THE HAGUE

Your Excellency,

I have the honour to refer to consultations between representatives of our Governments relating to the establishment of security arrangements to permit and regulate the exchange of information between the Government of Australia and the Government of the Kingdom of the Netherlands.

The establishment of these arrangements has become desirable in view of the cooperation between the Netherlands and Australia as regards the production and procurement of military equipment. I am now instructed to communicate to Your Excellency that the Australian Government is prepared to conclude an arrangement to be called “The Netherlands-Australia Defence Security Arrangement”, with respect to this matter in the following terms.

Mutual Security Protection

  • 1. The material to which this Arrangement relates is classified material of either or both countries relating to or in the nature of government-approved arrangements connected with Defence, including contracts, sub-contracts and pre-contract negotiations placed or entered into by or on behalf of the Netherlands Government or by or on behalf of the Australian Government.

  • 2. Each Government will take all appropriate measures in accordance with this Arrangement and the Schedules thereto to protect material to which this Arrangement relates that is within its territorial jurisdiction or while possessed by or furnished to persons authorised by it to take that material abroad.

  • 3. Matter subject to this Arrangement will be given security protection at least equal to that given each Government own classified matter of a corresponding level of security classification.

  • 4. Each Government will observe any further requirements for security protection which may be considered necessary by the two Governments for the purpose of regulating the exchange of classified military information between them.

  • 5. Each Government will withhold matter subject to this Arrangement from the Government, firms, or citizens of a third State unless written approval to do otherwise is first obtained from the Government furnishing the matter.

  • 6. Matter subject to this Arrangement will not be used for purposes other than defence purposes.

  • 7. Each Government will arrange for necessary security inspections to be made of any facility within its territorial jurisdiction to which or through which matter subject to this Arrangement may be passed, or which may in any way be connected with the use or transmission of that matter.

  • 8. Each Government, upon request, will provide reasonable facility for periodic visits by representatives of the requesting Government to review together the security provisions presently in force with a view to achieving mutual understanding of the adequacy and reasonable compatibility of the respective security systems.

  • 9. Where a contract or arrangement involving classified matter is negotiated by or through the Government of the country furnishing the matter and is to be performed within the other country, the Government furnishing the matter will in each case incorporate in the contract document a security requirements clause as required by Schedule B to this letter, in the case of the Netherlands Government, or Schedule C to this letter in the case of the Australian Government, or in either case an appropriate equivalent clause.

  • 10. Transmission of matter subject to this Arrangement will be made only through Government-to-Government channels and by representatives designated by each of the Governments.

  • 11. Matter subject to this Arrangement will be made available only to a person who requires it in the performance of his duties and who has been appropriately security cleared and authorised to have the information.

  • 12. Visits which involve access to or the exchange or passage of classified matter must have the prior approval of both Governments. Approval for such visits will be granted only to persons possessing valid clearances.

Terminology

  • 13. In this Arrangement, the term “classified matter” includes all matter, in whatever form transmitted from one Government to the other, that is marked with a security classification or is indicated to be so classified by or under the direction of the transmitting Government.

Protection of Private Rights

  • 14. Each Government will respect all industrial ownership rights, including copyrights and rights originating from inventions, which are involved in information exchanged under this Arrangement.

Security Costs

  • 15. No compensation will be paid between Governments for costs arising in connection with the carrying out of security measures.

Violation of Provisions for Security Protection

  • 16. Violation of any security regulations or provisions for security protection of matter subject to this Arrangement will be investigated and proceeded against according to law by the appropriate authorities and in the relevant law courts.

  • 17. If there is any loss, compromise or possible compromise of classified matter or any violation of security regulations in respect of matter subject to this Arrangement, such incident will be reported promptly to the Government which furnished the matter.

Schedules

  • 18. Further details on the proceedings to be followed for the implementation of this Arrangement are set out in Schedules A, B, C and D attached to this letter.

Review or Termination of the Arrangement

  • 19. This Arrangement will be reviewed on the request of either Government.

  • 20. This Arrangement will cease to operate six months after receipt of written notice of termination by one Government from the other.

  • 21. Unless otherwise agreed by both Governments, where the Arrangement ceases to operate all matter subject to the Arrangement will be treated according to the terms of the Arrangement.

  • 22. This Arrangement will only apply to the part of the Kingdom of the Netherlands situated in Europe.

If the foregoing is acceptable to the Government of the Kingdom of the Netherlands, I propose that this letter and Your Excellency's confirmatory reply constitute the Arrangement which will come into effect on the date on which the Government of the Kingdom of the Netherlands informs the Government of Australia in writing that the procedures constitutionally required in the Kingdom of the Netherlands have been complied with.

I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.

Schedule A

  • 1. Where required by this Arrangement, the Government of the Netherlands will protect matter subject to the Arrangement according to the Netherlands security regulations and in particular according to “artikel 2, hoofdstuk 1” of “Beveiligingsvoorschrift - II, 1965” and the “Algemeen Beveiligingsvoorschrift voor Defensie-opdrachten 1965” (Security Directive), where appropriate.

  • 2. Where required by this Arrangement, the Australian Government will protect matter subject to the Arrangement according to Australian security regulations and in particular according to the Protective Security Handbook, 1966 and the Handbook of Security Procedures for Contractors where appropriate.

  • 3. Where there is to be any change in the security regulations or procedures of either country relevant to matter subject to the Arrangement the Government of that country will immediately notify the other Government of the decision to change the regulations or procedures.

  • 4. Where there is a change in the security regulations or procedures of either country, the Government of the other country may demand that the regulations and procedures formerly applied continue to be applied in respect of matter subject to the Arrangement.

  • 5. From the date of this Arrangement, the provisions of the Arrangement shall extend to classified matter passed from one country to the other before the date of this Arrangement unless it is otherwise agreed by both Governments in respect of any particular matter.

  • 6. Where matter subject to this Arrangement is oral information, the fact of transmission of that information will be recorded in a “Note for File” (memo) which will be subject to the same security measures as any other written document subject to the Arrangement.

  • 7. Where sub-contracts involving matter subject to the Arrangement are let to the country originally furnishing the matter to the contractor, that country will assume responsibility for security measures affecting the facilities used and persons employed on such projects.

Security Clearances

  • 8. Issue of clearances of facilities and individuals will be conducted according to the regulations of the country having responsibility for administering measures for matter subject to the Arrangement.

Security Requirements for Contractors

  • 9. Each Government will ensure that contractors or sub-contractors having access to matter subject to the Arrangement are furnished instructions setting forth their responsibilities to protect the matter in accordance with the applicable laws and regulations.

    • (a) The Netherlands Government will furnish such contractors and sub-contractors in the Netherlands with a copy of the Security Directive (“Algemeen Beveiligingsvoorschrift voor Defensie-opdrachten 1965”) between the contractor and the Minister for Defence, and any modification to it necessary for proper security protection in each particular case.

    • (b) The Australian Government will furnish such contractors and sub-contractors in Australia with a copy of the Handbook of Security Procedures for Contractors, the Security Agreement (Release of Australian Government Classified Matter to Industry - Security Document No. 4) between the contractor and the Department of Defence, the provisions of Security Document No. 1 (Secrecy and Security for Contracts Classified “Restricted”) or Security Document No. 2 (Secrecy and Security for Contracts Classified “Confidential”, “Secret” or “Top Secret”) as applicable, and any modification to the Security Agreement or Security Document No. 1 or No. 2 necessary for proper security protection in each particular case.

  • 10. A copy of any security requirements clause required by this Arrangement to be included by either Government in a contract document, and any other security provisions related to that contract shall be furnished to the other Government.

Transmission

  • 11.

    • (a) All persons to whom or from whom matter subject to this Arrangement is to be transmitted shall be informed, by the appropriate Government, of the channels of transmission to be used by them.

    • (b) Matter subject to this Arrangement shall be prepared for any transmission in accordance with the regulations of the country from which the material is to be despatched.

  • 12. Each Government shall ensure that classified matter it furnishes to the other Government is marked with its appropriate classification marking and the name of the country of origin.

  • 13. Australian classified matter, including matter produced or reproduced in the Netherlands, shall also be marked with the markings indicated in Schedule D. When no longer required, Netherlands classified matter shall be returned through the Australian Embassy, The Hague, to the designated Netherlands Intelligence Authority.

Australian Classified Matter

  • 14.

    • (a) Where the Australian Government furnishes classified matter it will assign a security classification to each of the elements of that matter, mark them appropriately and advise the Director of the designated Netherlands Intelligence Authority of that classification. Upon receipt, the Netherlands Government will assign an equivalent Netherlands classification to each of the elements of classified matter furnished or to be furnished, mark them, and forward them to the appropriate contractor or agent.

