Agreement on Social Security between the Government of the Kingdom of the Netherlands and the Government of New Zealand

The Government of the Kingdom of the Netherlands

and

The Government of New Zealand,

Wishing to extend and modify the Agreement on Social Security between the Government of the Kingdom of the Netherlands and the Government of New Zealand done at Wellington on 8 October 1990; and

Wishing to maintain and strengthen the warm and friendly relations existing between the two countries and allow the payment of pensions from the Netherlands in New Zealand and the payment of New Zealand benefits in the Netherlands in respect of citizens taking up permanent residence in the other country,

Have agreed upon the following:

Part I. Definitions and scope

Article 1. Definitions

  • 1 In this Agreement unless the context otherwise requires:

    • a) ``benefit", for New Zealand means a New Zealand benefit or pension payable in terms of the Social Security Act 1964 or the Social Welfare (Transitional Provisions) Act 1990 or Part 1 of the New Zealand Superannuation Act 2001; and for the Netherlands means: any benefit or pension provided for in the laws of the Netherlands including any increase of, or additional amount payable with a benefit or pension by virtue of these laws;

    • b) ``competent authority" means in relation to New Zealand, the chief executive of the Ministry of Social Development (the Department of Work and Income) or an authorised representative of the chief executive; and in relation to the Netherlands, the Minister of Social Affairs and Employment;

    • (ba) "income tested benefit" means any benefit where eligibility for or the rate of it is dependent on the income of any person;

    • c) ``institution" in relation to a Contracting Party means, the institution or institutions that are responsible for the application of this Agreement in respect of that Contracting Party;

    • d) ``month" means a calendar month, but where fractions of a month are aggregated, a month means 30 days;

    • e) ``social security laws" means in relation to a Contracting Party the laws specified in Article 2 in relation to that Contracting Party;

    • f) ``New Zealand" means New Zealand only (and not the Cook Islands, Niue and Tokelau); ``The Netherlands" means the Kingdom of the Netherlands in Europe;

    • g) ``national" means in relation to New Zealand, a New Zealand citizen and in relation to the Netherlands, a person of Netherlands nationality;

    • h) ``1990 Agreement" means the Agreement on Social Security between the Government of New Zealand and the Government of the Kingdom of the Netherlands done at Wellington on 8 October 1990.

  • 2 In the application by a Contracting Party of this Agreement in relation to a person, any term not defined in this Article shall, unless the context otherwise requires, have the meaning assigned to it in the social security laws of either Contracting Party.

Article 2. Legislative Scope

  • 1 The legislation within the scope of this Agreement is:

    • a) in relation to New Zealand: the Social Security Act 1964 and the Social Welfare (Transitional Provisions) Act 1990 as amended at the date of signature of this Agreement and Part 1 of the New Zealand Superannuation Act 2001, and any legislation that subsequently amends, supplements or replaces any of those Acts, in so far as those Acts and that legislation provide for and for all matters in relation to the following benefits:

      • (i) New Zealand superannuation;

      • (ii) invalids' benefits;

      • (iii) widows' benefits;

      • (iv) domestic purposes benefits paid to widowers; and

      • (v) veterans' pension

    • b) in relation to the Netherlands laws governing:

      • (i) sickness insurance;

      • (ii) general old age insurance;

      • (iii) invalidity insurance for employed and self employed persons;

      • (iv) general survivors insurance; and

      • (v) children's allowances; and for the application of Article 5 also its laws on:

      • (vi) unemployment insurance.

  • 2 The Agreement shall only apply to legislation specified in paragraph 1. This Agreement shall not apply to any agreement on social security that either Contracting Party has concluded with a third Party or to any laws or regulations that amend the legislation specified in paragraph 1 of this Article for the purpose of giving effect to such an agreement.

  • 3 The competent authorities of the Contracting Parties shall notify each other of legislation that amends, supplements or replaces the laws within the scope of this Agreement promptly after the such mentioned laws are enacted.

  • 4 In relation to the Netherlands, this Agreement shall not apply to any social and medical assistance schemes.

Article 3. Personal Scope

Unless otherwise provided this Agreement shall apply to all persons who are or have been subject to the laws of one or both of the Contracting Parties as well as, in the case of the Netherlands, to people deriving their rights from such persons.

Article 4. Equality of Treatment

  • 1 In any case in which entitlement to a benefit under the social security laws of New Zealand and of the Netherlands depends, in whole or in part, on the nationality of a Contracting Party, a person who is a national of the other Contracting Party shall, for the purposes of a claim for that benefit, be deemed to be a national of the first mentioned Contracting Party.

  • 2 The persons to whom this Agreement applies shall be treated equally by each of the Contracting Parties in regards to rights and obligations which arise by virtue of this Agreement in relation to each Contracting Party.

Article 5. Secondment

  • 1 Where a person, who is subject to the legislation of the Netherlands, in the service of an employer having its place of business in the territory of the Netherlands is sent from that territory by that employer to work in the territory of New Zealand for a period not expected to exceed 5 years, the person may remain subject to the legislation of the Netherlands as if he or she were employed in the territory of the Netherlands.

  • 2 If the duration of the work is expected to exceed beyond the aforementioned duration, a person, who is subject to the legislation of the Netherlands in the service of an employer having his place of business in the territory of the Netherlands, is sent from that territory by that employer to work in the territory of New Zealand, the person may, if justified by special reasons, remain subject to the legislation of the Netherlands as if he or she were employed in the territory of the Netherlands.

  • 3 If the actual duration of work of the person described in paragraph 1 exceeds the expected period of work owing to unforeseeable circumstances, that person may remain subject to the legislation of the Netherlands as if he or she were employed in the territory of the Netherlands.

  • 4 For the purposes of the Netherlands legislation, a person who was subject to the Netherlands legislation in accordance with the provisions of this Article shall be considered to be resident in the territory of the Netherlands.

  • 5 According to the provisions of this Article the Netherlands legislation shall be applicable if the employer or the employee has applied for a certificate of secondment within three months after the first day of secondment or as expressed in paragraph 3 before the end of the expected period of secondment and this certificate has been issued to the person concerned.

Part II

A. PROVISIONS RELATING TO NEW ZEALAND BENEFITS

Article 6. Residence in the Netherlands

  • 1 If a person would be entitled to receive a benefit under the legislation of New Zealand (including a person who would be entitled under Article 7) except that he or she is not ordinarily resident in New Zealand on the date of application for that benefit, that person shall be deemed, for the purposes of that application, to be ordinarily resident in New Zealand on that date, provided that he or she:

    • a) is ordinarily resident in the Netherlands, and present either in the Netherlands or New Zealand, on that date;

    • b) has the intention of remaining ordinarily resident in the Netherlands for at least 26 weeks; and

    • c) has resided in New Zealand at any time in his or her life for a continuous period of at least 12 months since attaining the age of 20 years.

  • 2 Subject to this Agreement, if a person is entitled to receive a benefit under the legislation of New Zealand (including a person who is entitled under paragraph 1, or under Article 7, or both) but payment of that benefit is conditional on presence in New Zealand, that person shall be deemed, for the purpose of the payment of that benefit, to be present in New Zealand, provided that he or she:

    • a) is ordinarily resident in the Netherlands, and present either in the Netherlands or New Zealand and;

    • b) has resided in New Zealand at any time in his or her life for a continuous period of at least 12 months since attaining the age of 20 years.

  • 3 For the purposes of this Part:

    • a) if a person who is ordinarily resident in the Netherlands is temporarily absent from the Netherlands for a period which does not exceed 26 weeks, the period of temporary absence from the Netherlands shall not be considered as interrupting that person's ordinary residence in the Netherlands;

    • b) if a person who has been ordinarily resident in the Netherlands is absent from the Netherlands for a period which exceeds 26 weeks, that person shall cease to be considered ordinarily resident in the Netherlands on the date of his or her departure from the Netherlands; and

    • c) if a person leaves New Zealand with the intention of becoming ordinarily resident in the Netherlands for at least 26 weeks, and if that person begins to be ordinarily resident in the Netherlands within 26 weeks of his or her departure from New Zealand, that person shall be deemed to have become ordinarily resident in the Netherlands on the date of his or her departure from New Zealand.

  • 4 If a person who is ordinarily resident in the Netherlands reaches the age of entitlement to New Zealand superannuation or a veteran's pension, that person shall not be entitled to receive, or shall no longer be entitled to receive, as the case may be, an invalids benefit, widows benefit or domestic purposes benefit paid to a widower, if that person is qualified to receive New Zealand superannuation or a veteran's pension.

  • 5 For the purposes of this Agreement, a person who has not reached the age of entitlement for New Zealand superannuation shall not be entitled to receive New Zealand superannuation or a veteran's pension by virtue of the fact that his or her spouse is in receipt of New Zealand superannuation or a veteran's pension.

Article 7. Totalisation

  • 1 In determining whether a person meets the residential qualifications for a benefit specified in the legislation of New Zealand, the institution of New Zealand shall:

    • a) in the case of New Zealand superannuation or a veteran's pension, for a person who is over the age of 65 years, deem a Netherlands period of insurance accumulated by that person after attaining the age of 20 years to be a period during which that person was both resident and present in New Zealand, but only periods of insurance relating to periods over the age of 50 years shall be taken into account to meet the residential requirements for New Zealand superannuation which state that a person must be resident in New Zealand for 5 years over age 50;

    • b) in the case of any other benefit, deem a Netherlands period of insurance accumulated by that person after attaining the age of 20 years to be a period during which that person was both resident and present in New Zealand.

  • 2 For purposes of paragraph 1, if a period of residence in New Zealand and a Netherlands period of insurance coincide, the period of coincidence shall be taken into account only once as a period of residence in New Zealand.

  • 3 In determining whether a person who is ordinarily resident in New Zealand or the Netherlands is entitled to receive a widows benefit or a domestic purposes benefit paid to a widower, a dependent child of that person born in the Netherlands shall be treated as though that child was born in New Zealand provided that:

    • a) in the case of a widow, the child was conceived before the death of the person's last deceased spouse; and

    • b) the case of a widower, the child was born before the death of the person's last deceased spouse.

  • 4 In determining whether a widow who is ordinarily resident in New Zealand or the Netherlands is entitled to receive a widow's benefit:

    • a) that widow shall be deemed to have accumulated a period of New Zealand residence for any period during which her last deceased spouse accumulated a period of insurance under Netherlands social security laws;

    • b) any period during which that widow and her last deceased spouse both accumulated a Netherlands period of insurance under the Netherlands social security laws shall be taken into account once only; and

    • c) a Netherlands period of insurance accumulated under the Netherlands social security laws by that widow's last deceased spouse shall be deemed to be a period during which that spouse was ordinarily resident in New Zealand for the purposes of determining the ordinary residence of that spouse; and

    • d) if the death of the last deceased spouse of a widow occurs in the Netherlands, he shall be deemed to have died in New Zealand.

Article 8. Rate of New Zealand Superannuation and Veterans' Pensions in the Netherlands

If a person who is ordinarily resident in the Netherlands is entitled to receive New Zealand superannuation or a veteran's pension under Article 6, the amount of that benefit shall be calculated in accordance with the following formula: number of whole months residence in New Zealand/Y x maximum benefit rate

where ``Y" equals:

480 if the person was born before 1 April 1932;

492 if the person was born between 1 April 1932 and 30 June 1932;

495 if the person was born between 1 July 1932 and 30 September 1932;

498 if the person was born between 1 October 1932 and 31 December 1932;

501 if the person was born between 1 January 1933 and 31 March 1933;

504 if the person was born between 1 April 1933 and 30 June 1933;

507 if the person was born between 1 July 1933 and 30 September 1933;

510 if the person was born between 1 October 1933 and 31 December 1933;

513 if the person was born between 1 January 1934 and 31 March 1934;

516 if the person was born between 1 April 1934 and 30 June 1934;

519 if the person was born between 1 July 1934 and 30 September 1934;

522 if the person was born between 1 October 1934 and 30 December 1934;

525 if the person was born between 1 January 1935 and 31 March 1935;

528 if the person was born between 1 April 1935 and 30 June 1935;

531 if the person was born between 1 July 1935 and 30 September 1935;

534 if the person was born between 1 October 1935 and 31 December 1935;

537 if the person was born between 1 January 1936 and 31 March 1936;

540 if the person was born after 31 March 1936;

subject to the following provisions:

  • a) in determining the number of whole months residence in New Zealand, only residence after attaining the age of 20 years shall be taken into account;

  • b) all periods of residence in New Zealand since attaining the age of 20 years shall be aggregated;

  • c) the maximum benefit rate shall be:

    • (i) in the case of a single person, the maximum rate of benefit payable under the legislation of New Zealand to a single person who is not living alone; and

    • (ii) in the case of a married person, the maximum rate of benefit payable under the legislation of New Zealand to a married person whose spouse also qualifies for New Zealand superannuation or a veteran's pension;

  • d) in relation to a person who reached the age of 65 prior to the date that this Agreement came into force, that person has resided in New Zealand, at any time, for at least 10 years;

  • e) if a person who became or becomes ordinarily resident in the Netherlands after 1 April 1990 was entitled to receive New Zealand superannuation or a Veteran's pension at the date of departure from New Zealand and is entitled to receive that benefit as a result of Article 6, but not as a result of Article 7, the amount of that benefit shall be not less than the amount that would be paid in the absence of this Agreement;

  • f) in no case shall the rate of benefit exceed 100% of the maximum benefit rate;

  • g) no account shall be taken of any benefit which is also payable under the Netherlands social security laws or any benefit or pension payable under the social security laws of a third country.

