Verdrag inzake sociale zekerheid tussen de Regering van het Koninkrijk der Nederlanden en de Regering van de Volksrepubliek China

Verdrag inzake sociale zekerheid tussen de Regering van het Koninkrijk der Nederlanden en de Regering van de Volksrepubliek China

De Regering van het Koninkrijk der Nederlanden (hierna te noemen Nederland of „de verdragsluitende partij”)

en

de Regering van de Volksrepubliek China (hierna te noemen China of „de verdragsluitende partij”),

Ernaar strevend de vriendschappelijke betrekkingen tussen Nederland en China te ontwikkelen, en

Geleid door de wens hun wederzijdse samenwerking op het gebied van sociale zekerheid te bevorderen, met name ter voorkoming van dubbele verzekering van bepaalde elementen uit hoofde van de stelsels van sociale zekerheid van beide landen,

Zijn het volgende overeengekomen:

Artikel 1. Begripsomschrijvingen

  • 1 Voor de toepassing van dit Verdrag wordt verstaan onder:

    • a. de uitdrukking „grondgebied”, wat de Volksrepubliek China betreft, het volledige grondgebied van de Volksrepubliek China waarop de Socialezekerheidswet van de Volksrepubliek China en overige relevante wet- en regelgeving van toepassing zijn, met inbegrip van haar landgebied, binnenwateren, territoriale zee en het luchtruim daarboven, alsmede elk gebied buiten haar territoriale zee waarbinnen de Volksrepubliek China soevereine rechten uitoefent of rechtsmacht heeft in overeenstemming met het internationale recht en haar nationale recht; en

      wat het Koninkrijk der Nederlanden betreft, het Europese deel van Nederland, met inbegrip van zijn territoriale zee en elk gebied buiten en grenzend aan zijn territoriale zee waarbinnen het Koninkrijk der Nederlanden, in overeenstemming met het internationale recht, rechtsmacht heeft of soevereine rechten uitoefent;

    • b. de uitdrukking „wetgeving”, wat China betreft, de wetten, de administratieve, ministeriële en lokale regels en voorschriften en de overige wettelijke bepalingen met betrekking tot de socialezekerheidsstelsels die onder de reikwijdte van dit Verdrag vallen [als genoemd] in artikel 2, eerste lid, onderdeel i; en

      wat Nederland betreft, de in artikel 2, eerste lid, onderdeel ii, genoemde wet- en regelgeving;

    • c. de uitdrukking „bevoegde autoriteit”, wat China betreft, het ministerie van Human Resources en Sociale Zekerheid; en

      wat Nederland betreft, de minister van Sociale Zaken en Werkgelegenheid;

    • d. de uitdrukking „bevoegde orgaan”, wat China betreft, de Sociale Verzekeringsadministratie van het ministerie van Human Resources en Sociale Zekerheid of andere door bovengenoemd ministerie aangewezen lichamen; en

      wat Nederland betreft, de Sociale Verzekeringsbank of andere door bovengenoemde minister aangewezen lichamen.

  • 2 Elke uitdrukking die niet wordt omschreven in het eerste lid van dit artikel heeft de betekenis die eraan wordt gegeven in de van toepassing zijnde wetgeving.

Artikel 2. Reikwijdte van de wetgeving

  • 1 Dit Verdrag is van toepassing op de wetgeving met betrekking tot de volgende sociale verzekeringen:

    • i. wat China betreft,

      • a. de basisouderdomsverzekering voor werknemers;

      • b. de werkloosheidsverzekering; en

    • ii. wat Nederland betreft,

      • a. ouderdom;

      • b. werkloosheid;

      • c. nabestaanden.

  • 2 Tenzij anders voorzien in dit Verdrag omvat de in het eerste lid van dit artikel bedoelde wetgeving geen verdragen inzake sociale zekerheid die tussen een verdragsluitende partij en een derde staat kunnen worden gesloten, of wetgeving die met het oog op de specifieke implementatie daarvan wordt uitgevaardigd.