    • (b) Where Australian classified matter is produced or reproduced in the Netherlands, the Netherlands Government will ensure that it is marked, under Government supervision, with the assigned classification marks of both countries as provided in clause 16 below. The markings will be applied in the manner prescribed in the Netherlands regulations.

    • (c) If Australian classified matter is disclosed orally pursuant to a visit to the contractor or agent by or on behalf of the Australian Government, that Government shall ensure that the contractor or agent is informed of the security classification of the matter.

Netherlands Classified Matter

  • 15.

    • (a) Where the Netherlands Government furnishes classified matter it will assign a security classification to each of the elements of that matter, mark them appropriately and advise the Chief Security Adviser, Central Office of Industrial Security, Department of Defence of that classification. Upon receipt, the Australian Government will assign an equivalent Australian classification to each of the elements of classified matter furnished or to be furnished, mark them, and forward them to the appropriate contractor or agent.

    • (b) Where Netherlands classified matter is produced or reproduced in Australia, the Australian Government will ensure that it is marked, under Government supervision, with the assigned classification markings of both countries as provided in clause 16 below. The markings will be applied in the manner prescribed in the Netherlands regulations.

    • (c) If Netherlands classified matter is disclosed orally pursuant to a visit to the contractor or agent by or on behalf of the Netherlands Government, that Government shall ensure that the contractor or agent is informed of the security classification of the matter.

  • 17. The Government furnishing classified matter shall furnish each contractor or agent specific classification guidance pertaining to each element related to the contract. The guidance will be forwarded by that Government to the other Government for adoption and transmission to the contractor or agent. Any change to the classification guidance or to the classification of any classified element related to the contract shall similarly be forwarded to the other Government and then transmitted to the contractor or agent.

Sub-Contracts

  • 18. Where there is a contract or sub-contract involving matter subject to this Arrangement, the contractor or sub-contractor, unless specifically prohibited in the contract or sub-contract, may subcontract within his own country in accordance with the security procedure prescribed by his country for sub-contracts involving classified matter, and within the country of the Government originally furnishing the classified matter if the procedure established by this Arrangement for placing a prime contract in that country is followed. A contractor or sub-contractor shall not sub-contract with another firm which is located outside his own country without first seeking and obtaining through established Government channels the written approval of the Government originally furnishing the classified matter.

Visits

  • 19. Visitors on visits involving the exchange or passage of classified matter and approved by both Governments may be authorised to have access to classified matter provided the authorisation is limited to that necessary for official purposes in connection with the contract involving the classified matter.

  • 20. Authorisation of visitors to have access to classified matter at the facility of a prime contractor may, on request, include authorisation to have access to or to disclose classified matter at the facility of a sub-contractor engaged in performance of work in connection with the same prime contract.

    • (a) Requests for approval of a visit shall include the following information:

      • (i) Name in full (Surname first or separate);

      • (ii) Date and place of birth and current citizenship;

      • (iii) Purpose of visit in detail, and identification of contract, if any;

      • (iv) Official title of visitor;

      • (v) Person (s) to be visited and the name and place of the establishment/firm;

      • (vi) Date (s) of visit;

      • (vii) Current security clearance status (personal);

      • (viii) If the visitor is an industrialist, the current Cleared Facility Status of the Firm he represents;

      • (ix) Authority to disclose Netherlands/Australian classified matter up to and including......................... level in accordance with the terms of reference of the visit;

      • (x) Authority of Sponsorship (Appropriate Ministry/Department).

      Requests for approval of visits shall be submitted at least four weeks in advance and in the manner described in clauses 21 and 22 below.

    • (b) If required a list may be developed to indicate those individuals who have been authorised by both Governments to visit the specified government activities or contractor facilities during specified periods of time, not to exceed twelve months, in connection with a specific contract. This authorisation may be renewed for additional periods of twelve months as may be necessary in the performance of the contract. Requests for individuals included in the approved list to visit in connection with the contract shall be submitted in advance of such visit through Government-to-Government channels to the government activity or contractor facility which is to be visited.

Procedure Involving Australian Classified Matter in the Netherlands

  • 21.

    • (a) General

      For the Minister for Defence the responsibility for the implementation of the security regulations in the Netherlands industry lies with:

      • The Director of Naval Intelligence

        (Hoofd van de Marine Inlichtingendienst)

      • The Director of Army Intelligence

        (Hoofd van de Landmacht Inlichtingendienst)

      • The Director of Air Force Intelligence

        (Hoofd van de Luchtmacht Inlichtingendienst)

      These authorities have the responsibility for arranging facility clearance and approval of visits of Australian personnel when it is desired to carry on precontractual negotiations leading to the possible award of a contract in the Netherlands involving Australian classified matter.

      Through abovementioned authorities Australian departmental agencies may arrange for placement of sub-contracts in the Netherlands.

      Australian departments or agencies shall make their requests through the Australian Embassy, The Hague. The latter Embassy shall be in possession of a list of Netherlands industries. This list shall indicate which of the abovementioned authorities will be responsible for the implementation of the security regulations in each industry.

    • (b) Initial procedure

      Prior to disclosing classified matter to a prospective Netherlands tenderer, contractor or sub-contractor, department or agency, the Australian Government will communicate through the Australian Embassy, The Hague, with one of the Netherlands agencies specified in sub-clause 21 (a) and

      • (1) Where facility is involved, obtain information as to the present security clearance status of the facility (which includes its secure storage protective capability) in order to carry on classified discussion, and request a higher level clearance status if required;

      • (2) Obtain information as to the security clearance status of the contractor's personnel and personnel of the Netherlands department or agency with whom they desire to talk, and request higher level clearances if required.

    • (c) Visits

      Requests for approval of individual visits or requests to establish an approved list for continuing visits shall be submitted by the Australian Government, through the Australian Embassy, The Hague, to one of the authorities mentioned under 21 (a).

Procedure Involving Netherlands Classified Matter in Australia

  • 22.

    • (a) General

      The initial point of contact for classified discussions, precontractual negotiations, tenders, and the placement of a contract or subcontract in Australia involving Netherlands classified matter shall be the Chief Security Adviser, Central Office of Industrial Security, Department of Defence, CANBERRA, A.C.T., who will administer security measures for these activities.

    • (b) Initial Procedure

      Prior to disclosing classified matter to a prospective Netherlands tenderer, contractor or sub-contractor, department or agency, the Australian Government will communicate through the Australian Embassy, The Hague, with one of the Netherlands agencies specified in sub-clause 21 (a) and

      • (1) Where facility is involved, obtain information as to the present security clearance status of the facility (which includes its secure storage protective capability) in order to carry on classified discussion, and request a higher level clearance status if required;

      • (2) Obtain information as to the security clearance status of the contractor's personnel and personnel of the Netherlands department or agency with whom they desire to talk, and request higher level clearances if required.

    • (c) Visits

      • (1) Requests as appropriate for approval of individual visits or to establish an approved list for continuing visits will be submitted by the Netherlands Government to:

        Chief Security Adviser,

        Central Office of Industrial Security,

        Department of Defence,

        CANBERRA, A.C.T.

        who will seek advice from the Department of Defence (including the Navy, Army and Air Force Offices) as to the acceptability of the visit. Fourteen “clear” days prior notice should be given before any visit is made.

Security Costs

  • 23. Before any security measure is required which will result in an increase in security costs which a contractor is entitled to recover under his contract, such action will be coordinated after negotiation with the Government for whom the contract is to be performed.

Schedule B

  • 1. Security Requirement Clause

    • (a) The provisions of this clause are based upon the Netherlands-Australia Defence Security Arrangement, and shall apply to the extent that this contract involves access to and the handling of information to which a security classification has been assigned by the Government of the Netherlands.

    • (b) The Government of the Netherlands shall assign a security classification to each of the elements of classified information furnished or to be developed under this contract, and shall advise the Chief Security Adviser, Central Office of Industrial Security, Department of Defence of such security classification. If classified information is disclosed orally pursuant to a visit to the contractor by or on behalf of the Government of the Netherlands, the contractor shall be informed of such security classification. The Chief Security Adviser, Central Office of Industrial Security, Department of Defence shall assign an equivalent Australian security classification to each of the elements of classified information furnished or to be developed under the contract, and shall forward the information to the contractor. The Government of the Netherlands shall keep current all security classifications, and inform the Chief Security Adviser, Central Office of Industrial Security, Department of Defence of any changes thereto by means of a security classification guide. Each classified element of this contract shall be safeguarded by the contractor as Australian classified information and shall be subject to the provisions of the Australian laws and regulations.

