The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Organisation for the Prohibition of Chemical Weapons and, with reference to the Agreement between the Kingdom of the Netherlands and the Organisation for the Prohibition of Chemical Weapons (OPCW) concerning the Headquarters of the OPCW of 22 May 1997 as well as to the consultations between the Ministry and the OPCW regarding the registration of interns who have been accepted by the OPCW into its internship programme in the Netherlands, has the honour to propose the following:

  • 1. For the purpose of this Agreement, the following definition of an intern shall apply: An individual who has been accepted by the OPCW into the internship programme of the OPCW and who, on that basis, performs certain tasks for the OPCW. An intern shall in no case fall under the definition of an official of the OPCW.

  • 2. Within eight (8) days after first arrival of an intern in the Netherlands, the OPCW shall request the Ministry of Foreign Affairs to register the intern in accordance with paragraph 3.

  • 3. The Ministry of Foreign Affairs shall register an intern for the purpose of his/her internship with the OPCW for a maximum period of six months, provided that the OPCW supplies the Ministry of Foreign Affairs with a declaration signed by the intern, accompanied by adequate proof, to the effect that:

    • a) the intern entered the Netherlands in accordance with the applicable immigration procedures;

    • b) the intern has sufficient financial means for living expenses and for repatriation, as well as sufficient medical insurance (including coverage of costs of hospitalization for at least the duration of the internship plus one month) and third party liability insurance, and will not be a charge on the public purse of the Netherlands;

    • c) the intern will not work in the Netherlands during his or her internship otherwise than as an intern at the OPCW;

    • d) the intern will not bring any family members to reside with him or her in the Netherlands other than in accordance with the applicable immigration procedures;

    • e) the intern will leave the Netherlands within 14 days after the end of the internship unless he or she is otherwise entitled to stay in the Netherlands in accordance with the applicable immigration legislation.

  • 4. Upon registration of the intern in accordance with paragraph 3, the Ministry of Foreign Affairs shall issue an identity card to the intern.

  • 5. The OPCW shall not incur liability for damage resulting from non-fulfilment, by interns registered in accordance with paragraph 3, of the conditions of the declaration referred to in that paragraph.

  • 6. Interns shall not enjoy any privileges or immunities.

  • 7. In exceptional circumstances, the maximum period of six months mentioned in paragraph 3 may be extended once by a maximum period of six months.

  • 8. The OPCW shall notify the Ministry of Foreign Affairs of the final departure of the intern from the Netherlands within eight (8) days after such departure, and shall at the same time return the intern’s identity card.

If this proposal is acceptable to the OPCW, the Ministry suggests that this Note and the OPCW’s affirmative reply to it shall together constitute an Agreement between the Kingdom of the Netherlands and OPCW. This Agreement shall be applied provisionally as from the date of such reply and shall enter into force on the day the Kingdom of the Netherlands has notified OPCW in writing that the legal requirements for entry into force have been complied with.

The Ministry of Foreign Affairs of the Kingdom of the Netherlands avails itself of this opportunity to renew to the OPCW the assurances of its highest consideration.

The Organisation for the Prohibition of Chemical Weapons presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the honour to acknowledge receipt of the Ministry’s Note MINBUZA-2015.47587, dated 10 February 2015.

The Organisation for the Prohibition of Chemical Weapons has the honour to inform the Ministry of Foreign Affairs that the proposal as formulated in the Ministry’s Note MINBUZA-2015.47587 of 10 February 2015 is acceptable to the Organisation for the Prohibition of Chemical Weapons. The Organisation for the Prohibition of Chemical Weapons accordingly agrees that the Ministry’s Note and this reply shall constitute an Agreement between the Organisation for the Prohibition of Chemical Weapons and the Kingdom of the Netherlands. This Agreement shall be applied provisionally as from the date of this reply and shall enter into force on the day the Kingdom of the Netherlands has notified the Organisation for the Prohibition of Chemical Weapons in writing that the legal requirements for entry into force have been complied with.

Het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden biedt de Organisatie voor het Verbod van Chemische Wapens zijn complimenten aan en heeft, onder verwijzing naar het Verdrag tussen het Koninkrijk der Nederlanden en de Organisatie voor het Verbod van Chemische Wapens betreffende de zetel van de OPCW van 22 mei 1997 alsmede naar de gesprekken tussen het Ministerie en de OPCW inzake de registratie van stagiairs die de OPCW heeft toegelaten tot haar stageprogramma in Nederland, de eer het volgende voor te stellen:

  • 1. Voor de toepassing van dit Verdrag wordt verstaan onder “stagiair”: Een persoon die door de OPCW is toegelaten tot het stageprogramma van de OPCW en op die grond bepaalde taken voor de OPCW vervult. Een stagiair valt in geen geval onder de begripsomschrijving van een functionaris van de OPCW.

