Being desirous of making more and more effective the prevention and punishment of counterfeiting currency, have appointed as their Plenipotentiaries:

who, having communicated their full powers, found in good and due form, have agreed on the following provisions:

Part I

Article 1

The High Contracting Parties recognise the rules laid down in Part I of this Convention as the most effective means in present circumstances for ensuring the prevention and punishment of the offence of counterfeiting currency.

Article 2

In the present Convention, the word „currency” is understood to mean paper money (including banknotes) and metallic money, the circulation of which is legally authorised.

Article 3

The following should be punishable as ordinary crimes:

  • (1) Any fraudulent making or altering of currency, whatever means are employed;

  • (2) The fraudulent uttering of counterfeit currency;

  • (3) The introduction into a country of or the receiving or obtaining counterfeit currency with a view to uttering the same and with knowledge that it is counterfeit;

  • (4) Attempts to commit, and any intentional participation in, the foregoing acts;

  • (5) The fraudulent making, receiving or obtaining of instruments or other articles peculiarly adapted for the counterfeiting or altering of currency.

Article 4

Each of the acts mentioned in Article 3, if they are committed in different countries, should be considered as a distinct offence.

Article 5

No distinction should be made in the scale of punishments for offences referred to in Article 3 between acts relating to domestic currency on the one hand and to foreign currency on the other; this provision may not be made subject to any condition of reciprocal treatment by law or by treaty.

Article 6

In countries where the principle of the international recognition of previous convictions is recognised, foreign convictions for the offences referred to in Article 3 should, within the conditions prescribed by domestic law, be recognised for the purpose of establishing habitual criminality.

Article 7

In so far as „civil parties” are admitted under the domestic law, foreign „civil parties”, including, if necessary, the High Contracting Party whose money has been counterfeited, should be entitled to all rights allowed to inhabitants by the laws of the country in which the case is tried.

Article 8

In countries where the principle of the extradition of nationals is not recognised, nationals who have returned to the territory of their own country after the commission abroad of an offence referred to in Article 3 should be punishable in the same manner as if the offence had been committed in their own territory, even in a case where the offender has acquired his nationality after the commission of the offence.

This provision does not apply if, in a similar case, the extradition of a foreigner could not be granted.

Article 9

Foreigners who have committed abroad any offence referred to in Article 3, and who are in the territory of a country whose internal legislation recognises as a general rule the principle of the prosecution of offences committed abroad, should be punishable in the same way as if the offence had been committed in the territory of that country.

The obligation to take proceedings is subject to the condition that extradition has been requested and that the country to which application is made cannot hand over the person accused for some reason which has no connection with the offence.

Article 10

The offences referred to in Article 3 shall be deemed to be included as extradition crimes in any extradition treaty which has been or may hereafter be concluded between any of the High Contracting Parties.

The High Contracting Parties who do not make extradition conditional on the existence of a treaty or reciprocity, henceforward recognise the offences referred to in Article 3 as cases of extradition as between themselves.

Extradition shall be granted in conformity with the law of the country to which application is made.

Article 11

Counterfeit currency, as well as instruments or other articles referred to in Article 3 (5), should be seized and confiscated. Such currency, instruments or other articles should, after confiscation, be handed over on request either to the Government or bank of issue whose currency is in question, with the exception of exhibits whose preservation as a matter of record is required by the law of the country where the prosecution took place, and any specimens whose transmission to the Central Office mentioned in Article 12 may be deemed advisable. In any event, all such articles should be rendered incapable of use.

Article 12

In every country, within the framework of its domestic law, investigations on the subject of counterfeiting should be organised by a central office.

This central office should be in close contact:

  • (a) With the institutions issuing currency;

  • (b) With the police authorities within the country;

  • (c) With the central offices of other countries.

It should centralise, in each country, all information of a nature to facilitate the investigation, prevention and punishment of counterfeiting currency.

Article 13

The central offices of the different countries should correspond directly with each other.

Article 14

Each central office should, so far as it considers expedient, forward to the central offices of the other countries a set of cancelled specimens of the actual currency of its own country.

It should, subject to the same limitation, regularly notify to the central offices in foreign countries, giving all necessary particulars:

  • (a) New currency issues made in its country;

  • (b) The withdrawal of currency from circulation, whether as out of date or otherwise.

