The Embassy of the Federal Republic of Germany presents its compliments to the Ministry
of Foreign Affairs of the Kingdom of the Netherlands and has the honour to refer to
the Agreement on the resolution of practical problems with respect to deep seabed
mining areas concluded at New York on 14 August 1987, between the Governments of the
Kingdom of Belgium, Canada, the Republic of Italy, the Kingdom of the Netherlands
and the Union of Soviet Socialist Republics and the Exchange of Notes relating to
that Agreement dated 14 August 1987, between the Federal Republic of Germany and the
Union of Soviet Socialist Republics. In this connection the Embassy has the honour
to propose that the Government of the Kingdom of the Netherlands shall not take steps
to terminate that Agreement and the Government of the Federal Republic of Germany
shall not take steps to terminate the Agreement concluded by that Exchange of Notes,
except by common accord of the Government of the Federal Republic of Germany and the
Government of the Kingdom of the Netherlands.
This Agreement shall also apply to Land Berlin, provided that the Government of the
Federal Republic of Germany does not make a contrary declaration to the Government
of the Kingdom of the Netherlands within three months of the date of entry into force
of this Agreement.
If it is acceptable to the Government of the Kingdom of the Netherlands, this Note
and the Note in reply shall constitute an Agreement between the two Governments which
shall enter into force on the date on which the Government of the Federal Republic
of Germany will receive from the Government of the Kingdom of the Netherlands a notification
of the completion of the constitutional requirements in the Kingdom of the Netherlands.
The Embassy of the Federal Republic of Germany avails itself of this opportunity to
renew to the Ministry of Foreign Affairs the assurances of its highest consideration.