    • (c) The contractor shall not incorporate, disclose, or release any Netherlands classified information, other than that furnished to him in connection with this contract, in the performance of this contract without the express written authorisation of the Director of the designated Netherlands Intelligence Authority.

    • (d) To the extent that elements of this contract have been or may be assigned a security classification, as provided in paragraph (b) above, the contractor shall safeguard all classified elements of this contract and shall provide and maintain a system of security controls within his own organisation in accordance with the requirements of:

      • (1) The Security Agreement-Security Document No. 4 (attached) and the provisions of Security Document No. 1 or No. 2 as applicable (refer Schedule A) between the contractor and the Department of Defence and any modification to the Security Agreement or Security Document No. 1 or 2 as applicable for the purpose of adopting these regulations to the contractor's business;

      • (2) Any amendments to said regulations made after the date of this contract, notice of which has been furnished to the contractor by the Australian Government (Central Office of Industrial Security, Department of Defence) having security cognizance over the facility.

    • (e) Representatives of the Department of Defence, Central Office of Industrial Security having security cognizance over the facility shall be authorised to inspect at reasonable intervals the procedures, methods, and facilities utilised by the contractor in complying with the security requirements under this contract at locations within Australia. Should the Government of Australia determine that the contractor is not complying with the Security requirements of this contract, the contractor shall be informed in writing by the Central Office of Industrial Security, Department of Defence of the proper action to be taken in order to effect compliance with such requirement.

    • (f) If, subsequent to the date of this contract, the security classifications or security requirements under this contract are changed by the Government of the Netherlands or by the Government of Australia, and the security costs under this contract are thereby increased or decreased, the contract price shall be subject to an equitable adjustment by reason of such increased or decreased costs.

    • (g) The contractor agrees to insert provisions in all sub- contracts awarded to the Australian contractors here-under which involve access to classified information which shall conform substantially to the language of this clause, including this paragraph. For subcontracts awarded to other than Australian contractors, an appropriate security requirements clause will be obtained from the Government of the Netherlands and inserted in the sub-contract.

    • (h) The contractor also agrees that he shall determine that any sub-contractor proposed by him for the furnishing of supplies and services which will involve access to classified information in the contractor's custody, prior to being accorded access to classified information:

      • (1) if located in Australia, has been granted an appropriate Central Office of Industrial Security, Department of Defence security clearance which is still in effect, and has the ability to store classified information properly;

      • (2) if located in any other country, has been approved by the Government of the Netherlands to have access to its classified information.

    • (i) An appropriate clause shall be inserted in the contract if the contracting office desires to limit the sub-contracting procedure.

Schedule C

  • 1. Security Requirements Clause

    • (a) The provisions of this clause are based upon the Netherlands Australia Defence Security Arrangement, and shall apply to the extent that this contract involves access to and the handling of information to which a security classification has been assigned by the Government of Australia.

    • (b) The Government of Australia shall assign a security classification to each of the elements of classified information furnished or to be developed under this contract, and shall advise the Director of the designated Netherlands Intelligence Authority of such security classification. If classified information is disclosed orally pursuant to a visit to the contractor by or on behalf of the Government of Australia, the contractor shall be informed of such security classification. The designated Netherlands Intelligence Authority shall assign an equivalent Netherlands security classification to each of the elements of classified information furnished or to be developed under the contract, and shall forward the information to the contractor. The Government of Australia shall keep current all security classifications, and inform the designated Netherlands Intelligence Authority of any changes thereto. Each classified element of this contract shall be safeguarded by the contractor as Netherlands classified information and shall be subject to the provisions of the Netherlands laws and regulations.

    • (c) The contractor shall not incorporate, disclose, or release any Australian classified information, other than that furnished to him in connection with this contract, in the performance of this contract without the express written authorisation of the Australian Government.

    • (d) To the extent that elements of this contract have been or may be assigned a security classification, as provided in paragraph (b) above, the contractor shall safeguard all classified elements of this contract and shall provide and maintain a system of security controls within his own organisation in accordance with the requirements of:

      • (i) The Security Directive (“Algemeen Beveiligingsvoorschrift voor Defensie - Opdrachten 1965”) between the contractor and the Minister of Defence, and any modification to the Security Directive for the purpose of adapting these regulations to the contractor's business;

      • (ii) Any amendments to said regulations made after the date of this contract, notice of which has been furnished to the contractor by the designated Netherlands Intelligence Authority having security cognizance over the facility.

    • (e) Representatives of the designated Netherlands Intelligence Authority having security cognizance over the facility shall be authorised to inspect at reasonable intervals the procedures, methods, and facilities utilised by the contractor in complying with the security requirements under this contract at locations within the Netherlands. Should the Government of the Netherlands determine that the contractor is not complying with the security requirements of this contract, the contractor shall be informed in writing by the Netherlands Department of Defence of the proper action to be taken in order to effect compliance with such requirements.

    • (f) If, subsequent to the date of this contract, the security classifications or security requirements under this contract are changed by the Government of the Netherlands or by the Government of Australia, and the security costs under this contract are thereby increased or decreased, the contract price shall be subject to an equitable adjustment by reason of such increased or decreased costs.

    • (i) An appropriate clause shall be inserted in the contract if the contracting office desires to limit the sub-contracting procedure.

  • 1. I/We acknowledge that I am/we are responsible for the safeguarding and supervision of the Australian Government classified matter detailed in paragraph 3 below once it has been received by me/us and I/we give the following undertakings in accordance with the Netherlands-Australia Defence Security Arrangement:

    • (a) I/We will not copy or reproduce the classified matter1 without prior written consent; and

    • (b) I/we will not without your authority publish, show, distribute, release the classified matter or information derived therefrom to any person including overseas affiliates other than persons of this organisation for whom appropriate Government of Australia (refer Note 1) approvals are held and who have a direct “need to know”; and

    • (c) I/we also agree that any classified matter or information therefrom approved by the Government of Australia for release to overseas affiliates will be transmitted by that Government (refer Note 1) on a Government-to-Government basis; and

    • (d)

      • (i) I/we will safeguard the classified matter in accordance with the security classification (s) endorsed thereon; and

      • (ii) I/we agree that the classified matter and the security protective arrangements can be audited and inspected by a Security Officer (s) of the Central Office of Industrial Security of the Government of Australia when considered necessary (refer Note 2).

    • (e) In the event of the classified matter and any information generated therefrom either being recalled by the Government of Australia or being no longer required by me/us or by any person authorised by you to whom I/we have distributed or released such /classified matter and information I/we will comply forthwith or will you thereof, as appropriate, and carry out the instructions given by you.

  • 2. I am/We are aware of the requirements arising from the security classification (s) of the matter and I am/we are also aware of the provisions of the relevant Australian Government (refer Note 1) Statutes relating to Official Secrecy.

    Instructions for the Return of Classified Matter

    Before returning the classified matter covered by this Agreement and any generated information pertaining thereto to the originator the advice of the Department of Defence (refer Note 2) should be first sought and any directions given are to be observed (paragraph l(e) refers).

    Guide Instructions for the Custody of Classified Matter

    • 1. TOP SECRET specific instructions will be issued on each occasion.2

    • 2. SECRET AND CONFIDENTIAL matter is to be stored when not in actual use or under guard, in secure vaults, safes or equivalent containers, having anti-drill protection, and secured by an approved 3combination lock of the dial type.

    • 3. RESTRICTED matter, when not in use, is to be stored in a container, preferably having anti-drill protection, and secured by an approved4 key lock or angle locking bar with approved 5 padlock.

NOTES

  • 1. In cases where the Security Agreement is executed by industry located outside of Australia the word “Government” is to be interpreted as meaning the National Government of the country in which the industry is domiciled and further that that Government is acting as Agent for the Government of Australia, and has, inter alia, assured itself that the relevant security clearances have been obtained at the appropriate level for all access personnel. Furthermore where the text of the Agreement implies it the security rules and regulations of the National Industrial Security Organisation and the National Statutes relating to Official Secrecy of the Government of the country concerned apply.

  • 2. In countries outside Australia for “Central Office of Industrial Security, Department of Defence/Government of Australia” substitute “The Industrial Security Organisation” or its equivalent of the National Government of the country concerned.

Ik heb de eer te verwijzen naar het overleg dat heeft plaatsgevonden tussen vertegenwoordigers van onze Regeringen met betrekking tot het totstandbrengen van beveiligingsregelingen ten einde de uitwisseling van gegevens mogelijk te maken en te regelen tussen de Regering van Australië en de Regering van het Koninkrijk der Nederlanden.

