Agreement concerning the Adoption of Harmonized Technical United Nations Regulations for Wheeled Vehicles, Equipment and Parts which can be Fitted and/or be Used on Wheeled Vehicles and the Conditions for Reciprocal Recognition of Approvals Granted on the Basis of these United Nations Regulations1

Preamble

The Contracting Parties,

Having decided to amend the Agreement Concerning the Adoption of Uniform Conditions of Approval and Reciprocal Recognition of Approval for Motor Vehicle Equipment and Parts, done at Geneva on 20 March 1958, as amended on 16 October 1995, and

Desiring to reduce technical barriers to international trade by defining harmonized technical UN Regulations that it will suffice for certain wheeled vehicles, equipment and parts to fulfil in order to be used in their countries or regions,

Recognizing the importance of safety, environmental protection, energy efficiency and anti-theft performance of wheeled vehicles, equipment and parts, which can be fitted and/or be used on wheeled vehicles for the development of regulations that are technically and economically feasible and adapted to technical progress,

Desiring to apply these UN Regulations whenever possible in their countries or regions,

Desiring to facilitate the acceptance in their countries of the vehicles, equipment and parts, where approved according to these UN Regulations by the approval authorities of another Contracting Party,

Desiring to establish an International Whole Vehicle Type Approval scheme (IWVTA) within the framework of the Agreement to increase the advantages of individual UN Regulations annexed to the Agreement and so create opportunities to simplify implementation by Contracting Parties and the wider adoption of mutual recognition of type approvals for whole vehicles, and,

Desiring to increase the number of Contracting Parties to the Agreement by improving its functioning and reliability, and thus ensure that it remains the key international framework for the harmonization of technical regulations in the automotive sector,

Have agreed as follows:

Article 1

  • 1 The Contracting Parties shall establish, through an Administrative Committee made up of all the Contracting Parties in conformity with the rules of procedure set out in the Appendix to this Agreement and on the basis of the following articles, paragraphs, UN Regulations for wheeled vehicles, equipment and parts which can be fitted and/or be used on wheeled vehicles. Conditions for granting type approvals and their reciprocal recognition will be included for use by Contracting Parties which choose to implement Regulations through type approval.

    For the purposes of this Agreement:

    The term “wheeled vehicles, equipment and parts” shall include any wheeled vehicles, equipment and parts whose characteristics have a bearing on vehicle safety, protection of the environment, energy saving and the performance of anti-theft technology.

    The term “type approval pursuant to a UN Regulation” indicates an administrative procedure by which the approval authorities of one Contracting Party declare, after carrying out the required verifications that a type of vehicle, equipment or part submitted by the manufacturer conforms to the requirements of the given UN Regulation. Afterwards the manufacturer certifies that each vehicle, equipment or parts put on the market were produced to be identical with the approved product.

    The term “whole vehicle type approval” indicates that type approvals granted pursuant to applicable UN Regulations for wheeled vehicles, equipment and parts of a vehicle are integrated into an approval of the whole vehicle according to the provisions of the administrative IWVTA system.

    The term “version of a UN Regulation” indicates that a UN Regulation, following its adoption and establishment, may subsequently be amended following the procedures described in this Agreement, in particular Article 12. The unamended UN Regulation as well as the UN Regulation, after integration of subsequent amendment(s), are considered to be separate versions of that UN Regulation.

    The term “applying a UN Regulation” indicates that a UN Regulation enters into force for a Contracting Party. When doing so, Contracting Parties have the possibility to keep their own national/regional legislation. If they wish, they may substitute their national/regional legislation by the requirements of the UN Regulations they are applying, but they are not bound by the Agreement to do so. However, Contracting Parties shall accept, as an alternative to the relevant part of their national/regional legislation, UN type approvals granted pursuant to the latest version of UN Regulations applied in their country/region. The rights and obligations of Contracting Parties applying a UN Regulation are detailed in the various articles of this Agreement.

    For the application of the UN Regulations there could be various administrative procedures alternative to type approval. The only alternative procedure generally known and applied in certain member States of the Economic Commission for Europe is the self-certification by which the manufacturer certifies, without any preliminary administrative control, that each product put on the market conforms to the given UN Regulation; the competent administrative authorities may verify by random sampling on the market that the self-certified products comply with the requirements of the given UN Regulation.

  • 2 The Administrative Committee shall be composed of all the Contracting Parties in accordance with the rules of procedure set out in the Appendix.

    A UN Regulation, after having been established in accordance with the procedure indicated in the Appendix, shall be communicated by the Administrative Committee to the Secretary-General of the United Nations, hereinafter called “Secretary-General”. As soon as possible thereafter, the Secretary-General shall give notification of this UN Regulation to the Contracting Parties.

    The UN Regulation will be considered as adopted unless, within a period of six months from its notification by the Secretary-General, more than one-fifth of the Contracting Parties at the time of notification have informed the Secretary-General of their disagreement with the UN Regulation.

    The UN Regulation shall cover the following:

    • a) Wheeled vehicles, equipment or parts concerned;

    • b) Technical requirements, which shall be performance oriented wherever appropriate and not design-restrictive, that give objective consideration to available technologies, costs and benefits as appropriate, and may include alternatives;

    • c) Test methods by which any performance requirements are to be demonstrated;

    • d) Conditions for granting type approval and their reciprocal recognition including administrative provisions, any approval markings and conditions for ensuring conformity of production;

    • e) The date(s) on which the UN Regulation enters into force, including the date when Contracting Parties applying it can issue approvals pursuant to that UN Regulation, and the date from which they shall accept approvals (if different);

    • f) An information document to be provided by the manufacturer.

    The UN Regulation may, if needed, include references to the laboratories accredited by the approval authorities where acceptance tests of the types of wheeled vehicles, equipment or parts submitted for approval shall be carried out.

    In addition to the above-mentioned UN Regulations, this Agreement provides for establishing a UN Regulation to introduce a system of Whole Vehicle Type Approval. This UN Regulation shall set the scope, administrative procedures, and technical requirements that can include different levels of stringency in one version of the said UN Regulation.

    Notwithstanding other provisions of Article 1 and Article 12, a Contracting Party applying the UN Regulation on IWVTA shall only be obliged to accept those type approvals granted pursuant to the highest level of stringency of the latest version of the said UN Regulation.

    This Agreement also includes Schedules of Administrative and Procedural Provisions applicable to all UN Regulations annexed to this Agreement and to all Contracting Parties applying one or more UN Regulations.

  • 3 When a UN Regulation has been adopted, the Secretary-General shall so notify as soon as possible all the Contracting Parties, specifying which Contracting Parties have objected, or have notified their agreement but intention not to begin applying the UN Regulation at the date of entry into force, and in respect of which the UN Regulation shall not enter into force.

  • 4 The adopted UN Regulation shall enter into force on the date(s) specified therein as a UN Regulation annexed to this Agreement for all Contracting Parties which have not notified either their disagreement, or their intention not to apply it on that date.

  • 5 When depositing its instrument of accession, any new Contracting Party may declare that it will not apply certain UN Regulations then annexed to this Agreement or that it will not apply any of them. If, at that time, the procedure laid down in paragraphs 2, 3, and 4 of this Article is in progress for a draft or adopted UN Regulation, the Secretary-General shall communicate such draft or adopted UN Regulation to the new Contracting Party and it shall enter into force as a UN Regulation for the new Contracting Party unless this Contracting Party notifies its disagreement with the adopted UN Regulation within a period of six months after the deposit of its instrument of accession. The Secretary-General shall notify all the Contracting Parties of the date of such entry into force. The Secretary-General shall also communicate to them all declarations concerning the non-application of certain UN Regulations that any Contracting Party may make in accordance with the terms of this paragraph.

  • 6 Any Contracting Party applying a UN Regulation may at any time notify the Secretary-General, subject to one year’s notice, about its intention to cease applying that UN Regulation. Such notification shall be communicated by the Secretary-General to the other Contracting Parties.

    Approvals previously granted pursuant to that UN Regulation by that Contracting Party shall remain valid unless they are withdrawn in accordance with the provisions of Article 4.

    If a Contracting Party ceases to issue approvals to a UN Regulation it shall:

    • a) Maintain proper supervision on conformity of production of products for which it previously granted type approval;

    • b) Take the necessary steps set out in Article 4 when advised of non-conformity by a Contracting Party that continues to apply the UN Regulation;

    • c) Continue to notify the other Contracting Parties of withdrawal of approvals as set out in Article 5;

    • d) Continue to grant extensions to existing approvals.

  • 7 Any Contracting Party not applying a UN Regulation may at any time notify the Secretary-General that it intends henceforth to apply it and the UN Regulation will then enter into force for this Party on the sixtieth day after this notification. The Secretary-General shall notify all the Contracting Parties of every entry into force of a UN Regulation for a new Contracting Party affected in accordance with the terms of this paragraph.

  • 8 The Contracting Parties for which a UN Regulation is in force shall hereinafter be referred to as “the Contracting Parties applying a UN Regulation”.

Article 2

  • 1 Each Contracting Party applying UN Regulations largely through type approval shall grant the type approvals and approval markings described in any UN Regulation for the types of wheeled vehicles, equipment or parts covered by the UN Regulation, provided that it has the technical competence and is satisfied with the arrangements for ensuring conformity of the product with the approved type. Each Contracting Party which grants type approval shall take the necessary measures as set out in Schedule 1 annexed to this Agreement to verify that adequate arrangements have been made to ensure that wheeled vehicles, equipment and parts are manufactured in conformity with the approved type.

  • 2 Each Contracting Party issuing type approvals pursuant to a UN Regulation shall specify an approval authority for the UN Regulation. The approval authority shall have the responsibility for all aspects of type approval pursuant to the said UN Regulation. This approval authority may designate technical services to carry out on its behalf the testing and inspections necessary for the verifications required in paragraph 1 of this article. Contracting Parties shall ensure that technical services are assessed, designated and notified in accordance with the requirements set out in Schedule 2 annexed to this Agreement.

  • 3 The type approvals, approval markings and identifiers for the types of wheeled vehicles, equipment and parts shall be specified in the UN Regulation and granted in accordance with the procedures set out in Schedules 3 to 5 annexed to this Agreement.

  • 4 Each Contracting Party applying a UN Regulation shall refuse to grant the type approvals and approval markings covered by the UN Regulation if the above-mentioned conditions are not complied with.

Article 3

  • 1 Wheeled vehicles, equipment or parts for which type approvals have been issued by a Contracting Party in accordance with Article 2 of this Agreement, shall be held to be in conformity with the relevant part of the national legislation of all the Contracting Parties applying the said UN Regulation.

  • 2 Contracting Parties applying UN Regulations shall, by mutual recognition, accept for the placement in their markets, and subject to the provisions of Articles 1, 8 and 12 as well as any special provisions within these UN Regulations, type approvals granted pursuant to these UN Regulations, without requiring any further testing, documentation, certification or marking concerning these type approvals.

Article 4

  • 1 Should a Contracting Party applying a UN Regulation find that certain wheeled vehicles, equipment or parts bearing approval markings issued under the said UN Regulation by one of the Contracting Parties, do not conform to the approved types or the requirements of the said UN Regulation, they shall advise the approval authority of the Contracting Party which issued the approval.

    The Contracting Party that issued the approval shall take the necessary steps to ensure that the non-conformity is rectified.

  • 2 When the non-conformity is due to non-compliance with the technical requirements specified in a UN Regulation, as referred to in Article 1.2.(b), the Contracting Party that issued the approval shall immediately inform all other Contracting Parties about the situation and shall provide regular advice to Contracting Parties of the steps it is taking, which may include, if necessary, the withdrawal of the approval.

    After having considered the potential impact on vehicle safety, protection of the environment, energy saving or the performance of anti-theft technology, Contracting Parties may prohibit the sale and use of such wheeled vehicles, equipment or parts in their territory until this non-conformity is rectified. In such a case, these Contracting Parties shall inform the secretariat of the Administrative Committee of the measures taken. For resolution of disputes between the Contracting Parties, the procedure provided in Article 10.4 shall apply.

  • 3 Notwithstanding the provisions of paragraph 1 of this Article, if a non-conforming product, as referred to in paragraph 2 of this Article, has not been brought into conformity within a period of three months, the Contracting Party responsible for the approval shall temporarily or permanently withdraw the approval. By exception, this period may be extended by a period not exceeding three months unless one or more Contracting Parties applying the concerned UN Regulation object. When the period is being extended, the Contracting Party that issued the approval shall, within the initial three-month period, notify all Contracting Parties applying the concerned UN Regulation of their intention to extend the period in which the non-conformity shall be rectified and provide a justification for such extension.

  • 4 When the non-conformity is due to non-compliance with the administrative provisions, approval markings, conditions for conformity of production or the information document specified in a UN Regulation, as referred to in Article 1.2.(d) and 1.2.(f), the Contracting Party that issued the approval shall temporarily or permanently withdraw the approval if the non-conformity has not been rectified within a period of six months.

  • 5 Paragraphs 1 to 4 of this Article also apply in the situation where the Contracting Party responsible for issuing of the approval itself finds that certain wheeled vehicles, equipment or parts bearing approval markings do not conform to the approved types or the requirements of a UN Regulation.

Article 5

  • 1 The approval authorities of each Contracting Party applying UN Regulations shall send upon the request from the other Contracting Parties, a list of the wheeled vehicles, equipment or parts, of which it has refused to grant or has withdrawn approvals.

  • 2 In addition, on receiving a request from another Contracting Party applying a UN Regulation, it shall send forthwith, in accordance with the provisions of Schedule 5 annexed to this Agreement, to that Contracting Party a copy of all relevant information on which it based its decision to grant, refuse to grant, or to withdraw an approval of a wheeled vehicle, equipment or part pursuant to that UN Regulation.

  • 3 The paper copy may be replaced by an electronic file in accordance with Schedule 5 annexed to this Agreement.

Article 6

  • 1 Countries members of the Economic Commission for Europe, countries admitted to the Commission in a consultative capacity in accordance with paragraph 8 of the Commission’s Terms of Reference, and regional economic integration organizations set up by countries members of the Economic Commission for Europe to which their member States have transferred powers in the fields covered by this Agreement, including the power to make binding decisions on their member States, may become Contracting Parties to this Agreement.

    For the determination of the number of votes referred to in Article 1, paragraph 2 and in Article 12, paragraph 2, regional economic integration organizations vote with the number of votes of their member States being members of the Economic Commission for Europe.

  • 2 Countries members of the United Nations as may participate in certain activities of the Economic Commission for Europe in accordance with paragraph 11 of the Commission's Terms of Reference and regional economic integration organizations of such countries to which their member States have transferred powers in the fields covered by this Agreement including power to make binding decisions on their member States may become Contracting Parties to this Agreement.

    For the determination of the number of votes referred to in Article 1, paragraph 2 and in Article 12, paragraph 2, regional economic integration organizations vote with the number of votes of their member States being members of the United Nations.

  • 3 Accession to this Agreement by new Contracting Parties which are not Parties to the 1958 Agreement shall be effected by the deposit of an instrument with the Secretary-General, after the entry into force of this Agreement.

Article 7

  • 1 This Agreement shall be deemed to enter into force nine months after the date of its transmission by the Secretary-General to all the Contracting Parties to the 1958 Agreement.

  • 2 This Agreement shall be deemed not to enter into force if any objection from the Contracting Parties to the 1958 Agreement is expressed within a period of six months following the date of its transmission to them by the Secretary-General.

  • 3 For any new Contracting Party acceding to this Agreement, this Agreement shall enter into force on the sixtieth day after the deposit of the instrument of accession.

Article 8

  • 1 Any Contracting Party may denounce this Agreement by notifying the Secretary-General.

  • 2 Denunciation shall take effect twelve months after the date of receipt by the Secretary-General of such notification.

  • 3 Any type approvals granted by the Contracting Party shall remain valid for a period of twelve months after the denunciation has taken effect in accordance with Article 8.2.

Article 9

  • 1 Any Contracting Party as defined in Article 6 of this Agreement may, at the time of accession or at any time thereafter, declare by notification addressed to the Secretary-General that this Agreement shall extend to all or any of the territories for whose international relations it is responsible. The Agreement shall extend to the territory or territories named in the notification as from the sixtieth day after its receipt by the Secretary-General.

  • 2 Any Contracting Party as defined in Article 6 of this Agreement which has made a declaration in accordance with paragraph 1 of this Article extending this Agreement to any territory for whose international relations it is responsible may denounce the Agreement separately in respect of that territory, in accordance with the provisions of Article 8.

Article 10

  • 1 Any dispute between two or more Contracting Parties concerning the interpretation or application of this Agreement shall, so far as possible, be settled by negotiation between them.

  • 2 Any dispute which is not settled by negotiation shall be submitted to arbitration if any one of the Contracting Parties in dispute so requests and shall be referred accordingly to one or more arbitrators selected by agreement between the Parties in dispute. If within three months from the date of the request for arbitration the Parties in dispute are unable to agree on the selection of an arbitrator or arbitrators, any of those Parties may request the Secretary-General to nominate a single arbitrator to whom the dispute shall be referred for decision.

  • 3 The decision of the arbitrator or arbitrators appointed in accordance with paragraph 2 of this Article shall be binding on the Contracting Parties in dispute.

  • 4 Any dispute between two or more Contracting Parties concerning the interpretation or application of UN Regulations annexed to this Agreement shall be settled by negotiation in accordance with the procedure set out in Schedule 6 annexed to this Agreement.

Article 11

  • 1 Any Contracting Party may, at the time of acceding to this Agreement, declare that it does not consider itself bound by paragraphs 1 to 3 of Article 10 of the Agreement. Other Contracting Parties shall not be bound by paragraphs 1 to 3 of Article 10 in respect of any Contracting Party which has entered such a reservation.

  • 2 Any Contracting Party having entered a reservation as provided for in paragraph 1 of this Article may at any time withdraw such reservation by notifying the Secretary-General.

  • 3 No other reservation to this Agreement, its Appendix, Schedules and the UN Regulations annexed thereto shall be permitted; but any Contracting Party may, in accordance with the terms of Article 1, paragraph 5, declare that it does not intend to apply certain of the UN Regulations or that it does not intend to apply any of them.

Article 12

The UN Regulations annexed to this Agreement may be amended in accordance with the following procedure:

  • 1. Amendments to UN Regulations shall be established by the Administrative Committee as described in Article 1, paragraph 2 and in accordance with the procedure indicated in the Appendix.

    An amendment to the UN Regulation, after having been established, shall be communicated by the Administrative Committee to the Executive Secretary of the United Nations Economic Commission for Europe. As soon as possible thereafter, the Executive Secretary of the United Nations Economic Commission for Europe shall give notification of this amendment to the Contracting Parties applying the UN Regulation and the Secretary-General.

  • 2. An amendment to a UN Regulation will be considered to be adopted unless, within a period of six months from its notification by the Executive Secretary of the United Nations Economic Commission for Europe, more than one-fifth of the Contracting Parties applying the UN Regulation at the time of notification have informed the Secretary-General of their disagreement with the amendment. When an amendment to a UN Regulation is adopted, the Secretary-General shall as soon as possible declare the amendment as adopted and binding upon those Contracting Parties applying the UN Regulation.

  • 3. Amendments to a UN Regulation may include transitional provisions relating to the entry into force of the amended UN Regulation, the date up to which Contracting Parties shall accept approvals pursuant to the preceding version of the UN Regulation and the date as from which Contracting Parties shall not be obliged to accept type approvals issued pursuant to the preceding version of the amended UN Regulation.

  • 4. Notwithstanding that transitional provisions in any version of UN Regulations may have stipulated otherwise, Contracting Parties to this Agreement which are applying UN Regulations may, subject to compliance with the provisions of Article 2, nevertheless issue type approvals pursuant to earlier versions of UN Regulations. However, subject to paragraph 3 of this Article, Contracting Parties applying a UN Regulation shall not be obliged to accept type approvals issued pursuant to these earlier versions.

  • 5. All Contracting Parties applying a UN Regulation, except for Contracting Parties which notified the Secretary-General of their intention to cease applying the UN Regulation, shall accept approvals granted pursuant to the latest version of that UN Regulation. A Contracting Party which notified the Secretary-General of its intention to cease applying a UN Regulation shall, during the one-year period mentioned in paragraph 6 of Article 1, accept approvals granted pursuant to the version(s) of the UN Regulation applicable for that Contracting Party at the instance of its notification to Secretary-General.

  • 6. A Contracting Party applying a UN Regulation may grant an exemption approval pursuant to a UN Regulation for a single type of wheeled vehicle, equipment or part which is based on a new technology, when this new technology is not covered by the existing UN Regulation, and is incompatible with one or more requirements of this UN Regulation. In such a case, the procedures set out in Schedule 7 annexed to this Agreement shall apply.

  • 7. Should a new Contracting Party accede to this Agreement between the time of the notification of the amendment to a UN Regulation by the Executive Secretary of the United Nations Economic Commission for Europe and its entry into force, the UN Regulation in question shall enter into force for that Contracting Party unless, within a period of six months from its notification of accession by the Secretary-General, that Party has informed the Secretary-General of its disagreement with the amendment.

Article 13

The text of the Agreement itself and of its Appendix may be amended in accordance with the following procedure:

  • 1. Any Contracting Party may propose one or more amendments to this Agreement and its Appendix. The text of any proposed amendment to the Agreement and its Appendix shall be transmitted to the Secretary-General, who shall transmit it to all Contracting Parties and inform all other countries referred to in paragraph 1 of Article 6 thereof.