Article 9. Rate of New Zealand Widows' Benefits, Domestic Purposes Benefits Paid to Widowers and Invalids' Benefits in the Netherlands

If a person who is ordinarily resident in the Netherlands is entitled to receive a widow's benefit, a domestic purposes benefit paid to a widower or an invalid's benefit as a result of Article 6, the amount of that benefit shall be calculated in accordance with the following formula: the number of whole months resident in New Zealand/300 months x maximum bene-fit rate

subject to the following provisions:

  • a) in determining the number of whole months residence in New Zealand, only residence in New Zealand since attaining the age of 20 years shall be taken into account;

  • b) all periods of residence in New Zealand since attaining the age of 20 years shall be aggregated;

  • c) the maximum amount of benefit payable shall be the maximum rate of benefit which that person would be entitled to receive under the legislation of New Zealand;

  • d) in no case shall the rate of benefit exceed 100% of the maximum benefit rate; and

  • e) no account shall be taken of any benefit which is also payable under the Netherlands social security laws, the Disablement Assistance Act for Handicapped Young Persons, or any pension or benefit payable under the social security laws of a third party.

Article 10. Payment of Supplementary Benefits and Allowances

  • 1 If a person who is ordinarily resident in New Zealand becomes entitled to receive a New Zealand benefit under Article 7, the institution of New Zealand shall also pay to that person any supplementary benefit or allowance under the legislation of New Zealand for which that person is qualified.

  • 2 If a person who is ordinarily resident in the Netherlands becomes entitled to receive a New Zealand benefit under this Agreement, the amount of that benefit shall not include any supplementary benefit or allowance which would be payable under the legislation of New Zealand if that person were ordinarily resident in New Zealand.

Article 11. Residence in a Third State

A person who:

  • a) is ordinarily resident in New Zealand;

  • b) is entitled to receive a benefit solely through the application of the totalising provisions of Article 7; and

  • c) either:

    • (i) departs New Zealand with the intention of residing in a third State for a period which exceeds 26 weeks, or;

    • (ii) resides in a third State for a period which exceeds 26 weeks;

shall not be entitled to receive New Zealand superannuation or a veteran's pension while outside New Zealand or the Netherlands unless he or she is entitled to receive that benefit under a Social Security Agreement which New Zealand has entered into with that third State.

Article 12. Effect of Netherlands Taxation of Netherlands Pensions

If a person who is ordinarily resident in New Zealand, is receiving a Netherlands pension and a New Zealand benefit, for the purposes of calculating the New Zealand benefit rate, any taxes levied under Netherlands tax legislation shall be excluded from the amount of the Netherlands pension to be deducted from the New Zealand benefit, unless that person elects otherwise.

Article 13. Treatment of Netherlands Voluntary Insurance

Netherlands benefits based on periods of voluntary insurance under the social security laws of the Netherlands shall not be directly deductible from New Zealand benefits under the social security laws of New Zealand.

B. PROVISIONS RELATING TO THE NETHERLANDS BENEFITS

Article 14. Sickness Insurance

  • 1 The Netherlands institution shall determine the sickness benefit in accordance with the Netherlands Sickness Benefits Act (ZW).

  • 2 A New Zealand resident who would be entitled to receive a Netherlands sickness benefit if he or she was resident in the territory of the Netherlands, shall be entitled to receive a Netherlands sickness benefit at the same rate as he or she would be entitled to receive if he or she was resident in the Netherlands.

Article 15. Old Age Benefits

  • 1 The Netherlands institution shall determine the old age benefit on the basis of periods of insurance completed under the Netherlands General Old Age Pensions Act and of this Agreement.

  • 2 Subject to paragraphs 3 and 4, periods before 1 January 1957, during which a national of a Contracting Party resided in the territory of the Netherlands after reaching the age of fifteen years or during which, while residing in another country the person was remuneratively employed in the territory of the Netherlands, shall also be considered as periods of insurance if the person does not satisfy the conditions of the Netherlands legislation permitting such periods to be treated for that person as periods of insurance.

  • 3 The period referred to in paragraph 2 shall be taken into consideration in the calculation of the old age benefit only if the person concerned has been insured under the Netherlands General Old Age Pensions Act and has resided for at least six years in the territory of one or both Contracting Parties after reaching the age of fifty-nine years and only while the person is residing in the territory of either Contracting Party. However, the periods before 1 January 1957, shall not be taken into consideration if they coincide with periods taken into consideration for the calculation of an old age benefit under the legislation of a country other than the Netherlands.

  • 4 Where the sum of the amount of the Netherlands old age benefit according to this Agreement or according to the Netherlands General Old Age Pensions Act, exclusive of income-related supplementary allowance and holiday allowance as defined in Article 8, section 1 or Article 28 of that Act respectively, and the amount of the New Zealand superannuation or veterans' pension under this Agreement or New Zealand legislation for a person who resides in the Netherlands, exceeds the maximum amount according to the Netherlands General Old Age Pensions Act, exclusive of income-related supplementary allowance and holiday allowance as defined in Article 8, section 1 or Article 28 of that Act respectively, the Netherlands institution shall adjust its benefit by an amount equal to the excess amount.

  • 5 Changes in the exchange rate shall not affect the amount calculated according to the previous section, provided that a conversion takes place at least once a year, using the exchange rate parity as advised by the Bank of the Netherlands (De Nederlandsche Bank NV) on the day of the payment of the New Zealand benefit for the month in which the recalculation takes place.

  • 6 The reduction referred to in paragraph 4 shall not affect the amount that is based on periods of insurance after 1 January 1957, according to the Netherlands General Old Age Pensions Act.

  • 7 A New Zealand resident who would be entitled to receive a Netherlands old age benefit if he or she was resident in the territory of the Netherlands, shall be entitled to receive a Netherlands old age benefit at the same rate as he or she would be entitled to receive if he or she was resident in the Netherlands.

Article 16. Survivors Benefits

  • 1 The Netherlands institution shall determine the survivors benefit on the basis of the Netherlands General Survivors Insurance Act and this Agreement.

  • 2 A New Zealand resident who would be entitled to receive a Netherlands survivor's benefit if he or she was resident in the territory of the Netherlands, shall be entitled to receive a Netherlands survivor's benefit at the same rate as he or she would be entitled to receive if he or she was resident in the Netherlands.

  • 3 A person who is resident in the territory of the Netherlands shall be entitled, in respect of his or her children who stay or reside in the territory of New Zealand, to the orphans' pension of the Netherlands as if those children live in the territory of the Netherlands.

Article 17. Invalidity Benefits

  • 1 The Netherlands institution shall determine the invalidity benefit in accordance with the Netherlands Disablement Insurance Act and this Agreement.

  • 2 A New Zealand resident who would be entitled to receive a Netherlands invalidity benefit if he or she was resident in the territory of the Netherlands, shall be entitled to receive a Netherlands invalidity benefit at the same rate as he or she would be entitled to receive if he or she was resident in the Netherlands.

Article 18. Children's Allowances

  • 1 The Netherlands institution shall determine the children's allowances in accordance with the Netherlands General Child Benefits Act and this Agreement.

  • 2 A person who is resident in the territory of New Zealand shall be entitled, in respect of his or her children who stay or reside in the territory of the Netherlands or New Zealand, to the children's allowances of the Netherlands as if that person and those children all resided in the Netherlands.

  • 3 A person who is resident in the territory of the Netherlands shall be entitled, in respect of his or her children who stay or reside in the territory of New Zealand, to the children's allowances of the Netherlands as if those children resided in the territory of the Netherlands.

C. COMMON PROVISIONS RELATING TO BENEFIT PAYMENTS

Article 19. Assessment of Income Tests

  • 1 Where a Contracting Party pays a benefit to a person residing in the territory of the other Contracting Party, that Contracting Party will disregard any income tested benefit paid to that person or the spouse of that person by the other Contracting Party.

  • 2 Where a person has incurred social security debts in both the Netherlands and New Zealand by virtue of the fact that the 1990 Agreement conferred on that person an entitlement to a higher rate of Netherlands old age benefit than would otherwise be payable, and the Netherlands company pension fund reimburses New Zealand for half of the debt incurred by that fund due to the same higher old age benefit entitlement, the Government of New Zealand shall write off the remainder of its debts of that person incurred by reason of that same higher entitlement and pay the debtor any amount that exceeds the difference between half the original New Zealand debt due to that same higher entitlement and the amount reimbursed by the Netherlands company pension fund and/or the amount of that original debt already repaid by the debtor to the New Zealand Government.

Part III. Mutual assistance

Article 20. Exchange of Information

  • 1 The competent authorities shall communicate to each other any information necessary for the application of this Agreement or of the respective social security laws of the Contracting Parties concerning all matters arising under this Agreement or under those laws.

  • 2 The institutions shall on request:

    • a) provide each other with any information in their possession or that they are lawfully able to obtain required for the determination or payment of any benefit or pension under this Agreement or any other entitlement under their respective social security laws;

    • b) provide each other with any information in their possession or that they are lawfully able to obtain required for the recovery of any social security debt under this Agreement or relating to any other entitlement under their respective social security laws;

    • c) provide each other with any information in their possession or that they are lawfully able to obtain required for the determination or recovery of any taxes or contributions levied in relation to social security.

  • 3 If an institution does not hold information requested by the other institution but that information is held by the tax authorities in the State of the institution receiving the request, the latter institution shall obtain the information from the tax authorities for the requesting institution.

  • 4 An institution that receives information under paragraphs 2 or 3 may provide that information to the tax authorities of that Party for the purposes of making an assessment of the tax due by any person under the laws of the requesting Party relating to taxation or detecting tax fraud or tax evasion under the laws of the requesting Party.

  • 5 An institution, if so requested, shall supply the institution of the other Party with any information required by that institution to answer any questions or to make any report or return required by a person or body authorised to monitor compliance with that Party's privacy laws.

  • 6 The administrative arrangements referred to in Article 29 shall specify the conditions and procedures for determining the arrangement that the parties shall comply with when requesting or supplying information under this Article. The administrative arrangements shall:

    • a) include provisions that ensure, in relation to New Zealand, that the safeguards that are required under New Zealand privacy laws in information matching agreements are complied with and that the arrangements are consistent with the information matching rules under New Zealand privacy laws;

    • b) list the items of information that each Party may request under this Article;

    • c) limit the supply of information to the items listed in accordance with subparagraph b).

  • 7 The assistance referred to in paragraph 2 or 3 shall be provided free of charge.

  • 8 Any information transmitted in accordance with this Agreement to an institution shall be given the same protections (including privacy protection) in the same manner as information obtained under the social security laws of the receiving Party.

  • 9 A Party that receives, under this Article, personal information about an individual from the other Party may not supply that information to any other country without the consent of the competent institution that supplied the information or the individual concerned.

Article 21. Administrative Checks and Medical Examinations

  • 1 On request in accordance with Article 20, the institution of a Contracting Party, within the limits laid down by their legislation, shall provide the liaison body or the institution of the other Contracting Party with any available medical information and documentary evidence of the sickness, injury, or disability of a person claiming or receiving a benefit payable on the grounds of sickness, injury, or disability under this Agreement.

  • 2 The institutions may request each other to carry out administrative checks and medical examinations of claimants or recipients of their respective benefits to ascertain their eligibility for a benefit.

Article 22. Assistance in Recovery

  • 1 For the purposes of this Article:

``requesting institution" means an institution requesting assistance in the recovery of a social security debt;

``requested institution" means an institution requested to assist in the recovery of a social security debt; and

``social security debt" means a debt incurred under the social security laws of a Contracting Party and, in relation to the Netherlands, includes a debt relating to taxes or contributions levied for social security purposes.

  • 2 At the request of the requesting institution, the requested institution shall recover social security debts of the requesting institution in accordance with the law and administrative practice for the recovery of its own social security debts. However such claims for social security debts do not enjoy any priority in the State of the requested institution and cannot be recovered by imprisonment for debt of the debtor. Nor is the requested institution obliged to take any executory measures that are not provided for in the laws of the State of the requesting institution.

  • 3 The provisions of paragraph 2 shall apply only to a social security debt where the chief executive officer of the requesting institution issues a certificate that certifies that:

    • a) the amount of the debt in the currency of both the State of the requesting institution and of the requested institution;

    • b) the debt is a social security debt;

    • c) the provisions of paragraph 5a) have been complied with;

    • d) the provisions of paragraph 6 have been complied with;

    • e) the enforcement of the social security debt is permitted in the State of the requesting institution and citing the relevant legislation authorising its enforcement;

    • f) the request does not contravene the provisions of paragraph 7; and

    • g) any right of review or appeal of the debt under the social security laws of the requesting Party has been exhausted or has expired. For the purposes of this subparagraph a right of review or appeal has expired:

      • (i) if the right has not been exercised within the time limit provided for its exercise; and

      • (ii) irrespective of whether the court or tribunal or body or person that would have jurisdiction in respect of the review or appeal, or any other person, retains a discretion (however expressed in those laws) to allow the right of review or appeal to be exercised after that time.

  • 4 The obligation to provide assistance in the recovery of social security claims concerning a deceased person or that person's estate is limited to the value of the estate or the property acquired by each beneficiary of the estate, according to whether the claim is to be recovered from the estate or from the beneficiaries thereof.