Het totstandkomen van deze regelingen is wenselijk geworden in verband met de samenwerking tussen Nederland en Australië op het gebied van de produktie en de aanschaf van militaire uitrusting. Ik kan Uwe Excellentie thans mededelen dat de Australische Regering bereid is ter zake een overeenkomst te sluiten, te noemen „Nederlands-Australische Overeenkomst inzake een defensiebeveiligingsregeling”, waarbij het volgende wordt geregeld.

Wederzijdse beveiliging

  • 1. De gegevens waarop deze Overeenkomst betrekking heeft, zijn geclassificeerde gegevens van een van beide landen of van beide landen, die verband houden met of vallen onder van regeringswege goedgekeurde regelingen inzake defensie-aangelegenheden, daarbij inbegrepen contracten, subcontracten of aan de totstandkoming daarvan voorafgaande onderhandelingen, geplaatst, respectievelijk aangegaan door of namens de Nederlandse Regering of door of namens de Australische Regering.

  • 2. Iedere Regering neemt in overeenstemming met deze Overeenkomst en de daarbij behorende bijlagen alle passende maatregelen ter bescherming van de gegevens waarop deze Overeenkomst betrekking heeft en die zich bevinden op haar territoriaal rechtsgebied dan wel in het bezit zijn van of worden verstrekt aan personen die door haar zijn gemachtigd deze gegevens mee naar het buitenland te nemen.

  • 3. De gegevens die onder deze Overeenkomst vallen, krijgen een beveiliging, die ten minste gelijk is aan de beveiliging gegeven aan de eigen geclassificeerde gegevens van iedere Regering die een overeenkomstige beveiligingsclassificatie bezitten.

  • 4. Iedere Regering neemt alle verdere beveiligingsvoorschriften in acht die door beide Regeringen als noodzakelijk kunnen worden beschouwd voor het regelen van de onderlinge uitwisseling van geclassificeerde militaire informatie.

  • 5. Geen van beide Regeringen verleent inzage van de gegevens die onder deze Overeenkomst vallen, aan de Regering, ondernemingen en burgers van een derde Staat, tenzij eerst van de Regering die deze gegevens heeft verstrekt, schriftelijk toestemming is verkregen om anders te handelen.

  • 6. De onder deze Overeenkomst vallende gegevens worden niet gebruikt voor andere dan defensiedoeleinden.

  • 7. Iedere Regering zorgt voor de noodzakelijke beveiligingsinspecties waaraan dient te worden onderworpen ieder object op haar territoriale rechtsgebied waaraan of waardoor onder deze Overeenkomst vallende gegevens kunnen worden doorgegeven of dat op enigerlei wijze zou kunnen zijn betrokken bij het gebruik of het doorgeven van deze gegevens.

  • 8. Iedere Regering verstrekt op verzoek redelijke faciliteiten voor periodieke bezoeken door vertegenwoordigers van de verzoekende Regering ten einde te zamen de alsdan van kracht zijnde beveiligingsbepalingen te bezien met het doel te komen tot een wederzijds inzicht in de toereikendheid en de redelijke verenigbaarheid van de onderscheiden beveiligingssystemen.

  • 9. Indien over een contract of regeling inzake geclassificeerde gegevens wordt onderhandeld door of namens de Regering van het land dat de gegevens verstrekt, en dit contract of deze regeling ten uitvoer moet worden gelegd in het andere land, zal de Regering die de gegevens verstrekt, in dat contract een beveiligingsclausule opnemen zoals vereist in Bijlage B bij deze brief wanneer het de Nederlandse Regering betreft, of in Bijlage C bij deze brief wanneer het de Australische Regering betreft, of in elk van beide gevallen een passende gelijkwaardige clausule.

  • 10. Het doorgeven van onder deze Overeenkomst vallende gegevens geschiedt alleen langs tussen de Regeringen bestaande kanalen en door vertegenwoordigers die door iedere Regering zijn aangewezen.

  • 11. De onder deze Overeenkomst vallende gegevens worden alleen ter beschikking gesteld van personen die deze gegevens nodig hebben bij de uitoefening van hun taken en die ten aanzien van de beveiliging een passende clearance hebben verkregen alsmede de machtiging om de informatie in hun bezit te hebben.

  • 12. Bezoeken die de toegang tot of de uitwisseling of overdracht van geclassificeerde gegevens met zich brengen, dienen vooraf te worden goedgekeurd door beide Regeringen. Voor deze bezoeken wordt goedkeuring alleen verleend aan personen die in het bezit zijn van geldige clearances.

Terminologie

  • 13. In deze Overeenkomst omvat de term „geclassificeerde gegevens” alle gegevens, in welke vorm dan ook, die van de ene Regering aan de andere Regering worden toegezonden en waarop een beveiligingsclassificatie is aangebracht dan wel waarop is aangegeven dat zij aldus dienen te worden geclassificeerd door of onder leiding van de Regering die deze gegevens toezendt.

Bescherming van particuliere rechten

  • 14. Iedere Regering eerbiedigt de industriële eigendomsrechten met inbegrip van auteursrechten en rechten die voortvloeien uit uitvindingen, voor zover deze rechten in het geding zijn bij de krachtens deze Overeenkomst uitgewisselde informatie.

Beveiligingskosten

  • 15. De Regeringen betalen elkaar geen vergoeding voor de kosten die verband houden met de uitvoering van beveiligingsmaatregelen.

Schending van de beveiligingsbepalingen

  • 16. In geval van schending van voorschriften of bepalingen inzake de beveiliging van onder deze Overeenkomst vallende gegevens, wordt door de bevoegde autoriteiten en door de bevoegde rechtbanken een onderzoek en rechtsvervolging ingesteld.

  • 17. In geval van verlies, compromittering of mogelijke compromittering van geclassificeerde gegevens of enige schending van voorschriften inzake de beveiliging van onder deze Overeenkomst vallende gegevens, wordt hiervan onverwijld melding gemaakt aan de Regering die de gegevens heeft verstrekt.

Bijlagen

  • 18. Nadere bijzonderheden omtrent de te volgen werkwijze bij de uitvoering van deze Overeenkomst worden uiteengezet in de Bijlagen A, B, C en D bij deze brief.

Herziening of beëindiging van de Overeenkomst

  • 19. Deze Overeenkomst wordt herzien op verzoek van een van beide Regeringen.

  • 20. Deze Overeenkomst houdt op van kracht te zijn zes maanden na ontvangst van een door de ene Regering aan de andere Regering toegezonden schriftelijke kennisgeving van beëindiging.

  • 21. Tenzij door beide Regeringen anders is overeengekomen worden alle onder deze Overeenkomst vallende gegevens, bij beëindiging van de Overeenkomst, behandeld overeenkomstig de bepalingen van de Overeenkomst.

  • 22. Deze Overeenkomst is alleen van toepassing op het in Europa gelegen deel van het Koninkrijk der Nederlanden.

Indien het bovenstaande aanvaardbaar is voor de Regering van het Koninkrijk der Nederlanden, stel ik voor dat deze brief en Uwer Excellenties bevestigend antwoord de Overeenkomst vormen die in werking zal treden op de datum waarop de Regering van het Koninkrijk der Nederlanden de Regering van Australië schriftelijk ervan in kennis stelt dat is voldaan aan de in het Koninkrijk der Nederlanden constitutioneel vereiste procedures.

Ik maak van deze gelegenheid gebruik Uwe Excellentie opnieuw te verzekeren van mijn zeer bijzondere hoogachting.

Bijlage A

  • 1. Indien deze Overeenkomst zulks vereist, beveiligt de Nederlandse Regering de onder de Overeenkomst vallende gegevens overeenkomstig de Nederlandse beveiligingsvoorschriften en in het bijzonder overeenkomstig het bepaalde in artikel 2, hoofdstuk 1 van het Beveiligingsvoorschrift - II, 1965 en eventueel het Algemeen Beveiligingsvoorschrift voor Defensie-opdrachten 1965.

  • 2. Indien deze Overeenkomst zulks vereist, beveiligt de Australische Regering de onder de Overeenkomst vallende gegevens overeenkomstig de Australische beveiligingsvoorschriften en in het bijzonder overeenkomstig het „Protective Security Handbook, 1966” en eventueel het „Handbook of Security Procedures for Contractors”.

