Overeenkomst tussen het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden (de Benelux-staten) en de Republiek Kosovo betreffende de terug- en overname van onregelmatig binnengekomen en/of verblijvende personen (terug- en overnameovereenkomst)

Het Koninkrijk België,

het Groothertogdom Luxemburg

en

het Koninkrijk der Nederlanden,

die krachtens de bepalingen van de op 11 april 1960 gesloten Benelux-Overeenkomst gemeenschappelijk optreden (de BENELUX-Staten),

en

de Republiek Kosovo,

hierna genoemd „de Partijen”,

Ernaar strevend de samenwerking tussen de Partijen te bevorderen en de onderlinge communicatie te verbeteren teneinde beter uitvoering te geven aan de wetgeving en regelgeving inzake het personenverkeer,

Ernaar strevend hun gezamenlijke wens strekkende tot het efficiënt bestrijden van de illegale immigratie van Benelux-onderdanen of Kosovaarse staatsburgers alsmede van de onderdanen van een derde Staat te herbevestigen,

Ernaar strevend de internationaalrechtelijke verplichting tot terugname van eigen onderdanen ten uitvoer te brengen, en met name artikel 12, lid 4, van het internationale Verdrag van 19 december 1966 inzake burgerrechten en politieke rechten,

Ernaar strevend een verplichting tot overname van de onderdanen van een derde Staat tussen de Partijen tot stand te brengen, onder de voorwaarden in deze Overeenkomst genoemd,

Ernaar strevend, op basis van wederkerigheid, de terug- en overname van personen die onregelmatig op het grondgebied van een andere Partij zijn binnengekomen en/of verblijven, en de doorgeleiding van te verwijderen personen te vergemakkelijken,

Bezorgd dat deze terug- en overname snel en veilig moet plaatsvinden, volgens procedures die de menselijke waardigheid waarborgen;

Zijn het volgende overeengekomen:

Artikel 1. Definities en werkingssfeer

Voor de toepassing van deze Overeenkomst wordt verstaan onder:

  • 1. „grondgebied”:

    • voor de Benelux-Staten: het gezamenlijke grondgebied in Europa van het Koninkrijk België, van het Groothertogdom Luxemburg en van het Koninkrijk der Nederlanden;

    • voor de Republiek Kosovo: het grondgebied van de Republiek Kosovo;

  • 2. „onregelmatig binnengekomen en/of verblijvende persoon”: eenieder die niet of niet meer voldoet aan de geldende voorwaarden voor binnenkomst of verblijf;

  • 3. „terugname” en „overname”:

    terugname van een persoon van wie kan worden aangetoond of aannemelijk gemaakt dat hij de nationaliteit van één der Benelux-Staten of het staatsburgerschap van de Republiek Kosovo heeft, respectievelijk de overname van een onderdaan van een derde Staat; in beide gevallen voldoet de betrokkene niet meer aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van een van de andere Partijen;

  • 4. „eigen onderdaan of staatsburger”:

    • 1. eenieder die de nationaliteit heeft van één der Benelux-Staten;

    • 2. eenieder die het staatsburgerschap heeft of in aanmerking komt voor het staatsburgerschap van de Republiek Kosovo overeenkomstig artikel 29 van de wet op het staatsburgerschap van Kosovo.;

  • 5. „derde Staat”: elke Staat die geen Benelux-Staat en niet de Republiek Kosovo is;

  • 6. „onderdaan van een derde Staat”: eenieder die niet de nationaliteit van één van de Benelux-Staten noch het staatsburgerschap van de Republiek Kosovo heeft, waaronder wordt begrepen een staatloze;

  • 7. „staatloze”: de persoon waarvan de status door het Verdrag betreffende de status van staatlozen van 28 september 1954 wordt bepaald;

  • 8. „verzoekende Partij”: de Partij op wiens grondgebied zich een onregelmatig binnengekomen en/of verblijvende persoon bevindt en die om de terug- of overname van deze persoon dan wel zijn doorgeleiding verzoekt, onder de voorwaarden in deze Overeenkomst genoemd;

  • 9. „aangezochte Partij”: de Partij die wordt verzocht een onregelmatig binnengekomen en/of verblijvende persoon op haar grondgebied terug of over te nemen dan wel zijn doorgeleiding over haar grondgebied toe te staan, onder de voorwaarden in deze Overeenkomst genoemd;

  • 10. ”verblijfstitel”: een door de Partijen afgegeven vergunning, ongeacht van welke aard, die een persoon recht geeft om op haar grondgebied te verblijven. Hieronder valt niet de tijdelijke toelating tot verblijf met het oog op de behandeling van een asielverzoek of van een verzoek om een verblijfstitel.

Artikel 2. Terugname van eigen onderdanen of staatsburgers

  • 1 Iedere Partij neemt op verzoek van de andere Partij, zonder andere formaliteiten dan die welke in deze Overeenkomst zijn genoemd, de persoon op haar grondgebied terug die niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de verzoekende Partij, wanneer kan worden aangetoond of op basis van een begin van bewijs aannemelijk kan worden gemaakt dat hij de nationaliteit of het staatsburgerschap van de aangezochte Partij heeft.

  • 2 De terugnameplicht uit lid (1) geldt ook voor de persoon die na binnenkomst op het grondgebied van de verzoekende Partij de nationaliteit of het staatsburgerschap van de aangezochte Partij heeft verloren, tenzij die persoon tenminste een naturalisatietoezegging van de verzoekende Partij heeft ontvangen.

  • 3 Op verzoek van de verzoekende Partij, en conform de bepalingen van artikel 7, lid (6), van deze Overeenkomst, verstrekt de aangezochte Partij onverwijld en uiterlijk binnen drie dagen na de datum van ontvangst van het verzoek de met het oog op de teruggeleiding van de terug te nemen personen vereiste reisdocumenten.

  • 4 De verzoekende Partij neemt deze persoon onder dezelfde voorwaarden terug, indien uit een onderzoek, uitgevoerd binnen een termijn van drie maanden na de terugname van betrokkene, blijkt dat hij op het moment van het verlaten van het grondgebied van de verzoekende Partij niet de nationaliteit of het staatsburgerschap van de aangezochte Partij had, tenzij de terugnameplicht volgt uit lid (2).

Artikel 3. Overname van onderdanen van een derde Staat en staatlozen

  • 1 Iedere Partij neemt op verzoek van de andere Partij en zonder andere formaliteiten dan die welke in deze Overeenkomst zijn genoemd, elke onderdaan van een derde Staat over op haar grondgebied die niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de verzoekende Partij, wanneer kan worden aangetoond of op basis van een begin van bewijs aannemelijk kan worden gemaakt dat die onderdaan

    • 1. in het bezit is van een geldige verblijfstitel afgegeven door de aangezochte Partij, of

    • 2. in het bezit is van een geldig visum, anders dan een transitvisum, afgegeven door de aangezochte Partij, of

    • 3. bij binnenkomst op het grondgebied van de verzoekende Partij in het bezit was van een geldige verblijfstitel of een geldig visum, anders dan een transitvisum, afgegeven door de aangezochte Partij, of

    • 4. het grondgebied van de verzoekende Partij is binnengekomen nadat hij het grondgebied van de aangezochte Partij is doorgereisd of aldaar heeft verbleven.

  • 2 De in lid (1) bedoelde overnameplicht is niet van toepassing wanneer de verzoekende Partij aan de onderdaan van een derde Staat, vóór of na binnenkomst op het grondgebied van de verzoekende Partij, een visum, anders dan een transitvisum, of verblijfstitel heeft afgegeven met een langere geldigheidsduur dan die van het visum of de verblijfstitel die door de aangezochte Partij is afgegeven.

Artikel 4. Indiening van het verzoek om terug- of overname

  • 1 Een verzoek om terug- of overname op grond van artikel 2 of 3 wordt schriftelijk ingediend bij de bevoegde autoriteit van de aangezochte Partij.

  • 2 Elk verzoek om terug- of overname bevat de volgende inlichtingen:

    • 1. de personalia van de betrokkene (naam, voornamen, eventueel vroegere namen, namen van de ouders, bijnamen en pseudoniemen, alias, geslacht, geboortedatum en, indien mogelijk, geboorteplaats en laatste verblijfplaats op het grondgebied van de aangezochte Partij);

    • 2. een kopie van de bewijsmiddelen als bedoeld in artikel 5 of 6.

  • 3 Het verzoek om terug- of overname moet in een voorkomend geval ook de volgende inlichtingen bevatten:

    • 1. een indicatie waaruit blijkt dat de over te dragen persoon een bijzondere (medische of andere) behandeling behoeft of vervoer per ambulance vereist;

    • 2. alle andere beschermings- of veiligheidsmaatregelen die voor deze overdracht nodig kunnen zijn.