  • 5 The requested institution shall not be obliged to take action with respect to the request:

    • a) if the requesting institution has not pursued all means available in its own territory, except where recourse to those means would give rise to disproportionate difficulty; or

    • b) if and insofar as it considers the claim for the social security debt to be contrary to the provisions of this Agreement or of any other Agreement to which both the Contracting Parties are parties.

  • 6 The institutions may specify a minimum amount of social security debt that may be recovered under the provisions of this Article in the administrative arrangements made in accordance with Article 29.

  • 7 Issues concerning any period limiting the time in which a social security debt can be enforced shall be governed by the law of the requesting State but the requested country shall not commence action to recover a social security debt if more than 5 years have passed since the debt was first assessed.

  • 8 The request for administrative assistance in the recovery of a social security debt shall be accompanied by:

    • a) a certification under paragraph 3;

    • b) any other document required for recovery;

    • c) where appropriate a certified copy of any related decision issued by a court or an administrative body.

  • 9 The rate of exchange to be used for determining the amount of a social security debt in the currency of the State of the requested institution shall be the telegraphic transfer selling rate settled in the State of the requesting institution on the date the certification is made.

  • 10 If the debtor exercises a right or review or appeal of a debt after a request for its recovery is made under paragraph 2:

    • (a) the requesting institution shall immediately advise the requested institution of the exercise of the right; and

    • (b) the requested institution shall:

      • (i) defer recovery of the debt until notified by the requesting institution that the review or appeal is finally determined; and

      • (ii) take measures to conserve any funds it holds that are attributable to the debtor with a view to recovery of the debt after such notification is received.

  • 11 Acts of recovery carried out by the requested institution, pursuant to a request for assistance that would have the effect of suspending or interrupting any period referred to in paragraph 7 shall also have this effect under the laws of the State of the requesting institution. The requested institution shall inform the requesting institution of any instances where this situation occurs.

  • 12 The requested institution or the courts or administrative bodies of the State of the requested institution may allow for payments to be deferred or made by instalments if permitted in similar circumstances under the laws or administrative practices of that institution or State. The requested institution shall inform the requesting institution of any such decision.

  • 13 The requesting institution shall pay the reasonable costs of any acts of recovery and the requested institution shall advise the requesting institution of the estimated costs on receiving a request and before taking any action for the recovery of the social security debt.

  • 14 The requesting institution shall be responsible for any pecuniary consequences incurred as a consequence of acts of recovery that are found to be unjustified with regard to the validity of the social security debt.

  • 15 An amount recovered by the requested institution under the provisions of this Article, less any amounts deductible under paragraphs 13 or 14 shall be transferred to the requesting institution in the currency of the State of the requested institution.

Article 23. Recovery of Overpayments

  • 1 Where an amount paid by one of the Contracting Parties to a person in respect of a benefit exceeded the amount if any, that was properly payable, whether by virtue of this Agreement or otherwise, in respect of that benefit the institution of that other Contracting Party shall, if requested in accordance with Article 22 by the other institution to do so, and in accordance with this Article and Article 22, deduct the amount equivalent to the excess payment referred to above from the amount due in respect of the last mentioned benefit.

  • 2 The amount of an excess payment referred to in paragraph 1 shall be the amount determined by the institution of the Contracting Party by whom the excess payment was made.

  • 3 The rate of deductions made in accordance with paragraph 1 from amounts due in respect of a benefit, and any incidental or related matters, shall be determined by the institution of the Contracting Party by whom the benefit is payable, in accordance with the social security laws or administrative practice of that Contracting Party.

  • 4 Any amount deducted by the institution of one of the Contracting Parties in accordance with paragraph 1 and any amounts received by that institution under paragraph 3 shall be remitted to the other institution as agreed between the institutions or in administrative arrangements made pursuant to Article 29.

Article 25. Refusal to Pay, Suspension or Termination of a Benefit

An institution of a Contracting Party may refuse to pay, suspend or terminate a benefit otherwise payable if that institution considers that a claimant or a recipient or the institution of the other Contracting Party fails to provide sufficient information promptly or to undergo, or as the case may be, carry out, any examination as required under this Agreement.

Part IV. Miscellaneous provisions

Article 26. Lodgment of Claims

  • 1 An application duly lodged for a benefit under the legislation of one of the Contracting Parties shall be regarded as an application duly lodged under the legislation of the other Contracting Party.

  • 2 The date of receipt of any application or other document submitted to one competent authority or institution shall be regarded as the date of receipt of such application or other document by the other competent authority or institution. The application or document shall be transmitted without delay to the institution of the other Contracting Party.

Article 27. Determination and Commencement of Claims

  • 1 The commencement date for payment of a benefit payable by virtue of this Agreement shall be determined in accordance with the social security laws of the Contracting Party concerned but in no case shall commence earlier than the date on which this Agreement enters into force.

  • 2 Any period of insurance, residence or remunerative employment completed before the date of entry into force of this Agreement shall be taken into account for the purpose of determining the right to a benefit under this Agreement.

Article 28. Appeals

  • 1 Any person affected by a decision of the competent authority or institution of a Contracting Party, in relation to a matter arising by virtue of this Agreement, shall have the same rights to a review by or appeal to, administrative or judicial bodies of that Contracting Party, as provided for under the domestic laws of the Contracting Party.

  • 2 Documents relating to reviews or appeals that may be made to administrative or judicial bodies established by the social security laws of one of the Contracting Parties may be lodged in the territory of the other Contracting Party, and any documents duly lodged in that manner shall be regarded as duly lodged for the purposes of those laws.

  • 3 The date on which a document is duly lodged in the territory of one of the Contracting Parties in accordance with paragraph 2 shall determine whether that document is lodged within any time limit specified by the laws or administrative practices of the other Contracting Party which govern the appeal concerned.

Article 29. Administrative Arrangements

The competent authorities of the Contracting Parties shall establish by means of an administrative arrangement the measures necessary for the implementation of this Agreement.

Article 30. Language of Communication

The competent authorities and institutions may correspond directly with the other and with any person wherever that person may reside whenever it is necessary for the application of this Agreement. The correspondence may be in English or the Netherlands language.

Article 31. Currency

  • 1 Payments under this Agreement may be made validly in the currency of the Contracting Party making the payment.

  • 2 Money transfers made under this Agreement shall be made in accordance with any relevant arrangements in force between the Contracting Parties at the time of transfer.

  • 3 In the event that provisions designed to restrict the exchange or exportation of currencies are introduced by either Contracting Party, the Governments of both Contracting Parties shall immediately decide on the measures necessary to ensure the transfer of sums owed by either Contracting Party or institution under this Agreement.

Article 32. Settlement of Disputes

  • 1 The competent authorities of the Contracting Parties shall settle, to the extent possible, any disputes that arise in interpreting or applying this Agreement according to its spirit and fundamental principles.

  • 2 The Contracting Parties shall consult promptly at the request of either concerning matters which have not been settled by the competent authorities in accordance with paragraph 1.

  • 3 If the dispute has not been settled within six months following the first consultation prescribed in paragraph 2 of this Article, it shall be submitted to an arbitral tribunal whose composition and procedure shall be agreed upon by the Contracting Parties. The arbitral tribunal shall settle the dispute according to the fundamental principles and in the spirit of the present Agreement. The decision by the arbitral tribunal shall be by majority vote and shall be final and binding upon the Contracting Parties.

Article 33. Review of the Agreement

The Contracting Parties may agree at any time to review any of the provisions of this Agreement to review and report to the competent authorities on the operation and effectiveness of the Agreement.

Article 34. Transitional Provisions

Any person who is in receipt of a New Zealand benefit by virtue of Article 7, Article 8 or Article 9 of the 1990 Agreement at the date of termination of that Agreement, shall continue to be entitled to receive that benefit at the rate provided under the 1990 Agreement but a person who is in receipt of New Zealand superannuation at the rate payable to a person who has a spouse who does not qualify for New Zealand superannuation in his or her own right, shall cease to be entitled to that rate when his or her spouse reaches the age of 65 years.

Article 35. Entry into Force and Termination

  • 1 Both Contracting Parties shall notify each other in writing of the completion of their respective statutory and constitutional procedures required for the entry into force of this Agreement. The Agreement shall enter into force on the first day of the second month following the date of the last notification.

  • 2 The Kingdom of the Netherlands shall apply this Agreement provisionally from the first day of the second month following signature and, for the Kingdom of the Netherlands, this Agreement shall enter into force on the understanding that Articles 2(1)b), 14, 15(7), 16, 17 and 18 shall have retrospective effect to 1 January 2000.

  • 3 Subject to paragraph 4, this Agreement shall remain in force until the expiration of 12 months from the date on which either Contracting Party receives from the other written notice through the diplomatic channel of the intention of the other Party to terminate the Agreement.

  • 4 In the event that this Agreement is terminated in accordance with paragraph 3, the Agreement shall continue to have effect in relation to all persons whom by virtue of this Agreement:

    • a) at the date of termination, are in receipt of benefits or pensions; or

    • b) prior to the expiry of the period referred to in that paragraph, gave lodged claims for, and would be entitled to receive benefits or pensions.

IN WITNESS WHEREOF, the undersigned, being duly authorised thereto by their respective Governments, have signed this Agreement.

Administrative Arrangement

Pursuant to Article 29 of The Agreement on Social Security between

The Government of the Netherlands

and

The Government of New Zealand

signed at The Hague on 30 June 2000

PART I. GENERAL PROVISIONS

Section 1. Definitions

  • 1 For the application of this Administrative Arrangement ``Agreement” means the Agreement on Social Security between the Government of New Zealand and the Government of the Netherlands, signed at The Hague on 30 June 2000.

  • 2 Authorised information matching means: the comparison of any document, whether by manual or electronic means, that contains personal information with one or more other documents that contain personal information for the purpose of producing or verifying information about an identifiable individual.

  • 3 Other terms will have the meaning given to them in the Agreement or in this Arrangement.

Section 2. Liaison Bodies

  • 1 For the application of the Agreement, the following are designated as Liaison Bodies:

    • A. in the Netherlands

      • (a) for old age and survivors' benefits and children's allowances;

      • Sociale verzekeringsbank (Social Insurance Bank), Amstelveen

      • (b) for sickness and invalidity benefits;

      • Uitvoeringsinstituut werknemersverzekeringen (Institute for Employee Benefits), Amsterdam;

    • B. in New Zealand

      International Services of Work and Income, Ministry of Social Development, Wellington.

  • 2 The duties of the Liaison Bodies are stated in this Arrangement. For the application of this Agreement and Administrative Arrangement, the Liaison Bodies may communicate directly with each other as well as with the persons concerned or their representatives. The Liaison Bodies will assist each other in the application of the Agreement.

PART II. PROVISIONS CONCERNING SECONDMENT

Section 3. Certificates of Secondment

  • 1 For the purpose of this Section, ``institution" means the Sociale verzekeringsbank (Social Insurance Bank), Amstelveen.

  • 2 Where Article 5 of the Agreement applies, the Netherlands Institution will, at the request of the employed person or his or her employer, issue a certificate stating that, as long as the employed person fulfils the conditions laid down in Article 5 of the Agreement, the employed person remains subject to the Netherlands legislation until the date indicated on the certificate.

  • 3 In the event of an extension in accordance with Article 5 of the Agreement, the Netherlands Institution again issues a certificate of secondment.

  • 4 The certificates referred to in the previous paragraphs will be proof that the Netherlands Institution authorises the secondment.

  • 5 The Netherlands Institution will send copies of a certificate issued under paragraph 2 or 3 to the employed person and to his or her employer.

PART III. PROVISIONS CONCERNING APPLICATIONS AND APPEALS

Section 4. Applications

  • 1 In the application of the Agreement, a claim for a benefit under the Agreement may be presented to the Liaison Body of either Contracting Party whose legislation applies.

  • 2 When a claim for a benefit referred to under paragraph 1 is presented to a Liaison Body, that Liaison Body will send the claim to the Liaison Body of the Contracting Party whose legislation is applicable, along with supporting documents necessary to establish the claimant's eligibility for that benefit.

  • 3 In the case of New Zealand, the documentary evidence will include, as the circumstances require:

    • a) a certified copy of the claimant's identification such as passport, birth certificate, marriage certificate or drivers license;

    • b) verification of the Netherlands pension reference number and/or social fiscal number of the claimant, his or her spouse and dependent children;

    • c) a copy of the birth certificate of each dependent child;

    • d) a copy of the death certificate of the claimant's spouse;

    • e) verification produced by the claimant of his or her Netherlands or New Zealand bank account number, the name of the bank, the location of the bank and the name of the account.

  • 4 In the case of the Netherlands, the documentary evidence will include, as the circumstances require:

    • (i) a certified copy of the claimant or recipient's identity such as a passport or drivers license;

    • (ii) marriage certificate;

    • (iii) decree nisi (attestation of divorce);

    • (iv) wage slip or tax assessment certificate;

    • (v) life certificate;

    • (vi) medical data held by the New Zealand institute.

  • 5 All documentary evidence will be date stamped by the Contracting Party receiving the claim on the date of receipt.

  • 6 The Liaison Body of New Zealand will indicate on the liaison form any requirement to withhold arrears in terms of Article 23 of the Agreement; and the Liaison Body of the Netherlands will remit the arrears that have been held immediately after a decision to grant the benefit has been made.

