Culturele Overeenkomst tussen de Regering van het Koninkrijk der Nederlanden en de Regering van de Hongaarse Volksrepubliek

Cultural Agreement between the Government of the Kingdom of the Netherlands and the Government of the Hungarian People's Republic

The Government of the Kingdom of the Netherlands and the Government of the Hungarian People's Republic, being desirous of promoting co-operation between the two countries in the fields of education, science and culture, and convinced that such co-operation will contribute to a better understanding between the two nations, have decided to conclude a cultural agreement and have agreed as follows:

Article I

In order to promote co-operation between the two countries in the fields of science, education and social welfare the Contracting Parties undertake in particular, and on a basis of reciprocity:

  • a. to further the exchange of, and contacts between, university professors, other scholars and students, social welfare officials, as well as co-operation between the universities and other scientific institutions;

  • b. to promote in similar fashion co-operation between specialists and institutions active in the field of secondary education, including technical and artistic education;

  • c. to provide scholarships in order to enable nationals of the other country to study at their scientific, educational and social welfare

    institutions or to visit the respective countries for study purposes, including the participation in summer courses;

  • d. promoting tourism by facilitating free contacts and other means that may contribute to a better understanding of the way of life, work and culture of the other country;

  • e. promoting co-operation between sport-organisations and sport-federations;

  • f. to facilitate the access to libraries, archives, museums and cultural and scientific institutions for scientists and research workers in the respective countries;

  • g. fostering the exchange of books, periodicals and other publications of a scientific, technical, and cultural nature between libraries and other institutions of both countries;

  • h. to determine through mutual consultations the value to be attributed to the certificates and academic titles awarded by the institutions of the other country.

Article II

In order to promote in their respective countries a better knowledge of the culture of the other country, the Contracting Parties shall encourage exchange visits and other contacts between persons active in the fields of culture, such as authors, composers, choreographers, artists, art critics, and specialists in mass media, social welfare, popular education, youth training and sports.

With the same object in view the Contracting Parties shall, on a basis of reciprocity, assist each other as much as possible in:

  • a. establishing and further developing professorships, lectureships and courses on the language, culture, and civilization of the other country at their respective universities and other educational and research institutes;

  • b. having translations made of literary works from the other country;

  • c. organizing art exhibitions and other exhibitions of cultural nature;

  • d. organizing conferences, concerts and theatrical performances;

  • e. organizing radio and television broadcasts and disseminating gramophone records and similar aids;

  • f. disseminating books, periodicals and other publications;

  • g. showing scientific, educational and cultural films.

Article III

The Contracting Parties shall set up a mixed committee whose duty it shall be, in application of Articles I and II, to recommend to the two Governments a programme of activities for a period of two years at a time; the programme shall be accompanied by suggestions as to the financing of its various parts. Each Contracting Party shall submits its decisions concerning the recommendations and suggestions of the mixed committee to the other Party through the ordinary diplomatic channels.

Article IV

The committee shall consist of not more than ten members; each Contracting Party shall appoint an equal number of members.

Article V

The mixed committee shall in principle meet every two years, alternately in the Netherlands and in Hungary.

The respective diplomatic representatives of each of the Contracting Parties shall be invited to attend the meetings of the committee. The members may be assisted at the meetings by a limited number of specialists.

The meetings shall be presided over by a member of the committee belonging to the country in which the meeting is held.

Article VI

As regards the Kingdom of the Netherlands the present Agreement shall apply to the Kingdom in Europe.

Article VII

The Agreement shall be ratified and the instruments of ratification shall be exchanged as soon as possible at the Hague.

The Agreement shall enter into force on the date on which the instruments of ratification are exchanged.

Article VIII

The present Agreement shall remain in force for a period of five years. If it has not been denounced six months before the date of its termination, it shall be tacitly renewed. However, either Contracting Party shall then have the right to denounce the Agreement at any time by giving six months' notice to the other Contracting Party.

IN WITNESS WHEREOF the respective plenipotentiaries have signed the present Agreement and affixed their seals thereto.

Culturele Overeenkomst tussen de Regering van het Koninkrijk der Nederlanden en de Regering van de Hongaarse Volksrepubliek

De Regering van het Koninkrijk der Nederlanden en de Regering van de Hongaarse Volksrepubliek, de wens koesterend de samenwerking tussen beide landen op het gebied van onderwijs, wetenschap en cultuur te bevorderen, en ervan overtuigd dat deze samenwerking zal bijdragen tot een beter begrip tussen de beide volkeren, hebben besloten een culturele overeenkomst te sluiten, en zijn als volgt overeengekomen:

Artikel I

Ten einde de samenwerking tussen de beide landen op het gebied van de wetenschap, het onderwijs en het maatschappelijk werk te bevorderen, verbinden de Overeenkomstsluitende Partijen zich met name ertoe op basis van wederkerigheid:

  • a. de uitwisseling van en contacten tussen hoogleraren, andere geleerden en studenten, functionarissen op het gebied van het maatschappelijk werk, alsmede de samenwerking tussen de universiteiten en andere instellingen van wetenschap te bevorderen;