  • 4 Het verzoek om terug- of overname kan worden vervangen door een schriftelijke mededeling aan de aangezochte Partij binnen een redelijke termijn voor de terug- of overname van de betrokken persoon op voorwaarde dat de terug of over te nemen persoon in het bezit is van een geldig reisdocument en, indien van toepassing, een geldig visum of geldige verblijfstitel van de aangezochte Partij.

  • 5 Indien de terug of over te nemen persoon zich in de internationale zone van een luchthaven van één der Partijen bevindt kunnen de bevoegde luchthavenautoriteiten een vereenvoudigde procedure overeenkomen.

Artikel 5. Bewijsmiddelen met betrekking tot eigen onderdanen of staatsburgers

  • 1 Het bewijs van de nationaliteit of het staatsburgerschap overeenkomstig artikel 2 kan worden geleverd door middel van de navolgende documenten:

    • 1. een geldig paspoort of paspoortvervangend reisdocument met foto (laissez-passer);

    • 2. een geldig identiteitsbewijs;

    • 3. een geldig militair identiteitsbewijs of een ander identiteitsbewijs van het personeel van de strijdkrachten met een foto van de houder;

    • 4. een geldig zeemansboekje;

    • 5. een UNMIK reisdocument of identiteitsbewijs;

    • 6. een geldige consulaire kaart;

    • 7. andere officiële documenten waaruit de nationaliteit of het staatsburgerschap van betrokkene blijkt, afgegeven door de aangezochte Partij en voorzien van een foto;

    • 8. een document, zoals hiervoor beschreven, waarvan de geldigheidsduur is verstreken op de datum waarop het verzoek om terug- of overname wordt verzonden;

    • 9. informatie uit het Visuminformatiesysteem (VIS)1, op voorwaarde dat de Commissie overeenkomstig artikel 25, lid 6, van Richtlijn 95/46/EG een besluit heeft genomen over de passende bescherming van persoonsgegevens in dat derde land.

    Wanneer dergelijke documenten worden voorgelegd, erkennen de Partijen de nationaliteit of het staatsburgerschap zonder verdere formaliteiten.

  • 2 Het begin van bewijs van de nationaliteit of het staatsburgerschap overeenkomstig artikel 2 kan worden geleverd door middel van de navolgende documenten of elementen:

    • 1. een kopie van één van de in lid (1) genoemde documenten;

    • 2. een officieel identiteitsbewijs, afgegeven door de Voormalige Joegoslavische Republiek;

    • 3. andere documenten die kunnen bijdragen tot het vaststellen van de nationaliteit of het staatsburgerschap van de betrokkene (rijbewijs, e.a.);

    • 4. een document waaruit een consulaire inschrijving blijkt, een nationaliteits- of staatsburgerschapsbewijs, een bewijs van de burgerlijke stand of geboortebewijs afgegeven door de UNMIK;

    • 5. een bedrijfspas;

    • 6. afschriften/kopieën van de onder 2. tot en met 4. genoemde documenten;

    • 7. de taal waarin de persoon zich uitdrukt,

    • 8. een betrouwbare getuigenverklaring;

    • 9. de verklaring van de betrokkene zelf.

    Wanneer dergelijke documenten of elementen worden voorgelegd, nemen de Partijen de nationaliteit of het staatsburgerschap als vaststaand aan, tenzij de aangezochte Partij het tegendeel kan bewijzen.

  • 3 Indien geen van de in lid (1) of (2) genoemde documenten of elementen kan worden voorgelegd, kan de verzoekende Partij de aangezochte Partij verzoeken in het bevolkingsregister van de aangezochte Partij te onderzoeken. Een positief resultaat van het onderzoek geldt als bewijs als bedoeld in lid (1).

  • 4 Indien geen van de in lid (1), (2) en (3) genoemde documenten, elementen of gegevens kan worden voorgelegd, doch er naar de mening van de verzoekende Partij een vermoeden bestaat met betrekking tot de nationaliteit of het staatsburgerschap van de terug te nemen persoon, dan treffen de bevoegde autoriteiten van de aangezochte Partij de vereiste maatregelen om de nationaliteit of het staatsburgerschap van de betrokkene vast te stellen. Hiertoe zal de bij de verzoekende Partij geaccrediteerde diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij tot het horen van de betrokkene overgaan teneinde vast te stellen of het een eigen onderdaan of staatsburger betreft.

  • 5 Indien om feitelijke of technische redenen de bij de verzoekende Partij geaccrediteerde diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij niet in staat is om de betrokkene te horen, zal deze taak in uitzonderlijke omstandigheden worden uitgevoerd door ofwel een in onderlinge overeenstemming aangewezen deskundige ofwel een uitgenodigde delegatie van de aangezochte Partij die bij de verzoekende Partij is geaccrediteerd.

Artikel 6. Bewijsmiddelen met betrekking tot onderdanen van een derde Staat

  • 1 Het bewijs dat is voldaan aan de in artikel 3 vermelde voorwaarden voor overname van onderdanen van een derde Staat kan worden geleverd door middel van de navolgende bewijsmiddelen:

    • 1. geldige visa of verblijfstitels afgegeven door de aangezochte Partij;

    • 2. visa of verblijfstitels afgegeven door de aangezochte Partij, waarvan de geldigheidsduur niet langer dan twee jaar is verstreken;

    • 3. inreis- / uitreisstempels of soortgelijke aantekeningen in het reisdocument van de betrokkene waaruit diens binnenkomst of het verblijf op het grondgebied van de aangezochte Partij blijkt of waarmee zijn binnenkomst op het grondgebied van de verzoekende Partij vanuit het grondgebied van de aangezochte Partij kan worden aangetoond (reisroute);

    • 4. door de aangezochte Partij op naam afgegeven documenten (bijvoorbeeld: rijbewijs, legitimatiebewijs);

    • 5. documenten van de burgerlijke stand of een inschrijving op het grondgebied van de aangezochte Partij;

    • 6. kopieën van de onder 1. tot en met 5. genoemde documenten.

    Bovengenoemde bewijsmiddelen worden tussen de Partijen zonder verdere formaliteiten erkend.

  • 2 Een begin van bewijs dat is voldaan aan de in artikel 3 genoemde voorwaarden voor overname van onderdanen van een derde Staat kan worden geleverd door middel van de navolgende bewijsmiddelen:

    • 1. op naam gestelde reisbiljetten, bescheiden of facturen indien daaruit de binnenkomst of het verblijf van de betrokkene op het grondgebied van de aangezochte Partij blijkt, of waarmee zijn binnenkomst op het grondgebied van de verzoekende Partij vanuit het grondgebied van de aangezochte Partij kan worden aangetoond (bijvoorbeeld: hotelrekeningen, afspraakkaarten voor bezoek aan arts/tandarts, toegangsbewijzen voor openbare/particuliere instellingen, passagierslijsten voor vlieg- of bootreizen);

    • 2. inlichtingen waaruit blijkt dat de betrokkene gebruik heeft gemaakt van de diensten van een reisbegeleider of reisbureau;

    • 3. officiële verklaringen van met name met de controle aan de grens van de aangezochte Partij belaste ambtenaren en andere functionarissen die kunnen getuigen dat de betrokkene de grens van de aangezochte Partij heeft overschreden;

    • 4. officiële verklaringen van ambtenaren over de aanwezigheid van de betrokkene op het grondgebied van de aangezochte Partij;

    • 5. een sedert meer dan twee jaren verlopen verblijfstitel, afgegeven door de aangezochte Partij;

    • 6. een op schrift gestelde verklaring waarin de plaats en omstandigheden worden beschreven waaronder de betrokkene na binnenkomst op het grondgebied van de verzoekende Partij is onderschept;

    • 7. inlichtingen die door een internationale organisatie zijn verstrekt met betrekking tot de identiteit en het verblijf van de betrokkene op het grondgebied van de aangezochte Partij of van diens reisroute van het grondgebied van de aangezochte Partij naar dat van de verzoekende Partij;

    • 8. een door een reisgenoot afgelegde getuigenverklaring;

    • 9. verklaringen van de betrokkene zelf;

    • 10. andere bescheiden (bijvoorbeeld niet op naam gestelde toegangskaartjes) of betrouwbare informatie aan de hand waarvan het verblijf op of de doorreis over het grondgebied van de aangezochte Partij aannemelijk gemaakt kan worden.

    Wanneer dit begin van bewijs is geleverd, nemen de Partijen aan dat aan de voorwaarden is voldaan, tenzij de aangezochte Partij het tegendeel kan bewijzen.

Artikel 7. Termijnen

  • 1 Het verzoek om terugname van een eigen onderdaan of staatsburger kan op ieder ogenblik door de bevoegde autoriteit van de verzoekende Partij worden ingediend, wanneer is vastgesteld dat de betrokkene niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de verzoekende Partij.