  • 2. Any proposed amendment circulated in accordance with paragraph 1 of this Article shall be deemed to be accepted if no Contracting Party expresses an objection within a period of nine months following the date of circulation of the proposed amendment by the Secretary-General.

  • 3. The Secretary-General shall, as soon as possible, notify all Contracting Parties whether an objection to the proposed amendment has been expressed. If an objection to the proposed amendment has been expressed, the amendment shall be deemed not to have been accepted, and shall be of no effect whatsoever. If no such objection has been expressed, the amendment shall enter into force for all Contracting Parties three months after the expiry of the period of nine months referred to in paragraph 2 of this Article.

Article 13 bis

  • 1 The Schedules of Administrative and Procedural Provisions annexed to this Agreement may be amended in accordance with the following procedure:

    • 1.1. Amendments to the Schedules of Administrative and Procedural Provisions shall be established by the Administrative Committee as referred to in Article 1.1 and in accordance with the procedure indicated in Article 7 of the Appendix to this Agreement.

    • 1.2. An amendment to the Schedules of Administrative and Procedural Provisions shall be communicated by the Administrative Committee to the Secretary-General. As soon as possible thereafter, the Secretary-General shall give notification of this amendment to the Contracting Parties applying one or more UN Regulations.

  • 2 An amendment to the Schedules of Administrative and Procedural Provisions will be considered to be adopted unless2, within a period of six months from its notification by the Secretary-General, no Contracting Party applying one or more UN Regulations has informed the Secretary-General of its disagreement with the amendment.

  • 3 The Secretary-General shall, as soon as possible, notify all Contracting Parties to the Agreement applying one or more UN Regulations whether an objection to the proposed amendment has been expressed. If an objection to the proposed amendment has been expressed, the amendment shall be deemed not accepted, and shall be of no effect whatsoever. If no such objection has been expressed, the amendment shall enter into force for all Contracting Parties applying one or more UN Regulations three months after the expiry of the period of six months referred to in paragraph 2 of this Article.

  • 4 A new schedule shall be considered as an amendment to the Schedules of Administrative and Procedural Provisions and, therefore, established according to the same procedure as specified in this Article.

Article 14

  • 2 In accordance with the provisions of this Agreement and the annexed Schedules of Administrative and Procedural Provisions, the Executive Secretary of the United Nations Economic Commission for Europe shall notify:

    • a) The Secretary-General and the Contracting Parties of the establishment of an amendment to a UN Regulation in accordance with paragraph 2 of Article 12;

    • b) The Contracting Parties of the decision by Administrative Committee on an exemption approval request and, subsequently, of its adoption in accordance with paragraph 5 of Schedule 7.

Article 15

  • 1 If at the date the above provisions come into effect the procedures envisaged in Article 1, paragraphs 3 and 4 of the previous version of the Agreement are under way for adopting a new UN Regulation, the said new UN Regulation shall enter into force under the provisions of paragraph 4 of the said Article.

  • 2 If at the date the above provisions come into effect, the procedures envisaged in Article 12, paragraph 1 of the previous version of the Agreement are under way for the adoption of an amendment to a UN Regulation, the said amendment shall enter into force under the provisions of the said Article.

  • 3 If all Contracting Parties to the Agreement agree, any UN Regulation adopted under the terms of the previous version of the Agreement may be treated as though it were a UN Regulation adopted under the terms of the above provisions.

Article 16

This Agreement was done at Geneva in a single copy in the English, French and Russian languages, each text being equally authentic.

Appendix Composition and rules of procedure of the Administrative Committee

Article 1

The members of the Administrative Committee shall be composed of all the Contracting Parties to the amended Agreement.

Article 2

The Executive Secretary of the United Nations Economic Commission for Europe shall provide the Committee with secretariat services.

Article 3

The Committee shall, at its first session each year, elect a chairman and vice-chairman.

Article 4

The Secretary-General of the United Nations shall convene the Committee under the auspices of the Economic Commission for Europe whenever a new UN Regulation, an amendment to a UN Regulation, a notification according to the procedure for an exemption approval for new technologies (set out in Schedule 7) or an amendment to the Schedules of Administrative and Procedural Provisions is required to be established.

Article 5

Proposed new UN Regulations shall be put to the vote. Each country, Contracting Party to the Agreement shall have one vote. A quorum consisting of not less than half of the Contracting Parties is required for the purposes of taking decisions. For the determination of the quorum regional economic integration organizations, being Contracting Parties to the Agreement, vote with the number of votes of their member States. The representative of a regional economic integration organization may deliver the votes of its constituent sovereign countries. New draft UN Regulations shall be established by a four-fifths majority of those present and voting.

Article 6

Proposed amendments to UN Regulations shall be put to the vote. Each country, Contracting Party to the Agreement applying the UN Regulation shall have one vote. A quorum of not less than half of the Contracting Parties applying the UN Regulation is required for the purposes of taking decisions. For the determination of the quorum, regional economic integration organizations, being Contracting Parties to the Agreement, vote with the number of votes of their member States. The representative of a regional economic integration organization may deliver the votes of those of its constituent sovereign countries which apply the UN Regulation. Draft amendments to UN Regulations shall be established by a four-fifths majority of those present and voting.

Article 7

Proposed amendments to the Schedules of Administrative and Procedural Provisions annexed to this Agreement shall be put to the vote. Each Contracting Party to the Agreement applying one or more UN Regulations shall have one vote. A quorum of not less than half of the Contracting Parties to the Agreement applying one or more UN Regulations is required for the purposes of taking decisions. For the determination of the quorum, regional economic integration organizations, being Contracting Parties to the Agreement, vote with the number of votes of their member States. The representative of a regional economic integration organization may deliver the votes of those of its constituent sovereign countries which apply one or more UN Regulations. Draft amendments to the Schedules of Administrative and Procedural Provisions shall be established by unanimous vote of those present and voting.

Article 8

The request of a Contracting Party for an authorization to grant a proposed exemption approval concerning new technologies shall be put to the vote. Each Contracting Party applying the UN Regulation shall have one vote. A quorum of not less than half of the Contracting Parties applying the UN Regulation is required for the purposes of taking decisions. For the determination of the quorum, regional economic integration organizations, being Contracting Parties to the Agreement, vote with the number of votes of their member States. The representative of a regional economic integration organization may deliver the votes of those of its constituent sovereign countries which apply the UN Regulation. The authorization to grant an exemption approval for the said Contracting Party shall be established by a four-fifths majority of those present and voting.

Schedule 1. Conformity of production procedures

Objectives

The conformity of production procedure aims to ensure that each produced wheeled vehicle, equipment or part is in conformity with the approved type.

Procedures include inseparably the assessment of quality management systems, referred to below as “initial assessment” and verification of the approval subject and product-related controls, referred to as “product conformity arrangements”.

1. Initial assessment

  • 1.1. The approval authority of a Contracting Party shall verify – before granting UN type approval – the existence of satisfactory arrangements and procedures for ensuring effective control so that wheeled vehicles, equipment or parts when in production conform to the approved type.

  • 1.2. Guidance for conducting assessments may be found in the international standard ISO 19011:2011 – Guidelines for auditing management systems.

  • 1.3. The requirement in paragraph 1.1 shall be verified to the satisfaction of the authority granting UN type approval.

    The approval authority granting UN type approval shall be satisfied with the initial assessment and the product conformity arrangements in section 2 below, taking into account as necessary one of the arrangements described in paragraphs 1.3.1 to 1.3.3, or a combination of those arrangements in full or in part as appropriate.

    • 1.3.1. The actual initial assessment and/or verification of product conformity arrangements shall be carried out by the approval authority granting UN type approval or by a technical service designated to act on behalf of that approval authority.

      • 1.3.1.1. When considering the extent of the initial assessment to be carried out, the approval authority may take account of available information relating to:

        • a) The manufacturer's certification described in paragraph 1.3.3 below, which has not been qualified or recognized under that paragraph;

        • b) In the case of UN type approval of equipment or parts, quality system assessments performed by vehicle manufacturer(s), in the premises of the manufacturer(s) of the equipment or parts, according to one or more of the industry sector specifications satisfying the requirements in the international standard ISO 9001:2008.

    • 1.3.2. The actual initial assessment and/or verification of product conformity arrangements may also be carried out by the approval authority of another Contracting Party, or the technical service designated for this purpose by the latter approval authority, provided this Contracting Party applies at least the same UN Regulations upon which the UN type approval has been based.

      • 1.3.2.1. In such a case, the approval authority of the other Contracting Party shall prepare a statement of compliance outlining the areas and production facilities it has covered as relevant to the product(s) to be type approved and to the UN Regulations according to which these products are to be type approved.

      • 1.3.2.2. On receiving an application for a compliance statement from the approval authority of a Contracting Party granting UN type approval, the approval authority of another Contracting Party shall send forthwith the statement of compliance or advise that it is not in a position to provide such a statement.

      • 1.3.2.3. The statement of compliance shall include at least the following:

        • a) Group or company (e.g. XYZ Automotive);

        • b) Particular organization (e.g. Regional division);

        • c) Plants/sites (e.g. Engine plant 1 (in country A) – Vehicle plant 2 (in country B));

        • d) Vehicle/Component range (e.g. all category M1 models);

        • e) Areas assessed (e.g. Engine assembly, body pressing and assembly, vehicle assembly);

        • f) Documents examined (e.g. Company and site quality manual and procedures);

        • g) Date of the assessment (e.g. Audit conducted from dd/mm/yyyy to dd/mm/yyyy);

        • h) Planned monitoring visit (e.g. mm/yyyy).

    • 1.3.3. The approval authority may also accept the manufacturer's certification to the international standard ISO 9001:2008 (the scope of this certification shall cover the product(s) to be approved) or an equivalent accreditation standard as satisfying the initial assessment requirements of paragraph 1.1. The manufacturer shall provide details of the certification and undertake to inform the approval authority of any revisions to its validity or scope of that certification.

  • 1.4. For the purpose of the International Whole Vehicle Type Approval, the initial assessments carried out for granting UN approvals for equipment and parts of the vehicle need not be repeated but shall be completed by an assessment covering the areas not covered by the former assessments, in particular, in relation to the assembly of the whole vehicle.

2. Product conformity arrangements

  • 2.1. Every vehicle, equipment or part approved pursuant to a UN Regulation annexed to the 1958 Agreement shall be so manufactured as to conform to the type approved by meeting the requirements of this Schedule and of the said UN Regulation.

  • 2.2. The approval authority of a Contracting Party granting a type approval pursuant to a UN Regulation annexed to the 1958 Agreement shall verify the existence of adequate arrangements and documented control plans, to be agreed with the manufacturer for each approval, to carry out at specified intervals those tests or associated checks necessary to verify continued conformity with the approved type, including, specifically, where applicable, tests specified in the said UN Regulation.

  • 2.3. The holder of the UN type approval shall, in particular:

    • 2.3.1. Ensure the existence and application of procedures for effective control of the conformity of products (wheeled vehicles, equipment or parts) to the approved type;

    • 2.3.2. Have access to the testing or other appropriate equipment necessary for checking the conformity to each approved type;

    • 2.3.3. Ensure that test or check results' data are recorded and that annexed documents remain available for a period to be determined in agreement with the approval authority. This period shall not exceed 10 years;

    • 2.3.4. Analyse the results of each type of test or check, in order to verify and ensure the stability of the product characteristics, making allowance for variation of an industrial production;

    • 2.3.5. Ensure that for each type of product, at least the checks prescribed in this Schedule and the tests prescribed in the applicable UN Regulations are carried out;

    • 2.3.6. Ensure that any set of samples or test pieces giving evidence of non-conformity in the type of test in question gives rise to a further sampling and test. All the necessary steps shall be taken to restore conformity of the corresponding production.

3. Continued verification arrangements

  • 3.1. The authority which has granted UN type approval may at any time verify the conformity control methods applied in each production facility.

    • 3.1.1. The normal arrangements shall be to monitor the continued effectiveness of the procedures laid down in paragraphs 1 and 2 (initial assessment and product conformity arrangements) of this Schedule.

      • 3.1.1.1. Surveillance activities carried out by the technical services (qualified or recognized as required in paragraphs 1.3.1 and 1.3.2) shall be accepted as satisfying the requirements of paragraph 3.1.1 concerning the procedures established at the initial assessment.

      • 3.1.1.2. The normal frequency of these verifications by the approval authority (other than those referred to in paragraph 3.1.1.1) shall be such as to ensure that the relevant controls applied in accordance with paragraphs 1 and 2 of this Schedule are reviewed at intervals based on a risk assessment methodology consistent with the international standard ISO 31000:2009 – Risk Management – Principles and guidelines and, in all cases, with a minimum frequency of once every three years. This methodology should take particular account of any non-conformity raised by Contracting Parties under Article 4 of the 1958 Agreement.

  • 3.2. At every review, the records of tests and checks and production records shall be available to the inspector; in particular, records of those tests or checks documented as required in paragraph 2.2.

  • 3.3. The inspector may select samples at random to be tested in the manufacturer's laboratory or in the facilities of the technical service. In such a case only physical tests shall be carried out. The minimum number of samples may be determined according to the results of the manufacturer's own verification.

  • 3.4. Where the level of control appears unsatisfactory, or when it seems necessary to verify the validity of the tests carried out in application of paragraph 3.3, the inspector shall select samples to be sent to the technical service to perform physical tests.

  • 3.5. Where unsatisfactory results are found during an inspection or a monitoring review, the approval authority shall ensure that all necessary steps are taken to restore conformity of production as rapidly as possible.

Schedule 2

Part one. Assessment, designation and notification of technical services

1. Designation of technical services

  • 1.1. When an approval authority designates a technical service, the latter shall comply with the provisions of this Schedule.

  • 1.2. The technical services shall carry out themselves, or supervise, the tests required for approval or inspections specified in UN Regulations, except where alternative procedures are specifically permitted. They may not conduct tests or inspections for which they have not been duly designated.

    The performance of technical services and the quality of the tests and inspections they are carrying out shall ensure that the products for which UN type approval is requested are adequately verified for their compliance with the requirements of the applicable UN Regulations for which the technical services are designated.

  • 1.3. The technical services shall be designated according to one or more of the four following categories of activities, depending on their field of competence:

    • a) Category A: Technical services which carry out the tests referred to in UN Regulations in their own facilities;

    • b) Category B: Technical services which supervise the tests referred to in the UN Regulations, performed in the manufacturer's facilities or in the facilities of a third party;

    • c) Category C: Technical services which assess and monitor on a regular basis the manufacturer's procedures for controlling conformity of production;

    • d) Category D: Technical services which supervise or perform tests or inspections in the framework of the surveillance of conformity of production.

  • 1.4. Technical services shall demonstrate appropriate skills, specific technical knowledge and proven experience in the specific fields covered by the UN Regulations for which they are designated.

    In addition, technical services shall comply with, but not necessarily be approved/accredited in accordance with, the standards listed in Part two of this Schedule which are relevant for the categories of activities for which they are designated.

    The technical services shall ensure that they are free from any control and influence of interested parties which may adversely affect the impartiality and quality of the tests and inspections.

    The technical services shall have access to the test facilities and measurement devices necessary to supervise or perform tests or inspections referred to in the UN Regulations for which the technical services are designated.

  • 1.5. An approval authority may act as a technical service for one or more of the activities referred to in paragraph 1.3. Where an approval authority acting as a technical service has been appointed by national law of a Contracting Party and is financed by the latter, the provisions of this Schedule or equivalent rules to the provisions in paragraphs 1, 2 and 3.4 of this Schedule shall be complied with. The same applies for technical services that have been appointed by national law of a Contracting Party and are subject to financial and managerial control by the Government of that Contracting Party. The equivalent rules shall guarantee the same level of performance and independence.

  • 1.6. Regardless of paragraph 3.3, a manufacturer or its representative acting on its behalf may be designated as a technical service for category A activities for only those UN Regulations which make provision for such a designation. In this case, and regardless of paragraph 1.4, such technical service shall be accredited in accordance with the standards referred to in paragraph 1 of Part two of this Schedule.

  • 1.7. The entities referred to in paragraphs 1.5 and 1.6 shall comply with the provisions of paragraph 1.

2. Assessment of the skills of the technical services

  • 2.1. The skills referred to in paragraph 1 shall be demonstrated in an assessment report established by a competent authority.4 This may include a certificate of accreditation issued by an accreditation body.

  • 2.2. The assessment referred to in paragraph 2.1 shall be conducted in accordance with the provisions of Part three of this Schedule.

    The assessment report shall be reviewed after a maximum period of three years.

  • 2.3. The assessment report shall be communicated to the UNECE secretariat and to the Contracting Parties upon request.

  • 2.4. The approval authority which acts as a technical service shall demonstrate compliance with documentary evidence.

    This includes an assessment which shall be conducted by auditors independent of the activity being assessed. Such auditors may be from within the same organization provided that they are independent of the personnel undertaking the assessed activity.

  • 2.5. A manufacturer or its representative acting on their behalf, designated as the technical service, shall comply with the relevant provisions of paragraph 2.

3. Procedures for notification

  • 3.1. Contracting Parties shall notify the UNECE secretariat of the name, the address including electronic address and the category of activities of each designated technical service. They shall also notify the UNECE secretariat any subsequent modifications thereof.

    The notification act shall state for which UN Regulations the technical services have been designated.

  • 3.2. A technical service may conduct the activities described in paragraph 1 for the purposes of UN type approval only if it has been notified to the UNECE secretariat.

  • 3.3. The same technical service may be designated and notified by several Contracting Parties, irrespective of the category of activities which they conduct.

  • 3.4. The UNECE secretariat shall publish the list and contact details of the approval authorities and technical services on its website.

Part two. Standards which the technical services, referred to in Part one of this Schedule, shall comply with

1. Activities in testing for UN type approval, to be carried out in accordance with UN Regulations

  • 1.1. Category A (tests performed in own facilities):

    ISO/IEC 17025:2005 on the general requirements for the competence of testing and calibration laboratories.

    A technical service designated for category A activities may carry out or supervise the tests according to UN Regulations for which it has been designated, in the facilities of the manufacturer or of its representative.

  • 1.2. Category B (supervising tests performed in the manufacturer's facilities or in the facilities of its representative):

    ISO/IEC 17020:2012 on the general criteria for the operation of various types of bodies performing inspection.

    Before performing or supervising any test in the facilities of a manufacturer or of its representative, the technical service shall verify that the test facilities and measurement devices comply with the appropriate requirements of paragraph 1.1.

2. Activities related to Conformity of Production

  • 2.1. Category C (procedure for the initial assessment and surveillance audits of the manufacturer’s quality management system):

    ISO/IEC 17021:2015 on the requirements for bodies providing audit and certification of management systems.

  • 2.2. Category D (inspection or testing of production samples or supervision thereof):

    ISO/IEC 17020:2012 on the general criteria for the operation of various types of bodies performing inspection.

Part three. Procedure for the assessment of technical services

1. Purpose

  • 1.1. This part of Schedule 2 establishes the conditions by which the assessment procedure of the technical services shall be conducted by the competent authority referred to in paragraph 2 of Part one of this Schedule.

  • 1.2. These requirements shall apply, mutatis mutandis, to all technical services irrespective of their legal status (independent organization, manufacturer or approval authority acting as technical service).

2. Principles of assessing

Assessment shall be characterized by reliance on a number of principles:

  • a) Independence which is the basis for the impartiality and objectivity of the conclusions;

  • b) An evidence-based approach which guarantees reliable and reproducible conclusions.

Auditors shall show trust and integrity, and shall respect confidentiality and discretion. They shall report truthfully and accurately findings and conclusions.

3. Auditor skills

  • 3.1. The assessments may only be conducted by auditors with the technical and administrative knowledge necessary for such purposes.

  • 3.2. The auditors shall have been trained specifically for assessment activities. In addition, they shall have the specific knowledge of the technical area in which the technical service will exercise its activities.

  • 3.3. Without prejudice to the provisions of paragraphs 3.1 and 3.2 above, the assessment referred to in paragraph 2.5 of Part one of this Schedule shall be conducted by auditors independent of the activities for which the assessment is conducted.

4. Application for designation

  • 4.1. A duly authorized representative of the applicant technical service shall make a formal application to the competent authority. The application shall include as a minimum the following:

    • a) General features of the technical service, including corporate entity, name, addresses, legal status and human and technical resources;

    • b) A detailed description including curriculum vitae of the personnel in charge of testing and/or inspections and of the managerial staff as evidenced by the skills both educational and professional;

    • c) In addition to the above, technical services which use virtual testing methods shall provide evidence of their ability to work in a Computer-Aided-x environment;

    • d) General information concerning the technical service, such as its activities, its relationship in a larger corporate entity, if any, and addresses of all its physical location(s) to be covered by the scope of designation;

    • e) An agreement to fulfil the requirements for designation and the other obligations of the technical service as applicable in the relevant UN Regulations for which it is designated;

    • f) A description of the conformity assessment services that the technical service undertakes in the framework of the applicable UN Regulations and a list of the UN Regulations for which the technical service applies for designation, including its limits of capability where applicable;

    • g) A copy of the quality assurance manual or comparable operational rules of the technical service.

  • 4.2. The competent authority shall review for adequacy the information supplied by the technical service.

  • 4.3. The technical service shall notify the approval authority of any modifications to the information provided in accordance with paragraph 4.1.

5. Resource review

The competent authority shall review its ability to carry out the assessment of the technical service, in terms of its own policy, its competence and the availability of suitable auditors and experts.