  • 7 Any payment of arrears made by the Liaison Body of the Netherlands will be deposited in a bank account nominated by the Liaison Body of New Zealand.

  • 8 As soon as a decision on a claim for benefit has been reached, the Liaison Body of the Contracting Party whose legislation applies, will notify the claimant giving information about review and appeal procedures and the time related limits set down by that legislation; the Liaison Body will also advise the Liaison Body of the other Contracting Party of the details of the decision, by means of a liaison form.

  • 9 When requested, the Liaison Body of a Contracting Party, within the conditions and limits laid down under its own legislation, will provide verification of details of the income for a claimant and of that claimant's spouse or partner or dependent child for a benefit payable under the legislation of the other Contracting Party.

  • 10 The Liaison Bodies will inform each other by means of a liaison form of the award, revision, suspension or withdrawal of pensions or benefits under the Agreement.

Section 5. Appeals and Related Documents

A Competent Authority or Liaison Body that receives appeals and related documents under the legislation of the other Contracting Party will:

  • a) Stamp on each document the date of receipt;

  • b) Record the receipt of each document by its own Liaison Body; and

  • c) Send the documents as soon as possible to the Liaison Body of the other Contracting Party.

Section 6. Claims Under Other Agreements

  • 1 A Liaison Body will accept on behalf of the other Liaison Body, a claim for a benefit under an agreement on social security that the Contracting Party of the latter Liaison Body has entered into with a third State; will stamp that claim with the date of receipt; and send it to the other Liaison Body as soon as possible.

  • 2 A Liaison Body that has received an application under paragraph 1 may request specific assistance from the other Liaison Body in regard to the determination of that claim and the other Liaison Body will provide, to the extent practicable, the same degree of assistance as if the claim were made under the Agreement.

Section 7. Exchange of Information

  • 1 Except as provided in this section, where a Competent Authority or Liaison Body requests information under Article 20 of the Agreement, the Competent Authority or Liaison Body so requested will supply that information in as timely a manner as possible.

  • 2 The Liaison Bodies of both Contracting Parties will exchange information of the changes in pension amounts to be paid to each recipient of a benefit and of the effective date and the new amount payable as soon as possible after those changes are known in the manner agreed in writing, from time to time, between the Liaison Bodies.

  • 3 The Liaison Bodies will provide each other in the manner agreed in writing, from time to time, with information on changes in circumstances of benefit recipients that may affect entitlement to a benefit paid by the other Contracting Party.

  • 4 Except in relation to paragraphs 2 and 3 of this Section, where a Liaison Body requests personal information under Article 20 of the Agreement that constitutes an authorised information matching programme under the privacy laws of either Contracting Party:

    • a) the requesting Liaison Body will inform the other Liaison Body of the purpose for which the data is requested;

    • b) each Liaison Body will produce a report for the other Contracting Party on the Privacy Laws in force in its jurisdiction that may affect the exchange of information;

    • c) the Liaison Bodies will exchange technical reports on the exchange of data;

    • d) the Liaison Bodies will provide each other with any information requested by their respective privacy authorities.

  • 5 Requests for information made under Article 20 of the Agreement that constitutes an authorised information matching programme under the privacy laws of either Contracting Party, shall be limited to:

    • a) four requests per annum by each Liaison Body; and

    • b) one request for income details per tax year.

  • 6 If a request for information made under Article 20 of the Agreement constitutes an authorised information matching programme under the privacy laws of either Contracting Party, the information that the Liaison Body of New Zealand may request from the Liaison Body of the Netherlands, as circumstances require, is:

    • a) Netherlands' pension reference number;

    • b) benefit or pension type;

    • c) nationality;

    • d) marital status;

    • e) duration of marriage, in the case of widows and widowers;

    • f) maiden name and married surname, in the case of women;

    • g) residential status i.e. living alone or sharing accommodation;

    • h) spouse reference number;

    • i) spouse date of birth;

    • j) spouse date of death and place of death;

    • k) names and birth dates and place of birth of dependent children including those between 16 and 18 years who are still at school;

    • l) date of grant of Netherlands pension;

    • m) rate of benefit or pension payable, including increases in payment and amounts based upon voluntary contributions;

    • n) income details of the claimant or recipient and their spouse or partner and their dependent children, including income generated from assets;

    • o) periods of contributions and/or residence in the Netherlands;

    • p) periods of contributions and/or residence in a third State, where known;

    • q) details of pensions from a third State, where known;

    • r) bank account details;

    • s) executors of estates;

    • t) medical reports;

    • u) address;

    • v) name and address of employer.

  • 7 If a request for information made under Article 20 of the Agreement constitutes an authorised information matching programme under the privacy laws of either Contracting Party, the information that the Institution of the Netherlands may request from the Institution of New Zealand, as circumstances require, is:

    • a) New Zealand pension reference number;

    • b) benefit or pension type;

    • c) marital status;

    • d) date of marriage;

    • e) date of divorce;

    • f) residential status i.e. living alone or sharing accommodation;

    • g) spouse date of birth;

    • h) spouse date of death;

    • i) names, birth dates and place of birth of dependent children;

    • j) income details of the claimant or recipient and their spouse or partner and their dependent children;

    • k) medical reports;

    • l) full time enrolment at secondary or tertiary institution of dependent child (if known);

    • m) name and address of employer.

  • 8 Provided that the Contracting Parties have obtained any necessary consents from their respective Privacy Authorities, the Contracting Parties may agree in writing to add, amend or delete items from the lists in paragraph 6 and 7 of this Section provided that the additions, amendments or deletions have any necessary consents of the privacy authorities of either Contracting Party.

  • 9 In respect of any request for information that constitutes an authorised information matching programme under the privacy laws of New Zealand, no information shall be exchanged if the consent of the New Zealand Privacy Authorities is withheld.

  • 10 The Liaison Bodies will exchange statistics regarding the payments each has made to recipients of benefits residing in the territory of the other Contracting Party upon request. The statistics will include data on the number of benefit recipients and the total number of benefits identified by benefit types.

Section 8. Recovery of Debts

  • 1 For the implementation of Article 22 of the Agreement, the requesting Liaison Body will send the requested Liaison Body the documentation required under that Article, together with the name, date of birth and address, where known, of the debtor and, if required, the same details for any other person against whom the debt is to be recovered.

  • 2 Except for the arrears mentioned in Section 4 (6) of this Arrangement, each Liaison Body will advise the other Liaison Body of any overpayment that it has made in the terms of Article 23 of the Agreement, as and when those payments occur, on a liaison form giving the name, address and date of birth of the person in respect of whom the overpayment was made and the amount of the overpayment for which reimbursement is requested and any other documents required for recovery in accordance with the social security laws or administrative practice of that Contracting Party.

  • 3 During December of each year, each Liaison Body will reimburse the other Liaison Body for all the overpayments for which reimbursement has been requested, as specified in Section 8 (1) of this Arrangement, during the previous year and, at the same time, will forward to the other Liaison Body a form giving:

    • a) the names, addresses and dates of birth of all persons to whom the overpayments relate;

    • b details of the amounts of each overpayment for which reimbursement was requested by the other Liaison Body; and

    • c) the amounts actually reimbursed in respect of each overpayment.

Section 9. Minimum Recovery Amounts

  • 1 In accordance with paragraph 6 of Article 22 of the Agreement, the minimum amounts to be recovered will be:

    • a) New Zealand $ 500 for social security debts incurred in New Zealand; and

    • b) Euro 250 for social security debts incurred in the Netherlands.

  • 2 The Liaison Bodies from time to time may agree, in writing, to vary the minimum amount of debt to be recovered under the terms of paragraph 6 of Article 22.

Section 10. Reviews and Appeals Process for Debt Recovery

  • 1 Each Liaison Body will provide the other Liaison Body with the relevant legislation which contains the provisions applicable to the recovery of social security debts, review and appeal processes and the time limits specified for such review and appeal processes.

  • 2 The competent Authorities will advise each other by a note in writing through the diplomatic channel of any changes to their review and appeal processes.

PART IV. MISCELLANEOUS PROVISIONS

Section 11. Administrative Checks and Medical Examinations

  • 1 Where the New Zealand Liaison Body requests the Netherlands Liaison Body to undertake administrative checks or medical examinations of claimants or recipients of New Zealand benefits who are resident in the Netherlands, they will be carried out by the Uitvoeringsinstituut werknemersverzekeringen (Institute for Employee Benefits) for sickness and invalidity benefits, and by the Sociale verzekeringsbank (Social Insurance Bank) for old age benefits, survivors' benefits and children's allowances.

  • 2 Where the Netherlands Liaison Body requests the New Zealand Liaison Body to undertake administrative checks and medical examinations of claimants or recipients of Netherlands benefits who reside in New Zealand, they will be carried out at the request of the New Zealand Liaison Body by an agent of that Liaison Body.

  • 3 Where the Institutions of a Contracting Party requires claimants or recipients residing in the territory of the other Contracting Party to undergo an additional medical examination, the Liaison Body of the latter Contracting Party, at the request of the former Contracting Party, will make arrangements for that examination to be carried out in accordance with the provisions it administers.

  • 4 The Netherlands Liaison Body reserves the right to require the claimant or recipient to be examined by a medical practitioner agreed to by the claimant or recipient or, in the case of the Netherlands Liaison Body, to summon the person involved to undergo a medical examination in the territory of the Netherlands.

  • 5 A person to whom paragraph 4 of this Section applies will present him or herself for medical examination. However, if that person considers that he or she is unfit to travel to the territory of the State where he or she has been summoned by a Liaison Body, he or she will inform that Liaison Body immediately and will submit to that Liaison Body a medical statement issued by a medical practitioner designated for this purpose by a Liaison Body. The statement shall include the medical reasons why the person is unfit to travel and the expected duration of that incapacity.

  • 6 The Liaison Body requesting a medical examination shall reimburse the costs of that examination and where a person has been requested to present him or herself in the territory of the Netherlands, the Netherlands shall pay the travel and accommodation expenses of that person.

Section 12. Forms and Procedures

  • 1 The Liaison Bodies will agree on the forms and procedures required to implement the Agreement and this Arrangement.

  • 2 The Liaison Bodies may agree on supplementary administrative procedures for the implementation of this Arrangement.

Section 13. Life Certificates

The Liaison Bodies and Institutions will assist each other with regard to the establishment of the identities of persons in receipt of pensions or benefits, their spouse, partner or dependent child, under the Agreement and in the completion of life certificates issued by the respective Liaison Bodies or Institutions.

Section 14. Language

The Liaison Bodies, where necessary, will assist each other in translating claims and other documents written in their respective official languages.

Section 15. Correspondence

The Institutions will inform each other, by means of the forms referred to in Section 12 of this Arrangement, of the award, revision, suspension or withdrawal of benefits to which the Agreement applies.

Section 16. Transaction Costs

At the discretion and agreement of the Liaison Bodies, benefits may be paid to benefit recipients free from the deduction of transaction costs that may be incurred in paying the benefit.

Section 17. Entry into Effect

This Administrative Arrangement will enter into effect on the date of the entry into force of the Agreement and will have the same period of validity.

Verdrag inzake sociale zekerheid tussen de Regering van het Koninkrijk der Nederlanden en de Regering van Nieuw-Zeeland

De Regering van het Koninkrijk der Nederlanden

en

de Regering van Nieuw-Zeeland,

Geleid door de wens de op 8 oktober 1990 te Wellington tot stand gekomen Overeenkomst inzake sociale zekerheid tussen de Regering van het Koninkrijk der Nederlanden en de Regering van Nieuw-Zeeland uit te breiden en te wijzigen, en

Geleid door de wens de bestaande hartelijke en vriendschappelijke betrekkingen tussen de beide landen te handhaven en te versterken en de betaling van Nederlandse pensioenen in Nieuw-Zeeland en de betaling van Nieuw-Zeelandse pensioenen in Nederland mogelijk te maken ten aanzien van staatsburgers die zich permanent vestigen in het andere land,

Zijn als volgt overeengekomen:

DEEL I. BEGRIPSOMSCHRIJVINGEN EN WERKINGSSFEER

Artikel 1. Begripsomschrijvingen

  • 1 Tenzij het zinsverband anders vereist, wordt in dit Verdrag verstaan onder:

    • a. ``uitkering": voor Nieuw-Zeeland een Nieuw-Zeelandse uitkering of pensioen ingevolge de Social Security Act 1964 of deSocial Welfare (Transitional Provisions) Act 1990 of Deel 1 van de New Zealand Superannuation Act 2001; en voor Nederland: elke uitkering of elk pensioen krachtens de wetten van Nederland, met inbegrip van verhogingen van of aanvullingen op een uitkering of pensioen uit hoofde van deze wetten;

    • b. ``bevoegde autoriteit": met betrekking tot Nieuw-Zeeland, de hoogste bewindsman van het Ministerie van Sociale Ontwikkeling (het Ministerie van Werk en Inkomen) of een gemachtigde plaatsvervanger van de hoogste bewindsman; en met betrekking tot Nederland, de Minister van Sociale Zaken en Werkgelegenheid;

    • ba. "inkomensgetoetste uitkering": elke uitkering waarbij het inkomen van een persoon bepaalt of hij ervoor in aanmerking komt of waarbij het inkomen bepalend is voor de hoogte van de uitkering;

    • c. ``orgaan": met betrekking tot een Verdragsluitende Partij, het orgaan of de organen die verantwoordelijk zijn voor de toepassing van dit Verdrag ten aanzien van die Verdragsluitende Partij;

    • d. ``maand": een kalendermaand, maar waar delen van een maand worden samengevoegd: 30 dagen;

    • e. ``wetten inzake sociale zekerheid": met betrekking tot een Verdragsluitende Partij, de wetten die, met betrekking tot die Verdragsluitende Partij, zijn opgenomen in artikel 2;

    • f. ``Nieuw-Zeeland": uitsluitend Nieuw-Zeeland (en niet de Cook eilanden, Niue en Tokelau); ``Nederland": het Koninkrijk der Nederlanden in Europa;

    • g. ``onderdaan": met betrekking tot Nieuw-Zeeland, een Nieuw-Zeelands staatsburger en, met betrekking tot Nederland, een persoon van de Nederlandse nationaliteit;

    • h. ``Overeenkomst van 1990": de op 8 oktober 1990 te Wellington tot stand gekomen Overeenkomst inzake sociale zekerheid tussen de Regering van Nieuw-Zeeland en de Regering van het Koninkrijk der Nederlanden.