Except in cases of purely local interest, each central office should, so far as it thinks expedient, notify to the central in offices in foreign countries:

  • (1) Any discovery of counterfeit currency. Notification of the forgery of bank or currency notes shall be accompanied by a technical description of the forgeries, to be provided solely by the institution whose notes have been forged. A photographic reproduction or, if possible, a specimen forged note should be transmitted. In urgent cases, a notification and a brief description made by the police authorities may be discreetly communicated to the central offices interested, without prejudice to the notification and technical description mentioned above;

  • (2) Investigation and prosecutions in cases of counterfeiting, and arrests, convictions and expulsions of counterfeiters, and also, where possible, their movements, together with any details which may be of use, and in particular their descriptions, fingerprints and photographs;

  • (3) Details of discoveries of forgeries, stating whether it has been possible to seize all the counterfeit currency put into circulation.

Article 15

In order to ensure, improve and develop direct international co-operation in the prevention and punishment of counterfeiting currency, the representatives of the central offices of the High Contracting Parties should from time to time hold conferences with the participation of representatives of the banks of issue and of the central authorities concerned. The organisation and supervision of a central international information office may form the subject of one of these conferences.

Article 16

The transmission of letters of request1 relating to offences referred to in Article 3 should be effected:

  • (a) Preferably by direct communication between the judicial authorities, through the central offices where possible;

  • (b) By direct correspondence between the Ministers of Justice of the two countries, or by direct communication from the authority of the country making the request to the Minister of Justice of the country to which the request is made;

  • (c) Through the diplomatic or consular representative of the country making the request in the country to which the request is made; this representative shall send the letters of request direct to the competent judicial authority or to the authority appointed by the Government of the country to which the request is made, and shall receive direct from such authority the papers showing the execution of the letters of request.

In cases (a) and (c), a copy of the letters of request shall always be sent simultaneously to the superior authority of the country to which application is made.

Unless otherwise agreed, the letters of request shall be drawn up in the language of the authority making the request, provided always that the country to which the request is made may require a translation in its own language, certified correct by the authority making the request.

Each High Contracting Party shall notify to each of the other High Contracting Parties the method or methods of transmission mentioned above which it will recognise for the letters of request of the latter High Contracting Party.

Until such notification is made by a High Contracting Party, its existing procedure in regard to letters of request shall remain in force.

Execution of letters of request shall not be subject to payment of taxes or expenses of any nature whatever other than expenses of experts.

Nothing in the present article shall be construed as an undertaking on the part of the High Contracting Parties to adopt in criminal matters any form or methods of proof contrary to their laws.

Article 17

The participation of a High Contracting Party in the present Convention shall not be interpreted as affecting that Party's attitude on the general question of criminal jurisdicton as a question of international law.

Article 18

The present Convention does not affect the principle that the offences referred to in Article 3 should in each country, without ever being allowed impunity, be defined, prosecuted and punished in conformity with the general rules of its domestic law.

Part II

Article 19

The High Contracting Parties agree that any disputes which might arise between them relating to the interpretation or application of this Convention shall, if they cannot be settled by direct negotiation, be referred for decision to the Permanent Court of International Justice. In case any or all of the High Contracting Parties parties to such a dispute should not be Parties to the Protocol bearing the date of December 16th, 1920, relating to the Permanent Court of International Justice, the dispute shall be referred, at the choice of the parties and in accordance with the constitutional procedure of each party, either to the Permanent Court of International Justice or to a court of arbitration constituted in accordance with the Convention of October 18th, 1907, for the Pacific Settlement of International Disputes, or to some other court of arbitration.

Article 20

The present Convention, of which the French and English texts are both authentic, shall bear to-day's date. Until the 31st of December 1929, it shall be open for signature on behalf of any Member of the League of Nations and on behalf of any non-member State which was represented at the Conference which elaborated the present Convention or to which a copy is communicated by the Council of the League of Nations.

It shall be ratified, and the instruments of ratification shall be transmitted to the Secretary-General of the League of Nations, who will notify their receipt to all the Members of the League and to the non-member States aforesaid.

Article 21

After the 1st day of January 1930, the present Convention shall be open to accession on behalf of any Member of the League of Nations and any of the non-member States referred accord n'aurait pas été signé.