6. Subcontracting the assessment

  • 6.1. The competent authority may subcontract parts of the assessment to another designated authority or ask for support from technical experts provided by other competent authorities. The subcontractors and experts shall be accepted by the applicant technical service.

  • 6.2. The competent authority shall take into account accreditation certificates with adequate scope, in order to complete its global assessment of the technical service.

7. Preparation for assessment

  • 7.1. The competent authority shall formally appoint an assessment team. The former shall ensure that the expertise brought to each assignment is appropriate. In particular, the team as a whole:

    • a) Shall have appropriate knowledge of the specific scope for which designation is sought; and

    • b) Shall have sufficient understanding to reliably assess the competence of the technical service which operates within its scope of designation.

  • 7.2. The competent authority shall clearly define the assignment given to the assessment team. The task of the assessment team is to review the documents collected from the applicant technical service and to conduct the on-site assessment.

  • 7.3. The competent authority shall agree, together with the technical service and the assigned assessment team, on the date and timetable for the assessment. However, it remains the responsibility of the competent authority to pursue a date that is in accordance with the surveillance and reassessment plan.

  • 7.4. The competent authority shall ensure that the assessment team is provided with the appropriate criteria documents, previous assessment records, and the relevant documents and records of the technical service.

8. On-site assessment

The assessment team shall conduct the assessment of the technical service on the premises of the technical service from which one or more key activities are performed and, where relevant, shall perform eyewitness assessment at other selected locations where the technical service operates.

9. Analysis of findings and assessment report

  • 9.1. The assessment team shall analyse all relevant information and evidence from the document and record review and the on-site assessment. This analysis shall be sufficient to allow the team to determine the extent of competence and conformity of the technical service with the requirements for designation.

  • 9.2. The competent authority's reporting procedures shall ensure that the following requirements are fulfilled.

    • 9.2.1. A meeting shall take place between the assessment team and the technical service prior to leaving the site. At this meeting, the assessment team shall provide a written and/or oral report of its findings obtained from the analysis. The technical service shall have the opportunity to ask questions about the findings, including non-conformities, if any, and their basis.

    • 9.2.2. A written report on the outcome of the assessment shall be promptly brought to the attention of the technical service. This assessment report shall contain comments on competence and conformity, and shall identify non-conformities, if any, that need to be resolved in order to conform to all of the requirements for designation.

    • 9.2.3. The technical service shall be invited to respond to the assessment report and to describe the specific actions taken or planned to be taken, within a defined time, to resolve any identified non-conformities.

  • 9.3. The competent authority shall ensure that the responses of the technical service are sufficient and effective to resolve non-conformities. If the technical service responses are found to be insufficient, further information shall be requested. Additionally, evidence of effective implementation of actions taken may be requested, or a follow-up assessment may be carried out to verify effective implementation of corrective actions.

  • 9.4. The assessment report shall include, as a minimum:

    • a) The unique identification of the technical service;

    • b) The date(s) of the on-site assessment;

    • c) The name(s) of the auditor(s) and/or experts involved in the assessment;

    • d) The unique identification of all premises assessed;

    • e) The proposed scope of designation that was assessed;

    • f) A statement on the adequacy of the internal organization and procedures adopted by the technical service supporting its competence, as determined through its fulfilment of the requirements for designation;

    • g) The information on resolving all non-conformities;

    • h) A recommendation on whether the applicant should be designated or confirmed as technical service and, if so, the scope of designation.

10. Granting/confirming a designation

  • 10.1. The approval authority shall, without undue delay, make the decision on whether to grant, confirm or extend designation on the basis of the report(s) and any other relevant information.

  • 10.2. The approval authority shall provide a certificate to the technical service. This certificate shall identify the following:

    • a) The identity and logo of the approval authority;

    • b) The unique identity of the designated technical service;

    • c) The effective date of granting of designation and the expiry date;

    • d) A brief indication of, or a reference to, the scope of designation (applicable UN Regulations or parts thereof);

    • e) A statement of conformity and a reference to this Schedule.

11. Reassessment and surveillance

  • 11.1. Reassessment is similar to an initial assessment except that experience gained during previous assessments shall be taken into account. Surveillance on-site assessments are less extensive than reassessments.

  • 11.2. The competent authority shall design its plan for reassessment and surveillance of each designated technical service, so that representative samples of the scope of designation are assessed on a regular basis.

    The interval between on-site assessments, whether reassessment or surveillance, depends on the proven stability of the technical service.

  • 11.3. When, during surveillance or reassessments, non-conformities are identified, the competent authority shall define strict time limits for the implementation of corrective actions.

  • 11.4. When the corrective or improvement actions have not been taken within the agreed timeframe, or are not deemed to be sufficient, the competent authority shall adopt appropriate measures such as, conducting further assessment, suspending/withdrawing the designation for one or more of the activities for which the technical service has been designated.

  • 11.5. When the competent authority decides to suspend or withdraw the designation of a technical service, it shall inform the latter by registered mail, and shall inform the UNECE secretariat thereof accordingly. In any case, the competent authority shall adopt all the necessary measures to ensure the continuity of the activities already undertaken by the technical service.

12. Records on designated technical services

  • 12.1. The competent authority shall maintain records on technical services to demonstrate that requirements for designation, including competence, have been effectively fulfilled.

  • 12.2. The competent authority shall keep the records on technical services secure to ensure confidentiality.

  • 12.3. Records on technical services shall include at least:

    • a) Relevant correspondence;

    • b) Assessment records and reports;

    • c) Copies of designation certificates.

Schedule 3. Procedures for UN type approvals

1. Application for and conduct of UN type approval

  • 1.1. An application for UN type approval shall be submitted to the approval authority of a Contracting Party by the manufacturer or their authorized representative (hereinafter referred to as the “applicant”).

  • 1.2. Only one application may be submitted for a particular type of vehicle, equipment or part and it may be submitted in only one Contracting Party applying the UN Regulations pursuant to which UN type approval is sought. A separate application shall be submitted for each type to be approved.

  • 1.3. The application shall be accompanied by the information as specified in the UN Regulations pursuant to which approval is sought. This information shall contain a detailed description of the particulars of the type to be approved, including drawings, diagrams and pictures as necessary.

  • 1.4. The approval authority may, by reasoned request, call upon the applicant to supply any additional information necessary to enable decision on the approval tests required or facilitating the execution of those tests.

  • 1.5. The applicant shall make available to the approval authority as many wheeled vehicles, equipment or parts as are required for the performance of the tests required by the UN Regulations pursuant to which approval is sought.

  • 1.6. Compliance with the requirements laid down in the UN Regulations shall be demonstrated by means of appropriate tests performed on wheeled vehicles, equipment and parts which are representative of the type to be approved.

    The approval authority shall apply the principle of “worst-casing”, by selecting the variant or version from the specified type that for the purpose of testing will represent the type to be approved under the worst conditions. The decisions taken along with their justification shall be recorded in the approval documentation.

    However, the applicant may select, in agreement with the approval authority, a vehicle, equipment or parts which, while not representative of the type to be approved, combines a number of most unfavourable features with regard to the level of performance required by the UN Regulations (worst-casing). Virtual testing methods may be used to aid the decision-making on the selection of the worst-case.

  • 1.7. The approval tests will be performed or supervised by technical services. The test procedures to be applied and the specific equipment and tools to be used shall be those specified in the UN Regulations.

  • 1.8. As an alternative to the test procedures referred to in paragraphs 1.6 and 1.7 above, virtual testing may be used at the request of the applicant, in as far as this is provided for in the relevant UN Regulations and subject to the fulfilment of the general conditions as set out in Schedule 8 annexed to the 1958 Agreement.

  • 1.9. Contracting Parties shall issue type approvals only where compliance with conformity of production requirements of Schedule 1 annexed to the 1958 Agreement is ensured.

  • 1.10. When the approval tests have demonstrated that the type complies with the technical requirements of the UN Regulation, an approval of that type shall be granted, an approval number shall be assigned according to Schedule 4 annexed to the 1958 Agreement and an approval mark shall be assigned to each type in accordance with the specific provisions of the UN Regulation concerned.

  • 1.11. The approval authority shall ensure that the following is included in the approval documentation:

    • a) A record of the worst-case selection and the justification for that selection. This may include information provided by the manufacturer;

    • b) A record of any significant technical interpretation made, different test methods applied, or new technology introduced;

    • c) A test report from the technical service that includes recorded values achieved for measurements and tests as required by the UN Regulation;

    • d) Information documents from the manufacturer, properly specifying the characteristics of the type to be approved;

    • e) A statement of compliance with the conformity of the production requirements of Schedule 1 annexed to the 1958 Agreement, detailing which of the arrangements referred to in paragraph 1.3 of Schedule 1 annexed to the 1958 Agreement have been taken into account as the basis for the initial assessment as well as the date of the initial assessment and any surveillance activities;

    • f) The type approval certificate.

2. Amendments to UN type approvals

  • 2.1. The manufacturer holding a UN type approval for their vehicle, equipment or part shall inform without delay the Contracting Party that issued the UN type approval of any change in the particulars of the type as recorded in the information referred to in paragraph 1.3.

  • 2.2. The Contracting Party shall decide which of the two procedures to amend the UN type approval as laid down in paragraphs 2.5 and 2.6 is to be followed. Where necessary, the Contracting Party may decide, in consultation with the manufacturer that a new UN type approval may need to be granted.

  • 2.3. An application for amending a UN type approval may only be submitted to the Contracting Party that issued the original UN type approval.

  • 2.4. If the Contracting Party finds it necessary, for the purpose of amending the UN type approval, to carry out inspections or tests, it shall inform the manufacturer accordingly.

  • 2.5. When particulars of the type as recorded in the information documents and test reports have changed and the Contracting Party considers that the changes are unlikely to have an appreciable adverse effect on the environmental and/or functional safety performance, and that in any case the type still complies with the requirements of the UN Regulations concerned, the modification of the UN type approval shall be designated as a “revision”.

    In such a case, the Contracting Party shall issue the revised pages of the information documents and test reports as necessary, marking each revised page to show clearly the nature of the modification and the date of re-issue. A consolidated, updated version of the information documents and test reports, accompanied by a detailed description of the modification, shall be deemed to meet this requirement.

  • 2.6. The amendment to a UN type approval shall be designated as an “extension” if, in addition to the change of the data recorded in the information documents:

    • a) Further inspections or tests are required; or

    • b) Any information on the communication document (with the exception of its attachments) has changed; or

    • c) Approval to a later series of amendments is requested after its entry into force, which can be granted provided that the requirements of a later series of amendments are fulfilled.

  • 2.7. Confirmation or refusal of amending the UN type approval, specifying the alterations, shall be communicated to the Contracting Parties to the 1958 Agreement applying the UN Regulation by means of a communication form. In addition, the index to the information documents and to the test reports, attached to the communication document, shall be amended accordingly to show the date of the most recent revision or extension.

  • 2.8. The type approval authority granting the extension of approval shall update the approval number with an extension number incremented in accordance with the number of successive extensions already granted in accordance with Schedule 4 annexed to the 1958 Agreement and issue a revised communication form denoted by this extension number.

Schedule 4. Numbering of UN type approvals

  • 1. As from the entry into force of the 1958 Agreement, Contracting Parties shall issue a type approval number according to paragraphs 1.10 and 2.8 of Schedule 3 for each new type approval and each extension of such an approval.

  • 2. As from the entry into force of the 1958 Agreement and notwithstanding that the provisions on approval markings in any version of UN Regulations may have stipulated otherwise, the manufacturer shall affix an approval mark, if requested, according the provisions of the relevant UN Regulations, however, utilizing in that marking the first two digits of Section 2 and the digits of Section 3 of the approval number as mentioned in this Schedule as approval number to each wheeled vehicle, equipment or part for which a new approval has been granted or for which such approvals have been extended. However, this provision does not apply where a UN Regulation requires an approval code or an identification code to be used in the approval mark instead of an approval number. The leading zeros to Section 3 may be omitted.

  • 3. An approval number shall be assigned to each type approved. The type approval number shall consist of 4 sections. Each section shall be separated by the “*” character.

    Section 1: The capital letter “E” followed by the distinguishing number of the Contracting Party which has granted the type approval.

    Section 2: The number of the relevant UN Regulation, followed by the letter “R”, successively followed by:

    • a) Two digits (with leading zeros as applicable) indicating the series of amendments incorporating the technical provisions of the UN Regulation applied to the approval (00 for the UN Regulation in its original form);

    • b) A slash and two digits (with leading zeros as applicable) indicating the number of supplement to the series of amendments applied to the approval (00 for the series of amendments in its original form);

    • c) A slash and one or two character(s) indicating the implementing stage, if applicable.

    Section 3: A four-digit sequential number (with leading zeros as applicable). The sequence shall start from 0001.

    Section 4: A two-digit sequential number (with leading zeros if applicable) to denote the extension. The sequence shall start from 00.

    All digits shall be Arabic digits.

  • 4. The same Contracting Party shall not assign the same number to another approval.

    Examples:

    Example of the second extension to the fourth type approval issued by the Netherlands according to UN Regulation No. 58 in its original version:

Schedule 5. Circulation of approval documentation

  • 1. Where an approval authority is required to or is requested to provide a copy of an approval and its attachments, it shall send the documents as paper copies, or by e-mail in electronic format, or by utilizing the secure internet database established by the United Nations Economic Commission for Europe.

  • 2. Documents stored on the secure internet database shall consist of at least the documents specified in each UN Regulation. These shall include documentation communicating to Contracting Parties notice of approval, of extension, of refusal or withdrawal of approval or where production is definitely discontinued of a type of wheeled vehicles, equipment or parts pursuant to the UN Regulation.

  • 3. If the type approvals applicable to a wheeled vehicles, equipment or parts are stored on the secure internet database, then the approval markings required by UN Regulations may be replaced by a Unique Identifier (UI) preceded by the symbol

    , unless specified otherwise in the UN Regulations. Such unique identifier shall be generated by the database automatically.

  • 4. All Contracting Parties applying a UN Regulation shall have access to the information for that UN Regulation contained in the database by using the Unique Identifier and this will provide access to the relevant information relating to the specific approval(s).

  • 5. UN Regulations annexed to the 1958 Agreement may require the circulation of type approvals by electronic copies utilizing the secure internet database, where necessary for the efficient operation of the approval process, subject to the access rights as defined by the Contracting Parties.

Schedule 6. Procedures for resolving interpretation issues in relation to the application of UN Regulations and granting approvals pursuant to these UN Regulations

1. Interpretation issues prior to UN type approval being granted

When an application for UN type approval requires the approval authority to make a significant interpretation on the application of the UN Regulation, or if so requested by the applicant for approval, the approval authority shall actively inform and seek guidance from other approval authorities before making a decision.

The approval authority concerned shall notify the other approval authorities applying the UN Regulation of the issue and of their proposed solution for the interpretation, including any supporting information from the manufacturer. As a general rule, this should be done via electronic media. A period of fourteen days shall be allowed for replies from the other approval authorities.

  • a) The approval authority having taken account of any comments received, can then grant approvals in accordance with the new interpretation.

  • b) If it is not possible to take a decision according to the comments received, the approval authority shall seek further clarification by means of the procedure described in paragraph 3 below.

2. Interpretation issues subsequent to UN type approval being granted

In situations where different interpretations exist between Contracting Parties but subsequent to an approval being issued the following procedures shall be followed.

In the first instance, the Contracting Parties concerned shall seek to resolve the issue by mutual agreement. This will require liaison and for each Contracting Party to review the procedures used to test and approve the wheeled vehicles, equipment and parts being the subject of the interpretation dispute. The following procedures will be applied:

  • a) In the event of an error being acknowledged by an approval authority, the approval authority shall take an action in accordance with the provisions of the 1958 Agreement, and in particular its Article 4.

  • b) Where agreement is reached which necessitates a new or different interpretation of existing practice (by either Contracting Party), then this shall be communicated to other Contracting Parties applying the UN Regulation concerned as a matter of urgency. The other Parties shall have fourteen days to comment upon the decision, following which the approval authorities, having taken account of any comments received, can issue UN type approvals in accordance with the new interpretation.

  • c) Where agreement cannot be reached, then the Contracting Parties concerned shall seek further review by the arbitration process described in paragraph 3 below.

  • d) In any event, the matter shall be brought to the attention of the competent Working Party subsidiary to the World Forum for Harmonization of Vehicle Regulations (WP.29). If deemed necessary, the subsidiary Working Party shall submit to WP.29 proposals for suitable regulatory amendments aimed at resolving the difference of interpretations.

3. Arbitration process through WP.29 and its subsidiary Working Parties

The Chairs of the subsidiary Working Parties shall identify the issues arising from diverging interpretations between Contracting Parties in relation to the application of UN Regulations and the granting of UN type approvals pursuant to these UN Regulations, with a view to put in place measures at the earliest opportunity to resolve the different interpretations.

The Chairs of the Working Parties will develop suitable procedures to deal with such interpretation issues, in order to be able to demonstrate to WP.29 that:

  • a) Full consideration is given to the different opinions by the approval authorities of the Contracting Parties concerned, as well as to the views of other Contracting Parties applying the UN Regulation;

  • b) Decisions are based upon appropriate technical advice, taking full account of the subject area;

  • c) Wherever possible, an unanimous decision is reached; and

  • d) Procedures are transparent and auditable.

If necessary to resolve the issue, the Chair may submit a new agenda item on the issue to the next available session of the subsidiary Working Party, without obtaining prior approval from WP.29. In these circumstances, the Chair shall report on the progress to WP.29 at the earliest opportunity.

At the end of the arbitration process, the Chair shall provide a report to WP.29.

  • 3.1. Where the issue can be resolved within the current regulatory framework:

    The interpretation of the UN Regulation as agreed in the Working Party shall be implemented and approval authorities shall issue UN type approvals accordingly.

  • 3.2. Where the issue cannot be resolved within the current regulatory framework:

    WP.29 shall be informed accordingly and shall request the relevant subsidiary Working Party to consider the issue as a priority item at its next session. The agenda of the session shall be amended accordingly.

    The subsidiary Working Party shall consider any proposal on the interpretation issue and shall submit formal proposals to WP.29 to amend the UN Regulation concerned following the normal procedures. WP.29 will consider the issue as a priority item at its next session.

Schedule 7. Procedure for exemption approvals concerning new technologies

  • 1. Contracting Parties applying a UN Regulation may, on application by the manufacturer, grant exemption approval pursuant to a UN Regulation in respect of a vehicle, equipment or part that incorporates technologies which are incompatible with one or more requirements of that UN Regulation, subject to authorization being granted by the Administrative Committee of the 1958 Agreement under the procedure described in paragraphs 2 to 12 of this Schedule.

  • 2. Pending the decision on whether or not authorization for such an exemption approval is granted, the Contracting Party applying the UN Regulation may grant provisional approval for its territory only. Other Contracting Parties applying that UN Regulation may decide to accept this provisional approval in their territory.

  • 3. The Contracting Party granting the provisional approval mentioned in paragraph 2 of this Schedule shall notify the Administrative Committee of its decision and submit a file with the following:

    • a) The reasons why the technologies or concept concerned make the vehicle, equipment or part incompatible with the requirements of the UN Regulation;

    • b) A description of the safety, environmental or other considerations and the measures taken;

    • c) A description of the tests and results, demonstrating that, compared with the requirements from which exemption is sought, at least an equivalent level of safety and environmental protection is ensured;

    • d) A request for authorization to grant an exemption approval to the UN Regulation for the type of vehicle, equipment or part.

  • 4. The Administrative Committee shall consider the complete notification referred to in paragraph 3 of this Schedule at its next session following receipt of the notification, provided this notification was received at least three months prior to the session. After considering the notification, the Administrative Committee may decide to authorize or to refuse the granting of the exemption approval or to refer the issue to the competent subsidiary Working Party.

  • 5. The decision of the Administrative Committee shall be established in accordance with the procedure indicated in the Appendix, Article 8.

  • 6. The requested exemption approval pursuant to a UN Regulation, mentioned under paragraph 3 of this Schedule, will be considered to be authorized unless, within a period of one month from the notification by the Executive Secretary of the United Nations Economic Commission for Europe of the Administrative Committee's authorization decision, more than one-fifth of the Contracting Parties applying the UN Regulation at the time of notification have informed the Executive Secretary of the United Nations Economic Commission for Europe of their disagreement with the authorization of the exemption approval.

  • 7. When the authorization for granting the exemption approval is adopted, the Executive Secretary of the United Nations Economic Commission for Europe shall, as soon as possible, notify the Contracting Parties applying the concerned UN Regulation about this adoption.

    As from the date of that notification the Contracting Party referred to in paragraph 3 of this Schedule may then deliver the exemption approval pursuant to the UN Regulation. The exemption approval shall be accepted by the Contracting Parties applying the UN Regulation, with the exception of those who have notified their disagreement, or their intention not to accept the exemption approval immediately, to the Executive Secretary of the United Nations Economic Commission for Europe. The Contracting Parties which have notified their disagreement, or their intention not to accept the exemption approval immediately, with the authorization by the Administrative Committee may at a later date accept the exemption approval by notifying the Executive Secretary of the United Nations Economic Commission for Europe of their decision.

  • 8. The Administrative Committee shall specify any restrictions in the authorization decision. Time limits shall not be less than thirty-six months. Contracting Parties applying the UN Regulation shall accept the exemption approval at least until the expiration of the time limit, if any, or, when the UN Regulation in question is subsequently amended as per paragraphs 9 and 10 of this Schedule in order to take into account the technology covered by the exemption approval, until the date, as from which Contracting Parties may refuse approvals to the previous version of the UN Regulation, whichever of these two dates comes first.