  • 2 Bij de toepassing van dit Verdrag door een Verdragsluitende Partij ten aanzien van een persoon, heeft elke term die niet in dit artikel is omschreven de betekenis die daaraan wordt toegekend in de wetten inzake sociale zekerheid van één van beide Verdragsluitende Partijen, tenzij het zinsverband anders vereist.

Artikel 2. Materiële werkingssfeer

  • 1 De wetgeving die binnen de werkingssfeer van dit Verdrag valt, is:

    • a. wat Nieuw-Zeeland betreft: de Social Security Act 1964 en deSocial Welfare (Transitional Provisions) Act 1990, zoals gewijzigd op de datum van ondertekening van dit Verdrag en Deel 1 van de New Zealand Superannuation Act 2001, en elke wetgeving waardoor een van die wetten op een later tijdstip wordt gewijzigd, aangevuld of vervangen, voorzover die wetten en die wetgeving voorzien in de volgende uitkeringen en de daarmee verband houdende aangelegenheden:

      • i. Nieuw-Zeelands ouderdomspensioen;

      • ii. invaliditeitsuitkeringen;

      • iii. weduwenuitkeringen;

      • iv. uitkeringen aan weduwnaren voor huishoudelijke doeleinden; en

      • v. veteranenpensioen.

    • b. wat Nederland betreft de wetten inzake:

      • i. de ziekteverzekering;

      • ii. de algemene ouderdomsverzekering;

      • iii. de invaliditeitsverzekering voor werknemers en zelfstandigen;

      • iv. de algemene nabestaandenverzekering; en

      • v. de kinderbijslag; en voor de toepassing van artikel 5 tevens de wetten inzake:

      • vi. de werkloosheidsverzekering.

  • 2 Het Verdrag is slechts van toepassing op in het eerste lid omschreven wetgeving. Dit Verdrag is niet van toepassing op verdragen inzake sociale zekerheid die één van beide Verdragsluitende Partijen heeft gesloten met een derde Partij of op wetten of voorschriften tot wijziging van de in het eerste lid van dit artikel omschreven wetgeving om uitvoering te geven aan een dergelijk verdrag.

  • 3 De bevoegde autoriteiten van de Verdragsluitende Partijen stellen elkaar in kennis van de wetgeving waardoor de wetten die binnen de werkingssfeer van dit Verdrag vallen, worden gewijzigd, aangevuld of vervangen, zulks onmiddellijk na de inwerkingtreding van bedoelde wetten.

  • 4 Wat Nederland betreft, is dit Verdrag niet van toepassing op regelingen inzake sociale en medische bijstand.

Artikel 3. Personele werkingssfeer

Tenzij anders is bepaald, is dit Verdrag van toepassing op alle personen op wie de wetten van één of van beide Verdragsluitende Partijen van toepassing zijn, dan wel zijn geweest, alsmede, wat Nederland betreft, op personen die rechten ontlenen aan bedoelde personen.

Artikel 4. Gelijkheid van behandeling

  • 1 In alle gevallen waarin recht op een uitkering krachtens de wetten inzake sociale zekerheid van Nieuw-Zeeland of Nederland geheel of ten dele afhangt van de nationaliteit van een Verdragsluitende Partij, wordt een persoon die onderdaan is van de andere Verdragsluitende Partij, met het oog op een aanspraak op die uitkering, beschouwd als onderdaan van eerstbedoelde Verdragsluitende Partij.

  • 2 De personen op wie dit Verdrag van toepassing is, worden door elk van de Verdragsluitende Partijen gelijk behandeld met betrekking tot de rechten en verplichtingen die uit hoofde van dit Verdrag ontstaan ten aanzien van elke Verdragsluitende Partij.

Artikel 5. Detachering

  • 1 Wanneer een persoon die onder de wetgeving van Nederland valt, in dienst van een werkgever wiens bedrijf op het grondgebied van Nederland is gevestigd, door deze werkgever van dit grondgebied wordt uitgezonden om gedurende een tijdvak dat vermoedelijk niet langer is dan 5 jaar op het grondgebied van Nieuw-Zeeland te werken, kan op die persoon de wetgeving van Nederland van toepassing blijven, alsof hij op het grondgebied van Nederland werkzaam was.

  • 2 Indien de duur van de werkzaamheden vermoedelijk bovengenoemde tijdsduur zal overschrijden, kan op een persoon die onder de wetgeving van Nederland valt en die, in dienst van een werkgever wiens bedrijf op het grondgebied van Nederland is gevestigd, door deze werkgever van dit grondgebied wordt uitgezonden om op het grondgebied van Nieuw-Zeeland te werken, de wetgeving van Nederland van toepassing blijven, alsof hij op het grondgebied van Nederland werkzaam was, indien bijzondere redenen dat rechtvaardigen.

  • 3 Indien de feitelijke duur van de werkzaamheden van de persoon omschreven in het eerste lid wegens onvoorzienbare omstandigheden langer is dan het verwachte tijdvak, kan op die persoon de wetgeving van Nederland van toepassing blijven, alsof hij op het grondgebied van Nederland werkzaam was.

  • 4 Voor de toepassing van de Nederlandse wetgeving wordt een persoon op wie de Nederlandse wetgeving van toepassing was overeenkomstig de bepalingen van dit artikel, geacht op het grondgebied van Nederland te wonen.

  • 5 Overeenkomstig de bepalingen van dit artikel is de Nederlandse wetgeving van toepassing indien de werkgever of de werknemer heeft verzocht om een verklaring van detachering binnen drie maanden na de eerste dag van uitzending of, in het geval bedoeld in het derde lid, vóór het einde van het verwachte tijdvak van uitzending, en deze verklaring aan de belanghebbende is afgegeven.

DEEL II

A. BEPALINGEN BETREFFENDE NIEUW-ZEELANDSE UITKERINGEN

Artikel 6. Woonplaats in Nederland

  • 1 Indien een persoon gerechtigd zou zijn een uitkering te ontvangen krachtens de Nieuw-Zeelandse wetgeving (met inbegrip van een persoon die hiertoe gerechtigd zou zijn ingevolge artikel 7), ware het niet dat hij of zij niet zijn of haar vaste woonplaats in Nieuw-Zeeland heeft op de datum van het aanvragen van die uitkering, wordt die persoon, ten behoeve van die aanvraag, geacht op die datum zijn of haar vaste woonplaats in Nieuw-Zeeland te hebben, mits hij of zij:

    • a. zijn of haar vaste woonplaats in Nederland heeft en op die datum in Nederland of Nieuw-Zeeland verblijft;

    • b. voornemens is voor ten minste 26 weken in Nederland een vaste woonplaats te houden; en

    • c. te eniger tijd in zijn of haar leven in Nieuw-Zeeland gewoond heeft gedurende een ononderbroken tijdvak van ten minste 12 maanden na het bereiken van de leeftijd van 20 jaar.

  • 2 Onder voorbehoud van dit Verdrag wordt, indien een persoon gerechtigd is een uitkering te ontvangen krachtens de wetgeving van Nieuw-Zeeland (met inbegrip van een persoon die daartoe gerechtigd is ingevolge het eerste lid, of ingevolge artikel 7, of beide), maar betaling van die uitkering afhankelijk is van verblijf in Nieuw-Zeeland, die persoon ten behoeve van de betaling van die uitkering geacht te verblijven in Nieuw-Zeeland, mits hij of zij:

    • a. zijn of haar vaste woonplaats heeft in Nederland, en hetzij in Nederland hetzij in Nieuw-Zeeland verblijft; en

    • b. te eniger tijd in zijn of haar leven in Nieuw-Zeeland heeft gewoond gedurende een ononderbroken tijdvak van ten minste 12 maanden na het bereiken van de leeftijd van 20 jaar.

  • 3 Voor de toepassing van dit Deel wordt:

    • a. indien een persoon die zijn of haar vaste woonplaats heeft in Nederland tijdelijk afwezig is uit Nederland voor een tijdvak van niet langer dan 26 weken, het tijdvak van tijdelijke afwezigheid uit Nederland niet beschouwd als onderbreking van de vaste woonplaats van die persoon in Nederland;

    • b. indien een persoon die zijn of haar vaste woonplaats heeft gehad in Nederland, afwezig is uit Nederland voor een tijdvak van langer dan 26 weken, deze persoon niet meer geacht zijn of haar vaste woonplaats in Nederland te hebben vanaf de datum van zijn of haar vertrek uit Nederland; en

    • c. indien een persoon Nieuw-Zeeland verlaat met het voornemen een vaste woonplaats te kiezen in Nederland voor ten minste 26 weken, en indien die persoon aanvangt een vaste woonplaats te hebben in Nederland binnen 26 weken na zijn of haar vertrek uit Nieuw-Zeeland, die persoon geacht een vaste woonplaats in Nederland te hebben gekregen op de datum van zijn of haar vertrek uit Nieuw-Zeeland.

  • 4 Indien een persoon die zijn of haar vaste woonplaats in Nederland heeft, de leeftijd bereikt voor aanspraak op een Nieuw-Zeelands pensioen of een veteranenpensioen, heeft die persoon geen aanspraak of, naar gelang van het geval, geen aanspraak meer op een invaliditeitsuitkering, weduwenuitkering of uitkering aan weduwnaars voor huishoudelijke doeleinden, indien die persoon voldoet aan de vereisten voor een Nieuw-Zeelands pensioen of een veteranenpensioen.

  • 5 Voor de toepassing van dit Verdrag is een persoon die niet de leeftijd heeft bereikt voor aanspraak op een Nieuw-Zeelands pensioen, niet gerechtigd een Nieuw-Zeelands pensioen of een veteranenpensioen te ontvangen op grond van het feit dat zijn of haar echtgenote of echtgenoot een Nieuw-Zeelands pensioen of een veteranenpensioen ontvangt.

Artikel 7. Optelling

  • 1 Om vast te stellen of een persoon voldoet aan de verblijfsvereisten voor een in de Nieuw-Zeelandse wetgeving omschreven uitkering, beschouwt het Nieuw-Zeelandse orgaan:

    • a. in het geval van een Nieuw-Zeelands pensioen of een veteranenpensioen, voor een persoon die ouder is dan 65 jaar, een cumulatief Nederlands verzekeringstijdvak dat die persoon heeft voltooid na het bereiken van de leeftijd van 20 jaar, als een tijdvak waarin die persoon zowel zijn of haar woonplaats in Nieuw-Zeeland had als er verbleef, maar slechts verzekeringstijdvakken betreffende tijdvakken boven de leeftijd van 50 jaar worden in aanmerking genomen voor het voldoen aan de verblijfsvereisten voor het Nieuw-Zeelandse pensioen die bepalen dat, boven de leeftijd van 50 jaar, een persoon 5 jaar lang zijn of haar woonplaats in Nieuw-Zeeland moet hebben;

    • b. in het geval van een andere uitkering, een cumulatief Nederlands verzekeringstijdvak, door die persoon na het bereiken van de leeftijd van 20 jaar voltooid, als tijdvak waarin die persoon zowel zijn of haar woonplaats in Nieuw-Zeeland had als er verbleef.

  • 2 Voor de toepassing van het eerste lid wordt, indien een tijdvak van wonen in Nieuw-Zeeland en een Nederlands verzekeringstijdvak samenvallen, het tijdvak van samenvallen slechts een maal in aanmerking genomen als een tijdvak van wonen in Nieuw-Zeeland.

  • 3 Om vast te stellen of een persoon die een vaste woonplaats heeft in Nieuw-Zeeland of Nederland gerechtigd is een weduwenuitkering of een uitkering aan weduwnaars voor huishoudelijke doeleinden te ontvangen, wordt een ten laste van die persoon komend in Nederland geboren kind behandeld als was dat kind geboren in Nieuw-Zeeland, mits:

    • a. in het geval van een weduwe, het kind is verwekt voor de dood van de laatst overleden echtgenoot van die persoon; en

    • b. in het geval van een weduwnaar, het kind is geboren voor de dood van de laatst overleden echtgenote van die persoon.