The instruments of accession shall be transmitted to the Secretary-General of the League of Nations, who will notify their receipt to all the Members of the League and to the non-member States referred to in Article 20.

Article 22

The countries which are ready to ratify the Convention under the second paragraph of Article 20 or to accede to the Convention under Article 21 but desire to be allowed to make any reservations with regard to the application of the Convention may inform the Secretary-General of the League of Nations to this effect, who shall forthwith communicate such reservations to the High Contracting Parties on whose behalf ratifications or accessions have been deposited and enquire whether they have any objection thereto. If within six months of the date of the communication of the Secretary-General no objections have been received, the participation in the Convention of the country making the reservation shall be deemed to have been accepted by the other High Contracting Parties subject to the said reservation.

Article 23

Ratification of or accession to the present Convention by any High Contracting Party implies that its legislation and its administrative organisation are in conformity with the rules contained in the Convention.

Article 24

In the absence of a contrary declaration by one of the High Contracting Parties at the time of signature, ratification or accession, the provisions of the present Convention shall not apply to colonies, overseas territories, protectorates or territories under suzerainty or mandate.

Nevertheless, the High Contracting Parties reserve the right to accede to the Convention, in accordance with the provisions of Articles 21 and 23, for their colonies, overseas territories, protectorates or territories under suzerainty or mandate. They also reserve the right to denounce it separately in accordance with the provisions of Article 27.

Article 25

The present Convention shall not come into force until five ratifications or accessions on behalf of Members of the League of Nations or non-member States have been deposited. The date of its coming into force shall be the ninetieth day after the receipt by the Secretary-General of the League of Nations of the fifth ratification or accession.

Article 26

After the coming into force of the Convention in accordance with Article 25, each subsequent ratification or accession shall take effect on the ninetieth day from the date of its receipt by the Secretary-General of the League of Nations.

Article 27

The present Convention may be denounced on behalf of any Member of the League of Nations or non-member State by a notification in writing addressed to the Secretary-General of the League of Nations, who will inform all the Members of the League and the non-member States referred to in Article 20. Such denunciation shall take effect one year after the date of its receipt by the Secretary-General of the League of Nations, and shall operate only in respect of the High Contracting Party on whose behalf it was notified.

Article 28

The present Convention shall be registered by the Secretariat of the League of Nations on the date of its coming into force.

IN FAITH WHEREOF the above-mentioned Plenipotentiaries have signed the present Convention.

DONE at Geneva, the twentieth day of April, one thousand nine hundred and twenty-nine, in a single copy, which will remain deposited in the archives of the Secretariat of the League of Nations, and of which certified copies will be transmitted to all the Members of the League and to the non-member States referred to in Article 20.

Verlangend de voorkoming en de bestraffing van de valsche munterij meer en meer doeltreffend te maken, hebben als hun Gevolmachtigden aangewezen:

Die, na hun volmachten, welke in goeden en behoorlijken vorm bevonden zijn, te hebben overgelegd, omtrent de volgende bepalingen zijn overeengekomen:

Deel I

Artikel 1

De Hooge Verdragsluitende Partijen erkennen de in Deel I van dit Verdrag vervatte regels als het in de tegenwoordige omstandigheden meest doeltreffende middel om delicten van valsche munterij te voorkomen en te bestraffen.

Artikel 2

In dit Verdrag wordt onder het woord „munt” verstaan papiergeld, waaronder begrepen bankbiljetten, en metalen geld, welke wettig betaalmiddel zijn.

Artikel 3

Als gemeenrechtelijke delicten moeten worden bestraft:

  • 1°. Iedere bedriegelijke vervaardiging of verandering van munt, welk middel ook gebezigd moge zijn om het resultaat te verkrijgen;

  • 2°. Het bedriegelijk in omloop brengen van valsche munt;

  • 3°. Het binnen het land invoeren of het ontvangen of zich verschaffen van valsche munt, waarvan men weet, dat zij valsch is, ten einde deze in omloop te brengen;

  • 4°. Poging tot en opzettelijke deelneming aan de voormelde handelingen;

  • 5°. Het bedriegelijk vervaardigen, ontvangen of zich verschaffen van werktuigen of andere voorwerpen, welke naar hun aard bestemd zijn voor de vervaardiging van valsche munt of voor de verandering van munt.