    The Contracting Party authorized to grant the exemption approval shall ensure that the manufacturer fully complies with all restrictions associated with this approval and that the communication form clearly indicates that it is based on an exemption authorized by the Administrative Committee.

  • 9. The Administrative Committee shall at the same time inform the subsidiary Working Party responsible for the UN Regulation about the authorization to grant the exemption approval.

    The Contracting Party authorized to grant the exemption approval shall submit to the subsidiary Working Party responsible for the UN Regulation a proposal to amend the UN Regulation for which the exemption approval was requested, in order to adapt it to the technological development. This submission shall be made not later than by the next session of the subsidiary Working Party following the notification of the Administrative Committee authorization decision according to paragraph 6 of this Schedule.

  • 10. As soon as the UN Regulation has been amended to take into account the technology for which the exemption approval was granted, and entered into force, the manufacturer shall be authorized to apply for type approval pursuant to the amended UN Regulation, in replacement of the previously granted exemption approval to that UN Regulation. The approval authority granting that type approval shall, as soon as reasonable, withdraw the exemption approval or inform the approval authority which granted the exemption approval that this exemption approval is to be withdrawn.

  • 11. If the procedure to amend the UN Regulation is not completed before the expiration of the time limit defined in paragraph 8 of this Schedule, the validity of the exemption approval may be extended, at the request of the Contracting Party which granted the exemption approval, subject to a decision adopted in accordance with the procedure described in paragraphs 2 and 3 of this Schedule. If, however, the Contracting Party which has been authorized to grant the exemption approval failed to submit a proposal to amend the UN Regulation before the deadline specified in paragraph 9 of this Schedule, that Contracting Party shall immediately withdraw this exemption approval, taking however into account the time limit as defined in paragraph 8 of this Schedule. The Contracting Party which withdrew the exemption approval shall inform the Administrative Committee accordingly at its next session.

  • 12. If the Administrative Committee decides to refuse an authorization to grant an exemption approval, the Contracting Party which issued the provisional approval referred to in paragraph 2 of this Schedule may withdraw this provisional approval. In this case, that Contracting Party shall immediately give notice to the holder of the provisional approval that this provisional approval, granted in accordance with paragraph 2 of this Schedule, will be withdrawn six months after the date of the decision taking into account that the provisional approval shall be valid at least for twelve months from the date of its granting.

Schedule 8. General conditions for virtual testing methods

1. Virtual test pattern

The following scheme shall be used as a basic structure for describing and conducting virtual testing:

  • a) Purpose;

  • b) Structure model;

  • c) Boundary conditions;

  • d) Load assumptions;

  • e) Calculation;

  • f) Assessment;

  • g) Documentation.

2. Fundamentals of computer simulation and calculation

  • 2.1. Mathematical model

    The mathematical model shall be supplied by the manufacturer. It shall reflect the complexity of the structure of the wheeled vehicles, equipment and parts to be tested in accordance with the requirements of the UN Regulations concerned and its boundary conditions.

    The same provisions shall apply, mutatis mutandis, for testing components independent of the vehicle.

  • 2.2. Validation process of the mathematical model

    The mathematical model shall be validated in comparison with the actual test conditions.

    To that effect, physical testing shall be conducted as appropriate for the purposes of comparing the results obtained when using the mathematical model with the results of a physical test. Comparability of the test results shall be proven. A validation report shall be drafted by the manufacturer or by the technical service and submitted to the approval authority.

    Any change made to the mathematical model or to the software likely to invalidate the validation report shall be brought to the attention of the approval authority which may require a new validation process to be conducted.

  • 2.3. Documentation

    The data and auxiliary tools used for the simulation and calculation shall be made available by the manufacturer and be documented in a way suitable for the technical service.

3. Tools and support

At the request of the approval authority or the technical service, the manufacturer shall supply or provide access to the necessary tools including appropriate software.

In addition the manufacturer shall provide appropriate support to the approval authority or the technical service.

Providing access and support to a technical service does not remove any obligation of the technical service regarding the skills of its personnel, the payment of licence rights and respect of confidentiality.

Preambule

De overeenkomstsluitende partijen,

Besloten hebbende tot wijziging van de Overeenkomst betreffende het aannemen van eenvormige goedkeuringsvoorwaarden en de wederzijdse erkenning van goedkeuring van uitrustingsstukken en onderdelen van motorrijtuigen, gesloten in Genève op 20 maart 1958, zoals gewijzigd op 16 oktober 1995, en

Geleid door de wens om de technische belemmeringen voor de internationale handel te verminderen door geharmoniseerde technische VN-reglementen vast te stellen waaraan bepaalde voertuigen op wielen, uitrustingsstukken en onderdelen ten minste moeten voldoen om in hun land of regio te worden gebruikt,

Erkennend het belang van veiligheid, milieubescherming, energie-efficiëntie en diefstalbeveiliging van voertuigen op wielen en van uitrustingsstukken en onderdelen die daarop kunnen worden gemonteerd en/of gebruikt, voor de vaststelling van reglementen die technisch en economisch haalbaar zijn en aan de technische vooruitgang zijn aangepast,

Geleid door de wens om deze VN-reglementen in hun land of regio zoveel mogelijk toe te passen,

Geleid door de wens om in hun land de aanvaarding van de voertuigen, uitrustingsstukken en onderdelen die door de goedkeuringsinstanties van een andere overeenkomstsluitende partij krachtens deze VN-reglementen zijn goedgekeurd, te vergemakkelijken,

Geleid door de wens om in het kader van de overeenkomst een systeem voor de internationale typegoedkeuring van gehele voertuigen (IWVTA) tot stand te brengen teneinde de voordelen van de aan de overeenkomst gehechte afzonderlijke VN-reglementen te vergroten en zo mogelijkheden te scheppen om de uitvoering ervan door de overeenkomstsluitende partijen te vereenvoudigen en de wederzijdse erkenning van typegoedkeuringen voor gehele voertuigen op ruimere schaal toe te passen, en

Geleid door de wens om het aantal partijen bij de overeenkomst te vergroten door de werking en betrouwbaarheid ervan te verbeteren en er zo voor te zorgen dat zij het belangrijkste internationale kader voor de harmonisatie van technische regelgeving in de automobielsector blijft,

Zijn overeengekomen als volgt:

Artikel 1

  • 1 De overeenkomstsluitende partijen stellen, door middel van een beheerscomité samengesteld uit alle overeenkomstsluitende partijen volgens het reglement van orde in het aanhangsel van deze overeenkomst en op basis van de volgende artikelen en punten, VN-reglementen vast voor voertuigen op wielen en voor uitrustingsstukken en onderdelen die daarop kunnen worden gemonteerd en/of gebruikt. De voorwaarden voor het verlenen van typegoedkeuringen en de wederzijdse erkenning ervan zullen worden opgenomen ten behoeve van overeenkomstsluitende partijen die besluiten reglementen via typegoedkeuring toe te passen.

    Voor de toepassing van deze overeenkomst wordt verstaan onder:

    • „voertuigen op wielen, uitrustingsstukken en onderdelen”: alle voertuigen op wielen en alle uitrustingsstukken en onderdelen waarvan de eigenschappen van invloed zijn op de voertuigveiligheid, milieubescherming, energiebesparing en diefstalbeveiligingstechnologie;

    • „typegoedkeuring krachtens een VN-reglement”: een administratieve procedure waarbij de goedkeuringsinstanties van één overeenkomstsluitende partij, na de vereiste verificaties te hebben uitgevoerd, verklaren dat een door de fabrikant ter beschikking gesteld type voertuig, uitrustingsstuk of onderdeel voldoet aan de voorschriften van het betreffende VN-reglement. Vervolgens certificeert de fabrikant dat elk voertuig, uitrustingsstuk of onderdeel dat hij in de handel brengt, zodanig is geproduceerd dat het identiek is aan het goedgekeurde product;

    • „typegoedkeuring van een geheel voertuig”: de typegoedkeuringen die krachtens de betreffende VN-reglementen voor voertuigen op wielen, uitrustingsstukken en onderdelen van een voertuig zijn verleend, worden samengevoegd tot een goedkeuring van het gehele voertuig overeenkomstig de bepalingen van het administratieve IWVTA-systeem;

    • „versie van een VN-reglement”: nadat een VN-reglement is aangenomen en vastgesteld, kan het later worden gewijzigd volgens de procedures die zijn beschreven in deze overeenkomst, met name in artikel 12. Het ongewijzigde VN-reglement en ook het VN-reglement waarin alle latere wijzigingen zijn opgenomen, worden als afzonderlijke versies van dat VN-reglement beschouwd;

    • „toepassing van een VN-reglement”: de inwerkingtreding van een VN-reglement voor een overeenkomstsluitende partij. Daarbij hebben de overeenkomstsluitende partijen de mogelijkheid om hun eigen nationale of regionale wetgeving te behouden. Als zij het wensen, mogen zij hun nationale of regionale wetgeving vervangen door de VN-reglementen die zij toepassen, maar zij zijn daar door de overeenkomst niet toe gebonden. De overeenkomstsluitende partijen aanvaarden echter, als alternatief voor het betreffende deel van hun nationale of regionale wetgeving, VN-typegoedkeuringen verleend krachtens de recentste versie van de VN-reglementen die in hun land of regio worden toegepast. De rechten en verplichtingen van de overeenkomstsluitende partijen die een VN-reglement toepassen, worden in de verschillende artikelen van deze overeenkomst uitvoerig beschreven.

    Voor de toepassing van de VN-reglementen kunnen er verschillende administratieve procedures bestaan als alternatief voor typegoedkeuring. De enige alternatieve procedure die algemeen bekend is en in sommige lidstaten van de Economische Commissie voor Europa wordt toegepast, is zelfcertificering waarbij de fabrikant, zonder enige voorafgaande administratieve controle, verklaart dat elk product dat hij in de handel brengt, voldoet aan het betreffende VN-reglement; de bevoegde administratieve instanties kunnen door middel van steekproeven op de markt verifiëren of de zelfgecertificeerde producten inderdaad voldoen aan de voorschriften van het betreffende reglement.

  • 2 Het beheerscomité wordt samengesteld uit alle overeenkomstsluitende partijen overeenkomstig het reglement van orde in het aanhangsel.

    Nadat een VN-reglement volgens de procedure van het aanhangsel is vastgesteld, deelt het beheerscomité het mee aan de secretaris-generaal van de Verenigde Naties, hierna „secretaris-generaal” genoemd. Vervolgens brengt de secretaris-generaal dit VN-reglement zo spoedig mogelijk ter kennis van de overeenkomstsluitende partijen.

    Het VN-reglement wordt geacht te zijn aangenomen tenzij, binnen zes maanden na de kennisgeving door de secretaris-generaal, meer dan een vijfde van de overeenkomstsluitende partijen op het tijdstip van de kennisgeving de secretaris-generaal heeft meegedeeld niet in te stemmen met het VN-reglement.

    Het VN-reglement heeft betrekking op:

    • a. voertuigen op wielen en uitrustingsstukken of onderdelen ervan;

    • b. technische voorschriften, die waar nodig op prestaties zijn gericht en niet ontwerpbeperkend zijn, die op objectieve wijze rekening houden met de beschikbare technologieën en met de kosten en baten naargelang het geval en die alternatieven mogen omvatten;

    • c. testmethoden die moeten aantonen dat de prestaties aan de voorschriften voldoen;

    • d. de voorwaarden voor het verlenen van typegoedkeuring en de wederzijdse erkenning ervan, met inbegrip van de administratieve bepalingen, de goedkeuringsmerken en de voorwaarden om de conformiteit van de productie te waarborgen;

    • e. de datum of data van inwerkingtreding van het VN-reglement, met inbegrip van de datum waarop de overeenkomstsluitende partijen die het VN-reglement toepassen, krachtens dat reglement goedkeuring kunnen verlenen en vanaf welke datum zij goedkeuringen aanvaarden (indien verschillend);

    • f. een door de fabrikant te verstrekken inlichtingenformulier.

    Het VN-reglement kan zo nodig verwijzingen bevatten naar de door de goedkeuringsinstanties geaccrediteerde laboratoria waar de aanvaardingstests van de voor goedkeuring ter beschikking gestelde typen voertuigen op wielen, uitrustingsstukken of onderdelen worden uitgevoerd.

    Naast de bovengenoemde VN-reglementen voorziet deze overeenkomst in de vaststelling van een VN-reglement tot invoering van een systeem voor de typegoedkeuring van gehele voertuigen. Dat VN-reglement zal het toepassingsgebied, de administratieve procedures en de technische voorschriften vaststellen die in één versie van dat VN-reglement verschillende stringentieniveaus kunnen omvatten.

    Onverminderd de overige bepalingen van de artikelen 1 en 12 is een overeenkomstsluitende partij die het VN-reglement betreffende de internationale typegoedkeuring van gehele voertuigen toepast, alleen verplicht die typegoedkeuringen te aanvaarden die op grond van het meest stringente niveau van de recentste versie van dat VN-reglement zijn verleend.

    Deze overeenkomst omvat ook bijlagen met administratieve en procedurele bepalingen die van toepassing zijn op alle aan deze overeenkomst gehechte VN-reglementen en op alle overeenkomstsluitende partijen die een of meer VN-reglementen toepassen.

  • 3 Wanneer een VN-reglement is aangenomen, stelt de secretaris-generaal zo spoedig mogelijk alle overeenkomstsluitende partijen daarvan in kennis en geeft hij daarbij aan welke partijen bezwaar hebben aangetekend, welke partijen hun instemming hebben betuigd, maar voornemens zijn het VN-reglement niet op de datum van inwerkingtreding te beginnen toepassen en voor welke partijen het VN-reglement niet in werking zal treden.

  • 4 Het aangenomen VN-reglement treedt op de daarin aangegeven datum of data in werking als VN-reglement dat aan deze overeenkomst is gehecht, voor alle overeenkomstsluitende partijen die niet te kennen hebben gegeven dat zij er niet mee instemmen of dat zij voornemens zijn het niet op die datum toe te passen.

  • 5 Bij het neerleggen van haar akte van toetreding kan een nieuwe overeenkomstsluitende partij verklaren dat zij bepaalde, op dat moment aan deze overeenkomst gehechte VN-reglementen niet zal toepassen of dat zij er geen enkele van zal toepassen. Indien op dat moment de procedure van de leden 2, 3 en 4 van dit artikel voor een VN-ontwerpreglement of een aangenomen VN-reglement wordt gevolgd, deelt de secretaris-generaal dat VN-ontwerpreglement of aangenomen VN-reglement aan de nieuwe overeenkomstsluitende partij mee en treedt het voor de nieuwe overeenkomstsluitende partij als VN-reglement in werking, tenzij deze overeenkomstsluitende partij binnen zes maanden na het neerleggen van haar akte van toetreding te kennen geeft dat zij niet met het aangenomen VN-reglement instemt. De secretaris-generaal deelt alle overeenkomstsluitende partijen de datum van die inwerkingtreding mee. Hij deelt hun ook alle verklaringen mee die overeenkomstsluitende partijen over de niet-toepassing van bepaalde VN-reglementen overeenkomstig dit lid afleggen

  • 6 Elke overeenkomstsluitende partij die een VN-reglement toepast, kan de secretaris-generaal te allen tijde, met een opzegtermijn van één jaar, in kennis stellen van haar voornemen om dat VN-reglement niet langer toe te passen. De secretaris-generaal deelt deze kennisgeving aan alle andere overeenkomstsluitende partijen mee.

    Eerder door die overeenkomstsluitende partij krachtens dat VN-reglement verleende goedkeuringen blijven geldig tenzij zij overeenkomstig artikel 4 worden ingetrokken.

    Indien een overeenkomstsluitende partij niet langer goedkeuringen krachtens een VN-reglement verleent, is zij verplicht:

    • a. te blijven toezien op de conformiteit van de productie van de producten waarvoor zij eerder typegoedkeuring heeft verleend;

    • b. de nodige maatregelen te nemen zoals bedoeld in artikel 4, wanneer zij door een overeenkomstsluitende partij die het VN-reglement blijft toepassen, van non-conformiteit in kennis wordt gesteld;

    • c. de andere overeenkomstsluitende partijen in kennis te blijven stellen van de intrekking van goedkeuringen zoals bedoeld in artikel 5;

    • d. uitbreidingen van bestaande goedkeuringen te blijven toestaan.

  • 7 Elke overeenkomstsluitende partij die een VN-reglement niet toepast, kan de secretaris-generaal te allen tijde in kennis stellen van haar voornemen om het voortaan toe te passen; het VN-reglement zal dan voor deze partij op de zestigste dag na deze kennisgeving in werking treden. De secretaris-generaal stelt alle overeenkomstsluitende partijen in kennis van elke inwerkingtreding van een VN-reglement voor een nieuwe overeenkomstsluitende partij zoals bedoeld in dit lid.

  • 8 De overeenkomstsluitende partijen waarvoor een VN-reglement van kracht is, worden hierna genoemd „de overeenkomstsluitende partijen die een VN-reglement toepassen”.

Artikel 2

  • 1 Elke overeenkomstsluitende partij die VN-reglementen voornamelijk via typegoedkeuring toepast, verleent de typegoedkeuringen en kent de goedkeuringsmerken toe zoals beschreven in elk VN-reglement voor de typen voertuigen op wielen, uitrustingsstukken of onderdelen die onder het VN-reglement vallen, mits zij de technische bevoegdheid heeft en tevreden is met de maatregelen om de conformiteit van het product met het goedgekeurde type te waarborgen. Elke overeenkomstsluitende partij die typegoedkeuring verleent, neemt de nodige maatregelen zoals bedoeld in bijlage 1 die aan deze overeenkomst is gehecht, om te verifiëren dat afdoende regelingen zijn getroffen om te waarborgen dat de voertuigen op wielen, de uitrustingsstukken en de onderdelen conform het goedgekeurde type worden vervaardigd.

  • 2 Elke overeenkomstsluitende partij die typegoedkeuringen krachtens een VN-reglement verleent, duidt voor dat reglement een goedkeuringsinstantie aan. De goedkeuringsinstantie is verantwoordelijk voor alle aspecten van de typegoedkeuring krachtens dat reglement. Deze goedkeuringsinstantie kan technische diensten aanwijzen om in haar naam de tests en keuringen uit te voeren met het oog op de in lid 1 van dit artikel voorgeschreven verificaties. De overeenkomstsluitende partijen zien erop toe dat de technische diensten worden beoordeeld, aangewezen en aangemeld volgens de voorschriften in bijlage 2 die aan deze overeenkomst is gehecht.

  • 3 De typegoedkeuringen, goedkeuringsmerken en identificatiecodes voor de typen voertuigen op wielen, uitrustingsstukken en onderdelen worden gespecificeerd in het VN-reglement en worden verleend of toegekend volgens de procedures in de aan deze overeenkomst gehechte bijlagen 3 tot en met 5.

  • 4 Elke overeenkomstsluitende partij die een VN-reglement toepast, weigert typegoedkeuringen te verlenen en goedkeuringsmerken toe te kennen die onder het VN-reglement vallen als bovengenoemde voorwaarden niet zijn vervuld.

Artikel 3

  • 1 Voertuigen op wielen, uitrustingsstukken of onderdelen waarvoor een overeenkomstsluitende partij krachtens artikel 2 van deze overeenkomst typegoedkeuring heeft verleend, worden geacht conform te zijn met het desbetreffende deel van de nationale wetgeving van alle overeenkomstsluitende partijen die dat VN-reglement toepassen.

  • 2 De overeenkomstsluitende partijen die VN-reglementen toepassen, aanvaarden door wederzijdse erkenning en met inachtneming van de bepalingen van de artikelen 1, 8 en 12 en van alle bijzondere bepalingen in die VN-reglementen, typegoedkeuringen die krachtens die VN-reglementen zijn verleend zonder verdere tests, documentatie, certificering of markering te eisen.

Artikel 4

  • 1 Indien een overeenkomstsluitende partij die een VN-reglement toepast, vaststelt dat bepaalde voertuigen op wielen, uitrustingsstukken of onderdelen met een goedkeuringsmerk dat door een van de overeenkomstsluitende partijen krachtens dat VN-reglement is toegekend, niet conform zijn met het goedgekeurde type of met de voorschriften van dat reglement, stelt zij de goedkeuringsinstantie van de overeenkomstsluitende partij die de goedkeuring heeft verleend, daarvan in kennis.

    De overeenkomstsluitende partij die de goedkeuring heeft verleend, neemt de nodige maatregelen om ervoor te zorgen dat de non-conformiteit wordt rechtgezet.

  • 2 Wanneer de non-conformiteit het gevolg is van niet-naleving van de in artikel 1, lid 2, onder b), bedoelde technische voorschriften van een VN-reglement, brengt de overeenkomstsluitende partij die de goedkeuring heeft verleend, onmiddellijk alle andere overeenkomstsluitende partijen op de hoogte van de situatie en informeert zij hen geregeld over de stappen die zij onderneemt, zoals bijvoorbeeld de intrekking van de goedkeuring, indien nodig.

    Nadat zij de potentiële gevolgen voor de voertuigveiligheid, milieubescherming, energiebesparing of diefstalbeveiligingstechnologie hebben bestudeerd, mogen de overeenkomstsluitende partijen de verkoop en het gebruik van dergelijke voertuigen op wielen, uitrustingsstukken of onderdelen op hun grondgebied verbieden totdat de non-conformiteit is rechtgezet. In dat geval stellen deze overeenkomstsluitende partijen het secretariaat van het beheerscomité in kennis van de genomen maatregelen. Voor de beslechting van geschillen tussen de overeenkomstsluitende partijen geldt de procedure van artikel 10, lid 4.

