Annex (Provisions on the Status of

the Planning Element in Denmark)

Sir,

I have the honour to refer to the Memorandum of Understanding concerning the Operation, Funding, Administration and Status of the Planning Element of the Multinational United Nations Stand-by Forces High Readiness Brigade, initially signed by Denmark on 14th of March 1997, according to which the status of the Planning Element and its personnel from nations other than the Host Nation will be dealt with in separate arrangements (section 6.1).

The Government of Denmark has offered to provide facilities in Denmark for the Planning Element.

Following discussions of the International Implementation Group of the Multinational United Nations Stand-by Forces High Readiness Brigade I have the honour to propose that the status, immunities and procedures applicable to the Planning Element and its personnel will be as set out in this Note and the enclosed annex to this Note (Provisions on the Status of the Planning Element in Denmark) which represents the conclusions of the Group. It is the aim for the Planning Element to commence its functions as of 3rd of June 1997.

If this proposal, which has been approved by the said Implementation Group, is acceptable to the Government of the Netherlands, this Note and Your Excellency's reply to that effect will constitute an agreement between the Kingdom of the Netherlands and the Kingdom of Denmark that will enter into force on the first day of the second month after the Kingdom of the Netherlands and the Kingdom of Denmark have informed each other that the constitutional procedures therefor have been complied with.

It is the understanding that the agreement represents an interim arrangement which, subject to negotiations between the participants in the Multinational United Nations Stand-by Forces High Readiness Brigade and subject to constitutional requirements, is intended to be replaced by a multilateral and reciprocal agreement on the status of forces, including the status of the officials of the Planning Element of the Multinational United Nations Stand-by Forces High Readiness Brigade. Such an agreement could be inspired by existing international instruments defining the status of forces, e.g. the Agreement between the Parties to the North Atlantic Treaty regarding the status of their forces and the Agreement among the States Parties to the North Atlantic Treaty and the other States participating in the Partnership for Peace regarding the Status of their Forces and the Additional Protocol to that Agreement.

Consultations with respect to amendments to the said Provisions will be entered into at the request of either Government. Such amendments will be made by mutual consent and in writing.

Either Government may denounce this agreement by means of a notification in writing. The denunciation will take effect 1 year after the receipt of the denunciation. The Government of Denmark will inform the Steering Committee of the denunciation.

Any dispute between the two Governments concerning the interpretation or application of the said Provisions which is not settled by negotiation, will be referred for final decision to a tribunal of three arbitrators, one to be chosen by each Government and one to be chosen by the Steering Committee for the Multinational United Nations Stand-by Forces High Readiness Brigade. The tribunal will appoint one of its members as chairman.

This agreement shall be provisionally applied from the day after Your Excellency's reply.

Annex Provisions on the Status of the Planning Element in Denmark

Article 1. Basis for the establishment and operation of the Planning Element

  • 1 The Planning Element is established in accordance with the provisions set out in the Memorandum of Understanding concerning the Operation, Funding, Administration and Status of the Planning Element of the Multinational United Nations Stand-by Forces High Readiness Brigade initially signed by Denmark on 14th of March 1997, and is under the supervision of the Steering Committee for the Multinational United Nations Stand-by Forces High Readiness Brigade, as described in the Memorandum of Understanding concerning the Steering Committee initially signed by Denmark on 9th of March 1997.

  • 2 The status of the Planning Element, its officials and the Commander of the Multinational United Nations Stand-by Forces High Readiness Brigade while in the territory of Denmark is laid down in the following Provisions.

Article 2. Definitions

In the following,

  • a) the expression “SHIRBRIG" means the Multinational United Nations Stand-by Forces High Readiness Brigade, which is a pre-established (non-standing), multinational brigade at high readiness, composed of contributions to the United Nations Stand-by Arrangements System, which in accordance with national decisions can be offered to carry out peacekeeping missions mandated by the United Nations under Chapter VI of the Charter of the United Nations, including humanitarian tasks;

  • b) the expression “the Planning Element" means the multinational element, which is the permanent part of the SHIRBRIG staff, established to support the Brigade by performing pre-deployment functions;

  • c) the expression “Steering Committee for the Multinational United Nations Stand-by Forces High Readiness Brigade" means the committee, which is the executive body of the SHIRBRIG, including the Planning Element, established to provide oversight and policy guidance. (Point of contact will be the incumbent chairmanship of the Steering Committee for the multinational United Nations Stand-by Forces High Readiness Brigade);

  • d) the expression “Chief of Staff" means the head of the Planning Element;

  • e) the expression “Officials of the Planning Element" means official personnel of the Planning Element;

  • f) the expression “Commander of the SHIRBRIG" means the commander of Multinational United Nations Stand-by Forces High Readiness Brigade who, for the purpose of these Provisions, is deemed to be an official of the Planning Element;

  • g) the expression “the Government" means the Government of Denmark.

Article 3. Legal personality and capacity

  • 1 The Planning Element will have the capacity:

    • a) To enter into contracts;

    • b) To acquire and dispose of movable property;

    • c) To file, consider and settle or adjudicate claims in accordance with the Memorandum of Understanding concerning the Operation, Funding, Administration and Status of the Planning Element of the Multinational United Nations Standby Forces High Readiness Brigade;

    • d) To institute legal proceedings.

  • 2 The Planning Element and the Danish Ministry of Defence may agree that the Danish authorities will act on behalf of the Planning Element in any legal proceedings to which the Planning Element is a party before Danish courts. The costs connected to carrying out contracts or settling legal actions will be borne by the Planning Element.

Article 4. Representatives in Denmark

  • 1 The Commander of SHIRBRIG will be situated at the Planning Element in order to perform his tasks as laid down in the Memorandum of Understanding concerning the Operation, Funding, Administration and Status of the Planning Element.

  • 2 The Planning Element will be represented in Denmark by the Chief of Staff.

Article 5. Status of the premises

  • 1 Except as otherwise provided in these Provisions, the laws of Denmark will apply within the premises of the Planning Element.

