European Convention on Cinematographic Co-production

Preamble

The Member States of the Council of Europe and the other States party to the European Cultural Convention, signatory hereto,

Considering that the aim of the Council of Europe is to achieve a greater unity between its members in order, in particular, to safeguard and promote the ideals and principles which form their common heritage;

Considering that freedom of creation and freedom of expression constitute fundamental elements of these principles;

Considering that the defence of cultural diversity of the various European countries is one of the aims of the European Cultural Convention;

Considering that cinematographic co-production, an instrument of creation and expression of cultural diversity on a European scale, should be reinforced;

Determined to develop these principles and recalling the recommandations of the Committee of Ministers on the cinema and the audiovisual field, and particularly Recommendation No. R(86) 3 on the promotion of audiovisual production in Europe;

Acknowledging that the creation of the European Fund for the Support of Co-production and Distribution of Creative Cinematographic and Audiovisual Works, Eurimages, meets the concern of encouraging European cinematographic co-production and that a new driving force has thus been given to the development of cinematographic co-productions in Europe;

Resolved to achieve this cultural objective thanks to a common effort to increase production and define the rules which adapt themselves to European multilateral cinematographic co-productions as a whole;

Considering that the adoption of common rules tends to decrease restrictions and encourage European co-operation in the field of cinematographic co-production,

Have agreed as follows:

    In the case of multilateral co-productions, the provisions of this Convention shall override those of bilateral agreements between Parties to the Convention. The provisions concerning bilateral co-productions shall remain in force if they do not contravene the provisions of this Convention.

Europees Verdrag inzake cinematografische coproduktie

Preambule

Overwegende dat het doel van de Raad van Europa is het tot stand brengen van een grotere eenheid tussen zijn leden, ten einde met name de idealen en beginselen die hun gemeenschappelijk erfgoed zijn te beschermen en te verwezenlijken;

Overwegende dat de vrijheid van vormgeving en de vrijheid van expressie fundamentele elementen van deze beginselen vormen;

Overwegende dat de verdediging van de culturele verscheidenheid van de verschillende Europese landen één van de doelstellingen van het Europees Cultureel Verdrag is;

Overwegende dat de cinematografische coproduktie, als middel tot vormgeving en expressie van de culturele verscheidenheid op Europese schaal, dient te worden versterkt;

Ernaar strevend deze beginselen te ontwikkelen en herinnerend aan de aanbevelingen van het Comité van Ministers op het gebied van cinematografische en audiovisuele werken, en met name Aanbeveling n° R (86) 3 inzake de bevordering van de produktie van audiovisuele werken in Europa;

Erkennend dat de oprichting van het Europees fonds voor de ondersteuning van coproduktie en distributie van oorspronkelijke cinematografische en audiovisuele werken, Eurimages, aansluit bij het streven de Europese cinematografische coproduktie aan te moedigen en dat aldus een nieuwe impuls is gegeven aan de ontwikkeling van cinematografische coproduktie van werken in Europa;

Vastbesloten deze culturele doelstelling te verwezenlijken dankzij een gemeenschappelijke inspanning om de produktie te verhogen en regels op te stellen die aansluiten op alle Europese multilaterale cinematografische coprodukties;

HOOFDSTUK I. ALGEMENE BEPALINGEN

Artikel 1.

  • a. „cinematografisch werk”: een werk, ongeacht lengte of medium, in het bijzonder fictie-films, animatiefilms en documentaires, die voldoen aan de bepalingen die van kracht zijn voor de betreffende filmindustrie in elk der betrokken Partijen en die zijn bestemd voor bioscoopvertoning;

  • b. „coproducenten”: filmproduktie-ondernemingen of producenten die zijn gevestigd in de Partijen bij dit Verdrag en die zijn gebonden door een coproduktiecontract;

  • c. „Europees cinematografisch werk”: een cinematografisch werk dat voldoet aan de voorwaarden gesteld in Bijlage II, die een integrerend deel van dit Verdrag vormt;

    • a. één of meer minderheidsdeelnemingen omvatten, die slechts van financiële aard kunnen zijn, in overeenstemming met het coproduktiecontract, mits ieder nationaal aandeel niet minder bedraagt dan 10% en niet meer dan 25% van de produktiekosten;

    • b. een meerderheidscoproducent omvatten die een wezenlijke technische en artistieke inbreng levert en voldoet aan de voorwaarden om zijn werk in zijn eigen land als nationale film te doen aanmerken;

    • c. bijdragen aan het bevorderen van een Europese identiteit; en

    • d. onderwerp zijn van coproduktiecontracten waarin bepalingen zijn opgenomen inzake de verdeling van opbrengsten.

  • a. wordt het in principe toegevoegd aan de quota van het land dat de grootste inbreng levert;

  • b. in het geval van een cinematografisch werk waarbij door verschillende landen een gelijke inbreng is geleverd, wordt het toegevoegd aan de quota van het land dat de beste mogelijkheden heeft voor uitvoer naar het invoerende land;