Artikel 4

Ieder der in artikel 3 genoemde handelingen moet, indien zij in verschillende landen begaan zijn, als een afzonderlijk strafbaar feit worden beschouwd.

Artikel 5

Ten opzichte van de straffen mag geen onderscheid worden gemaakt ter zake van de in artikel 3 bedoelde delicten naarmate het betreft nationale munt of vreemde munt; dit voorschrift kan niet aan eenigerlei voorwaarde van wederkeerigheid krachtens wet of verdrag worden onderworpen.

Artikel 6

Landen, die het beginsel van internationale recidive aanvaarden, erkennen, dat overeenkomstig de door hun nationale wetgeving voorgeschreven voorwaarden de voor een der in artikel 3 bedoelde feiten in het buitenland uitgesproken veroordeelingen tot toepassing der bepalingen omtrent recidive zullen leiden.

Artikel 7

Voor zoover het stellen van civiele partij door de binnenlandsche wetgeving toegelaten is, moeten buitenlandsche civiele partijen, waaronder eventueel begrepen de Hooge Verdragsluitende Partij, welker munt vervalscht is, bevoegd zijn alle rechten uit te oefenen, welke aan ingezetenen zijn toegestaan volgens de wetten van het land, waar de zaak berecht wordt.

Artikel 8

In landen, die het beginsel van uitlevering van eigen onderdanen niet aanvaarden, moeten de onderdanen, die naar het gebied van hun land teruggekeerd zijn na zich in het buitenland aan een in artikel 3 bedoeld feit schuldig te hebben gemaakt, op dezelfde wijze gestraft worden alsof het feit op het eigen gebied gepleegd ware, zelfs in geval de schuldige zijn nationaliteit na het plegen van het strafbare feit verkregen zou hebben.

Deze bepaling is niet van toepassing, indien in een overeenkomstig geval de uitlevering van een vreemdeling niet zou kunnen worden toegestaan.

Artikel 9

Vreemdelingen, die in het buitenland een in artikel 3 bedoeld feit hebben begaan en die zich binnen het gebied van een land bevinden, welks binnenlandsche wetgeving als algemeenen regel het beginsel van vervolging van in het buitenland gepleegde strafbare feiten aanvaardt, moeten op dezelfde wijze worden gestraft alsof het feit op het gebied van dat land gepleegd ware.

De verplichting tot vervolging is afhankelijk van de voorwaarde, dat uitlevering gevraagd is en dat het land, waartoe de aanvraag gericht is, den beschuldigde niet kan uitleveren wegens een reden, welke geen verband met het feit houdt.

Artikel 10

De in artikel 3 bedoelde strafbare feiten zijn van rechtswege begrepen onder de gevallen, waarin uitlevering kan plaats hebben, in ieder tusschen de Hooge Verdragsluitende Partijen gesloten of te sluiten uitleveringsverdrag.

De Hooge Verdragsluitende Partijen, die uitlevering niet afhankelijk maken van het bestaan van een verdrag of van een voorwaarde van wederkeerigheid, erkennen van nu af de in artikel 3 bedoelde feiten als gevallen, waarin onderling uitlevering kan plaats hebben.

De uitlevering zal worden toegestaan overeenkomstig het recht van het land, waartoe de aanvraag gericht is.

Artikel 11

De valsche munt, alsmede de werktuigen en de andere voorwerpen, welke in artikel 3 onder 5°. bedoeld zijn, moeten worden in beslag genomen en verbeurd verklaard. Deze munt, werktuigen en andere voorwerpen, moeten na verbeurdverklaring op verzoek hetzij aan de Regeering hetzij aan de emissiebank, wier munt het betreft, worden overhandigd, met uitzondering van de stukken van overtuiging, waarvan de bewaring in de strafrechtelijke archieven door de wet van het land, waar de vervolging plaats heeft gehad, is voorgeschreven, en van de specimina, waarvan de opzending aan het in artikel 12 genoemde centrale bureau wenschelijk wordt geacht. In ieder geval moeten al deze voorwerpen buiten gebruik worden gesteld.