  • 2 Except as otherwise provided in these Provisions, the courts or other appropriate organs of Denmark will have jurisdiction, as provided in applicable laws, over acts, transactions or omissions taking place on the premises of the Planning Element.

  • 3 The archives and other official documents of the Planning Element, wherever located, will be inviolable, unless the Chief of Staff has waived this immunity.

  • 4 Juridical actions, including service of legal process and the seizure of property will not take place within the premises of the Planning Element, except with the consent of, and under the conditions approved by, the Steering Committee of the Multinational United Nations Stand-by Forces High Readiness Brigade.

  • 5 Danish regulations on the prevention and control of infectious diseases of humans, animals and plants and on the prevention and control of plant pests apply to the Planning Element, and the Planning Element and the Danish authorities will keep each other informed of the outbreak, or suspected outbreak, development and elimination of infectious diseases, and of the measures taken.

    • a) Official motor vehicles and trailers, belonging to the Planning Element, will bear a clearly recognisable sign issued by the Danish authorities indicating that they belong to a military installation. Deviations from regulations governing conduct in road traffic are permitted to the Planning Element on such conditions and to such extent as are permitted to the Danish Armed Forces.

    • b) With regard to its official motor vehicles and trailers, the Planning Element will not be subject to Danish regulations concerning compulsory insurance of holders of motor vehicles.

  • 7 Without prejudice to these Provisions, the Planning Element will take all feasible measures to prevent its premises from being used as a refuge by persons who are avoiding arrest under any law of Denmark, who are requested by the Government for extradition to another country, or who are endeavouring to avoid service of legal process.

  • 8 The appropriate Danish authorities will exercise due diligence to ensure that the tranquillity of the premises of the Planning Element is not disturbed by any person or group of persons attempting unauthorized entry into or creating disturbances in the immediate vicinity of those premises. If so requested by the Chief of Staff the appropriate Danish authorities will provide necessary assistance for the preservation of law and order in the Planning Element and for the removal of persons from the premises.

  • 9 The appropriate Danish authorities will make every possible effort to secure public services needed by the Planning Element. Public services will be supplied in accordance with the afore-mentioned Memorandum of Understanding concerning operation, funding and administration of the Planning Element.

Article 6. Freedom of access

  • 1 Without prejudice to Article 9, the competent Danish authorities will not impede access to or from the Planning Element or the Commander of the SHIRBRIG by persons holding official post therein or by persons invited thereto in connection with the official work and activities of the Planning Element upon their arrival in or departure from Denmark.

  • 2 The Government undertakes, for this purpose, to allow the entry into and residence in Denmark of the persons, listed hereunder during the performance of their duties for the Planning Element, without charging visa fees and without delay as well as under exemption from any requirement of exit visa formalities upon departure from Denmark:

    • a) Representatives of the Steering Committee of the Multinational United Nations Stand-by Forces High Readiness Brigade, as well as representatives of the SHIRBRIG and representatives of States participating in the SHIRBRIG, and representatives from intergovernmental and other organizations, with which the SHIRBRIG or the Planning Element have established official relations, invited or entitled to participate in conferences or meetings convened in Denmark by the SHIRBRIG or the Planning Element, including alternate representatives or observers, advisers, experts and assistants, as well as their spouses and dependent members of their families;

    • b) Officials assigned to work for the Planning Element and those who have official duties with the Planning Element as well as their spouses and dependent members of their families;

    • c) All persons invited to the Planning Element on official business.

  • 3 Without prejudice to the special immunities which they may enjoy, persons referred to in paragraph 2 above may not be forced by Danish authorities to leave Danish territory unless they abuse their recognized privileges by exercising an activity incompatible with their status granted in these Provisions, and subject to the following provisions:

    • a) No action to force the persons referred to in paragraph 2 above to leave Danish territory may be taken except with the prior approval of the Danish Ministry of Foreign Affairs. Such approval will be given only after consultation with the diplomatic representatives of the State to whom the person belongs;

    • b) Persons enjoying privileges and immunities under these Provisions may not be requested to leave Danish territory except in accordance with the practices and procedures applicable to diplomats accredited to the Government;

    • c) It is understood that persons referred to in paragraph 2 above will not be exempt from the application of quarantine or other health regulations.

Article 7. Communications facilities

  • 1 For all official postal, telephone, telegraph, telephoto, telefax and electronic communications, the Government will accord to the Planning Element a treatment equivalent to that accorded to the Danish Armed Forces.

  • 2 The Government will secure the inviolability of the official correspondence of the Planning Element and will not apply any censorship to such correspondence. Such inviolability will extend, without limitation by reason of this enumeration, to publications, still and moving pictures, films and sound recordings dispatched to or by the Planning Element.

  • 3 The Planning Element will have the right to use codes, cypher and to dispatch and receive its correspondence and other materials either through the Danish Postal Service or by courier or in sealed bags, which will have the same privileges and immunities as diplomatic couriers and bags. Non-official correspondence and packages sent by or addressed to the Planning Element or its officials through the Danish Postal Service will be duly stamped in the country of origin in accordance with the provisions of the Convention and the Rules of the Universal Postal Union.

  • 4

    • a) The Planning Element may import, install and use on Danish territory such military radio stations and telecommunications facilities as may be required for the operational functions of the Planning Element. Military radio stations etc. will be used exclusively for official purposes.

    • b) The Planning Element will be subject to the same procedures and regulations concerning location, allocation and use of frequencies and technical details of the equipment, including work, services and payments for the use of frequencies, as the Danish Armed Forces.

    • c) Requests for commercial communication systems and circuits within Danish territory and applications on the use of international communication systems and circuits will be coordinated with the appropriate Danish authorities and international authorities and agencies.

    • d) The Planning Element will take all measures necessary to avoid or eliminate interference with Danish radio or telecommunication services caused by the Planning Element communication activities or other electrical facilities. The Danish authorities will take all measures to avoid or eliminate interference with the radio or telecommunication activities of the Planning Element.