  • 2 Het verzoek om overname van een onderdaan van een derde Staat moet door de bevoegde autoriteit van de verzoekende Partij worden ingediend binnen een termijn van ten hoogste één jaar nadat de verzoekende Partij kennis heeft gekregen van het feit dat deze persoon niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de verzoekende Partij. Indien er juridische of feitelijke belemmeringen zijn waardoor het verzoek niet tijdig kan worden ingediend, wordt de termijn, op verzoek, verlengd doch uiterlijk totdat de belemmeringen zijn opgeheven.

  • 3 Een verzoek om terug- of overname moet onverwijld en in elk geval uiterlijk binnen een termijn van 28 kalenderdagen worden beantwoord en de afwijzing van een verzoek om terug- of overname moet worden gemotiveerd. Deze termijn begint te lopen vanaf de datum van ontvangst van het verzoek om terug- of overname. Wanneer niet binnen deze termijn wordt geantwoord, wordt aangenomen dat met de overdracht wordt ingestemd.

  • 4 De resultaten van een onderzoek in het bevolkingsregister overeenkomstig artikel 5, lid (3) moeten onverwijld en in elk geval binnen 7 kalenderdagen dagen2vanaf de datum van het verzoek aan de verzoekende Partij worden verstrekt.

  • 5 Nadat de instemming is gegeven of, in voorkomend geval, nadat de termijn van 28 kalenderdagen is verstreken, draagt de verzoekende Partij de persoon met wiens terug- of overname werd ingestemd onverwijld en in elk geval uiterlijk binnen een termijn van drie maanden over. Deze termijn kan op verzoek worden verlengd met de tijd die nodig is om de juridische of praktische belemmeringen op te heffen.

  • 6 Op verzoek van de verzoekende Partij verstrekt de aangezochte Partij op naam van de over te dragen persoon onverwijld, doch uiterlijk binnen drie werkdagen, de voor zijn terugkeer noodzakelijke reisdocumenten met een geldigheidsduur van drie maanden. Kan de aangezochte Partij het gevraagde reisdocument niet binnen drie werkdagen na de datum van ontvangst van het verzoek verstrekken, dan wordt aangenomen dat zij instemt met het gebruik van een door de verzoekende Partij verstrekt reisdocument. Indien de betrokkene om juridische of feitelijke redenen niet binnen de geldigheidstermijn van het oorspronkelijk afgegeven reisdocument kan worden overgedragen dan verstrekt de aangezochte Partij binnen drie werkdagen een nieuw reisdocument met dezelfde geldigheidsduur.

Artikel 8. Overdrachtmodaliteiten en wijze van vervoer

  • 1 Voordat een persoon wordt overgedragen stellen de bevoegde autoriteiten van de verzoekende Partij schriftelijk de bevoegde autoriteiten van de aangezochte Partij in kennis van de datum en de modaliteiten van de overdracht alsmede van het eventuele gebruik van begeleiders.

  • 2 Geen enkele wijze van vervoer, hetzij door de lucht, over land of over zee, is verboden doch in de regel geschiedt de overdracht door de lucht. De overdracht per vliegtuig kan plaatsvinden met gebruikmaking van lijn- of chartervluchten.

Artikel 9. Doorgeleiding

  • 1 De Partijen staan de doorgeleiding van onderdanen van een derde Staat over hun grondgebied toe indien een andere Partij daarom verzoekt, wanneer de verdere reis in eventuele andere Staten van doorreis en de overname door de Staat van bestemming verzekerd zijn.

  • 2 De Partijen doen het nodige om doorgeleiding van onderdanen van een derde Staat te beperken tot gevallen waarin die personen niet rechtstreeks aan de Staat van bestemming kunnen worden overgedragen.

  • 3 Doorgeleiding kan door de Partijen worden geweigerd:

    • 1. indien de onderdaan van een derde Staat in de Staat van bestemming of een andere Staat van doorreis een reëel risico loopt te worden onderworpen aan foltering, onmenselijke of vernederende behandeling of bestraffing, de doodstraf of te worden vervolgd op grond van zijn ras, godsdienst, nationaliteit, het behoren tot een bepaalde sociale groep of zijn politieke overtuiging;

    • 2. indien de onderdaan van een derde Staat op het grondgebied van de aangezochte Partij, strafrechtelijk vervolgd zal worden of de tenuitvoerlegging van een strafvonnis zal ondergaan.

  • 4 De Partijen kunnen elke verleende toestemming intrekken indien zich later omstandigheden als bedoeld in lid (3) voordoen die de doorgeleiding belemmeren of indien de verdere reis in eventuele Staten van doorreis of de overname door de Staat van bestemming niet meer verzekerd is. In die gevallen neemt de verzoekende Partij de betrokkene onverwijld op haar grondgebied terug.

Artikel 10. Doorgeleidingsprocedure

  • 1 Een doorgeleidingsverzoek moet schriftelijk worden ingediend bij de bevoegde autoriteiten en moet de volgende inlichtingen bevatten:

    • 1. type van doorgeleiding (door de lucht, over land of zee), de eventuele andere Staten van doorreis en de Staat van de beoogde eindbestemming;

    • 2. personalia van de betrokkene (naam, voornamen, geboortedatum en, in voorkomend geval, geboorteplaats, nationaliteit of staatsburgerschap, aard en nummer van het reisdocument);

    • 3. voorgestelde plaats van grensoverschrijding, tijdstip van overdracht en eventueel gebruik van begeleiders;

    • 4. een verklaring waarin wordt gesteld dat volgens de verzoekende Partij is voldaan aan de voorwaarden vermeld in artikel 9, lid (1) en (2), en dat er geen redenen bekend zijn voor een weigering op grond van artikel 9, lid (3).

  • 2 De bevoegde autoriteit van de aangezochte Partij brengt de bevoegde autoriteit van de verzoekende Partij onverwijld schriftelijk op de hoogte van de toelating, met bevestiging van de plaats waar de grens wordt overschreden en het geplande tijdstip van toelating, of van de weigering van de toelating en de redenen daarvoor.

  • 3 Indien de doorgeleiding door de lucht gebeurt, worden aan de door te geleiden persoon en eventuele begeleiders de noodzakelijke faciliteiten met het oog op toegang tot de nationale of internationale zone van de luchthaven van de aangezochte Partij verleend.

  • 4 De bevoegde autoriteiten van de aangezochte Partij steunen, mits in onderling overleg, de doorgeleiding, met name door toezicht op de betrokkenen en stellen daartoe geschikte voorzieningen beschikbaar.

Artikel 11. Kosten

Onverminderd het recht van de bevoegde autoriteiten om de aan de terug- of overname verbonden kosten van de terug of over te nemen persoon of derden terug te vorderen, komen alle kosten in verband met terug- of overname en doorgeleiding uit hoofde van deze Overeenkomst tot aan de grens van de Staat van eindbestemming ten laste van de verzoekende Partij.

Artikel 12. Gegevensbescherming

Persoonsgegevens worden alleen verstrekt wanneer dit nodig is voor de tenuitvoerlegging van deze Overeenkomst door de bevoegde autoriteiten van de Partijen. De verwerking en behandeling van persoonsgegevens in een bepaald geval zijn onderworpen aan de wetgeving van de Republiek Kosovo en, wanneer de behandeling door een bevoegde autoriteit van een Benelux-Staat wordt uitgevoerd, aan de bepalingen van Richtlijn 95/46/EG van 24 oktober 1995 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens, en de uit hoofde van deze Richtlijn vastgestelde nationale wetgeving. Daarnaast zijn de volgende beginselen van toepassing:

  • 1. persoonsgegevens moeten redelijk en rechtmatig worden verwerkt;

  • 2. persoonsgegevens moeten voor het welbepaalde, uitdrukkelijk omschreven en gerechtvaardigd doel van de tenuitvoerlegging van deze Overeenkomst worden verkregen en mogen door de mededelende of ontvangende autoriteit niet verder worden verwerkt op een wijze die onverenigbaar is met dat doel;

  • 3. persoonsgegevens moeten passend, relevant en niet bovenmatig zijn, uitgaande van de doeleinden waarvoor zij worden verzameld en/of vervolgens worden verwerkt; de verstrekte persoonsgegevens mogen met name uitsluitend betrekking hebben op:

    • de personalia van de over te dragen persoon (naam, voornaam, eventuele vroegere namen, bijnamen of pseudoniemen, geboortedatum en -plaats, geslacht, huidige en vorige nationaliteit of staatsburgerschap);

    • identiteitsbewijs of paspoort (serienummer, geldigheidsduur, datum van afgifte, afgevende autoriteit, plaats van afgifte);

    • verblijfplaatsen en reisroutes;

    • andere voor identificatie van de over te dragen persoon of voor het onderzoek van de terug- of overnamevereisten uit hoofde van deze Overeenkomst dienstige gegevens;