Artikel 3. Personele werkingssfeer

Tenzij anders aangegeven is dit Verdrag van toepassing op alle personen die onderworpen zijn aan de wetgeving van een van de verdragsluitende partijen alsmede op andere personen die rechten ontlenen aan deze personen.

Artikel 4. Gelijkheid van behandeling

Tenzij anders voorzien in dit Verdrag hebben de in artikel 3 bedoelde personen van een verdragsluitende partij wanneer zij werken of verblijven op het grondgebied van de andere verdragsluitende partij, dezelfde rechten en verplichtingen als de onderdanen van die verdragsluitende partij wat betreft de toepassing van de wetgeving van die verdragsluitende partij.

Artikel 5. Algemene bepaling

Tenzij anders voorzien in dit Verdrag is op personen die als werknemer werkzaam zijn op het grondgebied van een verdragsluitende partij ter zake van dat dienstverband uitsluitend de wetgeving van die verdragsluitende partij van toepassing.

Artikel 6. Gedetacheerde werknemers

  • 1 Wanneer een persoon op wie de wetgeving van een verdragsluitende partij van toepassing is en die ten minste een maand direct voorafgaand aan de detachering werkzaam was voor een werkgever met een plaats van bedrijfsuitoefening op het grondgebied van die verdragsluitende partij die daar normaal gesproken werkzaamheden uitvoert, door dezelfde werkgever wordt gedetacheerd om werkzaamheden te verrichten op het grondgebied van de andere verdragsluitende partij, is de werknemer uitsluitend onderworpen aan de wetgeving van de eerste verdragsluitende partij als zou deze werknemer werkzaam zijn op het grondgebied van de eerste verdragsluitende partij, mits de duur van deze detachering niet langer is dan 60 maanden.

  • 2 Achtereenvolgende detacheringen van dezelfde werknemer binnen een tijdvak van 60 maanden gelden als één detachering, tenzij zij door een tijdvak van ten minste 12 maanden onderbroken zijn.

  • 3 Indien een persoon ingevolge het eerste lid onderworpen blijft aan de wetgeving van de ene verdragsluitende partij, is dat lid van overeenkomstige toepassing op de echtgenoot/echtgenote en kinderen die hem vergezellen, tenzij zij zelf als werknemer of zelfstandige werkzaam zijn op het grondgebied van de andere verdragsluitende partij.

  • 4 Het eerste lid van dit artikel is van toepassing wanneer een persoon die door zijn of haar werkgever naar het grondgebied van een derde staat wordt gezonden en op wie de wetgeving van de zendende verdragsluitende partij van toepassing blijft, vervolgens door deze werkgever van het grondgebied van de derde staat naar het grondgebied van de ontvangende verdragsluitende partij wordt gezonden.

  • 5 Indien de detachering langer duurt dan het in het eerste lid van dit artikel genoemde tijdvak, blijft de wetgeving van de eerste in dat lid genoemde verdragsluitende partij van toepassing mits de bevoegde autoriteiten of organen van de verdragsluitende partijen daarmee instemmen. De procedures voor deze voortgezette toepassing worden vermeld in het Memorandum van Overeenstemming dat overeenkomstig artikel 13, eerste lid, wordt gesloten.

Artikel 7. Zeevarenden

Een persoon die tewerkgesteld wordt aan boord van een zeeschip is onderworpen aan de wetgeving zoals omschreven in artikel 2 van de verdragsluitende partij wier vlag het schip voert.

Wanneer een persoon die gewoonlijk op het grondgebied van de ene verdragsluitende partij woont door een werkgever in dezelfde verdragsluitende partij tewerk wordt gesteld op een zeeschip dat vaart onder de vlag van de andere verdragsluitende partij, dan is de wetgeving van de eerste verdragsluitende partij op deze persoon van toepassing als zou de persoon werkzaam zijn op het grondgebied van de eerste verdragsluitende partij.

