Facultatief Protocol bij het Verdrag van Wenen inzake diplomatiek verkeer betreffende de verplichte regeling van geschillen

Optional Protocol concerning the Compulsory Settlement of Disputes

The States Parties to the present Protocol and to the Vienna Convention on Diplomatic Relations, hereinafter referred to as “the Convention”, adopted by the United Nations Conference held at Vienna from 2 March to 14 April 1961,

Expressing their wish to resort in all matters concerning them in respect of any dispute arising out of the interpretation or application of the Convention to the compulsory jurisdiction of the International Court of Justice, unless some other form of settlement has been agreed upon by the parties within a reasonable period,

Have agreed as follows:

Article I

Disputes arising out of the interpretation or application of the Convention shall lie within the compulsory jurisdiction of the International Court of Justice and may accordingly be brought before the Court by an application made by any party to the dispute being a Party to the present Protocol.

Article II

The parties may agree, within a period of two months after one party has notified its opinion to the other that a dispute exists, to resort not to the International Court of Justice but to an arbitral tribunal. After the expiry of the said period, either party may bring the dispute before the Court by an application.

Article III

  • 1 Within the same period of two months, the parties may agree to adopt a conciliation procedure before resorting to the International Court of Justice.

  • 2 The conciliation commission shall make its recommendations within five months after its appointment. If its recommendations are not accepted by the parties to the dispute within two months after they have been delivered, either party may bring the dispute before the Court by an application.

Article IV

States Parties to the Convention, to the Optional Protocol concerning Acquisition of Nationality, and to the present Protocol may at any time declare that they will extend the provisions of the present Protocol to disputes arising out of the interpretation or application of the Optional Protocol concerning Acquisition of Nationality. Such declarations shall be notified to the Secretary-General of the United Nations.

Article V

The present Protocol shall be open for signature by all States which may become Parties to the Convention, as follows: until 31 October 1961 at the Federal Ministry for Foreign Affairs of Austria and subsequently, until 31 March 1962, at the United Nations Headquarters in New York.

Article VI

The present Protocol is subject to ratification. The instruments of ratification shall be deposited with the Secretary-General of the United Nations.

Article VII

The present Protocol shall remain open for accession by all States which may become Parties to the Convention. The instruments of accession shall be deposited with the Secretary-General of the United Nations.

Article VIII

  • 1 The present Protocol shall enter into force on the same day as the Convention or on the thirtieth day following the date of deposit of the second instrument of ratification or accession to the Protocol with the Secretary-General of the United Nations, whichever day is the later.

  • 2 For each State ratifying or acceding to the present Protocol after its entry into force in accordance with paragraph 1 of this Article, the Protocol shall enter into force on the thirtieth day after deposit by such State of its instrument of ratification or accession.

Article IX

The Secretary-General of the United Nations shall inform all States which may become Parties to the Convention:

  • (a) of signatures to the present Protocol and of the deposit of instruments of ratification or accession, in accordance with Articles V, VI and VII;

  • (b) of declarations made in accordance with Article IV of the present Protocol;

  • (c) of the date on which the present Protocol will enter into force, in accordance with Article VIII.

Article X

The original of the present Protocol, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations, who shall send certified copies thereof to all States referred to in Article V.

IN WITNESS WHEREOF the undersigned Plenipotentiaries, being duly authorized thereto by their respective Governments, have signed the present Protocol.

Facultatief Protocol betreffende de verplichte regeling van geschillen

De Staten die Partij zijn bij dit Protocol en bij het Verdrag van Wenen inzake diplomatiek verkeer, hierna te noemen „het Verdrag”, aanvaard tijdens de Conferentie van de Verenigde Naties, gehouden te Wenen van 2 maart tot 14 april 1961,

De wens te kennen gevend, in alle aangelegenheden die hun aangaan met betrekking tot een uit de uitlegging of toepassing van dit Verdrag gerezen geschil, beroep te doen op de verplichte rechtsmacht van het Internationale Gerechtshof, tenzij partijen binnen een redelijke termijn overeenstemming hebben bereikt over een andere wijze van regeling,

Zijn overeengekomen als volgt:

Artikel I

Geschillen die voortvloeien uit de uitlegging of toepassing van dit Verdrag vallen binnen de verplichte rechtsmacht van het Internationale Gerechtshof en kunnen dienovereenkomstig aan dit Hof worden voorgelegd door een desbetreffend request van een partij bij het geschil die tevens partij is bij dit Protocol.