  • 4 Om vast te stellen of een weduwe die een vaste woonplaats heeft in Nieuw-Zeeland of in Nederland gerechtigd is een weduwenuitkering te ontvangen wordt:

    • a. die weduwe geacht een cumulatief tijdvak van wonen in Nieuw-Zeeland te hebben voltooid voor elk tijdvak waarin haar laatst overleden echtgenoot een cumulatief verzekeringstijdvak voltooide krachtens de Nederlandse wetten inzake sociale verzekering;

    • b. een tijdvak waarin die weduwe en haar laatst overleden echtgenoot beiden een Nederlands cumulatief verzekeringstijdvak vergaarden krachtens de Nederlandse wetten inzake sociale verzekering slechts één maal in aanmerking genomen; en

    • c. een krachtens de Nederlandse wetten inzake sociale verzekering door de laatst overleden echtgenoot van die weduwe vergaard cumulatief Nederlands verzekeringstijdvak geacht een tijdvak te zijn waarin die echtgenoot een vaste woonplaats in Nieuw-Zeeland had ter vasttelling van de vaste woonplaats van die echtgenoot; en

    • d. indien de dood van de laatst overleden echtgenoot van een weduwe in Nederland plaatsvindt, hij geacht te zijn overleden in Nieuw-Zeeland.

Artikel 8. Hoogte van het Nieuw-Zeelandse pensioen en veteranenpensioen in Nederland

Indien een persoon die een vaste woonplaats heeft in Nederland gerechtigd is een Nieuw-Zeelands pensioen of veteranenpensioen te ontvangen ingevolge artikel 6, wordt het bedrag van die uitkering berekend overeenkomstig de volgende formule:

480 indien de persoon is geboren vóór 1 april 1932;

492 indien de persoon is geboren tussen 1 april 1932 en 30 juni 1932;

495 indien de persoon is geboren tussen 1 juli 1932 en 30 september 1932;

498 indien de persoon is geboren tussen 1 oktober 1932 en 31 december 1932;

501 indien de persoon is geboren tussen 1 januari 1933 en 31 maart 1933;

504 indien de persoon is geboren tussen 1 april 1933 en 30 juni 1933;

507 indien de persoon is geboren tussen 1 juli 1933 en 30 september 1933;

510 indien de persoon is geboren tussen 1 oktober 1933 en 31 december 1933;

513 indien de persoon is geboren tussen 1 januari 1934 en 31 maart 1934;

516 indien de persoon is geboren tussen 1 april 1934 en 30 juni 1934;

519 indien de persoon is geboren tussen 1 juli 1934 en 30 september 1934;

522 indien de persoon is geboren tussen 1 oktober 1934 en 30 december 1934;

525 indien de persoon is geboren tussen 1 januari 1935 en 31 maart 1935;

528 indien de persoon is geboren tussen 1 april en 30 juni 1935;

531 indien de persoon is geboren tussen 1 juli 1935 en 30 september 1935;

534 indien de persoon is geboren tussen 1 oktober 1935 en 31 december 1935;

537 indien de persoon is geboren tussen 1 januari 1936 en 31 maart 1936;

540 indien de persoon is geboren na 31 maart 1936;

met inachtneming van de volgende bepalingen:

  • a. voor het vaststellen van het aantal hele maanden van wonen in Nieuw-Zeeland wordt slechts wonen na het bereiken van de leeftijd van 20 jaar in aanmerking genomen;

  • b. alle tijdvakken van wonen in Nieuw-Zeeland na het bereiken van de leeftijd van de leeftijd van 20 jaar worden samengevoegd;

  • c. de maximum uitkering is:

    • i. in het geval van een ongehuwde, de maximum uitkering die betaalbaar is krachtens de Nieuw-Zeelandse wetgeving aan een ongehuwde die niet alleen woont; en

    • ii. in het geval van een gehuwde persoon, de maximum hoogte van de uitkering die uitkeerbaar is krachtens de Nieuw-Zeelandse wetgeving aan een gehuwd persoon van wie de echtgenote of echtgenoot eveneens voldoet aan de vereisten voor een Nieuw-Zeelands pensioen of een veteranenpensioen;

  • d. met betrekking tot een persoon die de leeftijd van 65 jaar heeft bereikt vóór de datum waarop dit Verdrag in werking is getreden, heeft die persoon gedurende ten minste 10 jaar, te eniger tijd, in Nieuw-Zeeland gewoond;

  • e. indien een persoon die na 1 april 1990 een vaste woonplaats heeft gekozen of kiest in Nederland, gerechtigd was een Nieuw-Zeelands pensioen of een veteranenpensioen te ontvangen op de datum van vertrek uit Nieuw-Zeeland en gerechtigd is die uitkering te ontvangen op grond van artikel 6 en niet op grond van artikel 7, is het bedrag van die uitkering niet lager dan het bedrag dat betaald zou worden bij afwezigheid van dit Verdrag;

  • f. in geen geval overschrijdt de hoogte van de uitkering 100% van de maximum uitkering;

  • g. buiten beschouwing blijven uitkeringen die eveneens uitkeerbaar zijn krachtens de Nederlandse wetten inzake sociale verzekering, of uitkeringen of pensioenen die betaalbaar zijn krachtens de wetten inzake sociale verzekering van een derde land.

Artikel 9. Hoogte van Nieuw-Zeelandse weduwenuitkeringen, uitkeringen aan weduwnaren voor huishoudelijke doeleinden en invaliditeitsuitkeringen in Nederland

Indien een persoon die een vaste woonplaats heeft in Nederland gerechtigd is een weduwenuitkering, een uitkering aan weduwnaren voor huishoudelijke doeleinden of een invaliditeitsuitkering te ontvangen op grond van artikel 6, wordt het bedrag van die uitkering berekend overeenkomstig de volgende formule:

(Het aantal hele maanden van wonen in Nieuw-Zeeland / 300 maanden) x maximum uitkering

met inachtneming van de volgende bepalingen:

  • a. voor het vaststellen van het aantal hele maanden van wonen in Nieuw-Zeeland wordt slechts wonen na het bereiken van de leeftijd van 20 jaar in aanmerking genomen;

  • b. alle tijdvakken van wonen in Nieuw-Zeeland na het bereiken van de leeftijd van 20 jaar worden samengevoegd;

  • c. het te betalen maximale uitkeringsbedrag is de maximum uitkering waarop die persoon aanspraak zou hebben ingevolge de Nieuw-Zeelandse wetgeving;

  • d. in geen geval overschrijdt de hoogte van de uitkering 100% van de maximum uitkering; en

  • e. buiten beschouwing blijven uitkeringen die eveneens betaalbaar zijn krachtens de Nederlandse wetten inzake sociale zekerheid, de Disablement Assistance Act for Handicapped Young Persons, of pensioenen of uitkeringen die betaalbaar zijn krachtens de wetten inzake sociale zekerheid van een derde partij.

Artikel 10. Betaling van aanvullende uitkeringen en toeslagen

  • 1 Indien een persoon die een vaste woonplaats heeft in Nieuw-Zeeland gerechtigd wordt een Nieuw-Zeelandse uitkering te ontvangen ingevolge artikel 7, betaalt het Nieuw-Zeelandse orgaan krachtens de Nieuw-Zeelandse wetgeving aan die persoon tevens de aanvullende uitkeringen of toeslagen aan de vereisten waarvoor die persoon voldoet.

  • 2 Indien een persoon die een vaste woonplaats heeft in Nederland gerechtigd wordt een Nieuw-Zeelandse uitkering te ontvangen krachtens deze Overeenkomst, zijn in het bedrag van die uitkering niet de aanvullende uitkeringen en toeslagen begrepen die betaalbaar zouden zijn krachtens de Nieuw-Zeelandse wetgeving indien die persoon een vaste woonplaats had in Nieuw-Zeeland.

Artikel 11. Woonplaats in een derde staat

Een persoon die:

  • a. een vaste woonplaats heeft in Nieuw-Zeeland;

  • b. slechts gerechtigd is een uitkering te ontvangen bij toepassing van de bepalingen inzake optelling van artikel 7; en

  • c. hetzij:

    • i. Nieuw-Zeeland verlaat met het voornemen te gaan wonen in een derde staat voor een periode van langer dan 26 weken, of

    • ii. woont in een derde staat voor een periode van langer dan 26 weken;

is niet gerechtigd een Nieuw-Zeelands pensioen of een veteranenpensioen te ontvangen terwijl hij zich buiten Nieuw-Zeeland of Nederland bevindt, tenzij hij of zij gerechtigd is die uitkering te ontvangen krachtens een verdrag inzake sociale zekerheid die Nieuw-Zeeland is aangegaan met die derde staat.

Artikel 12. Gevolg van Nederlandse belastingheffing op Nederlandse pensioenen

Indien een persoon die een vaste woonplaats heeft in Nieuw-Zeeland een Nederlands pensioen en een Nieuw-Zeelandse uitkering ontvangt, worden, ter berekening van de hoogte van de Nieuw-Zeelandse uitkering, krachtens de Nederlandse belastingwetgeving geheven belastingen uitgezonderd van het bedrag van het Nederlandse pensioen dat in mindering wordt gebracht op de Nieuw-Zeelandse uitkering, tenzij die persoon anders wenst.

Artikel 13. Behandeling van de Nederlandse vrijwillige verzekering

Nederlandse uitkeringen op grond van tijdvakken van vrijwillige verzekering krachtens de Nederlandse wetten inzake sociale zekerheid kunnen niet rechtstreeks in mindering worden gebracht op Nieuw-Zeelandse uitkeringen krachtens de Nieuw-Zeelandse wetten inzake sociale zekerheid.

B. BEPALINGEN BETREFFENDE NEDERLANDSE UITKERINGEN

Artikel 14. Ziekteverzekering

  • 1 Het Nederlandse orgaan stelt de ziekte-uitkering vast in overeenstemming met de Nederlandse Ziektewet (ZW).

  • 2 Hij of zij die woont in Nieuw-Zeeland en gerechtigd zou zijn een Nederlandse ziekte-uitkering te ontvangen indien hij of zij zou wonen op het grondgebied van Nederland, is gerechtigd een Nederlandse ziekte-uitkering te ontvangen van dezelfde hoogte als hij of zij gerechtigd zou zijn te ontvangen indien hij of zij woonde in Nederland.

Artikel 15. Ouderdomsuitkeringen

  • 1 Het Nederlandse orgaan stelt de ouderdomsuitkering vast op grond van verzekeringstijdvakken die zijn vervuld krachtens de Nederlandse Algemene Ouderdomswet en van dit Verdrag.

  • 2 Met inachtneming van het derde en het vierde lid worden tijdvakken voor 1 januari 1957 gedurende welke een onderdaan van een Verdragsluitende Partij op het grondgebied van Nederland woonde na het bereiken van de leeftijd van vijftien jaar of gedurende welke hij, terwijl hij in een ander land woonde, op het grondgebied van Nederland arbeid in loondienst verrichtte, ook beschouwd als verzekeringstijdvakken indien de betrokkene niet voldoet aan de voorwaarden van de Nederlandse wetgeving op grond waarvan zulke tijdvakken voor hem met verzekeringstijdvakken mogen worden gelijkgesteld.

  • 3 Het in het tweede lid bedoelde tijdvak wordt bij de berekening van de ouderdomsuitkering slechts in aanmerking genomen indien de belanghebbende verzekerd is geweest krachtens de Nederlandse Algemene Ouderdomswet en ten minste zes jaar op het grondgebied van één of beide Verdragsluitende Partijen heeft gewoond na het bereiken van de leeftijd van negenenvijftig jaar en alleen zolang hij op het grondgebied van één van de Verdragsluitende Partijen woont. De tijdvakken vóór 1 januari 1957 worden evenwel niet in aanmerking genomen indien deze samenvallen met tijdvakken die reeds in aanmerking zijn genomen voor de berekening van een ouderdomsuitkering krachtens de wetgeving van een ander land dan Nederland.

  • 4 Wanneer de som van het bedrag van de Nederlandse ouderdomsuitkering overeenkomstig dit Verdrag of overeenkomstig de Nederlandse Algemene Ouderdomswet, afgezien van de inkomensafhankelijke toeslag en de vakantie-uitkering als omschreven in artikel 8, eerste lid, respectievelijk artikel 28 van die wet, en het bedrag van het Nieuw-Zeelandse pensioen of veteranenpensioen krachtens dit Verdrag of de Nieuw-Zeelandse wetgeving voor een persoon die in Nederland woont, hoger is dan het maximumbedrag overeenkomstig de Nederlandse Algemene Ouderdomswet, afgezien van de inkomensafhankelijke toeslag en de vakantie-uitkering als omschreven in artikel 8, eerste lid, respectievelijk artikel 28 van die wet, past het Nederlandse orgaan zijn uitkering aan met een bedrag dat gelijk is aan het surplus.

  • 5 Wijzigingen in de wisselkoers zijn niet van invloed op het in overeenstemming met het voorgaande lid berekende bedrag, mits ten minste één maal per jaar een omrekening plaats vindt, met gebruikmaking van de wisselkoerspariteit zoals die wordt geadviseerd door de Nederlandsche Bank NV op de dag van betaling van de Nieuw-Zeelandse uitkering voor de maand waarin de herberekening plaatsvindt.

  • 6 De in het vierde lid bedoelde vermindering heeft geen invloed op het bedrag dat is gebaseerd op de verzekeringstijdvakken na 1 januari 1957 overeenkomstig de Nederlandse Algemene Ouderdomswet.