    • e) The facilities provided for in this Article may, to the extent necessary for efficient operation, be established and operated outside the Planning Element with the consent of the appropriate Danish authorities.

Article 8. Property, funds and assets of the Planning Element

  • 1

    • a) The Planning Element will be exempted from customs duties on goods imported by the Planning Element itself. Imported goods will not be subject to general purchase tax upon importation. The Planning Element will be exempted from car taxes levied under the Motor Vehicles Weight Tax Act. When the Planning Element is making purchases for official use of moveable property on which value added tax has been charged or is chargeable, the appropriate Danish authorities will, whenever possible, make appropriate administrative arrangements for the reimbursement or remission of the amount of value added tax.

    • b) The Planning Element will be exempted from licence fees for radio and TV sets, procured for military purposes.

    • c) It is understood that items imported duty-free by the Planning Element for its operations will not be transferred to persons who are not entitled to enjoy this exemption until Danish duties and taxes have been paid. The time of transfer will govern the valuation for the purpose of customs clearance.

  • 2 The Planning Element may hold currency of any kind and operate accounts in any currency. Bank accounts of the Planning Element will be exempted from national currency regulations, and from national emergency measures against bank accounts.

  • 3 The property and assets of the Planning Element will be immune from search, requisition, confiscation, expropriation and any other form of interference, whether by executive, administrative, juridical or legislative actions, unless the Steering Committee of the Multinational United Nations Stand-by Forces High Readiness Brigade has waived this immunity.

Article 9. Privileges and immunities of officials of the Planning Element

  • 1 The officials of the Planning Element, with the exception of locally recruited staff and staff allocated by the Danish Armed Forces or related categories, will enjoy the following privileges and immunities. The privileges and immunities are granted as well for their spouses and dependents when referred to in the following provisions:

    • a) Immunity from legal process in respect of words spoken and written and all acts performed by them in their official capacity;

    • b) Inviolability of their personal papers and documents;

    • c) Immunity from inspection and seizure of their personal and official baggage;

    • d) Exemption for themselves and for their spouses and dependent members of the family from visa fees and immigration restrictions or aliens registration procedures;

    • e) Exemption from Danish taxation on the salaries and all other remuneration paid to them by the Planning Element and by their home states. Denmark retains the right to tax income from other sources;

    • f) In regard to foreign exchange, including holding accounts in foreign currencies, enjoyment of the same facilities as are accorded to diplomats accredited to the Government;

    • g) The same protection and repatriation facilities with respect to themselves, their spouses, their dependent relatives and other members of their households as are accorded in time of international crisis to diplomats accredited to the Government;

    • h) If they have been previously residing outside Denmark, the right to import their furniture, personal effects and all household appliances, including one motor vehicle intended for personal use, free of duty when they come to reside in Denmark. This privilege will normally be valid for a period of one year only, from the date of arrival in Denmark;

    • i) The officials of the Planning Element will have the right, once every three years, to import one motor vehicle free of customs and excise duties, including value added taxes, it being understood that permission to sell or dispose of the vehicle in the open market in Denmark will normally only be granted two years after its importation. It is further understood that customs and excise duties will become payable in the event of the sale or disposal of such motor vehicle within three years after its importation to a person who is not entitled to enjoy this exemption;

    • j) Officials of the Planning Element and their dependents are required to have a Danish driver's license. Current foreign driver's license or permits, issued in roman type by the authorities of the home state of the officials will be accepted by the Danish authorities as valid without a driving test or fee;

    • k) Military medical support will be provided by the Danish Armed Forces Health Service to officials of the Planning Element, their spouses and their dependents as laid down in the Memorandum of Understanding concerning the Operation, Funding, Administration and Status of the Planning Element, Annex G. Officials of the Planning Element, their spouses and their dependents may receive other medical and dental care on the same conditions as the members of the diplomatic mission accredited to the Government;

  • 2 The Danish Ministry of Defence will be authorized by these Provisions to furnish the officials of the Planning Element with an identity card bearing the photograph of the holder. This card may serve to identify the holder in relation to Danish authorities.

  • 3

    • a) The officials of the Planning Element may wear uniform;

    • b) The officials of the Planning Element may possess and carry arms when authorized to do so by their orders. The authorities of the State to whom the official belongs will give sympathetic consideration to requests from the Danish authorities concerning this matter.

  • 4

    • a) The Chief of Staff will communicate to the Parties the names of the officials of the Planning Element. The Chief of Staff will communicate to the Government a list of all the persons who fall within the scope of this Article. The list will be revised from time to time as may be necessary;

    • b) The privileges and immunities mentioned in this article are granted in the interest of the Planning Element and the SHIRBRIG, and not for the personal benefit of the officials themselves;

    • c) Immunity granted to any official employed by or allocated to the Planning Element will be waived whenever such immunity would impede the course of justice and can be waived without prejudice to the interest of the Planning Element. Immunity may be waived by the State to whom the official belongs.

Article 10. Cooperation with Danish authorities and implementation of the Provisions

  • 1 The Commander of the SHIRBRIG and the Chief of Staff will cooperate at all times with the appropriate authorities to facilitate the proper administration of justice, secure the observance of police regulations and avoid the occurrence of any abuse in connection with the facilities, privileges and immunities mentioned in these Provisions.

  • 2

    • a) The Planning Element may enter into the necessary practical arrangements with the appropriate Danish authorities in order to give effect to these Provisions, e.g. exemption from duties and taxes, duty-free privileges, the accounting and managing of tax-exempted supplies, and customs inspections;

    • b) Such arrangements will not be inconsistent with these Provisions. In the event of discrepancy these Provisions will prevail.

  • 3 The Planning Element will obtain appropriate approval in advance from the Danish Ministry of Defence before conducting or directing manoeuvres or other Training exercises on Danish territory.