Artikel II

Partijen kunnen, binnen een termijn van twee maanden nadat de ene partij de andere haar mening heeft te kennen gegeven dat er een geschil bestaat, overeenkomen zich niet tot het Internationale Gerechtshof te wenden, doch tot een scheidsgerecht. Na het verstrijken van bovengenoemde termijn kan elk der beide partijen het geschil door middel van een desbetreffend request aan het Hof voorleggen.

Artikel III

  • 1 Binnen dezelfde termijn van twee maanden kunnen partijen overeenkomen tot een verzoeningsprocedure over te gaan, alvorens zich tot het Internationale Gerechtshof te wenden.

  • 2 De verzoeningscommissie doet haar aanbevelingen binnen vijf maanden nadat zij is ingesteld. Indien de partijen bij het geschil deze aanbevelingen niet binnen twee maanden nadat zij zijn gedaan, aanvaarden, kan elk der beide partijen het geschil door middel van een desbetreffend request aan het Hof voorleggen.

Artikel IV

De staten die partij zijn bij dit Verdrag, bij het Facultatieve Protocol betreffende de verkrijging van nationaliteit, alsmede bij dit Protocol, kunnen te allen tijde verklaren dat zij de bepalingen van dit Protocol zullen uitbreiden tot geschillen die voortvloeien uit de uitlegging of toepassing van het Facultatieve Protocol betreffende de verkrijging van nationaliteit. Deze verklaringen worden aan de Secretaris-Generaal van de Verenigde Naties medegedeeld.

Artikel V

Dit Protocol staat open ter ondertekening door alle staten die partij kunnen worden bij het Verdrag. Tot 31 oktober 1961 staat dit Protocol ter ondertekening open bij het Bondsministerie van Buitenlandse Zaken van Oostenrijk en na die datum, tot 31 maart 1962, bij de Verenigde Naties te New York.

Artikel VI

Dit Protocol dient te worden bekrachtigd. De akten van bekrachtiging worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.

Artikel VII

Dit Protocol blijft open voor toetreding door elke staat die partij kan worden bij het Verdrag. De akten van toetreding worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.

Artikel VIII

  • 1 Dit Protocol treedt in werking op dezelfde dag als het Verdrag of op de dertigste dag die volgt op de datum van nederlegging van de tweede akte van bekrachtiging van, of toetreding tot, het Protocol bij de Secretaris-Generaal van de Verenigde Naties, al naar gelang welke van deze twee data de laatste is.

  • 2 Ten aanzien van elke staat die dit Protocol bekrachtigt of ertoe toetreedt nadat het overeenkomstig lid 1 van dit artikel in werking is getreden, treedt dit Protocol in werking op de dertigste dag na de datum waarop die staat zijn akte van bekrachtiging of toetreding heeft nedergelegd.

Artikel IX

De Secretaris-Generaal van de Verenigde Naties doet alle staten die partij kunnen worden bij het Verdrag mededeling van:

  • (a) de ondertekeningen van dit Protocol en de nederlegging van akten van bekrachtiging of toetreding overeenkomstig de artikelen V, VI en VII;

  • (b) de overeenkomstig artikel IV van dit Protocol afgelegde verklaringen;

  • (c) de datum waarop dit Protocol overeenkomstig artikel VIII in werking zal treden.

Artikel X

Het origineel van dit Protocol, waarvan de Chinese, Engelse, Franse, Russische en Spaanse teksten gelijkelijk authentiek zijn, wordt nedergelegd bij de Secretaris-Generaal van de Verenigde Naties, die voor eensluidend gewaarmerkte afschriften ervan doet toekomen aan alle in artikel V bedoelde staten.

TEN BLIJKE WAARVAN de ondergetekende gevolmachtigden, daartoe behoorlijk gemachtigd door hun onderscheiden Regeringen, dit Protocol hebben ondertekend.

GEDAAN te Wenen, de achttiende april negentienhonderd eenenzestig.