  • 3 Als, onverminderd lid 1 van dit artikel, een niet-conform product zoals bedoeld in lid 2 van dit artikel, niet binnen drie maanden weer in conformiteit is gebracht, trekt de voor de goedkeuring verantwoordelijke overeenkomstsluitende partij de goedkeuring tijdelijk of permanent in. Bij wijze van uitzondering kan deze termijn met maximaal drie maanden worden verlengd, tenzij een of meer overeenkomstsluitende partijen die het VN-reglement in kwestie toepassen, daar bezwaar tegen maken. Wanneer de termijn wordt verlengd, stelt de overeenkomstsluitende partij die de goedkeuring heeft verleend, binnen de oorspronkelijke periode van drie maanden alle overeenkomstsluitende partijen die dat VN-reglement toepassen, in kennis van haar voornemen tot verlenging van de periode waarin de non-conformiteit moet worden rechtgezet, en geeft zij een rechtvaardiging voor een dergelijke uitbreiding.

  • 4 Wanneer de non-conformiteit het gevolg is van niet-naleving van de administratieve bepalingen, goedkeuringsmerken, voorwaarden voor de conformiteit van de productie of het in een VN-reglement aangegeven inlichtingenformulier zoals bedoeld in artikel 1, lid 2, onder d) en f), trekt de overeenkomstsluitende partij die de goedkeuring heeft verleend, de goedkeuring tijdelijk of permanent in als de non-conformiteit niet binnen zes maanden is rechtgezet.

  • 5 De leden 1 tot en met 4 van dit artikel zijn ook van toepassing wanneer de overeenkomstsluitende partij die verantwoordelijk is voor het verlenen van de goedkeuring, zelf vaststelt dat bepaalde voertuigen op wielen, uitrustingsstukken of onderdelen met een goedkeuringsmerk niet-conform zijn met het goedgekeurde type of met de voorschriften van een VN-reglement.

Artikel 5

  • 1 De goedkeuringsinstanties van elke overeenkomstsluitende partij die VN-reglementen toepast, zenden op verzoek van de andere overeenkomstsluitende partijen een lijst toe van de voertuigen op wielen, uitrustingsstukken of onderdelen waarvan zij de goedkeuring hebben geweigerd of ingetrokken.

  • 2 Voorts zenden zij, op verzoek van een andere overeenkomstsluitende partij die een VN-reglement toepast, onmiddellijk overeenkomstig bijlage 5 die aan deze overeenkomst is gehecht, die overeenkomstsluitende partij een kopie toe van alle relevante informatie op grond waarvan zij haar besluit tot goedkeuring of tot weigering of intrekking van de goedkeuring van een voertuig op wielen, uitrustingsstuk of onderdeel krachtens dat VN-reglement heeft genomen.

  • 3 De papieren kopie kan worden vervangen door een elektronisch bestand overeenkomstig bijlage 5 die aan deze overeenkomst is gehecht.

Artikel 6

  • 1 De lidstaten van de Economische Commissie voor Europa, de landen die overeenkomstig paragraaf 8 van het mandaat van de commissie met adviserende bevoegdheid tot de commissie zijn toegelaten en de door lidstaten van de Economische Commissie voor Europa opgerichte organisaties voor regionale economische integratie waaraan hun lidstaten bevoegdheden op onder deze overeenkomst vallende gebieden hebben overgedragen, met inbegrip van de bevoegdheid om besluiten te nemen die bindend zijn voor hun lidstaten, kunnen partij worden bij deze overeenkomst.

    Voor de vaststelling van het aantal stemmen zoals bedoeld in artikel 1, lid 2, en in artikel 12, lid 2, beschikken de organisaties voor regionale economische integratie over het aantal stemmen van hun lidstaten die lid zijn van de Economische Commissie voor Europa.

  • 2 De lidstaten van de Verenigde Naties mogen overeenkomstig paragraaf 11 van het mandaat van de commissie aan bepaalde werkzaamheden van de Economische Commissie voor Europa deelnemen en de organisaties voor regionale economische integratie van die landen waaraan hun lidstaten bevoegdheden op onder deze overeenkomst vallende gebieden hebben overgedragen, met inbegrip van de bevoegdheid om besluiten te nemen die bindend zijn voor hun lidstaten, kunnen partij worden bij deze overeenkomst.

    Voor de vaststelling van het aantal stemmen zoals bedoeld in artikel 1, lid 2, en in artikel 12, lid 2, beschikken de organisaties voor regionale economische integratie over het aantal stemmen van hun lidstaten die lid zijn van de Verenigde Naties.

  • 3 Toetreding tot deze overeenkomst door nieuwe overeenkomstsluitende partijen die geen partij zijn bij de Overeenkomst van 1958, geschiedt door neerlegging van een akte bij de secretaris-generaal, na de inwerkingtreding van deze overeenkomst.

Artikel 7

  • 1 Deze overeenkomst wordt geacht in werking te treden negen maanden na de datum van toezending ervan door de secretaris-generaal aan alle partijen bij de Overeenkomst van 1958.

  • 2 Deze overeenkomst wordt geacht niet in werking te treden indien binnen zes maanden na de datum van toezending ervan door de secretaris-generaal de partijen bij de Overeenkomst van 1958 bezwaar maken.

  • 3 Voor elke nieuwe partij die tot deze overeenkomst toetreedt, treedt deze overeenkomst in werking op de zestigste dag na de neerlegging van de akte van toetreding.

Artikel 8

  • 1 Elke overeenkomstsluitende partij kan deze overeenkomst opzeggen door middel van een kennisgeving aan de secretaris-generaal.

  • 2 De opzegging wordt van kracht twaalf maanden na de datum waarop de secretaris-generaal die kennisgeving heeft ontvangen.

  • 3 De typegoedkeuringen die door de overeenkomstsluitende partij zijn verleend, blijven geldig gedurende een periode van twaalf maanden nadat de opzegging van kracht is geworden overeenkomstig lid 2 van dit artikel.

Artikel 9

  • 1 Elke overeenkomstsluitende partij in de zin van artikel 6 van deze overeenkomst kan op het moment van toetreding of op een later tijdstip door middel van een kennisgeving gericht aan de secretaris-generaal verklaren dat deze overeenkomst wordt uitgebreid tot alle of bepaalde grondgebieden waarvan zij de buitenlandse betrekkingen behartigt. De overeenkomst wordt vanaf de zestigste dag na ontvangst van de kennisgeving door de secretaris-generaal uitgebreid tot het grondgebied of de grondgebieden die in de kennisgeving zijn vermeld.

  • 2 Elke overeenkomstsluitende partij in de zin van artikel 6 van deze overeenkomst die overeenkomstig lid 1 van dit artikel een verklaring heeft afgegeven tot uitbreiding van deze overeenkomst tot een grondgebied waarvan zij de buitenlandse betrekkingen behartigt, kan de overeenkomst voor dat grondgebied afzonderlijk opzeggen overeenkomstig artikel 8.

Artikel 10

  • 1 Elk geschil tussen twee of meer overeenkomstsluitende partijen over de interpretatie of toepassing van deze overeenkomst wordt zoveel mogelijk beslecht door onderhandelingen tussen de betrokken partijen.

  • 2 Geschillen die niet via onderhandelingen zijn beslecht, worden onderworpen aan arbitrage als een van de betrokken overeenkomstsluitende partijen erom verzoekt, en worden dienovereenkomstig voorgelegd aan een of meer arbiters die in onderlinge overeenstemming tussen die partijen zijn gekozen. Indien de betrokken partijen binnen drie maanden na de datum van het verzoek om arbitrage geen overeenstemming kunnen bereiken over de keuze van een of meer arbiters, kan een van die partijen de secretaris-generaal verzoeken één arbiter te benoemen aan wie het geschil ter beslechting wordt voorgelegd.

  • 3 De uitspraak van de overeenkomstig lid 2 van dit artikel aangewezen arbiter of arbiters zijn bindend voor de betrokken overeenkomstsluitende partijen.

  • 4 Elk geschil tussen twee of meer overeenkomstsluitende partijen over de interpretatie of toepassing van aan deze overeenkomst gehechte VN-reglementen wordt beslecht door onderhandelingen volgens de procedure in bijlage 6 die aan deze overeenkomst is gehecht.

Artikel 11

  • 1 Een overeenkomstsluitende partij kan op het tijdstip van toetreding tot deze overeenkomst verklaren dat zij zich niet gebonden acht door de leden 1 tot en met 3 van artikel 10 van de overeenkomst. De andere overeenkomstsluitende partijen zijn door de leden 1 tot en met 3 van artikel 10 niet gebonden tegenover een overeenkomstsluitende partij die een zodanig voorbehoud heeft gemaakt.

  • 2 Elke overeenkomstsluitende partij die een voorbehoud heeft gemaakt overeenkomstig lid 1 van dit artikel, kan dit voorbehoud te allen tijde intrekken door middel van een kennisgeving aan de secretaris-generaal.

  • 3 Er zijn geen andere voorbehouden bij deze overeenkomst, het aanhangsel, de bijlagen en de daaraan gehechte VN-reglementen toegestaan, maar elke overeenkomstsluitende partij kan overeenkomstig artikel 1, lid 5, verklaren dat zij niet voornemens is bepaalde VN-reglementen toe te passen of dat zij voornemens is geen enkel VN-reglement toe te passen.

Artikel 12

De aan deze overeenkomst gehechte VN-reglementen kunnen worden gewijzigd volgens deze procedure:

  • 1. Wijzigingen van VN-reglementen worden door het in artikel 1, lid 2, beschreven beheerscomité vastgesteld volgens de procedure in het aanhangsel.

    Nadat een wijziging van het VN-reglement is vastgesteld, wordt zij door het beheerscomité meegedeeld aan de uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties. Vervolgens doet de uitvoerend secretaris zo spoedig mogelijk kennisgeving van deze wijziging aan de overeenkomstsluitende partijen die het VN-reglement toepassen, en aan de secretaris-generaal.

  • 2. Een wijziging van een VN-reglement wordt geacht te zijn aangenomen tenzij binnen zes maanden na de kennisgeving ervan door de uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties, meer dan een vijfde van de overeenkomstsluitende partijen die het VN-reglement toepassen, op het tijdstip van de kennisgeving de secretaris-generaal heeft meegedeeld niet in te stemmen met de wijziging. Wanneer een wijziging van een VN-reglement is aangenomen, verklaart de secretaris-generaal de wijziging zo spoedig mogelijk als aangenomen en bindend voor de overeenkomstsluitende partijen die het VN-reglement toepassen.

  • 3. Wijzigingen van een VN-reglement kunnen overgangsbepalingen bevatten met betrekking tot de inwerkingtreding van het gewijzigde VN-reglement, tot welke datum de overeenkomstsluitende partijen goedkeuringen krachtens de vorige versie van het VN-reglement aanvaarden en de datum met ingang waarvan de overeenkomstsluitende partijen niet verplicht zijn typegoedkeuringen te aanvaarden die krachtens de vorige versie van het gewijzigde VN-reglement zijn verleend.

  • 4. Ook als de overgangsbepalingen in een versie van VN-reglementen anders luiden, kunnen de overeenkomstsluitende partijen die VN-reglementen toepassen, met inachtneming van artikel 2 toch typegoedkeuringen krachtens eerdere versies van VN-reglementen verlenen. Overeenkomstig lid 3 van dit artikel zijn de overeenkomstsluitende partijen die een VN-reglement toepassen, echter niet verplicht typegoedkeuringen te aanvaarden die krachtens die eerdere versies zijn verleend.

  • 5. Alle overeenkomstsluitende partijen die een VN-reglement toepassen, behalve die welke de secretaris-generaal in kennis hebben gesteld van hun voornemen om het VN-reglement niet langer toe te passen, aanvaarden goedkeuringen die krachtens de recentste versie van dat VN-reglement zijn verleend. Een overeenkomstsluitende partij die de secretaris-generaal kennis heeft gegeven van haar voornemen om een VN-reglement niet langer toe te passen, aanvaardt tijdens de in artikel 1, lid 6, bedoelde periode van één jaar goedkeuringen die zijn verleend krachtens de versie(s) van het VN-reglement dat of die voor die overeenkomstsluitende partij op het ogenblik van haar kennisgeving aan de secretaris-generaal van toepassing is of zijn.

  • 6. Een overeenkomstsluitende partij die een VN-reglement toepast, kan vrijstellingsgoedkeuring krachtens een VN-reglement verlenen voor slechts één type voertuig op wielen, uitrustingsstuk of onderdeel dat gebaseerd is op een nieuwe technologie die niet onder het bestaande VN-reglement valt en onverenigbaar is met een of meer voorschriften van dit VN-reglement. In dat geval gelden de procedures van bijlage 7 die aan deze overeenkomst is gehecht.

  • 7. Mocht een nieuwe overeenkomstsluitende partij tot deze overeenkomst toetreden tussen het tijdstip van de kennisgeving van de wijziging van een VN-reglement door de uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties en de inwerkingtreding ervan, treedt het VN-reglement in kwestie voor die overeenkomstsluitende partij in werking, tenzij die partij, binnen zes maanden na de kennisgeving van haar toetreding door de secretaris-generaal, de secretaris-generaal ervan op de hoogte heeft gebracht dat zij niet met de wijziging instemt.

Artikel 13

De tekst van de overeenkomst zelf en van het aanhangsel kan worden gewijzigd volgens deze procedure:

  • 1. Elke overeenkomstsluitende partij kan een of meer wijzigingen van deze overeenkomst en het aanhangsel ervan voorstellen. De tekst van elke voorgestelde wijziging van de overeenkomst en het aanhangsel ervan wordt toegezonden aan de secretaris-generaal, die deze tekst doorzendt aan alle overeenkomstsluitende partijen en ter kennis brengt van alle andere in artikel 6, lid 1, bedoelde landen.

  • 2. Elke voorgestelde wijziging die overeenkomstig lid 1 van dit artikel is toegezonden, wordt geacht te zijn aanvaard als geen van de overeenkomstsluitende partijen bezwaar maakt binnen negen maanden na de datum waarop de secretaris-generaal de voorgestelde wijziging heeft doen toekomen.

  • 3. De secretaris-generaal stelt alle overeenkomstsluitende partijen er zo spoedig mogelijk van in kennis of tegen de voorgestelde wijziging bezwaar is gemaakt. Is dat het geval, wordt de wijziging geacht niet te zijn aanvaard en heeft zij geen enkel effect. Is dat niet het geval, treedt de wijziging voor alle overeenkomstsluitende partijen in werking drie maanden na het verstrijken van de in lid 2 van dit artikel bedoelde termijn van negen maanden.

Artikel 13 bis

  • 1 De aan deze overeenkomst gehechte bijlagen met administratieve en procedurele bepalingen kunnen worden gewijzigd volgens deze procedure:

    • 1.1. Wijzigingen van de bijlagen met administratieve en procedurele bepalingen worden vastgesteld door het in artikel 1, lid 1, bedoelde beheerscomité en volgens de procedure in artikel 7 van het aanhangsel van deze overeenkomst.

    • 1.2. Een wijziging van de bijlagen met administratieve en procedurele bepalingen wordt door het beheerscomité meegedeeld aan de secretaris-generaal. Vervolgens brengt de secretaris-generaal deze wijziging zo spoedig mogelijk ter kennis van de overeenkomstsluitende partijen die een of meer VN-reglementen toepassen.

  • 2 Een wijziging van de bijlagen met administratieve en procedurele bepalingen wordt geacht te zijn aangenomen indien, binnen zes maanden na de kennisgeving door de secretaris-generaal, geen enkele overeenkomstsluitende partij die een of meer VN-reglementen toepast, de secretaris-generaal heeft meegedeeld niet in te stemmen met de wijziging.

  • 3 De secretaris-generaal stelt alle overeenkomstsluitende partijen die een of meer VN-reglementen toepassen, er zo spoedig mogelijk van in kennis of tegen de voorgestelde wijziging bezwaar is gemaakt. Is dat het geval, wordt de wijziging geacht niet te zijn aanvaard en heeft zij geen enkel effect. Is dat niet het geval, treedt de wijziging voor alle overeenkomstsluitende partijen die een of meer VN-reglementen toepassen, in werking drie maanden na het verstrijken van de in lid 2 van dit artikel bedoelde termijn van zes maanden.

  • 4 Een nieuwe bijlage wordt als een wijziging van de bijlagen met administratieve en procedurele bepalingen beschouwd en wordt derhalve volgens dezelfde in dit artikel beschreven procedure vastgesteld.

Artikel 14

  • 1 Volgens de bepalingen van deze overeenkomst stelt de secretaris-generaal de overeenkomstsluitende partijen in kennis van:

    • a. toetredingen overeenkomstig artikel 6;

    • b. de data van inwerkingtreding van deze overeenkomst krachtens artikel 7;

    • c. opzeggingen overeenkomstig artikel 8;

    • d. overeenkomstig artikel 9 ontvangen kennisgevingen;

    • e. overeenkomstig artikel 11, leden 1 en 2, ontvangen verklaringen en kennisgevingen;

    • f. de inwerkingtreding van elk nieuw VN-reglement en van elke wijziging van een bestaand VN-reglement overeenkomstig artikel 1, leden 2, 3, 5 en 7, en artikel 12, lid 2;

    • g. de inwerkingtreding van elke wijziging van de overeenkomst, het aanhangsel ervan of de bijlagen met administratieve en procedurele bepalingen overeenkomstig artikel 13, lid 3, respectievelijk artikel 13 bis, lid 3;

    • h. de stopzetting van de toepassing van VN-reglementen door overeenkomstsluitende partijen krachtens artikel 1, lid 6.

  • 2 Overeenkomstig de bepalingen van deze overeenkomst en de daaraan gehechte bijlagen met administratieve en procedurele bepalingen geeft de uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties:

    • a. de secretaris-generaal en de overeenkomstsluitende partijen kennis van de vaststelling van een wijziging van een VN-reglement overeenkomstig artikel 12, lid 2;

    • b. de overeenkomstsluitende partijen kennis van het besluit van het beheerscomité over een verzoek om vrijstellingsgoedkeuring en van de aanneming ervan overeenkomstig punt 5 van bijlage 7.

Artikel 15

  • 1 Indien op de datum van inwerkingtreding van de bovenstaande bepalingen de in artikel 1, leden 3 en 4, van de vorige versie van de overeenkomst beoogde procedures voor de aanneming van een nieuw VN-reglement aan de gang zijn, treedt dat nieuwe VN-reglement in werking overeenkomstig lid 4 van voornoemd artikel.

  • 2 Indien op de datum van inwerkingtreding van de bovenstaande bepalingen de in artikel 12, lid 1, van de vorige versie van de overeenkomst beoogde procedures voor de aanneming van een wijziging van een VN-reglement aan de gang zijn, treedt die wijziging overeenkomstig voornoemd artikel in werking.

  • 3 Indien alle partijen bij de overeenkomst het erover eens zijn, kan elk krachtens de vorige versie van de overeenkomst aangenomen VN-reglement worden beschouwd als een VN-reglement dat overeenkomstig de bovenstaande bepalingen is aangenomen.

Artikel 16

Deze overeenkomst werd ondertekend te Genève in één exemplaar in de Engelse, de Franse en de Russische taal, waarbij alle teksten gelijkelijk authentiek zijn.

Aanhangsel Samenstelling en reglement van orde van het beheerscomité

Artikel 1

Het beheerscomité wordt samengesteld uit alle partijen bij de gewijzigde overeenkomst.

Artikel 2

De uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties verleent het comité secretariaatsdiensten.

Artikel 3

Het comité kiest elk jaar in zijn eerste zitting een voorzitter en een vicevoorzitter.

Artikel 4

De secretaris-generaal van de Verenigde Naties roept het comité onder de auspiciën van de Economische Commissie voor Europa van de Verenigde Naties bijeen telkens als een nieuw VN-reglement, een wijziging van een VN-reglement, een kennisgeving volgens de procedure voor vrijstellingsgoedkeuring met betrekking tot nieuwe technologieën (toegelicht in bijlage 7) of een wijziging van de bijlagen met administratieve en procedurele bepalingen moet worden vastgesteld.

Artikel 5

Voorgestelde nieuwe VN-reglementen worden in stemming gebracht. Elk land dat partij is bij de overeenkomst, heeft één stem. Voor het nemen van besluiten is een quorum vereist van ten minste de helft van de overeenkomstsluitende partijen. Voor de vaststelling van het quorum beschikken de organisaties voor regionale economische integratie die overeenkomstsluitende partij zijn, over het aantal stemmen van hun lidstaten. De vertegenwoordiger van een organisatie voor regionale economische integratie kan de stemmen uitbrengen van de soevereine staten die daar lid van zijn. Nieuwe VN-ontwerpreglementen worden vastgesteld met een viervijfdemeerderheid van de aanwezige leden die hun stem uitbrengen.