Artikel 12

In ieder land moeten de opsporingen op het gebied van valsche munterij binnen het kader van de nationale wetgeving door een centraal bureau worden georganiseerd.

Dit centrale bureau moet in nauwe verbinding staan:

  • a) Met de instellingen, welke munt uitgeven;

  • b) Met de binnenlandsche politie-autoriteiten;

  • c) Met de centrale bureaux van andere landen.

Het moet in ieder land alle inlichtingen, welke de opsporing, voorkoming en bestraffing van valsche munterij kunnen vergemakkelijken, centraliseeren.

Artikel 13

De centrale bureaux der verschillende landen moeten rechtstreeks met elkander briefwisseling voeren.

Artikel 14

Ieder centraal bureau zal, voor zoover het zulks dienstig acht, aan de centrale bureaux der andere landen een stel onbruikbaar gemaakte authentieke specimina der munten van zijn land moeten toezenden.

Onder hetzelfde voorbehoud zal het geregeld met opgave van alle noodige bijzonderheden aan de centrale bureaux in het buitenland moeten kennis geven van:

  • a) Nieuwe uitgiften van munt, welke in het eigen land plaats hadden;

  • b) Het uit de circulatie nemen van munt, wegens verloop van tijd of om andere redenen.

Behalve in gevallen van louter plaatselijk belang zal ieder centraal bureau, voor zoover het zulks doelmatig acht, aan de centrale bureaux in het buitenland moeten kennis geven van:

  • 1°. Iedere ontdekking van valsche munt. De kennisgeving van vervalsching van bankbiljetten of van muntbiljetten zal vergezeld gaan van een technische beschrijving van de vervalschingen, uitsluitend te verstrekken door de emissie-instelling, waarvan de biljetten vervalscht zijn. Een fotografische afbeelding of zoo mogelijk een exemplaar van het valsche biljet zal worden overgelegd. In spoedeischende gevallen zal een bericht en een korte beschrijving, afkomstig van de politie-autoriteiten, onder de noodige voorzorgen aan de belanghebbende centrale bureaux kunnen worden toegezonden, onverminderd de kennisgeving en de technische beschrijving, waarvan hierboven sprake was.

  • 2°. Opsporingen en vervolgingen in gevallen van vervalsching en aanhoudingen, veroordeelingen en uitwijzigingen van valsche munters, alsmede eventueel hun verplaatsingen en alle verdere inlichtingen, welke van nut kunnen zijn, in het bijzonder de signalementen, vinger-afdrukken en fotografieën van valsche munters;

  • 3°. Bijzonderheden omtrent de ontdekking van vervaardiging van valsche munt, met vermelding of het mogelijk geweest is alle in omloop gebrachte valsche munt in beslag te nemen.

Artikel 15

Ter verzekering, verbetering en ontwikkeling van de rechtstreeksche internationale samenwerking op het gebied van voorkoming en bestraffing van valsche munterij moeten de vertegenwoordigers van de centrale bureaux der Hooge Verdragsluitende Partijen van tijd tot tijd besprekingen houden, waaraan vertegenwoordigers van de emissiebanken en van de betrokken centrale autoriteiten deelnemen. De organisatie en het toezicht van een internationaal centraal inlichtingenbureau zal het onderwerp van een dezer conferenties kunnen uitmaken.

Artikel 16

De overmaking van rogatoire commissies met betrekking tot de in artikel 3 bedoelde strafbare feiten moet geschieden:

  • a) Bij voorkeur door rechtstreeksche toezending tusschen de rechterlijke autoriteiten, eventueel door tusschenkomst van de centrale bureaux;

  • b) Door rechtstreeksche briefwisseling van de Ministers van Justitie der twee landen of door rechtstreeksche toezending door de autoriteit van het verzoekende land aan den Minister van Justitie van het aangezochte land;

  • c) Door tusschenkomst van den diplomatieken of consulairen vertegenwoordiger van het verzoekende land in het aangezochte land; deze vertegenwoordiger zal de rogatoire commissie rechtstreeks toezenden aan de bevoegde rechterlijke autoriteit of aan de autoriteit, die door het aangezochte land aangewezen is, en zal rechtstreeks van deze autoriteit de stukken ontvangen, waaruit de uitvoering van de rogatoire commissie blijkt.

