuiskosten en begrafeniskosten, alsmede, wat de nabestaanden betreft die ten laste van het slachtoffer kwamen, het verlies van inkomsten ter zake van levensonderhoud.

Artikel 5

In de regeling van schadeloosstelling kan, indien nodig, voor een of meer bestanddelen van de schadeloosstelling een boven- en een benedengrens worden vastgesteld, waarboven en waarbeneden geen schadeloosstelling wordt toegekend.

Artikel 6

In de regeling van schadeloosstelling kan een termijn worden vastgesteld waarbinnen de verzoeken tot schadeloosstelling moeten worden gedaan.

Artikel 7

De schadeloosstelling kan worden verminderd of geweigerd op grond van de financiële situatie van de verzoeker.

Artikel 8

  • 1 De schadeloosstelling kan worden verminderd of geweigerd op grond van het gedrag van het slachtoffer of de verzoeker vóór, tijdens of na het misdrijf, dan wel met betrekking tot het letsel of het overlijden.

  • 2 De schadeloosstelling kan eveneens worden verminderd of geweigerd op grond van het feit dat het slachtoffer of de verzoeker betrokken is bij georganiseerde misdaad of lid is van een organisatie die zich bezighoudt met het plegen van geweldmisdrijven.

  • 3 De schadeloosstelling kan eveneens worden verminderd of geweigerd indien toekenning - al dan niet volledig - in strijd zou zijn met het rechtsgevoel of met de openbare orde („ordre public").

Artikel 9

Ten einde dubbele schadeloosstelling te vermijden, kan de Staat of de bevoegde autoriteit eventuele bedragen die tengevolge van het letsel of het overlijden, van de dader, de sociale zekerheid, een verzekering, of uit welke andere bron ook, zijn ontvangen, van de toegekende schadeloosstelling aftrekken of deze van de degene die schadeloos is gesteld, terugvorderen.

Artikel 10

De Staat of de bevoegde autoriteit kan worden gesubrogeerd in de rechten van degene die schadeloos is gesteld voor het bedrag van de betaalde schadeloosstelling.

Artikel 11

Elke Partij neemt de nodige maatregelen om te verzekeren dat gegevens over de regeling voor eventuele verzoekers beschikbaar zijn.

DEEL II. Internationale samenwerking

Artikel 12

Onder voorbehoud van de toepassing van tussen de Verdragsluitende Staten gesloten bilaterale of multilaterale overeenkomsten inzake wederzijdse bijstand verlenen de bevoegde autoriteiten van elke Partij, op verzoek van de desbetreffende autoriteiten van elke andere Partij, bijstand van de grootst mogelijke omvang in verband met de aangelegenheden waarop dit Verdrag betrekking heeft. Met het oog hierop wijst elke Verdragsluitende Partij een centrale autoriteit aan voor het in ontvangst nemen van verzoeken om dergelijke bijstand en voor het treffen van maatregelen naar aanleiding daarvan, en stelt zij de Secretaris-Generaal van de Raad van Europa hiervan in kennis bij het nederleggen van haar akte van bekrachtiging, aanvaarding, goedkeuring of toetreding.

Artikel 13

  • 1 Het Europese Comité voor strafrechtelijke vraagstukken (CDPC) van de Raad van Europa wordt op de hoogte gehouden van de toepassing van het Verdrag.

  • 2 Met het oog hierop verstrekt elke Partij aan de Secretaris-Generaal van de Raad van Europa alle ter zake dienende gegevens aangaande haar wetgevende bepalingen of regelingen betreffende de aangelegenheden waarop het Verdrag betrekking heeft.

DEEL III. Slotbepalingen

Artikel 14

Dit Verdrag staat open voor ondertekening door de Lid-Staten van de Raad van Europa en dient te worden bekrachtigd, aanvaard of goedgekeurd. De akten van bekrachtiging, aanvaarding of goedkeuring worden nedergelegd bij de Secretaris-Generaal van de Raad van Europa.

Artikel 15

  • 1 Dit Verdrag treedt in werking op de eerste dag van de maand die volgt op het verstrijken van een periode van drie maanden na de datum waarop drie Lid-Staten van de Raad van Europa hun instemming door het Verdrag te worden gebonden tot uiting hebben gebracht overeenkomstig het bepaalde in artikel 14.

  • 2 Ten aanzien van elke andere Lid-Staat die daarna zijn instemming door het Verdrag te worden gebonden tot uiting brengt, treedt deze in werking op de eerste dag van de maand die volgt op het verstrijken van een periode van drie maanden na de datum van de nederlegging van de akte van bekrachtiging, aanvaarding of goedkeuring.