Artikel 6

Voorgestelde wijzigingen van VN-reglementen worden in stemming gebracht. Elk land dat partij is bij de overeenkomst en het VN-reglement toepast, heeft één stem. Voor het nemen van besluiten is een quorum vereist van ten minste de helft van de overeenkomstsluitende partijen die het VN-reglement toepassen. Voor de vaststelling van het quorum beschikken de organisaties voor regionale economische integratie die overeenkomstsluitende partij zijn, over het aantal stemmen van hun lidstaten. De vertegenwoordiger van een organisatie voor regionale economische integratie kan de stemmen uitbrengen van de soevereine staten die daar lid van zijn en het VN-reglement toepassen. Ontwerpwijzigingen van VN-reglementen worden vastgesteld met een viervijfdemeerderheid van de aanwezige leden die hun stem uitbrengen.

Artikel 7

Voorgestelde wijzigingen van de aan deze overeenkomst gehechte bijlagen met administratieve en procedurele bepalingen worden in stemming gebracht. Elke overeenkomstsluitende partij die een of meer VN-reglementen toepast, heeft één stem. Voor het nemen van besluiten is een quorum vereist van ten minste de helft van de overeenkomstsluitende partijen die een of meer VN-reglementen toepassen. Voor de vaststelling van het quorum beschikken de organisaties voor regionale economische integratie die overeenkomstsluitende partij zijn, over het aantal stemmen van hun lidstaten. De vertegenwoordiger van een organisatie voor regionale economische integratie kan de stemmen uitbrengen van de soevereine staten die daar lid van zijn en een of meer VN-reglementen toepassen. Ontwerpwijzigingen van de bijlagen met administratieve en procedurele bepalingen worden vastgesteld met eenparigheid van stemmen van de aanwezige leden die hun stem uitbrengen.

Artikel 8

Het verzoek van een partij om machtiging tot het verlenen van een voorgestelde vrijstellingsgoedkeuring met betrekking tot nieuwe technologieën wordt in stemming gebracht. Elke overeenkomstsluitende partij die het VN-reglement toepast, heeft één stem. Voor het nemen van besluiten is een quorum vereist van ten minste de helft van de overeenkomstsluitende partijen die het VN-reglement toepassen. Voor de vaststelling van het quorum beschikken de organisaties voor regionale economische integratie die overeenkomstsluitende partij zijn, over het aantal stemmen van hun lidstaten. De vertegenwoordiger van een organisatie voor regionale economische integratie kan de stemmen uitbrengen van de soevereine staten die daar lid van zijn en het VN-reglement toepassen. De machtiging tot het verlenen van een vrijstellingsgoedkeuring voor de genoemde overeenkomstsluitende partij wordt vastgesteld met een viervijfdemeerderheid van de aanwezige leden die hun stem uitbrengen.

Bijlage 1. Procedures voor de conformiteit van de productie

Doelstellingen

Doel van de procedures voor de conformiteit van de productie is te garanderen dat elk geproduceerd voertuig op wielen, systeem of onderdeel conform is met het goedgekeurde type.

De procedures omvatten de volgende maatregelen die onlosmakelijk met elkaar verbonden zijn: de beoordeling van de kwaliteitsbeheersystemen, hierna de „eerste beoordeling” genoemd, de verificatie van het goedgekeurde object en productgerelateerde controles, hierna „maatregelen betreffende de productconformiteit” genoemd.

1. Eerste beoordeling

  • 1.1. Alvorens VN-typegoedkeuring te verlenen, gaat de goedkeuringsinstantie van een overeenkomstsluitende partij na of er afdoende maatregelen en procedures voor effectieve controle zijn vastgesteld, zodat de geproduceerde voertuigen op wielen, uitrustingsstukken of onderdelen conform zijn met het goedgekeurde type.

  • 1.2. Aanwijzingen voor het verrichten van beoordelingen zijn te vinden in de internationale norm ISO 19011:2002 – Richtlijnen voor het uitvoeren van kwaliteits- en/of milieumanagementsysteemaudits.

  • 1.3. De goedkeuringsinstantie die VN-typegoedkeuring verleent, controleert of aan het voorschrift van punt 1.1 is voldaan.

    De goedkeuringsinstantie die VN-typegoedkeuring verleent, moet tevreden zijn met de eerste beoordeling en de maatregelen betreffende de productconformiteit van punt 2, waarbij zo nodig rekening wordt gehouden met een van de in de punten 1.3.1 tot en met 1.3.3 beschreven maatregelen of, naargelang het geval, een complete of incomplete combinatie ervan.

    • 1.3.1. De feitelijke eerste beoordeling en/of verificatie van de maatregelen betreffende de productconformiteit wordt uitgevoerd door de goedkeuringsinstantie die VN-typegoedkeuring verleent of door een technische dienst die is aangewezen om namens die goedkeuringsinstantie op te treden.

      • 1.3.1.1. Om de omvang van de uit te voeren eerste beoordeling te bepalen, kan de goedkeuringsinstantie rekening houden met de beschikbare informatie over:

        • a. de in punt 1.3.3 beschreven certificering van de fabrikant, die krachtens dat punt niet als voldoende is beschouwd of niet is erkend;

        • b. bij VN-typegoedkeuring van uitrustingsstukken of onderdelen, de beoordelingen van het kwaliteitsbewakingssysteem die door de voertuigfabrikant(en) zijn uitgevoerd in het bedrijf van de fabrikant(en) van de uitrustingsstukken of onderdelen, overeenkomstig een of meer bedrijfstakspecificaties die voldoen aan de voorschriften van de internationale norm ISO 9001:2008.

    • 1.3.2. De feitelijke eerste beoordeling en/of verificatie van de maatregelen betreffende de productconformiteit kan ook worden uitgevoerd door de goedkeuringsinstantie van een andere overeenkomstsluitende partij of door de technische dienst die daartoe door laatstgenoemde goedkeuringsinstantie is aangewezen, mits deze overeenkomstsluitende partij ten minste dezelfde VN-reglementen toepast als die waarop de VN-typegoedkeuring is gebaseerd.

      • 1.3.2.1. In dat geval stelt de goedkeuringsinstantie van de andere overeenkomstsluitende partij een verklaring van overeenstemming op waarin de gebieden en productiefaciliteiten staan vermeld die van belang worden geacht voor het product (de producten) waarvoor typegoedkeuring moet worden verleend, en voor de VN-reglementen krachtens welke aan deze producten typegoedkeuring moet worden verleend.

      • 1.3.2.2. Na ontvangst van een aanvraag voor een verklaring van overeenstemming van de goedkeuringsinstantie van een overeenkomstsluitende partij die VN-typegoedkeuring verleent, stuurt de goedkeuringsinstantie van de andere overeenkomstsluitende partij onmiddellijk de verklaring van overeenstemming of deelt zij mee dat zij die verklaring niet kan afgeven.

      • 1.3.2.3. De verklaring van overeenstemming omvat ten minste het volgende:

        • a. groep of onderneming (bv. XYZ Automobielen)

        • b. specifieke organisatie (bv. regionale afdeling);

        • c. fabrieken/vestigingsplaatsen (bv. Motorenfabriek 1 (in land A) – voertuigfabriek 2 (in land B));

        • d. voertuig/onderdelenserie (bv. alle modellen van categorie M1);

        • e. beoordeelde afdelingen (bv. motorassemblage, carrosserieperserij en -assemblage, voertuigassemblage);

        • f. onderzochte documenten (bv. kwaliteitshandboek en -procedures van het bedrijf en de locatie);

        • g. datum van de beoordeling (bv. controle uitgevoerd van dd-mm-jjjj tot en met dd-mm-jjjj);

        • h. gepland controlebezoek (bv. mm-jjjj).

    • 1.3.3. De goedkeuringsinstantie kan ook de certificering van de fabrikant krachtens de internationale norm ISO 9001:2008 (waaronder ook de goed te keuren producten moeten vallen) of een equivalente accrediteringsnorm aanvaarden als bewijs dat aan de initiële-beoordelingsvoorschriften van punt 1.1 is voldaan. De fabrikant verschaft gegevens over de certificering en verbindt zich ertoe de goedkeuringsinstantie van elke herziening van de geldigheid of het toepassingsgebied ervan op de hoogte te brengen.

  • 1.4. Voor de internationale typegoedkeuring van gehele voertuigen hoeven de eerste beoordelingen die zijn uitgevoerd om VN-goedkeuringen voor uitrustingsstukken en onderdelen van het voertuig te verlenen, niet te worden herhaald, maar worden deze aangevuld met een beoordeling van de gebieden die niet eerder zijn beoordeeld, met name in verband met de assemblage van het gehele voertuig.

2. Maatregelen betreffende de productconformiteit

  • 2.1. Elk voertuig, uitrustingsstuk of onderdeel dat is goedgekeurd krachtens een VN-reglement dat aan de Overeenkomst van 1958 is gehecht, wordt zo vervaardigd dat het conform is met het goedgekeurde type door te voldoen aan de voorschriften van deze bijlage of van het VN-reglement in kwestie.

  • 2.2. De goedkeuringsinstantie van een overeenkomstsluitende partij die typegoedkeuring verleent krachtens een VN-reglement dat aan de Overeenkomst van 1958 is gehecht, verifieert of er passende afspraken en gedocumenteerde controleplannen bestaan, die bij elke goedkeuring met de fabrikant moeten worden overeengekomen, om op gezette tijden die tests of bijbehorende controles uit te voeren die nodig zijn om na te gaan of er nog steeds conformiteit is met het goedgekeurde type, waartoe in voorkomend geval met name ook de in het desbetreffende VN-reglement vermelde tests behoren.

  • 2.3. De houder van de VN-typegoedkeuring moet met name:

    • 2.3.1. ervoor zorgen dat er procedures voor een doeltreffende controle van de conformiteit van de producten (voertuigen op wielen, uitrustingsstukken of onderdelen) met het goedgekeurde type bestaan en dat deze worden toegepast;

    • 2.3.2. toegang hebben tot de test- of andere geschikte apparatuur die nodig is om de conformiteit met elk goedgekeurd type te controleren;

    • 2.3.3. erop toezien dat de resultaten van de tests en controles worden vastgelegd en dat de bijbehorende documenten gedurende een in overleg met de goedkeuringsinstantie vastgestelde periode beschikbaar blijven. Deze periode duurt ten hoogste tien jaar;

    • 2.3.4. de resultaten van elk soort test of controle analyseren om na te gaan en te garanderen dat de eigenschappen van het product stabiel blijven, daarbij rekening houdend met de variaties van een industriële productie;

    • 2.3.5. ervoor zorgen dat voor elk type product ten minste de in deze bijlage voorgeschreven controles worden verricht, alsook de tests die in de desbetreffende VN-reglementen zijn voorgeschreven;

    • 2.3.6. erop toezien dat, als bij het desbetreffende soort test een stel monsters of testobjecten niet-conform blijkt te zijn, er opnieuw monsters worden genomen en een nieuwe test wordt uitgevoerd. Alle nodige stappen worden ondernomen om de conformiteit van de productie in kwestie te herstellen.

3. Voortgezette controlemaatregelen

  • 3.1. De instantie die VN-typegoedkeuring heeft verleend, kan op elk tijdstip de in elke productie-eenheid toegepaste conformiteitscontrolemethoden verifiëren.

    • 3.1.1. De normale regeling is de continue doeltreffendheid van de procedures van de punten 1 en 2 (eerste beoordeling en maatregelen betreffende de productconformiteit) te verifiëren.

      • 3.1.1.1. Toezicht door de (overeenkomstig punt 1.3.3 bevoegde of erkende) technische diensten wordt als toereikend beschouwd voor wat betreft de naleving van de voorschriften van punt 3.1.1 met betrekking tot de procedures die voor de eerste beoordeling zijn vastgesteld.

      • 3.1.1.2. De normale frequentie van deze (andere dan de in punt 3.1.1.1 bedoelde) verificaties door de goedkeuringsinstantie moet zo zijn dat de relevante, overeenkomstig de punten 1 en 2 uitgevoerde controles worden geëvalueerd met tussenpozen die gebaseerd zijn op een risicobeoordelingsmethode die in overeenstemming is met de internationale norm ISO 31000:2009 – Principes en richtsnoeren voor risicobeheer, en in ieder geval ten minste om de drie jaar. Deze methode moet met name rekening houden met elke non-conformiteit die door overeenkomstsluitende partijen krachtens artikel 4 van de Overeenkomst van 1958 wordt gemeld.

  • 3.2. Bij elke evaluatie moeten de test- en controledossiers en de productiegegevens ter beschikking worden gesteld van de inspecteur. Met name moeten dossiers van de in punt 2.2 voorgeschreven tests of controles worden overgelegd.

  • 3.3. De inspecteur kan willekeurig monsters nemen die in het laboratorium van de fabrikant of in de voorzieningen van de technische dienst moeten worden getest. In dat geval worden er alleen fysieke tests uitgevoerd. Het minimumaantal monsters kan worden bepaald aan de hand van de resultaten van de verificatie door de fabrikant zelf.

  • 3.4. Indien het niveau van de controle onvoldoende lijkt of als het nodig blijkt de geldigheid van de overeenkomstig punt 3.2 uitgevoerde tests te verifiëren, neemt de inspecteur monsters die naar de technische dienst moeten worden gezonden om fysieke tests uit te voeren.

  • 3.5. Indien er tijdens een inspectie of controle onbevredigende resultaten worden gevonden, zorgt de goedkeuringsinstantie ervoor dat alle nodige maatregelen worden getroffen om de conformiteit van de productie zo snel mogelijk te herstellen.

Bijlage 2

Deel 1. Beoordeling, aanwijzing en aanmelding van technische diensten

1. Aanwijzing van technische diensten

  • 1.1. Een technische dienst die door een goedkeuringsinstantie wordt aangewezen, voldoet aan de bepalingen van deze bijlage.

  • 1.2. De technische diensten voeren de voor de goedkeuring noodzakelijke tests of de in VN-reglementen gespecificeerde keuringen zelf uit of zien daarop toe, tenzij alternatieve procedures uitdrukkelijk zijn toegestaan. Zij mogen geen tests of keuringen uitvoeren waarvoor zij niet zijn aangewezen.

    De prestaties van de technische diensten en de kwaliteit van de tests en keuringen die zij uitvoeren, waarborgen dat de producten waarvoor VN-typegoedkeuring wordt aangevraagd, op passende wijze worden gecontroleerd op hun overeenstemming met de voorschriften van de toepasselijke VN-reglementen waarvoor de technische diensten zijn aangewezen.

  • 1.3. De technische diensten worden aangewezen volgens een of meer van de vier volgende activiteitencategorieën, afhankelijk van hun competentiegebied:

    • a. Categorie A: technische diensten die de in VN-reglementen bedoelde tests in hun eigen voorzieningen uitvoeren;

    • b. Categorie B: technische diensten die toezien op de in de VN-reglementen bedoelde tests die in de voorzieningen van de fabrikant of in de voorzieningen van een derde worden uitgevoerd;

    • c. Categorie C: technische diensten die de door de fabrikant toegepaste procedures voor de controle van de conformiteit van de productie geregeld evalueren en verifiëren;

    • d. Categorie D: technische diensten die in het kader van de controle van de conformiteit van de productie tests of keuringen uitvoeren of daarop toezien.

  • 1.4. De technische diensten tonen aan dat zij beschikken over de juiste vaardigheden, specifieke technische kennis en bewezen ervaring op de specifieke gebieden die vallen onder de VN-reglementen waarvoor zij zijn aangewezen.

    Voorts voldoen de technische diensten aan de in deel 2 van deze bijlage vermelde normen die relevant zijn voor de activiteitencategorieën waarvoor zij zijn aangewezen, maar zij hoeven niet volgens die normen te zijn goedgekeurd of geaccrediteerd.

    De technische diensten zorgen ervoor dat ze vrij zijn van elke controle en invloed van belanghebbenden die een nadelige invloed kunnen hebben op de onpartijdigheid en kwaliteit van de tests en keuringen.

    De technische diensten hebben toegang tot de testvoorzieningen en meetinstrumenten die nodig zijn om tests of keuringen uit te voeren of erop toe te zien, zoals bedoeld in de VN-reglementen waarvoor zij zijn aangewezen.

  • 1.5. Een goedkeuringsinstantie kan optreden als technische dienst voor een of meer van de in punt 1.3 bedoelde activiteiten. Wanneer een goedkeuringsinstantie die als technische dienst optreedt, bij de nationale wetgeving van een overeenkomstsluitende partij is aangesteld en door laatstgenoemde wordt gefinancierd, moet worden voldaan aan deze bijlage of aan regels die gelijkwaardig zijn met de punten 1, 2 en 3.4. Hetzelfde geldt voor technische diensten die bij de nationale wetgeving van een overeenkomstsluitende partij zijn aangesteld en onderworpen zijn aan financiële en bestuurlijke controle door de overheid van die overeenkomstsluitende partij. De gelijkwaardige regels moeten hetzelfde prestatieniveau en dezelfde onafhankelijkheid garanderen.

  • 1.6. Ongeacht punt 3.3 kan een fabrikant of een namens hem optredende vertegenwoordiger als technische dienst voor activiteiten van categorie A alleen worden aangewezen met betrekking tot VN-reglementen die in een dergelijke aanwijzing voorzien. In dat geval en ongeacht punt 1.4 moet die technische dienst zijn geaccrediteerd volgens de normen waarnaar in punt 1 van deel 2 van deze bijlage wordt verwezen.

  • 1.7. De in de punten 1.5 en 1.6 bedoelde entiteiten moeten voldoen aan punt 1.

2. Beoordeling van de vaardigheden van de technische diensten

  • 2.1. De in punt 1 bedoelde vaardigheden moeten worden aangetoond door middel van een door een bevoegde instantie7 opgesteld beoordelingsverslag. Dit kan een door een accrediteringsinstantie afgegeven accrediteringscertificaat omvatten.

  • 2.2. De in punt 2.1 bedoelde beoordeling moet worden uitgevoerd volgens deel 3 van deze bijlage.

    Het beoordelingsverslag moet na maximaal drie jaar opnieuw worden bezien.

  • 2.3. Het beoordelingsverslag wordt aan het VN/ECE-secretariaat en op verzoek aan de overeenkomstsluitende partijen verstrekt.

  • 2.4. De goedkeuringsinstantie die optreedt als technische dienst, toont met bewijsstukken aan dat zij aan de voorwaarden voldoet.

    Dit omvat een beoordeling door controleurs die onafhankelijk zijn van de beoordeelde activiteit. Die controleurs kunnen uit dezelfde organisatie komen mits zij onafhankelijk zijn van het personeel dat de beoordeelde activiteit uitoefent.

  • 2.5. Een als technische dienst aangewezen fabrikant of zijn vertegenwoordiger die namens hem optreedt, moet voldoen aan de desbetreffende bepalingen van punt 2.

3. Aanmeldingsprocedures

  • 3.1. De overeenkomstsluitende partijen delen het VN/ECE-secretariaat de naam, het adres, inclusief het elektronische adres, en de activiteitencategorie van elke aangewezen technische dienst mee. Zij delen het VN/ECE-secretariaat ook alle latere wijzigingen daarvan mee.

    In de aanmeldingsakte moet worden vermeld voor welke VN-reglementen de technische diensten zijn aangewezen.

  • 3.2. Een technische dienst kan de in punt 1 beschreven activiteiten voor de VN-typegoedkeuring alleen uitoefenen als hij bij het VN/ECE-secretariaat is aangemeld.

  • 3.3. Dezelfde technische dienst kan door verschillende overeenkomstsluitende partijen worden aangewezen en aangemeld, ongeacht de categorie van activiteiten die hij uitoefent.

  • 3.4. Het VN/ECE-secretariaat publiceert de lijst en contactgegevens van de goedkeuringsinstanties en technische diensten op zijn website.

Deel 2. Normen waaraan de in de punten 1 tot en met 3.4 van deel 1 van deze bijlage bedoelde technische diensten moeten voldoen

1. Activiteiten in verband met tests voor VN-typegoedkeuring die krachtens VN-reglementen moeten worden verricht

  • 1.1. Categorie A (tests verricht in eigen voorzieningen):

    ISO/IEC 17025:2005 betreffende de algemene eisen voor de competentie van beproevings- en kalibratielaboratoria.

    Een technische dienst die voor activiteiten van categorie A is aangewezen, kan de tests krachtens de VN-reglementen waarvoor hij is aangewezen, in de voorzieningen van de fabrikant of diens vertegenwoordiger verrichten of daar toezicht op houden.

  • 1.2. Categorie B (toezicht op tests die in de voorzieningen van de fabrikant of diens vertegenwoordiger worden verricht):

    ISO/IEC 17020:2012 betreffende de algemene criteria voor het functioneren van verschillende soorten instellingen die keuringen uitvoeren.

    Vóór het verrichten van of toezicht houden op tests in de voorzieningen van een fabrikant of diens vertegenwoordiger controleert de technische dienst of de testvoorzieningen en meetinstrumenten voldoen aan de ter zake geldende voorschriften van punt 1.1.

2. Activiteiten in verband met de conformiteit van de productie

  • 2.1. Categorie C (procedure voor de eerste beoordeling en de controles in het kader van het toezicht op het systeem voor kwaliteitszorg van de fabrikant):

    ISO/IEC 17021:2011 betreffende de eisen voor instellingen die audits en certificatie van managementsystemen uitvoeren.

  • 2.2. Categorie D (keuren of testen van productiemonsters of toezicht daarop):

    ISO/IEC 17020:2012 betreffende de algemene criteria voor het functioneren van verschillende soorten instellingen die keuringen uitvoeren.

Deel 3. Procedure voor de beoordeling van technische diensten

1. Doel

  • 1.1. In dit deel van bijlage 2 worden de voorschriften vastgesteld voor de procedure voor de beoordeling van de technische diensten door de in punt 2 van deel 1 van deze bijlage bedoelde bevoegde instantie.