  • 4. persoonsgegevens moeten nauwkeurig zijn en moeten zo nodig worden bijgewerkt;

  • 5. persoonsgegevens mogen in een vorm die het mogelijk maakt de betrokkenen te identificeren, niet langer worden bewaard dan voor de verwezenlijking van de doeleinden waarvoor zij worden verzameld of vervolgens worden verwerkt, noodzakelijk is;

  • 6. de mededelende en de ontvangende autoriteit treffen alle passende maatregelen om waar nodig te zorgen voor het rectificeren, het schrappen of het afschermen van persoonsgegevens wanneer de verwerking niet in overeenstemming is met de bepalingen van dit artikel, met name omdat de gegevens niet passend, irrelevant, onnauwkeurig of bovenmatig zijn in verhouding tot het doel van de verwerking. Dit behelst tevens de kennisgeving van elke rectificatie, schrapping of afscherming aan de andere Partij;

  • 7. op verzoek stelt de ontvangende autoriteit de mededelende autoriteit in kennis van het gebruik dat van de verstrekte gegevens is gemaakt en van de daardoor verkregen resultaten;

  • 8. persoonsgegevens mogen uitsluitend aan de bevoegde autoriteiten worden verstrekt. Voor de verdere verstrekking aan andere instanties is de voorafgaande goedkeuring van de mededelende autoriteit vereist;

  • 9. de mededelende en ontvangende autoriteiten zijn verplicht de verstrekking en ontvangst van persoonsgegevens schriftelijk te registreren.

Artikel 13. Onverminderde toepasselijkheid

Deze Overeenkomst doet geen afbreuk aan de verplichtingen die voortvloeien uit:

Artikel 14. Comité van deskundigen

  • 1 De Partijen verlenen elkaar onderling hulp bij de toepassing en uitlegging van deze Overeenkomst. Daartoe stellen zij een Comité van deskundigen in dat met name:

    • 1. de toepassing van deze Overeenkomst volgt;

    • 2. voorstellen doet om vraagstukken in verband met de toepassing van deze Overeenkomst op te lossen;

    • 3. wijzigingen van en aanvullingen op deze Overeenkomst voorstelt;

    • 4. passende maatregelen ter bestrijding van illegale immigratie uitwerkt en aanbeveelt.

  • 2 De Partijen behouden zich het recht voor om de door het Comité van deskundigen voorgestelde maatregelen al dan niet goed te keuren.

  • 3 Het Comité bestaat uit één vertegenwoordiger voor België, één vertegenwoordiger voor Luxemburg, één vertegenwoordiger voor Nederland en drie (3) vertegenwoordigers voor de Republiek Kosovo. De Partijen wijzen daarin de voorzitter en zijn plaatsvervangers aan. Plaatsvervangende leden worden benoemd. Indien nodig kunnen andere deskundigen bij de werkzaamheden van het Comité worden betrokken.

  • 4 Het Comité komt indien nodig bijeen op verzoek van één van de Partijen.

Artikel 15. Uitvoeringsprotocol

Alle nodige praktische bepalingen voor de uitvoering van deze Overeenkomst worden in het Uitvoeringsprotocol vastgelegd. In het Uitvoeringsprotocol wordt onder andere geregeld:

  • 1. de aanwijzing van de bevoegde autoriteiten van de Partijen;

  • 2. de aanwijzing van de plaatsen voor het overschrijden van de grenzen;

  • 3. de voorwaarden waaronder en de wijze waarop begeleiding plaatsvindt van terug of over te nemen of door te geleiden personen.

Artikel 16. Territoriale toepassing

Wat het Koninkrijk der Nederlanden betreft, kan de toepassing van deze Overeenkomst tot de buiten Europa gelegen gebiedsdelen van het Koninkrijk worden uitgebreid door een kennisgeving aan de Regering van het Koninkrijk België, depositaris van deze Overeenkomst, die de overige Partijen hiervan in kennis stelt.

Artikel 17. Inwerkingtreding

  • 1 Deze Overeenkomst treedt in werking op de eerste dag van de tweede maand die volgt op de datum van ontvangst door de Regering van het Koninkrijk België van de notificaties van twee Ondertekenende Staten, waarvan de ene de Republiek Kosovo is, waarbij ervan kennis wordt gegeven dat de voor de inwerkingtreding vereiste interne formaliteiten zijn nageleefd.

  • 2 Ten aanzien van iedere andere Ondertekenende Staat treedt deze Overeenkomst in werking op de eerste dag van de tweede maand die volgt op de datum van ontvangst door de Regering van het Koninkrijk België van de notificatie waarbij ervan kennis wordt gegeven dat de voor de inwerkingtreding vereiste interne formaliteiten zijn nageleefd.

  • 3 De Regering van het Koninkrijk België stelt ieder der Ondertekenende Staten in kennis van de in lid (1) en (2) bedoelde notificaties en van de data van de inwerkingtreding van deze Overeenkomst ten aanzien van de Partijen.

Artikel 18. Schorsing, opzegging

  • 1 Deze Overeenkomst wordt voor onbepaalde tijd gesloten.

  • 2 Het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden gezamenlijk en de Republiek Kosovo kunnen deze Overeenkomst, na kennisgeving aan de Regering van het Koninkrijk België, die de overige Partijen hiervan in kennis stelt, om ernstige redenen, met name in verband met de bescherming van de staatsveiligheid, de openbare orde of de volksgezondheid, schorsen. Wat betreft de intrekking van een dergelijke maatregel, brengen de Partijen elkaar onverwijld via diplomatieke weg op de hoogte.

  • 3 De schorsing van deze Overeenkomst wordt van kracht op de eerste dag van de eerste maand volgende op de maand waarin de kennisgeving bedoeld in lid (2) door de Regering van het Koninkrijk België is ontvangen.

  • 4 Het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden gezamenlijk en de Republiek Kosovo kunnen deze Overeenkomst, na mededeling aan de Regering van het Koninkrijk België, die de overige Partijen hiervan in kennis stelt, om ernstige redenen opzeggen.

  • 5 De opzegging van deze Overeenkomst wordt van kracht op de eerste dag van de tweede maand volgende op de maand waarin de kennisgeving bedoeld in lid (4) door de Regering van het Koninkrijk België is ontvangen.

Artikel 19. Depositaris

De Regering van het Koninkrijk België is depositaris van deze Overeenkomst.

TEN BLIJKE waarvan de vertegenwoordigers van de Partijen, daartoe naar behoren gemachtigd, deze Overeenkomst hebben ondertekend.

GEDAAN te Brussel, op 12 mei 2011, in de Engelse, Franse, Nederlandse Albanese en Servische taal, zijnde de teksten in elk van de talen gelijkelijk authentiek. In geval van verschillen in interpretatie is de Engelse tekst (werktaal) doorslaggevend.

Het origineel zal worden nedergelegd bij de Regering van het Koninkrijk België, depositaris van deze Overeenkomst, die een voor eensluidend gewaarmerkt afschrift daarvan aan alle Partijen toezendt.

Uitvoeringsprotocol bij de overeenkomst tussen het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden (de Benelux-staten) en de Republiek Kosovo betreffende de terug- en overname van onregelmatig binnengekomen en/of verblijvende personen (terug- en overnameovereenkomst)

Zijn het volgende overeengekomen:

Artikel 1. Definities

Voor de toepassing van dit Uitvoeringsprotocol wordt verstaan onder:

  • 1. diplomatieke vertegenwoordiging: de diplomatieke vertegenwoordiging van de aangezochte Partij op het grondgebied van de verzoekende Partij;

  • 2. begeleider(s): de door de verzoekende Partij aangewezen persoon (of personen), belast met de begeleiding van de terug of over te nemen of door te geleiden persoon.

Artikel 2. Verzoek om terug- of overname

  • 1 Een verzoek om terug- of overname dat de inlichtingen bevat als bedoeld in artikel 4, van de Overeenkomst, wordt per telefax of via elektronische weg ingediend bij de bevoegde autoriteit van de aangezochte Partij.

  • 2 Voor de indiening van het verzoek om terugname van een eigen onderdaan of staatsburger wordt gebruik gemaakt van het formulier dat als bijlage 1 A aan dit Uitvoeringsprotocol is gehecht. Voor de indiening van het verzoek om overname van een onderdaan van een derde Staat wordt gebruik gemaakt van het formulier dat als bijlage 1 B aan dit Uitvoeringsprotocol is gehecht.

  • 4 De verzoekende Partij wendt zich voor het verstrekken alsmede voor het verkrijgen van nadere inlichtingen met betrekking tot het ingediende verzoek om terug- of overname tot de bevoegde autoriteit van de aangezochte Partij.

  • 5 Het antwoord op een verzoek om terug- of overname wordt per telefax of via elektronische weg overgemaakt aan de bevoegde autoriteit van de verzoekende Partij door middel van het formulier dat als bijlage 1A of 1B aan dit Uitvoeringsprotocol is gehecht.

