Note Verbale No. 2013/34

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Republic of Estonia and has the honour to refer to the Agreement between the Kingdom of the Netherlands and the Republic of Estonia on mutual administrative assistance for the proper application of customs law and for the prevention, investigation and combating of customs offences, signed at The Hague on 11 October 1995 (hereinafter referred to as “the Agreement of 1995”).

The Government of the Kingdom of the Netherlands proposes that, in accordance with Article 19, paragraphs 2 and 3, of the Agreement of 1995, the application of the Agreement of 1995 shall be extended to Aruba, Curaçao and Sint Maarten, subject to the following:

• 1. For the Kingdom of the Netherlands, the term “Customs Administration” in Article 1, paragraph 1, of the Agreement of 1995 shall mean, as regards Aruba, Curaçao and Sint Maarten, the respective central administrations responsible for the implementation of customs laws.

• 2. Article 2, paragraph 4, of the Agreement of 1995 shall apply only to Aruba, Curaçao and Sint Maarten, as the case may be, insofar as the agreements referred to therein apply to those respective parts of the Kingdom of the Netherlands.

• 3. As regards Aruba, Curaçao and Sint Maarten, the requirements of national law within the meaning of Articles 13 and 14 of the Agreement of 1995 fall under the scope of the applicable laws of Aruba, Curaçao and Sint Maarten respectively.

If the foregoing is acceptable to the Government of the Republic of Estonia, the Embassy has the further honour to propose that this Note and the Ministry’s reply shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Estonia which shall enter into force on the first day of the second month following the date of receipt of the later notification in which one Party informs the other Party that the formalities required for the entry into force of the Agreement have been complied with.

The Embassy of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Estonia the assurance of its highest consideration.

The Ministry of Foreign Affairs of the Republic of Estonia present their compliments to the Embassy of the Kingdom of the Netherlands and have the honour to refer to the Embassy’s Note No. 2013/34, dated 8 November 2013, which reads as follows:

The Ministry of Foreign Affairs of the Republic of Estonia confirm that the foregoing is acceptable to the Government of the Republic of Estonia. Accordingly the Embassy’s Note and this reply Note shall constitute the Agreement to amend the Agreement between the Republic of Estonia and the Kingdom of the Netherlands on mutual administrative assistance for the proper application of customs law and for the prevention, investigation and combating of customs offences, which shall enter into force on the first day of the second month following the date of receipt of the later notification in which one Party informs the other Party the formalities required for the entry into force of the Agreement have been complied with.

The Ministry kindly ask the Embassy to convey the date of receipt of this Note in order to set the date for the entry into force of the amending Agreement.

The Ministry of Foreign Affairs of the Republic of Estonia avail themselves of this opportunity to renew to the Embassy of the Kingdom of the Netherlands the assurances of their highest consideration.

Note Verbale nr. 2013/34

De Ambassade van het Koninkrijk der Nederlanden biedt het Ministerie van Buitenlandse Zaken van de Republiek Estland haar complimenten aan en heeft de eer te verwijzen naar het Verdrag tussen het Koninkrijk der Nederlanden en de Republiek Estland inzake wederzijdse administratieve bijstand ten behoeve van de juiste toepassing van de douanewetgeving en de voorkoming, opsporing en bestrijding van inbreuken op de douanewetgeving, ondertekend te Den Haag op 11 oktober 1995 (hierna te noemen „het Verdrag van 1995”).

De Regering van het Koninkrijk der Nederlanden stelt voor dat, in overeenstemming met artikel 19, tweede en derde lid, van het Verdrag van 1995, de toepassing van het Verdrag van 1995 wordt uitgebreid tot Aruba, Curaçao en Sint Maarten, met inachtneming van het volgende:

• 1. Voor het Koninkrijk der Nederlanden wordt, wat Aruba, Curaçao en Sint Maarten betreft, onder de uitdrukking „douane-administratie” in artikel 1, eerste lid, van het Verdrag van 1995 verstaan de respectieve centrale administraties die verantwoordelijk zijn voor de toepassing van de douanewetgeving.

• 2. Artikel 2, vierde lid, van het Verdrag van 1995 is uitsluitend van toepassing op Aruba, Curaçao en Sint Maarten, naargelang van het geval, voor zover de daarin bedoelde overeenkomsten van toepassing zijn op deze respectieve delen van het Koninkrijk der Nederlanden.

• 3. De vereisten van de nationale wetgeving in de zin van de artikelen 13 en 14 van het Verdrag van 1995 vallen wat Aruba, Curaçao en Sint Maarten betreft, onder het bereik van de toepasselijke wetgeving van respectievelijk Aruba, Curaçao en Sint Maarten.

Indien het voorgaande aanvaardbaar is voor de Regering van de Republiek Estland, heeft de Ambassade voorts de eer voor te stellen dat deze nota en het antwoord van het Ministerie een verdrag zullen vormen tussen het Koninkrijk der Nederlanden en de Republiek Estland dat in werking zal treden op de eerste dag van de tweede maand die volgt op de datum van ontvangst van de laatste kennisgeving waarin één van de partijen aan de andere partij mededeelt dat aan de benodigde formaliteiten voor de inwerkingtreding van het verdrag is voldaan.

De Ambassade van het Koninkrijk der Nederlanden maakt van deze gelegenheid gebruik om het Ministerie van Buitenlandse Zaken van de Republiek Estland opnieuw te verzekeren van haar zeer bijzondere hoogachting.

Het Ministerie van Buitenlandse Zaken van de Republiek Estland biedt de Ambassade van het Koninkrijk der Nederlanden zijn complimenten aan en heeft de eer de ontvangst te bevestigen van nota no. 2013/34 van de Ambassade d.d. 8 november 2013, die als volgt luidt:

Het Ministerie van Buitenlandse Zaken van de Republiek Estland bevestigt dat het voorgaande aanvaardbaar is voor de Regering van de Republiek Estland. De nota van de Ambassade en deze antwoordnota zullen derhalve een verdrag vormen tot wijziging van het Verdrag tussen het Koninkrijk der Nederlanden en de Republiek Estland inzake wederzijdse administratieve bijstand ten behoeve van de juiste toepassing van de douanewetgeving en de voorkoming, opsporing en bestrijding van inbreuken op de douanewetgeving, dat in werking zal treden op eerste dag van de tweede maand die volgt op de datum van ontvangst van de laatste kennisgeving waarin één van de partijen aan de andere partij mededeelt dat aan de benodigde formaliteiten voor de inwerkingtreding van het verdrag is voldaan.

Het Ministerie verzoekt de Ambassade vriendelijk de datum van ontvangst van deze nota door te geven teneinde de datum van inwerkingtreding van het verdrag tot wijziging te kunnen vaststellen.

Het Ministerie van Buitenlandse Zaken van de Republiek Estland maakt van deze gelegenheid gebruik om de Ambassade van het Koninkrijk der Nederlanden opnieuw te verzekeren van zijn zeer bijzondere hoogachting.