Dit artikel laat onverlet de verplichtingen van de reder ingevolge het Maritieme Arbeidsverdrag, 2006, (MLC, 2006) zoals vastgelegd in de nationale wet- en regelgeving van de verdragsluitende partij wier vlag het schip voert.

Artikel 8. Bemanning van luchtvaartuigen

Een persoon die als lid van de bemanning van een luchtvaartuig werkt, is, met betrekking tot die dienstbetrekking, uitsluitend onderworpen aan de wetgeving van de verdragsluitende partij op het grondgebied waarvan de werkgever zijn voornaamste plaats van bedrijfsuitoefening heeft. Indien de onderneming echter een filiaal of statutaire zetel op het grondgebied van de andere verdragsluitende partij heeft en deze persoon bij dat filiaal of deze zetel werkzaam is, is deze persoon uitsluitend onderworpen aan de wetgeving van de verdragsluitende partij op het grondgebied waarvan dat filiaal of die zetel is gevestigd.

Artikel 9. Ambtenaren, leden van diplomatieke vertegenwoordigingen en consulaire posten

  • 2 Ambtenaren van de ene verdragsluitende partij die naar het grondgebied van de andere verdragsluitende partij worden gezonden, zijn uitsluitend onderworpen aan de wetgeving van de eerste verdragsluitende partij als zou deze persoon werkzaam zijn op het grondgebied van de eerste verdragsluitende partij.

  • 3 Indien een persoon ingevolge het tweede lid onderworpen blijft aan de wetgeving van een verdragsluitende partij, is dat lid van overeenkomstige toepassing op de echtgenoot/echtgenote en kinderen die hem vergezellen, tenzij zij zelf als werknemer of zelfstandige werkzaam zijn op het grondgebied van de andere verdragsluitende partij.

  • 4 Wanneer een persoon die lokaal in dienst is genomen door een diplomatieke missie of consulaire post van een verdragsluitende partij tewerkgesteld wordt op het grondgebied van de andere verdragsluitende partij, is de wetgeving van de laatste verdragsluitende partij van toepassing op die persoon.

Artikel 10. Uitzonderingen

De bevoegde autoriteiten of de bevoegde organen van beide verdragsluitende partijen kunnen ermee instemmen om in het belang van bepaalde personen of categorieën personen uitzonderingen op de toepassing van de artikelen 5 tot en met 8 en artikel 9, tweede, derde en vierde lid, toe te staan, mits op de betreffende personen uitsluitend de wetgeving van een van de verdragsluitende partijen van toepassing is.

Artikel 11. Woonplaats

Een persoon die in overeenstemming met de bepalingen van dit Verdrag onderworpen is aan de wetgeving van Nederland wordt, wat betreft de verzekering ingevolge die wetgeving, beschouwd als wonend op het grondgebied van Nederland.

Artikel 12. Afgifte van verklaringen

In de omstandigheden omschreven in de artikelen 6 en 10 van dit Verdrag:

  • a. wordt, wanneer de wetgeving van China dient te worden toegepast, uiterlijk 6 maanden na aanvang van de detachering door het bevoegde orgaan in China de verklaring afgegeven waarop vermeld staat dat de werknemer aan deze wetgeving is onderworpen. In de verklaring staat de geldigheidsduur ervan vermeld en een afschrift wordt naar het bevoegde orgaan in Nederland verzonden.

  • b. wordt, wanneer de wetgeving van Nederland dient te worden toegepast, uiterlijk 6 maanden na aanvang van de detachering door het bevoegde orgaan in Nederland de verklaring waarop vermeld staat dat de werknemer aan deze wetgeving is onderworpen, afgegeven en door de rechtspersoon in China waar de werknemer wordt gedetacheerd bij het bevoegde orgaan in China ingediend. De verklaring dient de geldigheidsduur ervan te vermelden.

  • c. Indien de verklaring niet binnen de aangegeven 6 maanden na aanvang van de detachering wordt afgegeven of ingediend, kan het ontvangende bevoegde orgaan een latere aanvangsdatum van de detachering goedkeuren.