  • 4 Upon request from the Planning Element the Danish Ministry of Defence will appoint military motor inspectors, military medical advisers and similar expertise to advise the Planning Element.

I have the honour to acknowledge the receipt of Your Excellency's Note of 5 March 1998, with annex, which reads as follows:

I have the honour to inform Your Excellency, on behalf of the Government of the Kingdom of the Netherlands, that the Government of the Kingdom of the Netherlands accepts the above proposal of the Government of Denmark and to confirm that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the Kingdom of the Netherlands and the Kingdom of Denmark on this matter which shall be provisionally applied from the day after the receipt of this reply and which shall enter into force on the first day of the second month after both States have informed each other that the constitutional procedures therefor have been complied with.

I would appreciate it if Your Excellency could confirm receipt of this reply.

(Bepalingen inzake de rechtspositie van de kernbrigade-staf in Denemarken)

Excellentie,

Ik heb de eer te verwijzen naar het Memorandum van Overeenstemming inzake de werking, de financiering, het beheer en de rechtspositie van de kernbrigadestaf van de Multinationale United Nations Stand-by Forces High Readiness Brigade, dat in eerste instantie door Denemarken is ondertekend op 14 maart 1997, en waarin is bepaald dat de rechtspositie van de kernbrigadestaf en van het personeel van deze staf uit andere landen dan het gastheerland, wordt vastgelegd in afzonderlijke regelingen (hoofdstuk 6.1).

De Regering van Denemarken heeft aangeboden voorzieningen in Denemarken beschikbaar te stellen ten behoeve van de kernbrigadestaf.

Naar aanleiding van discussies binnen de internationale Implementatiegroep van de Multinationale United Nations Stand-by Forces High Readiness Brigade heb ik de eer u te mogen voorstellen dat de rechtspositie, immuniteiten en procedures die van toepassing zijn op de kernbrigadestaf en op het personeel hiervan, luiden zoals vermeld in deze brief en in de bijlage bij deze brief (Bepalingen inzake de rechtspositie van de kernbrigadestaf in Denemarken), die de conclusies van de Implementatiegroep weergeeft. Het is de bedoeling dat de kernbrigadestaf op 3 juni 1997 met zijn werkzaamheden begint.

Indien dit voorstel, dat door genoemde Implementatiegroep is goedgekeurd, aanvaardbaar is voor de Nederlandse Regering, vormen deze brief en Uwer Excellenties antwoord daarop een verdrag tussen het Koninkrijk der Nederlanden en het Koninkrijk Denemarken, dat in werking treedt op de eerste dag van de tweede maand nadat het Koninkrijk der Nederlanden en het Koninkrijk Denemarken elkaar ervan op de hoogte hebben gebracht dat aan de daarvoor constitutioneel vereiste procedures is voldaan.

Dit Verdrag houdt een tijdelijke regeling in waarvan de bedoeling is dat deze, afhankelijk van onderhandelingen tussen de deelnemers aan de Multinationale United Nations Stand-by Forces High Readiness Brigade en afhankelijk van constitutionele vereisten, wordt vervangen door een multilateraal en wederzijds verdrag inzake de rechtspositie van de strijdkrachten, met inbegrip van de rechtspositie van de functionarissen van de kernbrigadestaf van de Multinationale United Nations Stand-by Forces High Readiness Brigade. Dit Verdrag zou gebaseerd kunnen zijn op bestaande internationale akten waarin de rechtspositie van strijdkrachten is vastgelegd, bijvoorbeeld het Verdrag tussen de Staten die Partij zijn bij het Noord-Atlantisch Verdrag, nopens de rechtspositie van hun krijgsmachten en het Verdrag tussen Staten die Partij zijn bij het Noord-Atlantisch Verdrag en de overige Staten die deelnemen aan het Partnerschap voor de Vrede, nopens de rechtspositie van hun krijgsmachten en het Aanvullend Protocol daarbij.

Overleg betreffende wijzigingen van de genoemde Bepalingen vindt plaats op verzoek van een van beide Regeringen. Deze wijzigingen geschieden schriftelijk en met wederzijdse instemming.

Elk der Regeringen kan dit Verdrag opzeggen door middel van een schriftelijke kennisgeving. De opzegging wordt van kracht een jaar na de ontvangst van de kennisgeving van opzegging. De Regering van Denemarken stelt de Stuurgroep in kennis van de opzegging.

Geschillen tussen de twee Regeringen inzake de interpretatie of de toepassing van de genoemde Bepalingen die niet door middel van onderhandelingen kunnen worden beslecht, worden ter finale beslissing voorgelegd aan een scheidsgerecht met drie scheidsrechters, waarvan een wordt gekozen door elke Regering en een door de Stuurgroep voor de Multinationale United Nations Stand-by Forces High Readiness Brigade. Het scheidsgerecht benoemt een van zijn leden tot voorzitter.

Dit verdrag wordt voorlopig toegepast vanaf de dag nadat Uwe Excellenties antwoord is ontvangen.

Gaarne maak ik van deze gelegenheid gebruik om Uwe Excellentie de hernieuwde verzekering van mijn zeer bijzondere hoogachting aan te bieden.

Artikel 1. Basis voor de oprichting en de werking van de kernbrigadestaf

  • 1 De kernbrigadestaf wordt opgericht in overeenstemming met de bepalingen genoemd in het Memorandum van Overeenstemming inzake de werking, de financiering, het beheer en de rechtspositie van de kernbrigadestaf van de Multinationale United Nations Stand-by Forces High Readiness Brigade, dat in eerste instantie door Denemarken is ondertekend op 14 maart 1997, en staat onder toezicht van de Stuurgroep voor de Multinationale United Nations Stand-by Forces High Readiness Brigade, zoals omschreven in het Memorandum van Overeenstemming inzake de Stuurgroep, dat in eerste instantie door Denemarken is ondertekend op 9 maart 1997.