  • 1.2. Deze voorschriften zijn van overeenkomstige toepassing op alle technische diensten, ongeacht hun juridische status (onafhankelijke organisatie, fabrikant of goedkeuringsinstantie die als technische dienst optreedt).

2. Beginselen van de beoordeling

De beoordeling is gebaseerd op een aantal beginselen:

  • a. het beginsel van onafhankelijkheid, dat de basis vormt voor de onpartijdigheid en objectiviteit van de conclusies;

  • b. het beginsel dat de aanpak gebaseerd moet zijn op feiten, wat garant staat voor betrouwbare en reproduceerbare conclusies.

Controleurs geven blijk van betrouwbaarheid en integriteit en eerbiedigen de vertrouwelijkheid en geheimhouding. Zij geven de resultaten en conclusies waarheidsgetrouw en nauwkeurig weer.

3. Controlevaardigheden

  • 3.1. De beoordelingen mogen uitsluitend worden verricht door controleurs met de daartoe vereiste technische en administratieve kennis.

  • 3.2. De controleurs moeten een specifieke opleiding voor beoordelingsactiviteiten hebben gekregen. Bovendien moeten zij beschikken over specifieke kennis van de technische sector waarin de technische dienst zijn activiteiten zal verrichten.

  • 3.3. Onverminderd de punten 3.1 en 3.2 moet de in punt 2.5 van deel 1 van deze bijlage bedoelde beoordeling worden verricht door controleurs die onafhankelijk zijn van de activiteiten waarvoor de beoordeling wordt verricht.

4. Aanvraag tot aanwijzing

  • 4.1. Een daartoe gemachtigde vertegenwoordiger van de aanvragende technische dienst moet bij de bevoegde instantie een formele aanvraag indienen. De aanvraag moet ten minste de volgende elementen bevatten:

    • a. algemene kenmerken van de technische dienst, zoals ondernemingsvorm, naam, adressen, juridische status en personele en technische middelen;

    • b. een gedetailleerde beschrijving, inclusief curriculum vitae van het met de tests belaste personeel en van het leidinggevend personeel, gestaafd door diploma’s of bewijzen van beroepskwalificaties;

    • c. technische diensten die virtuele testmethoden toepassen, moeten in aanvulling hierop hun bekwaamheid tot het werken in een computergesteunde omgeving aantonen;

    • d. algemene informatie over de technische dienst, bijvoorbeeld over zijn activiteiten, de verhouding tot een ruimer ondernemingsverband, indien van toepassing, en de adressen van alle fysieke locaties die onder het toepassingsgebied van de aanwijzing moeten vallen;

    • e. een verklaring van de technische dienst dat aan de voorschriften voor aanwijzing en de andere verplichtingen wordt voldaan, zoals bepaald in de VN-reglementen waarvoor hij is aangewezen;

    • f. een beschrijving van de diensten voor conformiteitsbeoordeling die de technische dienst in het kader van de toepasselijke VN-reglementen verricht, en een lijst van de VN-reglementen waarvoor de technische dienst om aanwijzing verzoekt, met inbegrip van de beperkingen van zijn mogelijkheden, indien van toepassing;

    • g. een exemplaar van het kwaliteitshandboek of van vergelijkbare operationele voorschriften van de technische dienst.

  • 4.2. De bevoegde instantie gaat na of de door de technische dienst verstrekte informatie adequaat is.

  • 4.3. De technische dienst deelt de goedkeuringsinstantie alle wijzigingen van de overeenkomstig punt 4.1 verstrekte informatie mee.

5. Beoordeling van de middelen

De bevoegde instantie gaat na of zij de technische dienst kan beoordelen, rekening houdend met haar eigen beleid, haar competentie en de beschikbaarheid van geschikte controleurs en deskundigen.

6. Uitbesteden van de beoordeling

  • 6.1. De bevoegde instantie kan gedeelten van de beoordeling aan een andere aangewezen instantie uitbesteden of de hulp inroepen van technische deskundigen van andere bevoegde instanties. De onderaannemers en de deskundigen moeten door de aanvragende technische dienst worden aanvaard.

  • 6.2. De bevoegde instantie houdt rekening met accrediteringscertificaten van passende reikwijdte om haar algemene beoordeling van de technische dienst te voltooien.

7. Voorbereiding op de beoordeling

  • 7.1. De bevoegde instantie wijst formeel een beoordelingsteam aan. Zij ziet erop toe dat bij elke opdracht de passende expertise beschikbaar is. Het team als geheel bezit met name de volgende kenmerken:

    • a. het beschikt over de nodige kennis van het specifieke toepassingsgebied waarvoor om aanwijzing wordt verzocht, en

    • b. het heeft voldoende inzicht om een betrouwbare beoordeling te kunnen maken van de competentie van de technische dienst die binnen het toepassingsgebied van zijn aanwijzing werkzaam is.

  • 7.2. De bevoegde instantie geeft een duidelijke omschrijving van de opdracht die aan het beoordelingsteam wordt gegeven. Het beoordelingsteam heeft tot taak de documenten die de aanvragende technische dienst heeft ingediend, te beoordelen en de beoordeling ter plaatse te verrichten.

  • 7.3. De bevoegde instantie maakt met de technische dienst en het aangewezen beoordelingsteam afspraken over de datum en het tijdschema voor de beoordeling. Zij blijft evenwel verantwoordelijk voor het kiezen van een datum die strookt met het plan voor toezicht en herbeoordeling.

  • 7.4. De bevoegde instantie zorgt ervoor dat het beoordelingsteam over de juiste documenten met criteria, de vorige beoordelingsverslagen en de desbetreffende documenten en stukken van de technische dienst beschikt.

8. Beoordeling ter plaatse

Het beoordelingsteam verricht de beoordeling van de technische dienst op de locatie van de technische dienst vanwaar een of meer kernactiviteiten worden verricht, en woont in voorkomend geval activiteiten bij op andere geselecteerde locaties waar de technische dienst werkzaam is.

9. Analyse van de bevindingen en beoordelingsverslag

  • 9.1. Het beoordelingsteam analyseert alle relevante informatie en bewijzen die tijdens de beoordeling van documenten en stukken en tijdens de beoordeling ter plaatse zijn verzameld. Deze analyse moet het team voldoende mogelijkheden bieden om te bepalen in hoeverre de technische dienst competent is en aan de voorwaarden voor aanwijzing voldoet.

  • 9.2. De rapportageprocedures van de bevoegde instantie waarborgen dat aan de hiernavolgende voorschriften wordt voldaan.

    • 9.2.1. Het beoordelingsteam en de technische dienst komen bijeen voordat het team de locatie verlaat. Het beoordelingsteam brengt bij die gelegenheid schriftelijk en/of mondeling verslag uit over zijn bevindingen van de analyse. De technische dienst krijgt de kans om vragen te stellen over de bevindingen, zoals over eventuele gevallen van non-conformiteit, alsook over de gegevens waarop die bevindingen zijn gebaseerd.

    • 9.2.2. Een schriftelijk verslag over het resultaat van de beoordeling wordt onverwijld aan de technische dienst voorgelegd. Dit beoordelingsverslag bevat opmerkingen over competentie en conformiteit, en geeft eventuele gevallen van non-conformiteit aan die moeten worden opgelost om aan alle voorschriften voor aanwijzing te voldoen.

    • 9.2.3. De technische dienst wordt verzocht te reageren op het beoordelingsverslag en de specifieke maatregelen te omschrijven die zijn genomen of binnen een welbepaalde termijn zullen worden genomen om alle aangegeven gevallen van non-conformiteit op te lossen.

  • 9.3. De bevoegde instantie zorgt ervoor dat de reacties van de technische dienst toereikend en doelmatig zijn om de gevallen van non-conformiteit op te lossen. Indien de reacties van de technische dienst ontoereikend worden geacht, wordt er meer informatie gevraagd. Bovendien kan worden verzocht het bewijs te leveren van de daadwerkelijke uitvoering van de genomen maatregelen, of kan een follow-upbeoordeling worden verricht om de daadwerkelijke uitvoering van corrigerende maatregelen te verifiëren.

  • 9.4. Het beoordelingsverslag omvat ten minste de volgende elementen:

    • a. de unieke identificatie van de technische dienst;

    • b. de datum of de data van de beoordeling ter plaatse;

    • c. de naam van de bij de beoordeling betrokken controleur(s) en/of deskundige(n);

    • d. de unieke identificatie van alle beoordeelde locaties;

    • e. het voorgestelde toepassingsgebied voor aanwijzing dat werd beoordeeld;

    • f. een verklaring betreffende de geschiktheid van de interne organisatie en procedures van de technische dienst ter bevestiging van de competentie die hij bezit door aan de eisen voor aanwijzing te voldoen;

    • g. de informatie over het oplossen van alle gevallen van non-conformiteit;

    • h. een aanbeveling om de aanvrager al dan niet aan te wijzen of te bevestigen als technische dienst en, zo ja, het toepassingsgebied van de aanwijzing.

10. Toekennen/bevestigen van een aanwijzing

  • 10.1. De goedkeuringsinstantie neemt zo snel mogelijk een besluit over de toekenning, bevestiging of uitbreiding van een aanwijzing op basis van het verslag (de verslagen) en alle andere relevante informatie.

  • 10.2. De goedkeuringsinstantie geeft een certificaat af aan de technische dienst. Dit certificaat bevat de volgende gegevens:

    • a. de identificatiegegevens en het logo van de goedkeuringsinstantie;

    • b. de unieke identificatiegegevens van de aangewezen technische dienst;

    • c. de werkelijke datum van toekenning van de aanwijzing en de datum waarop de aanwijzing verstrijkt;

    • d. een korte omschrijving van of een verwijzing naar het toepassingsgebied van de aanwijzing (toepasselijke VN-reglementen of gedeelten ervan);

    • e. een verklaring van conformiteit en een verwijzing naar deze bijlage.

11. Herbeoordeling en controle

  • 11.1. Een herbeoordeling is vergelijkbaar met een eerste beoordeling, behalve dat tevens rekening wordt gehouden met de tijdens eerdere beoordelingen opgedane ervaring. Controlebeoordelingen ter plaatse zijn minder uitgebreid dan herbeoordelingen.

  • 11.2. De bevoegde instantie stelt haar plan voor herbeoordeling en controle van elke aangewezen technische dienst zodanig op dat regelmatig representatieve steekproeven van het toepassingsgebied van de aanwijzing worden beoordeeld.

    De tijd tussen beoordelingen ter plaatse in het kader van herbeoordeling of controle, hangt af van de stabiliteit waarvan de technische dienst blijk heeft gegeven.

  • 11.3. Wanneer bij een controle of herbeoordeling gevallen van non-conformiteit worden vastgesteld, stelt de bevoegde instantie strikte termijnen vast voor de uitvoering van corrigerende maatregelen.

  • 11.4. Wanneer de maatregelen ter correctie of verbetering niet binnen de overeengekomen termijn zijn getroffen of ontoereikend worden geacht, neemt de bevoegde instantie passende maatregelen, zoals het verrichten van een bijkomende beoordeling of de schorsing/intrekking van de aanwijzing voor een of meer activiteiten waarvoor de technische dienst is aangewezen.

  • 11.5. Wanneer de bevoegde instantie besluit de aanwijzing van een technische dienst te schorsen of in te trekken, brengt zij die technische dienst daarvan per aangetekend schrijven op de hoogte en deelt zij dat aan het VN/ECE-secretariaat mee. De bevoegde instantie neemt in ieder geval alle nodige maatregelen om de continuïteit te waarborgen van de activiteiten die de technische dienst al heeft aangevat.

12. Registers betreffende aangewezen technische diensten

  • 12.1. De bevoegde instantie houdt registers van technische diensten bij als bewijs dat daadwerkelijk aan de voorschriften voor aanwijzing, onder meer qua competentie, is voldaan.

  • 12.2. De bevoegde instantie beveiligt de registers betreffende de technische diensten om de vertrouwelijkheid te waarborgen.

  • 12.3. De registers betreffende de technische diensten omvatten ten minste de volgende elementen:

    • a. relevante correspondentie;

    • b. stukken en verslagen betreffende beoordelingen;

    • c. kopieën van aanwijzingscertificaten.

Bijlage 3. Procedures voor VN-typegoedkeuringen

1. Aanvraag en uitvoering van een VN-typegoedkeuring

  • 1.1. Een aanvraag om VN-typegoedkeuring wordt door de fabrikant of zijn gemachtigde vertegenwoordiger (hierna de „aanvrager” genoemd) bij de goedkeuringsinstantie van een overeenkomstsluitende partij ingediend.

  • 1.2. Voor een specifiek type voertuig, uitrustingsstuk of onderdeel mag maar één aanvraag worden ingediend in slechts één overeenkomstsluitende partij die de VN-reglementen toepast krachtens welke VN-typegoedkeuring wordt aangevraagd. Voor elk goed te keuren type moet een afzonderlijke aanvraag worden ingediend.

  • 1.3. De aanvraag moet vergezeld gaan van de informatie die is gespecificeerd in de VN-reglementen krachtens welke goedkeuring wordt aangevraagd. Deze informatie bevat een gedetailleerde beschrijving van de kenmerken van het goed te keuren type, met inbegrip van tekeningen, schema’s en zo nodig foto’s.

  • 1.4. In een met redenen omkleed verzoek kan de goedkeuringsinstantie van de aanvrager verlangen dat hij haar de nodige aanvullende informatie verstrekt om te kunnen beslissen welke goedkeuringstests moeten worden verricht of om de uitvoering van die tests te vergemakkelijken.

  • 1.5. De aanvrager stelt de goedkeuringsinstantie zoveel voertuigen op wielen, uitrustingsstukken of onderdelen ter beschikking als nodig is voor de uitvoering van de tests die zijn voorgeschreven volgens de VN-reglementen krachtens welke goedkeuring wordt aangevraagd.

  • 1.6. De naleving van de voorschriften van de VN-reglementen moet worden aangetoond door middel van passende tests uitgevoerd op voertuigen op wielen, uitrustingsstukken en onderdelen die representatief zijn voor het goed te keuren type.

    De goedkeuringsinstantie moet het beginsel van het „slechtste geval” toepassen door de variant of versie van het gespecificeerde type te kiezen die voor de tests het goed te keuren type onder de meest ongunstige voorwaarden zal voorstellen. De genomen besluiten en de motivering ervan moeten in de goedkeuringsdocumenten worden opgenomen.

    Met het akkoord van de goedkeuringsinstantie kan de aanvrager evenwel een voertuig, uitrustingsstuk of onderdeel kiezen dat niet representatief is voor het goed te keuren type, maar dat een aantal van de meest ongunstige kenmerken ten aanzien van het door de VN-reglementen vereiste prestatieniveau bezit („slechtste geval”). Virtuele testmethoden mogen worden toegepast om de besluitvorming over de keuze van het slechtste geval te ondersteunen.

  • 1.7. De goedkeuringstests zullen door of onder toezicht van technische diensten worden verricht. De te volgen testprocedures en de te gebruiken specifieke uitrusting en gereedschappen worden in de VN-reglementen gespecificeerd.

  • 1.8. Als alternatief voor de in de punten 1.6 en 1.7 bedoelde testprocedures mag op verzoek van de aanvrager gebruik worden gemaakt van virtuele tests voor zover de desbetreffende VN-reglementen daarin voorzien en mits de algemene voorwaarden van bijlage 8 die aan de Overeenkomst van 1958 is gehecht, worden vervuld.

  • 1.9. De overeenkomstsluitende partijen verlenen alleen typegoedkeuring als de naleving van de voorschriften voor de conformiteit van de productie van bijlage 1 die aan de Overeenkomst van 1958 is gehecht, is gewaarborgd.

  • 1.10. Wanneer de goedkeuringstests hebben uitgewezen dat het type voldoet aan de technische voorschriften van het VN-reglement, wordt voor dat type goedkeuring verleend, wordt een goedkeuringsnummer toegekend volgens bijlage 4 die aan de Overeenkomst van 1958 is gehecht, en wordt aan elk type een goedkeuringsmerk toegekend overeenkomstig de specifieke bepalingen van het desbetreffende VN-reglement.

  • 1.11. De goedkeuringsinstantie ziet erop toe dat de goedkeuringsdocumenten het volgende bevatten:

    • a. aantekeningen met betrekking tot de keuze van het slechtste geval en de rechtvaardiging voor die keuze. Dit kan informatie omvatten die door de fabrikant is verstrekt;

    • b. aantekeningen met betrekking tot alle significante technische interpretaties die zijn gemaakt, verschillende testmethoden die zijn toegepast of nieuwe technologie die is ingevoerd;

    • c. een testrapport van de technische dienst met de bij metingen en tests geregistreerde waarden zoals voorgeschreven bij het VN-reglement;

    • d. informatiedocumenten van de fabrikant waarin de kenmerken van het goed te keuren type naar behoren worden gespecificeerd;

    • e. een verklaring van naleving van de productieconformiteitsvoorschriften van bijlage 1 die aan de Overeenkomst van 1958 is gehecht, waarin wordt aangegeven welke van de maatregelen zoals bedoeld in punt 1.3 van voornoemde bijlage 1 in aanmerking zijn genomen als basis voor de eerste beoordeling, alsook de datum van de eerste beoordeling en van eventueel toezicht;

    • f. het VN-typegoedkeuringscertificaat.

2. Wijziging van VN-typegoedkeuringen

  • 2.1. De fabrikant die houder is van een VN-typegoedkeuring voor zijn voertuig, uitrustingsstuk of onderdeel, stelt de overeenkomstsluitende partij die de VN-typegoedkeuring heeft verleend, onverwijld in kennis van elke wijziging van de gegevens van het type zoals opgenomen in de in punt 1.3 bedoelde inlichtingenformulier.

  • 2.2. De overeenkomstsluitende partij beslist welke van de twee, in de punten 2.5 en 2.6 vastgelegde procedures tot wijziging van de VN-typegoedkeuring moet worden gevolgd. Zo nodig kan zij in overleg met de fabrikant besluiten dat er misschien een nieuwe VN-typegoedkeuring moet worden verleend.

  • 2.3. Een aanvraag tot wijziging van een VN-typegoedkeuring mag alleen worden ingediend bij de overeenkomstsluitende partij die de oorspronkelijke VN-typegoedkeuring heeft verleend.

  • 2.4. Indien de overeenkomstsluitende partij vindt dat het voor het wijzigen van de VN-typegoedkeuring nodig is keuringen of tests uit te voeren, moet zij de fabrikant daarvan in kennis stellen.

  • 2.5. Wanneer gegevens van het type zoals opgenomen in de informatiedocumenten en testrapporten zijn gewijzigd en de overeenkomstsluitende partij van mening is dat de wijzigingen waarschijnlijk geen noemenswaardig nadelig effect op de milieu- en/of functionele veiligheidsprestaties zullen hebben en dat het type in elk geval nog steeds aan de voorschriften van de desbetreffende VN-reglementen voldoet, wordt de wijziging van de VN-typegoedkeuring een „herziening” genoemd.

    In dat geval geeft de overeenkomstsluitende partij de herziene bladzijden van de informatiedocumenten en testrapporten af, waarbij op elke herziene bladzijde duidelijk de aard van de wijziging en de nieuwe afgiftedatum zijn vermeld. Met een geconsolideerde, bijgewerkte versie van de informatiedocumenten en testrapporten, vergezeld van een gedetailleerde beschrijving van de wijzigingen, wordt geacht aan deze eis te zijn voldaan.

  • 2.6. De wijziging van een VN-typegoedkeuring wordt een „uitbreiding” genoemd als er naast de wijziging van de in de informatiedocumenten opgenomen gegevens:

    • a. aanvullende keuringen of tests zijn vereist, of

    • b. informatie op het mededelingendocument (met uitzondering van de bijlagen) is gewijzigd, of

    • c. goedkeuring krachtens een latere wijzigingenreeks wordt aangevraagd na de inwerkingtreding ervan, die kan worden verleend op voorwaarde dat aan de voorschriften van een latere wijzigingenreeks wordt voldaan.

  • 2.7. De bevestiging of weigering van de wijziging van de VN-typegoedkeuring, met vermelding van de wijzigingen, moet aan de partijen bij de Overeenkomst van 1958 die het VN-reglement toepassen, worden meegedeeld door middel van een mededelingenformulier. Voorts wordt de inhoudsopgave bij de informatiedocumenten en testrapporten die aan het mededelingendocument zijn gehecht, dienovereenkomstig gewijzigd om de datum van de recentste herziening of uitbreiding aan te geven.

  • 2.8. De typegoedkeuringsinstantie die de uitbreiding van de goedkeuring verleent, werkt het goedkeuringsnummer bij met een uitbreidingsnummer dat één hoger is dan het aantal opeenvolgende uitbreidingen dat al volgens de aan de Overeenkomst van 1958 gehechte bijlage 4 is verleend, en geeft een herzien mededelingenformulier af met daarop dat uitbreidingsnummer.

Bijlage 4. Nummering van VN-typegoedkeuringen

  • 1. Vanaf de inwerkingtreding van de Overeenkomst van 1958 kennen de overeenkomstsluitende partijen voor elke nieuwe typegoedkeuring en voor elke uitbreiding van een typegoedkeuring een typegoedkeuringsnummer toe overeenkomstig punt 1.10 van bijlage 3.