Artikel 3. Reisdocumenten

  • 1 Ingeval van een positief antwoord op het verzoek om terug- of overname, worden de voor terugkeer noodzakelijke reisdocumenten overeenkomstig artikel 7, lid (6), van de Overeenkomst, op naam van de over te dragen persoon gesteld en door de diplomatieke vertegenwoordiging aan de bevoegde autoriteiten van de verzoekende Partij overhandigd.

  • 2 Op grond van artikel 7, lid (6), van de Overeenkomst, wordt de aangezochte Partij, indien de diplomatieke vertegenwoordiging het gevraagde reisdocument niet binnen drie werkdagen na de datum van ontvangst van het verzoek daartoe kan verstrekken, geacht in te stemmen met het gebruik van een door de verzoekende Partij verstrekt reisdocument. De documenten die de Partijen voor dit doel zullen gebruiken zijn als bijlage 4 en 5 aan dit Uitvoeringsprotocol gehecht.

Artikel 4. Overdracht

  • 1 De bevoegde autoriteit van de verzoekende Partij stelt de bevoegde autoriteit van de aangezochte Partij, per telefax of via elektronische weg, minimaal twee werkdagen vóór de geplande overdracht in kennis van haar voornemen daartoe over te gaan. Daartoe wordt gebruik gemaakt van het formulier dat als bijlage 2 aan dit Uitvoeringsprotocol is gehecht.

  • 2 Indien de overdracht van de terug- of over te nemen persoon binnen de in artikel 7, lid (5), van de Overeenkomst genoemde termijn van drie maanden niet kan plaatsvinden stelt de verzoekende Partij de bevoegde autoriteit van de aangezochte Partij, daarvan onverwijld in kennis.

  • 3 Indien medische redenen vervoer over de weg of over zee rechtvaardigen, maken de bevoegde autoriteiten van de verzoekende Partij daarvan afzonderlijk melding op het formulier dat als bijlage 2 aan dit Uitvoeringsprotocol is gehecht.

Artikel 5. Procedure met het oog op de doorgeleiding van onderdanen van een derde Staat en staatlozen

  • 1 Een verzoek om doorgeleiding wordt minimaal twee dagen voor de geplande doorgeleiding per telefax of via elektronische weg ingediend bij de bevoegde autoriteit van de aangezochte Partij. Voor de indiening van het verzoek wordt gebruik gemaakt van het formulier dat als bijlage 6 aan dit Uitvoeringsprotocol is gehecht.

  • 2 De bevoegde autoriteit van de aangezochte Partij bericht onverwijld, per telefax of via elektronische weg, of zij instemt met de doorgeleiding en het hiervoor geplande tijdstip, de plaats waar de grens wordt overschreden, de wijze van vervoer en het gebruik van begeleiders. Daartoe wordt gebruik gemaakt van het in lid 1, van dit artikel, bedoelde formulier.

  • 3 Doorgeleiding geschiedt in beginsel door de lucht.

Artikel 6. Ondersteuning van de doorgeleiding

  • 1 Indien de verzoekende Partij ondersteuning van de doorgeleiding door de autoriteiten van de aangezochte Partij noodzakelijk acht, geeft zij dit verzoek aan in het formulier dat als bijlage 6 aan dit Uitvoeringsprotocol is gehecht.

  • 2 Bij gelegenheid van het antwoord op het verzoek om doorgeleiding bericht de aangezochte Partij of zij kan voorzien in de gevraagde ondersteuning. De Partijen treden zo nodig nader met elkaar in overleg.

  • 3 Indien de betrokkene wordt begeleid, geschieden de bewaking en het aan boord brengen onder het gezag van de aangezochte Partij.

Artikel 7. Verplichtingen van de begeleiders

  • 1 Bij de uitvoering van de doorgeleiding zijn de bevoegdheden van de begeleiders beperkt tot zelfverdediging. Daarnaast kunnen de begeleiders, bij afwezigheid van terzake bevoegde ambtenaren van de aangezochte Partij of ter ondersteuning van deze ambtenaren, in reactie op een onmiddellijke en ernstige dreiging op redelijke en evenredige wijze optreden om te voorkomen dat de betrokkene vlucht, zichzelf of derden letsel toebrengt dan wel schade aan goederen veroorzaakt.

  • 2 De begeleiders moeten in alle omstandigheden het recht van de aangezochte Partij naleven.

  • 3 Begeleiders voeren hun taak ongewapend en in burgerkledij uit. Zij dienen te zijn voorzien van een document waaruit blijkt dat toestemming is verleend voor de terug- of overname of de doorgeleiding en dienen te allen tijde in staat te zijn hun identiteit en dienstopdracht aan te tonen.

  • 4 De autoriteiten van de aangezochte Partij verlenen de begeleiders bij de uitoefening van hun taken in het kader van de Overeenkomst dezelfde bescherming en bijstand als aan de eigen terzake bevoegde ambtenaren.

Artikel 8. Aanwijzing bevoegde autoriteiten

Overeenkomstig artikel 15, onder 1, van de Overeenkomst wisselen de Partijen uiterlijk 30 dagen na de sluiting van dit Uitvoeringsprotocol schriftelijk een lijst van de voor de uitvoering van de Overeenkomst bevoegde autoriteiten uit. Iedere wijziging in deze lijst delen zij elkaar onverwijld mede.

Artikel 9. Aanwijzing plaatsen grensoverschrijding

Overeenkomstig artikel 15, onder 2, van de Overeenkomst delen de Partijen elkaar uiterlijk 30 dagen na de sluiting van dit Uitvoeringsprotocol schriftelijk mede via welke grensovergangen personen daadwerkelijk worden overgedragen en toegelaten. Iedere wijziging in deze lijst delen zij elkaar onverwijld mede.

Artikel 10. Kosten

Door de aangezochte Partij gemaakte kosten in verband met terug- of overname en doorgeleiding welke op grond van artikel 11, van de Overeenkomst ten laste van de verzoekende Partij komen, worden door de verzoekende Partij na overlegging van een factuur vergoed.

Artikel 11. Comité van deskundigen

De Partijen stellen elkaar binnen de dertig dagen na de inwerkingtreding van de Overeenkomst in kennis van de samenstelling van hun delegatie in het krachtens artikel 14, van de Overeenkomst ingestelde Comité van deskundigen. Iedere wijziging in hun delegatie delen zij elkaar onverwijld mede.

Artikel 12. Taal

Partijen communiceren met elkaar in de Engelse taal.

Artikel 13. Wijziging van de bijlagen

  • 2 Elke wijziging van de bijlagen bij dit Uitvoeringsprotocol wordt schriftelijk overeengekomen tussen de Partijen en wordt van kracht op een door de Partijen te bepalen datum.

Artikel 14. Inwerkingtreding en opzegging

Dit Uitvoeringsprotocol wordt overeenkomstig artikel 17 en 18, van de Overeenkomst toegepast en gelijktijdig met de opzegging van de Overeenkomst opgezegd.

Artikel 15. Depositaris

Het Koninkrijk België is depositaris van dit Uitvoeringsprotocol. De depositaris zal alle Partijen een voor eensluidend verklaard afschrift daarvan overmaken.

Agreement between the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands (the States of the Benelux) and the Republic of Kosovo concerning the readmission of persons who have entered and/or are residing without authorisation (readmission agreement)

The Kingdom of Belgium,

the Grand Duchy of Luxembourg

and

the Kingdom of the Netherlands,

acting jointly by virtue of the provisions of the Benelux Convention concluded on 11 April 1960 (the States of the BENELUX),

and

the Republic of Kosovo,

hereafter referred to as “the Parties”,

Striving to promote cooperation between the Parties and to improve communication between them in order to better execute the laws and regulations on the circulation of persons,

Striving to reconfirm their common desire to effectively combat the illegal immigration of Benelux nationals or Kosovar citizens as well as of third State nationals,

Striving to fulfil the obligation under international law to readmit their own nationals, especially article 12, paragraph 4, of the International Covenant of 19 December 1966 on Civil and Political Rights,

Striving to establish an obligation to readmit the third State nationals between the Parties, under the conditions set forth in this Agreement,

Striving, on the basis of reciprocity, to facilitate the readmission of persons who have entered and/or are residing on the territory of another Party without authorisation, and the transit of persons to be removed,

Concerned to ensure that such readmission takes place quickly and safely, according to procedures which guarantee respect for human dignity;

Have agreed as follows:

Article 1. Definitions and scope

For the purposes of this Agreement, the following terms shall be understood to have the following meanings:

  • 1. “territory”:

    • for the States of the Benelux: the combined territory in Europe of the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands;

    • for the Republic of Kosovo: the territory of the Republic of Kosovo;