  • 2 De rechtspositie van de kernbrigadestaf, van de functionarissen hiervan en van de commandant van de Multinationale United Nations Stand-by Forces High Readiness Brigade wanneer deze zich op Deens grondgebied bevinden, is vastgelegd in de volgende Bepalingen.

Artikel 2. Begripsomschrijvingen

In het navolgende wordt verstaan onder:

  • a. „SHIRBRIG", de Multinationale United Nations Stand-by Forces High Readiness Brigade, een qua opzet en samenstelling vooraf vastgestelde (niet-staande) snel inzetbare multinationale brigade, samengesteld uit bijdragen aan het United Nations Stand-by Arrangements System, die in overeenstemming met nationale besluiten kunnen worden aangeboden voor door de Verenigde Naties gemandateerde vredesoperaties onder Hoofdstuk VI van het Handvest van de Verenigde Naties, met inbegrip van humanitaire operaties;

  • b. „Kernbrigadestaf", de multinationale staf, die het permanente deel van de SHIRBRIG-staf vormt, opgericht om de Brigade te ondersteunen door middel van het verrichten van taken voorafgaand aan de ontplooiing;

  • c. „Stuurgroep voor de Multinationale United Nations Stand-by Forces High Readiness Brigade", de groep, die de uitvoerende instantie van de SHIRBRIG is, met inbegrip van de kernbrigadestaf, opgericht voor het zorgen voor toezicht en beleidsmatige sturing. (Contactpunt is het desbetreffende voorzitterschap van de Stuurgroep voor de Multinationale United Nations Stand-by Forces High Readiness Brigade);

  • d. „Stafchef", het hoofd van de kernbrigadestaf;

  • e. „Functionarissen van de kernbrigadestaf", het officiële personeel van de kernbrigadestaf;

  • f. „SHIRBRIG-commandant", de commandant van de Multinationale United Nations Stand-by Forces High Readiness Brigade, die, voor de toepassing van deze Bepalingen, wordt geacht een functionaris van de kernbrigadestaf te zijn;

  • g. „Regering", de Regering van Denemarken.

Artikel 3. Rechtspersoonlijkheid en handelingsbevoegdheid

  • 1 De kernbrigadestaf is bevoegd:

    • a. contracten aan te gaan;

    • b. roerende zaken aan te schaffen en te verkopen;

    • c. in overeenstemming met het Memorandum van Overeenstemming inzake de werking, de financiering, het beheer en de rechtspositie van de kernbrigadestaf van de Multinationale United Nations Stand-by Forces High Readiness Brigade, vorderingen in te dienen, in overweging te nemen en tot een schikking of toewijzing te komen;

    • d. een gerechtelijke procedure te starten.

  • 2 De kernbrigadestaf en het Deense Ministerie van Defensie kunnen overeenkomen dat de Deense autoriteiten bij elke gerechtelijke procedure voor Deense rechtbanken waarbij de kernbrigadestaf partij is, optreden namens de kernbrigadestaf. De kosten die verband houden met het nakomen van contracten of het voeren van gerechtelijke procedures worden gedragen door de kernbrigadestaf.

Artikel 4. Vertegenwoordigers in Denemarken

  • 1 De SHIRBRIG-commandant wordt geplaatst bij de kernbrigadestaf teneinde zijn in het Memorandum van Overeenstemming inzake de werking, de financiering, het beheer en de rechtspositie van de kernbrigadestaf vastgelegde werkzaamheden te verrichten.

  • 2 De kernbrigadestaf wordt in Denemarken vertegenwoordigd door de stafchef.

Artikel 5. Rechtspositie van het terrein en de gebouwen

  • 1 Tenzij in deze Bepalingen anders wordt bepaald, is de Deense wet van toepassing op het terrein en de gebouwen van de kernbrigadestaf.

  • 2 Tenzij in deze Bepalingen anders wordt bepaald, hebben de Deense rechtbanken of andere toepasselijke Deense instanties op grond van de toepasselijke wetten rechtsbevoegdheid over handelingen, transacties of nalatingen die zich voordoen op of in het terrein en de gebouwen van de kernbrigadestaf.

  • 3 Het archief en andere officiële stukken van de kernbrigadestaf zijn, ongeacht waar deze zich bevinden, onschendbaar, tenzij de stafchef afstand heeft gedaan van deze immuniteit.

  • 4 Rechtshandelingen, met inbegrip van de betekening van juridische stukken en de inbeslagneming van eigendommen, vinden niet plaats binnen het terrein en de gebouwen van de kernbrigadestaf, behoudens met de instemming van, en onder de voorwaarden die zijn goedgekeurd door de Stuurgroep voor de Multinationale United Nations Stand-by Forces High Readiness Brigade.

  • 5 De Deense voorschriften inzake de voorkoming en bestrijding van besmettelijke ziekten bij mensen, dieren en planten en inzake de voorkoming en bestrijding van plantenziekten, zijn van toepassing op de kernbrigadestaf; de kernbrigadestaf en de Deense autoriteiten houden elkaar op de hoogte van het uitbreken, of het vermeende uitbreken, de ontwikkeling en de uitbanning van besmettelijke ziekten, en van de genomen maatregelen.

    • a) Officiële motorvoertuigen en aanhangers die aan de kernbrigadestaf toebehoren, zijn voorzien van een duidelijk herkenbaar, door de Deense autoriteiten afgegeven kenteken, dat aangeeft dat zij tot een militaire inrichting behoren. Afwijkingen van de voorschriften inzake gedragingen in het wegverkeer zijn de kernbrigadestaf toegestaan onder dezelfde voorwaarden en in dezelfde mate als dit de Deense strijdkrachten is toegestaan.

    • b) Ten aanzien van de officiële motorvoertuigen en aanhangers, gelden voor de kernbrigadestaf niet de Deense voorschriften inzake de verplichte verzekering van houders van motorvoertuigen.