  • 7 Hij of zij die woont in Nieuw-Zeeland en gerechtigd zou zijn een Nederlandse ouderdomsuitkering te ontvangen indien hij of zij zou wonen op het grondgebied van Nederland, is gerechtigd een Nederlandse ouderdomsuitkering te ontvangen van dezelfde hoogte als hij of zij gerechtigd zou zijn te ontvangen indien hij of zij woonde in Nederland.

Artikel 16. Nabestaandenuitkering

  • 1 Het Nederlandse orgaan stelt de nabestaandenuitkering vast op grond van de Nederlandse Algemene Nabestaandenwet en van dit Verdrag.

  • 2 Hij of zij die woont in Nieuw-Zeeland en gerechtigd zou zijn een Nederlandse nabestaandenuitkering te ontvangen indien hij of zij zou wonen op het grondgebied van Nederland, is gerechtigd een Nederlandse nabestaandenuitkering te ontvangen van dezelfde hoogte als hij of zij gerechtigd zou zijn te ontvangen indien hij of zij woonde in Nederland.

  • 3 Een persoon die woont op het grondgebied van Nederland is, ten aanzien van zijn of haar kinderen die verblijven of wonen op het grondgebied van Nieuw-Zeeland, gerechtigd de Nederlandse wezenuitkering te ontvangen alsof die kinderen wonen op het grondgebied van Nederland.

Artikel 17. Arbeidsongeschiktheidsuitkeringen

  • 1 Het Nederlandse orgaan stelt de invaliditeitsuitkering vast op grond van de Nederlandse Wet op de Arbeidsongeschiktheid en van dit Verdrag.

  • 2 Hij of zij die woont in Nieuw-Zeeland en gerechtigd zou zijn een Nederlandse invaliditeitsuitkering te ontvangen indien hij of zij zou wonen op het grondgebied van Nederland, is gerechtigd een Nederlandse arbeidsongeschiktheidsuitkering te ontvangen van dezelfde hoogte als waarop hij of zij gerechtigd zou zijn te ontvangen indien hij of zij woonde in Nederland.

Artikel 18. Kinderbijslag

  • 1 Het Nederlandse orgaan stelt de kinderbijslag vast in overeenstemming met de Nederlandse Kinderbijslagwet en met dit Verdrag.

  • 2 Een persoon die woont op het grondgebied van Nieuw-Zeeland is, ten aanzien van zijn of haar kinderen die verblijven of wonen op het grondgebied van Nederland of Nieuw-Zeeland, gerechtigd tot de Nederlandse kinderbijslag alsof die persoon en die kinderen allen woonden op het grondgebied van Nederland.

  • 3 Hij of zij die woont op het grondgebied van Nederland is, ten aanzien van zijn of haar kinderen die verblijven of wonen op het grondgebied van Nieuw-Zeeland, gerechtigd tot de Nederlandse kinderbijslag alsof die kinderen woonden op het grondgebied van Nederland.

C. GEMEENSCHAPPELIJKE BEPALINGEN INZAKE BETALING VAN UITKERINGEN

Artikel 19. Inkomensafhankelijke uitkeringen

  • 1 Wanneer een Verdragsluitende Partij een uitkering betaalt aan een persoon die woont op het grondgebied van de andere Verdragsluitende Partij, laat die Verdragsluitende Partij de door de andere Verdragsluitende Partij aan die persoon of aan de echtgenoot of echtgenote van die persoon betaalde inkomensafhankelijke uitkeringen buiten beschouwing.

  • 2 Wanneer een persoon in zowel Nederland als Nieuw-Zeeland een schuld inzake sociale zekerheid heeft opgebouwd op grond van het feit dat de Overeenkomst van 1990 die persoon aanspraak verleende op een hoger Nederlands ouderdomspensioen dan anders uitkeerbaar zou zijn, en het Nederlandse bedrijfspensioenfonds aan Nieuw-Zeeland de helft terugbetaalt van het bedrag dat dat fonds verschuldigd is vanwege die hogere aanspraak op ouderdomspensioen, schrapt de Nieuw-Zeelandse regering het restant van het bedrag dat zij jegens die persoon verschuldigd is op grond van die hogere aanspraak en betaalt zij aan de schuldenaar een bedrag dat hoger is dan het verschil tussen de helft van de oorspronkelijke Nieuw-Zeelandse schuld op grond van die hogere aanspraak en het bedrag dat is terugbetaald door het Nederlandse bedrijfspensioenfonds en/of het bedrag van de oorspronkelijke schuld die door de schuldenaar reeds is terugbetaald aan de Nieuw-Zeelandse regering.

DEEL III. WEDERZIJDSE BIJSTAND

Artikel 20. Uitwisseling van informatie

  • 1 De bevoegde autoriteiten geven elkaar alle informatie die nodig is voor de toepassing van dit Verdrag of de respectieve wetten inzake sociale zekerheid van de Verdragsluitende Partijen betreffende alle aangelegenheden die zich voordoen ingevolge dit Verdrag of die wetten.

  • 2 De organen verstrekken elkaar op verzoek:

    • a. alle informatie die in hun bezit is of die zij op rechtmatige wijze kunnen verkrijgen benodigd voor de vaststelling of betaling van een uitkering of pensioen krachtens dit Verdrag of enige andere aanspraak krachtens hun respectieve wetten inzake sociale zekerheid;

    • b. de informatie die in hun bezit is of die zij op rechtmatige wijze kunnen verkrijgen benodigd voor de invordering van een schulden inzake sociale zekerheid krachtens dit Verdrag of verband houdend met een andere aanspraak ingevolge hun respectieve wetten inzake sociale zekerheid;

    • c. alle informatie die in hun bezit is of die zij op rechtmatige wijze kunnen verkrijgen benodigd voor de vaststelling of invordering van belastingen of premies die geheven worden met betrekking tot de sociale zekerheid.

  • 3 Indien een orgaan informatie waarom het andere orgaan verzoekt niet bezit, maar die informatie in het bezit is van de belastingautoriteiten in de Staat van het orgaan dat het verzoek ontvangt, verwerft laatstbedoeld orgaan de informatie bij de belastingautoriteiten ten behoeve van het verzoekende orgaan.

  • 4 Een orgaan dat informatie ontvangt ingevolge het tweede en derde lid kan die informatie verstrekken aan de belastingautoriteiten van die Partij ten behoeve van het vaststellen van door een persoon krachtens de wetten van de verzoekende Partij verschuldigde belasting, in verband met het opleggen van een aanslag of opsporing van belastingfraude of belastingontwijking krachtens de wetten van de verzoekende Partij.

  • 5 Een orgaan verstrekt, op verzoek, aan het orgaan van de andere Partij alle informatie die dat orgaan nodig heeft om vragen te beantwoorden, een verslag te maken of een opgave te doen waarom verzocht is door een persoon of instelling die bevoegd is toe te zien op naleving van de wetten inzake de bescherming van de persoonlijke levenssfeer.

  • 6 In de in artikel 29 bedoelde administratieve akkoorden worden de voorwaarden en procedures omschreven voor vaststelling van de regeling die de Partijen naleven wanneer zij om informatie verzoeken of deze verstrekken ingevolge dit artikel. De administratieve akkoorden:

    • a. omvatten bepalingen die, met betrekking tot Nieuw-Zeeland, garanderen dat de waarborgen worden nageleefd die krachtens de Nieuw-Zeelandse wetten inzake de persoonlijke levenssfeer vereist zijn in akkoorden over het koppelen van gegevens en dat de akkoorden verenigbaar zijn met de regels inzake het koppelen van gegevens krachtens de Nieuw-Zeelandse wetten inzake de persoonlijke levenssfeer;

    • b. vermelden de gegevens waarom elke Partij ingevolge dit artikel kan verzoeken;

    • c. beperken de verstrekking van informatie tot de gegevens die in overeenstemming met onderdeel b zijn vermeld.

  • 7 De in het tweede of derde lid bedoelde bijstand wordt kosteloos verleend.

  • 8 Informatie die in overeenstemming met dit Verdrag aan een orgaan wordt toegezonden, wordt op dezelfde wijze beschermd (met inbegrip van bescherming van persoonsgegevens) als de informatie die wordt verkregen krachtens de wetten inzake sociale zekerheid van de ontvangende Partij.

  • 9 Een Partij die, uit hoofde van dit artikel, van de andere Partij persoonlijke informatie over een persoon ontvangt, mag deze informatie niet aan een ander land verstrekken zonder de toestemming van het bevoegde orgaan dat de informatie heeft verstrekt of van de betrokken persoon.

Artikel 21. Administratieve controles en medische onderzoeken

  • 1 Op verzoek in overeenstemming met artikel 20 verstrekt het orgaan van een Verdragsluitende Partij, binnen de grenzen van de wetgeving, aan het verbindingsorgaan of het orgaan van de andere Verdragsluitende Partij alle beschikbare medische informatie en bewijsstukken betreffende de ziekte, het letsel of de arbeidsongeschiktheid van een persoon die een uitkering aanvraagt of ontvangt die verschuldigd is op grond van ziekte, letsel of arbeidsongeschiktheid uit hoofde van dit Verdrag.

  • 2 De instellingen kunnen elkaar verzoeken administratieve controles en medische onderzoeken uit te voeren van aanvragers of ontvangers van hun respectieve uitkeringen om te verifiëren of zij voor een uitkering in aanmerking komen.

Artikel 22. Bijstand bij verhaal

  • 1 Voor de toepassing van dit artikel wordt verstaan onder:

    „verzoekend orgaan": een orgaan dat bijstand verzoekt bij het verhalen van een schuld inzake sociale zekerheid;

    „aangezocht orgaan": een orgaan dat verzocht wordt bijstand te verlenen bij het verhalen van een schuld inzake sociale zekerheid; en

    „schuld inzake sociale zekerheid": een schuld ontstaan krachtens de wetten inzake sociale zekerheid van een Verdragsluitende Partij en, met betrekking tot Nederland, met inbegrip van ten behoeve van sociale zekerheid geheven belastingen of premies.

  • 2 Op verzoek van het verzoekende orgaan verhaalt het aangezochte orgaan schulden inzake sociale zekerheid van het verzoekende orgaan, in overeenstemming met het recht en de bestuurlijke praktijk voor het verhalen van zijn eigen schulden inzake sociale zekerheid. Deze vorderingen betreffende schulden inzake sociale zekerheid genieten evenwel geen prioriteit in de Staat van het aangezochte orgaan en zij kunnen niet worden verhaald door middel van hechtenis van de schuldenaar wegens schuld. Evenmin is het aangezochte orgaan verplicht om executiemaatregelen te treffen waarin de wetten van de staat van het aangezocht orgaan niet voorzien.

  • 3 De bepalingen van het tweede lid zijn alleen van toepassing op een schuld inzake sociale zekerheid wanneer het uitvoerend hoofd van het verzoekende orgaan een verklaring verstrekt waarin wordt aangegeven:

    • a. het bedrag van de schuld in de munt van zowel de Staat van het verzoekende orgaan als van het aangezochte orgaan;

    • b. dat de schuld een schuld is inzake sociale zekerheid;

    • c. dat voldaan is aan de bepalingen van het vijfde lid onder a;

    • d. dat voldaan is aan de bepalingen van het zesde lid;

    • e. dat de invordering van de schuld inzake sociale zekerheid is toegestaan in de Staat van het verzoekende orgaan, onder vermelding van de betrokken wetgeving waarbij de invordering wordt toegestaan;

    • f. dat het verzoek niet strijdig is met de bepalingen van het zevende lid; en

    • g. dat alle rechten op herziening of beroep ten aanzien van de schuld krachtens de wetten inzake sociale zekerheid van de verzoekende Partij zijn uitgeput of vervallen. Voor de toepassing van dit onderdeel vervalt een recht op herziening of beroep:

      • i. indien het recht niet binnen de gestelde termijn is uitgeoefend; en

      • ii. ongeacht of de rechter die of het orgaan dat of de rechtspersoon die rechtsbevoegdheid zou hebben met betrekking tot de herziening of het beroep, of iedere andere persoon, de discretionaire bevoegdheid behoudt (ongeacht de wijze waarop dit is uitgedrukt in deze wetten) toe te staan dat het recht op herziening of beroep na deze termijn wordt uitgeoefend.

  • 4 De verplichting om bijstand te verlenen bij het verhalen van schulden inzake sociale zekerheid betreffende een overleden persoon of diens nalatenschap wordt beperkt tot de waarde van de nalatenschap of de door elke begunstigde van de nalatenschap verworven eigendom, naar gelang de vordering moet worden verhaald op de nalatenschap of op de begunstigden daarvan.

  • 5 Het aangezochte orgaan is niet verplicht actie te ondernemen ten aanzien van het verzoek:

    • a. indien het verzoekende orgaan niet alle op zijn eigen grondgebied beschikbare middelen heeft aangewend, tenzij het aanwenden van deze middelen onevenredige moeilijkheden zou opleveren; of

    • b. indien en voor zover het de schuld inzake sociale zekerheid strijdig acht met de bepalingen van dit Verdrag of een ander verdrag waarbij beide Verdragsluitende Partijen partij zijn.

  • 6 De organen kunnen in de administratieve akkoorden die worden opgesteld in overeenstemming met artikel 29, een minimumbedrag van een schuld inzake sociale zekerheid vaststellen dat kan worden verhaald ingevolge de bepalingen van dit artikel.