  • 2. “person who has entered and/or is residing without authorisation”: anyone who does not fulfil or no longer fulfils the conditions in force for entry or residence;

  • 3. “readmission”:

    the readmission of a person of whom it can be proven or plausibly demonstrated that he has either the nationality of one of the States of Benelux, the citizenship of the Republic of Kosovo or who is a third State national and who does not fulfil or no longer fulfils the conditions for entry or residence in the territory of one of the other Parties;

  • 4. “own national or citizen”:

    • 1. Anyone who has the nationality of one of the States of the Benelux;

    • 2. Anyone who has the citizenship or is eligible for the citizenship of the Republic of Kosovo in accordance with Article 29 of the Law of Citizenship of Kosovo;

  • 5. “third State”: any State which is neither a State of the Benelux nor the Republic of Kosovo;

  • 6. “third State national”: anyone who has neither the nationality of one of the States of the Benelux nor the citizenship of the Republic of Kosovo, including stateless persons;

  • 7. “stateless person”: a person whose status is governed by the Convention relating to the Status of Stateless Persons of 28 September 1954;

  • 8. “requesting Party”: the Party on whose territory a person who has entered and/or is residing without authorisation is to be found and which requests the readmission of this person or his transit, under the conditions set forth in this Agreement;

  • 9. “requested Party”: the Party which is asked to readmit a person who has entered and/or is residing without authorisation to its territory or to allow his transit over its territory, under the conditions set forth in this Agreement;

  • 10. ”residence permit”: authorisation issued by one of the Parties, regardless of what type, which gives a person the right to stay on its territory. This does not include temporary permission to reside with a view to the processing of an asylum application or of a request for a residence permit.

Article 2. Readmission of own nationals or citizens

  • 1 Each Party shall readmit to its territory, at the request of the other Party, without any formalities other than those which are set forth in this Agreement, a person who does not fulfil or no longer fulfils the conditions for entry into or residence in the territory of the requesting Party, when it can be proven, or, on the basis of prima facie evidence, it can be plausibly demonstrated, that he has the nationality or the citizenship of the requested Party.

  • 2 The readmission obligation in paragraph (1) also applies in the case of a person who, after entering the territory of the requesting Party, has lost the nationality or the citizenship of the requested Party, unless the person concerned has received at least a naturalisation commitment from the requesting Party.

  • 3 At the request of the requesting Party, and in accordance with the provisions of article 7, paragraph (6) of this agreement, the requested Party shall immediately and within three days at the latest after the date of reception of the request issue the travel documents required for the return journey of the persons to be readmitted.

  • 4 The requesting Party shall readmit this person on the same conditions should it emerge from examination within three months at the latest following the readmission of the person concerned that at the time of leaving the territory of the requesting Party he did not have the nationality or the citizenship of the requested Party, unless the readmission obligation follows from paragraph (2).

Article 3. Readmission of third State nationals and stateless persons

  • 1 Each Party shall readmit, at the request of the other Party and without any formalities other than those which are set forth in this Agreement, any third State national to its territory who does not fulfil or no longer fulfils the conditions for entry into or residence in the territory of the requesting Party, when it can be proven, or on the basis of prima facie evidence it can be plausibly demonstrated, that this national

    • 1. possesses a valid residence permit issued by the requested Party, or

    • 2. possesses a valid visa, other than a transit visa, issued by the requested Party, or

    • 3. upon entering the territory of the requesting Party possessed a valid residence permit or a valid visa, other than a transit visa, issued by the requested Party, or

    • 4. entered the territory of the requesting Party after having travelled through the territory of the requested Party or resided there.

  • 2 The readmission obligation set forth in paragraph (1) does not apply in the event that the requesting Party issued to the third State national concerned, before or after that person’s entry into its territory, a visa other than a transit visa, or a residence permit with a longer period of validity than that of the visa or the residence permit which was issued by the requested Party.

Article 4. Submission of the request for readmission

  • 1 A request for readmission on the basis of article 2 or 3 shall be submitted in writing to the competent authority of the requested Party.

  • 2 Each request for readmission shall include the following information:

    • 1. the personal details of the person concerned (surname, given names, any previous names, parent’s names, nicknames and pseudonyms, alias, sex, date of birth and, if possible, place of birth and last place of residence in the territory of the requested Party);

    • 2. copies of the items of evidence as mentioned in article 5 or 6.

  • 3 The request for readmission shall also include the following information, where appropriate:

    • 1. evidence that the person to be transferred needs special (medical or other) treatment or must be transported by ambulance;

    • 2. notification of all other protective or safety measures which might be necessary for this transfer.

  • 4 The request for readmission may be replaced by a written communication to the requested Party within a reasonable period to secure the readmission of the person concerned, provided that the person to be readmitted possesses a valid travel document and, if applicable, a valid visa or valid residence permit of the requested Party.

  • 5 If the person to be readmitted is in the international zone of an airport of one of the Parties, the competent airport authorities may agree on a simplified procedure.

Article 5. Proof with regard to own nationals or citizens

  • 1 The proof of nationality or citizenship in accordance with article 2 can be furnished by means of the following documents:

    • 1. a valid passport or passport-replacing travel document with photo (laissez-passer);

    • 2. a valid identity card;

    • 3. a valid military identity card or other armed forces personnel identity card with a photo of the holder;

    • 4. a valid seaman's book;

    • 5. a UNMIK travel document or identity card;

    • 6. a valid consular card;

    • 7. other official documents indicating the nationality or the citizenship of the person concerned, issued by the requested Party and bearing a photo;

    • 8. a document, as described above, which is no longer valid on the date on which the request for readmission is sent;

    • 9. information from the Visa Information System (VIS)3, provided the Commission has adopted a decision on the adequate protection of personal data in that third country in accordance with Article 25(6) of Directive 95/46/EC.

    When such documents are presented, the Parties shall recognise the person’s nationality or citizenship without further formalities.

  • 2 Prima facie evidence of nationality or citizenship in accordance with article 2 can be furnished by means of the following documents or items:

    • 1. a copy of one of the documents mentioned in paragraph (1);

    • 2. an official document of identification issued by the former Republic of Yugoslavia;

    • 3. other documents which may help to establish the nationality or the citizenship of the person concerned (driving licence etc.);

    • 4. a document indicating consular registration, proof of nationality or citizenship, proof issued by the municipal registry of births, marriages and death or birth certificates issued by UNMIK;

    • 5. a company pass;

    • 6. copies of the documents mentioned in points 2 to 4 inclusive;

    • 7. the language in which the person communicates;

    • 8. a reliable witness statement;

    • 9. the statement made by the person himself.

    When such documents or items are presented, the Parties shall accept the nationality or citizenship as having been established, unless the requested Party can disprove it.

  • 3 If none of the documents or items mentioned in paragraphs (1) and (2) can be presented, the requesting Party may request the requested Party to perform a research in its civil register. A positive outcome of this research shall be considered as a proof in paragraph (1).

  • 4 If none of the documents, items or data mentioned in paragraphs (1), (2) and (3) can be presented, but the requesting Party believes that a presumption exists with regard to the nationality or the citizenship of the person to be readmitted, the competent authorities of the requested Party shall take the necessary measures to determine the nationality or the citizenship of the person concerned. To this end the diplomatic or consular mission of the requested Party accredited with the requesting Party will interview the person concerned in order to determine whether he is one of its own nationals or citizens.

  • 5 If, for factual or technical reasons, the diplomatic or consular mission of the requested Party accredited with the requesting Party is unable to interview the person concerned, this task shall be handled in exceptional circumstances by either an expert appointed on a common agreement or an invited delegation from the requested Party accredited with the requesting Party.

Article 6. Proof with regard to third State nationals

  • 1 Proof that the conditions set for the readmission of third State nationals mentioned in article 3 have been met can be furnished by means of the following items of evidence:

    • 1. valid visas or residence permits issued by the requested Party;

    • 2. visas or residence permits issued by the requested Party whose period of validity has expired within the previous two years;

    • 3. entry / exit stamps or similar marks in the travel document of the person concerned demonstrating his entry into or residence in the territory of the requested Party or demonstrating his entry into the territory of the requesting Party from that of the requested Party (travel route);

    • 4. documents issued in the person’s name by the requested Party (e.g. driving licence, identity card);

    • 5. documents issued by the registry of births, marriages and deaths or registration on the territory of the requested Party;

    • 6. copies of the documents named in points 1 to 5 inclusive.

    The above items of evidence shall be recognised between the Parties without any further formalities.