  • 7 Onverminderd het in deze Bepalingen gestelde, neemt de kernbrigadestaf alle doenlijke maatregelen om te voorkomen dat het terrein en de gebouwen worden gebruikt als toevluchtsoord voor personen die hun arrestatie op grond van de Deense wetgeving trachten te ontlopen, die door de Regering worden opgeëist voor uitlevering aan een ander land, of die trachten de betekening van juridische documenten te ontlopen.

  • 8 De bevoegde Deense autoriteiten stellen al het nodige in het werk om ervoor te zorgen dat de rust op of in het terrein en de gebouwen van de kernbrigadestaf niet wordt verstoord door personen of groepen die zich zonder toestemming toegang willen verschaffen tot het terrein en de gebouwen of die onrust veroorzaken in de directe omgeving van het terrein en de gebouwen. Op verzoek van de stafchef leveren de bevoegde Deense autoriteiten de nodige bijstand voor de handhaving van de orde bij de kernbrigadestaf en voor de verwijdering van personen van of uit het terrein en de gebouwen.

  • 9 De bevoegde Deense autoriteiten stellen al het mogelijke in het werk om in de door de kernbrigadestaf benodigde openbare diensten te voorzien. De openbare diensten worden geleverd in overeenstemming met het bovengenoemde Memorandum van Overeenstemming inzake de werking, de financiering en het beheer van de kernbrigadestaf.

Artikel 6. Vrije toegang

  • 1 Onverminderd het bepaalde in artikel 9, wordt door de bevoegde Deense autoriteiten de toegang naar of het vertrek van de kernbrigadestaf of naar of van de SHIRBRIG-commandant aan personen die daar een officiële functie hebben of aan personen die daar in verband met de officiële werkzaamheden van de kernbrigadestaf zijn uitgenodigd, bij hun aankomst in of vertrek uit Denemarken niet belet.

  • 2 De Regering verbindt zich ertoe hiervoor de binnenkomst en het verblijf in Denemarken van de hieronder genoemde personen toe te staan gedurende de uitvoering van hun taken ten behoeve van de kernbrigadestaf, zonder visumrechten te heffen en zonder vertraging, alsmede met ontheffing van alle vereiste uitreisvisa-formaliteiten bij vertrek uit Denemarken:

    • a. Vertegenwoordigers van de Stuurgroep voor de Multinationale United Nations Stand-by Forces High Readiness Brigade, alsmede vertegenwoordigers van de SHIRBRIG en vertegenwoordigers van Staten die aan de SHIRBRIG deelnemen, en vertegenwoordigers van intergouvernementele en andere organisaties, waarmee de SHIRBRIG of de kernbrigadestaf officiële betrekkingen zijn aangegaan, die zijn uitgenodigd of bevoegd om deel te nemen aan conferenties of vergaderingen die door de SHIRBRIG of door de kernbrigadestaf in Denemarken bijeen worden geroepen, met inbegrip van plaatsvervangende vertegenwoordigers of waarnemers, adviseurs, deskundigen en assistenten, alsmede hun echtgenoten en de van hen afhankelijke gezinsleden;

    • b. Functionarissen die zijn aangewezen om voor de kernbrigadestaf te werken en zij die officiële taken hebben bij de kernbrigadestaf, alsmede hun echtgenoten en de van hen afhankelijke gezinsleden;

    • c. Iedereen die voor officiële bezigheden bij de kernbrigadestaf wordt uitgenodigd.

  • 3 Onverminderd de bijzondere immuniteiten die zij genieten, kunnen de in het tweede lid bedoelde personen door de Deense autoriteiten niet worden gedwongen het Deense grondgebied te verlaten, tenzij zij de hun toegekende voorrechten misbruiken door het verrichten van activiteiten die onverenigbaar zijn met de hun in deze Bepalingen verleende rechtspositie, en afhankelijk van de volgende bepalingen:

    • a. De in het tweede lid bedoelde personen mogen niet worden gedwongen het Deense grondgebied te verlaten, tenzij met voorafgaande goedkeuring van het Deense Ministerie van Buitenlandse Zaken. Een dergelijke goedkeuring wordt uitsluitend gegeven na overleg met de diplomatieke vertegenwoordigers van de Staat waartoe de persoon behoort;

    • b. Personen die op grond van deze Bepalingen voorrechten en immuniteiten genieten, kunnen uitsluitend worden verzocht het Deense grondgebied te verlaten in overeenstemming met de praktijken en procedures die van toepassing zijn op bij de Regering geaccrediteerde diplomaten;

    • c. De in het tweede lid bedoelde personen zijn niet uitgezonderd van de toepassing van quarantaineregelingen of andere voorschriften inzake de volksgezondheid.

Artikel 7. Communicatievoorzieningen

  • 1 Wat betreft alle officiële communicatie per post, telefoon, telegraaf, telefoto, telefax en langs elektronische weg, kent de Regering aan de kernbrigadestaf een behandeling toe die gelijkwaardig is aan die welke wordt toegekend aan de Deense strijdkrachten.

  • 2 De Regering draagt zorg voor de onschendbaarheid van de officiële briefwisseling van de kernbrigadestaf en past geen enkele vorm van censuur toe op deze briefwisseling. Deze onschendbaarheid strekt zich, zonder dat deze opsomming limitatief is, uit tot: publicaties, stilstaande en bewegende beelden, films en geluidsopnames die aan of door de kernbrigadestaf worden verzonden.

  • 3 De kernbrigadestaf heeft het recht codes en versleutelde berichten te gebruiken en briefwisseling en andere materialen te verzenden en te ontvangen, hetzij via de Deense postdienst of via een koerier of in verzegelde zakken, die dezelfde voorrechten en immuniteiten genieten als diplomatieke koeriers en zakken. Niet-officiële briefwisseling en pakketten die via de Deense postdienst worden verzonden door of gericht aan de kernbrigadestaf of de functionarissen daarvan, worden naar behoren afgestempeld in het land van herkomst in overeenstemming met de bepalingen van het Verdrag en de Regels van de Wereldpostunie.