  • 2. Binnen acht (8) dagen na de eerste aankomst van een stagiair in Nederland verzoekt de OPCW het Ministerie van Buitenlandse Zaken de stagiair te registreren in overeenstemming met het derde lid.

  • 3. Het Ministerie van Buitenlandse Zaken registreert een stagiair ten behoeve van zijn of haar stage bij de OPCW voor een tijdvak van ten hoogste zes maanden, mits de OPCW het Ministerie van Buitenlandse Zaken een door de stagiair ondertekende verklaring doet toekomen, vergezeld van voldoende bewijs, waaruit blijkt dat:

    • a. de stagiair Nederland is binnengekomen in overeenstemming met de van toepassing zijnde immigratieprocedures;

    • b. de stagiair over voldoende financiële middelen beschikt om in zijn of haar levensonderhoud te voorzien alsmede voor zijn of haar terugkeer, en voldoende verzekerd is tegen ziektekosten (met inbegrip van een dekking voor kosten van ziekenhuisopname voor ten minste de duur van de stage plus een maand) en een wettelijkeaansprakelijkheidsverzekering, en niet ten laste zal komen van de openbare middelen van Nederland;

    • c. de stagiair gedurende zijn of haar stage in Nederland uitsluitend werkzaam zal zijn als stagiair bij de OPCW;

    • d. de stagiair geen familieleden meebrengt die bij hem of haar in Nederland zullen wonen, tenzij in overeenstemming met de desbetreffende immigratieprocedures;

    • e. de stagiair Nederland verlaat binnen 14 dagen na het einde van zijn of haar stage, tenzij hij of zij op andere gronden gerechtigd is in Nederland te verblijven in overeenstemming met de desbetreffende immigratiewetgeving.

  • 4. Na registratie van de stagiair in overeenstemming met het derde lid, geeft het Ministerie van Buitenlandse Zaken aan de stagiair een identiteitskaart af.

  • 5. De OPCW is niet aansprakelijk voor schade voortvloeiend uit niet-naleving door in overeenstemming met het derde lid geregistreerde stagiairs van de voorwaarden van de in dat lid bedoelde verklaring.

  • 6. De stagiair geniet geen voorrechten of immuniteiten.

  • 7. In uitzonderlijke omstandigheden kan het maximumtijdvak van zes maanden genoemd in het derde lid eenmaal worden verlengd met ten hoogste zes maanden.

  • 8. De OPCW stelt het Ministerie van Buitenlandse Zaken binnen acht (8) dagen na het definitieve vertrek van de stagiair uit Nederland daarvan in kennis en retourneert daarbij de identiteitskaart van de stagiair.

Indien dit voorstel aanvaardbaar is voor de OPCW, stelt het Ministerie voor dat deze nota en de bevestigende antwoordnota van de OPCW tezamen een verdrag zullen vormen tussen het Koninkrijk der Nederlanden en de OPCW. Dit Verdrag wordt voorlopig toegepast vanaf de datum van dat antwoord en treedt in werking op de datum waarop het Koninkrijk der Nederlanden de OPCW er schriftelijk van in kennis heeft gesteld dat aan de wettelijke vereisten voor de inwerkingtreding is voldaan.

Het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden maakt van deze gelegenheid gebruik om de OPCW opnieuw te verzekeren van zijn zeer bijzondere hoogachting.

ORGANISATIE VOOR HET VERBOD VAN CHEMISCHE WAPENS

De Organisatie voor het Verbod van Chemische Wapens biedt haar complimenten aan het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden aan en heeft de eer de ontvangst te bevestigen van Nota MINBUZA-2015.47587 van het Ministerie van 10 februari 2015.

De Organisatie voor het Verbod van Chemische Wapens heeft de eer het Ministerie van Buitenlandse Zaken ervan in kennis te stellen dat het voorstel zoals geformuleerd in Nota MINBUZA-2015.47587 van het Ministerie van 10 februari 2015 aanvaardbaar is voor de Organisatie voor het Verbod van Chemische Wapens. De Organisatie voor het Verbod van Chemische Wapens stemt er dienovereenkomstig mee in dat de nota van het Ministerie en dit antwoord een Verdrag zullen vormen tussen de Organisatie voor het Verbod van Chemische Wapens en het Koninkrijk der Nederlanden. Dit Verdrag wordt voorlopig toegepast vanaf de datum van dit antwoord en treedt in werking op de dag waarop het Koninkrijk der Nederlanden de Organisatie voor het Verbod van Chemische Wapens er schriftelijk van in kennis heeft gesteld dat aan de wettelijke vereisten voor de inwerkingtreding is voldaan.

De Organisatie voor het Verbod van Chemische Wapens maakt van deze gelegenheid gebruik om het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden opnieuw te verzekeren van haar zeer bijzondere hoogachting.