Artikel 13. Uitvoeringsregelingen

  • 1 De bevoegde autoriteiten van de verdragsluitende partijen sluiten een Memorandum van Overeenstemming waarin de maatregelen staan vervat die nodig zijn voor de uitvoering van dit Verdrag.

  • 2 De bevoegde autoriteiten van de verdragsluitende partijen stellen elkaar in kennis van eventuele wijzigingen van of aanvullingen op hun wetgeving die van invloed kunnen zijn op de uitvoering van dit Verdrag.

Artikel 14. Uitwisseling van informatie en wederzijdse bijstand

In antwoord op een schriftelijk verzoek verstrekken de bevoegde autoriteiten of bevoegde organen van de verdragsluitende partijen elkaar, voor zover zulks is toegestaan door hun respectieve wetgeving, informatie of wederzijdse bijstand voor de uitvoering van dit Verdrag.

Artikel 15. Voertaal

  • 1 Ten behoeve van de uitvoering van dit Verdrag is Engels de voertaal.

  • 2 Documenten, met name verklaringen, die voor de toepassing van dit Verdrag dienen te worden ingediend worden vrijgesteld van de vereisten voor authenticatie of soortgelijke formaliteiten.

Artikel 16. Beslechting van geschillen

Geschillen tussen de verdragsluitende partijen inzake de interpretatie of toepassing van dit Verdrag worden beslecht door middel van onderhandelingen en overleg tussen de bevoegde autoriteiten of bevoegde organen van de verdragsluitende partijen. Indien geschillen niet binnen een bepaald tijdsbestek worden opgelost, worden zij langs diplomatieke weg beslecht.

Artikel 17. Vertrouwelijkheid van informatie

  • 1 De bevoegde autoriteiten of bevoegde organen van een verdragsluitende partij zenden de bevoegde autoriteiten of bevoegde organen van de andere verdragsluitende partij in overeenstemming met haar wet- en regelgeving, uit hoofde van haar wetgeving verzamelde informatie over een natuurlijke persoon toe, voor zover deze informatie nodig is voor de uitvoering van dit Verdrag.

  • 2 Tenzij anderszins wordt vereist door de wet- en regelgeving van een verdragsluitende partij, wordt informatie over een natuurlijke persoon die in overeenstemming met de bepaling van het eerste lid van dit artikel door de andere verdragsluitende partij aan die verdragsluitende partij wordt toegezonden uitsluitend gebruikt voor de uitvoering van dit Verdrag. Op deze door een verdragsluitende partij ontvangen informatie is de wet- en regelgeving van deze verdragsluitende partij inzake de bescherming van de en vertrouwelijkheid van persoonsgegevens van toepassing.

Artikel 18. Overgangsbepaling

Bij de toepassing van artikel 6, eerste lid, worden in het geval van personen die vóór de inwerkingtreding van dit Verdrag werkzaam waren op het grondgebied van een verdragsluitende partij, de tijdvakken van detachering bedoeld in artikel 6, eerste lid, geacht te zijn begonnen op de datum van inwerkingtreding van dit Verdrag. De verklaring wordt uiterlijk 6 maanden na de inwerkingtreding van dit Verdrag en in overeenstemming met artikel 12 afgegeven of ingediend.

Artikel 19. Toetsing

  • 1 Dit Verdrag wordt door de verdragsluitende partijen getoetst op verzoek van een van de verdragsluitende partijen.

  • 2 Uiterlijk 10 jaar na de inwerkingtreding van dit Verdrag toetsen de verdragsluitende partijen gezamenlijk of het Verdrag dient te worden gewijzigd teneinde te waarborgen dat de volledige socialezekerheidsdekking voor personen van beide verdragsluitende partijen zoals aangegeven in artikel 3 onder dit Verdrag valt.