  • 4

    • a. De kernbrigadestaf is bevoegd de eventueel voor de operationele functies van de kernbrigadestaf benodigde militaire radiostations en telecommunicatievoorzieningen op Deens grondgebied te importeren, te installeren en te gebruiken. Militaire radiostations en dergelijke worden uitsluitend gebruikt voor officiële doeleinden.

    • b. Voor de kernbrigadestaf gelden dezelfde procedures en voorschriften inzake de positie, de toewijzing en het gebruik van frequenties en technische details van de uitrusting, met inbegrip van werkzaamheden, onderhoud en betalingen voor het gebruik van frequenties, als die welke voor de Deense strijdkrachten gelden.

    • c. Verzoeken om commerciële communicatiesystemen en -netwerken op Deens grondgebied en aanvragen voor het gebruik van internationale communicatiesystemen en -netten worden gecoördineerd door de bevoegde Deense autoriteiten en internationale autoriteiten en instanties.

    • d. De kernbrigadestaf neemt alle nodige maatregelen om de door de communicatie-activiteiten of andere elektrische voorzieningen van de kernbrigadestaf veroorzaakte interferentie met de Deense radio- of telecommunicatiediensten tegen te gaan of weg te nemen. De Deense autoriteiten nemen alle maatregelen om interferentie met de radio- of telecommunicatie-activiteiten van de kernbrigadestaf tegen te gaan of weg te nemen.

    • e. De in dit artikel genoemde voorzieningen kunnen, voor zover nodig voor de goede werking ervan, na toestemming van de bevoegde Deense autoriteiten, buiten de kernbrigadestaf worden opgericht en bediend.

Artikel 8. Eigendommen, gelden en financiële middelen van de kernbrigadestaf

  • 1

    • a. De kernbrigadestaf is vrijgesteld van douaneheffingen op goederen die door de kernbrigadestaf zelf worden ingevoerd. Ingevoerde goederen zijn bij invoer niet onderworpen aan omzetbelasting. De kernbrigadestaf is vrijgesteld van motorrijtuigenbelasting geheven krachtens de „[Deense] Wet inzake de belasting op het gewicht van motorrijtuigen". Indien de kernbrigadestaf voor officieel gebruik roerende zaken aanschaft waarover belasting toegevoegde waarde is of kan worden geheven, treffen de desbetreffende Deense autoriteiten, waar mogelijk, de nodige administratieve regelingen voor de teruggaaf of ontheffing van het bedrag van de belasting toegevoegde waarde.

    • b. De kernbrigadestaf is vrijgesteld van kijk- en luistergelden voor radio- en televisietoestellen die voor militaire doeleinden worden aangeschaft.

    • c. Artikelen die door de kernbrigadestaf belastingvrij worden ingevoerd ten behoeve van zijn werkzaamheden, worden niet overgedragen aan personen die geen recht hebben op deze ontheffing voordat de Deense heffingen en belastingen zijn betaald. Het tijdstip van overdracht is doorslaggevend voor de waardebepaling ten behoeve van de inklaring.

  • 2 De kernbrigadestaf kan elke munteenheid in bezit hebben en rekeningen in elke munteenheid aanhouden. Bankrekeningen van de kernbrigadestaf zijn noch onderworpen aan nationale valutavoorschriften noch aan nationale noodmaatregelen inzake bankrekeningen.

  • 3 De eigendommen en financiële middelen van de kernbrigadestaf zijn gevrijwaard van doorzoeking, vordering, inbeslagname, onteigening en alle andere vormen van bemoeienis, hetzij door executoire, administratieve, juridische of wettelijke actie, tenzij de Stuurgroep voor de Multinationale United Nations Stand-by Forces High Readiness Brigade afstand heeft gedaan van deze immuniteit.

Artikel 9. Voorrechten en immuniteiten van functionarissen van de kernbrigadestaf

  • 1 De functionarissen van de kernbrigadestaf, met uitzondering van het lokaal in dienst genomen personeel en het door de Deense strijdkrachten toegewezen personeel of daaraan gerelateerde categorieën, genieten de volgende voorrechten en immuniteiten. De voorrechten en immuniteiten worden eveneens aan hun echtgenoten en de van hen afhankelijke gezinsleden toegekend, indien zij in de volgende bepalingen worden genoemd:

    • a. Immuniteit van rechtsvervolging met betrekking tot het door hen gesproken of geschreven woord en alle door hen in de uitoefening van hun officiële functie verrichte handelingen;

    • b. Onschendbaarheid van hun persoonlijke stukken en documenten;

    • c. Immuniteit van inspectie van en beslaglegging op hun persoonlijke en officiële bagage;

    • d. Ontheffing voor henzelf en voor hun echtgenoten en de van hen afhankelijke gezinsleden van visumheffingen en inreisbeperkingen of vreemdelingenregistratie;

    • e. Ontheffing van Deense belasting op het salaris en alle andere emolumenten die hun door de kernbrigadestaf en door hun eigen land worden betaald. Denemarken behoudt zich het recht voor inkomsten uit andere bronnen te belasten;

    • f. Met betrekking tot buitenlandse valuta, met inbegrip van het aanhouden van rekeningen in vreemde valuta, het genot van dezelfde faciliteiten als worden toegekend aan bij de Regering geaccrediteerde diplomaten;

    • g. Dezelfde bescherming en repatriëringsfaciliteiten voor henzelf, hun echtgenoten, de van hen afhankelijke gezinsleden en andere leden die deel uitmaken van hun huishouding, als bij internationale crises worden toegekend aan bij de Regering geaccrediteerde diplomaten;

    • h. Indien zij voordien buiten Denemarken woonachtig waren, het recht hun huisraad, persoonlijke bezittingen en alle huishoudelijke apparatuur met inbegrip van een voor persoonlijk gebruik bedoeld motorvoertuig belastingvrij in te voeren wanneer zij in Denemarken komen wonen. Dit voorrecht is normaal gesproken slechts geldig voor een periode van een jaar, gerekend vanaf de datum van aankomst in Denemarken;