  • 2 Prima facie proof that the conditions set for the readmission of third State nationals mentioned in article 3 have been met can be furnished by means of the following items of evidence:

    • 1. travel tickets, documents or invoices bearing the person’s name if they show the person’s entry into, or residence in, the territory of the requested Party, or that show his entry into the territory of the requesting Party from that of the requested Party (e.g. hotel bills, appointment cards for visit to doctor/dentist, passes granting access to public/private institutions, passenger lists for plane or boat trips);

    • 2. information showing that the person concerned used the services of a tour guide or travel agency;

    • 3. official declarations, in particular by border control officials working at the border of the requested Party and other public servants who can testify that the person concerned crossed the border of the requested Party;

    • 4. official declarations by public servants about the presence of the person concerned in the territory of the requested Party;

    • 5. a residence permit issued by the requested Party which expired more than two years ago;

    • 6. a written declaration describing the place where, and the circumstances in which, the person concerned was intercepted after entering the territory of the requesting Party;

    • 7. information provided by an international organisation with regard to the person’s identity and his residence in the territory of the requested Party or his travel route from the territory of the requested Party to that of the requesting Party;

    • 8. a witness statement made by a travelling companion;

    • 9. statements made by the person himself;

    • 10. other documents (for example entrance tickets not bearing the person’s name) or reliable information on the basis of which the person’s residence in or journey through the territory of the requested Party can be credibly established.

    When this prima facie evidence is furnished, the Parties assume that the conditions have been met, unless the requested Party can disprove it.

Article 7. Time limits

  • 1 A request to readmit a Party’s own national or citizen can be submitted at any time by the competent authority of the requesting Party, if it has been established that the person concerned does not fulfil or no longer fulfils the conditions for entry into or residence in the territory of the requesting Party.

  • 2 A request for the readmission of a third State national must be submitted by the competent authority of the requesting Party no later than one year after the requesting Party has ascertained that this person does not fulfil or no longer fulfils the conditions for entry into or residence in the territory of the requesting Party. If there are legal or practical impediments preventing the request from being submitted within the time allotted, the period shall be extended on request, but only, at the latest, until such time as these impediments have been removed.

  • 3 A request for readmission must be answered immediately, and in any event within 28 calendar days at the latest, and the reason(s) for refusing a readmission request must be specified. This period shall begin on the date of receipt of the request for readmission. If there is no answer within this period, it shall be assumed that the transfer has been approved.

  • 4 The results of a research in the civil register, in accordance with article 5, paragraph (3), must be transmitted immediately to the requesting Party, and in any event within 7 calendar days after the date of its request.

  • 5 After the transfer has been approved, or, where appropriate, after the 28 calendar days period has elapsed, the requesting Party shall transfer the person whose readmission has been agreed immediately, and in any case within three months at the latest. This period may be extended, on request, by the time required to remove legal or practical impediments.

  • 6 At the request of the requesting Party, the requested Party shall provide immediately, and in any case within three working days at the latest, the travel documents necessary for the person’s return, bearing his name and valid for three months. If the requested Party cannot provide the requested travel document within three working days after the date of receipt of the request, the requested Party will be deemed to have consented to the use of a travel document provided by the requesting Party. If the person concerned cannot be transferred before the expiry of the initial travel document, for legal or practical reasons, the requested Party shall within three working days provide a new travel document with the same period of validity.

Article 8. Transfer modalities and form of transport

  • 1 Before a person is transferred, the competent authorities of the requesting Party shall inform the competent authorities of the requested Party in writing of the date and modalities of the transfer and of the use of any escorts.

  • 2 No form of transport – whether by land, sea or air – is prohibited, but transfers generally take place by air. Either scheduled or charter flights may be used.

Article 9. Transit

  • 1 The Parties shall authorize the transit of third State nationals through their territory if another Party so requests, if they are given assurances that these persons will travel onward through any other transit States and will be readmitted by the State of destination.

  • 2 The Parties shall do whatever is necessary to limit the transit of third State nationals to cases in which these persons cannot be transferred directly to the State of destination.

  • 3 Transit can be refused by the Parties:

    • 1. if the third State national runs a genuine risk in the State of destination or some other transit State of being subjected to torture, inhuman or degrading treatment or punishment, the death penalty, or persecution because of his race, religion, nationality, political convictions or membership of a particular social group;

    • 2. if the third State national will be prosecuted under the criminal law or subject to the enforcement of a criminal judgement in the territory of the requested Party.

  • 4 The Parties may withdraw any approval previously granted if later circumstances as referred to in paragraph (3) arise which impede transit, or if the person’s onward travel into any transit States or his readmission by the State of destination is no longer assured. In such cases, the requesting Party shall immediately readmit the person concerned to its territory.

Article 10. Transit procedure

  • 1 A transit request must be submitted in writing to the competent authorities and must include the following information:

    • 1. type of transit (by air, land or sea), the other possible transit States and the State of the intended final destination;

    • 2. personal details of the person concerned (surname, given names, date of birth and, as appropriate, place of birth, nationality or citizenship, type and number of the travel document);

    • 3. proposed border crossing, time of transfer and possible use of escorts;

    • 4. a declaration that, according to the requesting Party, the conditions defined in article 9, paragraphs (1) and (2) have been met, and that no reasons are known for a refusal on the basis of article 9, paragraph (3).

  • 2 The competent authority of the requested Party shall immediately, inform the competent authority of the requesting Party in writing of the authorisation for admission, with confirmation of the place where the border will be crossed and the planned time of admission, or of the refusal of admission and the reasons.

  • 3 If the transit takes place by air, the necessary facilities shall be provided to the person who is in transit and any escorts with a view to accessing the national or international zone of the airport of the requested Party.

  • 4 The competent authorities of the requested Party shall lend their support to the transit, subject to mutual agreement, in particular by supervising the persons concerned and making suitable facilities available for this purpose.

Article 11. Costs

Without prejudice to the right of the competent authorities to claim the costs arising from the readmission from the person to be readmitted or from third parties, all costs related to readmission and transit on the basis of this Agreement up to the border of the State of final destination shall be paid by the requesting Party.

Article 12. Data protection

Personal data shall be furnished only when it is necessary for the implementation of this Agreement by the competent authorities of the Parties. The processing and handling of personal data in a given case are subject to the laws of the Republic of Kosovo and, if the handling is done by a competent authority of a State of the Benelux, to the provisions of Directive 95/46/EC of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the national legislation established on the basis of this Directive. In addition, the following principles apply:

  • 1. personal data must be processed fairly and lawfully;

  • 2. personal data must be obtained for the specific, explicitly defined and justified objective of implementing this Agreement and may not be processed further by the communicating or receiving authority in any way that is incompatible with that objective;

  • 3. personal data must be appropriate, relevant and not excessive, given the objectives for which they are collected and/or are subsequently processed; in particular, the personal data provided may not concern anything other than the following:

    • the personal details of the person to be transferred (surname, given name, any previous names, nicknames or pseudonyms, date and place of birth, sex, current and previous nationality or citizenship);

    • identity card or passport (serial number, period of validity, issue date, issuing authority, place of issue);

    • stopping places and travel routes;

    • other data useful for the identification of the person to be transferred or for examining the readmission requirements on the basis of this Agreement;

  • 4. personal data must be accurate and must be updated as necessary;

  • 5. personal data must not be kept in a form which makes it possible to identify the persons concerned any longer than is necessary in order to achieve the objectives for which the data were collected or are subsequently processed;

  • 6. the communicating and the receiving authorities shall take all appropriate measures to ensure, where necessary, the correction, deletion or masking of personal data when the processing is not in accordance with the provisions of this article, in particular because the data are inappropriate, irrelevant, inaccurate or excessive in relation to the objective of the processing. This includes notifying the other Party of each correction, deletion or masking;

  • 7. on request, the receiving authority shall inform the communicating authority of the use that is being made of the data provided and of the results obtained;

  • 8. personal data may be provided solely to the competent authorities. Passing them on to other authorities requires prior approval from the communicating authority;

  • 9. the communicating and receiving authorities are obliged to keep written records of any provision or receipt of personal data.

Article 13. Non affection clause

This Agreement in no way impairs the obligations deriving from:

Article 14. Committee of experts

  • 1 The Parties shall assist one another in applying and interpreting this Agreement. For this purpose they shall appoint a Committee of Experts which shall in particular:

    • 1. monitor the application of this Agreement;

    • 2. make proposals to resolve issues relating to the application of this Agreement;

    • 3. propose amendments and supplements to this Agreement;

    • 4. elaborate and recommend appropriate measures to control illegal immigration.

  • 2 The Parties reserve the right to approve or to reject the measures proposed by the Committee of Experts.

  • 3 The Committee shall consist of one representative for Belgium, one representative for Luxembourg, one representative for the Netherlands and three (3) representatives for the Republic of Kosovo. The Parties shall designate therein the chairman and his deputies. Deputy members shall be appointed. If necessary, other experts may be involved in the Committee’s activities.

  • 4 The Committee shall meet as necessary at the request of one of the Parties.