Artikel 20. Inwerkingtreding

De verdragsluitende partijen stellen elkaar langs diplomatieke weg schriftelijk in kennis van de voltooiing van hun respectieve interne juridische procedures die vereist zijn voor de inwerkingtreding van dit Verdrag. Het Verdrag treedt in werking op de eerste dag van de vierde maand na de datum van ontvangst van de laatste nota.

Artikel 21. Duur en beëindiging

Dit Verdrag wordt gesloten voor onbepaalde tijd en blijft van kracht tot en met de laatste dag van de twaalfde maand waarin een van de verdragsluitende partijen de andere verdragsluitende partij een schriftelijke kennisgeving van beëindiging doet toekomen.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd door hun respectieve regeringen, dit Verdrag hebben ondertekend.

GEDAAN in tweevoud te ’s-Gravenhage op 12 september 2016 in de Nederlandse, de Chinese en de Engelse taal, waarbij alle teksten gelijke geldigheid hebben. In geval van verschillen in uitlegging is de Engelse tekst doorslaggevend.

Agreement on Social Security between the Government of the Kingdom of the Netherlands and the Government of the People’s Republic of China

The Government of the Kingdom of the Netherlands (hereinafter referred to as the Netherlands or “the Contracting Party”)

and

the Government of the People’s Republic of China (hereinafter referred to as China or “the Contracting Party”),

Aiming to develop the friendly relations between the Netherlands and China, and

Being desirous of furthering their mutual cooperation in the field of social security, in particular, to prevent double coverage of certain elements under the social security systems of both countries,

Have agreed as follows:

Article 1. Definitions

  • 1 For the purpose of this Agreement:

    • a) The term “territory” means, as regards the People’s Republic of China, all the territory of the People’s Republic of China in which the Social Insurance Law of the People’s Republic of China and other relevant laws and regulations apply, including its land territory, internal waters, territorial sea and the air space above them, as well as any area beyond its territorial sea, within which the People’s Republic of China has sovereign rights or jurisdiction in accordance with international law and its domestic law; and

      as regards the Kingdom of the Netherlands, the European part of the Netherlands, including its territorial sea and any area beyond and adjacent to its territorial sea within which the Kingdom of the Netherlands, in accordance with international law, exercises jurisdiction or sovereign rights;

    • b) The term “legislation” means, as regards China, the laws, the administrative, ministerial, and local rules and regulations, and the other legal provisions concerning the social insurance systems covered by the scope of this Agreement in item i of Paragraph 1 of Article 2; and

      as regards the Netherlands, the laws and regulations specified in item ii of Paragraph 1 of Article 2;

    • c) The term “Competent Authority” means, as regards China, the Ministry of Human Resources and Social Security; and

      as regards the Netherlands, the Minister of Social Affairs and Employment;

    • d) The term “Competent Agency” means, as regards China, the Social Insurance Administration of the Ministry of Human Resources and Social Security or other bodies designated by the said Ministry; and

      as regards the Netherlands, the Social Insurance Bank or other bodies designated by the said Minister.

  • 2 Any term not defined in Paragraph 1 of this Article shall have the meaning assigned to it in the applicable legislation.

Article 2. Scope of Legislation

  • 1 This Agreement shall apply to the legislations related to the following social insurance schemes:

    • (i) as regards China,

      • a) Basic Old-Age Insurance for Employees;

      • b) Unemployment Insurance; and

    • (ii) as regards the Netherlands,

      • a) old-age;

      • b) unemployment;

      • c) survivors.

  • 2 Unless otherwise provided in this Agreement, the legislation referred to in Paragraph 1 of this Article shall not include treaties on social security that may be concluded between one Contracting Party and a third State, or legislation promulgated for their specific implementation.

Article 3. Personal Scope

Unless otherwise specified, this Agreement shall apply to all persons who are subject to the legislation of either of the Contracting Parties, and other persons who derive rights from such persons.

Article 4. Equal Treatment

Unless otherwise provided in this Agreement, persons referred to in Article 3 of one Contracting Party shall, when they work or reside in the territory of the other Contracting Party, have the same obligations and rights as nationals of that Contracting Party regarding the application of the legislation of that Contracting Party.