    • i. De functionarissen van de kernbrigadestaf hebben het recht eens in de drie jaar vrij van belasting en douaneheffingen, met inbegrip van de belasting toegevoegde waarde, een motorvoertuig in te voeren, waarbij geldt dat de toestemming om het voertuig in Denemarken op de vrije markt te verkopen of te vervreemden normaal gesproken pas wordt verleend twee jaar na de datum van invoer van het motorvoertuig. Voorts is bepaald dat belasting en douaneheffingen verschuldigd zijn indien het desbetreffende motorvoertuig binnen drie jaar na invoer wordt vervreemd of verkocht aan een persoon die geen recht heeft op genoemde vrijstelling;

    • j. Functionarissen van de kernbrigadestaf en de van hen afhankelijke gezinsleden worden geacht een Deens rijbewijs te bezitten. Huidige buitenlandse rijbewijzen afgegeven in romein door de autoriteiten van de Staat waartoe de functionarissen behoren, worden door de Deense autoriteiten als geldig aanvaard zonder rijvaardigheidstest of heffing;

    • k. De geneeskundige dienst van de Deense strijdkrachten geeft militaire geneeskundige ondersteuning aan de functionarissen van de kernbrigadestaf, aan hun echtgenoten en aan de van hen afhankelijke gezinsleden zoals bepaald in Bijlage G bij het Memorandum van Overeenstemming inzake de werking, de financiering, het beheer en de rechtspositie van de kernbrigadestaf. Functionarissen van de kernbrigadestaf, hun echtgenoten en de van hen afhankelijke gezinsleden kunnen andere medische en tandartszorg ontvangen onder dezelfde voorwaarden als gelden voor de leden van de bij de Regering geaccrediteerde diplomatieke vertegenwoordiging.

  • 2 Het Deense Ministerie van Defensie is op grond van deze Bepalingen gemachtigd aan de functionarissen van de kernbrigadestaf een identiteitsbewijs met daarop een foto van de houder af te geven. Dit bewijs kan dienen ter identificatie van de houder bij de Deense autoriteiten.

  • 3

    • a. De functionarissen van de kernbrigadestaf mogen uniform dragen;

    • b. De functionarissen van de kernbrigadestaf mogen wapens in hun bezit hebben en dragen, indien zij hiertoe bevoegd zijn op grond van hun orders. De autoriteiten van de Staat waartoe de functionaris behoort, neemt verzoeken van de Deense autoriteiten inzake deze aangelegenheid in welwillende overweging.

  • 4

    • a. . De stafchef doet de Partijen de namen van de functionarissen van de kernbrigadestaf toekomen. De stafchef doet de Regering een lijst toekomen van alle personen waarop dit artikel van toepassing is. Indien nodig wordt de lijst van tijd tot tijd herzien;

    • b. De in dit artikel genoemde voorrechten en immuniteiten worden verleend in het belang van de kernbrigadestaf en de SHIRBRIG, en niet ten behoeve van het persoonlijk gewin van de functionarissen zelf;

    • c. De aan een bij de kernbrigadestaf werkzame of hieraan toegewezen functionaris verleende immuniteit wordt ingetrokken wanneer deze de rechtsgang zou belemmeren en kan worden ingetrokken zonder afbreuk te doen aan het belang van de kernbrigadestaf. De immuniteit kan worden ingetrokken door de Staat waartoe de functionaris behoort.

Artikel 10. Samenwerking met de Deense autoriteiten en uitvoering van de Bepalingen

  • 1 De SHIRBRIG-commandant en de stafchef werken te allen tijde samen met de bevoegde autoriteiten ter bevordering van een goede rechtsbedeling, ter naleving van de politievoorschriften en ter voorkoming van misbruik met betrekking tot de in deze Bepalingen genoemde faciliteiten, voorrechten en immuniteiten.

  • 2

    • a. . De kernbrigadestaf kan de nodige praktische regelingen treffen met de bevoegde Deense autoriteiten teneinde uitvoering te geven aan deze Bepalingen, bijvoorbeeld vrijstelling van heffingen en belastingen, belastingvrijdom, het administreren en beheren van belastingvrije bevoorrading, en douane-inspecties;

    • b. Dergelijke regelingen mogen niet onverenigbaar zijn met deze Bepalingen. In geval van onderlinge afwijking zijn deze Bepalingen doorslaggevend.

  • 3 De kernbrigadestaf moet voorafgaand aan het uitvoeren of leiden van manoeuvres of andere oefeningen op Deens grondgebied de benodigde goedkeuring verkrijgen van het Deense Ministerie van Defensie.

  • 4 Op verzoek van de kernbrigadestaf benoemt het Deense Ministerie van Defensie militaire motorinspecteurs, militaire medische adviseurs en soortgelijke expertise ter advisering van de kernbrigadestaf.

Ik heb de eer Uwe Excellentie namens de Regering van het Koninkrijk der Nederlanden ervan op de hoogte te brengen dat de Regering van het Koninkrijk der Nederlanden bovenstaand voorstel van de Regering van Denemarken aanvaardt en te bevestigen dat Uwer Excellenties brief en dit antwoord worden beschouwd als een verdrag tussen het Koninkrijk der Nederlanden en het Koninkrijk Denemarken, dat vanaf de dag na ontvangst van dit antwoord voorlopig wordt toegepast en dat in werking treedt op de eerste dag van de tweede maand nadat beide Staten elkaar ervan op de hoogte hebben gebracht dat aan de daarvoor constitutioneel vereiste procedures is voldaan. Ik stel het op prijs als Uwe Excellentie de ontvangst van dit antwoord zou willen bevestigen.

Gaarne maak ik van deze gelegenheid gebruik om Uwe Excellentie de hernieuwde verzekering van mijn zeer bijzondere hoogachting aan te bieden.