In de gevallen a) en c) zal steeds tegelijkertijd afschrift van de rogatoire commissie aan de hoogste juridische autoriteit van het aangezochte land worden gezonden.

Tenzij anders wordt overeengekomen, zal de rogatoire commissie moeten worden opgesteld in de taal van de verzoekende autoriteit, onverminderd het recht van het aangezochte land om steeds een vertaling in de eigen taal, voor eensluidend door de verzoekende autoriteit gewaarmerkt, te verlangen.

Iedere Hooge Verdragsluitende Partij zal door een mededeeling aan ieder der andere Hooge Verdragsluitende Partijen doen weten, welke der bovenbedoelde wijzen van overmaking zij voor de rogataire commissies van die Hooge Verdragsluitende Partij toelaat.

Totdat een Hooge Verdragsluitende Partij een zoodanige mededeeling zal hebben gedaan, zal de door haar thans gevolgde procedure ten aanzien van rogatoire commissies gehandhaafd blijven.

De uitvoering van rogatoire commissies zal geen aanleiding kunnen geven tot vergoeding van andere rechten en kosten dan de kosten van deskundigen-onderzoek.

Niets in dit artikel zal kunnen worden uitgelegd als een verbintenis van de zijde der Hooge Verdragsluitende Partijen om met betrekking tot de bewijsvoering in strafzaken een afwijking van haar wet te aanvaarden.

Artikel 17

De deelneming van een Hooge Verdragsluitende Partij aan dit Verdrag moet niet worden uitgelegd als inbreuk te maken op haar houding in de algemeene kwestie van de strafrechtelijke bevoegdheid als volkenrechtelijk vraagstuk.

Artikel 18

Dit Verdrag laat het beginsel onaangetast, dat de in artikel 3 bedoelde feiten in ieder land, zonder dat daaraan ooit straffeloosheid verzekerd zij, aangemerkt, vervolgd en bestraft moeten worden overeenkomstig de algemeene regels van de binnenlandsche wetgeving.

Deel II

Artikel 19

De Hooge Verdragsluitende Partijen komen overeen, dat alle geschillen, welke tusschen haar zouden kunnen rijzen ten aanzien van de uitlegging of de toepassing van dit Verdrag, indien zij niet door rechtstreeksche onderhandelingen geregeld kunnen worden, ter beslissing aan het Permanente Hof van Internationale Justitie zullen worden voorgelegd. Indien de Hooge Verdragsluitende Partijen, tusschen welke een geschil rijst, of één harer, geen partij zijn bij het den datum van 16 December 1920 dragende Protocol met betrekking tot het Permanente Hof van Internationale Justitie, zal dit geschil met haar goedvinden en overeenkomstig de constitutioneele regels van ieder harer worden verwezen hetzij naar het Permanente Hof van Internationale Justitie, hetzij naar een overeenkomstig het Verdrag van 18 October 1907 in zake de vreedzame beslechting van internationale geschillen samengesteld scheidsgerecht, hetzij naar eenig ander scheidsgerecht.

Artikel 20

Dit Verdrag, waarvan de Fransche en de Engelsche tekst beide als authentiek zullen gelden, zal de dagteekening dragen van heden; het zal tot 31 December 1929 kunnen worden geteekend namens ieder Lid van den Volkenbond en iederen Staat niet-Lid, die ter Conferentie, welke dit Verdrag opgesteld heeft, vertegenwoordigd is geweest of aan wien de Raad van den Volkenbond een exemplaar van dit Verdrag zal hebben doen toekomen.

Dit Verdrag zal worden bekrachtigd. De akten van bekrachtiging zullen worden toegezonden aan den Secretaris-Generaal van den Volkenbond, die van de ontvangst daarvan kennis zal geven aan alle Leden van den Volkenbond alsmede aan de in het vorige lid bedoelde Staten niet-Leden.

Artikel 21

Van 1 Januari 1930 af zal toetreding tot dit Verdrag kunnen geschieden namens ieder Lid van den Volkenbond of iederen in artikel 20 bedoelden Staat niet-Lid, door wien het niet zou zijn onderteekend.