Article 5. General Provision

Unless otherwise provided in this Agreement, a person who works as an employee in the territory of one Contracting Party shall, with respect to that employment, be subject only to the legislation of that Contracting Party.

Article 6. Posted Workers

  • 1 Where a person who is covered under the legislation of one Contracting Party and who has been working in the territory of that Contracting Party for at least one month directly before posting for an employer with a place of business in the territory of that Contracting Party which normally carries out its activities there, is posted by the same employer, to work in the territory of the other Contracting Party, the employee shall be subject only to the legislation of the first Contracting Party as if that employee were working in the territory of the first Contracting Party, provided that the period of such posting does not exceed 60 months.

  • 2 Successive postings of the same employee within a period of 60 months shall be counted as one, unless they are separated by at least 12 months.

  • 3 If under Paragraph 1, a person continues to be subject to the legislation of one Contracting Party, that Paragraph shall also apply by analogy to the person’s spouse and children who accompany him, unless they are employed or self- employed in the territory of the other Contracting Party.

  • 4 Paragraph 1 of this Article shall apply where a person who has been sent by his or her employer to the territory of a third state and who remains subject to the legislation of the sending Contracting Party, is subsequently sent by that employer from the territory of the third state to the territory of the receiving Contracting Party.

  • 5 In case the posting continues beyond the period specified in Paragraph 1 of this Article, the legislation of the first Contracting Party referred to in that Paragraph shall continue to apply provided that the Competent Authorities or Agencies of the Contracting Parties agree. The procedures for that continued application shall be stated in the Memorandum of Understanding concluded in accordance with Paragraph 1 of Article 13.

Article 7. Seafarers

A person employed on board a sea-going ship shall be subject to the legislation as defined in Article 2 of the Contracting Party whose flag the ship flies.

However, where a person who ordinarily resides in the territory of one Contracting Party is sent by an employer in the same Contracting Party to work on board a sea-going vessel flying the flag of the other Contracting Party, the legislation of the first Contracting Party shall apply to this person as though the person were employed in the territory of the first Contracting Party.

This Article is without prejudice to the obligations of the ship-owner according to the Maritime Labour Convention 2006 (MLC, 2006) as defined in the national laws and regulations of the Contracting Party whose flag the ship flies.

Article 8. Aircraft Crew

A person who works as a member of the crew of an aircraft shall, with respect to that employment, be subject only to the legislation of the Contracting Party in the territory of which the employer’s principle place of business is located. If, however, the enterprise has a branch or registered office in the territory of the other Contracting Party, and such a person is employed by that branch or registered office, that person shall be subject only to the legislation of the Contracting Party in the territory of which the branch or registered office is located.

Article 9. Civil Servants, Members of Diplomatic Missions and Consular Posts

  • 2 Civil servants of one Contracting Party, who are sent to the territory of the other Contracting Party, shall be subject only to the legislation of the frst Contracting Party as if that person were working in the territory of the first Contracting Party.

  • 3 If under Paragraph 2, a person continues to be subject to the legislation of one Contracting Party, that Paragraph shall also apply by analogy to the person’s spouse and children who accompany him, unless they are employed or self-employed in the territory of the other Contracting Party.

  • 4 Where a person, locally engaged, is employed in a diplomatic mission or consular post of one Contracting Party in the territory of the other Contracting Party, the legislation of the latter Contacting Party shall apply to that person.

Article 10. Exceptions

The Competent Authorities or the Competent Agencies of the two Contracting Parties may agree to grant an exception on the application of Articles 5 to 8 and Paragraph 2, 3, 4 of Article 9, in the interest of particular persons or categories of persons, provided that the affected persons shall be subject to the legislation of one of the Contracting Parties.

Article 11. Residence

A person who is subject to the legislation of the Netherlands in accordance with the provisions of this Agreement shall, for being insured pursuant of that legislation, be considered as residing in the territory of the Netherlands.