Article 15. Implementing protocol

All necessary practical provisions for the implementation of this Agreement shall be laid down in the Implementing Protocol. The Implementing Protocol regulates inter alia:

  • 1. the designation of the competent authorities of the Parties;

  • 2. the designation of border crossings;

  • 3. the conditions under which and the manner in which persons to be readmitted or to travel in transit are escorted.

Article 16. Territorial application

With regard to the Kingdom of the Netherlands, application of this Agreement can be extended to the parts of the Kingdom which are situated outside Europe through a notification to the Government of the Kingdom of Belgium, depositary of this Agreement, which shall inform the other Parties thereof.

Article 17. Entry into force

  • 1 This Agreement shall enter into force on the first day of the second month following the date of receipt by the Government of the Kingdom of Belgium of the notifications of two Signatory States, one of which is the Republic of Kosovo, to the effect that the internal formalities required for entry into force have been observed.

  • 2 With regard to any other Signatory State, this Agreement shall enter into force on the first day of the second month following the date of receipt by the Government of the Kingdom of Belgium of the notification to the effect that the internal formalities required for entry into force have been observed.

  • 3 The Government of the Kingdom of Belgium shall inform each of the Signatory States of the notifications mentioned in paragraph (1) and (2) and of the dates of the entry into force of this Agreement vis-à-vis the Parties.

Article 18. Suspension, termination

  • 1 This Agreement is concluded for an indefinite period.

  • 2 The Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands jointly and the Republic of Kosovo can suspend this Agreement, after notification to the Government of the Kingdom of Belgium, which shall inform the other Parties thereof, for serious reasons, in particular relating to the protection of state security, the public order, or public health. With regard to the withdrawal of such a measure, the Parties will immediately inform one another through diplomatic channels.

  • 3 The suspension of this Agreement shall take effect on the first day of the first month following the month in which the notification mentioned in paragraph (2) is received by the Government of the Kingdom of Belgium.

  • 4 The Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands jointly and the Republic of Kosovo can, for serious reasons, terminate this Agreement, after communication to the Government of the Kingdom of Belgium, which shall inform the other Parties thereof.

  • 5 The termination of this Agreement shall take effect on the first day of the second month following the month in which the notification mentioned in paragraph (4) is received by the Government of the Kingdom of Belgium.

Article 19. Depositary

The Government of the Kingdom of Belgium shall be the depositary of this Agreement.

IN WITNESS whereof the representatives of the Parties, duly authorised for this purpose, have signed this Agreement.

DONE at Brussels, on 12 May 2011, in the English, Dutch, French, Albanian and Serbian languages, the texts in each of the languages being equally authentic. In the event of differences in interpretation, the English text (working language) shall prevail.

The original will be filed with the Government of the Kingdom of Belgium, depositary of this Agreement, which shall send a certified and authenticated copy thereof to all Parties.

The Kingdom of Belgium,

the Grand Duchy of Luxembourg

the Kingdom of the Netherlands,

and

the Republic of Kosovo,

hereafter referred to as “the Parties”,

On the basis of article 15 of the Agreement signed on 12 May at Brussels between the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands (the States of the BENELUX) and the Republic of Kosovo concerning the readmission of persons who have entered and/or are residing without authorisation,

hereafter referred to as “the Agreement”,

Have agreed as follows:

Article 1. Definitions

For the application of this Implementing Protocol, the following terms shall be understood to have the following meanings:

  • 1. diplomatic mission: the diplomatic mission of the requested Party on the territory of the requesting Party;

  • 2. escort(s): the person (or persons) assigned by the requesting Party to accompany the person to be readmitted, or who is in transit.

Article 2. Request for readmission

  • 1 A request for readmission shall be submitted by fax or electronically, containing the information as set forth in article 4 of the Agreement to the competent authority of the requested Party.

  • 2 A request for readmission of an own national or citizen shall be made using the form attached as annex 1 A to this Implementing Protocol. A request for readmission of a third State national shall be made using the form attached as annex 1 B to this Implementing Protocol.

  • 4 To provide or obtain more detailed information on a particular request for readmission, the requesting Party shall apply to the competent authority of the requested Party.

  • 5 The response to a request for readmission shall be sent by fax or electronically to the competent authority of the requesting Party, respectively using the form attaches as annex 1A or 1B to this Implementing Protocol.

Article 3. Travel documents

  • 1 In the event of a positive response to the request for readmission, the travel documents necessary for the return journey in accordance with article 7, paragraph (6) of the Agreement shall be issued in the name of the person to be transferred and delivered by the diplomatic mission to the competent authorities of the requesting Party.

  • 2 On the basis of article 7, paragraph (6) of the Agreement, if the diplomatic mission is unable to provide the requested travel document within three (3) working days after the date of receipt of the request for it, the requested Party shall be deemed to have consented to the use of a travel document provided by the requesting Party. The documents that the Parties will use for this purpose are attached as annexes 4 and 5 to this Implementing Protocol.

Article 4. Transfer

  • 1 The competent authority of the requesting Party shall inform the competent authority of the requested Party of the intended transfer, by fax or electronically, at least two working days ahead of time. For this purpose it shall use the form attached as annex 2 to this Implementing Protocol.

  • 2 If the transfer of the person to be readmitted can not be realised within the three month period referred to in article 7, paragraph (5) of the Agreement, it shall immediately inform the competent authority of the requested Party thereof.

  • 3 If medical reasons justify transport by road or sea, the competent authorities of the requesting Party shall make separate mention of this fact on the form attached as annex 2 to this Implementing Protocol.

Article 5. Procedure regarding transit of third country nationals and stateless persons

  • 1 A transit request shall be submitted at least two days before the planned transit by fax or electronically to the competent authority of the requested Party. This request shall be made using the form attached as annex 6 to this Implementing Protocol.

  • 2 The competent authority of the requested Party shall respond immediately, by fax or electronically, stating whether it consents to the transit and the time for which it has been scheduled, the designated border crossing, the transport method and the use of escorts. This reply shall be made using the form mentioned in paragraph 1 of this article.

  • 3 In principle, transit shall take place by air.

Article 6. Support for transit

  • 1 If the requesting Party deems it necessary to have the support of the authorities of the requested Party for a particular transit, that request will be indicated in the form attached as Annex 6 to this Implementing Protocol.

  • 2 In its response to the transit request, the requested Party will also state whether it can provide the requested support. For this purpose Parties shall enter into more detailed consultation with one another if necessary.

  • 3 Escorts guarding and assisting the embarkation of the person concerned will operate under the authority of the Requested Party.

Article 7. Obligations for escorts

  • 1 The authority of escorts accompanying a person in transit is limited to self-defence. In addition, in the absence of any officials of the requested Party who are authorised to take the necessary action or in order to support such officials, the escorts may respond to an immediate and serious threat in a reasonable and proportionate manner in order to prevent the person concerned from fleeing, injuring himself or third parties or causing damage to property.

  • 2 Escorts must adhere to the law of the requested Party in all circumstances.

  • 3 Escorts shall perform their task unarmed and in civilian dress. They must be in the possession of papers showing that the readmission or transit has been approved, and must at all times be able to prove their identity and official instructions.

  • 4 The authorities of the requested Party shall grant the same protection and assistance to the escorts, while the latter are performing their duties within the framework of the Agreement, as they grant to their own officials who are authorised to take such action.

Article 8. Designation of competent authorities

The Parties shall exchange in writing, pursuant to article 15, paragraph (1) of the Agreement, lists of the authorities competent to implement the Agreement ultimately 30 days after the conclusion of this Implementing Protocol. They shall inform one another immediately of any change in this list.

Article 9. Designation of border crossings

The Parties shall inform one another in writing, pursuant to article 15, paragraph (2) of the Agreement, of the border crossings at which persons will be actually transferred and admitted, ultimately 30 days after the conclusion of this Implementing Protocol. They shall inform one another immediately of any changes in this list.

Article 10. Costs

Costs incurred by the requested Party in connection with readmission and transit that are to be borne by the requesting Party pursuant to article 11 of the Agreement shall be compensated by the requesting Party upon submission of an invoice.

Article 11. Committee of Experts

The Parties shall inform one another within thirty days after the entry into force of the Agreement of the composition of their delegation in the Committee of Experts established pursuant to article 14 of the Agreement. They shall inform one another immediately of any change in their delegation.

Article 12. Language

Parties shall communicate with one another in the English language.

Article 13. Amendments to annexes

  • 1 Annexes 1 to 6 shall constitute an integral part of the Implementing Protocol.

  • 2 Any modification of the annexes to this Implementing Protocol shall be agreed in writing between the Parties and shall enter into force on a date to be determined by the Parties.

Article 14. Entry into force and termination

This Implementing Protocol shall be applied in accordance with articles 17 and 18 of the Agreement and shall be terminated simultaneously with the termination of the Agreement.

Article 15. Depositary

The Kingdom of Belgium is depositary of the Protocol. The depositary shall issue each Party with a true copy of the original.