  • b. op overeenkomstige wijze de samenwerking te bevorderen tussen deskundigen en instellingen op het gebied van het voortgezet onderwijs, waaronder begrepen het technisch onderwijs en het kunstonderwijs;

  • c. studiebeurzen te verstrekken, ten einde onderdanen van het andere land in de gelegenheid te stellen aan hun instellingen van wetenschap, onderwijs en maatschappelijk werk te studeren of hun onderscheiden landen voor studiedoeleinden te bezoeken, waaronder begrepen deelneming aan zomercursussen;

  • d. het vreemdelingenverkeer te bevorderen, zowel door het vergemakkelijken van vrij contact, als met andere middelen die zouden kunnen bijdragen tot een beter begrip van het leven, het werk en de cultuur van het andere land;

  • e. samenwerking tussen sportorganisaties en sportfederaties te bevorderen;

  • f. in de onderscheiden landen voor beoefenaars der wetenschap en wetenschappelijke onderzoekers de toegang tot bibliotheken, archieven, musea en culturele en wetenschappelijke instellingen te vergemakkelijken;

  • g. de uitwisseling te bevorderen van boeken, tijdschriften en andere geschriften van wetenschappelijke, technische en culturele aard tussen bibliotheken en andere instellingen in de beide landen;

  • h. in onderling overleg de waarde vast te stellen die moet worden toegekend aan diploma's en universitaire titels, verleend door instellingen in het andere land.

Artikel II

Ten einde in hun onderscheiden landen een betere kennis van de cultuur van het andere land te bevorderen, moedigen de Overeenkomstsluitende Partijen de uitwisseling van bezoeken en andere contacten aan tussen persoonlijkheden uit het culturele leven, zoals schrijvers, componisten, choreografen, beeldende kunstenaars, kunstcritici en deskundigen op het gebied van de massamedia, het maatschappelijk werk, het volksontwikkelingswerk, de jeugdvorming en de sportbeoefening.

Met hetzelfde doel steunen de Overeenkomstsluitende Partijen elkaar op basis van wederkerigheid en zoveel als mogelijk is bij:

  • a. het instellen en verder ontwikkelen van leerstoelen, lectoraten en cursussen aan hun universiteiten en andere instellingen van onderwijs en onderzoek, die betrekking hebben op de taal, de cultuur en de beschaving van het andere land;

  • b. het doen vervaardigen van vertalingen van literaire werken uit het andere land;

  • c. het organiseren van tentoonstellingen op het gebied der kunst en andere tentoonstellingen met een cultureel karakter;

  • d. het organiseren van conferenties, concerten en toneelvoorstellingen;

  • e. het organiseren van radio- en televisie-uitzendingen, alsmede de verspreiding van grammofoonplaten en soortgelijke middelen;

  • f. het verspreiden van boeken, tijdschriften en andere geschriften;

  • g. het vertonen van wetenschappelijke, opvoedkundige of culturele films.

Artikel III

De Overeenkomstsluitende Partijen stellen een gemengde commissie in, die tot taak heeft ter uitvoering van de artikelen I en II aan de beide Regeringen een programma van activiteiten, telkens voor een periode van twee jaar, aan te bevelen, vergezeld van suggesties betreffende de financiering van de verschillende onderdelen daarvan. Elke Overeenkomstsluitende Partij maakt via de normale diplomatieke kanalen haar beslissing ten aanzien van de aanbevelingen en suggesties van de gemengde commissie aan de andere Partij kenbaar.

Artikel IV

De commissie bestaat uit ten hoogste tien leden; elke Overeenkomstsluitende Partij benoemt een gelijk aantal leden.

Artikel V

De gemengde commissie komt in beginsel eenmaal in de twee jaar bijeen, beurtelings in Nederland en in Hongarije.

De onderscheiden diplomatieke vertegenwoordigers van elk der Overeenkomstsluitende Partijen worden uitgenodigd de bijeenkomsten van de commissie bij te wonen. De leden kunnen zich ter vergadering doen bijstaan door een beperkt aantal deskundigen.

De bijeenkomsten worden voorgezeten door een commissielid van het land waar zij worden gehouden.

Artikel VII

De Overeenkomst dient te worden bekrachtigd en de akten van bekrachtiging zullen zo spoedig mogelijk te 's-Gravenhage worden uitgewisseld.

De Overeenkomst treedt in werking op de datum van de uitwisseling van de akten van bekrachtiging.

Artikel VIII

Deze Overeenkomst blijft van kracht voor een tijdvak van vijf jaar. Indien zij niet zes maanden voor de datum van beëindiging is opgezegd, wordt zij stilzwijgend verlengd, met dien verstande dat elk van de Overeenkomstsluitende Partijen zich in dat geval het recht voorbehoudt haar op ieder tijdstip op te zeggen met inachtneming van een opzeggingstermijn van zes maanden.

TEN BLIJKE WAARVAN de onderscheiden gevolmachtigden deze Overeenkomst hebben ondertekend en van hun zegel voorzien.