  • 7 Aangelegenheden betreffende een termijn waarbinnen een schuld inzake sociale zekerheid kan worden ingevorderd, worden beheerst door het recht van de verzoekende Staat, maar de aangezochte Staat begint geen actie om een schuld inzake sociale zekerheid terug te vorderen indien meer dan 5 jaar verstreken zijn sinds die schuld voor het eerst is vastgesteld.

  • 8 Het verzoek om administratieve bijstand gaat bij het terugvorderen vergezeld van:

    • a. een verklaring ingevolge het derde lid;

    • b. alle andere voor de terugvordering benodigde documenten;

    • c. wanneer van toepassing, een gewaarmerkt afschrift van elke desbetreffende beslissing door een gerecht of bestuursorgaan gegeven.

  • 9 De wisselkoers die gebruikt dient te worden ter vaststelling van het bedrag van een schuld inzake sociale zekerheid in de munt van de Staat van het aangezochte orgaan, is de verkoopkoers bij telegrafische overmaking, vastgesteld in de Staat van het verzoekende orgaan op de datum waarop de verklaring is gemaakt.

  • 10 Indien de schuldenaar een recht op herziening of beroep ten aanzien van een schuld uitoefent nadat ingevolge het tweede lid een verzoek tot verhaal van deze schuld is ingediend:

    • a. brengt het verzoekende orgaan het aangezochte orgaan terstond in kennis van de uitoefening van het recht; en

    • b. stelt het aangezochte orgaan:

      • i. het terugvorderen van de schuld uit totdat het verzoekende orgaan hem ervan in kennis heeft gesteld dat de herziening of het beroep definitief is vastgesteld; en

      • ii. neemt het maatregelen om alle bedragen in zijn bezit die bestemd zijn voor de schuldenaar te bewaren met het oog op de invordering van de schuld nadat een dergelijke kennisgeving is ontvangen.

  • 11 Handelingen van het aangezochte orgaan terzake van invordering, uit hoofde van een verzoek om bijstand die het gevolg zouden hebben van schorsing of stuiting van een in het zevende lid bedoelde termijn, hebben dit gevolg ook krachtens de wetten van de Staat van het verzoekende orgaan. Het aangezochte orgaan stelt het verzoekende orgaan in kennis van elk geval waarbij deze situatie zich voordoet.

  • 12 Het aangezochte orgaan of de gerechten of bestuursorganen van de Staat van het aangezochte orgaan kunnen toestaan dat de betalingen worden uitgesteld of plaats vinden in termijnen, indien dit in vergelijkbare omstandigheden is toegestaan krachtens de wetten of bestuurlijke praktijken van dat orgaan of die Staat. Het aangezochte orgaan stelt het verzoekende orgaan van zulke beslissingen in kennis.

  • 13 Het verzoekende orgaan betaalt de redelijke kosten van de handelingen terzake van invordering en licht het aangezochte orgaan het verzoekende orgaan in over de geraamde kosten na ontvangst van een verzoek en alvorens over te gaan tot het verhalen van de schuld inzake sociale verzekering.

  • 14 Het verzoekende orgaan is aansprakelijk voor alle financiële gevolgen die ontstaan door handelingen terzake van invordering welke ongerechtvaardigd blijken ten aanzien van de geldigheid van de schuld inzake sociale zekerheid.

  • 15 Een bedrag wordt ingevorderd door het aangezochte orgaan krachtens de bepalingen van dit artikel, minus de ingevolge het dertiende of veertiende lid in mindering te brengen bedragen, aan het verzoekende orgaan overgemaakt in de munt van de Staat van het aangezochte orgaan.

Artikel 23. Terugvordering van te veel betaalde bedragen

  • 1 Wanneer een door één van de Partijen met betrekking tot een uitkering aan een persoon een bedrag is betaald dat hoger is dan het eventuele bedrag dat eigenlijk verschuldigd was met betrekking tot die uitkering, krachtens dit Verdrag of anderszins, trekt het orgaan van die andere Verdragsluitende Partij, indien daartoe in overeenstemming met artikel 22 verzocht door het andere orgaan en in overeenstemming met dit artikel en artikel 22, een bedrag gelijk aan het bovenbedoelde teveel betaalde bedrag af van het bedrag dag verschuldigd is met betrekking tot laatstbedoelde uitkering.

  • 2 Het in het eerste lid bedoelde te veel betaalde bedrag is het bedrag vastgesteld door het orgaan van de Verdragsluitende Partij die het te veel betaalde bedrag heeft uitgekeerd.

  • 3 De hoogte van de aftrek, overeenkomstig het eerste lid, van verschuldigde bedragen met betrekking tot een uitkering, alsmede bijkomende of daarmee verband houdende aangelegenheden, wordt bepaald door het orgaan van de Verdragsluitende Partij die de uitkering dient te betalen, in overeenstemming met de wetten inzake sociale zekerheid of de bestuurlijke praktijk van die Verdragsluitende Partij.

  • 4 Bedragen die zijn afgetrokken door het orgaan van één van de Verdragsluitende Partijen in overeenstemming met het eerste lid, alsmede bedragen die door dat orgaan zijn ontvangen ingevolge het derde lid, worden overgemaakt aan het andere orgaan op de wijze zoals overeengekomen tussen de organen of in administratieve akkoorden ingevolge artikel 29.

Artikel 25. Weigering te betalen, opschorting of beëindiging van een uitkering

Een orgaan van een Verdragsluitende Partij kan een overigens betaalbare uitkering weigeren uit te betalen, opschorten of beëindigen indien dat orgaan oordeelt dat een aanvrager of ontvanger of het orgaan van de andere Verdragsluitende Partij nalaat terstond voldoende informatie te verstrekken of een onderzoek als vereist krachtens dit Verdrag te ondergaan of, naar gelang van het geval, uit te voeren.

Deel IV. DIVERSE BEPALINGEN

Artikel 26. Indiening van vorderingen

  • 1 Een naar behoren ingediende aanvraag om een uitkering krachtens de wetgeving van één van de Verdragsluitende Partijen wordt beschouwd als een naar behoren ingediende aanvraag krachtens de wetgeving van de andere Verdragsluitende Partij.

  • 2 De datum van ontvangst van een aanvraag of ander document overgelegd bij een bevoegde autoriteit of orgaan wordt beschouwd als datum van ontvangst van de aanvraag of het andere document door de andere bevoegde autoriteit of het andere orgaan. De aanvraag of het document wordt onverwijld doorgezonden naar het orgaan van de andere Verdragsluitende Partij.

Artikel 27. Vaststelling en ingangsdatum van het recht op uitkering

  • 1 De datum van ingang voor de uitbetaling van een uitkering krachtens dit Verdrag wordt vastgesteld in overeenstemming met de wetten inzake sociale zekerheid van de betrokken Verdragsluitende Partij, doch zal in geen geval eerder vallen dan de datum waarop dit Verdrag in werking treedt.

  • 2 Tijdvakken van verzekering, wonen of arbeid in loondienst afgerond vóór de datum van inwerkingtreding van dit Verdrag worden in aanmerking genomen ter vaststelling van het recht op een uitkering krachtens dit Verdrag.

Artikel 28. Beroep

  • 1 Een persoon ten aanzien van wie een beslissing is genomen door de bevoegde autoriteit of het orgaan van een Verdragsluitende Partij, in verband met een aangelegenheid die zich voordoet krachtens dit Verdrag, heeft dezelfde rechten op heroverweging door, of beroep bij, bestuurlijke of rechterlijke instanties van die Verdragsluitende Partij als die waarin is voorzien krachtens de nationale wetten van de Verdragsluitende Partij.

  • 2 Documenten met betrekking tot een heroverweging door of een beroep bij bestuurlijke of rechterlijke instanties ingesteld bij de wetten inzake sociale zekerheid van één van de Verdragsluitende Partijen, kunnen worden ingediend op het grondgebied van de andere Verdragsluitende Partij, en documenten die op deze wijze naar behoren zijn ingediend worden geacht naar behoren te zijn ingediend voor de toepassing van die wetten.

  • 3 De datum waarop een document overeenkomstig het tweede lid naar behoren is ingediend op het grondgebied van één van de Verdragsluitende Partijen bepaalt of dat document is ingediend binnen een termijn die wordt gesteld door de wetten of bestuurlijke praktijk van de andere Verdragsluitende Partij die van toepassing zijn op het desbetreffende beroep.

Artikel 29. Administratieve akkoorden

De bevoegde autoriteiten van de Verdragsluitende Partijen brengen door middel van een administratief akkoord de maatregelen tot stand die noodzakelijk zijn voor de uitvoering van dit Verdrag.

Artikel 30. Communicatietaal

De bevoegde autoriteiten en organen kunnen rechtstreeks corresponderen met elkaar en met personen, ongeacht waar deze wonen, wanneer zulks nodig is ter toepassing van dit Verdrag. De correspondentie mag worden gevoerd in de Engelse of Nederlandse taal.

Artikel 31. Munt

  • 1 Betalingen krachtens dit Verdrag kunnen geldig worden gedaan in de munt van de Verdragsluitende Partij die de betaling doet.

  • 2 Overmakingen van geld krachtens dit Verdrag geschieden in overeenstemming met de desbetreffende verdragen die op het tijdstip van overmaking tussen de Verdragsluitende Partijen van kracht zijn.

  • 3 Ingeval door één van beide Verdragsluitende Partijen bepalingen worden ingevoerd die zijn gericht op de beperking van het wisselen of uitvoeren van valuta's, beslissen de Regeringen van de beide Verdragsluitende Partijen onmiddellijk over de maatregelen die noodzakelijk zijn ter verzekering van de overmaking van bedragen die de Verdragsluitende Partij of het orgaan verschuldigd is krachtens dit Verdrag.

Artikel 32. Beslechting van geschillen

  • 1 De bevoegde autoriteiten van de Verdragsluitende Partijen regelen, voor zover mogelijk, alle geschillen die zich voordoen bij de uitlegging of toepassing van dit Verdrag, zulks in overeenstemming met de geest en grondbeginselen ervan.

  • 2 De Verdragsluitende Partijen plegen onmiddellijk overleg op verzoek van een van hen aangaande aangelegenheden die niet zijn geregeld door de bevoegde autoriteiten in overeenstemming met het eerste lid.

  • 3 Indien het geschil niet is geregeld binnen zes maanden na het eerste in het tweede lid van dit artikel voorgeschreven overleg, wordt het voorgelegd aan een scheidsgerecht, waarvan samenstelling en procedure door de Verdragsluitende Partijen worden overeengekomen. Het scheidsgerecht beslecht het geschil overeenkomstig de grondbeginselen en in de geest van dit Verdrag. De beslissing van het scheidsgerecht wordt genomen bij meerderheid van stemmen en is onherroepelijk en bindend voor de Verdragsluitende Partijen.

Artikel 33. Herziening van het Verdrag

De Verdragsluitende Partijen kunnen te allen tijde overeenkomen bepalingen van dit Verdrag te herzien en aan de bevoegde autoriteiten verslag te doen aangaande de werking en doeltreffendheid van het Verdrag.

Artikel 34. Overgangsbepalingen

Een persoon die een Nieuw-Zeelandse uitkering ontvangt uit hoofde van artikel 7, artikel 8 of artikel 9 van de Overeenkomst van 1990 op de datum van beëindiging van die Overeenkomst, blijft aanspraak houden op die uitkering ter hoogte van het bedrag waarin ingevolge de Overeenkomst van 1990 wordt voorzien, maar een persoon die een Nieuw-Zeelandse ouderdomsuitkering ontvangt ter hoogte van het bedrag uit te keren aan een persoon die een echtgenoot of echtgenote heeft die niet uit eigen hoofde in aanmerking komt voor een Nieuw-Zeelands ouderdomspensioen, heeft geen recht meer op die hoogte wanneer zijn of haar echtgenote of echtgenoot de leeftijd van 65 jaar bereikt.

Artikel 35. Inwerkingtreding en beëindiging

  • 1 Beide Verdragsluitende Partijen stellen elkaar schriftelijk in kennis van de voltooiing van hun respectieve wettelijke en constitutionele procedures die zijn vereist voor de inwerkingtreding van dit Verdrag. Het Verdrag treedt in werking op de eerste dag van de tweede maand volgend op de datum van de laatste kennisgeving.

  • 2 Het Koninkrijk der Nederlanden past dit Verdrag voorlopig toe vanaf de eerste dag van de tweede maand volgend op de ondertekening en voor het Koninkrijk der Nederlanden treedt dit Verdrag in werking met dien verstande dat de artikelen 2, eerste lid, onder b, 14, 15, zevende lid, 16, 17 en 18 terugwerkende kracht hebben tot 1 januari 2000.

  • 3 Dit Verdrag blijft, onder voorbehoud van het vierde lid, van kracht tot het verstrijken van 12 maanden na de datum waarop één van beide Verdragsluitende Partijen van de andere langs diplomatieke weg een schriftelijke kennisgeving ontvangt van het voornemen van de andere Partij om het Verdrag te beëindigen.

  • 4 Ingeval dit Verdrag wordt beëindigd in overeenstemming met het derde lid, blijft hij van kracht ten aanzien van personen die krachtens dit Verdrag:

    • a. op de datum van beëindiging een uitkering of pensioen ontvangen; of

    • b. vóór het verstrijken van het in dat lid bedoelde tijdvak een vordering hebben ingediend voor, en recht zouden hebben op, een uitkering of pensioen.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd door hun respectieve Regeringen, dit Verdrag hebben ondertekend.