Article 12. Issue of Certificates

In the circumstances described in Articles 6 and 10 of this Agreement:

  • a) Where the legislation of China is to be applied, the certificate shall be issued by the Competent Agency of China no later than 6 months from the start of the posting stating that the employee is subject to that legislation. The certificate shall include information on the period for which it is valid and a copy shall be sent to the Competent Agency of the Netherlands.

  • b) Where the legislation of the Netherlands is to be applied, the certificate shall be issued by the Competent Agency of the Netherlands and submitted to the Competent Agency of China by the legal entity in China where the employee is posted no later than 6 months from the start of the posting stating that the employee is subject to that legislation. The certificate shall include information on the period for which it is valid.

  • c) If the certificate is not issued or submitted within the indicated 6 months from the start of the posting, the receiving Competent Agency may approve a later date of the start of the posting.

Article 13. Implementing Arrangements

  • 1 The Competent Authorities of the Contracting Parties shall conclude a Memorandum of Understanding that sets out the measures necessary for the implementation of this Agreement.

  • 2 The Competent Authorities of the Contracting Parties shall inform each other of any amendments and additions to their legislation which may affect the implementation of this Agreement.

Article 14. Exchange of Information and Mutual Assistance

Responding to the written request, the Competent Authorities or the Competent Agencies of the Contracting Parties shall provide each other, to the extent permitted by their respective legislation, with any information and mutual assistance for the implementation of this Agreement.

Article 15. Language of Communication

  • 1 For the implementation of this Agreement, English shall be the language of communication.

  • 2 Documents, especially certificates, to be submitted in application of this Agreement shall be exempted from the requirements for any authentication or any similar formality.

Article 16. Settlement of Disputes

Disputes between the Contracting Parties regarding interpretation or application of this Agreement shall be settled through negotiation and consultation between the Competent Authorities or Competent Agencies of the Contracting Parties. If disputes are not resolved within a certain period of time, they shall be settled through diplomatic channels.

Article 17. Confidentiality of Information

  • 1 The Competent Authorities or Competent Agencies of one Contracting Party shall, in accordance with its laws and regulations, send to the Competent Authorities or Competent Agencies of the other Contracting Party information about an individual collected under its legislation insofar as the information is necessary for the implementation of this Agreement.

  • 2 Unless otherwise required by the laws and regulations of one Contracting Party, information about an individual which is transmitted in accordance with the provision of Paragraph 1 of this Article to that Contracting Party by the other Contracting Party shall be used exclusively for the purpose of implementing this Agreement. Such information received by one Contracting Party shall be governed by the laws and regulations of that Contracting Party for the protection of confidentiality of personal data.

Article 18. Transitional Provision

In applying Article 6, Paragraph 1, in case of persons who have been working in the territory of one Contracting Party prior to the date of entry into force of this Agreement, the periods of posting referred to in that Paragraph shall be considered to begin on the date of entry into force of this Agreement. The certificate shall be issued or submitted no later than 6 months after the date of entry into force of this Agreement and in accordance with Article 12.

Article 19. Review

  • 1 This Agreement shall be subject to review by the Contracting Parties at the request of one Contracting Party.

  • 2 No later than 10 years after this Agreement has entered into force, the Contracting Parties shall jointly review, if the Agreement should be amended to ensure that the complete social insurance coverage for persons as indicated in Article 3 of both Contracting Parties will be covered by this Agreement.

Article 20. Entry into Force

The Contracting Parties shall notify each other in writing, through diplomatic channels, of the completion of their respective internal legal procedures required for the entry into force of this Agreement. The Agreement shall enter into force on the first day of the fourth month after the date of receiving of the last note.

Article 21. Period of Duration and Termination

This Agreement shall be concluded for an indefinite period of time and remain in force and effect until the last day of the twelfth month in which written notice of its termination is given by either Contracting Party to the other Contracting Party.

IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.

DONE in duplicate at The Hague, on this 12 September 2016, in the Dutch, Chinese and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
