Your Excellency,
I have the honour to refer to the Convention between the Government of the Kingdom of the Netherlands and the Government
of the Federative Republic of Brazil on mutual administrative assistance for the proper
application of customs law and for the prevention, investigation and combating of
customs offences, signed at Brasilia on 7 March 2002 (hereinafter referred to as “the Convention of
2002”).
The Government of the Kingdom of the Netherlands proposes that, in accordance with
Article 19, paragraphs 2 and 3, of the Convention of 2002, the application of the Convention of 2002 be extended to Aruba, Curaçao and Sint
Maarten, subject to the following:

1. For the Kingdom of the Netherlands, the term “customs administration” in Article 1, paragraph 1 of the Convention of 2002, shall mean, as regards Aruba, Curaçao and Sint Maarten, the respective central administrations
responsible for the implementation of customs laws.

2. The second sentence of Article 2, paragraph 4, of the Convention of 2002 shall apply only to Aruba, Curaçao and Sint Maarten, as the case may be, insofar
as the bilateral and multilateral treaties referred to therein apply to those respective
parts of the Kingdom of the Netherlands.

3. The requirements of national law in the sense of Articles 14 and 15 of the Convention of 2002, as regards Aruba, Curaçao and Sint Maarten, fall under the scope of the applicable
laws of Aruba, Curaçao and Sint Maarten respectively.
If the foregoing is acceptable to the Government of the Federative Republic of Brazil,
I have the further honour to propose that this Note and Your Excellency’s Note in
reply shall constitute an Agreement between the Kingdom of the Netherlands and the
Federative Republic of Brazil which shall enter into force on the first day of the
second month following the date of receipt of the later notification in which one
Party informs the other Party that the formalities required for the entry into force
have been complied with.