De akten van toetreding zullen worden toegezonden aan den Secretaris-Generaal van den Volkenbond, die van de ontvangst daarvan kennis zal geven aan alle Leden van den Bond en aan de in artikel 20 bedoelde Staten niet-Leden.

Artikel 22

De landen, die bereid zijn het Verdrag overeenkomstig het tweede lid van artikel 20 te bekrachtigen of er toe krachtens artikel 21 toe te treden, maar die verlangen gemachtigd te worden voorbehouden te maken ten aanzien van de toepassing van het Verdrag, zullen van hun voornemen den Secretaris-Generaal van den Volkenbond kennis kunnen geven. Deze zal onmiddellijk deze voorbehouden aan alle Hooge Verdragsluitende Partijen mededeelen, namens wie een akte van bekrachtiging of van toetreding zal zijn nedergelegd, en haar daarbij vragen, of zij bezwaren daartegen hebben in te brengen. Indien binnen een termijn van zes maanden na deze mededeeling geen der Hooge Verdragsluitende Partijen bezwaren gemaakt heeft, zal de deelneming aan het Verdrag van het land, dat het betreffende voorbehoud gemaakt heeft, beschouwd worden als door de andere Hooge Verdragsluitende Partijen onder dat voorbehoud te zijn aanvaard.

Artikel 23

De bekrachtiging door een Hooge Verdragsluitende Partij of haar toetreding tot dit Verdrag sluit in, dat haar wetgeving en haar administratieve organisatie in overeenstemming zijn met de in het Verdrag gestelde regels.

Artikel 24

Behoudens verklaring van het tegendeel door een Hooge Verdragsluitende Partij bij de onderteekening, bekrachtiging of toetreding zullen de bepalingen van dit Verdrag niet van toepassing zijn op koloniën, overzeesche gewesten, protectoraten of gebieden onder suzereiniteit of mandaat.

Evenwel behouden de Hooge Verdragsluitende Partijen zich het recht voor overeenkomstig de bepalingen der artikelen 21 en 23 voor haar koloniën, overzeesche gewesten, protectoraten of gebieden onder suzereiniteit of mandaat tot het Verdrag toe te treden. Zij behouden zich eveneens het recht voor het afzonderlijk overeenkomstig de bepalingen van artikel 27 op te zeggen.

Artikel 25

Dit Verdrag zal slechts in werking treden, wanneer het zal zijn bekrachtigd of wanneer er toe zal zijn toegetreden namens vijf Leden van den Volkenbond of Staten niet-Leden. De datum van inwerkingtreding zal zijn de negentigste dag volgende op de ontvangst door den Secretaris-Generaal van den Volkenbond van de vijfde bekrachtiging of toetreding.

Artikel 26

Iedere bekrachtiging of toetreding, die na de inwerkingtreding van het Verdrag overeenkomstig artikel 25 tot stand zal komen, zal van kracht worden op den negentigsten dag volgende op den datum van de ontvangst er van door den Secretaris-Generaal van den Volkenbond.

Artikel 27

Dit Verdrag zal namens ieder Lid van den Volkenbond of iederen Staat niet-Lid kunnen worden opgezegd door een schriftelijke kennisgeving gericht tot den Secretaris-Generaal van den Volkenbond, die er van mededeeling zal doen aan alle Leden van den Volkenbond en aan de in artikel 20 bedoelde Staten niet-Leden. De opzegging zal van kracht worden een jaar na den datum, waarop zij zal zijn ontvangen door den Secretaris-Generaal van den Volkenbond, en zal alleen gevolg hebben ten opzichte van de Hooge Verdragsluitende Partij, voor wie zij zal zijn geschied.

Artikel 28

Dit Verdrag zal worden geregistreerd door den Secretaris-Generaal van den Volkenbond op den datum van de inwerkingtreding.

TEN BLIJKE WAARVAN de bovengenoemde Gevolmachtigden dit Verdrag hebben onderteekend.

GEDAAN te Genève, den twintigsten April negentien honderd negen en twintig, in een enkel exemplaar, dat zal blijven berusten in het archief van het Secretariaat van den Volkenbond en waarvan eensluidend gewaarmerkte afschriften zullen worden afgegeven aan alle Leden van den Volkenbond en aan de in artikel 20 bedoelde Staten niet-Leden.