  • 2. Vanaf de inwerkingtreding van de Overeenkomst van 1958 en ongeacht het feit dat de bepalingen inzake goedkeuringsmerken in een versie van VN-reglementen misschien anders luiden, brengt de fabrikant op verzoek een goedkeuringsmerk overeenkomstig de bepalingen van de desbetreffende VN-reglementen aan, waarbij hij in dat merk echter de eerste twee cijfers van deel 2 en de cijfers van deel 3 gebruikt van het goedkeuringsnummer dat in deze bijlage is aangegeven als goedkeuringsnummer voor elk voertuig op wielen, uitrustingsstuk of onderdeel waarvoor een nieuwe goedkeuring is verleend of waarvoor een dergelijke goedkeuring is uitgebreid. Deze bepaling is echter niet van toepassing wanneer een VN-reglement voorschrijft om in het goedkeuringsmerk in plaats van een goedkeuringsnummer een goedkeuringscode of identificatiecode te gebruiken. De nullen waarmee deel 3 begint, mogen worden weggelaten.

  • 3. Aan elk goedgekeurd type wordt een goedkeuringsnummer toegekend. Het typegoedkeuringsnummer bestaat uit 4 delen. Elk deel wordt gescheiden door een sterretje (*).

    Deel 1: De hoofdletter E, gevolgd door het nummer van de overeenkomstsluitende partij die de typegoedkeuring heeft verleend.

    Deel 2: Het nummer van het desbetreffende VN-reglement, gevolgd door de letter R, op zijn beurt gevolgd door:

    • a. twee cijfers (eventueel twee nullen of beginnend met een nul) ter aanduiding van de wijzigingenreeks met de technische bepalingen van het bij de goedkeuring toegepaste VN-reglement (00 voor het VN-reglement in zijn oorspronkelijke vorm),

    • b. een schuine streep en twee cijfers (eventueel twee nullen of beginnend met een nul) ter aanduiding van het nummer van het supplement op de bij de goedkeuring toegepaste wijzigingenreeks (00 voor de wijzigingenreeks in haar oorspronkelijke vorm),

    • c. een schuine streep en een of twee tekens ter aanduiding van de uitvoeringsfase, indien van toepassing.

    Deel 3: Een uit vier cijfers bestaand volgnummer (eventueel beginnend met een of meer nullen). De serie begint met 0001.

    Deel 4: Een uit twee cijfers bestaand volgnummer (eventueel twee nullen of beginnend met een nul) om de uitbreiding aan te geven. De serie begint met 00.

    Alle cijfers zijn Arabische cijfers.

  • 4. Dezelfde overeenkomstsluitende partij mag hetzelfde nummer niet aan een andere goedkeuring toekennen.

    Voorbeelden:

    Voorbeeld van de tweede uitbreiding van de vierde typegoedkeuring verleend door Nederland krachtens VN-Reglement nr. 58 in zijn oorspronkelijke versie:

Bijlage 5. Circulatie van goedkeuringsdocumenten

  • 1. Wanneer een goedkeuringsinstantie verplicht is of wordt verzocht een kopie te verstrekken van een goedkeuring en de bijbehorende bijlagen, zendt zij de documenten op papier of in elektronisch formaat per e-mail of door gebruik te maken van de beveiligde internetdatabase die door de Economische Commissie voor Europa van de Verenigde Naties is opgezet.

  • 2. De documenten die in de beveiligde database zijn opgeslagen, omvatten ten minste de in elk VN-reglement gespecificeerde documenten. Het betreft onder meer de documenten waarmee aan de overeenkomstsluitende partijen kennis wordt gegeven van de goedkeuring, de uitbreiding, weigering of intrekking van de goedkeuring of de definitieve stopzetting van de productie van een type voertuigen op wielen, uitrustingsstuk of onderdeel krachtens het VN-reglement.

  • 3. Indien de typegoedkeuringen die van toepassing zijn op voertuigen op wielen, uitrustingsstukken of onderdelen, in de beveiligde internetdatabase worden opgeslagen, mag het bij VN-reglementen voorgeschreven goedkeuringsmerk worden vervangen door een unieke identificatiecode (UI) voorafgegaan door het symbool

    , tenzij in de VN-reglementen anders wordt bepaald. Die unieke identificatiecode wordt automatisch door de database gegenereerd.

  • 4. Alle overeenkomstsluitende partijen die een VN-reglement toepassen, moeten toegang hebben tot de informatie voor dat VN-reglement in de database door gebruik te maken van de unieke identificatiecode die toegang zal bieden tot de relevante informatie over de specifieke goedkeuring(en).

  • 5. De aan de overeenkomst van 1958 gehechte VN-reglementen kunnen de circulatie vergen van typegoedkeuringen in elektronische vorm via de beveiligde internetdatabase om waar nodig de goedkeuringsprocedure efficiënt te laten verlopen, afhankelijk van de toegangsrechten die door de overeenkomstsluitende partijen zijn vastgesteld.

Bijlage 6. Procedures voor het oplossen van interpretatieproblemen in verband met de toepassing van VN-reglementen en het verlenen van goedkeuringen krachtens deze VN-reglementen

1. Interpretatieproblemen voordat VN-typegoedkeuring wordt verleend

Wanneer voor een aanvraag om VN-typegoedkeuring de goedkeuringsinstantie een belangrijke interpretatie over de toepassing van het VN-reglement moet maken of als de aanvrager van de goedkeuring erom verzoekt, moet de goedkeuringsinstantie andere goedkeuringsinstanties actief informeren en om advies vragen alvorens een besluit te nemen.

De betrokken goedkeuringsinstantie stelt de andere goedkeuringsinstanties die het VN-reglement toepassen, in kennis van het probleem en van de voor de interpretatie voorgestelde oplossing, met inbegrip van alle ondersteunende informatie van de fabrikant. Als algemene regel geldt dat dit via elektronische media moet gebeuren. Voor antwoorden van de andere goedkeuringsinstanties wordt een termijn van veertien dagen toegestaan.

  • a. Na rekening te hebben gehouden met de ontvangen opmerkingen, kan de goedkeuringsinstantie dan goedkeuring verlenen overeenkomstig de nieuwe interpretatie.

  • b. Als het niet mogelijk is om aan de hand van de ontvangen opmerkingen een besluit te nemen, vraagt de goedkeuringsinstantie om opheldering volgens de in punt 3 beschreven procedure.

2. Interpretatieproblemen nadat VN-typegoedkeuring is verleend

Wanneer er tussen overeenkomstsluitende partijen interpretatieverschillen bestaan nadat een goedkeuring is verleend, worden de volgende procedures gevolgd.

In eerste instantie trachten de betrokken overeenkomstsluitende partijen het probleem in onderlinge overeenstemming op te lossen. Daarvoor is overleg nodig en moet elke overeenkomstsluitende partij de procedures toetsen die worden toegepast voor het testen en goedkeuren van de voertuigen op wielen, uitrustingsstukken en onderdelen waar het interpretatiegeschil betrekking op heeft. De volgende procedures zullen worden toegepast:

  • a. indien een goedkeuringsinstantie een fout erkent, onderneemt zij een actie overeenkomstig de bepalingen van de Overeenkomst van 1958, en met name van artikel 4;

  • b. wanneer overeenstemming wordt bereikt die een nieuwe of andere interpretatie van de bestaande praktijk (door een van de overeenkomstsluitende partijen) vergt, wordt dit zo spoedig mogelijk meegedeeld aan de andere overeenkomstsluitende partijen die het VN-reglement in kwestie toepassen. De andere partijen hebben dan veertien dagen om commentaar te geven op het besluit, waarna de goedkeuringsinstanties, rekening houdend met de ontvangen opmerkingen, VN-typegoedkeuringen volgens de nieuwe interpretatie kunnen verlenen;

  • c. wanneer geen overeenstemming kan worden bereikt, eisen de betrokken overeenkomstsluitende partijen een nieuwe toetsing volgens de in punt 3 beschreven arbitrageprocedure;

  • d. in ieder geval wordt de kwestie onder de aandacht gebracht van de bevoegde werkgroep die ressorteert onder het Wereldforum voor harmonisatie van de regelgeving voor voertuigen (WP.29). Indien het noodzakelijk wordt geacht, dient de ondergeschikte werkgroep bij WP.29 voorstellen voor passende wijzigingen van de regelgeving in om de interpretatieverschillen op te lossen.

3. Arbitrageprocedure via WP.29 en haar ondergeschikte werkgroepen

De voorzitters van de ondergeschikte werkgroepen identificeren de problemen die voortvloeien uit uiteenlopende interpretaties tussen overeenkomstsluitende partijen in verband met de toepassing van VN-reglementen en het verlenen van VN-typegoedkeuringen krachtens die VN-reglementen, teneinde maatregelen te nemen om daar zo spoedig mogelijk een oplossing voor te vinden.

De voorzitters van de werkgroepen ontwikkelen geschikte procedures om dergelijke interpretatieproblemen op te lossen, om WP.29 te kunnen aantonen dat:

  • a. terdege rekening wordt gehouden met de verschillende standpunten van de goedkeuringsinstanties van de betrokken overeenkomstsluitende partijen, alsook met die van de andere overeenkomstsluitende partijen die het VN-reglement toepassen;

  • b. de besluiten op passend technisch advies zijn gebaseerd, met volledige inachtneming van het betrokken gebied;

  • c. voor zover mogelijk een besluit met eenparigheid van stemmen wordt genomen, en

  • d. de procedures transparant en controleerbaar zijn.

Indien dit nodig is om het probleem op te lossen, kan de voorzitter daarover een nieuw punt op de agenda van de eerstvolgende zitting van de ondergeschikte werkgroep plaatsen, zonder voorafgaande goedkeuring van WP.29. Onder deze omstandigheden brengt de voorzitter WP.29 bij de eerste gelegenheid verslag uit over de voortgang.

Aan het einde van de arbitrageprocedure legt de voorzitter WP.29 een verslag over.

  • 3.1. Indien het probleem binnen het huidige regelgevingskader kan worden opgelost:

    wordt de in de werkgroep overeengekomen interpretatie van het VN-reglement uitgevoerd en verlenen de goedkeuringsinstanties dienovereenkomstig VN-typegoedkeuringen.

  • 3.2. Indien het probleem binnen het huidige regelgevingskader niet kan worden opgelost:

    wordt WP.29 daarvan in kennis gesteld en verzoekt WP.29 de desbetreffende ondergeschikte werkgroep deze kwestie in haar volgende zitting prioritair te behandelen. De agenda van de zitting wordt dienovereenkomstig gewijzigd.

    De ondergeschikte werkgroep onderzoekt elk voorstel betreffende de interpretatiekwestie en dient bij WP.29 formele voorstellen in om het desbetreffende VN-reglement volgens de gebruikelijke procedures te wijzigen. WP.29 behandelt de kwestie in haar volgende zitting prioritair.

Bijlage 7. Procedure voor vrijstellingsgoedkeuring met betrekking tot nieuwe technologieën

  • 1. De overeenkomstsluitende partijen die een VN-reglement toepassen, kunnen op verzoek van de fabrikant vrijstellingsgoedkeuring krachtens een VN-reglement verlenen voor een voertuig, uitrustingsstuk of onderdeel waarin technologieën zijn toegepast die onverenigbaar zijn met een of meer voorschriften van dat VN-reglement, mits het beheerscomité van de Overeenkomst van 1958 daar volgens de in de punten 2 tot en met 12 beschreven procedure toestemming voor verleent.

  • 2. In afwachting van het besluit over het al dan niet verlenen van toestemming voor een dergelijke vrijstellingsgoedkeuring kan de overeenkomstsluitende partij die het VN-reglement toepast, alleen voor haar grondgebied voorlopige goedkeuring verlenen. De andere overeenkomstsluitende partijen die dat reglement toepassen, kunnen beslissen deze voorlopige goedkeuring op hun grondgebied te aanvaarden.

  • 3. De overeenkomstsluitende partij die de in punt 2 bedoelde voorlopige goedkeuring verleent, stelt het beheerscomité van haar besluit in kennis en dient een dossier in met de volgende elementen:

    • a. de redenen waarom de desbetreffende technologieën of concepten tot gevolg hebben dat het voertuig, uitrustingsstuk of onderdeel onverenigbaar is met de voorschriften van het VN-reglement;

    • b. een beschrijving van de veiligheids-, milieu- en andere overwegingen en van de genomen maatregelen;

    • c. een beschrijving van de tests en de resultaten ervan, waaruit blijkt dat in vergelijking met de voorschriften waarvan vrijstelling wordt aangevraagd, ten minste een even hoog veiligheids- en milieubeschermingsniveau wordt gewaarborgd;

    • d. een verzoek om toestemming tot het verlenen van een vrijstellingsgoedkeuring krachtens het VN-reglement voor het type voertuig, uitrustingsstuk of onderdeel.

  • 4. Het beheerscomité onderzoekt de volledige kennisgeving zoals bedoeld in punt 3 in zijn eerstvolgende zitting na ontvangst van de kennisgeving, mits deze kennisgeving uiterlijk drie maanden vóór de zitting is ontvangen. Na onderzoek van de kennisgeving kan het beheerscomité besluiten het verlenen van de vrijstellingsgoedkeuring toe te staan of te weigeren, dan wel de zaak naar de bevoegde ondergeschikte werkgroep door te verwijzen.

  • 5. Het besluit van het beheerscomité wordt genomen volgens de procedure van artikel 8 in het aanhangsel.

  • 6. De gevraagde vrijstellingsgoedkeuring krachtens een VN-reglement zoals bedoeld in punt 3, wordt geacht te zijn toegestaan tenzij binnen één maand na de kennisgeving door de uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties, van het toestemmingsbesluit van het beheerscomité meer dan een vijfde van de overeenkomstsluitende partijen die het VN-reglement toepassen, op het tijdstip van de kennisgeving de uitvoerend secretaris heeft meegedeeld niet met de toestemming tot vrijstellingsgoedkeuring in te stemmen.

  • 7. Wanneer de toestemming tot het verlenen van de vrijstellingsgoedkeuring is aangenomen, stelt de uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties de overeenkomstsluitende partijen die het desbetreffende VN-reglement toepassen, daar zo spoedig mogelijk van in kennis.

    Vanaf de datum van die kennisgeving mag de in punt 3 bedoelde overeenkomstsluitende partij de vrijstellingsgoedkeuring krachtens het VN-reglement verlenen. De vrijstellingsgoedkeuring wordt door de overeenkomstsluitende partijen die het VN-reglement toepassen, aanvaard met uitzondering van die partijen die de uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties kennis hebben gegeven van hun niet-instemming of van hun voornemen om de vrijstellingsgoedkeuring niet meteen te aanvaarden. Laatstgenoemde partijen mogen met de toestemming van het beheerscomité de vrijstellingsgoedkeuring op een latere datum aanvaarden door de uitvoerend secretaris van de Economische Commissie voor Europa van de Verenigde Naties daarvan in kennis te stellen.

  • 8. Het beheerscomité vermeldt alle eventuele beperkingen in het toestemmingsbesluit. De termijn mag niet minder dan zesendertig maanden bedragen. De overeenkomstsluitende partijen die het VN-reglement toepassen, aanvaarden de vrijstellingsgoedkeuring ten minste tot het verstrijken van de termijn, indien van toepassing, of, wanneer het VN-reglement in kwestie later overeenkomstig de punten 9 en 10 wordt gewijzigd om rekening te houden met de technologie waarop de vrijstellingsgoedkeuring betrekking heeft, tot de datum vanaf welke de overeenkomstsluitende partijen goedkeuringen krachtens de vorige versie van het VN-reglement kunnen weigeren, al naargelang welke van beide data eerst valt.

    De overeenkomstsluitende partij die toestemming heeft gekregen om de vrijstellingsgoedkeuring te verlenen, zorgt ervoor dat de fabrikant volledig voldoet aan alle beperkingen die aan deze goedkeuring verbonden zijn, en dat op het mededelingenformulier duidelijk wordt aangegeven dat het gebaseerd is op een vrijstelling die door het beheerscomité is toegestaan.

  • 9. Tegelijkertijd stelt het beheerscomité de ondergeschikte werkgroep die verantwoordelijk is voor het VN-reglement, op de hoogte van de toestemming om de vrijstellingsgoedkeuring te verlenen.

    De overeenkomstsluitende partij die toestemming heeft gekregen om de vrijstellingsgoedkeuring te verlenen, dient bij de ondergeschikte werkgroep die verantwoordelijk is voor het VN-reglement, een voorstel in tot wijziging van het VN-reglement waarvoor de vrijstellingsgoedkeuring werd aangevraagd, teneinde het aan de technologische ontwikkeling aan te passen. Dit voorstel wordt uiterlijk ingediend op de eerstvolgende zitting van de ondergeschikte werkgroep na de kennisgeving van het toestemmingsbesluit door het beheerscomité overeenkomstig punt 6.

  • 10. Zodra het VN-reglement is gewijzigd om rekening te houden met de technologie waarvoor de vrijstellingsgoedkeuring werd verleend en het in werking is getreden, wordt de fabrikant toegestaan typegoedkeuring krachtens het gewijzigde VN-reglement aan te vragen ter vervanging van de eerder verleende vrijstellingsgoedkeuring krachtens dat VN-reglement. De goedkeuringsinstantie die die typegoedkeuring verleent, trekt de vrijstellingsgoedkeuring zo spoedig als redelijkerwijs mogelijk is in of stelt de goedkeuringsinstantie die de vrijstellingsgoedkeuring had verleend, ervan op de hoogte dat die vrijstellingsgoedkeuring moet worden ingetrokken.

  • 11. Indien de procedure om het VN-reglement te wijzigen niet vóór het verstrijken van de in punt 8 vastgestelde termijn is voltooid, kan op verzoek van de overeenkomstsluitende partij die de vrijstellingsgoedkeuring heeft verleend, de geldigheid van die vrijstellingsgoedkeuring bij een volgens de in de punten 2 en 3 beschreven procedure genomen besluit worden verlengd. Indien de overeenkomstsluitende partij die toestemming heeft gekregen om de vrijstellingsgoedkeuring te verlenen, vóór het verstrijken van de in punt 9 vermelde termijn echter geen voorstel tot wijziging van het VN-reglement heeft ingediend, trekt die overeenkomstsluitende partij die vrijstellingsgoedkeuring meteen in, rekening houdend met de termijn die in punt 8 is vastgesteld. De overeenkomstsluitende partij die de vrijstellingsgoedkeuring heeft ingetrokken, stelt het beheerscomité daar op haar eerstvolgende zitting van in kennis.

  • 12. Indien het beheerscomité besluit een toestemming tot het verlenen van een vrijstellingsgoedkeuring te weigeren, kan de overeenkomstsluitende partij die de in punt 2 bedoelde voorlopige goedkeuring heeft verleend, die voorlopige goedkeuring intrekken. In dat geval stelt die overeenkomstsluitende partij er de houder van de voorlopige goedkeuring onverwijld van in kennis dat die overeenkomstig punt 2 verleende voorlopige goedkeuring zes maanden na de datum van het besluit zal worden ingetrokken, gelet op het feit dat de voorlopige goedkeuring geldig moet zijn gedurende ten minste twaalf maanden vanaf de datum waarop zij is verleend.

Bijlage 8. Algemene voorwaarden voor virtuele testmethoden

1. Patroon van de virtuele test

Als basisstructuur voor de beschrijving en uitvoering van virtuele tests moet het volgende schema worden gebruikt:

  • a. doel;

  • b. structuurmodel;

  • c. randvoorwaarden;

  • d. belastingsparameters;

  • e. berekening;

  • f. beoordeling;

  • g. documentatie.

2. Basisbeginselen voor computersimulatie en -berekening

  • 2.1. Wiskundig model

    Het wiskundige model wordt door de fabrikant ter beschikking gesteld. Het moet een weerspiegeling zijn van de complexiteit van de constructie van de te testen voertuigen op wielen, uitrustingsstukken en onderdelen overeenkomstig de voorschriften van de desbetreffende VN-reglementen en de randvoorwaarden ervan.

    Dezelfde bepalingen zijn van overeenkomstige toepassing op het onafhankelijk van het voertuig testen van onderdelen.

  • 2.2. Validering van het wiskundige model

    Het wiskundige model wordt ten opzichte van de werkelijke testomstandigheden gevalideerd.

    Daartoe worden in voorkomend geval fysieke tests uitgevoerd om de resultaten bij gebruik van het wiskundige model met de resultaten van een fysieke test te kunnen vergelijken. Er moet worden aangetoond dat de testresultaten vergelijkbaar zijn. De fabrikant of de technische dienst stelt een valideringsrapport op en dient het in bij de goedkeuringsinstantie.

    Elke wijziging van het wiskundige model of de software die afbreuk kan doen aan de geldigheid van het valideringsrapport, wordt gemeld aan de goedkeuringsinstantie, die een nieuwe validering kan doen uitvoeren.

  • 2.3. Documentatie

    De voor de simulatie en berekening gebruikte gegevens en hulpmiddelen worden door de fabrikant ter beschikking gesteld en tot tevredenheid van de technische dienst gedocumenteerd.

3. Hulpmiddelen en ondersteuning

Op verzoek van de goedkeuringsinstantie of de technische dienst moet de fabrikant de nodige hulpmiddelen, waaronder ook geschikte software, verstrekken of toegankelijk maken.

Ook verleent de fabrikant de goedkeuringsinstantie of de technische dienst de nodige ondersteuning.

Het verlenen van toegang en ondersteuning aan een technische dienst ontslaat deze dienst niet van enige verplichting met betrekking tot de vaardigheden van zijn personeel, de betaling van licentierechten en de vertrouwelijkheid.