  • 3. Bij iedere voorgenomen wijziging in de beveiligingsvoorschriften of -procedures van een van beide landen betreffende de onder de Overeenkomst vallende gegevens, stelt de Regering van dat land de andere Regering terstond in kennis van het besluit de voorschriften of procedures te wijzigen.

  • 4. Bij wijziging in de beveiligingsvoorschriften of -procedures van een van beide landen kan de Regering van het andere land verlangen dat de eerder van kracht zijnde voorschriften en procedures van toepassing blijven ten aanzien van de onder de Overeenkomst vallende gegevens.

  • 5. Vanaf de datum van deze Overeenkomst zijn de bepalingen van de Overeenkomst van toepassing op de geclassificeerde gegevens die voor de datum van deze Overeenkomst van het ene land aan het andere land zijn overgedragen, tenzij door beide Regeringen anders wordt overeengekomen ten aanzien van bepaalde gegevens.

  • 6. Indien onder deze Overeenkomst vallende gegevens mondelinge informatie betreffen, wordt de overbrenging van deze informatie vastgelegd in een memo („Note for File”), waarop dezelfde veiligheidsmaatregelen van toepassing zijn als op ieder ander schriftelijk document dat valt onder de Overeenkomst.

  • 7. Indien subcontracten waarbij onder de Overeenkomst vallende gegevens zijn betrokken, worden gegund in het land dat oorspronkelijk de gegevens aan de contractant heeft verstrekt, dan neemt dat land de verantwoordelijkheid op zich voor de beveiligingsmaatregelen ten aanzien van de bij die projecten betrokken objecten en personen.

Beveiligingsclearances

  • 8. De afgifte van clearances voor objecten en personen geschiedt overeenkomstig de voorschriften van het land dat verantwoordelijk is voor de toepassing van de beveiligingsmaatregelen voor de onder de Overeenkomst vallende gegevens.

Beveiligingsvoorschriften voor contractanten

  • 9. Iedere Regering draagt er zorg voor dat de contractanten of subcontractanten die toegang hebben tot onder de Overeenkomst vallende gegevens, instructies ontvangen waarin is uiteengezet welke verantwoordelijkheid zij hebben bij de beveiliging van de gegevens overeenkomstig de van toepassing zijnde wetten en voorschriften.

    • (a) De Nederlandse Regering verstrekt deze contractanten en subcontractanten in Nederland een exemplaar van het „Algemeen Beveiligingsvoorschrift voor Defensie-opdrachten 1965” voor de betrekkingen tussen de contractant en de Minister van Defensie, alsmede van iedere wijziging daarop die noodzakelijk mocht zijn voor een passende beveiliging in ieder bepaald geval.

    • (b) De Australische Regering verstrekt deze contractanten en subcontractanten in Australië een exemplaar van het „Handbook of Security Procedures for Contractors” van de Beveiligingsovereenkomst (Publikatie van de Australische Regering inzake geclassificeerde gegevens voor de industrie - Beveiligingsdocument No. 4) voor de betrekkingen tussen de contractant en het Ministerie van Defensie, van de bepalingen van Beveiligingsdocument No. 1 (Geheimhouding en beveiliging voor contracten met de classificatie „Dienstgeheim (Restricted)) of van Beveiligingsdocument No. 2 (Geheimhouding en beveiliging voor contracten met de classificatie „Confidentieel” (Confidential), „Geheim” (Secret) of „Zeer geheim” (Top Secret)) al naar gelang van toepassing is, alsmede van iedere wijziging op de Beveiligingsovereenkomst of Beveiligingsdocument No. 1 of No. 2, die noodzakelijk mocht zijn voor een passende beveiliging in ieder bepaald geval.

  • 10. Een exemplaar van iedere door deze Overeenkomst vereiste beveiligingsclausule die door een der Regeringen moet worden opgenomen in een contract alsmede van alle andere beveiligingsbepalingen betrekking hebbend op dat contract, wordt verstrekt aan de andere Regering.

Overbrenging

  • 11.

    • (a) Alle personen aan wie onder deze Overeenkomst vallende gegevens worden overgebracht of die deze gegevens overbrengen, worden door de desbetreffende Regering op de hoogte gesteld van de kanalen die zij hierbij dienen te gebruiken.

    • (b) Onder deze Overeenkomst vallende gegevens worden klaargemaakt voor overbrenging overeenkomstig de voorschriften van het land waaruit de gegevens worden verzonden.

  • 12. Iedere Regering draagt er zorg voor dat de geclassificeerde gegevens die zij verstrekt aan de andere Regering, zijn voorzien van de passende classificatieaanduiding en de naam van het land van oorsprong.

  • 13. De Australische geclassificeerde gegevens, met inbegrip van de gegevens die zijn geproduceerd of gereproduceerd in Nederland, worden eveneens voorzien van de aanduidingen zoals vermeld in Bijlage D. De Nederlandse geclassificeerde gegevens worden, indien deze niet meer nodig zijn, via de Australische Ambassade te 's-Gravenhage teruggezonden aan de daartoe aangewezen Nederlandse inlichtingendienst.

Australische geclassicificeerde gegevens

  • 14.

    • (a) Wanneer de Australische Regering geclassificeerde gegevens verstrekt, kent zij aan elk van de elementen van die gegevens een beveiligingsclassificatie toe, brengt hierop de overeenkomstige aanduiding aan en stelt de Directeur van de aangewezen Nederlandse inlichtingendienst op de hoogte van die classificatie. Bij ontvangst kent de Nederlandse Regering een gelijkwaardige Nederlandse classificatie toe aan elk van de elementen van de verstrekte of te verstrekken geclassificeerde gegevens, brengt hierop de aanduiding aan en zendt deze elementen naar de desbetreffende contractant of functionaris.

    • (b) Wanneer Australische geclassificeerde gegevens worden geproduceerd of gereproduceerd in Nederland, draagt de Nederlandse Regering er zorg voor dat onder haar toezicht op deze gegevens de toegekende classificatieaanduidingen van beide landen worden aangebracht zoals bepaald in voorschrift 16 hieronder. De aanduidingen worden aangebracht op de in de Nederlandse voorschriften aangegeven wijze.

    • (c) Indien Australische geclassificeerde gegevens mondeling openbaar worden gemaakt naar aanleiding van een bezoek dat door of namens de Australische Regering wordt gebracht aan de contractant of functionaris, draagt die Regering er zorg voor dat de contractant of functionaris op de hoogte wordt gesteld van de beveiligingsclassificatie van de gegevens.

Nederlandse geclassificeerde gegevens

  • 15.

    • (a) Wanneer de Nederlandse Regering geclassificeerde gegevens verstrekt, kent zij een beveiligingsclassificatie toe aan elk van de elementen van die gegevens, brengt hierop de overeenkomstige aanduiding aan en stelt de beveiligingsfunctionaris (Chief Security Adviser) van het Centrale Bureau voor Industriële Beveiliging (Central Office of Industrial Security) van het Australische Ministerie van Defensie op de hoogte van die classificatie. Bij ontvangst kent de Australische Regering een gelijkwaardige Australische classificatie toe aan elk van de elementen van de verstrekte of te verstrekken geclassificeerde gegevens, brengt hierop de aanduiding aan en zendt deze elementen naar de desbetreffende contractant of functionaris.

    • (b) Wanneer Nederlandse geclassificeerde gegevens worden geproduceerd of gereproduceerd in Australië, draagt de Australische Regering er zorg voor dat onder haar toezicht op deze gegevens de toegekende classificatieaanduidingen van beide landen worden aangebracht zoals bepaald in voorschrift 16 hieronder. De aanduidingen worden aangebracht op de in de Nederlandse voorschriften aangegeven wijze.

    • (c) Indien Nederlandse geclassificeerde gegevens mondeling openbaar worden gemaakt naar aanleiding van een bezoek dat door of namens de Nederlandse Regering wordt gebracht aan de contractant of functionaris, draagt die Regering er zorg voor dat de contractant of functionaris op de hoogte wordt gesteld van de beveiligingsclassificatie van de gegevens.

  • 17. De Regering die geclassificeerde gegevens verstrekt, geeft iedere contractant of functionaris duidelijke classificatierichtlijnen voor ieder element dat verband houdt met het contract. De richtlijnen worden door die Regering toegezonden aan de andere Regering die deze dient goed te keuren en over te brengen aan de contractant of functionaris. Iedere wijziging in de classificatierichtlijnen of in de classificatie van enig geclassificeerd element dat verband houdt met het contract wordt eveneens toegezonden aan de andere Regering en vervolgens overgebracht aan de contractant of functionaris.