Artikel 16

  • 1 Na de inwerkingtreding van dit Verdrag kan het Comité van Ministers van de Raad van Europa elke Staat die geen Lid is van de Raad van Europa uitnodigen tot dit Verdrag toe te treden, bij een besluit, genomen door de in artikel 20(d) van het Statuut van de Raad van Europa voorziene meerderheid, en bij algemene stemmen van de vertegenwoordigers van de Verdragsluitende Partijen die gerechtigd zijn in het Comité zitting te hebben.

  • 2 Ten aanzien van elke toetredende Staat treedt het Verdrag in werking op de eerste dag van de maand die volgt op het verstrijken van een periode van drie maanden na de datum van de nederlegging van de akte van toetreding bij de Secretaris-Generaal van de Raad van Europa.

Artikel 17

  • 1 Elke Staat kan bij de ondertekening of de nederlegging van zijn akte van bekrachtiging, aanvaarding, goedkeuring of toetreding het grondgebied of de grondgebieden aanwijzen waarop dit Verdrag van toepassing zal zijn.

  • 2 Elke Staat kan op elk later tijdstip, door middel van een verklaring, gericht aan de Secretaris-Generaal van de Raad van Europa, de toepassing van dit Verdrag uitbreiden tot elk ander, in de verklaring aangewezen grondgebied. Ten aanzien van een dergelijk grondgebied treedt het Verdrag in werking op de eerste dag van de maand die volgt op het verstrijken van een periode van drie maanden na de datum van ontvangst van de verklaring door de Secretaris-Generaal.

  • 3 Elke krachtens de twee voorgaande leden afgelegde verklaring kan, ten aanzien van elk in een dergelijke verklaring aangewezen grondgebied, worden ingetrokken door middel van een kennisgeving, gericht aan de Secretaris-Generaal. De intrekking wordt van kracht op de eerste dag van de maand die volgt op het verstrijken van een periode van zes maanden na de datum van ontvangst van die verklaring door de Secretaris-Generaal.

Artikel 18

  • 1 Elke Staat kan bij de ondertekening of de nederlegging van zijn akte van bekrachtiging, aanvaarding, goedkeuring of toetreding verklaren een of meer voorbehouden te maken.

  • 2 Elke Verdragsluitende Partij die een voorbehoud krachtens het vorige lid heeft gemaakt, kan dit geheel of gedeeltelijk intrekken door middel van een kennisgeving, gericht aan de Secretaris-Generaal van de Raad van Europa. De intrekking wordt van kracht op de datum van ontvangst van de kennisgeving door de Secretaris-Generaal.

  • 3 Een Partij die een voorbehoud heeft gemaakt met betrekking tot een bepaling van dit Verdrag kan niet de toepassing van die bepaling door een andere Partij eisen; indien haar voorbehoud gedeeltelijk of voorwaardelijk is, kan zij evenwel de toepassing van die bepaling eisen voor zo ver zij deze zelf heeft aanvaard.

Artikel 19

  • 1 Elke Partij kan dit Verdrag op elk ogenblik opzeggen door middel van een kennisgeving, gericht aan de Secretaris-Generaal van de Raad van Europa.

  • 2 Een dergelijke opzegging wordt van kracht op de eerste dag van de maand die volgt op het verstrijken van een periode van zes maanden na ontvangst van de kennisgeving door de Secretaris-Generaal.

Artikel 20

De Secretaris-Generaal van de Raad van Europa stelt de Lid-Staten van de Raad en elke Staat die tot dit Verdrag is toegetreden in kennis van:

  • a. elke ondertekening;

  • b. de nederlegging van elke akte van bekrachtiging, aanvaarding, goedkeuring of toetreding;

  • c. elke datum van inwerkingtreding van dit Verdrag overeenkomstig de artikelen 15, 16 en 17;

  • d. elke andere handeling, kennisgeving of mededeling met betrekking tot dit Verdrag.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe behoorlijk gemachtigd, dit Verdrag hebben ondertekend.

GEDAAN te Straatsburg, op 24 november 1983, in de Engelse en de Franse taal, zijnde beide teksten gelijkelijk authentiek, in één enkel exemplaar, dat zal worden nedergelegd in het archief van de Raad van Europa. De Secretaris-Generaal van de Raad van Europa doet een voor eensluidend gewaarmerkt afschrift toekomen aan elke Lid-Staat van de Raad van Europa en aan elke Staat die is uitgenodigd tot dit Verdrag toe te treden.