Subcontracten

  • 18. Bij een contract of subcontract waarbij onder deze Overeenkomst vallende gegevens betrokken zijn, kan de contractant of subcontractant, tenzij zulks in het contract of subcontract uitdrukkelijk is verboden, een subcontract afsluiten in zijn eigen land in overeenstemming met de beveiligingsprocedure zoals die door zijn land is voorgeschreven voor subcontracten waarbij geclassificeerde gegevens betrokken zijn, alsmede in het land van de Regering die de geclassificeerde gegevens oorspronkelijk heeft verstrekt, indien daarbij de door deze Overeenkomst vastgestelde procedure voor het plaatsen van een hoofdcontract in dat land wordt gevolgd. Een contractant of subcontractant sluit geen subcontract met een andere firma die is gevestigd buiten zijn eigen land, zonder eerst via de gebruikelijke overheidskanalen schriftelijk goedkeuring te hebben gevraagd en verkregen van de Regering die oorspronkelijk de geclassificeerde gegevens heeft verstrekt.

Bezoeken

  • 19. Bij bezoeken waarbij het gaat om de uitwisseling of de overbrenging van geclassificeerde gegevens en die zijn goedgekeurd door beide Regeringen, kunnen de bezoekers worden gemachtigd toegang te hebben tot geclassificeerde gegevens, met dien verstande dat de machtiging wordt beperkt tot hetgeen noodzakelijk is voor officiële doeleinden in verband met het contract waarbij geclassificeerde gegevens betrokken zijn.

  • 20. De machtiging verleend aan bezoekers om toegang te hebben tot geclassificeerde gegevens berustend bij de hoofdcontractant, kan, op verzoek, ook de machtiging inhouden voor toegang tot of openbaarmaking van geclassificeerde gegevens berustend bij een subcontractant die is betrokken bij de uitvoering van werkzaamheden in verband met hetzelfde hoofdcontract.

    • (a) Verzoeken om toestemming voor een bezoek behoren de volgende informatie te omvatten:

      • (i) Naam voluit (achternaam eerst of afzonderlijk);

      • (ii) Datum en plaats van geboorte en nationaliteit op het moment van het verzoek;

      • (iii) Uitvoerige beschrijving van het doel van het bezoek en eventueel aanduiding van het desbetreffende contract;

      • (iv) Officiële titel van de bezoeker;

      • (v) Persoon of personen die zullen worden bezocht en de naam en plaats van de instelling/firma;

      • (vi) Datum of data van bezoek;

      • (vii) Aard van de clearance op het moment van het verzoek (persoonlijk);

      • (viii) Indien de bezoeker een industrieel is, de aard van de clearance die de door hem vertegenwoordigde firma heeft op het moment van het verzoek;

      • (ix) De autoriteit die gemachtigd is tot het openbaar maken van Nederlandse/Australische geclassificeerde gegevens tot en met (classificatieniveau) overeenkomstig het doel van het bezoek;

      • (x) Verantwoordelijk gezagsorgaan (desbetreffend Nederlands c.q. Australisch Ministerie).

      Verzoeken om toestemming voor bezoeken worden ten minste vier weken van tevoren ingediend op de wijze aangegeven in de voorschriften 21 en 22 hieronder.

    • (b) Desgewenst kan een lijst worden aangelegd met de namen van de personen die door beide Regeringen zijn gemachtigd tot het bezoeken van bepaalde regeringsactiviteiten of van objecten van contractanten gedurende bepaalde tijdvakken van maximaal twaalf maanden, in verband met een bepaald contract. Deze machtiging kan steeds worden verlengd met een nieuw tijdvak van twaalf maanden indien zulks noodzakelijk mocht zijn voor de tenuitvoerlegging van het contract. Verzoeken ten behoeve van op de goedgekeurde lijst vermelde personen om een bezoek af te leggen in verband met het contract worden vóór het desbetreffende bezoek via de tussen de Regeringen gebruikelijke kanalen voorgelegd aan de te bezoeken regeringsactiviteit of het te bezoeken object van de contractant.

Procedure betreffende Australische geclassificeerde gegevens in Nederland

  • 21.

    • (a) Algemeen

      Voor de Nederlandse Minister van Defensie berust de verantwoordelijkheid voor de uitvoering van de beveiligingsvoorschriften in de Nederlandse industrie bij:

      het Hoofd van de Marine Inlichtingendienst

      het Hoofd van de Landmacht Inlichtingendienst

      het Hoofd van de Luchtmacht Inlichtingendienst

      Deze autoriteiten zijn verantwoordelijk voor het verlenen van clearances voor objecten en van toestemming voor bezoeken van Australisch personeel indien het wenselijk is onderhandelingen te voeren die kunnen leiden tot het gunnen van een contract in Nederland waarbij Australische geclassificeerde gegevens zijn betrokken.

      Via bovengenoemde autoriteiten kunnen Australische overheidsinstanties zorgen voor het plaatsen van subcontracten in Nederland.

      De Australische overheidsinstanties doen hun verzoeken via de Australische Ambassade te 's-Gravenhage. Deze Ambassade wordt in het bezit gesteld van een lijst met Nederlandse industrieën. Op de lijst wordt aangegeven welke van de bovenvermelde autoriteiten verantwoordelijk is voor de toepassing van de beveiligingsvoorschriften in iedere industrie.

    • (b) Inleidende procedure

      Alvorens geclassificeerde gegevens ter beschikking te stellen aan een toekomstige Nederlandse inschrijver op een contract, een contractant of subcontractant, of een overheidsinstantie, neemt de Australische Regering, via de Australische Ambassade te 's-Gravenhage, contact op met een van de Nederlandse instanties genoemd in voorschrift 21 (a) en

      • (1) indien het gaat om objecten, wint zij inlichtingen in omtrent de aard van de clearances die op dat moment voor die objecten gelden (met inbegrip van de beveiliging van de aanwezige opbergingsmogelijkheden) ten einde geclassificeerde besprekingen te voeren, en indien nodig, verzoekt zij om een hoger clearanceniveau;

      • (2) wint zij inlichtingen in omtrent de aard van de clearance die geldt voor het personeel van de contractant en het personeel van het Nederlandse ministerie of de Nederlandse instantie waarmee zij besprekingen wenst te voeren, en indien nodig, verzoekt zij om een hoger clearanceniveau.

    • (c) Bezoeken

      Verzoeken om goedkeuring van persoonlijke bezoeken of verzoeken voor het vaststellen van een goedgekeurde lijst voor voortduren de bezoeken worden door de Australische Regering, via de Australische Ambassade te 's-Gravenhage, ingediend bij een van de autoriteiten vermeld onder voorschrift 21 (a).

Procedure betreffende Nederlandse gegevens in Australië

  • 22.

    • (a) Algemeen

      Het eerste contactpunt voor geclassificeerde besprekingen, onderhandelingen voorafgaand aan een contract, inschrijvingen en het plaatsen van een contract of subcontract in Australië waarbij Nederlandse geclassificeerde gegevens zijn betrokken, is de „Chief Security Adviser, Central Office of Industrial Security, Department of Defence, CANBERRA A.C.T.,” die voor deze activiteiten beveiligingsmaatregelen toepast.

    • (b) Inleidende procedure

      Alvorens geclassificeerde gegevens ter beschikking te stellen van een toekomstige Australische inschrijver op een contract, een contractant of subcontractant, of een overheidsinstantie, neemt de Nederlandse Regering, via de Nederlandse Ambassade te Canberra, contact op met de „Chief Security Adviser, Central Office of Industrial Security, Department of Defence, CANBERRA, A.C.T.” en

      • (1) indien het gaat om objecten, wint zij inlichtingen in omtrent de aard van de clearances die op dat moment voor die objecten gelden (met inbegrip van de beveiliging van de aanwezige opbergingsmogelijkheden) ten einde geclassificeerde besprekingen te voeren, en indien nodig, verzoekt zij om een hoger clearanceniveau;

      • (2) wint zij inlichtingen in omtrent de aard van de clearance die geldt voor het personeel van de contractant en het personeel van het Australische ministerie of de Australische instantie waarmee zij besprekingen wenst te voeren, en indien nodig, verzoekt zij om een hoger clearanceniveau.

    • (c) Bezoeken

      • (1) Verzoeken zoals vereist voor de goedkeuring van persoonlijke bezoeken of voor het vaststellen van goedgekeurde lijsten voor voortdurende bezoeken worden door de Nederlandse Regering ingediend bij:

        • Chief Security Adviser,

        • Central Office of Industrial Security,

        • Department of Defence,

        • CANBERRA, A.C.T.,

        die advies inwint bij het Ministerie van Defensie (met inbegrip van de Marine-, Landmacht- en Luchtmachtdiensten) omtrent de aanvaardbaarheid van het bezoek. Het clearancebericht dient te worden gegeven 14 volle dagen voordat het bezoek plaatsvindt.

Beveiligingskosten

  • 23. Voordat enige beveiligingsmaatregel wordt vereist die een verhoging betekent van de beveiligingskosten die een contractant is gerechtigd door te berekenen uit hoofde van zijn contract, wordt een en ander gecoördineerd na onderhandeling met de regering waarvoor het contract moet worden uitgevoerd.

Bijlage B

  • 1. Beveiligingsclausule

    • (a) De bepalingen van deze clausule zijn gebaseerd op de Nederlands-Australische Overeenkomst inzake een Defensiebeveiligingsregeling, en zijn van toepassing voor zover dit contract met zich brengt de toegang tot en het hanteren van informatie waaraan door de Nederlandse Regering een beveiligingsclassificatie is toegekend.

    • (b) De Nederlandse Regering kent een beveiligingsclassificatie toe aan ieder element van de geclassificeerde informatie die in het kader van dit contract wordt verstrekt of dient te worden ontwikkeld, en stelt de „Chief Security Adviser” van het „Central Office of Industrial Security” van het Ministerie van Defensie op de hoogte van deze beveiligingsclassificatie. Indien geclassificeerde informatie mondeling openbaar wordt gemaakt naar aanleiding van een bezoek dat door of namens de Nederlandse Regering wordt gebracht aan de contractant, wordt de contractant op de hoogte gesteld van deze beveiligingsclassificatie. De „Chief Security Adviser” van het „Central Office of Industrial Security" van het Ministerie van Defensie kent een gelijkwaardige Australische beveiligingsclassificatie toe aan ieder element van de geclassificeerde informatie die in het kader van het contract wordt verstrekt of dient te worden ontwikkeld, en zendt de informatie aan de contractant. De Nederlandse Regering houdt alle beveiligingsclassificaties bij en stelt de „Chief Security Adviser” van het „Central Office of Industrial Security” van het Ministerie van Defensie op de hoogte van iedere hierop aangebrachte wijziging en wel door middel van richtlijnen voor beveiligingsclassificatie. Ieder geclassificeerd element van dit contract wordt door de contractant beveiligd als Australische geclassificeerde informatie en valt onder de bepalingen van de Australische wetten en voorschriften.

    • (c) De contractant zal bij de uitvoering van dit contract geen andere Nederlandse geclassificeerde informatie verwerken, openbaren of vrijgeven dan die welke hem is verstrekt in verband met dit contract, zonder de uitdrukkelijke schriftelijke toestemming van de Directeur van de aangewezen Nederlandse Inlichtingendienst.

    • (d) Voor zover aan elementen van dit contract een beveiligingsclassificatie is toegekend of kan worden toegekend, zoals hierboven onder letter (b) is bedoeld, beveiligt de contractant alle geclassificeerde elementen van dit contract en draagt hij zorg voor een systeem van beveiligingscontroles binnen zijn eigen organisatie in overeenstemming met de vereisten van:

      • (1) de „Beveiligingsovereenkomst-Beveiligingsdocument” No. 4 (bijgevoegd) en de bepalingen van „Beveiligingsdocument” No. 1 of No. 2 al naar gelang van toepassing (zie Bijlage A) tussen de contractant en het Ministerie van Defensie, en van enige wijziging op de Beveiligingsovereenkomst of Beveiligingsdocument No. 1 of 2, al naar gelang van toepassing voor het aanpassen van deze voorschriften aan de werkzaamheden van de contractant;

      • (2) Elke wijziging op bedoelde voorschriften, tot stand gekomen na de datum van dit contract, waarvan de contractant in kennis is gesteld door de Australische Regering („Central Office of Industrial Security”, Ministerie van Defensie) die op het gebied van de beveiliging bevoegdheid bezit met betrekking tot de objecten.

    • (e) Vertegenwoordigers van het Ministerie van Defensie, het „Central Office of Industral Security” die op het gebied van de beveiliging bevoegdheid bezitten met betrekking tot de objecten, zijn gemachtigd om met redelijke tussenpozen een onderzoek in te stellen naar de procedures, methoden en objecten die door de contractant worden gebruikt bij het nakomen van de beveiligingsvoorschriften in het kader van dit contract op plaatsen in Australië. Mocht de Australische Regering vaststellen dat de contractant niet voldoet aan de beveiligingsvoorschriften van dit contract, dan wordt de contractant door het „Central Office of Industrial Security” van het Ministerie van Defensie schriftelijk op de hoogte gesteld van de passende maatregelen die moeten worden genomen opdat hij alsnog zal voldoen aan deze voorschriften.

    • (f) Indien na de datum van dit contract de beveiligingsclassificaties of de beveiligingsvoorschriften in het kader van dit contract worden gewijzigd door de Nederlandse Regering of door de Australische Regering, en de in het kader van dit contract te maken beveiligingskosten daardoor hoger of lager worden, wordt, in verband met deze hogere of lagere kosten, de contractprijs op billijke wijze aangepast.

    • (g) De contractant stemt in met het opnemen van bepalingen in alle subcontracten die worden gegund aan Australische contractanten en die toegang tot geclassificeerde informatie met zich brengen, welke bepalingen inhoudelijk overeenkomen met de tekst van deze clausule, met inbegrip van dit lid. Voor subcontracten die worden gegund aan andere dan Australische contractanten, wordt een passende beveiligingsclausule verkregen van de Nederlandse Regering en deze wordt opgenomen in het subcontract.

    • (h) De contractant stemt er tevens mee in dat hij nagaat of iedere subcontractant die hij voorstelt voor de levering van materiaal en diensten die toegang tot bij de contractant berustende geclassificeerde informatie met zich brengt, alvorens hem toegang wordt verleend tot de geclassificeerde informatie:

      • (1) indien de subcontractant is gevestigd in Australië, een passende en nog geldige beveiligingsclearance van het „Central Office of Industrial Security” van het Ministerie van Defensie heeft gekregen, en beschikt over de mogelijkheid om geclassificeerde informatie op passende wijze op te bergen;

      • (2) indien de subcontractant is gevestigd in een ander land, door de Nederlandse Regering is goedgekeurd om toegang te hebben tot Nederlandse geclassificeerde informatie.

    • (i) Een passende clausule wordt opgenomen in het contract indien de instantie die het contract aangaat, de procedure voor het aangaan van subcontracten wenst te beperken.

  • 1. Beveiligingsclausule

    • (a) De bepalingen van deze clausule zijn gebaseerd op de Nederlands-Australische Overeenkomst inzake een Defensiebeveiligingsregeling, en zijn van toepassing voor zover dit contract met zich brengt de toegang tot en het hanteren van informatie waaraan door de Australische Regering een beveiligingsclassificatie is toegekend.

    • (b) De Australische Regering kent een beveiligingsclassificatie toe aan ieder element van de geclassificeerde informatie die in het kader van dit contract wordt verstrekt of zal worden ontwikkeld, en stelt de Directeur van de aangewezen Nederlandse Inlichtingendienst op de hoogte van deze beveiligingsclassificatie. Indien geclassificeerde informatie mondeling openbaar wordt gemaakt naar aanleiding van een bezoek dat door of namens de Australische Regering wordt gebracht aan de contractant, wordt de contractant op de hoogte gesteld van deze beveiligingsclassificatie. De aangewezen Nederlandse Inlichtingendienst kent een gelijkwaardige Nederlandse beveiligingsclassificatie toe aan ieder element van de geclassificeerde informatie die in het kader van het contract wordt verstrekt of zal worden ontwikkeld, en zendt de informatie aan de contractant. De Australische Regering houdt alle beveiligingsclassificaties bij en stelt de aangewezen Nederlandse Inlichtingendienst op de hoogte van iedere hierop aangebrachte wijziging. Ieder geclassificeerd element van dit contract wordt door de contractant beveiligd als Nederlandse geclassificeerde informatie en valt onder de bepalingen van de Nederlandse wetten en voorschriften.

    • (c) De contractant zal bij de uitvoering van dit contract geen andere Australische geclassificeerde informatie verwerken, openharen of vrijgeven dan welke hem is verstrekt in verband met dit contract, zonder de uitdrukkelijke schriftelijke toestemming van de Australische Regering.

    • (d) Voor zover aan elementen van dit contract een beveiligingsclassificatie is toegekend of kan worden toegekend, zoals hierboven onder letter (b) is bedoeld, beveiligt de contractant alle geclassificeerde elementen van dit contract en draagt hij zorg voor een systeem van beveiligingscontroles binnen zijn eigen organisatie in overeenstemming met de vereisten van:

      • (1) het Algemeen Beveiligingsvoorschrift voor Defensieopdrachten 1965 voor de betrekkingen tussen de contractant en de Minister van Defensie, en van elke wijziging op het Algemeen Beveiligingsvoorschrift voor het aanpassen van deze voorschriften aan de werkzaamheden van de contractant;

      • (2) elke wijziging op bedoelde voorschriften, tot stand gekomen na de datum van dit contract, waarvan de contractant in kennis is gesteld door de aangewezen Nederlandse Inlichtingendienst die op het gebied van de beveiliging bevoegdheid bezit met betrekking tot de objecten.

    • (e) Vertegenwoordigers van de aangewezen Nederlandse Inlichtingendienst die op het gebied van de beveiliging bevoegdheid bezitten met betrekking tot de objecten, zijn gemachtigd om met redelijke tussenpozen een onderzoek in te stellen naar de procedures, methoden en objecten die door de contractant worden gebruikt bij het nakomen van de beveiligingsvoorschriften in het kader van dit contract op plaatsen in Nederland. Mocht de Nederlandse Regering vaststellen dat de contractant niet voldoet aan de beveiligingsvoorschriften van dit contract, dan wordt de contractant door het Nederlandse Ministerie van Defensie schriftelijk op de hoogte gesteld van de passende maatregelen die moeten worden genomen opdat hij alsnog zal voldoen aan deze voorschriften.

    • (f) Indien na de datum van dit contract de beveiligingsclassificaties of de beveiligingsvoorschriften in het kader van dit contract worden gewijzigd door de Nederlandse Regering of door de Australische Regering, en de in het kader van dit contract te maken beveiligingskosten daardoor hoger of lager worden, wordt, in verband met deze hogere of lagere kosten, de contractprijs op billijke wijze aangepast.

    • (g) De contractant stemt in met het opnemen van bepalingen in alle subcontracten die worden gegund aan Nederlandse contractanten en die toegang tot geclassificeerde informatie met zich brengen, welke bepalingen inhoudelijk overeenkomen met de tekst van deze clausule, met inbegrip van het lid. Voor subcontracten die worden gegund aan andere dan Nederlandse contractanten, wordt een passende beveiligingsclausule verkregen van de Australische Regering en deze wordt opgenomen in het subcontract.

    • (h) De contractant stemt er tevens mee in dat hij nagaat of iedere subcontractant die hij voorstelt voor de levering van materiaal en diensten die toegang tot bij de contractant berustende geclassificeerde informatie met zich brengt, alvorens hem toegang wordt verleend tot de geclassificeerde informatie:

      • (1) indien de subcontractant is gevestigd in Nederland, een passende en nog geldige beveiligingsclearance voor het desbetreffende object van het Nederlandse Ministerie van Defensie heeft gekregen en beschikt over de mogelijkheid om geclassificeerde informatie op passende wijze op te bergen;

      • (2) indien de subcontractant is gevestigd in een ander land, door de Australische Regering is goedgekeurd om toegang te hebben tot Australische geclassificeerde informatie.

    • (i) Een passende clausule wordt opgenomen in het contract indien de instantie die het contract aangaat, de procedure voor het aangaan van subcontracten wenst te beperken.

    • 1. Ik erken/Wij erkennen dat ik/wij verantwoordelijk ben/zijn voor de beveiliging van en het toezicht op geclassificeerde gegevens van de Australische Regering zoals nader aangegeven in het derde lid hieronder, zodra deze gegevens door mij/ons zijn ontvangen en ik zal/wij zullen overeenkomstig de Nederlands-Australische Overeenkomst inzake een Defensiebeveiligingsregeling de volgende verplichtingen op mij/ons nemen:

      • (a) Ik zal/Wij zullen de geclassificeerde gegevens 6 niet kopiëren of reproduceren zonder voorafgaande schriftelijke toestemming; en

      • (b) Ik zal/Wij zullen niet zonder Uw machtiging geclassificeerde gegevens of daarvan afgeleide informatie publiceren, tonen, verspreiden of vrijgeven aan andere personen, met inbegrip van filialen in het buitenland, dan personen van deze organisatie voor wie van de Australische Regering (zie opmerking 1) passende goedkeuringen zijn verkregen voor wie het absoluut noodzakelijk is om hiervan kennis te nemen; en

      • (c) Ik stem/Wij stemmen er tevens mee in dat alle geclassificeerde gegevens of daarvan afgeleide informatie die krachtens een door de Australische Regering afgegeven goedkeuring mogen worden vrijgegeven aan filialen in het buitenland, door deze Regering (zie opmerking 1) zullen worden overgebracht via de tussen de Regeringen bestaande kanalen;

      • (d)

        • (i) Ik zal/Wij zullen de geclassificeerde gegevens beveiligen overeenkomstig de daarop aangegeven beveiligingsclassificatie(s); en

        • (ii) Ik stem/Wij stemmen ermee in dat de geclassificeerde gegevens en de beveiligingsregelingen kunnen worden gecontroleerd en geïnspecteerd door een of meer beveiligingsfunctionarissen van het “Central Office of Industrial Security” van de Australische Regering indien zulks noodzakelijk wordt geacht (zie opmerking 2).

      • (e) Indien de geclassificeerde gegevens en enige daaruit voortgekomen informatie hetzij door de Australische Regering worden terugvorderd hetzij niet langer nodig zijn voor mij/ons of voor enige door u gemachtigde persoon aan wie ik/wij deze gegevens en informatie heb/hebben verspreid of vrijgegeven, dan zal ik/zullen wij onmiddellijk aan deze vordering voldoen, dan wel u hiervan op de hoogte stellen, al naar het geval, en de door u gegeven instructies uitvoeren.

    • 2. Ik ben/Wij zijn bekend met de vereisten voortvloeiend uit de beveiligingsclassificatie(s) van de gegevens en tevens ben ik/zijn wij bekend met de bepalingen van de van toepassing zijnde regelingen van de Australische Regering (zie opmerking 1) betreffende de officiële geheimhouding.

      Instructies voor terugzending van geclassificeerde gegevens

      Voordat de onder deze Overeenkomst vallende geclassificeerde gegevens en enige daaruit voortvloeiende en daartoe behorende informatie worden teruggezonden, dient eerst het advies van het Ministerie van Defensie (zie opmerking 2) te worden ingewonnen en dienen de gegeven aanwijzingen te worden opgevolgd (zie eerste lid, letter (e)).

      Richtlijnen voor het bewaren van geclassificeerde gegevens

      • 1. ZEER GEHEIM (Top Secret): bij iedere gelegenheid zullen bijzondere instructies worden gegeven.7

      • 2. GEHEIME EN CONFIDENTIËLE (Secret and Confidential) gegevens dienen, wanneer deze niet worden gebruikt of onder bewaking staan, te worden opgeborgen in veilige kluizen, brandkasten of soortgelijke bergmiddelen van hard staal die zijn beveiligd door een goedgekeurd8 combinatieslot met draaischijf.

      • 3. DIENSTGEHEIM (Restricted) gegevens dienen, indien zij niet worden gebruikt, te worden opgeborgen in een bergmiddel bij voorkeur van hard staal en beveiligd door een goedgekeurd9sleutelslot of hoekgrendel met goedgekeurd10hangslot.

OPMERKINGEN

  • 1. In gevallen waarin de Beveiligingsovereenkomst wordt uitgevoerd door een industrie gevestigd buiten Australië, dient onder het woord „Regering” te worden verstaan de nationale Regering van het land waarin de industrie is gevestigd en verder dat die Regering optreedt als functionaris voor de Australische Regering, en zich er onder andere van heeft verzekerd dat op het desbetreffende niveau passende beveiligingsclearances zijn verkregen voor al het personeel dat toegang heeft tot de gegevens. Waar de tekst van de Overeenkomst zulks impliceert, zijn voorts van toepassing de beveiligingsregels en -voorschriften van de „National Industrial Security Organisation” en de nationale regelingen inzake de officiële geheimhouding van de regering van het desbetreffende land.

  • 2. In landen buiten Australië wordt de verwijzing naar het „Central Office of Industrial Security, Department of Defence/Government of Australia” vervangen door verwijzing naar de „Industrial Security Organisation” of een soortgelijke instelling van de nationale Regering van het desbetreffende land.

  • 3. De firma die deze Overeenkomst uitvoert, dient een exemplaar ervan te behouden.
